		<section id="HC3E878025B034F1590719BEA11D6B551" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Helping Unaccompanied Minors and Alleviating National Emergency Act</short-title></quote> or the <quote><short-title>HUMANE Act</short-title></quote>.</text>
		</section><title id="H9B2B08E29CA54EF3AF5E115FAB3D0DE2" style="OLC"><enum>I</enum><header>Protecting Children</header>
			<section id="HBB34842C8BC4487A9D307E698B2F730B"><enum>101.</enum><header>Repatriation of unaccompanied alien children</header><text display-inline="no-display-inline">Section 235(a) of the <short-title>William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008</short-title> (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232(a)</external-xref>) is amended—</text>
				<paragraph id="H3A19A0EB377C423CA8EFB5696AB6D0DF"><enum>(1)</enum><text>in paragraph (2)—</text>
					<subparagraph id="H2F3D0AD8E53B41DB870853B8F18C1AE7"><enum>(A)</enum><text>by amending the paragraph heading to read as follows: <quote><header-in-text level="paragraph" style="OLC">Rules for unaccompanied alien children</header-in-text></quote>;</text>
					</subparagraph><subparagraph id="HF77FA23644C5466C9CB73F61524FF719"><enum>(B)</enum><text>in subparagraph (A), in the matter preceding clause (i), by striking <quote>who is a national or habitual resident of a country that is contiguous with the United States</quote>; and</text>
					</subparagraph><subparagraph id="H6EA0771FA5824DE0AB72A7046ADA71B4"><enum>(C)</enum><text>in subparagraph (C)—</text>
						<clause id="HC6DB4D68F3B4468C85BF4234F9FE5E3D"><enum>(i)</enum><text>by amending the subparagraph heading to read as follows: <quote><header-in-text level="subparagraph" style="OLC">Agreements with foreign countries</header-in-text></quote>; and</text>
						</clause><clause id="H48D87BFA3CF24A3097414521BF2B610F"><enum>(ii)</enum><text>in the matter preceding clause (i), by striking <quote>countries contiguous to the United States</quote> and inserting <quote>Canada, El Salvador, Guatemala, Honduras, Mexico, and any other foreign country that the Secretary
			 determines appropriate</quote>; and</text>
						</clause></subparagraph></paragraph><paragraph id="H671882FD4ADB4DAB9926220FBF2655BC"><enum>(2)</enum><text>in paragraph (5)(D)—</text>
					<subparagraph id="H927F0CE935CA42D58196EE966D592F5B"><enum>(A)</enum><text>in the subparagraph heading, by striking <quote><header-in-text level="subparagraph" style="OLC">Placement in removal proceedings</header-in-text></quote> and inserting <quote><header-in-text level="subparagraph" style="OLC">Expedited due process and screening for unaccompanied alien children</header-in-text></quote>;</text>
					</subparagraph><subparagraph id="HC8C1C605C9F243AA9E69E56A341C06B1"><enum>(B)</enum><text>in the matter preceding clause (i), by striking <quote>, except for an unaccompanied alien child from a contiguous country subject to the exceptions under
			 subsection (a)(2), shall be—</quote> and inserting <quote>who does not meet the criteria listed in paragraph (2)(A)—</quote>;</text>
					</subparagraph><subparagraph id="H32CFBAF5D7704B62923E94416B3BED59"><enum>(C)</enum><text>by striking clause (i) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="H8C5949923CF448EFA79359198227CFD5" style="OLC">
							<clause id="H52E5FD2060B0461E9CD1D8F2A92A7820"><enum>(i)</enum><text>shall be placed in a proceeding in accordance with section 235B of the Immigration and Nationality
			 Act, which shall commence not later than 7 days after the screening of an
			 unaccompanied alien child described in paragraph (4);</text></clause><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HD2E71C092C254EB785915906216CC626"><enum>(D)</enum><text>by redesignating clauses (ii) and (iii) as clauses (iii) and (iv), respectively;</text>
					</subparagraph><subparagraph id="HFF259AB7410A45FEAC97EED5EA9B53B0"><enum>(E)</enum><text>by inserting after clause (i) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H010B871B84A240DC95CE1D5C8D8532A6" style="OLC">
							<clause id="H534090BD6A1744F2B69EBC3F49663EDB"><enum>(ii)</enum><text>may not be placed in the custody of a nongovernmental sponsor or otherwise released from the
			 custody of the United States Government until the child is repatriated
			 unless the child is the subject of an order under section 235B(e)(1) of
			 the Immigration and Nationality Act;</text></clause><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HB97D106D9E13403FB7CA9B267EC83009"><enum>(F)</enum><text>in clause (iii), as redesignated, by inserting <quote>is</quote> before <quote>eligible</quote>; and</text>
					</subparagraph><subparagraph id="H045FE57612B448B1A1647AD043943B0F"><enum>(G)</enum><text>in clause (iv), as redesignated, by inserting <quote>shall be</quote> before <quote>provided</quote>.</text>
					</subparagraph></paragraph></section><section id="HA70711FB0CE14045A183517F635385F5"><enum>102.</enum><header>Expedited due process and screening of unaccompanied alien children </header>
				<subsection id="H01B8DFC9C14D487792EAFB40B4092615"><enum>(a)</enum><header>Amendments to Immigration and Nationality Act</header>
					<paragraph id="H7707EB287E314484A0F65A84F8741C6C"><enum>(1)</enum><header>In general</header><text>Chapter 4 of the Immigration and Nationality Act is amended by inserting after section 235A the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="HA67DE998E182475189B4DBFD3CCB0F43" style="OLC">
							<section id="H1083E166A1C84218B0AB28D59984A84B"><enum>235B.</enum><header>Humane and expedited inspection and screening for unaccompanied alien children</header>
								<subsection id="H13A9821254A2404C8840950E203A013F"><enum>(a)</enum><header>Defined term</header><text>In this section, the term <term>asylum officer</term> means an immigration officer who—</text>
									<paragraph id="HD55B39C16C1A476A9C7875657C5D24B9"><enum>(1)</enum><text>has had professional training in country conditions, asylum law, and interview techniques
			 comparable to that provided to full-time adjudicators of applications
			 under section 208, and</text>
									</paragraph><paragraph id="H104B50C2F8454836B151D08E63E4E9B4"><enum>(2)</enum><text>is supervised by an officer who—</text>
										<subparagraph id="H3B2C8031B2174103A205AA15C2C75BAB"><enum>(A)</enum><text>meets the condition described in paragraph (1); and</text>
										</subparagraph><subparagraph id="H5662A351D1384444A994A11BA424B898"><enum>(B)</enum><text>has had substantial experience adjudicating asylum applications.</text>
										</subparagraph></paragraph></subsection><subsection id="H0181FD71BC284F55AFC1D4D821C614CA"><enum>(b)</enum><header>Proceeding</header>
									<paragraph id="H22A0E5EBEC784D0EBCCB0672C355A10D"><enum>(1)</enum><header>In general</header><text>Not later than 7 days after the screening of an unaccompanied alien child under section 235(a)(4)
			 of the <short-title>William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008</short-title> (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232(a)(4)</external-xref>), an immigration judge shall conduct a proceeding to inspect, screen, and
			 determine the status of an unaccompanied alien child who is an applicant
			 for admission to the United States.</text>
									</paragraph><paragraph id="H3CECE81445664B7296AEE9BBCBC25895"><enum>(2)</enum><header>Time limit</header><text>Not later than 72 hours after the conclusion of a proceeding with respect to an unaccompanied alien
			 child under this section, the immigration judge who conducted such
			 proceeding shall issue an order pursuant to subsection (e).</text>
									</paragraph></subsection><subsection id="HB8D7380CFA614AB3BC4546A1907860B6"><enum>(c)</enum><header>Conduct of proceeding</header>
									<paragraph id="H9778DBB4D16C4D67A29B1EE5C8C4CD8E"><enum>(1)</enum><header>Authority of immigration judge</header><text>The immigration judge conducting a proceeding under this section—</text>
										<subparagraph id="H3BAB469CBED7436EAE97A49D67D03A19"><enum>(A)</enum><text>shall administer oaths, receive evidence, and interrogate, examine, and cross-examine the alien and
			 any witnesses;</text>
										</subparagraph><subparagraph id="HF9DB64ED5A264EF69F15534A5538573A"><enum>(B)</enum><text>may issue subpoenas for the attendance of witnesses and presentation of evidence; and</text>
										</subparagraph><subparagraph id="H3FA18C243D31440C9A4D9DBF0F59F240"><enum>(C)</enum><text>is authorized to sanction by civil money penalty any action (or inaction) in contempt of the
			 judge’s proper exercise of authority under this Act.</text>
										</subparagraph></paragraph><paragraph id="H07921412B8C8486D8ED67F77B1D05A71"><enum>(2)</enum><header>Form of proceeding</header><text>A proceeding under this section may take place—</text>
										<subparagraph id="H2E1AE1D5FA76405F868F5916AB18E5F9"><enum>(A)</enum><text>in person;</text>
										</subparagraph><subparagraph id="H618249B4EE5D4A5587E012710760D24F"><enum>(B)</enum><text>at a location agreed to by the parties, in the absence of the alien;</text>
										</subparagraph><subparagraph id="HE5747B5324574C4DBE86A46DF5CCDCBA"><enum>(C)</enum><text>through video conference; or</text>
										</subparagraph><subparagraph id="HE5FE38C101B54077A03BFF43B44F7353"><enum>(D)</enum><text>through telephone conference.</text>
										</subparagraph></paragraph><paragraph id="H769CD7DC93A247C0A86E5A1993783EE5"><enum>(3)</enum><header>Presence of alien</header><text>If it is impracticable by reason of an alien's mental incompetency for the alien to be present at
			 the proceeding, the Attorney General shall prescribe safeguards to protect
			 the rights and privileges of the alien.</text>
									</paragraph><paragraph id="HD9E8828836424C91A4C76570462F4BFF"><enum>(4)</enum><header>Rights of the alien</header><text>In a proceeding under this section—</text>
										<subparagraph id="H18014ED8D2F14A6D8A093182F9128C53"><enum>(A)</enum><text>the alien shall be given the privilege of being represented, at no expense to the Government, by
			 counsel of the alien’s choosing who is authorized to practice in such
			 proceedings;</text>
										</subparagraph><subparagraph id="HDE29388979154B348E11A57605CC4B65"><enum>(B)</enum><text>the alien shall be given a reasonable opportunity—</text>
											<clause id="H2F8EE58B7C624C67AA4F8F853869A1D2"><enum>(i)</enum><text>to examine the evidence against the alien;</text>
											</clause><clause id="H42D4BAB23C724C94B37A0477674A375C"><enum>(ii)</enum><text>to present evidence on the alien’s own behalf; and</text>
											</clause><clause id="H6B5ADF094A7E4307B57784E15F91CFD2"><enum>(iii)</enum><text>to cross-examine witnesses presented by the Government;</text>
											</clause></subparagraph><subparagraph id="H4F426F71BFDE419380DC4F76B548B13E"><enum>(C)</enum><text>the rights set forth in subparagraph (B) shall not entitle the alien—</text>
											<clause id="H12269410AA4D41CE8BA165C7F65D79D6"><enum>(i)</enum><text>to examine such national security information as the Government may proffer in opposition to the
			 alien’s admission to the United States; or</text>
											</clause><clause id="H89F2B4437B8641D98E6C327445131954"><enum>(ii)</enum><text>to an application by the alien for discretionary relief under this Act; and</text>
											</clause></subparagraph><subparagraph id="H9253B8E006D34E09946EBC0DC17D2DB2"><enum>(D)</enum><text>a complete record shall be kept of all testimony and evidence produced at the proceeding.</text>
										</subparagraph></paragraph><paragraph id="H89C4434A9E3C45D495B46FA0496FF08A"><enum>(5)</enum><header>Withdrawal of application for admission</header><text>In the discretion of the Attorney General, an alien applying for admission to the United States
			 may, and at any time, be permitted to withdraw such application and
			 immediately be returned to the alien’s country of nationality or country
			 of last habitual residence.</text>
									</paragraph></subsection><subsection id="H711632F997654F3E8B7EC1FD872465B2"><enum>(d)</enum><header>Decision and burden of proof</header>
									<paragraph id="HCD49966DB0894FA9B7EF387669F4ECB3"><enum>(1)</enum><header>Decision</header>
										<subparagraph id="H277AECB370C34792AC34FB22A512C012"><enum>(A)</enum><header>In general</header><text>At the conclusion of a proceeding under this section, the immigration judge shall determine whether
			 an unaccompanied alien child is likely to be—</text>
											<clause id="H98ABB0986CBD4E4DA7BF1AFA40D3B65C"><enum>(i)</enum><text>admissible to the United States; or</text>
											</clause><clause id="HE5230BF86990439B8C9C3E330BC6EB61"><enum>(ii)</enum><text>eligible for any form of relief from removal under this Act.</text>
											</clause></subparagraph><subparagraph id="H039A2B44B7A847CABD32DA9622CF9A7E"><enum>(B)</enum><header>Evidence</header><text>The determination of the immigration judge under subparagraph (A) shall be based only on the
			 evidence produced at the hearing.</text>
										</subparagraph></paragraph><paragraph id="H1E9C4877E2554267966A3D5E7C3C652B"><enum>(2)</enum><header>Burden of proof</header>
										<subparagraph id="H601F23FD827D455B8C526E9DC4BDDE9B"><enum>(A)</enum><header>In general</header><text>In a proceeding under this section, an alien who is an applicant for admission has the burden of
			 establishing, by a preponderance of the evidence, that the alien—</text>
											<clause id="H4DF02490D1204D4FA673F0305F1AFCA7"><enum>(i)</enum><text>is likely to be entitled to be lawfully admitted to the United States or eligible for any form of
			 relief from removal under this Act; or</text>
											</clause><clause id="H4AF9EBCA151B49EA8707312B4814D51E"><enum>(ii)</enum><text>is lawfully present in the United States pursuant to a prior admission.</text>
											</clause></subparagraph><subparagraph id="H4BACD416C18E4DE29B7E4966ECF70837"><enum>(B)</enum><header>Access to documents</header><text>In meeting the burden of proof under subparagraph (A)(ii), the alien shall be given access to—</text>
											<clause id="H22109874CD974019A8294CFAF2C84845"><enum>(i)</enum><text>the alien’s visa or other entry document, if any; and</text>
											</clause><clause id="H2632201E9D76438DA5DF25344DF3932D"><enum>(ii)</enum><text>any other records and documents, not considered by the Attorney General to be confidential,
			 pertaining to the alien’s admission or presence in the United States.</text>
											</clause></subparagraph></paragraph></subsection><subsection id="H4D3B5AB26D2E475FAE3684508AD5A46C"><enum>(e)</enum><header>Orders</header>
									<paragraph id="H945237A42FED4AF888A18F4124AC93BE"><enum>(1)</enum><header>Placement in further proceedings</header><text>If an immigration judge determines that the unaccompanied alien child has met the burden of proof
			 under subsection (d)(2), the judge shall order the alien to be placed in
			 further proceedings in accordance with section 240.</text>
									</paragraph><paragraph id="HB7A3A6DD13434068ABFB76FF8E27A338"><enum>(2)</enum><header>Orders of removal</header><text>If an immigration judge determines that the unaccompanied alien child has not met the burden of
			 proof required under subsection (d)(2), the judge shall order the alien
			 removed from the United States without further hearing or review unless
			 the alien claims—</text>
										<subparagraph id="H5A042F1EE27B45A4A32BFD738144EBB0"><enum>(A)</enum><text>an intention to apply for asylum under section 208; or</text>
										</subparagraph><subparagraph id="HFAF8920B626748C88752E4FD722DFF05"><enum>(B)</enum><text>a fear of persecution.</text>
										</subparagraph></paragraph><paragraph id="HACCDB3787DF34C608B69722DA7AFD279"><enum>(3)</enum><header>Claims for asylum</header><text>If an unaccompanied alien child described in paragraph (2) claims an intention to apply for asylum
			 under section 208 or a fear of persecution, the officer shall order the
			 alien referred for an interview by an asylum officer under subsection (f).</text>
									</paragraph></subsection><subsection id="HDD6D3AFD94A9473083728A3052F97ED7"><enum>(f)</enum><header>Asylum interviews</header>
									<paragraph id="H33BFC4085605482E9F45C00D2FEFF639"><enum>(1)</enum><header>Defined term</header><text>In this subsection, the term <term>credible fear of persecution</term> means, after taking into account the credibility of the statements made by the alien in support of
			 the alien’s claim and such other facts as are known to the officer, there
			 is a significant possibility that the alien could establish eligibility
			 for asylum under section 208.</text>
									</paragraph><paragraph id="H145F6DA93BC84CCCBF4EA1FF2C984965"><enum>(2)</enum><header>Conduct by asylum officer</header><text>An asylum officer shall conduct interviews of aliens referred under subsection (e)(3).</text>
									</paragraph><paragraph id="H9C22F921ADE54AF7959F230A53C45EDB"><enum>(3)</enum><header>Referral of certain aliens</header><text>If the officer determines at the time of the interview that an alien has a credible fear of
			 persecution, the alien shall be held in the custody of the Secretary of
			 Health and Human Services pursuant to section 235(b) of the William
			 Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (8
			 U.S.C. 1232(b)) during further consideration of the application for
			 asylum.</text>
									</paragraph><paragraph id="HD2E257B846CF42DD9C3AB13610E446A2"><enum>(4)</enum><header>Removal without further review if no credible fear of persecution</header>
										<subparagraph id="H7BEE333724D545D0B694BC62362088BC"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (C), if the asylum officer determines that an alien does not have a
			 credible fear of persecution, the officer shall order the alien removed
			 from the United States without further hearing or review.</text>
										</subparagraph><subparagraph id="HB0C10C49A1F541DCB574F0AB0A9F4163"><enum>(B)</enum><header>Record of determination</header><text>The officer shall prepare a written record of a determination under subparagraph (A), which shall
			 include—</text>
											<clause id="H28DF206EDBA644EBA17EF00C8BBCF92F"><enum>(i)</enum><text>a summary of the material facts as stated by the applicant;</text>
											</clause><clause id="H2162A95C04614E57B8D87B8CC425C9C9"><enum>(ii)</enum><text>such additional facts (if any) relied upon by the officer;</text>
											</clause><clause id="H0009E0FC693643719F53AD0D4B0411BA"><enum>(iii)</enum><text>the officer's analysis of why, in light of such facts, the alien has not established a credible
			 fear of persecution; and</text>
											</clause><clause id="HA3765D11BB3749FAA3BCCF7F50CD4E52"><enum>(iv)</enum><text>a copy of the officer’s interview notes.</text>
											</clause></subparagraph><subparagraph id="HB4D16A1671314A639676BA9DE2ABF3A0"><enum>(C)</enum><header>Review of determination</header>
											<clause id="HA9566806981042B68442FBD5A20DE23D"><enum>(i)</enum><header>Rulemaking</header><text>The Attorney General shall establish, by regulation, a process by which an immigration judge will
			 conduct a prompt review, upon the alien’s request, of a determination
			 under subparagraph (A) that the alien does not have a credible fear of
			 persecution.</text>
											</clause><clause id="H6B6CB24ABB0446CFAE8B7941C034321C"><enum>(ii)</enum><header>Mandatory components</header><text>The review described in clause (i)—</text>
												<subclause id="HC19AEEE5118741958B6DE869EE2C151C"><enum>(I)</enum><text>shall include an opportunity for the alien to be heard and questioned by the immigration judge,
			 either in person or by telephonic or video connection; and</text>
												</subclause><subclause id="H4E85B3D213624A1D97DAD0F8729E4542"><enum>(II)</enum><text>shall be conducted—</text>
													<item id="H471D30976C7F443CADD6253E28BE9D9F"><enum>(aa)</enum><text>as expeditiously as possible;</text>
													</item><item id="HD27450A1D913422388C255D2AE552693"><enum>(bb)</enum><text>within the 24-hour period beginning at the time the asylum officer makes a determination under
			 subparagraph (A), to the maximum extent practicable; and</text>
													</item><item id="HE0DBC65001A944C085610C978B26CC3B"><enum>(cc)</enum><text>in no case later than 7 days after such determination.</text>
													</item></subclause></clause></subparagraph><subparagraph id="HB857D8DF9D94437CBCE87C0C0087843B"><enum>(D)</enum><header>Mandatory protective custody</header><text>Any alien subject to the procedures under this paragraph shall be held in the custody of the
			 Secretary of Health and Human Services pursuant to Section 235(b) of the
			 William Wilberforce Trafficking Victims Protection Reauthorization Act of
			 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232(b)</external-xref>)—</text>
											<clause id="H7717B3F8408F4B7A8F52DE4BA4EED260"><enum>(i)</enum><text>pending a final determination of credible fear of persecution; and</text>
											</clause><clause id="H7864789860CB44C39CECDD16FD831426"><enum>(ii)</enum><text>after a determination that the alien does not such a fear, until the alien is removed.</text>
											</clause></subparagraph></paragraph></subsection><subsection id="H91A136971D9F4B0A823A0E6ED0A6857D"><enum>(g)</enum><header>Limitation on administrative review</header>
									<paragraph id="HB21FA145DD1842C5B09B1635DDC55081"><enum>(1)</enum><header>In general</header><text>Except as provided in subsection (f)(4)(C) and paragraph (2), a removal order entered in accordance
			 with subsection (e)(2) or (f)(4)(A) is not subject to administrative
			 appeal.</text>
									</paragraph><paragraph id="H914765EA5F7A4F449152EBE8135FA1FA"><enum>(2)</enum><header>Rulemaking</header><text>The Attorney General shall establish, by regulation, a process for the prompt review of an order
			 under subsection (e)(2) against an alien who claims under oath, or as
			 permitted under penalty of perjury under <external-xref legal-doc="usc" parsable-cite="usc/28/1746">section 1746</external-xref> of title 28, United
			 States Code, after having been warned of the penal ties for falsely making
			 such claim under such conditions to have been—</text>
										<subparagraph id="H970E9EE1F5E544449E78761428502FBB"><enum>(A)</enum><text>lawfully admitted for permanent residence;</text>
										</subparagraph><subparagraph id="HCE5327FFA51B4A1E8C959DFB6C53C5F0"><enum>(B)</enum><text>admitted as a refugee under section 207; or</text>
										</subparagraph><subparagraph id="H13D7DCFDB7B54D4482485C6491609360"><enum>(C)</enum><text>granted asylum under section 208.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H8BFF4731864744C9BD1002D71B28901D"><enum>(2)</enum><header>Clerical amendment</header><text>The table of contents for the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>) is amended
			 by inserting after the item relating to section 235A the following:</text>

					</paragraph></subsection><subsection id="H4370C81AE6BD45C98EFADD87B63528D9"><enum>(b)</enum><header>Judicial review of orders of removal</header><text>Section 242 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1252">8 U.S.C. 1252</external-xref>) is amended—</text>
					<paragraph id="H6A3C574034BB42F7900E54FC382BF2AD"><enum>(1)</enum><text>in subsection (a)—</text>

						</subparagraph></paragraph></subsection></section><section id="H1CC75E58814E47CE944FE7489C39E1D4"><enum>103.</enum><header>Due process protections for unaccompanied alien children present in the United States</header>
				<subsection id="H39988F5131F64541989E461FAE40F400"><enum>(a)</enum><header>Special motions for unaccompanied alien children</header>
					<paragraph id="HED88B0DE83234E5895BDC19A3568032E"><enum>(1)</enum><header>Filing authorized</header><text>Beginning on the date that is 60 days after the date of the enactment of this Act, the Secretary of
			 Homeland Security, notwithstanding any other provision of law, may, at the
			 sole and unreviewable discretion of the Secretary, permit an unaccompanied
			 alien child who was issued a Notice to Appear under section 239 of the
			 Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229">8 U.S.C. 1229</external-xref>) during the period
			 beginning on January 1, 2013, and ending on the date of the enactment of
			 this Act—</text>
						<subparagraph id="H148B57B9C18146118B839460F970FBE5"><enum>(A)</enum><text>to appear, in-person, before an immigration judge who has been authorized by the Attorney General
			 to conduct proceedings under section 235B of the Immigration and
			 Nationality Act, as added by section 102;</text>
						</subparagraph><subparagraph id="H4DF67C655EEF4A97B17F0B6B47A45572"><enum>(B)</enum><text>to attest to their desire to apply for admission to the United States; and</text>
						</subparagraph><subparagraph id="H516DB7F5A3314AD4A3A4303B9FA55D01"><enum>(C)</enum><text>to file a motion—</text>
							<clause id="HF1F18F860EC749F186CA847BEFFFCE4A"><enum>(i)</enum><text>to expunge—</text>
								<subclause id="H29AEC3A850504A65A1DFDD8A0CDE5EA3"><enum>(I)</enum><text>any final order of removal issued against them between January 1, 2013, and the date of the
			 enactment of this Act under section 240 of the Immigration and Nationality
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229a">8 U.S.C. 1229a</external-xref>); or</text>
								</subclause><subclause id="H5C7F25401F76462892A2E0FADD6430BE"><enum>(II)</enum><text>any Notice to Appear issued between January 1, 2013, and the date of the enactment of this Act
			 under
			 section 239 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229">8 U.S.C. 1229</external-xref>); and</text>
								</subclause></clause><clause id="H74464FDE52384CA88C030A90D4A39565"><enum>(ii)</enum><text>to apply for admission to the United States by being placed in proceedings under section 235B of
			 the Immigration and Nationality Act.</text>
							</clause></subparagraph></paragraph><paragraph id="HE5094943F8664C1D88B65A6233241401"><enum>(2)</enum><header>Motion granted</header><text>An immigration judge may, at the sole and unreviewable discretion of the judge, grant a motion
			 filed under paragraph (1)(C) upon a finding that—</text>
						<subparagraph id="H1F9A6DB485C14EE6A86DEC045B77B9FA"><enum>(A)</enum><text>the petitioner was an unaccompanied alien child (as defined in section 235 of the William
			 Wilberforce Trafficking Victims Protection Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232</external-xref>)) on
			 the date on which a Notice to Appear described in paragraph (1) was issued
			 to the alien;</text>
						</subparagraph><subparagraph id="HA806777B08F745EDB9CF1D4DFA66BDEC"><enum>(B)</enum><text>the Notice to Appear was issued during the period beginning on January 1, 2013, and ending on the
			 date of the enactment of this Act;</text>
						</subparagraph><subparagraph id="H95C49A55118946298BE8672B73674E3C"><enum>(C)</enum><text>the unaccompanied alien child is applying for admission to the United States; and</text>
						</subparagraph><subparagraph id="H6E0B07C13466468299241D8491CC28A6"><enum>(D)</enum><text>the granting of such motion would not be manifestly unjust.</text>
						</subparagraph></paragraph><paragraph id="HCC064D371C784FCD83E82E6330CAC224"><enum>(3)</enum><header>Effect of motion</header><text>Notwithstanding any other provision of law, upon the granting of a motion to expunge under
			 paragraph (2)—</text>
						<subparagraph id="H81C1F12D91AB4F1AB05B0CBC722D5DDD"><enum>(A)</enum><text>the Secretary of Homeland Security shall immediately expunge any final order of removal resulting
			 from a proceeding initiated by any Notice to Appear described in paragraph
			 (1), and such Notice to Appear; and</text>
						</subparagraph><subparagraph id="H27055CB5F8FE4022BD317E83169CE5B0"><enum>(B)</enum><text>the immigration judge who granted such motion shall, while the petitioner remains in-person,
			 immediately inspect and screen the petitioner for admission to the United
			 States by conducting a proceeding under section 235B of the Immigration
			 and Nationality Act.</text>
						</subparagraph></paragraph><paragraph id="HDBA915C12C004379A3EDE5684D8C6911"><enum>(4)</enum><header>Protective custody</header><text>An unaccompanied alien child who has been granted a motion under paragraph (2) shall be held in the
			 custody of the Secretary of Health and Human Services pursuant to section
			 235 of the William Wilberforce Trafficking Victims Protection
			 Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232</external-xref>).</text>
					</paragraph></subsection></section><section id="H9E93BFAA5B03450A91EB22F3135AB683"><enum>104.</enum><header>Emergency immigration judge resources</header>
				<subsection id="H059347BCA82A4C28A00C5B5DA636AD03"><enum>(a)</enum><header>Designation</header><text display-inline="yes-display-inline">Not later than 14 days after the date of the enactment of this Act, the Attorney General shall
			 designate up to 40 immigration judges, including through the hiring of
			 retired immigration judges or magistrate judges, or the reassignment of
			 current immigration judges, that are dedicated to conducting humane and
			 expedited inspection and screening for unaccompanied alien children under
			 section 235B of the Immigration and Nationality Act, as added by section
			 102.</text>
				</subsection><subsection id="HAA95DDFDD2DA4D18B75414518C389DFF"><enum>(b)</enum><header>Requirement</header><text display-inline="yes-display-inline">The Attorney General shall ensure that sufficient immigration judge resources are dedicated to the
			 purpose described in subsection (a) to comply with the requirement under
			 section 235B(b)(1) of the Immigration and Nationality Act.</text>
				</subsection></section><section id="H473640FACD354F6491EBE94025D26720"><enum>105.</enum><header>Protecting children from human traffickers, sex offenders, and other criminals</header><text display-inline="no-display-inline">Section 235(c)(3) of the William Wilberforce Trafficking Victims Protection Reauthorization Act of
			 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232(c)(3)</external-xref>) is amended—</text>
				<paragraph id="HDE3121687A584962BD95C41672361C85"><enum>(1)</enum><text>in subparagraph (A), by inserting <quote>, including a mandatory biometric criminal history check</quote> before the period at the end; and</text>
				</paragraph><paragraph id="H4824192AECDB4F19AC90D391D3A27E3D"><enum>(2)</enum><text>by adding at the end the following—</text>
					<quoted-block display-inline="no-display-inline" id="HB607BE81BBF845CE8EDD5BC10842AD5C" style="OLC">
						<subparagraph id="H129870B974924023829F0B7BB44BD0DD"><enum>(D)</enum><header>Prohibition on placement with sex offenders and human traffickers</header>
							<clause id="H4ED4C89604AA4863A7F202D0AF27A3DC"><enum>(i)</enum><header>In general</header><text>The Secretary of Health and Human Services may not place an unaccompanied alien child in the
			 custody of an individual who has been convicted of—</text>
								<subclause id="HA803068C2BD249C09114D334632D3842"><enum>(I)</enum><text>a sex offense (as defined in section 111 of the Sex Offender Registration and Notification Act (42
			 U.S.C. 16911)); or</text>
								</subclause><subclause id="H0EC2401B66BD4576BD06FA73A57736EA"><enum>(II)</enum><text>a crime involving a severe form of trafficking in persons (as defined in section 103 of the
			 Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>)).</text>
								</subclause></clause><clause id="HA05A8CAE2A9B4C109895A253E0A2E718"><enum>(ii)</enum><header>Requirements of criminal background check</header><text>A biometric criminal history check under subparagraph (A) shall be based on a set of fingerprints
			 or other biometric identifiers and conducted through—</text>
								<subclause id="HFDAE90BCB3E34E0BBD8427FCDF7846CE"><enum>(I)</enum><text>the Identification Division of the Federal Bureau of Investigation; and</text>
								</subclause><subclause id="H9E0204374D9B4374BE2E9BF3E0BDDA7B"><enum>(II)</enum><text>criminal history repositories of all States that the individual lists as current or former
			 residences.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section></title><title id="H99D92B67F14D425DBB6B575D41DD5889" style="OLC"><enum>II</enum><header>Border Security and Trade Facilitation</header>
			<section id="HF0713E7F3E1D4F62A2463CD0FD697192"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
				<paragraph id="H89E2417A477A4564A5BEAFF104CB260B"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text>
					<subparagraph id="H6150F86334E04CCCB7EE4387CB6C7C73"><enum>(A)</enum><text>the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>; and</text>
					</subparagraph><subparagraph id="HDF0DC2FC11394784BC432D3927429511"><enum>(B)</enum><text>the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name>.</text>
					</subparagraph></paragraph><paragraph id="H106447E367BA465D947192809B755709"><enum>(2)</enum><header>Cocaine removal effectiveness rate</header><text>The term <term>cocaine removal effectiveness rate</term> means the percentage that results from dividing the amount of cocaine removed by the Department of
			 Homeland Security’s maritime security components inside or outside a
			 transit zone, as the case may be, by the total documented cocaine flow
			 rate as contained in Federal drug databases.</text>
				</paragraph><paragraph id="H52B3B11B84C546F3848CA1D3F173224D"><enum>(3)</enum><header>Consequence delivery system</header><text>The term <term>Consequence Delivery System</term> means the series of consequences applied to persons illegally entering the United States by the
			 Border Patrol to prevent illegal border crossing recidivism.</text>
				</paragraph><paragraph id="HA648003F8B0040C8875087A90A2EF04E"><enum>(4)</enum><header>Got away</header><text>The term <term>got away</term> means an illegal border crosser who, after making an illegal entry into the United States, is not
			 turned back or apprehended.</text>
				</paragraph><paragraph id="H268F2C3D966A4AE79E9A19AF9B200462"><enum>(5)</enum><header>High traffic areas</header><text>The term <term>high traffic areas</term> means sectors along the northern and southern borders of the United States that are within the
			 responsibility of the Border Patrol that have the most illicit
			 cross-border activity, informed through situational awareness.</text>
				</paragraph><paragraph id="H67D73A03E83944F7A3FA55580947EFA5"><enum>(6)</enum><header>Illegal border crossing effectiveness rate</header><text>The term <term>illegal border crossing effectiveness rate</term> means the percentage that results from dividing the number of apprehensions and turn backs by the
			 number of apprehensions, turn backs, and got aways. The data used by the
			 Secretary of Homeland Security to determine such rate shall be collected
			 and reported in a consistent and standardized manner across all Border
			 Patrol sectors.</text>
				</paragraph><paragraph id="H34C1FD3CC3F34003A7E2D01796E8FCBD"><enum>(7)</enum><header>Major violator</header><text>The term <term>major violator</term> means a person or entity that has engaged in serious criminal activities at any land, air, or sea
			 port of entry, including possession of illicit drugs, smuggling of
			 prohibited products, human smuggling, weapons possession, use of
			 fraudulent United States documents, or other offenses serious enough to
			 result in arrest.</text>
				</paragraph><paragraph id="HF24BEEE57B414116B58021CA3C71CCE6"><enum>(8)</enum><header>Operational control</header><text>The term <term>operational control</term> means a condition in which there is a not lower than 90 percent illegal border crossing
			 effectiveness rate, informed by situational awareness, and a significant
			 reduction in the movement of illicit drugs and other contraband through
			 such areas is being achieved.</text>
				</paragraph><paragraph id="H45428977BC5441508EA07A21A6B4235F"><enum>(9)</enum><header>Situational awareness</header><text>The term <term>situational awareness</term> means knowledge and an understanding of current illicit cross-border activity, including
			 cross-border threats and trends concerning illicit trafficking and
			 unlawful crossings along the international borders of the United States
			 and in the maritime environment, and the ability to forecast future shifts
			 in such threats and trends.</text>
				</paragraph><paragraph id="HCE857B443D7A43B091E67713E1DB1D2A"><enum>(10)</enum><header>Transit zone</header><text>The term <term>transit zone</term> means the sea corridors of the western Atlantic Ocean, the Gulf of Mexico, the Caribbean Sea, and
			 the eastern Pacific Ocean through which undocumented migrants and illicit
			 drugs transit, either directly or indirectly, to the United States.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2CA415DDEDE2468B9A7BA0F4D7CCA2FD"><enum>(11)</enum><header>Turn back</header><text>The term <term>turn back</term> means an illegal border crosser who, after making an illegal entry into the United States, returns
			 to the country from which such crosser entered.</text>
				</paragraph></section><section id="H8D773FB0FF794FAB820030AE4C5B9051"><enum>202.</enum><header>Border security results</header>
				<subsection id="H7BA7330DB8EC4B7B985A679CB4D93A14"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, every 180 days thereafter until
			 the Comptroller General of the United States reports on the results of the
			 review described in section 203(k)(2)(B), and annually after the date of
			 such report, the Secretary of Homeland Security shall submit a report to
			 the appropriate congressional committees and the Government Accountability
			 Office that—</text>
					<paragraph id="H8BD846F91D574958845D1300519B6E98"><enum>(1)</enum><text>assesses and describes the state of situational awareness and operational control; and</text>
					</paragraph><paragraph id="HBBA6FF3F495A4F7BA2CA8F431599792B"><enum>(2)</enum><text>identifies the high traffic areas and the illegal border crossing effectiveness rate for each
			 sector along the northern and southern borders of the United States that
			 are within the responsibility of the Border Patrol.</text>
					</paragraph></subsection><subsection id="H66F40619C7E8474084AB4BED72E3D975"><enum>(b)</enum><header>GAO report</header><text>Not later than 90 days after receiving the initial report required under subsection (a), the
			 Comptroller General of the United States shall submit a report to the
			 appropriate congressional committees regarding the verification of the
			 data and methodology used to determine high traffic areas and the illegal
			 border crossing effectiveness rate.</text>
				</subsection></section><section id="HF6A87E35D91C42DE9CF5756C11950A4A"><enum>203.</enum><header>Strategy to achieve situational awareness and operational control of the border</header>
				<subsection id="HC7A8214E5EAD4F369EAF1AA011A7735E"><enum>(a)</enum><header>Strategy To secure the border</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Homeland
			 Security shall submit, to the appropriate congressional committees, a
			 comprehensive strategy for—</text>
					<paragraph id="H54B18BD506AE40FF9A3B294F1B57EB98"><enum>(1)</enum><text>gaining and maintaining situational awareness and operational control of high traffic areas not
			 later than 2 years after the date of the submission of the implementation
			 plan required under subsection (c); and</text>
					</paragraph><paragraph id="HD22DD8276D634CA4955724261BCC6FFD"><enum>(2)</enum><text>gaining and maintaining operational control along the Southwest border of the United States not
			 later than 5 years after such date of submission.</text>
					</paragraph></subsection><subsection id="H6FE7F7A135784B02970974359B988A33"><enum>(b)</enum><header>Contents of strategy</header><text>The strategy required under subsection (a) shall include a consideration of the following:</text>
					<paragraph id="H7B2573F11F0947328C9AFEE783716943"><enum>(1)</enum><text>An assessment of principal border security threats, including threats relating to the smuggling and
			 trafficking of humans, weapons, and illicit drugs.</text>
					</paragraph><paragraph id="H33B603A18CF84E04A65D6F284C43312D"><enum>(2)</enum><text>Efforts to analyze and disseminate border security and border threat information between the border
			 security components of the Department of Homeland Security and with other
			 appropriate Federal departments and agencies with missions associated with
			 the border.</text>
					</paragraph><paragraph id="H3181BCF918F5494D97D7F5037D8151A3"><enum>(3)</enum><text>Efforts to increase situational awareness, in accordance with privacy, civil liberties, and civil
			 rights protections, including—</text>
						<subparagraph id="H27F1E3C16F0444E3AE51EC4190DB049C"><enum>(A)</enum><text>surveillance capabilities developed or utilized by the Department of Defense, including any
			 technology determined to be excess by the Department of Defense; and</text>
						</subparagraph><subparagraph id="HA2DB4AC2236D4EB5BDBF22AB054B9E3B"><enum>(B)</enum><text>use of manned aircraft and unmanned aerial systems, including camera and sensor technology deployed
			 on such assets.</text>
						</subparagraph></paragraph><paragraph id="H916A319EB4EF4B6F831B02651728AF3C"><enum>(4)</enum><text>Efforts to detect and prevent terrorists and instruments of terrorism from entering the United
			 States.</text>
					</paragraph><paragraph id="H9F4030D2118149D0A3F3F3B5D454BEB3"><enum>(5)</enum><text>Efforts to ensure that any new border security technology can be operationally integrated with
			 existing technologies in use by the Department of Homeland Security.</text>
					</paragraph><paragraph id="H25BE5B9D2BAA464894F04FE17770282B"><enum>(6)</enum><text>An assessment of existing efforts and technologies used for border security and the effect of such
			 efforts and technologies on civil rights, private property rights, privacy
			 rights, and civil liberties.</text>
					</paragraph><paragraph id="H3B99E9897AC44677ADC7732D00D4A060"><enum>(7)</enum><text>Technology required to maintain, support, and enhance security and facilitate trade at ports of
			 entry, including nonintrusive detection equipment, radiation detection
			 equipment, biometric technology, surveillance systems, and other sensors
			 and technology that the Secretary of Homeland Security determines to be
			 necessary.</text>
					</paragraph><paragraph id="HA7CC3C2DFCE5499D9662355F60D763D0"><enum>(8)</enum><text>Operational coordination of the border security components of the Department of Homeland Security.</text>
					</paragraph><paragraph id="H6CF685F093F34847AA688FBB231DB353"><enum>(9)</enum><text>Lessons learned from Operation Jumpstart and Operation Phalanx.</text>

			 Federal law enforcement agencies that have jurisdiction on the northern or
			 southern borders, or in the maritime environment.</text>
					</paragraph><paragraph id="H80C2CA64972F4120917F268D14496EF8"><enum>(11)</enum><text>Border security information received from consultation with—</text>
						<subparagraph id="HA0A53A721E024ECCA48ECBC7273D7AD9"><enum>(A)</enum><text>State, local, tribal, and Federal law enforcement agencies that have jurisdiction on the northern
			 or southern border, or in the maritime environment; and</text>
						</subparagraph><subparagraph id="H572F2B677ABD45A2B95B323DD53BFF04"><enum>(B)</enum><text>border community stakeholders (including through public meetings with such stakeholders), including
			 representatives from border agricultural and ranching organizations and
			 representatives from business and civic organizations along the northern
			 or southern border.</text>
						</subparagraph></paragraph><paragraph id="HECB9EC1279F3497795DF978AEFE1B942"><enum>(12)</enum><text>Agreements with foreign governments that support the border security efforts of the United States,
			 including coordinated installation of standardized land border inspection
			 technology, such as license plate readers and RFID readers.</text>
					</paragraph><paragraph id="H7DF55A2C1F7B411A8E8BF19A36F47C89"><enum>(13)</enum><text>Staffing requirements for all border security functions.</text>
					</paragraph><paragraph id="HC2E6FF6C3E574705A6C74B81F82AE184"><enum>(14)</enum><text>A prioritized list of research and development objectives to enhance the security of the
			 international land and maritime borders of the United States.</text>
					</paragraph><paragraph id="HD77F0D50CA184837BAB8A8AF321D162D"><enum>(15)</enum><text>An assessment of training programs, including training programs regarding—</text>
						<subparagraph id="H6B5D7D8B82E440888B87392A1A65F5BE"><enum>(A)</enum><text>identifying and detecting fraudulent documents;</text>

			 human trafficking; and</text>
						</subparagraph><subparagraph id="H20C10278E4734F19829FB0137BAB776B"><enum>(E)</enum><text>social and cultural sensitivity toward border communities.</text>
						</subparagraph></paragraph><paragraph id="H6C9AD4D30EC14B899F4C5DBBEA20DC16"><enum>(16)</enum><text>Local crime indices of municipalities and counties along the southern border.</text>
					</paragraph><paragraph id="HB3A300530A724CDD8490539D01E215EB"><enum>(17)</enum><text>An assessment of how border security operations affect crossing times.</text>
					</paragraph><paragraph id="H78AD80A5386F41C8B05CD504AEDD5E20"><enum>(18)</enum><text>Resources and other measures that are necessary to achieve a 50-percent reduction in the average
			 wait times of commercial and passenger vehicles at international land
			 ports of entry along the southern border and the northern border.</text>
					</paragraph><paragraph id="H03B480A684564A6980A5CC57C027B0B1"><enum>(19)</enum><text>Metrics required under subsections (e), (f), and (g).</text>
					</paragraph></subsection><subsection id="H575B872150E94898811697BD27F8AD6F"><enum>(c)</enum><header>Implementation plan</header>
					<paragraph id="HFE2CAFB82C114E3CAD8E2AD0220F1670"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the submission of the strategy required under subsection (a), the
			 Secretary of Homeland Security shall submit, to the appropriate
			 congressional committees and to the Government Accountability Office, an
			 implementation plan for each of the border security components of the
			 Department of Homeland Security to carry out such strategy.</text>
					</paragraph><paragraph id="H20A2D524247547CDB1B8792D17DB2854"><enum>(2)</enum><header>Contents of plan</header><text>The implementation plan required under paragraph (1) shall—</text>
						<subparagraph id="H4083FF0E6FF24F5EB6BD14F6B5E17CD7"><enum>(A)</enum><text>specify what protections will be put in place to ensure that staffing and resources necessary for
			 the maintenance of operations at ports of entry are not diverted to the
			 detriment of such operations in favor of operations between ports of
			 entry; and</text>
						</subparagraph><subparagraph id="H1189BFCFA9D24DF4907F86343183DAA1"><enum>(B)</enum><text>include—</text>
							<clause id="H6055838333A54F65ABB93512A2FF2649"><enum>(i)</enum><text>an integrated master schedule and cost estimate, including lifecycle costs, for the activities
			 contained in such implementation plan; and</text>
							</clause><clause id="HEAB79C11B4E44598A7F96E4CD141E146"><enum>(ii)</enum><text>a comprehensive border security technology plan to improve surveillance capabilities that includes—</text>
								<subclause id="H896CC01C836A4FAB9C05D7C3F770838A"><enum>(I)</enum><text>a documented justification and rationale for technology choices;</text>
								</subclause><subclause id="HEEB872B653094D3B979A6A6ECFE879B0"><enum>(II)</enum><text>deployment locations;</text>
								</subclause><subclause id="HCD7C7486F54440A1BB06143DD8C16A61"><enum>(III)</enum><text>fixed versus mobile assets;</text>
								</subclause><subclause id="H695CC780996349319EE7D22B9E0541B9"><enum>(IV)</enum><text>a timetable for procurement and deployment;</text>
								</subclause><subclause id="H6285BE9D2FB64AF6BBB035F77C777CA7"><enum>(V)</enum><text>estimates of operation and maintenance costs;</text>
								</subclause><subclause id="H9AA6F6DE5D7346B1813941B248954E49"><enum>(VI)</enum><text>an identification of any impediments to the deployment of such technologies; and</text>
								</subclause><subclause id="H65D345BC4CEF4402B165211F230C435E"><enum>(VII)</enum><text>estimates of the relative cost effectiveness of various border security strategies and operations,
			 including—</text>
									<item id="H2097CFF292194547868E39A4C91782C0"><enum>(aa)</enum><text>the deployment of personnel and technology; and</text>
									</item><item id="H0FF74EE5F45F478190442EB6D8052346"><enum>(bb)</enum><text>the construction of new physical and virtual barriers.</text>
									</item></subclause></clause></subparagraph></paragraph><paragraph id="HF5D8BE0F4497486BACD7861310B38D1A"><enum>(3)</enum><header>Government accountability office review</header><text>Not later than 90 days after receiving the implementation plan in accordance with paragraph (1),
			 the Comptroller General of the United States shall submit an assessment of
			 such plan to the appropriate congressional committees a report on such
			 plan.</text>
					</paragraph></subsection><subsection id="H9BFCD14FCED54C9AA35E6BE62ACB94A8"><enum>(d)</enum><header>Periodic updates</header><text>Not later than 180 days after the submission of each Quadrennial Homeland Security Review required
			 under section 707 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/347">6 U.S.C. 347</external-xref>)
			 beginning with the first such Review that is due after the implementation
			 plan is submitted under subsection (c), the Secretary of Homeland Security
			 shall submit, to the appropriate congressional committees, an updated—</text>
					<paragraph id="H2D950BD1D8E344CDA3A2BDA9498CF9B6"><enum>(1)</enum><text>strategy under subsection (a); and</text>
					</paragraph><paragraph id="H9B2AF6535A3A49DFA2E9232335853F7F"><enum>(2)</enum><text>implementation plan under subsection (c).</text>
					</paragraph></subsection><subsection id="H5E36D6B6C9A0457B97D91C8D4DC80D99"><enum>(e)</enum><header>Metrics for securing the border between ports of entry</header><text>Not later than 120 days after the date of the enactment of this Act, the Secretary of Homeland
			 Security shall implement metrics, informed by situational awareness, to
			 measure the effectiveness of security between ports of entry, including—</text>
					<paragraph id="HBAE9D9FFABCE4862BDD826AB34969400"><enum>(1)</enum><text>an illegal border crossing effectiveness rate, informed by situational awareness;</text>
					</paragraph><paragraph id="H37D3379449A243EBA75D82087A58E3AC"><enum>(2)</enum><text>an illicit drugs seizure rate, which measures the amount and type of illicit drugs seized by the
			 Border Patrol in any fiscal year compared to an average of the amount and
			 type of illicit drugs seized by the Border Patrol for the immediately
			 preceding 5 fiscal years;</text>
					</paragraph><paragraph id="H214A842AEDDC41A69211575A41B5404B"><enum>(3)</enum><text>a cocaine seizure effectiveness rate, which shall be measured by calculating the percentage of the
			 total documented cocaine flow rate (as contained in Federal drug
			 databases) that is seized by the Border Patrol;</text>
					</paragraph><paragraph id="HFAC061DE7A4947E0A2597D9B137F1CB7"><enum>(4)</enum><text>estimates, using alternative methodologies, including recidivism data, survey data, known-flow
			 data, and technologically measured data, of—</text>
						<subparagraph id="H90DC923752A448A9855EF66F9649FB38"><enum>(A)</enum><text>total attempted illegal border crossings;</text>
						</subparagraph><subparagraph id="HC853A9B673454AD5B3B852E7B4C8497A"><enum>(B)</enum><text>total deaths and injuries resulting from such attempted illegal border crossings;</text>
						</subparagraph><subparagraph id="H155569297DF94085ACA6FA92BDB94A2A"><enum>(C)</enum><text>the rate of apprehension of attempted illegal border crossers; and</text>
						</subparagraph><subparagraph id="HA1FDB7D45C8A4FBFB537423E6128E084"><enum>(D)</enum><text>the inflow into the United States of illegal border crossers who evade apprehension; and</text>
						</subparagraph></paragraph><paragraph id="HD2665670D360435993B32CC27DCD8251"><enum>(5)</enum><text>estimates of the impact of the Border Patrol’s Consequence Delivery System on the rate of
			 recidivism of illegal border crossers.</text>
					</paragraph></subsection><subsection id="HFE78B06DC013457E9E210E2338E206A1"><enum>(f)</enum><header>Metrics for securing the border at ports of entry</header>
					<paragraph id="HF6762D0D3B984888B0A3FEF69617830D"><enum>(1)</enum><header>In general</header><text>Not later than 120 days after the date of the enactment of this Act, the Secretary of Homeland
			 Security shall implement metrics, informed by situational awareness, to
			 measure the effectiveness of security at ports of entry, which shall
			 include—</text>
						<subparagraph id="HD9EE482853BA4B408DBC87DF31D321E1"><enum>(A)</enum><text>an inadmissible border crossing rate, which measures the number of known inadmissible border
			 crossers who are apprehended, excluding those border crossers who
			 voluntarily withdraw their applications for admission, against the total
			 estimated number of inadmissible border crossers U.S. Customs and Border
			 Protection fails to apprehend;</text>
						</subparagraph><subparagraph id="H948A1361F3AB4D9AB7D789464E8AF762"><enum>(B)</enum><text>an illicit drugs seizure rate, which measures the amount and type of illicit drugs seized by U.S.
			 Customs and Border Protection in any fiscal year compared to an average of
			 the amount and type of illicit drugs seized by U.S. Customs and Border
			 Protection for the immediately preceding 5 fiscal years;</text>
						</subparagraph><subparagraph id="H3DB9AB66D2AB42D6871FE2C47BABC020"><enum>(C)</enum><text>a cocaine seizure effectiveness rate, which shall be measured by calculating the percentage of the
			 total documented cocaine flow rate (as contained in Federal drug
			 databases) that is seized by U.S. Customs and Border Protection;</text>
						</subparagraph><subparagraph id="H96836700E5DC425A83772C533803B0B2"><enum>(D)</enum><text>estimates, using alternative methodologies, including survey data and randomized secondary
			 screening data, of—</text>
							<clause id="H3054C6B9CF8046B0A1F5D1EBB7A3D6CF"><enum>(i)</enum><text>total attempted inadmissible border crossers;</text>
							</clause><clause id="H486253B9B1CA42C9812DDE813E4CA370"><enum>(ii)</enum><text>the rate of apprehension of attempted inadmissible border crossers; and</text>
							</clause><clause id="HE22096BDC5464003B6D830E0565E725B"><enum>(iii)</enum><text>the inflow into the United States of inadmissible border crossers who evade apprehension;</text>
							</clause></subparagraph><subparagraph id="H4AB536650F204123BB17D1B22A72F76E"><enum>(E)</enum><text>the number of infractions related to personnel and cargo committed by major violators who are
			 apprehended by U.S. Customs and Border Protection at ports of entry, and
			 the estimated number of such infractions committed by major violators who
			 are not so apprehended; and</text>
						</subparagraph><subparagraph id="H0CFAC1E459784095B5EDC880D1A1CB90"><enum>(F)</enum><text>a measurement of how border security operations affect crossing times.</text>
						</subparagraph></paragraph><paragraph id="H0AA66179B90E420786C32367524B3458"><enum>(2)</enum><header>Covert testing</header><text>The Inspector General of the Department of Homeland Security shall carry out covert testing at
			 ports of entry and submit to the Secretary of Homeland Security and the
			 appropriate congressional committees a report that contains the results of
			 such testing. The Secretary shall use such results to inform activities
			 under this subsection.</text>
					</paragraph></subsection><subsection id="H9922898A85CC4A0699DC5C9D96879DDE"><enum>(g)</enum><header>Metrics for securing the maritime border</header><text>Not later than 120 days after the date of the enactment of this Act, the Secretary of Homeland
			 Security shall implement metrics, informed by situational awareness, to
			 measure the effectiveness of security in the maritime environment, which
			 shall include—</text>
					<paragraph id="H7392A0B067024C139F834CA095BDF750"><enum>(1)</enum><text>an estimate of the total number of undocumented migrants the Department of Homeland Security’s
			 maritime security components fail to interdict;</text>
					</paragraph><paragraph id="H4352EB099F0C426898CDF327F8AAE68B"><enum>(2)</enum><text>an undocumented migrant interdiction rate, which measures the number of undocumented migrants
			 interdicted against the total estimated number of undocumented migrants
			 the Department of Homeland Security’s maritime security components fail to
			 interdict;</text>
					</paragraph><paragraph id="H8274CC7F884F4B5CAF478A4D5206A1AC"><enum>(3)</enum><text>an illicit drugs removal rate, which measures the amount and type of illicit drugs removed by the
			 maritime security components of the Department of Homeland Security inside
			 a transit zone in any fiscal year compared to an average of the amount and
			 type of illicit drugs removed by such components inside a transit zone for
			 the immediately preceding 5 fiscal years;</text>
					</paragraph><paragraph id="H42DC555EA400418BBFF7479D7B0351BE"><enum>(4)</enum><text>an illicit drugs removal rate, which measures the amount of illicit drugs removed by the maritime
			 security components of the Department of Homeland Security outside a
			 transit zone in any fiscal year compared to an average of the amount of
			 illicit drugs removed by such components outside a transit zone for the
			 immediately preceding 5 fiscal years;</text>
					</paragraph><paragraph id="H63F6D3102F684922B2D6FE5F70A06E0F"><enum>(5)</enum><text>a cocaine removal effectiveness rate inside a transit zone;</text>
					</paragraph><paragraph id="H8F6C4C7DC96946049F2A006388E5DC1F"><enum>(6)</enum><text>a cocaine removal effectiveness rate outside a transit zone; and</text>
					</paragraph><paragraph id="H2B59108A2B144D6DAEE96A837E2397DE"><enum>(7)</enum><text>a response rate which measures the Department of Homeland Security’s ability to respond to and
			 resolve known maritime threats, both inside and outside a transit zone, by
			 placing assets on-scene, compared to the total number of events with
			 respect to which the Department has known threat information.</text>
					</paragraph></subsection><subsection id="H94850738D0A0412EAE972C9150A61A0E"><enum>(h)</enum><header>Collaboration and consultation</header>
					<paragraph id="HBDE7756A99D648D68221319A310D49F8"><enum>(1)</enum><header>In general</header><text>The Secretary of Homeland Security shall collaborate with the head of a national laboratory within
			 the Department of Homeland Security laboratory network with expertise in
			 border security and the head of a border security university-based center
			 within the Department of Homeland Security centers of excellence network
			 to develop, and ensure the suitability and statistical validity of, the
			 metrics required under subsections (e), (f), and (g).</text>
					</paragraph><paragraph id="H7CC24D6AA35A4A038E3B9F0118C4BF4F"><enum>(2)</enum><header>Recommendations relating to certain other metrics</header><text>In carrying out paragraph (1), the head of the national laboratory and the head of a border
			 security university-based center shall make recommendations to the
			 Secretary of Homeland Security for other suitable metrics that may be used
			 to measure the effectiveness of border security.</text>
					</paragraph><paragraph id="H41F09705EBBD4CC39DA0961D6E963668"><enum>(3)</enum><header>Consultation</header><text>In addition to the collaboration described in paragraph (1), the Secretary shall also consult with
			 the Governors of every border State and the representatives of the Border
			 Patrol and U.S. Customs and Border Protection regarding the development of
			 the metrics required under subsections (e), (f), and (g).</text>
					</paragraph></subsection><subsection id="H39FDA79E01F946E29F98C44488B9C6DF"><enum>(i)</enum><header>Evaluation by the Government Accountability Office</header>
					<paragraph id="HF92848D7984448DFBB650112F5DDE2D0"><enum>(1)</enum><header>In general</header><text>The Secretary of Homeland Security shall provide the Government Accountability Office with the data
			 and methodology used to develop the metrics implemented under subsections
			 (e), (f), and (g).</text>
					</paragraph><paragraph id="H139C37E65F76491AB83311C26278A185"><enum>(2)</enum><header>Report</header><text>Not later than 270 days after receiving the data and methodology referred to in paragraph (1), the
			 Comptroller General of the United States shall submit a report to the
			 appropriate congressional committees on the suitability and statistical
			 validity of such data and methodology.</text>
					</paragraph></subsection><subsection id="HB24BC60096FB4CF085F8348E270DE464"><enum>(j)</enum><header>Certifications and reports relating to operational control</header>
					<paragraph id="HC7B94F66E7A249FAB3E3451F2357161D"><enum>(1)</enum><header>By the secretary of homeland security</header>
						<subparagraph id="H4B5BEF730DA0443F8F8EB71436C098A5"><enum>(A)</enum><header>Two years</header><text>If the Secretary of Homeland Security determines that situational awareness and operational control
			 of high traffic areas have been achieved not later than 2 years after the
			 date of the submission of the implementation plan required under
			 subsection (c), the Secretary shall submit an attestation of such
			 achievement to the appropriate congressional committees and the
			 Comptroller General of the United States.</text>
						</subparagraph><subparagraph id="HFDFEAD506FDE4A9A9A20DD6FE45E4BBD"><enum>(B)</enum><header>Five years</header><text>If the Secretary of Homeland Security determines that operational control along the southwest
			 border of the United States has been achieved not later than 5 years after
			 the date of the submission of the implementation plan required under
			 subsection (c), the Secretary shall submit an attestation of such
			 achievement to the appropriate congressional committees and the
			 Comptroller General of the United States.</text>
						</subparagraph><subparagraph id="HD805761DAC4E488B9FB3437188427247"><enum>(C)</enum><header>Annual updates</header><text>Every year beginning with the year after the Secretary of Homeland Security submits the attestation
			 under subparagraph (B), if the Secretary determines that operational
			 control along the southwest border of the United States is being
			 maintained, the Secretary shall submit an attestation of such maintenance
			 to the appropriate congressional committees and the Comptroller General of
			 the United States.</text>
						</subparagraph></paragraph><paragraph id="H39AC6790CB8949E8B47D2F2F1F77ECAA"><enum>(2)</enum><header>By the comptroller general</header>
						<subparagraph id="HC07C30E0DB7246CAB26A09AE830535B0"><enum>(A)</enum><header>Reviews</header><text>The Comptroller General of the United States shall review and assess the attestations of the
			 Secretary of Homeland Security under subparagraphs (A), (B), and (C) of
			 paragraph (1).</text>
						</subparagraph><subparagraph id="HE1B781A2C2B34D45AE34868027BA13B2"><enum>(B)</enum><header>Reports</header><text>Not later than 120 days after conducting the reviews described in subparagraph (A), the Comptroller
			 General of the United States shall submit a report on the results of each
			 such review to the appropriate congressional committees.</text>
						</subparagraph></paragraph></subsection><subsection id="HEBCB21573EC74410B4DE19D408C91C8A"><enum>(k)</enum><header>Failure To achieve situational awareness or operational control</header><text>If the Secretary of Homeland Security determines that situational awareness, operational control,
			 or both, as the case may be, has not been achieved by the dates referred
			 to in subparagraphs (A) and (B) of subsection (j)(1), as the case may be,
			 or if the Secretary determines that operational control is not being
			 annually maintained pursuant to subparagraph (C) of such subsection, the
			 Secretary shall, not later than 60 days after such dates, submit a report
			 to the appropriate congressional committees that—</text>
					<paragraph id="HD9B45810EE4C462E8AFAF8C74FD21324"><enum>(1)</enum><text>describes why situational awareness or operational control, or both, as the case may be, was not
			 achieved; and</text>
					</paragraph><paragraph id="H87B96CA11BD44BA9B9B1AA30785879AB"><enum>(2)</enum><text>includes a description of impediments incurred, potential remedies, and recommendations to achieve
			 situational awareness, operational control, or both, as the case may be.</text>
					</paragraph></subsection><subsection id="H046E2A9D928F4A6691F16C9353A17BD8"><enum>(l)</enum><header>Government accountability office report on border security duplication and cost effectiveness</header><text>Not later than 1 year after the date of the enactment of this Act, the Comptroller General of the
			 United States shall submit a report to the appropriate congressional
			 committees that addresses—</text>
					<paragraph id="H02B1F78116DE44158511DD1023983859"><enum>(1)</enum><text>areas of overlap in responsibilities within the border security functions of the Department of
			 Homeland Security; and</text>
					</paragraph><paragraph id="HD8EBEC8F352145A486518C9D272113DA"><enum>(2)</enum><text>the relative cost effectiveness of border security strategies, including deployment of additional
			 personnel and technology, and construction of virtual and physical
			 barriers.</text>
					</paragraph></subsection><subsection id="H7E9942B8E0FB4D03851254B2ED76108A"><enum>(m)</enum><header>Reports</header><text>Not later than 60 days after the date of the enactment of this Act and annually thereafter, the
			 Secretary of Homeland Security shall submit a report to the appropriate
			 congressional committees that contains—</text>
					<paragraph id="H9D55F3415C554DC5899687F3EB2E4103"><enum>(1)</enum><text>a resource allocation model for current and future year staffing requirements that includes—</text>
						<subparagraph id="HCCBE68B3329F4B45A07FADF8925083E6"><enum>(A)</enum><text>optimal staffing levels at all land, air, and sea ports of entry; and</text>
						</subparagraph><subparagraph id="HD424791268E442DB8EE1EF7966F59179"><enum>(B)</enum><text>an explanation of U.S. Customs and Border Protection methodology for aligning staffing levels and
			 workload to threats and vulnerabilities and their effects on cross border
			 trade and passenger travel across all mission areas;</text>
						</subparagraph></paragraph><paragraph id="HE1CACC28A073433580F85DC7E3BE4476"><enum>(2)</enum><text>detailed information on the level of manpower available at all land, air, and sea ports of entry
			 and between ports of entry, including the number of canine and
			 agricultural specialists assigned to each such port of entry;</text>
					</paragraph><paragraph id="H0AE83332B29448B19A02C72203C3098E"><enum>(3)</enum><text>detailed information that describes the difference between the staffing the model suggests and the
			 actual staffing at each port of entry and between the ports of entry; and</text>
					</paragraph><paragraph id="H03A7AC85087A43B7B36EDABB263CEB8D"><enum>(4)</enum><text>detailed information that examines the security impacts and competitive impacts of entering into a
			 reimbursement agreement with foreign governments for U.S. Customs and
			 Border Protection preclearance facilities.</text>
					</paragraph></subsection></section><section id="H10CB00C90BE4457D8F8DC1D4394166D5"><enum>204.</enum><header>Prohibition on land border crossing fee study</header><text display-inline="no-display-inline">The Secretary of Homeland Security may not conduct any study relating to the imposition of a border
			 crossing fee for pedestrians or passenger vehicles at land ports of entry
			 along the southern border or the northern border of the United States.</text>
			</section><section id="H613A52EF782D4984A05555B195BF652A"><enum>205.</enum><header>Border security resources</header>
				<subsection id="H418752DDCB4D43879F7D96C913A9F944"><enum>(a)</enum><header>Equipment and technology enhancements</header><text>Consistent with the Southern Border Security Strategy required under section 203, the Secretary of
			 Homeland Security, in consultation with the Commissioner of U.S. Customs
			 and Border Protection, shall upgrade existing technological assets and
			 equipment, and procure and deploy additional technological assets and
			 equipment on the southern border.</text>
				</subsection><subsection id="HE272E3D6A76542728F554BCF3F657B60"><enum>(b)</enum><header>Physical and tactical infrastructure improvements</header>
					<paragraph id="HB38985AF36334BC5B76CBE547CFED861"><enum>(1)</enum><header>Construction, upgrade, and acquisition of border control facilities</header><text>Consistent with the Southern Border Security Strategy required under section 203, the Secretary,
			 shall upgrade existing physical and tactical infrastructure of the
			 Department of Homeland Security, and construct and acquire additional
			 physical and tactical infrastructure on the southern border, including the
			 following:</text>
						<subparagraph id="H13C53700863448F79BB70A9CC5E58200"><enum>(A)</enum><text>U.S. Border Patrol stations.</text>
						</subparagraph><subparagraph id="H56FAC0FA1F57466CBA75D3EB5141C73A"><enum>(B)</enum><text>U.S. Border Patrol checkpoints.</text>
						</subparagraph><subparagraph id="H7661414149C348FF99AD5B3632D67BB3"><enum>(C)</enum><text>Forward operating bases.</text>
						</subparagraph><subparagraph id="H7E503907E2B6457A8379C679DDEBFD99"><enum>(D)</enum><text>Monitoring stations.</text>
						</subparagraph><subparagraph id="H9A26AD5A31D7432D9C51655EB97E6AD2"><enum>(E)</enum><text>Mobile command centers.</text>
						</subparagraph><subparagraph id="HF5E4D75ED689402EAB8F75DEE3B501E9"><enum>(F)</enum><text>Land border port of entry improvements.</text>
						</subparagraph><subparagraph id="H24BAC6CFAC974FF9927BD6007F845892"><enum>(G)</enum><text>Other necessary facilities, structures, and properties.</text>
						</subparagraph></paragraph></subsection><subsection id="HD12D73EBE84D4D2E861BE8550E9FF7A5"><enum>(c)</enum><header>Customs and border protection personnel enhancements</header>
					<paragraph id="HC437DEA779724136852371FBD037CA7B"><enum>(1)</enum><header>Additional officers</header><text>Consistent with the Southern Border Security Strategy required under section 203, the Secretary is
			 authorized to increase the number of trained active-duty U.S. Customs and
			 Border Protection officers deployed on the southern border, including—</text>
						<subparagraph id="H9BACF305A8E7482F954735DA74B7B2F6"><enum>(A)</enum><text>officers serving in the Office of the Border Patrol;</text>
						</subparagraph><subparagraph id="H99E7879C04B9412486273C8C8592B963"><enum>(B)</enum><text>officers serving in the Office of Air and Marine; and</text>
						</subparagraph><subparagraph id="HD0B4F278993144E1A2F01E6E017897A5"><enum>(C)</enum><text>officers serving in the Office of Field Operations, including officers stationed at land border
			 ports of entry.</text>
						</subparagraph></paragraph><paragraph id="HE03547A6EDC04E39960C6FD3B6556B0E"><enum>(2)</enum><header>Expedited training and deployment authority</header><text>When exercising authority under this section, the Secretary is authorized—</text>
						<subparagraph id="H43CFCD2E36E44886AD78CFA009A63DD9"><enum>(A)</enum><text>to conduct enhanced recruiting operations for U.S. Customs and Border Protection personnel;</text>
						</subparagraph><subparagraph id="HE96AA9DE66DE42CCBD662EE58B56D8F2"><enum>(B)</enum><text>to conduct additional training academies for U.S. Customs and Border Protection personnel; and</text>
						</subparagraph><subparagraph id="HE22779CB462F4202A064FDE7AF67247F"><enum>(C)</enum><text>to promulgate regulations allowing for the expedited training of U.S. Customs and Border Protection
			 personnel.</text>
						</subparagraph></paragraph></subsection><subsection id="HA3B7137980CF4D69AD416F817E54C9F0"><enum>(d)</enum><header>National Guard support for operations</header>
					<paragraph id="H91FC596C7CAC4DE192F1CC081BFFD6F4"><enum>(1)</enum><header>In general</header><text>Amounts authorized to be appropriated under this section may be expended, with the approval of the
			 Secretary of Defense and the Secretary of Homeland Security, for the
			 Governor of a State to order any units or personnel of the National Guard
			 of such State to perform operations and missions under section 502(f) of
			 title 32, United States Code, on the southern border.</text>
					</paragraph><paragraph id="H69E0E910D6E945A9875D7A901D3BE45D"><enum>(2)</enum><header>Assignment of operations and missions</header>
						<subparagraph id="H6DF1B4731A31451D9687E2BD6706D4C2"><enum>(A)</enum><header>In general</header><text>National Guard units and personnel deployed under paragraph (1) may be assigned such operations,
			 including missions specified in paragraph (3), as may be necessary to
			 provide assistance for operations on the southern border.</text>
						</subparagraph><subparagraph id="H446F91BB82044EF59F9B1CC77FDECCE7"><enum>(B)</enum><header>Nature of duty</header><text>The duty of National Guard personnel performing operations and missions described in subparagraph
			 (A) shall be full-time duty under title 32, United States Code.</text>
						</subparagraph></paragraph><paragraph id="H4C7867A44CB44DA5BB4F989A6ACA36BB"><enum>(3)</enum><header>Range of operations and missions</header><text>The operations and missions assigned under paragraph (2) shall include the temporary authority—</text>
						<subparagraph id="H4F188301B9B14B52A57301D07967018F"><enum>(A)</enum><text>to provide assistance for law enforcement, including the interdiction of human trafficking, illicit
			 drugs, and contraband crossing the border;</text>
						</subparagraph><subparagraph id="H61FD70CB80C1497BB2944B11BF090AE3"><enum>(B)</enum><text>to assist in the provision of humanitarian relief;</text>
						</subparagraph><subparagraph id="HD7D9BD2FD0C6405DA305D77A7B15BA1A"><enum>(C)</enum><text>to increase ground-based mobile surveillance systems;</text>
						</subparagraph><subparagraph id="H3485022DCCB54B5897CA58505B41B131"><enum>(D)</enum><text>to deploy additional unmanned aerial systems and manned aircraft sufficient to maintain continuous
			 surveillance of the southern border;</text>
						</subparagraph><subparagraph id="H6CE9829BD5544C7292C19FAD610FFB94"><enum>(E)</enum><text>to deploy and provide capability for radio communications interoperability between U.S. Customs and
			 Border Protection and State, local, and tribal law enforcement agencies;</text>
						</subparagraph><subparagraph id="HAC52E6A25F5A48BF82740BBADD7238CA"><enum>(F)</enum><text>to construct checkpoints along the southern border to bridge the gap to long-term permanent
			 checkpoints;</text>
						</subparagraph><subparagraph id="H977E96A7E6164C08B6BF07A366CB21D2"><enum>(G)</enum><text>to provide assistance to U.S. Customs and Border Protection, particularly in rural, high-trafficked
			 areas, as designated by the Commissioner of U.S. Customs and Border
			 Protection;</text>
						</subparagraph><subparagraph id="H238AAD98092944E6972C8F3C4FC1CA8E"><enum>(H)</enum><text>to enhance law enforcement rotary wing operations supporting quick reaction forces, medical air
			 evacuations, and incident awareness and assessment operations; and</text>
						</subparagraph><subparagraph id="H2B2514CCFF834029AD76A37C8D7B58B4"><enum>(I)</enum><text>to provide equipment and training to law enforcement agencies.</text>
						</subparagraph></paragraph><paragraph id="H5861FA7E4AFF48179F12D86D6A21B56F"><enum>(4)</enum><header>Materiel and logistical support</header><text>The Secretary of Defense shall deploy such materiel and equipment and logistical support as may be
			 necessary to ensure success of the operations and missions conducted by
			 the National Guard under this subsection.</text>
					</paragraph><paragraph id="HA5EF2F4D815242C48AA82E0E23E36FDC"><enum>(5)</enum><header>Exclusion from national guard personnel strength limitations</header><text>National Guard personnel deployed under paragraph (1) shall not be included in—</text>
						<subparagraph id="H682A48DB0B98401FB62ED4AB885DDF4C"><enum>(A)</enum><text>the calculation to determine compliance with limits on end strength for National Guard personnel;
			 or</text>
						</subparagraph><subparagraph id="HDB6B9098180F4C55A241551BE1300B4C"><enum>(B)</enum><text>limits on the number of National Guard personnel that may be placed on active duty for operational
			 support under <external-xref legal-doc="usc" parsable-cite="usc/10/115">section 115</external-xref> of title 10, United States Code.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0644CFF02876407E857BFD18B8EC5C8D"><enum>(6)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">There are authorized to be appropriated for fiscal years 2014 and 2015 such sums as may be
			 necessary to carry out this subsection.</text>
					</paragraph></subsection><subsection id="HFC7153CBD3E54480BB1CB205148C4B0C"><enum>(e)</enum><header>State and local assistance</header>
					<paragraph id="H19DE4A3A222A4EB89B65FC6C77D37A9B"><enum>(1)</enum><header>In general</header><text>The Federal Emergency Management Agency shall enhance law enforcement preparedness, humanitarian
			 responses, and operational readiness along the southern border through
			 Operation Stonegarden.</text>
					</paragraph><paragraph id="HF3A836BFF45D4DD9AA272083DD7C5539"><enum>(2)</enum><header>Grants and reimbursements</header>
						<subparagraph id="HADA6932C0F4E4212B7F42F994DBDDC76"><enum>(A)</enum><header>In general</header><text>For purposes of paragraph (1), amounts made available under this section shall be allocated for
			 grants and reimbursements to State and local governments in Border Patrol
			 Sectors on the southern border for personnel, overtime, travel, costs
			 related to combating illegal immigration and drug smuggling, and costs
			 related to providing humanitarian relief to unaccompanied alien children
			 who have entered the United States.</text>
						</subparagraph><subparagraph id="H8709057DD8104E78BAC3CFB92A76C49C"><enum>(B)</enum><header>Funding for state and local governments</header><text>Allocations for grants and reimbursements to State and local governments under this paragraph shall
			 be made by the Federal Emergency Management Agency through a competitive
			 process.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5180C0A383DB422DB5E5CF376E9B2039"><enum>(3)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">There are authorized to be appropriated for fiscal years 2014 and 2015 such sums as may be
			 necessary to carry out this subsection.</text>
