		<official-title display="yes">To authorize the National Desert Storm Memorial Association to establish the National Desert Storm
			 and Desert Shield Memorial as a commemorative work in the District of
			 Columbia, and for other purposes.</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" id="H8FD3C1794187430EB80FBA2390B95CAB" style="OLC">
		<section id="H3B65D035D7A34BA99CCBC16D0C379537" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Desert Storm and Desert Shield War Memorial Act</short-title></quote>.</text>
		</section><section id="H527EB45B710948B5A6BD47876F0B9F77"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">For the purposes of this Act:</text>
			<paragraph id="HA0F73D1C251F48859B4BDD89B084CACF"><enum>(1)</enum><header>Association</header><text display-inline="yes-display-inline">The term <term>Association</term> means the National Desert Storm Memorial Association, a corporation organized under the laws of
			 the State of Arkansas and described in section 501(c)(3) and exempt from
			 taxation under <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(a)</external-xref> of the Internal Revenue Code of 1986.</text>
			</paragraph><paragraph id="HE18A828EF3AB4EABB10E9A71755E6951"><enum>(2)</enum><header>Memorial</header><text display-inline="yes-display-inline">The term <term>memorial</term> means the National Desert Storm and Desert Shield Memorial authorized to be established under
			 section 3.</text>
			</paragraph></section><section id="H85942529D515437987EDFF81FCAD8CD1"><enum>3.</enum><header>Memorial to commemorate</header>
			<subsection id="HCB8EB837818C4698A095F0F67ED06794"><enum>(a)</enum><header>Authorization To establish commemorative work</header><text display-inline="yes-display-inline">The Association may establish the National Desert Storm and Desert Shield Memorial as a
			 commemorative work, on Federal land in the District of Columbia to
			 commemorate and honor those who, as a member of the Armed Forces, served
			 on active duty in support of Operation Desert Storm or Operation Desert
			 Shield.</text>
			</subsection><subsection id="HD7C06B13D7934C998ED48182483C9978"><enum>(b)</enum><header>Compliance with standards for Commemorative Works Act</header><text display-inline="yes-display-inline">The establishment of the commemorative work shall be in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/89">chapter 89</external-xref> of title 40, United States Code (commonly known as the <quote>Commemorative Works Act</quote>).</text>
			</subsection><subsection id="HF1332C2E4887473F96B1657F78DAADC8"><enum>(c)</enum><header>Use of federal funds prohibited</header><text display-inline="yes-display-inline">Federal funds may not be used to pay any expense of the establishment of the memorial. The
			 Association shall be solely responsible for acceptance of contributions
			 for, and payment of the expenses of, the establishment of the memorial.</text>
			</subsection><subsection id="H38AB29BC04294A288B6AA405B747106A"><enum>(d)</enum><header>Deposit of excess funds</header>
				<paragraph id="H6EA8C3BA5C424200BC35255145C82B03"><enum>(1)</enum><text>If upon payment of all expenses for the establishment of the memorial (including the maintenance
			 and preservation amount required by <external-xref legal-doc="usc" parsable-cite="usc/40/8906">section 8906(b)(1)</external-xref> of title 40, United States Code), there remains a balance of funds received for the establishment
			 of the commemorative work, the Association shall transmit the amount of
			 the balance to the Secretary of the Interior for deposit in the account
			 provided for in <external-xref legal-doc="usc" parsable-cite="usc/40/8906">section 8906(b)(3)</external-xref> of title 40, United States Code.</text>
				</paragraph><paragraph id="H48E0FCEB42B8410DA0289134EBA1B867"><enum>(2)</enum><text display-inline="yes-display-inline">If upon expiration of the authority for the commemorative work under <external-xref legal-doc="usc" parsable-cite="usc/40/8903">section 8903(e)</external-xref> of title 40, United States Code, there remains a balance of funds received for the establishment
			 of the commemorative work, the Association shall transmit the balance to a
			 separate account with the National Park Foundation for memorials, to be
			 available to the Secretary of the Interior or the Administrator (as
			 appropriate) following the process provided in <external-xref legal-doc="usc" parsable-cite="usc/40/8906">section 8906(b)(4)</external-xref> of title 40, United States Code, for accounts established under section 8906(b)(2) or (3) of title
			 40, United States Code.</text>
				</paragraph></subsection></section></legis-body>
