2.Congress finds that—
(1)the existing Highway Trust Fund system is unsustainable and unable to meet our Nation’s 21st century transportation needs;
(2)MAP–21 included important reforms that must be built upon in the next reauthorization bill to increase the efficient and effective utilization of Federal funding;
(3)these reforms should include the elimination of duplicative Federal regulations and increase the authority and responsibility of the States to safely and efficiently build, operate, and fund transportation systems that best serve the needs of their citizens, including the ability of each State to implement innovative solutions, while also maintaining the appropriate Federal role in transportation; and
(4)Congress should enact and the President should sign a surface transportation reauthorization and reform bill prior to the expiration of this Act.
<enum>I</enum><header>Surface Transportation Program Extension</header>
<subtitle id="H9C3520E60EF448349EEEF245F3BCDB8C"><enum>A</enum><header>Federal-Aid Highways</header>
<section display-inline="no-display-inline" id="HC5485B30EC424C45965D59AC954E78D4"><enum>1001.</enum><header>Extension of Federal-aid highway programs</header>
<subsection id="HA1022EDD858A401A8BF73FE3D845423D"><enum>(a)</enum><header>In general</header><text>Except as provided in this subtitle, requirements, authorities, conditions, eligibilities, limitations, and other provisions authorized under divisions A and E of MAP–21 (<external-xref legal-doc="public-law" parsable-cite="pl/112/141">Public Law 112–141</external-xref>), the SAFETEA–LU Technical Corrections Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/244">Public Law 110–244</external-xref>), titles I, V, and VI of SAFETEA–LU (<external-xref legal-doc="public-law" parsable-cite="pl/109/59">Public Law 109–59</external-xref>), titles I and V of the Transportation Equity Act for the 21st Century (<external-xref legal-doc="public-law" parsable-cite="pl/105/178">Public Law 105–178</external-xref>), the National Highway System Designation Act of 1995 (104–59), titles I and VI of the Intermodal Surface Transportation Act of 1991 (<external-xref legal-doc="public-law" parsable-cite="pl/102/240">Public Law 102–240</external-xref>), and title 23, United States Code (excluding chapter 4 of that title), which would otherwise expire on or cease to apply after September 30, 2014, are incorporated by reference and shall continue in effect until May 31, 2015.</text></subsection>
<subsection id="HA5D723F43AF748189515B5A3284B7E6A"><enum>(b)</enum><header>Authorization of appropriations</header>
<paragraph id="H86FE0CB64D2D4E658A8E0A0A94864A91"><enum>(1)</enum><header>Highway trust fund</header><text>Except as provided in section 1002, there is authorized to be appropriated out of the Highway Trust Fund (other than the Mass Transit Account) for the period beginning on October 1, 2014, and ending on May 31, 2015, a sum equal to <fraction>243/365</fraction> of the total amount authorized to be appropriated out of the Highway Trust Fund for programs, projects, and activities for fiscal year 2014 under divisions A and E of MAP–21 (<external-xref legal-doc="public-law" parsable-cite="pl/112/141">Public Law 112–141</external-xref>) and title 23, United States Code (excluding chapter 4 of that title).</text></paragraph>
<paragraph id="H8AA2D7CE886844FA9FD926C5DC772AF1"><enum>(2)</enum><header>General fund</header><text>Section 1123(h)(1) of MAP–21 (<external-xref legal-doc="usc" parsable-cite="usc/23/202">23 U.S.C. 202</external-xref> note) is amended by inserting <quote>and $19,972,603 out of the general fund of the Treasury to carry out the program for the period beginning on October 1, 2014, and ending on May 31, 2015</quote> before the period at the end.</text></paragraph></subsection>
<subsection id="H10E3436C1E94408BB1CF45B7B49AF822"><enum>(c)</enum><header>Use of funds</header>
<paragraph id="HA1033746623A43D2B71935C3B41016DA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as otherwise expressly provided in this subtitle, funds authorized to be appropriated under subsection (b)(1) for the period beginning on October 1, 2014, and ending on May 31, 2015, shall be distributed, administered, limited, and made available for obligation in the same manner and at the same levels as <fraction>243/365</fraction> of the amounts of funds authorized to be appropriated out of the Highway Trust Fund (other than the Mass Transit Account) for fiscal year 2014 to carry out programs, projects, activities, eligibilities, and requirements under MAP–21 (<external-xref legal-doc="public-law" parsable-cite="pl/112/141">Public Law 112–141</external-xref>), the SAFETEA–LU Technical Corrections Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/244">Public Law 110–244</external-xref>), SAFETEA–LU (<external-xref legal-doc="public-law" parsable-cite="pl/109/59">Public Law 109–59</external-xref>), titles I and V of the Transportation Equity Act for the 21st Century (<external-xref legal-doc="public-law" parsable-cite="pl/105/178">Public Law 105–178</external-xref>), the National Highway System Designation Act of 1995 (104–59), titles I and VI of the Intermodal Surface Transportation Act of 1991 (<external-xref legal-doc="public-law" parsable-cite="pl/102/240">Public Law 102–240</external-xref>), and title 23, United States Code (excluding chapter 4 of that title).</text></paragraph>
<paragraph id="HCC150F68315B4D659CEBC2555F985BF8"><enum>(2)</enum><header>Contract authority</header><text display-inline="yes-display-inline">Funds authorized to be appropriated out of the Highway Trust Fund (other than the Mass Transit Account) under this section shall be—</text>
<subparagraph id="H2CB4C8A7DB5046DB90AF84F48437CF39"><enum>(A)</enum><text>available for obligation and shall be administered in the same manner as if such funds were apportioned under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code; and</text></subparagraph>
<subparagraph id="H5D8B5AE99E8A4B558A9379F6C5F536DB"><enum>(B)</enum><text display-inline="yes-display-inline">subject to section 1102 of MAP–21 (<external-xref legal-doc="usc" parsable-cite="usc/23/104">23 U.S.C. 104</external-xref> note), as amended by this subsection.</text></subparagraph></paragraph>
<paragraph id="H8C9A171B983142529D1A0F2AB15221B2"><enum>(3)</enum><header>Obligation ceiling</header><text>Section 1102 of MAP–21 (<external-xref legal-doc="usc" parsable-cite="usc/23/104">23 U.S.C. 104</external-xref> note) is amended—</text>
<subparagraph id="H14B1AA027B6D4805BC97D003934CD504"><enum>(A)</enum><text>in subsection (a)—</text>
<clause id="H384E14D21CBF455889339AA96E026A7A"><enum>(i)</enum><text>by striking <quote>and</quote> at the end of paragraph (1);</text></clause>

<clause id="H985F93C7CD01400289FE41317472E63C"><enum>(i)</enum><text>in paragraph (10) by striking <quote>2011</quote> and inserting <quote>2012</quote>; and</text></clause>

<subsection id="H83CF633B0BB14985BE955BFA7938E976"><enum>(a)</enum><header>Authorization of contract authority</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act or any other law, there is authorized to be appropriated from the Highway Trust Fund (other than the Mass Transit Account), from amounts provided under section 1001, for administrative expenses of the Federal-aid highway program $292,931,507 for the period beginning on October 1, 2014, and ending on May 31, 2015.</text></subsection>
<subsection id="H4C75A3D49968404B9E7F5C471DDD7845"><enum>(b)</enum><header>Contract authority</header><text>Funds authorized to be appropriated by this section shall be—</text>
<paragraph id="H848885B673A1410FB2B9DF648D60104C"><enum>(1)</enum><text>available for obligation, and shall be administered, in the same manner as if such funds were apportioned under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, except that such funds shall remain available until expended; and</text></paragraph>
<paragraph id="HBD23B0E5B5C84E4789E6D062D5A01083"><enum>(2)</enum><text display-inline="yes-display-inline">subject to the limitation on obligations for Federal-aid highways and highway safety construction programs for the period beginning on October 1, 2014, and ending on May 31, 2015, specified in section 1102 of MAP–21 (<external-xref legal-doc="usc" parsable-cite="usc/23/104">23 U.S.C. 104</external-xref> note), as amended by this subtitle.</text></paragraph></subsection></section></subtitle>

<subparagraph id="HA88CC5F501C54FF8BAFA163BFB653E7E"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the amendments made by this subsection shall apply to plan years beginning after December 31, 2014.</text></subparagraph>
<subparagraph id="HF643343436514F8ABF7F95CFAF0B0B57"><enum>(B)</enum><header>Collectively bargained plans</header><text>In the case of a plan maintained pursuant to 1 or more collective bargaining agreements, the amendments made by this subsection shall apply to plan years beginning after December 31, 2015.</text></subparagraph></paragraph>
<paragraph id="HB97B94CAC7FF471A9023E6AB7D68B493"><enum>(4)</enum><header>Provisions relating to plan amendments</header>
<subparagraph id="H56769AAB62684BC1A9770E3464CA8A27"><enum>(A)</enum><header>In general</header><text>If this paragraph applies to any amendment to any plan or annuity contract, such plan or contract shall be treated as being operated in accordance with the terms of the plan during the period described in subparagraph (B)(ii).</text></subparagraph>
<subparagraph id="H5EDFA9D3576C490391FB91A5ABDE51B4"><enum>(B)</enum><header>Amendments to which paragraph applies</header>
<clause id="H9EFB813E2F5D45F2B6637192C99AB87C"><enum>(i)</enum><header>In general</header><text>This paragraph shall apply to any amendment to any plan or annuity contract which is made—</text>
<subclause id="H5ACB223D671847A7A0ABD9B19458B31E"><enum>(I)</enum><text>pursuant to the amendments made by this subsection, or pursuant to any regulation issued by the Secretary of the Treasury or the Secretary of Labor under any provision as so amended, and</text></subclause>
<subclause id="H1A0ACB2E644D4C4AA17F9FF6543DEBAD"><enum>(II)</enum><text>on or before the last day of the first plan year beginning on or after January 1, 2016, or such later date as the Secretary of the Treasury may prescribe.</text></subclause></clause>
<clause id="H3227D5CAA18A43DDB7435C1359569754"><enum>(ii)</enum><header>Conditions</header><text>This subsection shall not apply to any amendment unless, during the period—</text>
<subclause id="HB1BCD15BAD7E43288A1B20E6D9DAC8AB"><enum>(I)</enum><text>beginning on the date that the amendments made by this subsection or the regulation described in clause (i)(I) takes effect (or in the case of a plan or contract amendment not required by such amendments or such regulation, the effective date specified by the plan), and</text></subclause>
<subclause id="H686B72243793481F8723F23771DB05B4"><enum>(II)</enum><text>ending on the date described in clause (i)(II) (or, if earlier, the date the plan or contract amendment is adopted),</text></subclause><continuation-text continuation-text-level="clause">the plan or contract is operated as if such plan or contract amendment were in effect, and such plan or contract amendment applies retroactively for such period.</continuation-text></clause></subparagraph>
<subparagraph id="H85DD14068BEC4E28B53DA6BDD67E746E"><enum>(C)</enum><header>Anti-cutback relief</header><text>A plan shall not be treated as failing to meet the requirements of section 204(g) of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1054">29 U.S.C. 1054(g)</external-xref>) and <external-xref legal-doc="usc" parsable-cite="usc/26/411">section 411(d)(6)</external-xref> of the Internal Revenue Code of 1986 solely by reason of a plan amendment to which this paragraph applies.</text></subparagraph></paragraph></subsection>
<subsection id="H346F76AD37E94BF2A084471C33E656E1"><enum>(d)</enum><header>Modification of funding target determination periods</header>
<paragraph id="H3DA95F721FD943F58C779A9F1361EF64"><enum>(1)</enum><header>Internal Revenue Code of 1986</header><text>Clause (i) of <external-xref legal-doc="usc" parsable-cite="usc/26/430">section 430(h)(2)(B)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>the first day of the plan year</quote> and inserting <quote>the valuation date for the plan year</quote>.</text></paragraph>
<paragraph id="H3A341868C7304CA8B9C045B62D21EAAF"><enum>(2)</enum><header>Employee Retirement Income Security Act of 1974</header><text>Clause (i) of section 303(h)(2)(B) of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1083">29 U.S.C. 1083(h)(2)(B)(i)</external-xref>) is amended by striking <quote>the first day of the plan year</quote> and inserting <quote>the valuation date for the plan year</quote>.</text></paragraph></subsection>
<subsection id="H17B308D693DD47278607594DEA615996"><enum>(e)</enum><header>Effective date</header>
<paragraph id="HB6A4F5EEF40F442C8FC05F7FE8EA5216"><enum>(1)</enum><header>In general</header><text>The amendments made by subsections (a), (b), and (d) shall apply with respect to plan years beginning after December 31, 2012.</text></paragraph>
<paragraph id="H20B3B42CC1D8417CBD9DB220CF1A462C"><enum>(2)</enum><header>Elections</header><text>A plan sponsor may elect not to have the amendments made by subsections (a), (b), and (d) apply to any plan year beginning before January 1, 2014, either (as specified in the election)—</text>
<subparagraph id="HD9A2BD940DDD40EE8FD6CC0DFE070FB7"><enum>(A)</enum><text>for all purposes for which such amendments apply, or</text></subparagraph>
<subparagraph id="H70922DD773894993B00EBA3237182451"><enum>(B)</enum><text>solely for purposes of determining the adjusted funding target attainment percentage under sections 436 of the Internal Revenue Code of 1986 and 206(g) of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1054">29 U.S.C. 1054(g)</external-xref>) for such plan year.</text></subparagraph><continuation-text commented="no" continuation-text-level="paragraph">A plan shall not be treated as failing to meet the requirements of section 204(g) of such Act and section 411(d)(6) of such Code solely by reason of an election under this paragraph.</continuation-text></paragraph></subsection></section>
