<official-title display="yes">To amend the Energy Policy and Conservation Act to permit exemptions for external power supplies from certain efficiency standards, and for other purposes.</official-title>

<section id="H015F7C573E6249B49EB38EBE33676D6E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>EPS Service Parts Act of 2014</short-title></quote>.</text> </section> 
<section id="HFF4D39041E574E2AB96E74A7ABA2AAFF"><enum>2.</enum><header>Exempt supplies</header><text display-inline="no-display-inline">Section 325(u) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6295">42 U.S.C. 6295(u)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="H7D0B48AA91EE4514AF9DC408DF3E4B9F"><enum>(5)</enum><header>Exempt supplies</header> 
<subparagraph id="HABD280D0ABCA471E85A932F7765D850F"><enum>(A)</enum><header>February 10, 2014, rule</header> 
<clause id="HFFAE61AFB5584458B9E8E8C814F99318"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">An external power supply shall not be subject to the final rule entitled <quote>Energy Conservation Program: Energy Conservation Standards for External Power Supplies</quote>, published at 79 Fed. Reg. 7845 (February 10, 2014), if the external power supply—</text> 
<subclause id="H82E3348912954D198DEB9434033706F5"><enum>(I)</enum><text display-inline="yes-display-inline">is manufactured during the period beginning on February 10, 2016, and ending on February 10, 2020;</text> </subclause> 
<subclause id="H6D38F8CD54724E20B43FEDADD12B0FA8"><enum>(II)</enum><text>is marked in accordance with the External Power Supply International Efficiency Marking Protocol, as in effect on February 10, 2016;</text> </subclause> 
<subclause id="H426F407FC8BD47A08D3A2D945A06ABA6"><enum>(III)</enum><text display-inline="yes-display-inline">meets, where applicable, the standards under paragraph (3)(A), and has been certified to the Secretary as meeting International Efficiency Level IV or higher of the External Power Supply International Efficiency Marking Protocol, as in effect on February 10, 2016; and</text> </subclause> 
<subclause id="HB6CD364B063F4D8CBBDE32EA83B2363C"><enum>(IV)</enum><text>is made available by the manufacturer as a service part or a spare part for an end-use product that—</text> 
<item id="HAE4C2C6775114E55AE3B7AC144CEDBEB"><enum>(aa)</enum><text>constitutes the primary load; and</text> </item> 
<item id="H4BC2E7E8FBE54DFFB40F94A924F1DEB2"><enum>(bb)</enum><text>was manufactured before February 10, 2016.</text> </item></subclause></clause> 
<clause id="H408646F6FF1045B6957853AB62E03198"><enum>(ii)</enum><header>Reporting</header><text display-inline="yes-display-inline">The Secretary may require manufacturers of products exempted pursuant to clause (i) to report annual total units shipped as service and spare parts that fall below International Efficiency Level VI.</text> </clause> 
<clause id="H6504C61F1C204F1283DCA49AA1BD37FC"><enum>(iii)</enum><header>Limitation of exemption</header><text display-inline="yes-display-inline">The Secretary may issue a rule, after providing public notice and opportunity for public comment, to limit the applicability of the exemption established under clause (i) if the Secretary determines that the exemption is resulting in a significant reduction of the energy savings that would otherwise result from the final rule described in such clause.</text> </clause></subparagraph> 
<subparagraph id="H73EE2FF63ED442E6B2474E2DF26A1B2D"><enum>(B)</enum><header>Amended standards</header> 
<clause id="H20F14CCE1B0B4282B9F3F37F16465AFF"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may exempt an external power supply from any amended standard under this subsection if the external power supply—</text> 
<subclause id="HDA38030B4F83424A991D645CA452347E"><enum>(I)</enum><text>is manufactured within four years of the compliance date of the amended standard;</text> </subclause> 
<subclause id="H4D28D311DBAF408689D574033263E2C4"><enum>(II)</enum><text>complies with applicable marking requirements adopted by the Secretary prior to the amendment;</text> </subclause> 
<subclause id="H68B0519A838E45CF9A49DD68E084B1AB"><enum>(III)</enum><text>meets the standards that were in effect prior to the amendment; and</text> </subclause> 
<subclause id="HA59F329DCB4E4A3C9E9E175654404ECD"><enum>(IV)</enum><text>is made available by the manufacturer as a service part or a spare part for an end-use product that—</text> 
<item id="H3E4808146BF14EE9932EB630D3F62BBB"><enum>(aa)</enum><text>constitutes the primary load; and</text> </item> 
<item id="H67C8B003504945A3ABAB2860D2A44613"><enum>(bb)</enum><text>was manufactured before the compliance date of the amended standard.</text> </item></subclause></clause> 
<clause commented="no" id="H4A83B1C44BC843D1BF00654C349EDE73"><enum>(ii)</enum><header>Reporting</header><text>The Secretary may require manufacturers of a product exempted pursuant to clause (i) to report annual total units shipped as service and spare parts that do not meet the amended standard.</text> </clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </section>
