<section id="HDCB21A240E6D44C1A8057B0D72096291" section-type="section-one"><enum>1.</enum><header>Authority to recoup bonuses or awards paid to employees of Department of Veterans Affairs</header> 
<subsection id="H042F51573B624622911747823C13EB41"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/7">Chapter 7</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text>

<section id="H3794317C06654F71935425C5915C0281"><enum>714.</enum><header>Recoupment of bonuses or awards paid to employees of Department</header> 
<subsection id="H1608912DFAA44EAD874A8F3EF20ACA75"><enum>(a)</enum><header>Recoupment</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary may issue an order directing an employee of the Department to repay the amount, or a portion of the amount, of any award or bonus paid to the employee under title 5, including under chapters 45 or 53 of such title, or this title if—</text> 
<paragraph id="HF0616588A05F46B69FECA03762135B13"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary determines such repayment appropriate pursuant to regulations prescribed by the Secretary to carry out this section; and</text> </paragraph> 
<paragraph id="HE9DC40F8B5D44CDBA24E0F732F53DE56"><enum>(2)</enum><text>the employee is afforded notice and an opportunity for a hearing conducted by the Secretary.</text> </paragraph></subsection> 
<subsection id="H8B3D8220F9F24B5EBC8BD8B2266F9F36"><enum>(b)</enum><header>Review</header><text display-inline="yes-display-inline">The decision of the Secretary regarding a repayment by an employee pursuant to subsection (a) is final and may not be reviewed by any other agency or any court.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H8230A3FBB6E842C7A15D8F24B7E532A1"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by adding at the end the following new item:</text>

<subsection id="HCE25A08CB1CA443EBE9A7A232CE68B6E"><enum>(c)</enum><header>Effective date</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/714">Section 714</external-xref> of title 38, United States Code, as added by subsection (a), shall apply with respect to an award or bonus paid by the Secretary of Veterans Affairs to an employee of the Department of Veterans Affairs before, on, or after the date of the enactment of this Act.</text> </subsection> 
<subsection id="H3947DF152DA8448EB86B53D4C08BE2B9"><enum>(d)</enum><header>Construction</header><text>Nothing in this Act or the amendments made by this Act may be construed to modify the certification issued by the Office of Personnel Management and the Office of Management and Budget regarding the performance appraisal system of the Senior Executive Service of the Department of Veterans Affairs.</text> </subsection></section> 
<section id="H15879FC652B94C9C86FA04FB9E74BFAE"><enum>2.</enum><header>Limitations on subcontracts under contracts with small business concerns owned and controlled by veterans</header> 
<subsection id="HB6012FB4F7184C4CB62A5306B75DEF39"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/8127">Section 8127</external-xref> of title 38, United States Code, is amended—</text> 
<paragraph id="HEAD88C92AB194A3E8B67893E9CBA8A62"><enum>(1)</enum><text>by redesignating subsection (l) as subsection (m); and</text> </paragraph> 
<paragraph id="H2324C1871E814B53B0D8F9CA603268B7"><enum>(2)</enum><text>by inserting after subsection (k) the following new subsection (l):</text>

<subsection id="HF0168996BDB445D78BE053A3BE44C1B9"><enum>(l)</enum><header>Limitations on subcontracting</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="HB5C0FA2BA52A4A11924701567359B4B0"><enum>(1)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="HF7336D4F9BC54816B3E608C0BC3AD7A9"><enum>(A)</enum><text>The requirements applicable to a covered small business concern under section 46 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/657s">15 U.S.C. 657s</external-xref>) shall apply with respect to a small business concern owned and controlled by a veteran with a service-connected disability or a small business concern owned and controlled by a veteran that is awarded a contract that is counted for purposes of meeting the goals under subsection (a).</text> </subparagraph> 
<subparagraph changed="added" committee-id="HVR00" id="H1A0229E80F5C4A5C86B4B7C674914568" indent="up2" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">For purposes of applying the requirements of section 46 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/657s">15 U.S.C. 657s</external-xref>) pursuant to subparagraph (A), the term <quote>similarly situated entity</quote> used in such section 46 includes a subcontractor for a small business concern owned and controlled by a veteran with a service-connected disability or a small business concern owned and controlled by a veteran described in such subparagraph (A).</text> </subparagraph></paragraph> 
<paragraph changed="added" committee-id="HVR00" id="HB233DCEDFD5847B3B601BD8D6BB9DA52" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>Before awarding a contract that is counted for purposes of meeting the goals under subsection (a), the Secretary shall obtain from an offeror a certification that the offeror will comply with the requirements described in paragraph (1)(A) if awarded the contract. Such certification shall—</text> 
<subparagraph id="HA33B537110234EC99D5667896CCF5A00"><enum>(A)</enum><text>specify the exact performance requirements applicable under such paragraph; and</text> </subparagraph> 
<subparagraph id="HD2412D1C01F7493E875CFD0AF96FAA37"><enum>(B)</enum><text>explicitly acknowledge that the certification is subject to <external-xref legal-doc="usc" parsable-cite="usc/18/1001">section 1001</external-xref> of title 18.</text> </subparagraph></paragraph> 
<paragraph changed="added" committee-id="HVR00" id="H0AF7220B3461444D96D4C929A2B894CF" indent="up1" reported-display-style="italic"><enum>(3)</enum><text>If the Secretary determines that a small business concern that is awarded a contract that is counted for purposes of meeting the goals under subsection (a) did not act in good faith with respect to the requirements described in paragraph (1)(A), the small business concern shall be subject to the penalties specified in—</text> 
<subparagraph id="H68F30AFEA9CD4D3C91ABBD1F79B92810"><enum>(A)</enum><text display-inline="yes-display-inline">section 16(g)(1) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/645">15 U.S.C. 645(g)(1)</external-xref>); and</text> </subparagraph> 
<subparagraph id="H4137F36FA5C54C6AB368D14FAFFD8CCB"><enum>(B)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/18/1001">section 1001</external-xref> of title 18.</text> </subparagraph></paragraph> 
<paragraph changed="added" committee-id="HVR00" id="H7D9EC174F65049F8BB68FC1BDAF9F8AC" indent="up1" reported-display-style="italic"><enum>(4)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="HA5099DED734B46A5B7DCF4FB804EFE61"><enum>(A)</enum><text>The Director of Small and Disadvantaged Business Utilization for the Department, established pursuant to section 15(k) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644(k)</external-xref>), and the Chief Acquisition Officer of the Department, established pursuant to <external-xref legal-doc="usc" parsable-cite="usc/41/1702">section 1702</external-xref> of title 41, shall jointly implement a process using the systems described in section 16(g)(2) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/645">15 U.S.C. 645(g)(2)</external-xref>), or any other systems available, to monitor compliance with this subsection. The Director and the Chief Acquisition Officer shall jointly refer any violations of this subsection to the Inspector General of the Department.</text> </subparagraph> 
<subparagraph changed="added" committee-id="HVR00" id="H3A27BFB34298443A816846A20BF2C585" indent="up1" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">Not later than November 30 of each year, the Inspector General shall submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives a report for the fiscal year preceding the fiscal year during which the report is submitted that includes, for the fiscal year covered by the report—</text> 
<clause id="H04F1090B4CED4C1988197EFBE39227C0"><enum>(i)</enum><text>the number of referred violations received under subparagraph (A); and</text> </clause> 
<clause id="H6275742612F942D9955E7AC771222591"><enum>(ii)</enum><text>the disposition of such referred violations, including the number of small business concerns suspended or debarred from Federal contracting or referred to the Attorney General for prosecution.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection commented="no" id="H4FB9714E8D8347B8B8325C24AF7C0DC0"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">Subsection (l) of <external-xref legal-doc="usc" parsable-cite="usc/38/8127">section 8127</external-xref> of title 38, United States Code, as added by subsection (a) shall apply with respect to a contract entered into after the date of the enactment of this Act.</text> </subsection></section> 
<section id="H3017E6EAF21D4E93962DEE8554662DAD" section-type="subsequent-section"><enum>3.</enum><header>Review of lists of former prisoners of war</header> 
<subsection id="HDBE542309667411CAE9FFC2C6C394D6A"><enum>(a)</enum><header>Review of lists of prisoners of war</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall review the VA POW list and the DOD POW list to identify any discrepancies in such lists.</text> </subsection> 
<subsection id="HC50F4A9F48F249A3B8E42A0A28D54CA4"><enum>(b)</enum><header>Inspector General review of process</header><text display-inline="yes-display-inline">The Inspector General of the Department of Veterans Affairs shall review the process by which the Secretary determines that a veteran is a former prisoner of war, including whether the Secretary is following guidelines established by the Secretary to determine that a veteran is a former prisoner of war.</text> </subsection> 
<subsection id="H57397243E02041D7AC622A302108FFC3"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to Congress a report on the VA POW list, including the following:</text> 
<paragraph id="H67C9A33D7570454B96A80CD4E2F12BE3"><enum>(1)</enum><text display-inline="yes-display-inline">Any discrepancies, by period of conflict, in the number of prisoners of war included on the VA POW list and the DOD POW list.</text> </paragraph> 
<paragraph id="H7FB27E5F25A0465DBC417C0AF3B62229"><enum>(2)</enum><text>With respect to veterans included on the VA POW list who are not included on the DOD POW list, information regarding how such determinations were made, including what types of evidence were used, in a manner that does not personally identify such veterans.</text> </paragraph> 
<paragraph id="H6D8EC60F010C41C9990382617DBA12A0"><enum>(3)</enum><text display-inline="yes-display-inline">The results of the review of the Inspector General under subsection (b), without change.</text> </paragraph></subsection> 
<subsection id="H5062CF23D0E74C0A884F282B1598E133"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H7146225BA3864E94B78BC10C41CAE01B"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>DOD POW list</term> means the list maintained by the Secretary of Defense, acting through the Defense Prisoner of War/Missing Personnel Office, of members of the Armed Forces who were prisoners of war.</text> </paragraph> 
<paragraph id="HC8A6B56DA77448859F4F2D61B9C1D903"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>VA POW list</term> means the list maintained by the Secretary of Veterans Affairs of veterans whom the Secretary determines are former prisoners of war.</text> </paragraph></subsection></section> 
<section id="H06CEFB66DFCB45C7A6329FDBAC914068" section-type="subsequent-section"><enum>4.</enum><header>Limitation on expansion of dialysis pilot program</header> 
<subsection id="H26F996BD94BA41478886AE62E289A5B3"><enum>(a)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall not expand the dialysis pilot program or create any new dialysis capability provided by the Department of Veterans Affairs in any facility that is not an initial facility until after the date that—</text> 
<paragraph id="H140B6152D082453A95EA76198958C56B"><enum>(1)</enum><text>the Secretary has implemented the dialysis pilot program at each initial facility for a period of not less than two years;</text> </paragraph> 
<paragraph id="HB9F1499DD36B4D13899761F3AF73BFB4"><enum>(2)</enum><text>an independent analysis of the dialysis pilot program has been conducted at each initial facility; and</text> </paragraph> 
<paragraph id="H23B3B60BEA444035AEEE2D33EBBED611"><enum>(3)</enum><text>the report required by subsection (b) has been submitted.</text> </paragraph></subsection> 
<subsection id="HE0B9951E80504CFA8895CDA99844EF03"><enum>(b)</enum><header>Report</header><text>Not later than 60 days after the date of the completion of the independent analysis required by subsection (a)(2), the Secretary shall submit to Congress a report that—</text> 
<paragraph id="H756469B1A5254D218FEC9C52CE8688AF"><enum>(1)</enum><text display-inline="yes-display-inline">includes the results of that independent analysis, including a comparison of not only cost but non-cost factors such as access to care, quality of care, and Veteran satisfaction; and</text> </paragraph> 
<paragraph id="H1EC252BFB96A4DBF921475A791E081F2"><enum>(2)</enum><text>addresses any recommendations with respect to the dialysis pilot program provided in a report prepared by the Government Accountability Office.</text> </paragraph></subsection> 
<subsection id="HBB63B75DA83449B58DE75F561C2CAF25"><enum>(c)</enum><header>Use of existing dialysis resources</header><text display-inline="yes-display-inline">In order to increase the access of veterans to dialysis care and decrease the amount of time such veterans are required to travel to receive such care, the Secretary shall fully use the dialysis resources of the Department that exist as of the date of the enactment of this Act, including any community dialysis provider with which the Secretary has entered into a contract or agreement for the provision of such care.</text> </subsection> 
<subsection id="H1F4C7695A9014F768EAF875987331F43"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> 
<paragraph id="H8E80ABBF38C34119957A6AF66647A03A"><enum>(1)</enum><text>The term <term>dialysis pilot program</term> means the pilot demonstration program established by the Secretary in 2009 to provide dialysis care to patients at certain outpatient facilities operated by the Department of Veterans Affairs.</text> </paragraph> 
<paragraph id="H1F2916D3523F43A1A1E846D3EB769948"><enum>(2)</enum><text>The term <term>initial facility</term> means one of the four outpatient facilities identified by the Secretary to participate in the dialysis pilot program prior to the date of the enactment of this Act.</text> </paragraph></subsection></section>
