		<section commented="no" id="H7AB99A5DE92A480DAC8E61DB12DCD07A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Asylum Reform and Border Protection Act of 2014</short-title></quote>.</text>
		</section><section id="H0419BD42E9CF47B19879D9EEB4A28047"><enum>2.</enum><header>Safe removal of minors</header>
			<subsection id="H5FB4DF5D200845BBB1D6AD3AF0257BAA"><enum>(a)</enum><header>Country agreements</header><text display-inline="yes-display-inline">Section 235(a)(2) of the William Wilberforce Trafficking Victims Protection Reauthorization Act of
			 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232(a)(2)</external-xref>) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HBB5F6763696D432587A2D389777AAB00" style="OLC">
					<paragraph id="HE733248537504EB38BF29586AA83AB75"><enum>(2)</enum><header>Country agreements</header><text display-inline="yes-display-inline">The Secretary of State shall negotiate agreements between the United States and other countries
			 with respect to the repatriation of children. Such agreements shall be
			 designed to protect children from severe forms of trafficking in persons,
			 and shall, at a minimum, provide that—</text>
						<subparagraph id="HAA60AF4DB27B4AF69B27BC6A2ED86D10"><enum>(A)</enum><text>no child shall be returned to the child's country of nationality or of last habitual residence
			 unless returned to appropriate employees or officials, including child
			 welfare officials where available, of the accepting country's government;</text>
						</subparagraph><subparagraph id="HCE4A4379EDFE4AFB93C7A4F3018E7BDF"><enum>(B)</enum><text>no child shall be returned to the child's country of nationality or of last habitual residence
			 outside of reasonable business hours; and</text>
						</subparagraph><subparagraph id="HCF0E18755E4540AD81D8F91298FC47D7"><enum>(C)</enum><text>border personnel of the countries that are parties to such agreements are trained in the terms of
			 such agreements.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H413EFD742CCB495596BD4B0856467E0E"><enum>(b)</enum><header>Repeals</header><text display-inline="yes-display-inline">Section 235(a) of the William Wilberforce Trafficking Victims Protection Reauthorization Act of
			 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232(a)</external-xref>) is amended—</text>
				<paragraph id="HA4217DE484BD48C58345E6AEC8386EDE"><enum>(1)</enum><text>by striking paragraphs (3) and (4);</text>
				</paragraph><paragraph id="H48D29E1117DF4C1BA08F016AF67619C5"><enum>(2)</enum><text>by striking paragraph (5)(D); and</text>
				</paragraph><paragraph id="H116467B2181A4167A15608443DA3E558"><enum>(3)</enum><text>by redesignating paragraph (5) as paragraph (3).</text>
				</paragraph></subsection><subsection id="H37466D760DFB4C349725AA16E61593AE"><enum>(c)</enum><header>Screening of applicants for admission</header><text>Section 235(b)(1)(A)(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225(b)(1)(A)(i)</external-xref>) is
			 amended by striking <quote>(other than an alien described in subparagraph (F))</quote> and inserting <quote>(including a child, whether or not the child is an unaccompanied alien child (as defined in section
			 462(g)(2) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/279">6 U.S.C. 279(g)</external-xref>)), but not
			 including an alien described in subparagraph (F))</quote>.</text>
			</subsection></section><section id="HD34FA8019938441CA66C04AF8C0E06ED"><enum>3.</enum><header>Clarification of intent regarding taxpayer-provided counsel</header><text display-inline="no-display-inline">Section 292 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1362">8 U.S.C. 1362</external-xref>) is amended—</text>
			<paragraph id="H349EE26D438E44FDAE2D1DB03F72773E"><enum>(1)</enum><text>by striking <quote>(at no expense to the Government)</quote>; and</text>
			</paragraph><paragraph id="HD227CA98941E4FD295693AB60D28B087"><enum>(2)</enum><text>by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H4D58BED350D7406EA0914D3DF9039DEE" style="OLC">
					<quoted-block-continuation-text quoted-block-continuation-text-level="section">Notwithstanding any other provision of law, in no instance shall the Government bear any expense
			 for counsel for any person in removal proceedings or in any appeal
			 proceedings before the Attorney General from any such removal proceedings.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H2904F31B65524B7F8FB5D842A1E4A0BB"><enum>4.</enum><header>Special immigrant juvenile visas</header><text display-inline="no-display-inline">Section 101(a)(27)(J)(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(27)(J)(i)</external-xref>) is
			 amended by striking <quote>and whose reunification with 1 or both of the immigrant's parents is not viable due</quote> and inserting <quote>and who cannot be reunified with either of the immigrant’s parents due</quote>.</text>
		</section><section id="H2807645D8A2745C19500C92EFF2D7BB0"><enum>5.</enum><header>Credible fear interviews</header><text display-inline="no-display-inline">Section 235(b)(1)(B)(v) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225(b)(1)(B)(v)</external-xref>) is
			 amended by striking <quote>208.</quote> and inserting <quote>208, and it is more probable than not that the statements made by the alien in support of the
			 alien’s claim are true.</quote>.</text>
		</section><section id="HCFD82B6F40144FFFBC449B00260861A0"><enum>6.</enum><header>Recording expedited removal and credible fear interviews</header>
			<subsection id="H44DC6D389CD94D03A01EB205F770CBC8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall establish quality assurance procedures and take steps to
			 effectively ensure that questions by employees of the Department of
			 Homeland Security exercising expedited removal authority under section
			 235(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225(b)</external-xref>) are asked
			 in a uniform manner, and that both these questions and the answers
			 provided in response to them are recorded in a uniform fashion.</text>
			</subsection><subsection id="HD59EDF1CF5664048A46377BBEDC8BD5F"><enum>(b)</enum><header>Factors relating to sworn statements</header><text>Where practicable, any sworn or signed written statement taken of an alien as part of the record of
			 a proceeding under section 235(b)(1)(A) of the Immigration and Nationality
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225(b)(1)(A)</external-xref>) shall be accompanied by a recording of the
			 interview which served as the basis for that sworn statement.</text>
			</subsection><subsection id="H060B1E0F9C5C4995A82E7789F2701E5D"><enum>(c)</enum><header>Interpreters</header><text>The Secretary shall ensure that a competent interpreter, not affiliated with the government of the
			 country from which the alien may claim asylum, is used when the
			 interviewing officer does not speak a language understood by the alien and
			 there is no other Federal, State, or local government employee available
			 who is able to interpret effectively, accurately, and impartially.</text>
			</subsection><subsection id="H8003E78E509C41F9BD2945CE953CB9A4"><enum>(d)</enum><header>Recordings in immigration proceedings</header><text>Recordings of interviews of aliens subject to expedited removal shall be included in the record of
			 proceeding and shall be considered as evidence in any further proceedings
			 involving the alien.</text>
			</subsection><subsection id="H1224D63F9B0A456B84AE479134B7B99A"><enum>(e)</enum><header>No private right of action</header><text>Nothing in this section shall be construed to create any right, benefit, trust, or responsibility,
			 whether substantive or procedural, enforceable in law or equity by a party
			 against the United States, its departments, agencies, instrumentalities,
			 entities, officers, employees, or agents, or any person, nor does this
			 section create any right of review in any administrative, judicial, or
			 other proceeding.</text>
			</subsection></section><section display-inline="no-display-inline" id="H38185A67F4B14634B00F6262B167E169" section-type="subsequent-section"><enum>7.</enum><header>Parole reform</header>
			<subsection id="H41963033F2DD47E39419128023223979"><enum>(a)</enum><header>In general</header><text>Paragraph (5) of section 212(d) (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)</external-xref>) is amended to read as follows:</text>
				<quoted-block id="H17A117518CE94CE1A50A236DA82DC34E" style="OLC">
					<paragraph id="HB33CAE978D6048EB9E8202305709AC19"><enum>(5)</enum><header>Humanitarian and public interest parole</header>
						<subparagraph id="H7036E4A70A2D411E9068394077D3D7FB"><enum>(A)</enum><header>In general</header><text>Subject to the provisions of this paragraph and section 214(f)(2), the Secretary of Homeland
			 Security, in the sole discretion of the Secretary of Homeland Security,
			 may on a case-by-case basis parole an alien into the United States
			 temporarily, under such conditions as the Secretary of Homeland Security
			 may prescribe, only—</text>
							<clause id="H81A9C77F8BF141588DA897D025B499E1"><enum>(i)</enum><text>for an urgent humanitarian reason (as described under subparagraph (B)); or</text>
							</clause><clause id="HF25BF185F49A4AADA68CBBC55F8A0093"><enum>(ii)</enum><text>for a reason deemed strictly in the public interest (as described under subparagraph (C)).</text>
							</clause></subparagraph><subparagraph id="H59CD960C434F453397BE3DE96A7843C6"><enum>(B)</enum><header>Humanitarian parole</header><text>The Secretary of Homeland Security may parole an alien based on an urgent humanitarian reason
			 described in this subparagraph only if—</text>
							<clause id="H977269E565764AA99168D617DB41768D"><enum>(i)</enum><text>the alien has a medical emergency and the alien cannot obtain necessary treatment in the foreign
			 state in which the alien is residing or the medical emergency is
			 life-threatening and there is insufficient time for the alien to be
			 admitted through the normal visa process;</text>
							</clause><clause id="H9D24067023BD4C7082415B6DD9E5C55E"><enum>(ii)</enum><text>the alien is needed in the United States in order to donate an organ or other tissue for transplant
			 into a close family member; or</text>
							</clause><clause id="H2225AA264C124E78934BCFFE1B05EAFD"><enum>(iii)</enum><text>the alien has a close family member in the United States whose death is imminent and the alien
			 could not arrive in the United States in time to see such family member
			 alive if the alien were to be admitted through the normal visa process.</text>
							</clause></subparagraph><subparagraph id="H900DAF2C31A6429FAC89AC4B33AF8B6F"><enum>(C)</enum><header>Public interest parole</header><text>The Secretary of Homeland Security may parole an alien based on a reason deemed strictly in the
			 public interest described in this subparagraph only if the alien has
			 assisted the United States Government in a matter, such as a criminal
			 investigation, espionage, or other similar law enforcement activity, and
			 either the alien’s presence in the United States is required by the
			 Government or the alien’s life would be threatened if the alien were not
			 permitted to come to the United States.</text>
						</subparagraph><subparagraph id="HFA21787CB65241C38FCF836DAAB4C81B"><enum>(D)</enum><header>Limitation on the use of parole authority</header><text>The Secretary of Homeland Security may not use the parole authority under this paragraph to permit
			 to come to the United States aliens who have applied for and have been
			 found to be ineligible for refugee status or any alien to whom the
			 provisions of this paragraph do not apply.</text>
						</subparagraph><subparagraph id="HF8EA8DCD2E5940C18F0E6626E535DC6F"><enum>(E)</enum><header>Parole not an admission</header><text>Parole of an alien under this paragraph shall not be considered an admission of the alien into the
			 United States. When the purposes of the parole of an alien have been
			 served, as determined by the Secretary of Homeland Security, the alien
			 shall immediately return or be returned to the custody from which the
			 alien was paroled and the alien shall be considered for admission to the
			 United States on the same basis as other similarly situated applicants for
			 admission.</text>
						</subparagraph><subparagraph id="H4EFA409986E04DE8A0A65D11F4F2C1B9"><enum>(F)</enum><header>Report to Congress</header><text>Not later than 90 days after the end of each fiscal year, the Secretary of Homeland Security shall
			 submit a report to the Committees on the Judiciary of the House of
			 Representatives and the Senate describing the number and categories of
			 aliens paroled into the United States under this paragraph. Each such
			 report shall contain information and data concerning the number and
			 categories of aliens paroled, the duration of parole, and the current
			 status of aliens paroled during the preceding fiscal year.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H0456BAA71F0C4BBEA7ECA38A201B364A"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on the first day of the first month
			 beginning more than 60 days after the date of the enactment of this Act.</text>
			</subsection></section><section display-inline="no-display-inline" id="HD2AA1D7266EB4563A2A2DC4A40FFB932" section-type="subsequent-section"><enum>8.</enum><header>Report to Congress on parole procedures and standardization of parole procedures</header>
			<subsection id="HB2A6518E8C5B44FF8724EAB9029535A9"><enum>(a)</enum><header>In general</header><text>The Attorney General and the Secretary of Homeland Security shall jointly conduct a review, and
			 report to the Judiciary Committees of the House of Representatives and the
			 Senate, not later than 180 days after the date of the enactment of this
			 Act, and annually thereafter, regarding the effectiveness of parole and
			 custody determination procedures applicable to aliens who have established
			 a credible fear of persecution and are awaiting a final determination
			 regarding their asylum claim by the immigration courts. The report shall
			 include the following:</text>
				<paragraph id="H2293429737374DD8B6D9DD76F7B25E57"><enum>(1)</enum><text>An analysis of the rate at which release from detention (including release on parole) is granted to
			 aliens who have established a credible fear of persecution and are
			 awaiting a final determination regarding their asylum claim by the
			 immigration courts throughout the United States, and any disparity that
			 exists between locations or geographical areas, including explanation of
			 the reasons for this disparity and what actions are being taken to have
			 consistent and uniform application of the standards for granting parole.</text>
				</paragraph><paragraph id="H3AC6EBF8FAB146E3B7208E3A277A1959"><enum>(2)</enum><text>An analysis of the effect of the procedures and policies applied with respect to parole and custody
			 determinations both by the Attorney General and the Secretary on the
			 alien’s pursuit of their asylum claim before an immigration court.</text>
				</paragraph><paragraph id="H76FA6231B8A443A09DD87B9C90B12C05"><enum>(3)</enum><text>An analysis of the effectiveness of the procedures and policies applied with respect to parole and
			 custody determinations both by the Attorney General and the Secretary in
			 securing the alien’s presence at the immigration court proceedings.</text>
				</paragraph></subsection><subsection id="H4C0134038EC14EC2876B4CF2922D62E6"><enum>(b)</enum><header>Recommendations</header><text>The report should include recommendations with respect to whether the existing parole and custody
			 determination procedures applicable to aliens who have established a
			 credible fear of persecution and are awaiting a final determination
			 regarding their asylum claim by the immigration courts both respect the
			 interests of aliens and ensure the presence of the aliens at the
			 immigration court proceedings. The report should include an assessment on
			 corresponding failure to appear rates, inabsentia orders, and absconders.</text>
			</subsection></section><section display-inline="no-display-inline" id="H82CFDAA1F0FA44E2A817DCAB213D9129" section-type="subsequent-section"><enum>9.</enum><header>Grounds of inadmissibility and deportability for alien gang members</header>
			<subsection id="HA44C2BF8798E455FA55A958B25672651"><enum>(a)</enum><header>Definition of gang member</header><text>Section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>) is amended by adding at
			 the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HAA54A6D1D67A4547B1B92240985C24BA" style="traditional">
					<paragraph id="H20392C742F80401687637ECB9E65B86D" indent="up1"><enum>(53)</enum>
						<subparagraph commented="no" display-inline="yes-display-inline" id="H93D22381E80A467E8184AFDE2B56AAAF"><enum>(A)</enum><text>The term <quote>criminal gang</quote> means an ongoing group, club, organization, or association of 5 or more persons that has as one of
			 its primary purposes the commission of 1 or more of the following criminal
			 offenses and the members of which engage, or have engaged within the past
			 5 years, in a continuing series of such offenses, or that has been
			 designated as a criminal gang by the Secretary of Homeland Security, in
			 consultation with the Attorney General, as meeting these criteria. The
			 offenses described, whether in violation of Federal or State law or
			 foreign law and regardless of whether the offenses occurred before, on, or
			 after the date of the enactment of this paragraph, are the following:</text>
							<clause id="HBE1D6F1647D24241B6F920C7E8188D94" indent="up1"><enum>(i)</enum><text>A <quote>felony drug offense</quote> (as defined in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>)).</text>
							</clause><clause display-inline="no-display-inline" id="H5C1E2D97F6BC4F5A83C8AB24F6CF5510" indent="up1"><enum>(ii)</enum><text>An offense under section 274 (relating to bringing in and harboring certain aliens), section 277
			 (relating to aiding or assisting certain aliens to enter the United
			 States), or section 278 (relating to importation of alien for immoral
			 purpose).</text>
							</clause><clause display-inline="no-display-inline" id="H66FFC227F6DF4C62B31F0556176A3B11" indent="up1"><enum>(iii)</enum><text>A crime of violence (as defined in <external-xref legal-doc="usc" parsable-cite="usc/18/16">section 16</external-xref> of title 18, United States Code).</text>
							</clause><clause display-inline="no-display-inline" id="HA529C1119FB04443B67F16A9E7221153" indent="up1"><enum>(iv)</enum><text>A crime involving obstruction of justice, tampering with or retaliating against a witness, victim,
			 or informant, or burglary.</text>
							</clause><clause display-inline="no-display-inline" id="H2B03EAD3B6E142B28F81FA91E4B46893" indent="up1"><enum>(v)</enum><text>Any conduct punishable under sections <external-xref legal-doc="usc" parsable-cite="usc/18/1028">1028</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/18/1029">1029</external-xref> of title 18, United States Code (relating to
			 fraud and related activity in connection with identification documents or
			 access devices), sections 1581 through 1594 of such title (relating to
			 peonage, slavery and trafficking in persons), section 1952 of such title
			 (relating to interstate and foreign travel or transportation in aid of
			 racketeering enterprises), section 1956 of such title (relating to the
			 laundering of monetary instruments), section 1957 of such title (relating
			 to engaging in monetary transactions in property derived from specified
			 unlawful activity), or sections 2312 through 2315 of such title (relating
			 to interstate transportation of stolen motor vehicles or stolen property).</text>
							</clause><clause display-inline="no-display-inline" id="HA6306CBD36ED4D41BE94E432DBBE2FD7" indent="up1"><enum>(vi)</enum><text>A conspiracy to commit an offense described in clauses (i) through (v).</text>
							</clause></subparagraph><subparagraph id="HC204526A573C40848601F7B062354624" indent="up1"><enum>(B)</enum><text>Notwithstanding any other provision of law (including any effective date), the term applies
			 regardless of whether the conduct occurred before, on, or after the date
			 of the enactment of this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HBDDF22597B174BA6847EBB7D25660A5C"><enum>(b)</enum><header>Inadmissibility</header><text display-inline="yes-display-inline">Section 212(a)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(2)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HBDD4B79735FF4D4BA70E3A4B1E62C638" style="OLC">
					<subparagraph id="H1E9BF8A6E1C04C1ABA2FA20FA79C2C48"><enum>(J)</enum><header>Aliens associated with criminal gangs</header><text display-inline="yes-display-inline">Any alien is inadmissible who a consular officer, the Secretary of Homeland Security, or the
			 Attorney General knows or has reason to believe—</text>
						<clause id="H725BAE17A0DD46F58542FD8EBAE55BAC"><enum>(i)</enum><text>to be or to have been a member of a criminal gang (as defined in section 101(a)(53)); or</text>
						</clause><clause id="HC09999CD01ED4C06BBEEA8C1386A476D"><enum>(ii)</enum><text>to have participated in the activities of a criminal gang (as defined in section 101(a)(53)),
			 knowing or having reason to know that such activities will promote,
			 further, aid, or support the illegal activity of the criminal gang.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H598B069191E7413481F473976E501B32"><enum>(c)</enum><header>Deportability</header><text>Section 237(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(2)</external-xref>) is amended by adding

						<clause id="H852173064C7A4639AEFE2C67E0AC93FA"><enum>(i)</enum><text>is or has been a member of a criminal gang (as defined in section 101(a)(53)); or</text>
						</clause><clause id="H7BE0A6352C564E53B7A62084BC185DF0"><enum>(ii)</enum><text>has participated in the activities of a criminal gang (as so defined), knowing or having reason to
			 know that such activities will promote, further, aid, or support the
			 illegal activity of the criminal gang.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H7F2F29BB377748FDAE945F601120E9A3"><enum>(d)</enum><header>Designation</header>
				<paragraph id="H143BC5BD3A674C86BF8BE3EEB9E33A69"><enum>(1)</enum><header>In general</header><text>Chapter 2 of title II of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1181">8 U.S.C. 1181 et seq.</external-xref>) is amended by
			 inserting after section 219 the following:</text>

						<section id="H3A723B94385A4F71B172DF43B337DD80"><enum>220.</enum><header>Designation</header><subsection commented="no" display-inline="yes-display-inline" id="H5FB5EE6CB3A54A4E9FD3A5641F2EDD41"><enum>(a)</enum><header>In general</header><text>The Secretary of Homeland Security, in consultation with the Attorney General, and the Secretary of
			 State may designate a group or association as a criminal street gang if
			 their conduct is described in section 101(a)(53) or if the group or
			 association conduct poses a significant risk that threatens the security
			 and the public safety of United States nationals or the national security,
			 homeland security, foreign policy, or economy of the United States.</text>
							</subsection><subsection id="H4347DE03EFCA4AFA858D361120D4391F"><enum>(b)</enum><header>Effective date</header><text>Designations under subsection (a) shall remain in effect until the designation is revoked after
			 consultation between the Secretary of Homeland Security, the Attorney
			 General, and the Secretary of State or is terminated in accordance with
			 Federal law.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H52C32158AE734E85ACAF2EDDC49AFB96"><enum>(2)</enum><header>Clerical amendment</header><text>The table of contents for such Act is amended by inserting after the item relating to section 219

			 appropriate Federal agencies, shall submit a report to the Committees on
			 the Judiciary of the House of Representatives and of the Senate on the
			 number of aliens detained under the amendments made by paragraph (1).</text>
				</paragraph></subsection><subsection id="HFB99E49B44B94FFEA61256D67114AB7C"><enum>(f)</enum><header>Asylum claims based on gang affiliation</header>
				<paragraph id="HB891BFD856A0402F9ADF1C55AB712144"><enum>(1)</enum><header>Inapplicability of restriction on removal to certain countries</header><text>Section 241(b)(3)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1251">8 U.S.C. 1251(b)(3)(B)</external-xref>) is amended, in
			 the matter preceding clause (i), by inserting <quote>who is described in section 212(a)(2)(J)(i) or section 237(a)(2)(G)(i) or who is</quote> after <quote>to an alien</quote>.</text>
				</paragraph><paragraph id="HD1D4A581BD6C4762A21B27B390C7FEED"><enum>(2)</enum><header>Ineligibility for asylum</header><text>Section 208(b)(2)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158(b)(2)(A)</external-xref>) is amended—</text>
					<subparagraph id="H39E9AF3E857944C991B5F7E6192C4DDF"><enum>(A)</enum><text>in clause (v), by striking <quote>or</quote> at the end;</text>

				<paragraph id="HE5A7D46925EF499E8036D077E3D8C385"><enum>(1)</enum><text>by striking <quote>Attorney General</quote> each place it appears and inserting <quote>Secretary of Homeland Security</quote>;</text>
				</paragraph><paragraph id="H48FBB0392647431E8E3DBAC3540C2F6F"><enum>(2)</enum><text>in subparagraph (c)(2)(B)—</text>

					</subparagraph></paragraph></subsection><subsection id="H9E4B90307C6345E9B9AE0738F45462B2"><enum>(h)</enum><header>Special immigrant juvenile visas</header><text display-inline="yes-display-inline">Section 101(a)(27)(J)(iii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(27)(J)(iii)</external-xref>) is
			 amended—</text>

				</paragraph></subsection><subsection id="HBF56FD65F00A4DA199ACE779CFAD0618"><enum>(i)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date of the enactment of this Act and
			 shall apply to acts that occur before, on, or after the date of the
			 enactment of this Act.</text>
			</subsection></section><section id="H5F8B0A81B9BD4F859C06145D9121757D"><enum>10.</enum><header>Unaccompanied alien child defined</header><text display-inline="no-display-inline">Section 462(g)(2) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/279">6 U.S.C. 279(g)(2)</external-xref>) is amended to read as
			 follows:</text>
			<quoted-block display-inline="no-display-inline" id="H9770861100804043AD1D0A4FB7B3DA09" style="OLC">
				<paragraph id="HE8417ABE4ED54BC7BA1492F7DA53F2C8"><enum>(2)</enum><text display-inline="yes-display-inline">The term <quote>unaccompanied alien child</quote>—</text>
					<subparagraph id="H94FC9DBD81D94C49823B006D5F5C53F4"><enum>(A)</enum><text>means an alien who—</text>
						<clause id="H85A8DEA4C8874B50AA68364A1FE8D249"><enum>(i)</enum><text>has no lawful immigration status in the United States;</text>
						</clause><clause id="HD50371D52A4447CEBE2C675EC7D00616"><enum>(ii)</enum><text>has not attained 18 years of age; and</text>
						</clause><clause id="HB69FEA8AD78F41B08CD98AA322607755"><enum>(iii)</enum><text>with respect to whom—</text>
							<subclause id="H05998B4B060C448F8D13AA321DBD7AA3"><enum>(I)</enum><text>there is no parent or legal guardian in the United States;</text>
							</subclause><subclause id="HEC5EB9AA6A1741B38680F7561458D704"><enum>(II)</enum><text>no parent or legal guardian in the United States is available to provide care and physical custody;
			 or</text>
							</subclause><subclause id="H7E0D5B841A804ECA82CD699E8656B5E4"><enum>(III)</enum><text>no sibling over 18 years of age, aunt, uncle, grandparent, or cousin over 18 years of age is
			 available to provide care and physical custody; except that</text>
							</subclause></clause></subparagraph><subparagraph id="H0FDFD6590B1D48D8AE15568A01C1D24F"><enum>(B)</enum><text display-inline="yes-display-inline">such term shall cease to include an alien if at any time a parent, legal guardian, sibling over 18
			 years of age, aunt, uncle, grandparent, or cousin over 18 years of age of
			 the alien is found in the United States and is available to provide care
			 and physical custody (and the Secretary of Homeland Security and the
			 Secretary of Health and Human Services shall revoke accordingly any prior
			 designation of the alien under this paragraph).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HDD81A1173C644B6A8110B43F1A723B63"><enum>11.</enum><header>Modifications to preferential availability for asylum for unaccompanied alien minors</header><text display-inline="no-display-inline">Section 208 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158</external-xref>) is amended—</text>
			<paragraph id="H976EC30DB91145989915E811EA4B2E87"><enum>(1)</enum><text>by striking subsection (a)(2)(E); and</text>
			</paragraph><paragraph id="H19E52AB18D4542009B6F4371EDD3449A"><enum>(2)</enum><text>by striking subsection (b)(3)(C).</text>
			</paragraph></section><section id="HF39DB7D57F3F4478B52E7D10C213542B"><enum>12.</enum><header>Notification and transfer of custody regarding unaccompanied alien minors</header><text display-inline="no-display-inline">Section 235(b) of the William Wilberforce Trafficking Victims Protection Reauthorization Act of
			 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232(b)</external-xref>) is amended—</text>
			<paragraph id="H99B1CF9007E241C0BF1919A649D8B141"><enum>(1)</enum><text>in paragraph (2), by striking <quote>48 hours</quote> and inserting <quote>7 days</quote>; and</text>
			</paragraph><paragraph id="H19B392F58D15417E8C3FB82B9E72FC72"><enum>(2)</enum><text>in paragraph (3), by striking <quote>72 hours</quote> and inserting <quote>30 days</quote>.</text>
			</paragraph></section><section id="H5651CDD0861D487683FB6D3CC48307E5"><enum>13.</enum><header>Information sharing between Department of Health and Human Services and Department of Homeland
			 Security</header><text display-inline="no-display-inline">Section 235(b) of the William Wilberforce Trafficking Victims Protection Reauthorization Act of
			 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232(b)</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H570EA57B58744B5FBA244049455EA054" style="OLC">
				<paragraph id="H94D377E119F14A979AEA423B8FF05296"><enum>(5)</enum><header>Information sharing</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall share with the Secretary of Homeland Security any
			 information requested on a child who has been determined to be an
			 unaccompanied alien child and who is or has been in the custody of the
			 Secretary of Health and Human Services, including the location of the
			 child and any person to whom custody of the child has been transferred,
			 for any legitimate law enforcement objective, including enforcement of the
			 immigration laws.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H12990A55785A4968BD8DAB0EB5380C7D"><enum>14.</enum><header>Safe third country</header><text display-inline="no-display-inline">Section 208(a)(2)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158(a)(2)(A)</external-xref>) is amended—</text>
			<paragraph id="HFEEBE325CD184DAF9B21E6ABFA8283DA"><enum>(1)</enum><text>by striking <quote>Attorney General</quote> and inserting <quote>Secretary of Homeland Security</quote>; and</text>
			</paragraph><paragraph id="HAA36F0939DF64DB69B3F2AAC4FE7D542"><enum>(2)</enum><text>by striking <quote>removed, pursuant to a bilateral or multilateral agreement, to</quote> and inserting <quote>removed to</quote>.</text>
			</paragraph></section><section id="H98BF224FB38D4223A1F86CE2A68E9E31"><enum>15.</enum><header>Additional immigration judges and ICE prosecutors</header>
			<subsection id="HAF6903AF9F624E35979FDF9AB5188A71"><enum>(a)</enum><header>Executive Office for Immigration Review</header><text display-inline="yes-display-inline">Subject to the availability of appropriations, in each of fiscal years 2014 through 2016, the
			 Attorney General shall increase by not less than 50 the number of
			 positions for full-time immigration judges within the Executive Office for
			 Immigration Review above the number of such positions for which funds were
			 allotted for fiscal year 2013.</text>
			</subsection><subsection id="H0EBD71ED19144880BF7DBB687D2D537C"><enum>(b)</enum><header>Immigration and Customs Enforcement Office of the Principal Legal Advisor</header><text display-inline="yes-display-inline">Subject to the availability of appropriations, in each of fiscal years 2014 through 2016, the
			 Secretary of Homeland Security shall increase by not less than 60 the
			 number of positions for full-time trial attorneys within the Immigration
			 and Customs Enforcement Office of the Principal Legal Advisor above the
			 number of such positions for which funds were allotted for fiscal year
			 2013.</text>
			</subsection></section><section id="HDF903DB255D14CB19F43820D4643768F" section-type="subsequent-section"><enum>16.</enum><header>Prohibition on actions that impede border security on certain Federal land</header>
			<subsection id="H916AC4E9ACA34FFCB1C415BD863419B3"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This section may be cited as the <quote>National Security and Federal Lands Protection Act</quote>.</text>
			</subsection><subsection id="HC043CF24582C48889E79F530B6DC86FA"><enum>(b)</enum><header>Prohibition on Secretaries of the Interior and Agriculture</header><text display-inline="yes-display-inline">The Secretary of the Interior or the Secretary of Agriculture shall not impede, prohibit, or
			 restrict activities of U.S. Customs and Border Protection on Federal land
			 located within 100 miles of an international land border that is under the
			 jurisdiction of the Secretary of the Interior or the Secretary of
			 Agriculture, to execute search and rescue operations and to prevent all
			 unlawful entries into the United States, including entries by terrorists,
			 other unlawful aliens, instruments of terrorism, narcotics, and other
			 contraband through the international land borders of the United States.</text>
			</subsection><subsection id="H73490F8757B5487EACF70DAFE71A30D2"><enum>(c)</enum><header>Authorized activities of U.S. Customs and Border Protection</header><text display-inline="yes-display-inline">U.S. Customs and Border Protection shall have immediate access to Federal land within 100 miles of
			 the international land border under the jurisdiction of the Secretary of
			 the Interior or the Secretary of Agriculture for purposes of conducting
			 the following activities on such land that prevent all unlawful entries
			 into the United States, including entries by terrorists, other unlawful
			 aliens, instruments of terrorism, narcotics, and other contraband through
			 the international land borders of the United States:</text>
				<paragraph id="H0CC0147C9AB549FF86D0FD234B567637"><enum>(1)</enum><text>Construction and maintenance of roads.</text>
				</paragraph><paragraph id="H9EF79A9D4C8040BF83E83AA46BD4F726"><enum>(2)</enum><text>Construction and maintenance of barriers.</text>
				</paragraph><paragraph id="H909549C84417408CA3B3B92A9028ECEE"><enum>(3)</enum><text>Use of vehicles to patrol, apprehend, or rescue.</text>
				</paragraph><paragraph id="H4A0A8B445BF9440D9AAA71E8854171C5"><enum>(4)</enum><text>Installation, maintenance, and operation of communications and surveillance equipment and sensors.</text>
				</paragraph><paragraph id="HED5A24DC53F44A848720E0BFAC60BE0D"><enum>(5)</enum><text>Deployment of temporary tactical infrastructure.</text>
				</paragraph></subsection><subsection id="HD9FC185D9C2C4E38AF6C400AB77F2C77"><enum>(d)</enum><header>Clarification relating to waiver authority</header>
				<paragraph id="H148F0EE55BA941D38A0D2451D2F97405"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law (including any termination date relating to the waiver
			 referred to in this subsection), the waiver by the Secretary of Homeland
			 Security on April 1, 2008, under section 102(c)(1) of the Illegal
			 Immigration Reform and Immigrant Responsibility Act of 1996 (8 U.S.C. 1103
			 note; <external-xref legal-doc="public-law" parsable-cite="pl/104/208">Public Law 104–208</external-xref>) of the laws described in paragraph (2) with
			 respect to certain sections of the international border between the United
			 States and Mexico and between the United States and Canada shall be
			 considered to apply to all Federal land under the jurisdiction of the
			 Secretary of the Interior or the Secretary of Agriculture within 100 miles
			 of the international land borders of the United States for the activities
			 of U.S. Customs and Border Protection described in subsection (c).</text>
				</paragraph><paragraph id="H36A8776A98394EABB761B7F65764C778"><enum>(2)</enum><header>Description of laws waived</header><text>The laws referred to in paragraph (1) are limited to the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>),
			 the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>),
			 the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>), the National
			 Historic Preservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/470">16 U.S.C. 470 et seq.</external-xref>), <external-xref legal-doc="public-law" parsable-cite="pl/86/523">Public Law 86–523</external-xref> (16

			 92 Stat. 3467), and the Arizona Desert Wilderness Act of 1990 (16 U.S.C.
			 1132 note; <external-xref legal-doc="public-law" parsable-cite="pl/101/628">Public Law 101–628</external-xref>).</text>
				</paragraph></subsection><subsection id="HEE21219A3C564F8CAB8E1F6B067A9CB1"><enum>(e)</enum><header>Protection of legal uses</header><text>This section shall not be construed to provide—</text>
				<paragraph id="H7CD39DD3F4E24EE8B9379FD8CBD6E670"><enum>(1)</enum><text>authority to restrict legal uses, such as grazing, hunting, mining, or public-use recreational and
			 backcountry airstrips on land under the jurisdiction of the Secretary of
			 the Interior or the Secretary of Agriculture; or</text>
				</paragraph><paragraph id="H908233CFAF9E4532A060C9AEAC8D97DA"><enum>(2)</enum><text>any additional authority to restrict legal access to such land.</text>
				</paragraph></subsection><subsection id="HD2E24CF24AD142F48A169B96832B7E2B"><enum>(f)</enum><header>Effect on State and private land</header><text>This Act shall—</text>
				<paragraph id="H1FC20F3284A14D6EAD4896D102BFEE83"><enum>(1)</enum><text>have no force or effect on State or private lands; and</text>
				</paragraph><paragraph id="HFAF3B148C4744735B79E55F2A699F772"><enum>(2)</enum><text>not provide authority on or access to State or private lands.</text>
				</paragraph></subsection><subsection id="H719E04D6DB0946DC94224E97ECCF7142"><enum>(g)</enum><header>Tribal sovereignty</header><text>Nothing in this section supersedes, replaces, negates, or diminishes treaties or other agreements
			 between the United States and Indian tribes.</text>
			</subsection></section><section display-inline="no-display-inline" id="H7B61F5EC0FFF4F85BAD7123D85B8418F" section-type="subsequent-section"><enum>17.</enum><header>Minors in custody</header>
			<subsection id="HD433EE5C3A134D2D92E15F30CE03D057"><enum>(a)</enum><header>Minors in Department of Health and Human Services custody</header><text display-inline="yes-display-inline">Section 235(c)(2) of the William Wilberforce Trafficking Victims Protection Reauthorization Act of
			 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232(c)(2)</external-xref>) is amended by striking the last two sentences.</text>
			</subsection><subsection display-inline="no-display-inline" id="HFA7A5CB35D79428EBCCC9017E4A3335D"><enum>(b)</enum><header>Minors in expedited removal proceedings</header><text display-inline="yes-display-inline">Section 235(b)(1)(B)(ii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225(b)(1)(B)(ii)</external-xref>) is
			 amended by striking <quote>asylum.</quote> and inserting <quote>asylum (or may be detained if the alien is an unaccompanied alien child (as defined in section
			 462(g)(2) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/279">6 U.S.C. 279(g)</external-xref>))).</quote>.</text>
			</subsection></section><section display-inline="no-display-inline" id="HD2588BEBC35446EFAD79C557975F595C" section-type="subsequent-section"><enum>18.</enum><header>Foreign assistance for repatriation</header>
			<subsection id="H5E6217109BE6426AB1DECD50CDA48117"><enum>(a)</enum><header>Suspension of foreign assistance</header><text>The Secretary of State shall immediately suspend all foreign assistance, including under United
			 States Agency for International Development programs, the Central American
			 Regional Security Initiative, or the International Narcotic Control Law
			 Enforcement program, to any large sending country that—</text>
				<paragraph id="HFB0BB37E7DA84EFEB4146C5E4738E938"><enum>(1)</enum><text>refuses to negotiate an agreement under section 235(a)(2) of the William Wilberforce Trafficking
			 Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232(a)(2)</external-xref>), as
			 amended by section 2 of this Act; or</text>
				</paragraph><paragraph id="HB89013AA85C44D0ABE9B366D8F4A77DD"><enum>(2)</enum><text display-inline="yes-display-inline">refuses to accept from the United States repatriated unaccompanied alien children (as defined in
			 section 462(g)(2) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/279">6 U.S.C. 279(g)</external-xref>))
			 who are nationals or residents of the sending country.</text>
				</paragraph></subsection><subsection id="H282292BA64584D7992C7A2D8B0AB1902"><enum>(b)</enum><header>Use of foreign assistance for repatriation</header><text display-inline="yes-display-inline">The Secretary of State shall provide any additional foreign assistance from the United States that
			 such Secretary determines is needed to implement an agreement under
			 section 235(a)(2) of the William Wilberforce Trafficking Victims
			 Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232(a)(2)</external-xref>), as amended
			 by section 2 of this Act, or safely to repatriate or reintegrate nationals
			 or residents of a large sending country without increasing the total
			 quantity of foreign assistance to such country. Such country may use any
			 earlier foreign assistance for the purpose of repatriation or
			 implementation of any agreement under such section 235(a)(2).</text>
			</subsection><subsection id="HBE3DE337F6BB46FF8034D9664B28C788"><enum>(c)</enum><header>Definition of large sending program</header><text display-inline="yes-display-inline">For purposes of this section, the term <quote>large sending country</quote> means—</text>
				<paragraph id="H697F9E852487400C83FBCC1404327D3E"><enum>(1)</enum><text>any country which was the country of nationality or last habitual residence for 1,000 or more
			 unaccompanied alien children (as defined in section 462(g)(2) of the
			 Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/279">6 U.S.C. 279(g)</external-xref>)) who entered the United
			 States in a single fiscal year in any of the prior 3 fiscal years; and</text>
				</paragraph><paragraph id="H9573A25A58EA4F1792F4B1C9EAE40EB8"><enum>(2)</enum><text>any other country which the Secretary of Homeland Security deems appropriate.</text>
				</paragraph></subsection><subsection id="HC3417C40AE0F490985EDA6F00E987CB9"><enum>(d)</enum><header>Effective date</header><text display-inline="yes-display-inline">This section shall take effect on the date of the enactment of this Act and shall apply with
			 respect to any unaccompanied alien child (as defined in section 462(g)(2)
			 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/279">6 U.S.C. 279(g)</external-xref>)) apprehended on or
			 after such date.</text>
			</subsection></section><section id="HF2A37234F8014743BC8045A860F51971"><enum>19.</enum><header>Reports</header>
			<subsection id="H10C9460C0CC7492E81C45F681610AC52"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 6 months after the date of the enactment of this Act, and annually thereafter, the
			 Secretary of State and the Secretary of Health and Human Services, with
			 assistance from the Secretary of Homeland Security, shall submit a report
			 to the Committee on the Judiciary of the Senate and the Committee on the
			 Judiciary of the House of Representatives on efforts to improve
			 repatriation programs for unaccompanied alien children (as defined in
			 section 462(g)(2) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/279">6 U.S.C. 279(g)</external-xref>)).
			 Such reports shall include the following:</text>
				<paragraph id="H7921A628ED50479D9195052F46ACA4C3"><enum>(1)</enum><text>The average time that such a child is detained after apprehension until removal.</text>
				</paragraph><paragraph id="H72FFDD65B47544B5BB4C14C709725101"><enum>(2)</enum><text display-inline="yes-display-inline">The number of such children detained improperly beyond the required time periods under paragraphs
			 (2) and (3) of section 235(b) of the William Wilberforce Trafficking
			 Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232(b)</external-xref>).</text>
				</paragraph><paragraph id="HF81014D3960145A3A310365881AF38D3"><enum>(3)</enum><text>A statement of the funds used to effectuate the repatriation of such children, including any funds
			 that were reallocated from foreign assistance accounts as of the date of
			 the enactment of this Act.</text>
				</paragraph></subsection><subsection id="H8E033A983E5D4808AD8204868C896D31"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">This section shall take effect on the date of the enactment of this Act and shall apply with
			 respect to any unaccompanied alien child (as defined in section 462(g)(2)
			 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/279">6 U.S.C. 279(g)</external-xref>)) apprehended on or
			 after such date.</text>
