		<official-title>To amend title 49, United States Code, to reduce the fuel economy obligations of automobile
			 manufacturers whose fleets contain at least 50 percent fuel choice
			 enabling vehicles, and for other purposes.</official-title>

		<section id="H7884F92BEE094E4C87ED87B9E5E1F18C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fuel Choice for American Prosperity and Security Act of 2014</short-title></quote>.</text>
		</section><section id="H87E7D78F4ACD4C10898251692CDE3BE4"><enum>2.</enum><header>Fuel choice enabling manufacturers</header>
			<subsection id="H69EFC7233C0545E4B7664B53B6CD4C34"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/329">Chapter 329</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>
				<quoted-block id="H4F61049D2B554C73B5DCC8A83813411A" style="USC">
					<section id="H766F2F55414B4E9B98A97AE20A7B4861"><enum>32920.</enum><header>Fuel choice enabling manufacturers</header>
						<subsection id="HE7987ABE14CB4EAEA664DD6729D668B8"><enum>(a)</enum><header>Calculation of average fuel economy</header><text>The average fuel economy of a fuel choice enabling manufacturer is the sum of—</text>
							<paragraph id="HF221FBBCE1364D149F3EF9C255E341DC"><enum>(1)</enum><text>the average fuel economy of such manufacturer determined under section 32904; and</text>
							</paragraph><paragraph id="H4F65201D451A4C43A07F6064AD5C7ED5"><enum>(2)</enum><text>4 miles per gallon.</text>
							</paragraph></subsection><subsection id="H564085DD93F04B5ABBB6A837A2F1C30E"><enum>(b)</enum><header>Deemed compliance with greenhouse gas emission standards</header><text display-inline="yes-display-inline">If a fuel choice enabling manufacturer is in compliance with all applicable standards prescribed
			 under section 32902 for a model year, the automobiles manufactured by such
			 manufacturer in such model year are deemed to be in compliance with the
			 standards for emissions of greenhouse gases promulgated under section
			 202(a) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7521">42 U.S.C. 7521(a)</external-xref>).</text>
						</subsection><subsection id="H96E3E0A5ABFE4FE5B9C5A7B74B21C657"><enum>(c)</enum><header>Definitions</header><text>In this section:</text>
							<paragraph id="H6C0BCFC34F7B4029A95B118B4C2ADE35"><enum>(1)</enum><header>Biodiesel</header><text>The term <quote>biodiesel</quote> means diesel fuel which has been produced from a non-petroleum feedstock and which meets the
			 specifications of the ASTM D6751–03 standard.</text>
							</paragraph><paragraph id="H20639ADA783C49C5AB60AB94F5A5C800"><enum>(2)</enum><header>E<enum-in-header>85</enum-in-header></header><text display-inline="yes-display-inline">The term <quote>E85</quote> means a fuel mixture that contains up to 85 percent ethanol and meets the specifications of the
			 ASTM D5798 standard.</text>
							</paragraph><paragraph id="HD89068263A7F4057A03F784D18B631D3"><enum>(3)</enum><header>Flexible fuel vehicle</header><text>The term <quote>flexible fuel vehicle</quote> means a vehicle that has been warranted by its manufacturer to operate on gasoline, E85, and M85.</text>
							</paragraph><paragraph id="H59E3B039D825420E90DB7E94F19FCE14"><enum>(4)</enum><header>Fuel choice enabling manufacturer</header><text>The term <quote>fuel choice enabling manufacturer</quote> means a manufacturer whose total fleet of automobiles manufactured in a model year for sale in the
			 United States contains at least 50 percent fuel choice enabling vehicles.</text>
							</paragraph><paragraph id="HE6E489716493495FB23108FF28615B97"><enum>(5)</enum><header>Fuel choice enabling vehicle</header><text>The term <quote>fuel choice enabling vehicle</quote> means an automobile that—</text>
								<subparagraph id="HF0944C29F3EE48C692EADE3628CDE9D7"><enum>(A)</enum><text>has been warranted by its manufacturer to operate on natural gas, hydrogen, propane, or biodiesel;</text>
								</subparagraph><subparagraph id="H2F478F63930647BD89262923D2E025A0"><enum>(B)</enum><text>is a flexible fuel vehicle;</text>
								</subparagraph><subparagraph id="HEDD6B57CFD944B468DCFC6494B362F69"><enum>(C)</enum><text>is a plug-in electric drive vehicle;</text>
								</subparagraph><subparagraph id="HCFF5AF8B9E9B4A399C0F0665DFF2CB03"><enum>(D)</enum><text>is propelled solely by a fuel cell that can produce power without the use of petroleum or a
			 petroleum-based fuel; or</text>
								</subparagraph><subparagraph id="HC9E5D5D71643447DAF4FED5DAE3E77FE"><enum>(E)</enum><text>is propelled solely by something other than an internal combustion engine and is warranted by its
			 manufacturer to operate on something other than petroleum-based fuel.</text>
								</subparagraph></paragraph><paragraph id="HE2B964D5EF144167810995414C6C68EF"><enum>(6)</enum><header>Greenhouse gas</header><text display-inline="yes-display-inline">The term <quote>greenhouse gas</quote> means carbon dioxide, nitrous oxide, methane, hydrofluorocarbons, perfluorocarbons, sulfur
			 hexa­fluo­ride, or any other substance subject to regulation under section
			 202(a) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7521">42 U.S.C. 7521(a)</external-xref>) to address climate change.</text>
							</paragraph><paragraph id="H993E29DE8EA94CD386942405559A2F51"><enum>(7)</enum><header>M<enum-in-header>85</enum-in-header></header><text display-inline="yes-display-inline">The term <quote>M85</quote> means a fuel mixture that contains up to 85 percent methanol and meets the specifications of the
			 ASTM D5797 standard.</text>
							</paragraph><paragraph id="H1BA96E2CB3B744329642346462F80CBE"><enum>(8)</enum><header>Plug-in electric drive vehicle</header><text>The term <quote>plug-in electric drive vehicle</quote> has the meaning given such term in section 508(a) of the Energy Policy Act of 1992 (42 U.S.C.
			 13258(a)).</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H63A7411CD738478D81F1BF2EB0FFC9CF"><enum>(b)</enum><header>Average fuel economy defined</header><text>Paragraph (5) of <external-xref legal-doc="usc" parsable-cite="usc/49/32901">section 32901(a)</external-xref> of title 49, United States Code, is amended—</text>
				<paragraph id="HEDFDA5C46E484185928A97E9E93A65C9"><enum>(1)</enum><text>by striking the period at the end and inserting <quote>; or</quote>;</text>
				</paragraph><paragraph id="HFC55499E11C94FCEBEB7484616238698"><enum>(2)</enum><text>by striking <quote>means average</quote> and inserting the following:</text>
					<quoted-block display-inline="yes-display-inline" id="H59F4A36CCFF84ECEBCE28414599B4D37" style="USC"><text>means—</text><subparagraph id="H06EBEB065D2949BCA024CCED605E2725"><enum>(A)</enum><text display-inline="yes-display-inline">average</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H158739D4350745C0B2D4EC46A390F9F1"><enum>(3)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H44E8E68EF7C7461583CE26D98A3DC3BF" style="USC">
						<subparagraph id="HDC6D0B60461C4C47BD872CB955BE903C"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a fuel choice enabling manufacturer (as defined in section 32920), average fuel
			 economy determined under such section.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H6D88FCD17BBE4572A68D1E6C9CD08185"><enum>(c)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/329">chapter 329</external-xref> of title 49, United States Code, is amended by inserting after the
			 item relating to section 32919 the following:</text>

			</subsection><subsection id="H32761D494B0443AEB5E2EF03EA80BD18"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to model years beginning with model
			 year 2016.</text>
