		<section id="H3CFD971F2ABA4068BC5E8252A22867EE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Space Technology for Exploring Resource Opportunities In Deep Space Act</short-title></quote> or the <quote><short-title>ASTEROIDS Act</short-title></quote>.</text>
		</section><section id="HD324C70E54A04DCABE3596FC2017C207"><enum>2.</enum><header>Title 51 amendment</header>
			<subsection id="H24B27033C7414B33A1F887847BB82DD3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle V of title 51, United States Code, is amended by adding at the end the following new
			 chapter:</text>

					<chapter id="HE2CDBAD31720447C9E67B8357727EFA9"><enum>513</enum><header>Asteroid resource exploration and utilization</header>

							<toc-entry level="section">51301. Commercialization of asteroid resource exploration and utilization in outer space.</toc-entry>

						</toc>
						<section id="HB4C5A59665BF4559B932686B8AC86A46"><enum>51301.</enum><header>Commercialization of asteroid resource exploration and utilization in outer space</header><text display-inline="no-display-inline">The President, through the Administration, the Federal Aviation Administration, and other
			 appropriate Federal agencies, shall—</text>
							<paragraph id="H2DDB0944FD2643A38BD0255A1201EDA4"><enum>(1)</enum><text display-inline="yes-display-inline">facilitate the commercial exploration and utilization of asteroid resources to meet national needs;</text>
							</paragraph><paragraph id="H34CFD40FBB4242E2B1AE7132540F1CD2"><enum>(2)</enum><text display-inline="yes-display-inline">discourage government barriers to the development of economically viable, safe, and stable
			 industries for the exploration and utilization of asteroid resources in
			 outer space in manners consistent with the existing international
			 obligations of the United States;</text>
							</paragraph><paragraph id="HFB1B218DAE7E4930827F177B1312AFFE"><enum>(3)</enum><text display-inline="yes-display-inline">promote the right of United States commercial entities to explore and utilize resources from
			 asteroids in outer space, in accordance with the existing international
			 obligations of the United States, free from harmful interference, and to
			 transfer or sell such resources; and</text>
							</paragraph><paragraph id="H4EB63AA07A284298AA5135E01579CB66"><enum>(4)</enum><text display-inline="yes-display-inline">develop the frameworks necessary to meet the international obligations of the United States.</text>
							</paragraph></section><section id="HCDB5E28EDE2E4D0A95E076A9908E348A"><enum>51302.</enum><header>Legal framework</header>
							<subsection id="HF54E450B2F174691BD1D860753405C4F"><enum>(a)</enum><header>Property rights</header><text>Any resources obtained in outer space from an asteroid are the property of the entity that obtained
			 such resources, which shall be entitled to all property rights thereto,
			 consistent with applicable provisions of Federal law.</text>
							</subsection><subsection id="HEDAF8EF754C54ECBB3C3ED04DC430F3C"><enum>(b)</enum><header>Freedom from harmful interference</header><text display-inline="yes-display-inline">As between any entities over which the United States can exercise jurisdiction, any assertion of
			 superior right to execute specific commercial asteroid resource
			 utilization activities in outer space shall prevail if it is found to be
			 first in time, derived upon a reasonable basis, and in accordance with all
			 existing international obligations of the United States.</text>
							</subsection><subsection id="HA00EC0AC3C604DF7AA997A24ADFDE447"><enum>(c)</enum><header>Safety of operations</header><text display-inline="yes-display-inline">A United States commercial asteroid resource utilization entity shall avoid harmful interference to
			 other spacecraft.</text>
							</subsection><subsection id="HCF01F73C2E814A289BD899B4B51B707A"><enum>(d)</enum><header>Relief from harmful interference</header><text display-inline="yes-display-inline">A United States commercial asteroid resource utilization entity may bring an action for appropriate
			 legal or equitable relief, or both, under this chapter for any action, by
			 another private entity, compromising the right to conduct its operations
			 free of harmful interference.</text>
							</subsection><subsection id="H5DCEE9B75DE84BD19697B47A908716A3"><enum>(e)</enum><header>Exclusive jurisdiction</header><text>The district courts of the United States shall have exclusive jurisdiction of an action under this
			 chapter without regard to the amount in controversy.</text>
							</subsection></section><section id="H40D0270D44E2497EAB73C63DC1071CEB"><enum>51303.</enum><header>Definitions</header><text display-inline="no-display-inline">For the purposes of this chapter:</text>
							<paragraph id="H54A564E035CB4B32A4B81829E66EBF56"><enum>(1)</enum><header>State</header><text>The term <quote>State</quote> means any of the several States, the District of Columbia, the Commonwealth of Puerto Rico, the
			 Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern
			 Mariana Islands, and any other commonwealth, territory, or possession of
			 the United States.</text>
							</paragraph><paragraph id="HF338F6B0AEEC4E32902CA63BBCFD3EC1"><enum>(2)</enum><header>United states commercial asteroid resource utilization entity</header><text display-inline="yes-display-inline">The term <quote>United States commercial asteroid resource utilization entity</quote> means a person or company providing asteroid exploration or utilization services, the control of
			 which is held by persons other than a Federal, State, local, or foreign
			 government, that is—</text>
								<subparagraph id="H69B76BEDC99449E3BDB07F77BC47D64B"><enum>(A)</enum><text>duly organized under the laws of a State;</text>
								</subparagraph><subparagraph id="HCD37779B7CFB4E0BA8C1B26CBF99F9D6"><enum>(B)</enum><text>subject to the subject matter and personal jurisdiction of the courts of the United States; or</text>
								</subparagraph><subparagraph id="H2A89ECE640A545F986742DACD964CDE4"><enum>(C)</enum><text>a foreign entity that has voluntarily submitted to the subject matter and personal jurisdiction of
			 the courts of the United States.</text></subparagraph></paragraph></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HD4F227BC7E76401194D1D4CBB1E970FC"><enum>(b)</enum><header>Clerical amendment</header><text>The table of chapters for title 51, United States Code, is amended by adding at the end of the
			 items for subtitle V the following:</text>
