		<section id="H9ABA2D2334F34CEDBB27127B3A9F9552" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Empowering Students Through Enhanced Financial Counseling Act</short-title></quote>.</text>
		</section><section id="HFBD27C2C10CD46828791EDC10B4B5187"><enum>2.</enum><header>Annual counseling</header><text display-inline="no-display-inline">Section 485(l) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092(l)</external-xref>) is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="H63306FD5B399485280598547B56175D6" style="OLC">
				<subsection id="H71FEB823415A42DE860A47D13316BFE4"><enum>(l)</enum><header>Annual financial aid counseling</header>
					<paragraph id="HC9F5E4A1033E4677B04F81A86637767D"><enum>(1)</enum><header>Annual disclosure required</header>
						<subparagraph id="H163279AA554A4446A372C59B3BC34AF2"><enum>(A)</enum><header>In general</header><text>Each eligible institution shall ensure that each individual who receives a Federal Pell Grant or a
			 loan made under part D (other than a Federal Direct Consolidation Loan)
			 receives comprehensive information on the terms and conditions of such
			 Federal Pell Grant or loan and the responsibilities the individual has
			 with respect to such Federal Pell Grant or loan. Such information shall be
			 provided, for each award year for which the individual receives such
			 Federal Pell Grant or loan, in a simple and understandable manner—</text>
							<clause id="HCA6AF8BFB1B5474D836FCFBC2065617F"><enum>(i)</enum><text display-inline="yes-display-inline">during a counseling session conducted in person;</text>
							</clause><clause id="HA57EB55E093E41F0A5B44B514F155CD0"><enum>(ii)</enum><text display-inline="yes-display-inline">online, with the individual acknowledging receipt of the information; or</text>
							</clause><clause id="H2C5655381B31427B960B9CD4A797F0AC"><enum>(iii)</enum><text display-inline="yes-display-inline">through the use of the online counseling tool described in subsection (n)(1)(B).</text>
							</clause></subparagraph><subparagraph id="H719250FBFFAF4C6DB7E5117A892A4F3D"><enum>(B)</enum><header>Use of interactive programs</header><text display-inline="yes-display-inline">In the case of institutions not using the online counseling tool described in subsection (n)(1)(B),
			 the Secretary shall require such institutions to carry out the
			 requirements of subparagraph (A) through the use of interactive programs,
			 during an annual counseling session that is in-person or online, that test
			 the individual’s understanding of the terms and conditions of the Federal
			 Pell Grant or loan awarded to the student, using simple and understandable
			 language and clear formatting.</text>
						</subparagraph></paragraph><paragraph id="HE2F78916C8E6420C9A26344EAF2F9258"><enum>(2)</enum><header>All individuals</header><text display-inline="yes-display-inline">The information to be provided under paragraph (1)(A) to each individual receiving counseling under
			 this subsection shall include the following:</text>
						<subparagraph id="H73DC999CEDF4488B9FDE5DB81FB6A54D"><enum>(A)</enum><text>An explanation of how the student may budget for typical educational expenses and a sample budget
			 based on the cost of attendance for the institution.</text>
						</subparagraph><subparagraph commented="no" id="HBB7E92689A90412EBC1954DD45CDF1B8"><enum>(B)</enum><text display-inline="yes-display-inline">An explanation that an individual has a right to annually request a disclosure of information
			 collected by a consumer reporting agency pursuant to section 612(a) of the
			 Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681j">15 U.S.C. 1681j(a)</external-xref>).</text>
						</subparagraph><subparagraph id="HA79697A9EF3443D38F793FC33499599A"><enum>(C)</enum><text display-inline="yes-display-inline">Based on the most recent data available from the American Community Survey available from the
			 Department of Commerce, the estimated average income and percentage of
			 employment in the State of domicile of the borrower for persons with—</text>
							<clause id="H1797D43AA32C4BD39BCB8D157774DE66"><enum>(i)</enum><text>a high school diploma or equivalent;</text>
							</clause><clause id="H83CAF968B5774506907B4CE51FF290D4"><enum>(ii)</enum><text>some post-secondary education without completion of a degree or certificate; and</text>
							</clause><clause id="H7BD14D81F12843D284B74F4F82F84143"><enum>(iii)</enum><text>a bachelor’s degree.</text>
							</clause></subparagraph><subparagraph id="H6E5406DB7A574E81B8E1C2CF416E09EF"><enum>(D)</enum><text display-inline="yes-display-inline">An introduction to the financial management resources provided by the Financial Literacy and
			 Education Commission.</text>
						</subparagraph></paragraph><paragraph id="H1C5054F0E7204655B95B0B023EAE5F7C"><enum>(3)</enum><header>Students receiving Federal Pell Grants</header><text display-inline="yes-display-inline">The information to be provided under paragraph (1)(A) to each student receiving a Federal Pell
			 Grant shall include the following:</text>
						<subparagraph commented="no" id="H6F15D715F965422A9B052F90420E3075"><enum>(A)</enum><text>An explanation of the terms and conditions of the Federal Pell Grant.</text>
						</subparagraph><subparagraph id="H1A82EB15EC8C482BBCC5BEC3B41BE4C9"><enum>(B)</enum><text>An explanation of approved educational expenses for which the student may use the Federal Pell
			 Grant.</text>
						</subparagraph><subparagraph id="H2C8595FC970C4B2B9462440823BB9540"><enum>(C)</enum><text>An explanation of why the student may have to repay the Federal Pell Grant.</text>
						</subparagraph><subparagraph id="H4B58A49684A94E11BB6C469C2492B7DF"><enum>(D)</enum><text>An explanation of the maximum number of semesters or equivalent for which the student may be
			 eligible to receive a Federal Pell Grant, and a statement of the amount of
			 time remaining for which the student may be eligible to receive a Federal
			 Pell Grant.</text>
						</subparagraph><subparagraph id="HACAAF8891C284C349646BDEE1B19303E"><enum>(E)</enum><text display-inline="yes-display-inline">An explanation that if the student transfers to another institution not all of the student’s
			 courses may be acceptable in transfer toward meeting specific degree or
			 program requirements at such institution, but the amount of time remaining
			 for which a student may be eligible to receive a Federal Pell Grant, as
			 provided under subparagraph (D), will not change.</text>
						</subparagraph><subparagraph id="H1E1A5B8B303B4E04BAA7B927806FE3D4"><enum>(F)</enum><text>An explanation of how the student may seek additional financial assistance from the institution’s
			 financial aid office due to a change in the student’s financial
			 circumstances, and the contact information for such office.</text>
						</subparagraph></paragraph><paragraph id="HF28A3CA7BEC440A0AC3FB17BC5360DB7"><enum>(4)</enum><header>Borrowers receiving loans made under part D (other than Parent PLUS Loans)</header><text display-inline="yes-display-inline">The information to be provided under paragraph (1)(A) to a borrower of a loan made under part D
			 (other than a Federal Direct PLUS Loan made on behalf of a dependent
			 student) shall include the following:</text>
						<subparagraph id="H4CD471829E23434488D6C38E2B75E98E"><enum>(A)</enum><text>To the extent practicable, the effect of accepting the loan to be disbursed on the eligibility of
			 the borrower for other forms of student financial assistance.</text>
						</subparagraph><subparagraph id="HDF17F0A6590E483D9AEBE638D41448B0"><enum>(B)</enum><text>An explanation of the use of the master promissory note.</text>
						</subparagraph><subparagraph id="H4AF22A2B15EB47108FA2FFB51E9BA0A6"><enum>(C)</enum><text>An explanation that the borrower is not required to accept the full amount of the loan offered to
			 the borrower.</text>
						</subparagraph><subparagraph id="H710035362296476C83A7B6B356011DB2"><enum>(D)</enum><text>An explanation that the borrower should consider accepting any grant, scholarship, or State or
			 Federal work-study jobs for which the borrower is eligible prior to
			 accepting Federal student loans.</text>
						</subparagraph><subparagraph id="H0768E39CC94944418C01318C799F98EA"><enum>(E)</enum><text display-inline="yes-display-inline">A recommendation to the borrower to exhaust the borrower’s Federal student loan options prior to
			 taking out private loans, an explanation that Federal student loans
			 typically offer better terms and conditions than private loans, an
			 explanation of treatment of loans made under part D and private education
			 loans in bankruptcy, and an explanation that if a borrower decides to take
			 out a private education loan—</text>
							<clause commented="no" id="HD15DC07980DE42B99C5FAF8A153702FC"><enum>(i)</enum><text>the borrower has the ability to select a private educational lender of the borrower’s choice;</text>
							</clause><clause id="H83BB8FA2DFBC402B95BDB9C35516CD81"><enum>(ii)</enum><text>the proposed private education loan may impact the borrower’s potential eligibility for other
			 financial assistance, including Federal financial assistance under this
			 title; and</text>
							</clause><clause commented="no" id="H3E579839F61E473DA5A6A0ABA6B056EB"><enum>(iii)</enum><text display-inline="yes-display-inline">the borrower has a right—</text>
								<subclause commented="no" id="H908D9256BF89494F9A0597766E1D961D"><enum>(I)</enum><text>to accept the terms of the private education loan within 30 calendar days following the date on
			 which the application for such loan is approved and the borrower receives
			 the required disclosure documents, pursuant to section 128(e)(6) of the
			 Truth in Lending Act; and</text>
								</subclause><subclause commented="no" id="H6315ABE86228440FADEA873EA6A7F9FF"><enum>(II)</enum><text>to cancel such loan within 3 business days of the date on which the loan is consummated, pursuant
			 to section 128(e)(7) of such Act.</text>
								</subclause></clause></subparagraph><subparagraph id="HC3B2F7AEA4DB439FB070155FB7E37AE4"><enum>(F)</enum><text>An explanation of the approved educational expenses for which the borrower may use a loan made
			 under part D.</text>
						</subparagraph><subparagraph id="H5D1AD81A7F0D49469FB975BFDD80DD55"><enum>(G)</enum><text>Information on the annual and aggregate loan limits for Federal Direct Stafford Loans and Federal
			 Direct Unsubsidized Stafford Loans.</text>
						</subparagraph><subparagraph id="H136D7A8388B04954AEBFCE13F39DC1C6"><enum>(H)</enum><text>Information on how interest accrues and is capitalized during periods when the interest is not paid
			 by either the borrower or the Secretary.</text>
						</subparagraph><subparagraph id="H0097852E054C48A28E1532166BAF67E6"><enum>(I)</enum><text>In the case of a Federal Direct PLUS Loan or a Federal Direct Unsubsidized Stafford Loan, the
			 option of the borrower to pay the interest while the borrower is in
			 school.</text>
						</subparagraph><subparagraph commented="no" id="H94B3C317E5824F25B8D2E32B5AF147EC"><enum>(J)</enum><text>The definition of half-time enrollment at the institution, during regular terms and summer school,
			 if applicable, and the consequences of not maintaining at least half-time
			 enrollment.</text>
						</subparagraph><subparagraph id="HD0B514B1CFD841ADBD11CC2E09AC622B"><enum>(K)</enum><text display-inline="yes-display-inline">An explanation of the importance of contacting the appropriate offices at the institution of higher
			 education if the borrower withdraws prior to completing the borrower's
			 program of study so that the institution can provide exit counseling,
			 including information regarding the borrower's repayment options and loan
			 consolidation.</text>
						</subparagraph><subparagraph display-inline="no-display-inline" id="HF39B72DCC0C344C7B7C96A62B7DCF43D"><enum>(L)</enum><text display-inline="yes-display-inline">For a first-time borrower—</text>
							<clause id="HAA8419D49B2F499E9F08D9C59C60FE37"><enum>(i)</enum><text>a statement of the anticipated balance on the loan for which the borrower is receiving counseling
			 under this subsection;</text>
							</clause><clause id="HE23CC74782F741BC9AA0FE221F9393B8"><enum>(ii)</enum><text>based on such anticipated balance, the anticipated monthly payment amount under, at minimum—</text>
								<subclause id="H56FEDA9109BB4A8DADC7CA6CAD9CEF58"><enum>(I)</enum><text>the standard repayment plan; and</text>
								</subclause><subclause id="H303A55B9E30146C38BA7027331C1C17E"><enum>(II)</enum><text>an income-based repayment plan under section 493C, as determined using regionally available data
			 from the Bureau of Labor Statistics of the average starting salary for the
			 occupation in which the borrower has an interest in or intends to be
			 employed; and</text>
								</subclause></clause><clause id="H8CDF290AB0264FA1A059B38DE794B43D"><enum>(iii)</enum><text>an estimate of the projected monthly payment amount under each repayment plan described in clause
			 (ii), based on the average cumulative indebtedness at graduation for
			 borrowers of loans made under part D who are in the same program of study
			 as the borrower.</text>
							</clause></subparagraph><subparagraph id="H7FCFE82277E6444DBC60D562DF4BB0EA"><enum>(M)</enum><text>For a borrower with an outstanding balance of principal or interest due on a loan made under this
			 title—</text>
							<clause id="HBB13753F32FA4CD49C12946B1A61EBEA"><enum>(i)</enum><text>a current statement of the amount of such outstanding balance and interest accrued;</text>
							</clause><clause id="H418A9412DD2C42718537F91BD4CFD1C8"><enum>(ii)</enum><text display-inline="yes-display-inline">based on such outstanding balance, the anticipated monthly payment amount under, at minimum, the
			 standard repayment plan and, using regionally available data from the
			 Bureau of Labor Statistics of the average starting salary for the
			 occupation the borrower intends to be employed, an income-based repayment
			 plan under section 493C; and</text>
							</clause><clause id="H36D3D4D739164E71959EB93CB02C0A55"><enum>(iii)</enum><text display-inline="yes-display-inline">an estimate of the projected monthly payment amount under each repayment plan described in clause
			 (ii), based on—</text>
								<subclause id="H73D6B0770F63487BAE95636D7FCD9A08"><enum>(I)</enum><text display-inline="yes-display-inline">the outstanding balance described in clause (i);</text>
								</subclause><subclause id="H39F0D30C90C5471DA256228D1B978A59"><enum>(II)</enum><text>the anticipated outstanding balance on the loan for which the student is receiving counseling under
			 this subsection; and</text>
								</subclause><subclause id="H6FD08B0ECD9D417180F0A36D72BC6EB5"><enum>(III)</enum><text>a projection for any other loans made under part D that the borrower is reasonably expected to
			 accept during the borrower’s program of study based on at least the
			 expected increase in the cost of attendance of such program.</text>
								</subclause></clause></subparagraph><subparagraph id="HCCAA1B3D3A63470186ADF4C34629AFAF"><enum>(N)</enum><text>The obligation of the borrower to repay the full amount of the loan, regardless of whether the
			 borrower completes or does not complete the program in which the borrower
			 is enrolled within the regular time for program completion.</text>
						</subparagraph><subparagraph id="H09BAC82867ED4F27A16CC839EB50A8D0"><enum>(O)</enum><text display-inline="yes-display-inline">The likely consequences of default on the loan, including adverse credit reports, delinquent debt
			 collection procedures under Federal law, and litigation, and a notice of
			 the institution’s most recent cohort default rate (defined in section
			 435(m)), an explanation of the cohort default rate, the most recent
			 national average cohort default rate, and the most recent national average
			 cohort default rate for the category of institution described in section
			 435(m)(4) to which the institution belongs.</text>
						</subparagraph><subparagraph id="HFD2E0A5ED0434B2B8B8822223E75796F"><enum>(P)</enum><text>Information on the National Student Loan Data System and how the borrower can access the borrower's
			 records.</text>
						</subparagraph><subparagraph id="HA9B9E42FD8824C129CCBE7081F20DA68"><enum>(Q)</enum><text>The contact information for the institution’s financial aid office or other appropriate office at
			 the institution the borrower may contact if the borrower has any questions
			 about the borrower's rights and responsibilities or the terms and
			 conditions of the loan.</text>
						</subparagraph></paragraph><paragraph id="H4F4AA4310CEE48C88381BFD8DB71C510"><enum>(5)</enum><header>Borrowers receiving Parent PLUS Loans for dependent students</header><text>The information to be provided under paragraph (1)(A) to a borrower of a Federal Direct PLUS Loan
			 made on behalf of a dependent student shall include the following:</text>
						<subparagraph id="H2EAE1108D8F64346B576A18A5976FB33"><enum>(A)</enum><text>The information described in subparagraphs (A) through (C) and (N) through (Q) of paragraph (4).</text>
						</subparagraph><subparagraph id="HFC06C92C169F4E60AB4C538C5BA36BCE"><enum>(B)</enum><text display-inline="yes-display-inline">The option of the borrower to pay the interest on the loan while the loan is in deferment.</text>
						</subparagraph><subparagraph display-inline="no-display-inline" id="H34421BC31E564EF3831EEC8DCE013A40"><enum>(C)</enum><text display-inline="yes-display-inline">For a first-time borrower of such loan—</text>
							<clause id="H55F0899229594E73A40904478131A1CA"><enum>(i)</enum><text>a statement of the anticipated balance on the loan for which the borrower is receiving counseling
			 under this subsection;</text>
							</clause><clause id="H68AC4B590CF34DFF9094111B1A57F512"><enum>(ii)</enum><text>based on such anticipated balance, the anticipated monthly payment amount under the standard
			 repayment plan; and</text>
							</clause><clause id="HEC14A3174B03450181698E777C1280CF"><enum>(iii)</enum><text>an estimate of the projected monthly payment amount under the standard repayment plan, based on the
			 average cumulative indebtedness of other borrowers of Federal Direct PLUS
			 Loans made on behalf of dependent students who are in the same program of
			 study as the student on whose behalf the borrower borrowed the loan.</text>
							</clause></subparagraph><subparagraph id="H4F1F5DC1CBF84BA0AEB81FEA4691A205"><enum>(D)</enum><text display-inline="yes-display-inline">For a borrower with an outstanding balance of principal or interest due on such loan—</text>
							<clause id="HA9AC58EB7081417AAFCA950A33972A9F"><enum>(i)</enum><text>a statement of the amount of such outstanding balance;</text>
							</clause><clause id="H7F468DA102B94640BE6D2FE973786621"><enum>(ii)</enum><text>based on such outstanding balance, the anticipated monthly payment amount under the standard
			 repayment plan; and</text>
							</clause><clause id="H8DCF9A2733D04FC28D623DFC753A686E"><enum>(iii)</enum><text display-inline="yes-display-inline">an estimate of the projected monthly payment amount under the standard repayment plan, based on—</text>
								<subclause id="HDF4CFF47F63945F8AAEA697EBA7173B3"><enum>(I)</enum><text>the outstanding balance described in clause (i);</text>
								</subclause><subclause id="H73516AB8BFDE483A9B62534AD27AD5EB"><enum>(II)</enum><text>the anticipated outstanding balance on the loan for which the borrower is receiving counseling
			 under this subsection; and</text>
								</subclause><subclause id="H7DE3FD1084144F31B690FBE7F1BC4B8B"><enum>(III)</enum><text>a projection for any other Federal Direct PLUS Loan made on behalf of the dependent student that
			 the borrower is reasonably expected to accept during the program of study
			 of such student based on at least the expected increase in the cost of
			 attendance of such program.</text>
								</subclause></clause></subparagraph><subparagraph id="H799E1301294C4F068178CA0BD86AF992"><enum>(E)</enum><text display-inline="yes-display-inline">Debt management strategies that are designed to facilitate the repayment of such indebtedness.</text>
						</subparagraph><subparagraph id="H458A9132E39D4EF9A66B26D651AFFAE0"><enum>(F)</enum><text display-inline="yes-display-inline">An explanation that the borrower has the options to prepay each loan, pay each loan on a shorter
			 schedule, and change repayment plans.</text>
						</subparagraph><subparagraph id="HFB95716AD8E14161B851DB1BA27B1348"><enum>(G)</enum><text display-inline="yes-display-inline">For each Federal Direct PLUS Loan made on behalf of a dependent student for which the borrower is
			 receiving counseling under this subsection, the contact information for
			 the loan servicer of the loan and a link to such servicer’s Website.</text>
						</subparagraph></paragraph><paragraph id="H99E75B015C2745DC9D49A77DE07F37DD"><enum>(6)</enum><header>Annual loan acceptance</header><text display-inline="yes-display-inline">Prior to making the first disbursement of a loan made under part D (other than a Federal Direct
			 Consolidation Loan) to a borrower for an award year, an eligible
			 institution, shall, as part of carrying out the counseling requirements of
			 this subsection for the loan, ensure that after receiving the applicable
			 counseling under paragraphs (2), (4), and (5) for the loan the borrower
			 accepts the loan for such award year by—</text>
						<subparagraph id="H036C2F87F16D445ABC40BE79C1ED5BA7"><enum>(A)</enum><text>signing the master promissory note for the loan;</text>
						</subparagraph><subparagraph id="H94D9BFFA3DD2479BBE3E393BE1F9B9FE"><enum>(B)</enum><text>signing and returning to the institution a separate written statement that affirmatively states
			 that the borrower accepts the loan; or</text>
						</subparagraph><subparagraph id="H61C6EAE3F9CD4331AE8CA91864B4A4DB"><enum>(C)</enum><text>electronically signing an electronic version of the statement described in subparagraph (B).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HAC5A124C98DB4AA99CB92D8AE42CB1BD"><enum>3.</enum><header>Exit Counseling</header><text display-inline="no-display-inline">Section 485(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092(b)</external-xref>) is amended—</text>
			<paragraph id="HB6EBBF9BE673418BAF4EFD60203E3C52"><enum>(1)</enum><text>in paragraph (1)(A)—</text>
				<subparagraph id="H1177ED062E194EA4846D3A286233431C"><enum>(A)</enum><text>in the matter preceding clause (i), by striking <quote>through financial aid offices or otherwise</quote> and inserting <quote>through the use of an interactive program, during an exit counseling session that is in-person or
			 online, or through the use of the online counseling tool described in
			 subsection (n)(1)(A)</quote>;</text>
				</subparagraph><subparagraph id="H31A4C14D3BB74B77BBA1B082F862505D"><enum>(B)</enum><text>by redesignating clauses (i) through (ix) as clauses (iv) through (xii), respectively;</text>
				</subparagraph><subparagraph id="HD061908AED6045F4B2C1B5331B980499"><enum>(C)</enum><text>by inserting before clause (iv), as so redesignated, the following:</text>
					<quoted-block display-inline="no-display-inline" id="H98FBC992A1A843239026BD73BD0CDB4A" style="OLC">
						<clause id="H4E5BD032B14C41A984A2F814ED90C8D2" indent="up2"><enum>(i)</enum><text display-inline="yes-display-inline">a summary of the outstanding balance of principal and interest due on the loans made to the
			 borrower under part B, D, or E;</text>
						</clause><clause id="HBADBEE9ABE2E4830A4B98236951A41C0" indent="up2"><enum>(ii)</enum><text>an explanation of the grace period preceding repayment and the expected date that the borrower will
			 enter repayment;</text>
						</clause><clause id="H8414AB382746404DA1E64010A8F01AC5" indent="up2"><enum>(iii)</enum><text display-inline="yes-display-inline">an explanation that the borrower has the option to pay any interest that has accrued while the
			 borrower was in school or that may accrue during the grace period
			 preceding repayment or during an authorized period of deferment or
			 forbearance, prior to the capitalization of the interest;</text></clause><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="H4B354059CA5E494ABB60C26049B6B0D7"><enum>(D)</enum><text>in clause (iv), as so redesignated—</text>
					<clause id="H84644D1F2C34454BA8F9EDF13FDA4E3D"><enum>(i)</enum><text>by striking <quote>sample information showing the average</quote> and inserting <quote>information, based on the borrower’s outstanding balance described in clause (i), showing the
			 borrower’s</quote>; and</text>
					</clause><clause id="HAE4B5AE1E8464C62B3E9E78FE3036988"><enum>(ii)</enum><text>by striking <quote>of each plan</quote> and inserting <quote>of at least the standard repayment plan and the income-based repayment plan under section 493C</quote>;</text>
					</clause></subparagraph><subparagraph id="H9276E6E9311340799407876511E7B3EA"><enum>(E)</enum><text display-inline="yes-display-inline">in clause (ix), as so redesignated—</text>
					<clause id="HB6DFF629637D41098372745763162AB9"><enum>(i)</enum><text>by inserting <quote>decreased credit score,</quote> after <quote>credit reports,</quote>; and</text>
					</clause><clause id="HF92B84154D8D4756B05338C81A615A8B"><enum>(ii)</enum><text>by inserting <quote>reduced ability to rent or purchase a home or car, potential difficulty in securing employment,</quote> after <quote>Federal law,</quote>;</text>
					</clause></subparagraph><subparagraph id="H57B47D79D91E401B9C5E75EE614C42EF"><enum>(F)</enum><text>in clause (x), as so redesignated, by striking <quote>consolidation loan under section 428C or a</quote>;</text>
				</subparagraph><subparagraph id="H1D28FC6F9E8A46BFAC0F309EA904EE9C"><enum>(G)</enum><text>in clauses (xi) and (xii), as so redesignated, by striking <quote>and</quote> at the end; and</text>
				</subparagraph><subparagraph id="HB8684DE55C004D8AB0FEDA85C5E72871"><enum>(H)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H38C607093B484A5DB4635F349CEF8F59" style="OLC">
						<clause id="H54B105FDABC848BCB200DB2B5430B155" indent="up2"><enum>(xiii)</enum><text display-inline="yes-display-inline">for each of the borrower’s loans made under part B, D, or E for which the borrower is receiving
			 counseling under this subsection, the contact information for the loan
			 servicer of the loan and a link to such servicer’s Website; and</text>
						</clause><clause id="HFDF8B944B6714004BB2322D9B21213AA" indent="up2"><enum>(xiv)</enum><text>an explanation that an individual has a right to annually request a disclosure of information
			 collected by a consumer reporting agency pursuant to section 612(a) of the
			 Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681j">15 U.S.C. 1681j(a)</external-xref>).</text></clause><after-quoted-block>; </after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="HBB0FA3B2C8424E618AF7C5D4695D55C5"><enum>(2)</enum><text>in paragraph (1)(B)—</text>
				<subparagraph id="H5C5FD5E3AD0649D2878B01AF9B858241"><enum>(A)</enum><text>by inserting <quote>online or</quote> before <quote>in writing</quote>; and</text>
				</subparagraph><subparagraph commented="no" id="H6717B97E2AA34E6C8D95EEE6B99F030D"><enum>(B)</enum><text>by adding before the period at the end the following: <quote>, except that in the case of an institution using the online counseling tool described in
			 subsection (n)(1)(A), the Secretary shall attempt to provide such
			 information to the student in the manner described in subsection (n)(3)(C)</quote>; and</text>
				</subparagraph></paragraph><paragraph commented="no" id="H5BEA570202A84CF3AE1BA04049B799D5"><enum>(3)</enum><text>in paragraph (2)(C), by inserting <quote>, such as the online counseling tool described in subsection (n)(1)(A),</quote> after <quote>electronic means</quote>.</text>
			</paragraph></section><section id="H39806311EAA34153A14A8C9CA62A60D0"><enum>4.</enum><header>Online counseling tools</header><text display-inline="no-display-inline">Section 485 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092</external-xref>) is further amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H75E774FEF19544EBAC259C2E1E8AB145" style="OLC">
				<subsection id="H1A1568615BEF46BE8F49D111FFD57355"><enum>(n)</enum><header>Online counseling tools</header>
					<paragraph commented="no" id="H22018B292F2E43778325BE6A412D76E0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning not later than 1 year after the date of enactment of the <short-title>Empowering Students Through Enhanced Financial Counseling Act</short-title>, the Secretary shall maintain—</text>
						<subparagraph commented="no" id="H30A8AD7957A8438A8A24782FF175C8F4"><enum>(A)</enum><text>an online counseling tool that provides the exit counseling required under subsection (b) and meets
			 the applicable requirements of this subsection; and</text>
						</subparagraph><subparagraph commented="no" id="HC0F5223FD7054A588AA193BA84505E11"><enum>(B)</enum><text display-inline="yes-display-inline">an online counseling tool that provides the annual counseling required under subsection (l) and
			 meets the applicable requirements of this subsection.</text>
						</subparagraph></paragraph><paragraph id="H1FA4BCBF29434D20B44912F4AA6F2EEB"><enum>(2)</enum><header>Requirements of tools</header><text display-inline="yes-display-inline">In maintaining the online counseling tools described in paragraph (1), the Secretary shall ensure
			 that each such tool is—</text>
						<subparagraph commented="no" id="H33DA2843E2F34D23A50726B546C4A85A"><enum>(A)</enum><text display-inline="yes-display-inline">consumer tested, in consultation with other relevant Federal agencies, to ensure that the tool is
			 effective in helping individuals understand their rights and obligations
			 with respect to borrowing a loan made under part D or receiving a Federal
			 Pell Grant;</text>
						</subparagraph><subparagraph commented="no" id="H46E4F91E5FD54627800E5D85B64A9E8C"><enum>(B)</enum><text>understandable to students receiving Federal Pell Grants and borrowers of loans made under part D;
			 and</text>
						</subparagraph><subparagraph id="H29B6636B7D9A4B4787D8970C6B4743C8"><enum>(C)</enum><text>freely available to all eligible institutions.</text>
						</subparagraph></paragraph><paragraph id="H56137641582242EE9E5EDC381522302F"><enum>(3)</enum><header>Record of counseling completion</header><text display-inline="yes-display-inline">The Secretary shall—</text>
						<subparagraph id="H5410C679989F4D72A1C4F397A6E4BF14"><enum>(A)</enum><text>use each online counseling tool described in paragraph (1) to keep a record of which individuals
			 have received counseling using the tool, and notify the applicable
			 institutions of the individual’s completion of such counseling;</text>
						</subparagraph><subparagraph id="H843445FB49CA4B3398F2F5236D3984BD"><enum>(B)</enum><text>in the case of a borrower who receives annual counseling for a loan made under part D using the
			 tool described in paragraph (1)(B), notify the borrower by when the
			 borrower should accept, in a manner described in section 485(l)(6), the
			 loan for which the borrower has received such counseling; and</text>
						</subparagraph><subparagraph id="H312F6FC9323E4553B30D431E1DFC095F"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of a borrower described in subsection (b)(1)(B) at an institution that uses the online
			 counseling tool described in paragraph (1)(A) of this subsection, the
			 Secretary shall attempt to provide the information described in subsection
			 (b)(1)(A) to the borrower through such tool.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HFB7D93006BF14550BEF312C26D119609"><enum>5.</enum><header>Longitudinal study on the effectiveness of student loan counseling</header>
			<subsection id="H0DC47CC9155A4FCA94C73450A81ED09D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Education, acting
			 through the Director of the Institute of Education Sciences, shall begin
			 conducting a rigorous, longitudinal study of the impact and effectiveness
			 of the student loan counseling—</text>
				<paragraph id="H6638978907BF4D4BBAB82FE5C4FD8CD4"><enum>(1)</enum><text>provided under subsections (b), (l), and (n) of section 485 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092</external-xref>), as amended by this Act; and</text>
				</paragraph><paragraph id="H94BF22CDE56D4CABA7E036E3871DB4AE"><enum>(2)</enum><text>provided through such other means as the Secretary of Education may determine.</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="HD659A28927AB4792A93C2DB40935BAE6"><enum>(b)</enum><header>Contents</header>
				<paragraph id="H38FC86E7B67649B7BCCA1F7B7EAD1495"><enum>(1)</enum><header>Borrower information</header><text>The longitudinal study carried out under subsection (a) shall include borrower information, in the
			 aggregate and disaggregated by race, ethnicity, gender, income, and status
			 as an individual with a disability, on—</text>
					<subparagraph id="HEE7C3F5BAB7C4739B4E31B74EA32AF19"><enum>(A)</enum><text>student persistence;</text>
					</subparagraph><subparagraph id="H4DE5157FD961432BA750BB7A5EB3A605"><enum>(B)</enum><text>degree attainment;</text>
					</subparagraph><subparagraph id="H83F28BD34325429486D365C1C3E4E45D"><enum>(C)</enum><text>program completion;</text>
					</subparagraph><subparagraph id="H1EB896D9829243D0ADBFADDE34E6AAB8"><enum>(D)</enum><text>successful entry into student loan repayment;</text>
					</subparagraph><subparagraph id="HF08C793207934E30A5188ABC9EEC65B2"><enum>(E)</enum><text>cumulative borrowing levels; and</text>
					</subparagraph><subparagraph id="HEE62DF965AB2408E8FEDBCAA88B465A4"><enum>(F)</enum><text>such other factors as the Secretary of Ed<editorial></editorial>ucation may determine.</text>
					</subparagraph></paragraph><paragraph id="H55190F52C66E4A7C96F17F8E97A1AC39"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">The disaggregation under paragraph (1) shall not be required in a case in which the number of
			 borrowers in a category is insufficient to yield statistically reliable
			 information or the results would reveal personally identifiable
			 information about an individual borrower.</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="H7733DEBCC2D0400CBF50BA9FFF11029B"><enum>(c)</enum><header>Interim Reports</header><text>Not later than 18 months after the commencement of the study under subsection (a), and annually
			 thereafter, the Secretary of Education shall evaluate the progress of the
			 study and report any short-term findings to the appropriate committees of
			 Congress.</text>
			</subsection></section><section id="HA2B010122CF541DBA3B4EE483AD2C5D4"><enum>6.</enum><header>Availability of funds</header>
			<subsection id="H896CE4A39D094B2AB8A7F918B817628D"><enum>(a)</enum><header>Use of existing funds</header><text display-inline="yes-display-inline">Of the amount authorized to be appropriated for maintaining the Department of Education’s Financial
			 Awareness Counseling Tool, $2,000,000 shall be available to carry out this
			 Act and the amendments made by this Act.</text>
			</subsection><subsection id="H5209F99BECE94F2DA15B817C979AF6D7"><enum>(b)</enum><header>No additional funds authorized</header><text>No funds are authorized to be appropriated by this Act to carry out this Act or the amendments made
			 by this Act.</text>
