<section id="HC885558F0D51453EB242EAEEE78C9D57" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restoring Accountability in Veterans Access to Health Care Act</short-title></quote>.</text></section> 
<section id="HCC41C84B19CF426CA36AC426D212F0F0" section-type="subsequent-section"> <enum>2.</enum> <header>Treatment of staffing shortage and report on staffing of medical facilities of the Department of Veterans Affairs</header> 
<subsection id="HF2E7AD0697B44D8CB16D4D61D9ABC475"> <enum>(a)</enum> <header>Staffing shortage</header> 
<paragraph id="HC52486600C194B94A8B8074D6EEE1459"> <enum>(1)</enum> <header>In general</header> <text>Not later than 180 days after the date of the enactment of this Act, and annually thereafter, the Inspector General of the Department of Veterans Affairs shall determine, and publish in the Federal Register, the five occupations of health care providers of the Department of Veterans Affairs for which there is the largest staffing shortage throughout the Department.</text> </paragraph> 
<paragraph id="H2418425ECEC74AB49378BA6333128AC8"> <enum>(2)</enum> <header>Recruitment and appointment</header> <text>Notwithstanding sections 3304 and 3309 through 3318 of title 5, United States Code, the Secretary of Veterans Affairs, based upon a determination by the Inspector General under paragraph (1) that there is a staffing shortage throughout the Department with respect to a particular occupation of health care provider, may recruit and directly appoint highly qualified health care providers to a position to serve as a health care provider in that particular occupation for the Department.</text></paragraph></subsection> 
<subsection id="H05BA6F9E605B4CCC8D0A5A10A2536D8A"> <enum>(b)</enum> <header>Reports</header> 
<paragraph id="H71BC57DAE6E244B2ABEA70076102A5FE"> <enum>(1)</enum> <header>In general</header> <text>Not later than 180 days after the date of the enactment of this Act, and not later than December 31 of each even numbered year thereafter until 2024, the Secretary of Veterans Affairs shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report assessing the staffing of each medical facility of the Department of Veterans Affairs.</text> </paragraph> 
<paragraph id="H936C2FFA7A2B4DEC815F1486DEDABF4F"> <enum>(2)</enum> <header>Elements</header> <text>Each report submitted under paragraph (1) shall include the following:</text> 
<subparagraph id="HD60AF6D1C24E4A74B405BE951DF37CB9"> <enum>(A)</enum> <text>The results of a system-wide assessment of all medical facilities of the Department to ensure the following:</text> 
<clause id="HDA194159EBB540408747E46AE0E8E472"> <enum>(i)</enum> <text>Appropriate staffing levels for health care providers to meet the goals of the Secretary for timely access to care for veterans.</text> </clause> 
<clause id="HEA782E758B4E421883377E660948E4B0"> <enum>(ii)</enum> <text>Appropriate staffing levels for support personnel, including clerks.</text> </clause> 
<clause id="HAADE1087EF7C46C986E6E6B7E6BA7E7C"> <enum>(iii)</enum> <text>Appropriate sizes for clinical panels.</text> </clause> 
<clause commented="no" id="H1065A4B8E5B8471F8F04AE7D4B2E262D"> <enum>(iv)</enum> <text>Appropriate numbers of full-time staff, or full-time equivalent, dedicated to direct care of patients.</text></clause> 
<clause id="H04CA7B14226D4A57BCBD9CA29E30FDEB"><enum>(v)</enum><text>The appropriate physician to patient ratio (including for both primary and specialty care), as compared to such ratio as it exists on the date of the report.</text> </clause> 
<clause id="H975F091FCFD44469AE0751259CE199A9"> <enum>(vi)</enum> <text>Appropriate physical plant space to meet the capacity needs of the Department in that area.</text> </clause> 
<clause id="H44F866B05CD4478E88F65EB5B292372C"> <enum>(vii)</enum> <text>Such other factors as the Secretary considers necessary.</text> </clause></subparagraph> 
<subparagraph id="H94DC964CC0EA4F26B853AEF9F22CB429"><enum>(B)</enum><text>An explanation of the measurable productivity standards used to establish the levels in the assessment described in subparagraph (A).</text> </subparagraph> 
<subparagraph id="HF9ED197B54364107BCA452C79C84F0AF"> <enum>(C)</enum> <text>A plan for addressing any issues identified in the assessment described in subparagraph (A), including a timeline for addressing such issues.</text></subparagraph> 
<subparagraph id="HC4B7D35F65874D3590771E16B49A6A86"> <enum>(D)</enum> <text>A list of the current wait times and workload levels for the following clinics in each medical facility:</text> 
<clause id="H1DEF7A49A85940B0B2A37C7F80FE073F"> <enum>(i)</enum> <text>Mental health.</text> </clause> 
<clause id="HCFCC5B29A7784BF594EA27426879B017"> <enum>(ii)</enum> <text>Primary care.</text> </clause> 
<clause id="HAE0093F5FE114E2592CCDA6F0A2ECE55"> <enum>(iii)</enum> <text>Gastroenterology.</text> </clause> 
<clause id="HAB0AED38692E433DB00704674E0396CB"> <enum>(iv)</enum> <text>Women’s health.</text></clause>
<clause id="HEFE2D04EC1284A8F85D7CEEE37E5B839"><enum>(v)</enum><text>Specialty care.</text></clause>
<clause id="H73BB4A17C78046729370027A22C24B5E"><enum>(vi)</enum><text>Ophthalmology.</text> </clause> 
<clause id="H3F3E911C6D98432A946B0BBB2636D7FF"> <enum>(vii)</enum> <text>Such other clinics as the Secretary considers appropriate.</text> </clause></subparagraph> 
<subparagraph id="HADEBC29EAC6B44AFA042C5BE68EB4249"> <enum>(E)</enum> <text>A description of the results of the determination of the Secretary under paragraph (1) of subsection (a) and a plan to use direct appointment authority under paragraph (2) of such subsection to fill staffing shortages, including recommendations for improving the speed at which the credentialing and privileging process can be conducted.</text> </subparagraph> 
<subparagraph id="H4BEB0B1AA58C4FF99ECCEAFFFE7F950B"> <enum>(F)</enum> <text>The current staffing models of the Department for the following clinics, including recommendations for changes to such models:</text> 
<clause id="H2A97040C9609444F95BA10A522F56EFD"> <enum>(i)</enum> <text>Mental health.</text> </clause> 
<clause id="H66119B9F8F024DE39EB6FACFDC13BA06"> <enum>(ii)</enum> <text>Primary care.</text> </clause> 
<clause id="H2B680E58DE634E41B1A2AA90C0ABAF0B"> <enum>(iii)</enum> <text>Gastroenterology.</text> </clause> 
<clause id="H375D1FCF0D504A25BBFE92B938B02EBB"> <enum>(iv)</enum> <text>Women’s health.</text></clause>
<clause id="H5C0F006F9EC4415DA697005E18A36102"><enum>(v)</enum><text>Specialty care.</text></clause>
<clause id="H150DB31A49684720A3E796B2CD7A0DB1"><enum>(vi)</enum><text>Ophthalmology.</text> </clause> 
<clause id="H3D360F1327E54E8499C3C6C08059B484"> <enum>(vii)</enum> <text>Such other clinics as the Secretary considers appropriate.</text> </clause></subparagraph> 
<subparagraph id="H4C0FE7D3167D400B884AAF79618E0390"> <enum>(G)</enum> <text>A detailed analysis of succession planning at medical facilities of the Department, including the following:</text> 
<clause id="H0E0E442BE24D43EDA71E9E15A70B350F"> <enum>(i)</enum> <text>The number of positions in medical facilities throughout the Department that are not filled by a permanent employee.</text> </clause> 
<clause id="H30BAEE171F8A4DF5B496080A4C2773C9"> <enum>(ii)</enum> <text>The length of time each such position described in clause (i) remained vacant or filled by a temporary or acting employee.</text> </clause> 
<clause id="H07BAA79ED9A54E89AEECCCA3A8626037"> <enum>(iii)</enum> <text>A description of any barriers to filling the positions described in clause (i).</text> </clause> 
<clause id="H8657BF848C1647FB8F80C47B785E9C85"> <enum>(iv)</enum> <text>A plan for filling any positions that are vacant or filled by a temporary or acting employee for more than 180 days.</text> </clause> 
<clause id="H124DFB4D6DF2458682836B2C0F6DF385"> <enum>(v)</enum> <text>A plan for handling emergency circumstances, such administrative leave or sudden medical leave for senior officials.</text> </clause></subparagraph> 
<subparagraph id="HB9F8B82BD4504B98B97ACECA495E9077"><enum>(H)</enum><text>The number of health care providers who have been removed from their position or have retired, by provider type, during the two-year period preceding the submittal of the report.</text></subparagraph> 
<subparagraph id="HCB2918AB7FDB4AACAFF4D46D9475261F"><enum>(I)</enum><text>Of the health care providers specified in subparagraph (G) that have been removed from their position, the following:</text> 
<clause id="HF7AF437CD44B418790CC1709D623EE03"><enum>(i)</enum><text>The number of such health care providers who were reassigned to another position in the Department.</text></clause> 
<clause id="H02B7DB757E0A4280A8E6A2F8BBB63AB9"><enum>(ii)</enum><text>The number of such health care providers who left the Department.</text></clause></subparagraph></paragraph></subsection></section> 
<section id="H37E78007C5F647399CAE54F5D17BAD6F"> <enum>3.</enum> <header>Clinic management training program of the Department of Veterans Affairs</header> 
<subsection id="HE4D27E7C1AD54F70B77FEF04C13AD4A7"> <enum>(a)</enum> <header>In general</header> <text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall implement a clinic management training program to provide in-person, standardized education on health care management to all managers of, and health care providers at, medical facilities of the Department of Veterans Affairs.</text> </subsection> 
<subsection id="H2BD31BEDBB8C469384F983BC99A9D3D0"> <enum>(b)</enum> <header>Elements</header> <text>The clinic management training program required by subsection (a) shall include the following:</text> 
<paragraph id="H304E0775B8D34730BF71A985DC0C2985"> <enum>(1)</enum> <text>Training on how to manage the schedules of health care providers of the Department and training on customer service and veteran-centered care, including proper planning procedures for vacation, leave, and graduate medical education training schedules.</text> </paragraph> 
<paragraph id="HEA8B6CAE1AE34CAB9C31E804778D044C"> <enum>(2)</enum> <text>Training on the appropriate number of appointments that a health care provider should conduct on a daily basis, based on specialty.</text> </paragraph> 
<paragraph id="H37C16C9FDFDE43D38CC7E35CFF1CBC6F"> <enum>(3)</enum> <text>Training on how to determine whether there are enough available appointment slots to manage demand for different appointment types and mechanisms for alerting management of insufficient slots.</text></paragraph> 
<paragraph id="HC861734195EB4A3390E22B3F24962EE8"><enum>(4)</enum><text display-inline="yes-display-inline">Training on how scheduling systems will be monitored and how schedulers will be held accountable for accurate data.</text> </paragraph> 
<paragraph id="HC9D189DA4D094B2DA5D20C688A11E707"> <enum>(5)</enum> <text display-inline="yes-display-inline">Training on how to properly use data to meet the demand for health care, including the following:</text> 
<subparagraph id="H1F8855BC991D46298D2A960E750C8E53"> <enum>(A)</enum> <text>Training on determining the next available appointment for each health care provider at the medical facility.</text> </subparagraph> 
<subparagraph id="HC0E0B14766AB405F8CCB405DF0DB579F"> <enum>(B)</enum> <text>Training on determining the number of health care providers needed to meet demand for health care at the medical facility.</text> </subparagraph> 
<subparagraph id="H96ACC9C875EF402C9020DEBF8628A424"> <enum>(C)</enum> <text>Training on determining the number of exam rooms needed to meet demand for such health care in an efficient manner.</text> </subparagraph></paragraph> 
<paragraph id="H0FC5138EA7474795A819AA058F2E561E"> <enum>(6)</enum> <text>Training on how to properly use the appointment scheduling system of the Department, including any new scheduling system implemented by the Department.</text> </paragraph> 
<paragraph id="H300E8EA716904BD8971230177AEC7687"> <enum>(7)</enum> <text>Training on how to optimize the use of technology, including the following:</text> 
<subparagraph id="H0772F43B951D40D4A370AE5DEA1C1F9F"> <enum>(A)</enum> <text>Telemedicine.</text> </subparagraph> 
<subparagraph id="HE51AB18B6D844718A8871172C1B3DE85"> <enum>(B)</enum> <text>Electronic mail.</text> </subparagraph> 
<subparagraph id="H72F7834028B44E41A61952CF517F80C4"> <enum>(C)</enum> <text>Text messaging.</text> </subparagraph> 
<subparagraph id="HEBAE062F72294142B0C03558BBF796A1"> <enum>(D)</enum> <text>Such other technologies as specified by the Secretary.</text> </subparagraph></paragraph> 
<paragraph id="H89564B169EE4491A87665F40D57EF4F5"> <enum>(8)</enum> <text>Training on how to properly use physical plant space at medical facilities of the Department to ensure efficient flow and privacy for patients and staff.</text> </paragraph></subsection></section>
