		<section commented="no" id="HDDF0BE5A41614323B3FED1D464FBC6F9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>End Operation Choke Point Act of 2014</short-title></quote>.</text>
		</section><section id="H667F4F3BE5614381A3B706DF9EBDF366" section-type="subsequent-section"><enum>2.</enum><header>Business access to insured depository institutions</header>
			<subsection id="H94147866784E4D62AAEE89F20D54A0FE"><enum>(a)</enum><header>In general</header><text>The Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1811">12 U.S.C. 1811 et seq.</external-xref>) is amended by adding at the end the
			 following new section:</text>
				<quoted-block display-inline="no-display-inline" id="HA322B3936C0A41198506BCB4F0D4E1CE" style="OLC">
					<section id="H50280C11BFBE4871AEA1485A97005A1D"><enum>51.</enum><header>Business access to insured depository institutions</header>
						<subsection id="H3A8E65125D974F849746B6763CE611B6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Federal banking agencies may not prohibit or otherwise restrict or discourage an insured
			 depository institution from providing any product or service to an entity
			 that demonstrates to the insured depository institution that such entity—</text>
							<paragraph id="H0698975D10234D9A96E45961E3C42696"><enum>(1)</enum><text display-inline="yes-display-inline">is licensed and authorized to offer such product or service;</text>
							</paragraph><paragraph id="HA589908D2821422C80E21851A1135623"><enum>(2)</enum><text display-inline="yes-display-inline">is registered as a money transmitting business under <external-xref legal-doc="usc" parsable-cite="usc/31/5330">section 5330</external-xref> of title 31, United States Code,
			 or regulations promulgated under such section; or</text>
							</paragraph><paragraph id="H2D681015BFAB421C9CFC210E612D8726"><enum>(3)</enum><text display-inline="yes-display-inline">has a reasoned legal opinion that demonstrates the legality of the entity’s business under
			 applicable law.</text>
							</paragraph></subsection><subsection id="HC9524481B8F2428E87A398CFDD6B9B37"><enum>(b)</enum><header>Rule of Construction</header><text>Nothing in this section shall be construed to—</text>
							<paragraph id="HF9FC292ED3744F1A90A907A7F0F70C56"><enum>(1)</enum><text display-inline="yes-display-inline">require an insured depository institution—</text>
								<subparagraph id="H4127B96188434138814794696D9CD618"><enum>(A)</enum><text>to provide any product or service to any particular entity;</text>
								</subparagraph><subparagraph id="H5829555AA5AF49F18BBF993C13A8FC4A"><enum>(B)</enum><text>to regularly review the status of any license of an entity; or</text>
								</subparagraph><subparagraph id="H32BDD50316AC44EA8A292B282A5BB4B2"><enum>(C)</enum><text>to determine the validity or veracity of any reasoned legal opinion obtained under subsection
			 (a)(3); or</text>
								</subparagraph></paragraph><paragraph id="H053C3CB92382494C9AF038C5E2D10080"><enum>(2)</enum><text display-inline="yes-display-inline">imply or require that an insured depository institution may only provide products or services to an
			 entity that has met any of the requirements of paragraphs (1) through (3)
			 of subsection (a).</text>
							</paragraph></subsection><subsection id="HFD4D8BEEE58D4DE8A14FCD6B27B84A6B"><enum>(c)</enum><header>Limitation on rulemaking</header><text display-inline="yes-display-inline">The Federal banking agencies may not issue any guidance under subsection (a). Any rule implementing
			 subsection (a) shall be promulgated in accordance with section 553 of
			 title 5, United States Code.</text>
						</subsection><subsection id="H7033DA5AB7F34509A58773777F987551"><enum>(d)</enum><header>Reasoned legal opinion defined</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>reasoned legal opinion</term>—</text>
							<paragraph id="H656D34A762E3407EBA0B591CF06D0777"><enum>(1)</enum><text>means a written legal opinion by a State-licensed attorney that addresses the facts of a particular
			 business and the legality of the business’s provision of products or
			 services to customers in the relevant jurisdictions under applicable
			 Federal and State law, tribal ordinances, tribal resolutions, and
			 tribal-State compacts; and</text>
							</paragraph><paragraph id="H304B5B9F6BB0458C959060E2A45235F4"><enum>(2)</enum><text>does not include a written legal opinion that recites the facts of a particular business and states
			 a conclusion.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H3C46361155784780821596BEB5D1C27D"><enum>3.</enum><header>Business access to Federal credit unions</header>
			<text display-inline="no-display-inline">Title I of the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1751">12 U.S.C. 1751 et seq.</external-xref>) is amended by adding at the end
			 the following new section:</text>
			<quoted-block display-inline="no-display-inline" id="H1C8B3B8E9E8C449F9D392DC896CFC56B" style="OLC">
				<section id="H63020749A8034C8FAF7830B6FF66D5DC"><enum>132.</enum><header>Business access to insured credit unions</header>
					<subsection id="H1F1ABC4EA3AF4C048F575F0873984B24"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Board may not prohibit or otherwise restrict or discourage an insured credit union from
			 providing any product or service to an entity that demonstrates to the
			 insured credit union that such entity—</text>
						<paragraph id="HE0F247F77E5D43B6B7A7942025B82BE4"><enum>(1)</enum><text display-inline="yes-display-inline">is licensed and authorized to offer such product or service;</text>
						</paragraph><paragraph id="H0EC1851DBCE749A1988E9DB21168D393"><enum>(2)</enum><text display-inline="yes-display-inline">is registered as a money transmitting business under <external-xref legal-doc="usc" parsable-cite="usc/31/5330">section 5330</external-xref> of title 31, United States Code,
			 or regulations promulgated under such section; and</text>
						</paragraph><paragraph id="HB81F69174EE64E8A9E83C359D4378072"><enum>(3)</enum><text display-inline="yes-display-inline">has a reasoned legal opinion that demonstrates the legality of the entity’s business under
			 applicable law.</text>
						</paragraph></subsection><subsection id="H89F490B2FAA1499CAD6EB22A57F944A3"><enum>(b)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to—</text>
						<paragraph id="H526D98B6B3244368A44E6C42BD01782A"><enum>(1)</enum><text display-inline="yes-display-inline">require an insured credit union—</text>
							<subparagraph id="HFE7F3405323C4339934542821F789476"><enum>(A)</enum><text>to provide any products or services to any entity;</text>
							</subparagraph><subparagraph id="H49EE893D629348C0956D8F536785140E"><enum>(B)</enum><text>to regularly review the status of any license of an entity; or</text>
							</subparagraph><subparagraph id="H2F3BBB5F8E344495B4FF4BC7188276C8"><enum>(C)</enum><text>to determine the validity or veracity of any reasoned legal opinion obtained under subsection
			 (a)(3); or</text>
							</subparagraph></paragraph><paragraph id="H839DF56B8C9341D0BA1BE356858C312A"><enum>(2)</enum><text display-inline="yes-display-inline">imply or require that an insured credit union may only provide products or services to an entity
			 that has met any of the requirements of paragraphs (1) through (3) of
			 subsection (a).</text>
						</paragraph></subsection><subsection id="HB85E2D34997C41A2B34773B13BCBF026"><enum>(c)</enum><header>Limitation on rulemaking</header><text display-inline="yes-display-inline">The Board may not issue any guidance under subsection (a). Any rule implementing subsection (a)
			 shall be promulgated in accordance with <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United

					</subsection><subsection display-inline="no-display-inline" id="HC04FEE31E2E841F59F8E0CC887EB3F5C"><enum>(d)</enum><header>Reasoned legal opinion defined</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>reasoned legal opinion</term>—</text>
						<paragraph id="H33F2B706A5C34EDFA4B75C2DBDCC6839"><enum>(1)</enum><text>means a written legal opinion by a State-licensed attorney that addresses the facts of a particular
			 business and the legality of the business’s provision of products or
			 services to customers in the relevant jurisdictions under applicable
			 Federal and State law, tribal ordinances, tribal resolutions, and
			 tribal-State compacts; and</text>
						</paragraph><paragraph id="HE301170DEA9542E99297875EF72C0DB6"><enum>(2)</enum><text>does not include a written legal opinion that recites the facts of a particular business and states
			 a conclusion.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H103F690E891942A290A8B1DAED7430B9"><enum>4.</enum><header>Amendments to the Financial Institutions Reform, Recovery, and Enforcement Act of 1989</header>
			<text display-inline="no-display-inline">Section 951 of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 (12 U.S.C.
			 1833a) is amended—</text>
			<paragraph commented="no" id="H8C3F9A893B5049F88FD8A70E8DF4CA77"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c)(2), by inserting <quote>and where such violation or conspiracy to violate is in connection with a violation or conspiracy
			 to violate a section described under paragraph (1)</quote> after <quote>financial institution</quote>; and</text>
			</paragraph><paragraph id="H6CCB0B2BDE3D4D0CB67D8A1261A2A18C"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (g)—</text>
				<subparagraph id="H2A3843BA1CBA4E0B810F0BB1CCC11AFF"><enum>(A)</enum><text>in the header, by striking <quote><header-in-text level="subsection" style="OLC">subpoenas</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">investigations</header-in-text></quote>;</text>
				</subparagraph><subparagraph id="H0DD54A4BCCB44D02891A6ECDC486C46A"><enum>(B)</enum><text>in paragraph (1), by amending subparagraph (C) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H8EF23AACE3234BE69EC1E9BB12B5FAE9" style="OLC">
						<subparagraph id="HF7332CBFC5F5484EA69361CE3296630A"><enum>(C)</enum><text display-inline="yes-display-inline">request a court order from a court of competent jurisdiction, to summon witnesses and to require
			 the production of any books, papers, correspondence, memoranda, or other
			 records which the Attorney General deems relevant or material to the
			 inquiry, and which shall be issued only if the Attorney General offers
			 specific and articulable facts showing that there are reasonable grounds
			 to believe that the information or testimony sought is relevant and
			 material to an ongoing civil proceeding under this section.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="HF29F24A75965471F8D71A8B34EA2D506"><enum>(C)</enum><text>by amending paragraph (2) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H4BF255EBE07B49EA932DFDD6B5B50C5B" style="OLC">
						<paragraph id="H312056A26AA04EBE88E65B3337AA2035"><enum>(2)</enum><header>Annual report to Congress on FIRREA court orders</header><text display-inline="yes-display-inline">The Attorney General shall submit a report before January 31 of each year, beginning the first
			 January following the date of enactment of this Act, to the Committee on
			 Financial Services of the House of Representatives and the Committee on
			 Banking, Housing, and Urban Affairs of the Senate, which shall include a
			 detailed description of—</text>
							<subparagraph id="H35AB51D996E24BE2A8181BD372D58957"><enum>(A)</enum><text>the number of court orders sought by the Attorney General and the number of orders issued;</text>
							</subparagraph><subparagraph id="HCB85DA04EF6D49E1ABD0947BAB4B2209"><enum>(B)</enum><text>the recipient of the court orders;</text>
							</subparagraph><subparagraph id="HFB104910321C4FC3B77F4B59FB1037AE"><enum>(C)</enum><text>the number of documents requested and received;</text>
							</subparagraph><subparagraph id="HBCD700D716EB47299266D38F79758101"><enum>(D)</enum><text>the number of witnesses requested to testify and the number who actually testified; and</text>
							</subparagraph><subparagraph id="HDD99C1F1DD154EDEA01B1E3BF717982F"><enum>(E)</enum><text>whether a civil enforcement action was filed and the result of any such enforcement action,
			 including settlements that led to the dismissal of charges.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="HFB0A71138E6847F5A970F6B2CABF4575"><enum>(D)</enum><text>by striking paragraph (3).</text>
				</subparagraph></paragraph></section><section id="HDF80D93DFAEA498EA99B5E30C30B7564"><enum>5.</enum><header>Requiring cooperation to deter the commission of financial fraud</header>
			<text display-inline="no-display-inline">Subsection (a) of section 314 of the USA PATRIOT Act (<external-xref legal-doc="usc" parsable-cite="usc/31/5311">31 U.S.C. 5311</external-xref> note) is amended—</text>
			<paragraph id="HA0395F74E60B444C8BE22B605017AF6C"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>, the commission of financial fraud,</quote> after <quote>terrorist acts</quote>;</text>
			</paragraph><paragraph id="HA7C89E334EAE46FA8498ED7DB45A5738"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text>
				<subparagraph commented="no" id="H17EA0309D7B94D3BAF1929CD571EDD8B"><enum>(A)</enum><text>in subparagraph (B), by striking <quote>; and</quote> and inserting a semicolon;</text>
				</subparagraph><subparagraph commented="no" id="HC73FB5D121B24E06BF26525CD86B69E6"><enum>(B)</enum><text>in subparagraph (C), by striking the period at the end and inserting <quote>; and</quote>; and</text>
				</subparagraph><subparagraph id="HB00630A37F5342ACA450AB0904601882"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H643B4E9A66B34BF0AF6CFC223C62BFF7" style="USC">
						<subparagraph id="HA88141030CA44162B72CE735E2F663E2"><enum>(D)</enum><text display-inline="yes-display-inline">means of facilitating the identification of accounts and transactions involving persons engaged in
			 committing financial fraud, subject to the limitations described in
			 paragraph (5).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="HCD6C23B964424E11865E5ECB2411E9F7"><enum>(3)</enum><text>in paragraph (5), by striking <quote>shall not be used</quote> and all that follows through the period at the end and inserting the following:</text>
				<quoted-block display-inline="yes-display-inline" id="HC3259DD33BC04DB5A5FDF693888D6026" style="USC"><text>shall not—</text><subparagraph id="H11115AE5D906457E8C104A2C4372748B"><enum>(A)</enum><text display-inline="yes-display-inline">be used for any purpose other than identifying and reporting on activities that may involve
			 terrorist acts, financial fraud, or money laundering; and</text>
					</subparagraph><subparagraph id="H9B7AF3BC827140D2AF87BD3749C86E39"><enum>(B)</enum><text>be construed to require financial institutions to determine or assure compliance of any entity with
			 any Federal, State, or other licensing requirements.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H0A3249A4186B462CBD82F90CF7F0EFB5"><enum>6.</enum><header>Liability for disclosures in reporting suspicious transactions</header>
			<text display-inline="no-display-inline">Paragraph (3) of <external-xref legal-doc="usc" parsable-cite="usc/31/5318">section 5318(g)</external-xref> of title 31, United States Code, is amended—</text>
			<paragraph id="H5698F6BB787D4879A22C3FC08DA2B5FD"><enum>(1)</enum><text>in subparagraph (A), by inserting <quote>, for any underlying activity that is the subject of the disclosure,</quote> after <quote>for such disclosure</quote>; and</text>
			</paragraph><paragraph id="H1499AEFC647B4E54984BC2E54D072EF5"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B)(ii), by striking <quote>civil or</quote> before <quote>criminal</quote>.</text>
			</paragraph></section><section display-inline="no-display-inline" id="H58C0804CD7054650AF3426E20A727FB7" section-type="subsequent-section"><enum>7.</enum><header>Financial Crimes Enforcement Network Data Accountability Metrics</header>
			<text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/31/310">Section 310</external-xref> of title 31, United States Code, is amended—</text>
			<paragraph id="HAEF793087BFF451197CACCA919E131CC"><enum>(1)</enum><text>in subsection (b)(2)(C)—</text>
				<subparagraph display-inline="no-display-inline" id="H8F45524670DC46B08F79202735ADF2C1"><enum>(A)</enum><text>in clause (vi), by striking <quote>; and</quote> and inserting a semicolon;</text>
				</subparagraph><subparagraph id="HED7ECE3A23674921BCE322EFD6CFE1CD"><enum>(B)</enum><text>in clause (vii), by striking the period at the end and inserting <quote>; and</quote>; and</text>
				</subparagraph><subparagraph id="H14681642068149E0BF46DA8B2266DC48"><enum>(C)</enum><text>by adding at the end the following new clause:</text>
					<quoted-block display-inline="no-display-inline" id="H3A9A8766516D4A60A90C26E7C38A5792" style="USC">
						<clause id="H89CB28DBC3E548B99914C84E539FA8BC"><enum>(viii)</enum><text display-inline="yes-display-inline">generate feedback and report on the utility of the data access service described in subparagraph
			 (B) and the information collected by the service to improve cooperation
			 among data providers and users while reducing regulatory burden and
			 preserving payment system efficiency.</text></clause><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="H1A8D1BF1D9D74E7B822BECE5561EC9EB"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c)—</text>
				<subparagraph id="H2BE09B3BC1C34E7887227FF822F9C676"><enum>(A)</enum><text>in paragraph (1)(C), by striking <quote>; and</quote> and inserting a semicolon;</text>
				</subparagraph><subparagraph id="HAD85C12E111C4B61A501535D116EA18E"><enum>(B)</enum><text>in paragraph (2)(C), by striking the period at the end and inserting <quote>; and</quote>; and</text>
				</subparagraph><subparagraph commented="no" id="HB09A0268474B4A89968B6A66FDE2C17E"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H247CAAD294A342E49501490E67D293C1" style="USC">
						<paragraph commented="no" id="HF688226580024B878BA086CAF70083F2"><enum>(3)</enum><text display-inline="yes-display-inline">for appropriate metrics to monitor, track, assess, and report on access to information contained in
			 the data maintenance system maintained by FinCEN for—</text>
							<subparagraph commented="no" id="HCC75B031C5E548799B6A32B80BA89F6D"><enum>(A)</enum><text display-inline="yes-display-inline">identifying, tracking, and measuring how such information is used and the law enforcement results
			 obtained as a consequence of that use; and</text>
							</subparagraph><subparagraph commented="no" id="HD20A8117247044C3949224C336D3CA1E"><enum>(B)</enum><text display-inline="yes-display-inline">assuring accountability by law enforcement agencies for the utility, security, and privacy of such
			 information while reducing unnecessary regulatory burdens.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph></section></legis-body>
