		<section id="H0B109E0501DD441090CDD67284379B28" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Maritime Washington National Heritage Area Act</short-title></quote>.</text>
		</section><section id="H636F35E084434418AD4121FFEC191871"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="HDA1F3966FD72404D9A4FE579AE5B7322"><enum>(1)</enum><header>Heritage area</header><text>The term <term>Heritage Area</term> means the Maritime Washington National Heritage Area established by section 4.</text>
			</paragraph><paragraph id="HE4910FA4F4B84D91BC5AA1D244685892"><enum>(2)</enum><header>Local coordinating entity</header><text>The term <term>local coordinating entity</term> means the local coordinating entity for the Heritage Area designated by section 4(b).</text>
			</paragraph><paragraph id="HAE94FB5377B245678F6F4DF55B73FD01"><enum>(3)</enum><header>Management plan</header><text>The term <term>management plan</term> means the management plan for the Heritage Area specified in section 6.</text>
			</paragraph><paragraph id="HD6FD200EA333402BB9D785C5D8151FE0"><enum>(4)</enum><header>Map</header><text>The term <term>map</term> means the undated overview map entitled <quote>Washington State Maritime Heritage Area Proposed Boundary</quote> and the associated index maps.</text>
			</paragraph><paragraph id="H20C3869796E245199CA5FAE11CE81945"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="H62F60521F2414B18945C1207957C5E82"><enum>(6)</enum><header>State</header><text>The term <term>State</term> means the State of Washington.</text>
			</paragraph></section><section id="H4C3F8DFBDCFE40EAAC67A5A1DADBC2FC"><enum>3.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text>
			<paragraph id="HE1B1DD10E51D40B281A2F2D909F712FB"><enum>(1)</enum><text>to encourage and strengthen partnerships and collaboration among maritime interests for the purpose
			 of economic development and heritage tourism;</text>
			</paragraph><paragraph id="HD5642CE305E8451C951FCDC90E4B93E4"><enum>(2)</enum><text>to recognize that waterfronts are both a foundational part of Washington’s heritage and dynamic
			 places that are constantly adapting to new opportunities and challenges;</text>
			</paragraph><paragraph id="H7F6B1BC0F8FE4BBC8B7391212EE4A16E"><enum>(3)</enum><text>to recognize, interpret, and conserve the diverse and abundant nationally significant
			 maritime-related objects, sites, structures, places, events, and
			 activities that collectively form a distinctive landscape in western
			 Washington State’s ports and coastal communities;</text>
			</paragraph><paragraph id="H33593106B575433C85499FE88B8D2BA5"><enum>(4)</enum><text>to recognize and interpret the impact of this nationally important maritime landscape on Native
			 American and European-American heritage;</text>
			</paragraph><paragraph id="H8A02A3257D8D419C811A64C2362A6358"><enum>(5)</enum><text>to preserve landscapes, communities, traditions, historic sites, and natural features in the
			 Heritage Area associated with this maritime history;</text>
			</paragraph><paragraph id="H3BE1D443D59C48B69B5DA651038541F3"><enum>(6)</enum><text>to promote heritage, cultural, and recreational tourism, and to develop educational, interpretive,
			 recreational, and cultural programs through partnerships for the benefit
			 of visitors and the general public; and</text>
			</paragraph><paragraph id="H34FEB466E3CF44CF9B723856F15BBB22"><enum>(7)</enum><text>to provide appropriate linkages between Federal, State, and local historic sites, and communities,
			 governments, businesses, organizations, and individuals that stimulate
			 appropriate and compatible economic vitality within the Heritage Area,
			 without modifying the authority of any State, tribal, or local government
			 to regulate land use, public land policy, or private activity.</text>
			</paragraph></section><section id="HCC13D13A697344A9B818B30BBF36D127"><enum>4.</enum><header>Maritime Washington National Heritage Area</header>
			<subsection id="H82424BF3813D4204AC5384D5B1542E47"><enum>(a)</enum><header>Establishment</header><text>There is established the Maritime Washington National Heritage Area in the counties of Whatcom,
			 Skagit, Snohomish, San Juan, Island, King, Pierce, Thurston, Mason,
			 Kitsap, Jefferson, Clallam, and Grays Harbor in the State of Washington.</text>
			</subsection><subsection id="H3B1E7753EC4542AAAAD5D8CFF1F920AC"><enum>(b)</enum><header>Boundaries</header>
				<paragraph id="HAA620CBE8473472F92A15CA12A92621E"><enum>(1)</enum><header>In general</header><text>The Heritage Area shall consist of Federal, State, local, and tribal lands that allow public access
			 and are at least partly located within one-quarter mile landward of the
			 shoreline, as generally depicted on the map.</text>
				</paragraph><paragraph id="HE9B8D07BA59848E4BC0EB8888F7C2F0A"><enum>(2)</enum><header>Revision</header><text>The boundaries of the Heritage Area may be revised if the revision is—</text>
					<subparagraph id="HB4B75B757B53466FA8747216718CAFF1"><enum>(A)</enum><text>proposed in the management plan;</text>
					</subparagraph><subparagraph id="H15060AC05E3D49A0A42EE845EDBACDC6"><enum>(B)</enum><text>approved by the Secretary in accordance with section 5; and</text>
					</subparagraph><subparagraph id="H0D4A9D13629648129E0DBC00C2610AA3"><enum>(C)</enum><text>placed on file in accordance with paragraph 3.</text>
					</subparagraph></paragraph><paragraph id="H538FDD08D34E4442B721AD3909C32A8B"><enum>(3)</enum><header>Availability of map</header><text>The map shall be on file and available for public inspection in the appropriate offices of the
			 National Park Service and the local coordinating entity.</text>
				</paragraph><paragraph id="H6BA951FB9B9942A0A674FAE6F3E15E94"><enum>(4)</enum><header>Local coordinating entity</header><text>The local coordinating entity for the Heritage Area shall be the Pacific Northwest Maritime
			 Heritage Advisory Council, operating under the Washington Trust for
			 Historic Preservation.</text>
				</paragraph></subsection></section><section id="HEBA0B373B55C4771BAF1D6A4FAE1020A"><enum>5.</enum><header>Duties and authorities of the local coordinating entity</header>
			<subsection id="H98810D3F1F6042848E5B117D8ECE9EA7"><enum>(a)</enum><header>Duties of the local coordinating entity</header><text>To further the purposes of the Heritage Area, the local coordinating entity shall—</text>
				<paragraph id="H1D3E3CECE29545C4B1E45C0237C7BB8E"><enum>(1)</enum><text>prepare and submit to the Secretary in accordance with section 6, a management plan for the
			 Heritage Area;</text>
				</paragraph><paragraph id="H03BE1DA0942D4BE59F76D2FA777ED3B0"><enum>(2)</enum><text>assist willing partners, such as units of State, local, and tribal governments, regional planning
			 organizations and private organizations, in implementing the approved
			 management plan by—</text>
					<subparagraph id="HC316E4C0F20F489799B6B0FED0DDF51B"><enum>(A)</enum><text>advocating for and carrying out programs and projects that recognize and protect important resource
			 values within the Heritage Area;</text>
					</subparagraph><subparagraph id="H63494C19A20A4064B0A30DDF6F4F06D3"><enum>(B)</enum><text>promoting, developing, and maintaining interpretive exhibits and programs within the Heritage Area;</text>
					</subparagraph><subparagraph id="H508C6A9F23034F8FBCD487FA16022397"><enum>(C)</enum><text>promoting or developing recreational and educational opportunities in the Heritage Area;</text>
					</subparagraph><subparagraph id="HD7971959F38C45DF8306F38075536B26"><enum>(D)</enum><text>increasing public awareness of, and appreciation for, natural, historic, scenic, recreational, and
			 cultural resources of the Heritage Area;</text>
					</subparagraph><subparagraph id="HAB81A19C845E457688B01A8351BD1D0F"><enum>(E)</enum><text>advocating for the protection and preservation of historic sites, structures, objects, and
			 buildings in the Heritage Area that are consistent with the themes of the
			 Heritage Area;</text>
					</subparagraph><subparagraph id="HDB6ED5238A1F4857B54E0C54A09A1A7F"><enum>(F)</enum><text>ensuring that signs identifying points of public access and sites of interest are posted throughout
			 the Heritage Area; and</text>
					</subparagraph><subparagraph id="H303FB683F47E4FE7899E44328D0C20EE"><enum>(G)</enum><text>promoting a wide range of partnerships among governments, businesses, organizations, and
			 individuals to further the purposes of the Heritage Area;</text>
					</subparagraph></paragraph><paragraph id="HA2464B36B2C942389154151EA0779A73"><enum>(3)</enum><text>consider the interests of diverse units of government, businesses, organizations, and individuals
			 in the Heritage Area in the preparation and implementation of the
			 management plan;</text>
				</paragraph><paragraph id="H828C71D970D34F90B75BB10A1AA9C8F1"><enum>(4)</enum><text>undertake an open and transparent process for the development and implementation of the management
			 plan by holding regular public meetings;</text>
				</paragraph><paragraph id="HC9AE558D9B394968AD27C07F00A9C15B"><enum>(5)</enum><text>submit an annual report to the Secretary for each fiscal year in which the local coordinating
			 entity receives Federal funds under this Act specifying—</text>
					<subparagraph id="HF0FDF65CE58C46D8AF1A63361931C5DF"><enum>(A)</enum><text>the goals and accomplishments of the local coordinating entity;</text>
					</subparagraph><subparagraph id="H515A343C3EF14A90B81FFE79C7499575"><enum>(B)</enum><text>the expenses and income of the local coordinating entity;</text>
					</subparagraph><subparagraph id="H255E040AAB01436DA4AB7BE2F195C98A"><enum>(C)</enum><text>the amounts and sources of matching funds;</text>
					</subparagraph><subparagraph id="HCDAF0646B22D4F1BB387739795153A5C"><enum>(D)</enum><text>the amounts leveraged with Federal funds and sources of the leveraged funds;</text>
					</subparagraph><subparagraph id="HFC785F5A973B48A8A7A880FEE231C519"><enum>(E)</enum><text>grants made to any other entities during the fiscal year; and</text>
					</subparagraph><subparagraph id="H91E0C6CAB9EA437D98901122B65AE24A"><enum>(F)</enum><text>critical components for sustainability of the Heritage Area;</text>
					</subparagraph></paragraph><paragraph id="HA6B2551E55A74901AAB32D70BECF8C58"><enum>(6)</enum><text>make available for audit for any fiscal year for which the local coordinating entity receives
			 Federal funds under this Act, all information pertaining to the
			 expenditure of such funds and any matching funds;</text>
				</paragraph><paragraph id="HDA7FCBC3FE1D45DEA6264EDF41ED9055"><enum>(7)</enum><text>in all agreements authorizing expenditures of Federal funds by other organizations, that the
			 receiving organizations make available for audit all records and other
			 information pertaining to the expenditure of such funds; and</text>
				</paragraph><paragraph id="H2A811825D09F47E495BC0DFFD908C3F9"><enum>(8)</enum><text>encourage and strengthen partnerships and collaboration among maritime interests, by appropriate
			 means, for economic development and heritage tourism consistent with the
			 purposes of the Heritage Area.</text>
				</paragraph></subsection><subsection id="H57D47EE92F044EF4976C71653833B202"><enum>(b)</enum><header>Authorities</header><text>The local coordinating entity may, subject to the prior approval of the Secretary, for the purposes
			 of preparing and implementing the management plan, use Federal funds made
			 available under this Act to—</text>
				<paragraph id="HC616BA275F3D4C6FB583A21922A4C43A"><enum>(1)</enum><text>make grants to the State, political subdivisions of the State, nonprofit organizations, and other
			 persons;</text>
				</paragraph><paragraph id="H2744854005ED41ACB13C5B6D54C61D5D"><enum>(2)</enum><text>enter into cooperative agreements with, or provide technical assistance to, the State, political
			 subdivisions of the State, nonprofit organizations, Federal agencies, and
			 other interested parties;</text>
				</paragraph><paragraph id="H5294D288C3014D9D91D0B3AE198ED6AE"><enum>(3)</enum><text>hire and compensate staff;</text>
				</paragraph><paragraph id="H604A0BEA188849D69A0986B31A1DD01D"><enum>(4)</enum><text>obtain funds or services from any source, including funds and services provided under any other
			 Federal law or program;</text>
				</paragraph><paragraph id="H53C7856FC0B1433CBD138A3721E123EA"><enum>(5)</enum><text>contract for goods or services; and</text>
				</paragraph><paragraph id="HCCDC0246E5B44E9A9A35AD7494CB9ABB"><enum>(6)</enum><text>support activities of partners and any other activities that further the purposes of the Heritage
			 Area and are consistent with the approved management plan.</text>
				</paragraph></subsection><subsection id="H757366665D97461481A40417FBEAF2F2"><enum>(c)</enum><header>Prohibition on the acquisition of real property</header><text>The local coordinating entity may not use Federal funds received under this Act to acquire any
			 interest in real property.</text>
			</subsection></section><section id="H6F089FDDE67741BD82A100FE3112CAEA"><enum>6.</enum><header>Management plan</header>
			<subsection id="HCB872AE2B3DD474EB12279D0B4EF8AB9"><enum>(a)</enum><header>In general</header><text>Not later than 3 years after the date on which funds are made available to develop the management
			 plan, the local coordinating entity shall submit to the Secretary for
			 approval a proposed management plan for the Heritage Area.</text>
			</subsection><subsection id="HA5391C6F05A54CD6B4C08989E5DCF097"><enum>(b)</enum><header>Requirements</header><text>The management plan for the Heritage Area shall—</text>
				<paragraph id="H4AF04C496AB5480385A5D50FF0B7A261"><enum>(1)</enum><text>describe comprehensive policies, goals, strategies, and recommendations for the conservation,
			 funding, management, interpretation, and development of the Heritage Area;</text>
				</paragraph><paragraph id="HAB0BB9BB22D24EE19A280F4FC3E42D1B"><enum>(2)</enum><text>take into consideration existing State and local plans in the development and implementation of the
			 management plan;</text>
				</paragraph><paragraph id="H0D50A77CBC7547759A9DCE3F992E91DA"><enum>(3)</enum><text>include a description of actions and commitments that governments, private organizations, and
			 individuals plan to take to protect, enhance, and interpret the natural,
			 historic, scenic, and cultural resources of the Heritage Area;</text>
				</paragraph><paragraph id="HD9EEB1C0FE124650A41DE5444DD5EE9A"><enum>(4)</enum><text>specify existing and potential sources of funding or economic development strategies to conserve,
			 manage, and develop the Heritage Area;</text>
				</paragraph><paragraph id="H91B4853566104AD3B8904B2510AAD555"><enum>(5)</enum><text>include an inventory of the natural, historic, cultural, educational, scenic, and recreational
			 resources of the Heritage Area relating to the stories and themes of the
			 Heritage Area that should be protected, enhanced, managed, or developed;</text>
				</paragraph><paragraph id="H33D1C8A9B6F145589DCC68FAC36A446A"><enum>(6)</enum><text>recommend policies and strategies for resource management, including the development of
			 intergovernmental and interagency agreements, to protect the natural,
			 historic, cultural, educational, scenic, and recreational resources of the
			 Heritage Area;</text>
				</paragraph><paragraph id="HB687B331ABFF4F11A100BB7AF5827E21"><enum>(7)</enum><text>describe a program for implementation of the management plan including—</text>
					<subparagraph id="H9549FDB9F32444BBB3B106101F4FF683"><enum>(A)</enum><text>performance goals;</text>
					</subparagraph><subparagraph id="H0C16F4B1EEBB46868EEA75962CEEBDB8"><enum>(B)</enum><text>an approximate timeline for implementation;</text>
					</subparagraph><subparagraph id="H00116801DD004A698A49C7C9690E7BBF"><enum>(C)</enum><text>specific commitments for implementation; and</text>
					</subparagraph><subparagraph id="H17BC54D44F6B470DA72CA25A0E6C28FA"><enum>(D)</enum><text>how the plan will be evaluated and updated;</text>
					</subparagraph></paragraph><paragraph id="H595F76C605864C1C9D4E38C9BB015CE3"><enum>(8)</enum><text>include an analysis of, and recommendations for, ways in which Federal, State, tribal, and local
			 programs may best be coordinated (including the role of the National Park
			 Service and other Federal agencies associated with the Heritage Area) to
			 further the purposes of this Act;</text>
				</paragraph><paragraph id="HED36D31D69DD4787B4626259E906BD27"><enum>(9)</enum><text>provide recommendations for educational and interpretive programs to inform the public about the
			 resources of the Heritage Area; and</text>
				</paragraph><paragraph id="H80E0975BDE3245B79E2AD09DBE9A285C"><enum>(10)</enum><text>include a business plan that—</text>
					<subparagraph id="HAF74428300EB4D6499B1A36A0187468C"><enum>(A)</enum><text>describes the role, operation, financing, and functions of the local coordinating entity and of
			 each of the major activities contained in the management plan;</text>
					</subparagraph><subparagraph id="H94261CFC12C64BF88227C69170AAEFD0"><enum>(B)</enum><text>provides adequate assurances that the local coordinating entity has the partnerships and financial
			 and other resources necessary to implement the management plan for the
			 Heritage Area; and</text>
					</subparagraph><subparagraph id="HB1FE9F7206374128A9B55FBE5F7114B2"><enum>(C)</enum><text>describes goals and recommendations for sustainability of the coordinating entity through the term
			 of the legislation.</text>
					</subparagraph></paragraph></subsection><subsection id="HC01E92051E6C4303B0B7AA6E02B6B70F"><enum>(c)</enum><header>Termination of funding</header><text>If the management plan is not submitted to the Secretary in accordance with this section, the local
			 coordinating entity shall not qualify for additional financial assistance
			 under this Act until such time as the management plan is submitted to, and
			 approved by, the Secretary.</text>
			</subsection><subsection id="H9C088446BAE740B39F56C0A17DF530C4"><enum>(d)</enum><header>Approval of management plan</header>
				<paragraph id="H0800D36A39A44EFCAADF170F6958C12D"><enum>(1)</enum><header>Review</header><text>Not later than 180 days after the date on which the Secretary receives the management plan, the
			 Secretary shall approve or disapprove the management plan.</text>
				</paragraph><paragraph id="HA1841BDD144F440D8FCA5D90D061FCFC"><enum>(2)</enum><header>Criteria for approval</header><text>In determining the approval of the management plan, the Secretary shall consider whether—</text>
					<subparagraph id="H03D7AA1F462349BD93FCD98F475D1757"><enum>(A)</enum><text>the local coordinating entity represents the diverse interests of the Heritage Area, including
			 governments, resource-related organizations, educational institutions,
			 ports, businesses, community residents, and recreational organizations;</text>
					</subparagraph><subparagraph id="HEBD87A4F6C2B42CDB3BDBCA369B94421"><enum>(B)</enum><text>the local coordinating entity has afforded adequate opportunity for public and governmental
			 involvement (including workshops and public meetings) in the preparation
			 of the management plan;</text>
					</subparagraph><subparagraph id="H31222EB5A8824C68B74987A3767AC3A2"><enum>(C)</enum><text>the conservation and interpretation strategies described in the management plan, if implemented,
			 are compatible and consistent with this Act;</text>
					</subparagraph><subparagraph id="H06C64E1BFD9A49ED9D65030308B4856D"><enum>(D)</enum><text>the management plan would not adversely affect any activities authorized on Federal, State, local,
			 or tribal lands under applicable laws or land-use plans;</text>
					</subparagraph><subparagraph id="H59E3FFAD07734FC99CA97C9054F147FB"><enum>(E)</enum><text>the Secretary has received adequate assurances from the appropriate State, tribal, and local
			 officials whose support is needed to ensure the effective implementation
			 of the State, tribal, and local aspects of the management plan;</text>
					</subparagraph><subparagraph id="H5D2045FFB3DB421691FD85A8D5F4A519"><enum>(F)</enum><text>the local coordinating entity has identified existing and potential sources of funding for
			 implementing the management plan in partnership with others; and</text>
					</subparagraph><subparagraph id="HC035270A2AE34E81A7482945096A9CD6"><enum>(G)</enum><text>provisions for long-term sustainability of the Heritage Area are in place.</text>
					</subparagraph></paragraph><paragraph id="HE7AE33941BD84269A19468096795997E"><enum>(3)</enum><header>Action following disapproval</header>
					<subparagraph id="HE54916B12D9B43D4B315AF0B0285961C"><enum>(A)</enum><header>In general</header><text>If the Secretary disapproves the management plan, the Secretary—</text>
						<clause id="H8C3780187A9F4FF7ACF7D8E153CBEB98"><enum>(i)</enum><text>shall advise the local coordinating entity in writing of the reasons for the disapproval; and</text>
						</clause><clause id="HD589B857CC344B6980D6C3EFDEACF2C8"><enum>(ii)</enum><text>may make recommendations to the local coordinating entity for revisions to the management plan.</text>
						</clause></subparagraph><subparagraph id="HCCEB6D64657B4F00B964A4C318927310"><enum>(B)</enum><header>Deadline</header><text>Not later than 180 days after receiving a revised management plan, the Secretary shall approve or
			 disapprove the revised management plan.</text>
					</subparagraph></paragraph><paragraph id="H63EC09D6CFE34449981B1DCFC40EE37B"><enum>(4)</enum><header>Amendments</header>
					<subparagraph id="HBE914C4CE5EA4DF1ABF73B6262F5F799"><enum>(A)</enum><header>In general</header><text>An amendment to the management plan that substantially alters the management plan shall be reviewed
			 by the Secretary and approved or disapproved in the same manner as the
			 original management plan.</text>
					</subparagraph><subparagraph id="H4A92E702C053491DB318DF3C852EAD50"><enum>(B)</enum><header>Implementation</header><text>The local coordinating entity shall not use Federal funds authorized to be appropriated by this Act
			 to implement any amendment to the management plan until the Secretary
			 approves the amendment.</text>
					</subparagraph></paragraph></subsection></section><section id="H07468E3BA0B94040A071CD046CDE9CB6"><enum>7.</enum><header>Duties and authorities of the secretary</header>
			<subsection id="HE36795D01F414D2198C3F1D16B386E1D"><enum>(a)</enum><header>Technical and financial assistance</header>
				<paragraph id="H7CDE2C26F9B24095B5ABC74A11BFAF71"><enum>(1)</enum><header>In general</header><text>On the request of the local coordinating entity, the Secretary may provide technical and financial
			 assistance, on a reimbursable or nonreimbursable basis (as determined by
			 the Secretary), to the local coordinating entity to develop and implement
			 the management plan.</text>
				</paragraph><paragraph id="H64A8598E9E564891808D5DDC2FD5AE76"><enum>(2)</enum><header>Cooperative agreements</header><text>The Secretary may enter into cooperative agreements with the local coordinating entity and other
			 public or private organizations to provide technical or financial
			 assistance under paragraph (1).</text>
				</paragraph><paragraph id="H59FB7CDCC0C44855A481C89975F2A67B"><enum>(3)</enum><header>Priority</header><text>In assisting the Heritage Area, the Secretary shall give priority to actions that assist in—</text>
					<subparagraph id="H899763870D4D44589C343DCF14DD1212"><enum>(A)</enum><text>conserving the significant historic and cultural maritime-related resources of the Heritage Area;
			 and</text>
					</subparagraph><subparagraph id="HBF03A98CCC684700AF2F3E75921833D1"><enum>(B)</enum><text>providing educational, interpretive, and recreational opportunities for the public consistent with
			 the purposes of the Heritage Area.</text>
					</subparagraph></paragraph></subsection><subsection id="H6677A6B1D4A1480FA887296823503D39"><enum>(b)</enum><header>Evaluation; report</header>
				<paragraph id="HD20F012BA74A476AAC9C5A9C9699ADCA"><enum>(1)</enum><header>In general</header><text>Not later than 3 years before the date on which authority for Federal funding terminates for the
			 Heritage Area under section 10, the Secretary shall—</text>
					<subparagraph id="HD0876F4FDAAE42CE8CDBF298331AF4CC"><enum>(A)</enum><text>conduct an evaluation of the accomplishments of the Heritage Area; and</text>
					</subparagraph><subparagraph id="HAD93967284704272A2F26CEE8EF31ECF"><enum>(B)</enum><text>prepare a report with recommendations for the future role of the National Park Service, if any,
			 with respect to the Heritage Area, in accordance with paragraph (3).</text>
					</subparagraph></paragraph><paragraph id="H3ADFC3C0697646DE94E9B186730CDA20"><enum>(2)</enum><header>Evaluation components</header><text>An evaluation conducted under paragraph (1)(A) shall—</text>
					<subparagraph id="H94523114D8894B2CB338F176E2125175"><enum>(A)</enum><text>assess the progress of the local coordinating entity with respect to—</text>
						<clause id="HA20465D8E5A64974B7F71882B2B02174"><enum>(i)</enum><text>accomplishing the purposes of this Act for the Heritage Area; and</text>
						</clause><clause id="H79E6087009924F5FA246E72E15A941DC"><enum>(ii)</enum><text>achieving the goals and objectives of the approved management plan for the Heritage Area;</text>
						</clause></subparagraph><subparagraph id="H10FFF066FCCA4EB786D6C9099DB0AF64"><enum>(B)</enum><text>analyze the Federal, State, local, and private investments in the Heritage Area to determine the
			 leverage and impact of the investments; and</text>
					</subparagraph><subparagraph id="H4159705D796D4D3585A5AE7A7472FB98"><enum>(C)</enum><text>review the management structure, partnership relationships, and funding of the Heritage Area for
			 purposes of identifying the critical components for sustainability of the
			 Heritage Area.</text>
					</subparagraph></paragraph><paragraph id="H0162D03E741A4C5FB37A14865D3197C4"><enum>(3)</enum><header>Recommendations</header>
					<subparagraph id="H5676BBC4D36E4CCBB11F7B58F2574DA6"><enum>(A)</enum><header>In general</header><text>Based on the evaluation conducted under paragraph (1)(A), the Secretary shall prepare a report that
			 includes recommendations for the future role of the National Park Service,
			 if any, with respect to the Heritage Area.</text>
					</subparagraph><subparagraph id="HBA0554DB31724F28822F6910FE927BDB"><enum>(B)</enum><header>Required analysis</header><text>If the report prepared under this paragraph recommends that Federal funding for the Heritage Area
			 be reauthorized, the report shall include an analysis of—</text>
						<clause id="HA54DE8B6805040A98C0BBC7BBB903B26"><enum>(i)</enum><text>ways in which Federal funding for the Heritage Area may be reduced or eliminated; and</text>
						</clause><clause id="HB324041993E449358850D641A42C08AE"><enum>(ii)</enum><text>the appropriate time period necessary to achieve the recommended reduction or elimination.</text>
						</clause></subparagraph><subparagraph id="H5B9C7BA3156F4D5AB5F5BFAD385462B5"><enum>(C)</enum><header>Submission to congress</header><text>On completion of a report under this paragraph, the Secretary shall submit the report to—</text>
						<clause id="H0347D37491854E1184BEE9547986C707"><enum>(i)</enum><text>the Committee on Energy and Natural Resources of the Senate; and</text>
						</clause><clause id="H80F813D39B444479BDC06FEB0A4C0064"><enum>(ii)</enum><text>the Committee on Natural Resources of the House of Representatives.</text>
						</clause></subparagraph></paragraph></subsection></section><section id="H7C42BB460CF04E779A16838445C4E5DC"><enum>8.</enum><header>Relationship to other Federal agencies</header>
			<subsection id="HDAC276C54E32462FAA7DB5A61BECA7CD"><enum>(a)</enum><header>In general</header><text>Nothing in this Act affects the authority of any Federal agency to provide technical or financial
			 assistance under any other law.</text>
			</subsection><subsection id="H2FEE57F8420D45C5909DA2EA5974A1F1"><enum>(b)</enum><header>Consultation and coordination</header><text>To the maximum extent practicable, the head of any Federal agency planning to conduct activities
			 that may have an impact on the Heritage Area is encouraged to consult and
			 coordinate the activities with the Secretary and the local coordinating
			 entity.</text>
			</subsection><subsection id="HED56CFD0D0B1420DAC68BDB93B99C4A0"><enum>(c)</enum><header>Other Federal agencies</header><text>Nothing in this Act—</text>
				<paragraph id="HDABE609FB09D4E82809FCF0613F0DEE6"><enum>(1)</enum><text>modifies, alters, or amends any laws (including regulations) authorizing a Federal agency to manage
			 land under the jurisdiction of the Federal agency;</text>
				</paragraph><paragraph id="HD045A5F9145D4332BE4E21B0544C3AC4"><enum>(2)</enum><text>limits the discretion of a Federal land manager to implement an approved land-use plan within the
			 boundaries of the Heritage Area; or</text>
				</paragraph><paragraph id="HCF7474F6282449B0AFA22E4AFD1BA1A0"><enum>(3)</enum><text>modifies, alters, or amends any authorized use of Federal land under the jurisdiction of a Federal
			 agency.</text>
				</paragraph></subsection></section><section id="H982C78D58F9B4AACA6CCAA335177ED3D"><enum>9.</enum><header>Property owners and regulatory protections</header><text display-inline="no-display-inline">Nothing in this Act—</text>
			<paragraph id="H9AE8FBFC537445E09CA7239F43F41A80"><enum>(1)</enum><text>abridges the rights of any owner of public or private property, including the right to refrain from
			 participating in any plan, project, program, or activity conducted within
			 the Heritage Area;</text>
			</paragraph><paragraph id="H18C834A610AA415399690CA594CB11E7"><enum>(2)</enum><text>requires any property owner to—</text>
				<subparagraph id="HA8F6B801199F4B9481BB07ADA1395842"><enum>(A)</enum><text>permit public access (including Federal, State, tribal, or local government access) to the
			 property; or</text>
				</subparagraph><subparagraph id="H7DF72CCCEC344E92AC30FCE3CE7B16AB"><enum>(B)</enum><text>modify any provisions of Federal, State, tribal, or local law with regard to public access or use
			 of private land;</text>
				</subparagraph></paragraph><paragraph id="HFB4D2DB1C0254E10804640AC1BB884F9"><enum>(3)</enum><text>alters any duly adopted land-use regulations, approved land-use plan, or any other regulatory
			 authority of any Federal, State, or local agency, or tribal government;</text>
			</paragraph><paragraph id="H7D0A1C8451044B908D239371091A1B07"><enum>(4)</enum><text>conveys any land use or other regulatory authority to the local coordinating entity;</text>
			</paragraph><paragraph id="HAACB6B17B98149C0AC55831F2C856B79"><enum>(5)</enum><text>authorizes or implies the reservation or appropriation of water or water rights;</text>
			</paragraph><paragraph id="HB834A6DE91F1401D9CD122C1C13DA92D"><enum>(6)</enum><text>diminishes the authority of the State to manage fish and wildlife, including the regulation of
			 fishing and hunting within the Heritage Area; or</text>
			</paragraph><paragraph id="HF0B365FBF1234B558325442272613934"><enum>(7)</enum><text>creates any liability, or affects any liability under any other law, of any private property owner
			 with respect to any person injured on the private property.</text>
			</paragraph></section><section id="H2BF5F58224D34E359D03DF7F3C9D21C2"><enum>10.</enum><header>Authorization of appropriations</header>
			<subsection id="HCD1551AF101E4E6E9E29674AAF1BDFB4"><enum>(a)</enum><header>In general</header><text>There is authorized to be appropriated to carry out this Act $10,000,000, of which not more than
			 $500,000 shall be made available for any fiscal year.</text>
			</subsection><subsection id="H62F96EFA83AF486FB6D132855FB29DF8"><enum>(b)</enum><header>Availability</header><text>Funds made available under subsection (a) shall remain available until expended.</text>
			</subsection><subsection id="H962C824F1EB943F3846CC62F64473D4D"><enum>(c)</enum><header>Cost-Sharing requirement</header>
				<paragraph id="HCBE63389A8374573B31F36D85D50739E"><enum>(1)</enum><header>In general</header><text>The Federal share of the total cost of any activity under this section shall be not more than 50
			 percent.</text>
				</paragraph><paragraph id="HCC2607DA26234E059D83B9C3C0872640"><enum>(2)</enum><header>Form</header><text>The non-Federal contribution—</text>
					<subparagraph id="H9E2ED056CDB341408BDFCF70C2E56E68"><enum>(A)</enum><text>shall be from non-Federal sources; and</text>
					</subparagraph><subparagraph id="H12DB5EFCD8AF4838ACDFE29E8ADD35E7"><enum>(B)</enum><text>may be in the form of in-kind contributions of goods or services fairly valued.</text>
					</subparagraph></paragraph></subsection></section><section id="H11A7447FDBBD4236B1A285550216A5B5"><enum>11.</enum><header>Termination of financial assistance</header><text display-inline="no-display-inline">The authority of the Secretary to provide financial assistance under this Act terminates on the
			 date that is 15 years after the date of enactment of the Act.</text>
