			 respect to motor vehicle fuels, and for other purposes.</official-title>

		<section id="H2E1B36A8D5E3407A9BDDF542C4B1398D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Country-of-Origin Labeling for Fuels Act</short-title></quote>.</text>
		</section><section id="HB69E5812B7A74FF6824F0441CA375608"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H35E77C3096FE4245BCE3A490BC9EAC9C"><enum>(1)</enum><header>Country-of-origin information</header><text>The term <term>country-of-origin information</term> means information regarding each country in which motor vehicle fuel or the components of such
			 fuel were extracted, refined, or otherwise processed.</text>
			</paragraph><paragraph id="H070EB8B718B948A28AB33BF4E81043F8"><enum>(2)</enum><header>Motor vehicle fuel</header><text>The term <term>motor vehicle fuel</term>—</text>
				<subparagraph id="HCE2B5B6C4E074FC38148A3B298B2899D"><enum>(A)</enum><text>means any fuel used to power an automobile, as defined in <external-xref legal-doc="usc" parsable-cite="usc/49/32901">section 32901(a)</external-xref> of title 49, United
			 States Code; and</text>
				</subparagraph><subparagraph id="H0279D2577A0846DF9AE9E42657D9A402"><enum>(B)</enum><text>includes alternative fuels, as defined in such section, other than electricity (including
			 electricity from solar energy).</text>
				</subparagraph></paragraph><paragraph id="H52CF902DDA6948F79EB94E80A0851D58"><enum>(3)</enum><header>Motor vehicle fuel retailer</header><text>The term <term>motor vehicle fuel retailer</term> means a person in the motor vehicle fuel supply chain who sells motor vehicle fuel to the general
			 public for ultimate consumption.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA58A25445A294CD1A0D10C1CB8ACCFF3"><enum>(4)</enum><header>Motor vehicle fuel supplier</header><text>The term <term>motor vehicle fuel supplier</term> means a person in the motor vehicle fuel supply chain other than a motor vehicle fuel retailer.</text>
			</paragraph></section><section id="H262F9C2C8F46447497E92123BA087E00"><enum>3.</enum><header>Study on implementing country-of-origin labeling for motor vehicle fuel</header>
			<subsection id="HC2F675014EF2484AAC8AAB1A677CA810"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary of Energy, in
			 consultation with the Administrator of the Environmental Protection
			 Agency, shall—</text>
				<paragraph id="HDD2D73580BF7420EAC7E7B7BE258EF5F"><enum>(1)</enum><text display-inline="yes-display-inline">conduct a study to determine appropriate methods and standards for requiring that—</text>
					<subparagraph id="HFF0F0F737B744493923E6CEA32599ECB"><enum>(A)</enum><text display-inline="yes-display-inline">motor vehicle fuel suppliers disclose country-of-origin information with respect to motor vehicle
			 fuel to the next person in the motor vehicle fuel supply chain; and</text>
					</subparagraph><subparagraph id="H13EE5172861D427FB926999A26C6441A"><enum>(B)</enum><text>motor vehicle fuel retailers disclose such information to consumers; and</text>
					</subparagraph></paragraph><paragraph id="HB6925707E3E54FEA959BEC2BE2305C20"><enum>(2)</enum><text display-inline="yes-display-inline">make recommendations with respect to the most feasible and cost-effective country-of-origin
			 information disclosure requirements that can be imposed on motor vehicle
			 fuel suppliers and motor vehicle fuel retailers.</text>
				</paragraph></subsection><subsection id="H99E2EDBB991044F89405279A9D27D9A4"><enum>(b)</enum><header>Elements of study</header><text>The study required by subsection (a) shall address the following:</text>
				<paragraph id="HA5763CB7EA9E433CA82B7C1CE7A0BE23"><enum>(1)</enum><text>The extent to which persons at each step in the motor vehicle fuel supply chain have access to
			 country-of-origin information regarding the fuel they sell, and the nature
			 of any such information.</text>
				</paragraph><paragraph id="H1D24B615A0024B64B68D640B9D160EA9"><enum>(2)</enum><text display-inline="yes-display-inline">An assessment of whether such information is adequate—</text>
					<subparagraph id="HECA4CC8330A74B7EAD3AF4861774AE96"><enum>(A)</enum><text>to enable a motor vehicle fuel supplier to provide country-of-origin information to the next person
			 in the supply chain; and</text>
					</subparagraph><subparagraph id="H9467C706C31546E5B28531DBAE291C43"><enum>(B)</enum><text>to enable a motor vehicle fuel retailer to provide country-of-origin information to consumers, by
			 displaying that information at fuel pumps or on a website.</text>
					</subparagraph></paragraph><paragraph id="H5FC07D61B9BB45F2AA0F7B52120DA513"><enum>(3)</enum><text display-inline="yes-display-inline">If the Secretary determines under paragraph (2) that such information is inadequate to enable motor
			 vehicle fuel suppliers or motor vehicle fuel retailers to provide
			 country-of-origin information, measures that can be taken to collect
			 adequate information—</text>
					<subparagraph id="HD678959E84E84F34A4C55F5D7A1DB9A2"><enum>(A)</enum><text>by the Secretary; and</text>
					</subparagraph><subparagraph id="H61EC4E051B1644D398380BA7AD5E470E"><enum>(B)</enum><text>by motor vehicle fuel suppliers and motor vehicle fuel retailers.</text>
					</subparagraph></paragraph><paragraph id="H4D4AE3B9C2384D1F86A585B06C80C5EB"><enum>(4)</enum><text>The feasibility of various country-of-origin information disclosure requirements, including—</text>
					<subparagraph id="HC447EF0B504844539F44FA0D73A1662C"><enum>(A)</enum><text>displaying at each fuel pump the precise country or countries in which the fuel being dispensed to
			 each consumer originated; and</text>
					</subparagraph><subparagraph id="HBE89C3FAEFAD4C009068E715B2FD31CB"><enum>(B)</enum><text>displaying at each motor vehicle fuel retailer or on the website of each motor vehicle fuel
			 supplier or motor vehicle fuel retailer the country or countries from
			 which the fuel the supplier or retailer (as the case may be) sells
			 generally originates.</text>
					</subparagraph></paragraph><paragraph id="HAEFB1319E4794C40BD3CC21D301F3595"><enum>(5)</enum><text>Such other issues relating to motor vehicle fuel country-of-origin information disclosure
			 requirements as the Secretary considers appropriate.</text>
				</paragraph></subsection><subsection id="H9D940016EB9C4EC49D92D61951BAC270"><enum>(c)</enum><header>Report to Congress</header><text>Not later than 90 days after completing the study required by subsection (a), the Secretary shall
			 submit to Congress a report that—</text>
				<paragraph id="HBCC32F7513624D2384460F030FDC352F"><enum>(1)</enum><text>summarizes the results of the study; and</text>
				</paragraph><paragraph id="H3303F85B1EBB4DCBBACC67279B7CCBE9"><enum>(2)</enum><text>contains the recommendations required by subsection (a)(2).</text>
				</paragraph></subsection></section><section id="HBCD3C6F9BC114FD2A13A11A08A54F52D"><enum>4.</enum><header>Regulations requiring country-of-origin information disclosure</header>
			<subsection id="H6CAF7D78FE8C47889726E5CEFD3484FD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after submitting the report required by section 3(c), the Secretary of
			 Energy, in consultation with the Administrator of the Environmental
			 Protection Agency, shall prescribe regulations requiring disclosure of
			 country-of-origin information by motor vehicle fuel suppliers and motor
			 vehicle fuel retailers in accordance with the Secretary’s recommendations
			 in the report.</text>
			</subsection><subsection id="H101100940CC442EC9D363C63FE9BA5D3"><enum>(b)</enum><header>70 percent threshold</header><text>The regulations required by subsection (a) shall not require the listing of more than one
			 country-of-origin for a fuel blend containing fuel 70 percent or more of
			 which originated in a single country.</text>
			</subsection></section><section id="HD7B79733915A4FD6B993B06FA3274373"><enum>5.</enum><header>Enforcement</header>
			<subsection id="H589F477A8FA84F84AF10253DCF6CB51B"><enum>(a)</enum><header>In general</header><text>Subject to subsection (b), the Secretary of Energy may impose a civil penalty of not more than
			 $10,000 on a person that the Secretary determines, in accordance with
			 <external-xref legal-doc="usc" parsable-cite="usc/5/554">section 554</external-xref> of title 5, United States Code, knowingly violates the
			 regulations prescribed under section 4.</text>
			</subsection><subsection id="H055CA34D39E34812A5B26E23BEFA0EB6"><enum>(b)</enum><header>Requirements with respect to imposition of penalty</header>
				<paragraph id="H01252BBB0B444F68B94C712E4106BC2B"><enum>(1)</enum><header>Notice</header><text>The Secretary of Energy may not impose a penalty upon a person for violating the regulations
			 prescribed under section 4 unless—</text>
					<subparagraph id="HD2688B937E9D4A359B66F5A54145D097"><enum>(A)</enum><text>the Secretary provides the person with notice of the violation; and</text>
					</subparagraph><subparagraph id="HEC339A9D93AC492FB1B3E061ECFE0297"><enum>(B)</enum><text>the violation continues for more than 30 days after the date on which the person received notice
			 under subparagraph (A).</text>
					</subparagraph></paragraph><paragraph id="HB012227064B44A38AABBA5FFB4E8B77A"><enum>(2)</enum><header>Determination of amount of penalty</header><text>In determining the amount of the penalty to be imposed on a person for violating the regulations
			 prescribed under section 4, the Secretary shall consider the severity of
			 the violation, the size of the person’s business, and the effect of the
			 penalty on the person’s ability to continue in business.</text>
				</paragraph></subsection></section></legis-body>
