			 children, and for other purposes.</official-title>

		<section id="H638A395FD8884133A11319C1F5B3D585" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Children’s Firearm Marketing Safety Act</short-title></quote>.</text>
		</section><section id="H7433E4BF1BCA4225BFF82E41CC74A9D3"><enum>2.</enum><header>Prohibition of marketing firearms to children</header>
			<subsection commented="no" id="H5C00879AC47A4C9B99352C697DBC1D82"><enum>(a)</enum><header>Conduct prohibited</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Federal Trade Commission
			 shall promulgate rules in accordance with <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United
			 States Code, to prohibit any person from marketing firearms to children.
			 Such rules shall include the following:</text>
				<paragraph commented="no" id="HC9276209D0C64AA8B0069CDAB106DDCB"><enum>(1)</enum><text display-inline="yes-display-inline">A prohibition on the use of cartoon characters to promote firearms and firearm products.</text>
				</paragraph><paragraph commented="no" id="H36E91C88B1184E7EAE37484199F64B40"><enum>(2)</enum><text>A prohibition on firearm brand name merchandise marketed for children (such as hats, t-shirts, and
			 stuffed animals).</text>
				</paragraph><paragraph commented="no" id="H6B8BE3C7D790477389D9DA0BCC449F97"><enum>(3)</enum><text>A prohibition on the use of firearm marketing campaigns with the specific intent to appeal to
			 children.</text>
				</paragraph><paragraph commented="no" id="HA759E23491F7423F887E50EBE1FE70A3"><enum>(4)</enum><text>A prohibition on the manufacturing of a gun with colors or designs that are specifically designed
			 with the purpose to appeal to children.</text>
				</paragraph><paragraph commented="no" id="H66F783331C5A4B03982324D6EBD1F693"><enum>(5)</enum><text>A prohibition on the manufacturing of a gun intended for use by children that does not clearly and
			 conspicuously note the risk posed by the firearm by labeling somewhere
			 visible on the firearm any of the following:</text>
					<subparagraph id="HB3844A3755924BA681385C1DD75FA510"><enum>(A)</enum><text><quote>Real gun, not a toy.</quote>.</text>
					</subparagraph><subparagraph id="HC7166A91E2D44B0E99080C6BB6747E39"><enum>(B)</enum><text><quote>Actual firearm the use of which may result in death or serious bodily injury.</quote>.</text>
					</subparagraph><subparagraph id="H87024C8385D04A878C052432CCEB07AD"><enum>(C)</enum><text><quote>Dangerous weapon</quote>.</text>
					</subparagraph><subparagraph id="H07071E778488439AACBBBB59F7641E67"><enum>(D)</enum><text>Other similar language determined by the Federal Trade Commission.</text>
					</subparagraph></paragraph></subsection><subsection id="H5938527042CC4663A943BD88515D7677"><enum>(b)</enum><header>Enforcement</header>
				<paragraph id="H98A3FC7EE9464CBC86D659714DF5C3B2"><enum>(1)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of a rule promulgated under subsection (a) shall be treated as a violation of a
			 regulation under section 18(a)(1)(B) of the Federal Trade Commission Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>) regarding unfair or deceptive acts or practices.</text>
				</paragraph><paragraph id="HCF3B38D6961648FD8D34A7958C41F814"><enum>(2)</enum><header>Powers of Commission</header><text>The Federal Trade Commission shall enforce this Act in the same manner, by the same means, and with
			 the same jurisdiction as though all applicable terms and provisions of the
			 Federal Trade Commission Act were incorporated into and made a part of
			 this Act. Any person who violates the regulations promulgated under
			 subsection (a) shall be subject to the penalties and entitled to the
			 privileges and immunities provided in the Federal Trade Commission Act.</text>
				</paragraph></subsection><subsection id="H767D76D854244006805494D42AA0FF68"><enum>(c)</enum><header>Actions by States</header>
				<paragraph commented="no" id="H5D3E02606D44478E974E855349CD75E0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In any case in which the attorney general of a State has reason to believe that an interest of the
			 residents of such State has been or is threatened or adversely affected by
			 an act or practice in violation of a rule promulgated under subsection
			 (a), the State, as parens patriae, may bring a civil action on behalf of
			 the residents of the State in an appropriate State court to—</text>
					<subparagraph commented="no" id="H66FDCA03BFE34D2685C3BFED0CF8ACCA"><enum>(A)</enum><text>enjoin such act or practice;</text>
					</subparagraph><subparagraph commented="no" id="HB910A9D6DC4E451FBCA9867A06A5FF81"><enum>(B)</enum><text>enforce compliance with such rule;</text>
					</subparagraph><subparagraph commented="no" id="H985CA4770CEC450EB075D93A75230AE8"><enum>(C)</enum><text>obtain damages, restitution, or other compensation on behalf of residents of the State; or</text>
					</subparagraph><subparagraph commented="no" id="H5C0322A11DA64AC883695EE628F8FB12"><enum>(D)</enum><text>obtain such other legal and equitable relief as the court may consider to be appropriate.</text>
					</subparagraph></paragraph><paragraph commented="no" id="H35DB2CB0BF4043B6BCE453FDA31E0A88"><enum>(2)</enum><header>Notice</header><text>Before filing an action under this subsection, the attorney general, official, or agency of the
			 State involved shall provide to the Federal Trade Commission a written
			 notice of such action and a copy of the complaint for such action. If the
			 attorney general, official, or agency determines that it is not feasible
			 to provide the notice described in this paragraph before the filing of the
			 action, the attorney general, official, or agency shall provide written
			 notice of the action and a copy of the complaint to the Federal Trade
			 Commission immediately upon the filing of the action.</text>
				</paragraph><paragraph commented="no" id="H628E3B78096B407B8304614E7DBF4CCD"><enum>(3)</enum><header>Authority of Federal Trade Commission</header>
					<subparagraph id="H4A17DA4722AC4FF6828768E39643E7CF"><enum>(A)</enum><header>In general</header><text>On receiving notice under paragraph (2) of an action under this subsection, the Federal Trade
			 Commission shall have the right—</text>
						<clause commented="no" id="H420CB2EB19894A68A0FEA4F67F1EFD40"><enum>(i)</enum><text>to intervene in the action;</text>
						</clause><clause id="HEC024C86F983468FB5213C95D264BE20"><enum>(ii)</enum><text>upon so intervening, to be heard on all matters arising therein; and</text>
						</clause><clause commented="no" id="H1CE0BE65942F4EB998D4C359851DEBE9"><enum>(iii)</enum><text>to file petitions for appeal.</text>
						</clause></subparagraph><subparagraph commented="no" id="H87BB7BC9F7B34A63837BB9EAF59B4C3A"><enum>(B)</enum><header>Limitation on State action while Federal action is pending</header><text display-inline="yes-display-inline">If the Federal Trade Commission or the Attorney General of the United States has instituted a civil
			 action for violation of a rule promulgated under subsection (a) (referred
			 to in this subparagraph as the <quote>Federal action</quote>), no State attorney general, official, or agency may bring an action under this subsection during
			 the pendency of the Federal action against any defendant named in the
			 complaint in the Federal action for any violation of such rule alleged in
			 such complaint.</text>
					</subparagraph></paragraph><paragraph commented="no" id="HB312AD7188D449EEB548072B33968498"><enum>(4)</enum><header>Rule of construction</header><text>For purposes of bringing a civil action under this subsection, nothing in this Act shall be
			 construed to prevent an attorney general, official, or agency of a State
			 from exercising the powers conferred on the attorney general, official, or
			 agency by the laws of such State to conduct investigations, administer
			 oaths and affirmations, or compel the attendance of witnesses or the
			 production of documentary and other evidence.</text>
				</paragraph></subsection><subsection id="HFFB44C4E2BA44949888FED5223DD7B4D"><enum>(d)</enum><header>Definitions</header><text>In this section:</text>
				<paragraph id="H1DC514C827E0475FA78A722492F4ACCF"><enum>(1)</enum><header>Child</header><text>The term <term>child</term> means an individual that is less than 18 years of age.</text>
				</paragraph><paragraph commented="no" id="HA22C8120416A411895CD184CF6CD0870"><enum>(2)</enum><header>Firearm</header><text>The term <term>firearm</term> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/18/921">section 921</external-xref> of title 18, United States Code.</text>
