			 funding by States on the enactment and enforcement by States of certain
			 laws to prevent repeat intoxicated driving.</official-title>

		<section id="HDD530F1540844876B321115B2209C5B7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Alisa’s Law of 2014</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="H459142FEFD624855BE63CD542FC1749A"><enum>2.</enum><header>Use of ignition interlock devices to prevent repeat intoxicated driving</header>
			<subsection display-inline="no-display-inline" id="H8F7FC12DDD604CB5B9F9DC802C15C195"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">Chapter 1</external-xref> of title 23, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H3BC0FEE021CC4142994DE7EF9030E5AB" style="USC">
					<section id="HF6FA226268C84A9B9099CD928CA314A2"><enum>171.</enum><header>Use of ignition interlock devices to prevent repeat intoxicated driving</header>
						<subsection id="H79C0642CA5644C2BAB03B4A60DD1ED81"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
							<paragraph id="H4D0161F6F02849958F6AAFAD0D488D4B"><enum>(1)</enum><header>Alcohol concentration</header><text>The term <term>alcohol concentration</term> means grams of alcohol per 100 milliliters of blood or grams of alcohol per 210 liters of breath.</text>
							</paragraph><paragraph id="H4B64222CAA1F4080A1DAD97775EBA8D7"><enum>(2)</enum><header>Driving while intoxicated; driving under the influence</header><text>The terms <term>driving while intoxicated</term> and <term>driving under the influence</term> mean driving or being in actual physical control of a motor vehicle in a State while having a
			 blood alcohol concentration that is greater than or equal to the lesser
			 of—</text>
								<subparagraph id="H93390D6D5B8F40158F04B3FDD17BB2BF"><enum>(A)</enum><text>the blood alcohol concentration limit of the State in which the individual is driving; and</text>
								</subparagraph><subparagraph id="H032753B0458B45F4BDA424A9FAEAE257"><enum>(B)</enum><text>0.08 percent.</text>
								</subparagraph></paragraph><paragraph id="H56640C9D28144F56A04E7019EAFC1347"><enum>(3)</enum><header>Ignition interlock device</header><text>The term <term>ignition interlock device</term> means an in-vehicle device that—</text>
								<subparagraph id="H71F6C89A40FE47D3B76583B438DE1B08"><enum>(A)</enum><text>requires a driver to provide a breath sample prior to the motor vehicle starting; and</text>
								</subparagraph><subparagraph id="HE5DA8A0120814CEAA25A6283850CFD2D"><enum>(B)</enum><text>prevents a motor vehicle from starting if the alcohol concentration of the driver is above the
			 legal limit.</text>
								</subparagraph></paragraph><paragraph id="HB1FFCF665421496F8D5F95CA2D36581E"><enum>(4)</enum><header>Motor vehicle</header>
								<subparagraph id="HAFF1AA30C7F64F21B6A55D0DFA2F8320"><enum>(A)</enum><header>In general</header><text>The term <term>motor vehicle</term> means a vehicle driven or drawn by mechanical power and manufactured primarily for use on public
			 highways.</text>
								</subparagraph><subparagraph id="HF1F46E4F3413401D8881C6074C8BE6B2"><enum>(B)</enum><header>Exclusions</header><text>The term <term>motor vehicle</term> does not include—</text>
									<clause id="HC6EF4BA2BE3C420FA151F712AAD55BD6"><enum>(i)</enum><text>a vehicle operated solely on a rail line; or</text>
									</clause><clause id="HAF878F108DF34E0AA908F602F8F1B07F"><enum>(ii)</enum><text>a commercial vehicle.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="H85530C56A70942259F75166816EE7B32"><enum>(b)</enum><header>Laws requiring ignition interlock devices</header><text>A State meets the requirements of this subsection if the State has enacted and is enforcing a law
			 that requires throughout the State the installation of an ignition
			 interlock device for a minimum of 180 days on each motor vehicle operated
			 by an individual who is convicted of driving while intoxicated or driving
			 under the influence.</text>
						</subsection><subsection id="H96DCAA96F52B45A8B7A87B347EB1700D"><enum>(c)</enum><header>Withholding of funds for noncompliance</header>
							<paragraph id="H3D469C8BF9444D78AD8EB8B729CD51E2"><enum>(1)</enum><header>Fiscal year 2015</header><text display-inline="yes-display-inline">On October 1, 2014, the Secretary shall withhold 1 percent of the amount required to be apportioned
			 to a State under each of paragraphs (1) and (2) of section 104(b) if the
			 State does not meet the requirements of subsection (b).</text>
							</paragraph><paragraph id="H04B44482716D40D981F4CCB574FC0A17"><enum>(2)</enum><header>Fiscal year 2016</header><text>On October 1, 2015, the Secretary shall withhold 3 percent of the amount required to be apportioned
			 to a State under each of paragraphs (1) and (2) of section 104(b) if the
			 State does not meet the requirements of subsection (b).</text>
							</paragraph><paragraph id="HE9B69000D7454FCA974803D0B23D841B"><enum>(3)</enum><header>Fiscal year 2017 and thereafter</header><text>On October 1, 2016, and on October 1 of each fiscal year thereafter, the Secretary shall withhold 5
			 percent of the amount required to be apportioned to a State under each of
			 paragraphs (1) and (2) of section 104(b) if the State does not meet the
			 requirements of subsection (b).</text>
							</paragraph></subsection><subsection display-inline="no-display-inline" id="HC5BC1674D92A4C06A08F62294CEDF6AE"><enum>(d)</enum><header>Period of availability of withheld funds; effect of compliance and noncompliance</header>
							<paragraph id="HD0626847789A4D3BB11661861DF94E05"><enum>(1)</enum><header>Period of availability of withheld funds</header><text>Any funds withheld under subsection (c) from apportionment to a State shall remain available for
			 apportionment to the State until the end of the third fiscal year
			 following the fiscal year for which the funds are authorized to be
			 appropriated.</text>
							</paragraph><paragraph id="HAFF61ED2FC434A7B8C1DF6DF95050C7C"><enum>(2)</enum><header>Apportionment of withheld funds after compliance</header><text>If, before the last day of the period for which funds withheld under subsection (c) from
			 apportionment are to remain available for apportionment to a State under
			 paragraph (1), the State meets the requirements of subsection (b), the
			 Secretary shall, on the first day on which the State meets the
			 requirements of subsection (b), apportion to the State the funds withheld
			 under subsection (c) that remain available for apportionment to the State.</text>
							</paragraph><paragraph id="H3FD1054E2930440EBAB8BAA661E2C9D7"><enum>(3)</enum><header>Period of availability of subsequently apportioned funds</header><text display-inline="yes-display-inline">Any funds apportioned pursuant to paragraph (2)—</text>
								<subparagraph id="HB10A7399188A4203A6AB998E68A2A7A1"><enum>(A)</enum><text display-inline="yes-display-inline">shall remain available for expenditure until the end of the third fiscal year following the fiscal
			 year in which the funds are so apportioned; and</text>
								</subparagraph><subparagraph id="H91157D5404A44157A0C271576BE49C3B"><enum>(B)</enum><text display-inline="yes-display-inline">if not apportioned at the end of that period, shall lapse.</text>
								</subparagraph></paragraph><paragraph id="HBFB71DF5CC5B478393BBF153DE90FE47"><enum>(4)</enum><header>Effect of noncompliance</header><text display-inline="yes-display-inline">If, at the end of the period for which funds withheld under subsection (c) from apportionment are
			 available for apportionment to a State under paragraph (1), the State does
			 not meet the requirements of subsection (b), the funds shall lapse.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H4530961475254801AFA2AA5F9074E2A9"><enum>(b)</enum><header>Conforming amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, is amended by adding at the end the
			 following:</text>
