		<section id="HA37B2EBB85474B3BA6A7199475D650F4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Railroad Hours of Service Employees Technical Corrections Act</short-title></quote>.</text>
		</section><section id="H56CA9127B81F4EF7998528D426F2183F"><enum>2.</enum><header>Leave requirement for railroad hours of service employees</header>
			<subsection id="HF8A29F69A72E4066A6163CBAD6DD8F82"><enum>(a)</enum><header>Inclusion of railroad hours of service employees</header><text display-inline="yes-display-inline">Section 101(2) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611(2)</external-xref>) is amended by adding
			 at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HD552FD92C34E41548A18ABA837EFDF59" style="OLC">
					<subparagraph id="HA5344F39EE4345AB91C663F1E9694A0F"><enum>(E)</enum><header>Railroad hours of service employees</header>
						<clause id="H6229B456BD65488F9E5695388DD76CCD"><enum>(i)</enum><header>Determination</header><text display-inline="yes-display-inline">For purposes of determining whether a railroad employee who is subject to the hours of service laws
			 under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/211">chapter 211</external-xref> of title 49, United States Code, meets the hours of
			 service requirement specified in subparagraph (A)(ii), the employee will
			 be considered to meet the requirement if—</text>
							<subclause id="HD79FDA37B17E496CA6AD010C282D19A0"><enum>(I)</enum><text display-inline="yes-display-inline">the employee has worked or been paid for not less than 60 percent of the applicable total
			 guarantee, or the equivalent, for the previous 12-month period, for or by
			 the employer with respect to whom leave is requested under section 102;
			 and</text>
							</subclause><subclause id="H12DAD63F558642619A6B4DBB5A30E6ED"><enum>(II)</enum><text display-inline="yes-display-inline">the employee has worked or been paid for not less than 504 hours (not counting personal commute
			 time or time spent on vacation leave or medical or sick leave) during the
			 previous 12-month period, for or by that employer.</text>
							</subclause></clause><clause id="H467726BDE3084F65ACC4A8440D45100A"><enum>(ii)</enum><header>File</header><text display-inline="yes-display-inline">Each employer of an employee described in clause (i) shall maintain on file with the Secretary (in
			 accordance with such regulations as the Secretary may prescribe)
			 information specifying the applicable guarantee with respect to each
			 category of employee to which such guarantee applies.</text>
						</clause><clause id="H12C0A963EB1B4474A8147BA7071DC5B5"><enum>(iii)</enum><header>Definition</header><text display-inline="yes-display-inline">In this subparagraph, the term <quote>applicable guarantee</quote> means—</text>
							<subclause id="H27F52B0365044084B1E894867FED30AD"><enum>(I)</enum><text display-inline="yes-display-inline">for an employee described in clause (i) other than an employee on reserve status, the minimum
			 number of hours for which an employer has agreed to schedule such employee
			 for any given period; and</text>
							</subclause><subclause id="H48E1FC2C302D4583A36724637E3364C6"><enum>(II)</enum><text display-inline="yes-display-inline">for an employee described in clause (i) who is on reserve status, the number of hours for which an
			 employer has agreed to pay such employee on reserve status for any given
			 period,</text></subclause><continuation-text continuation-text-level="clause">as established in the applicable collective bargaining agreement or, if none exists, in the
			 employer’s policies.</continuation-text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H6CCC5CE37FBA4C168A78453B7EF2BBFE"><enum>(b)</enum><header>Calculation of leave for railroad hours of service employees</header><text display-inline="yes-display-inline">Section 102(a) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)</external-xref>) is amended by adding
			 at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HB85506B8DC24464BAC91FA1DB8051DBF" style="OLC">
					<paragraph id="H3F2F978538FC4F519926352B8366C80C"><enum>(5)</enum><header>Calculation of leave for railroad hours of service employees</header><text display-inline="yes-display-inline">The Secretary may provide, by regulation, a method for calculating the leave described in paragraph
			 (1) with respect to employees described in section 101(2)(E).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
