		</section><title id="HE800FC2DFE994ED398D65BFB93338685"><enum>I</enum><header>Protecting Children and Youth at Risk of Sex Trafficking</header>
			<subtitle id="H41B5048A0B8E4D77AABD3E904960D6E5"><enum>A</enum><header>Identifying and Protecting Children and Youth at Risk of Sex Trafficking</header>
				<section display-inline="no-display-inline" id="H26CCAB8D35D54067883010B30BA63AF0"><enum>101.</enum><header>Identifying, documenting, and determining services for children and youth at risk of sex
			 trafficking</header>
					<subsection id="H46476751F2D940B992DA1C5C937D189A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 471(a)(9) (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)(9)</external-xref>) is amended—</text>
						<paragraph id="H7F9C8F6CDE604A06A23F8EDF861506EA"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>and</quote>;</text>
						</paragraph><paragraph id="H8DE1BDF4A26D4E06BA927ABF76283CCA"><enum>(2)</enum><text>in subparagraph (B), by inserting <quote>and</quote> after the semicolon; and</text>
						</paragraph><paragraph id="H00F3D3CD72EE47A591EAB2FE22481217"><enum>(3)</enum><text>by adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="HB1E920A65B2E4273AE947DE0AB742549" style="OLC">
								<subparagraph id="H9BA9683E9DD446AEBDF54DB589AB92AC"><enum>(C)</enum><text display-inline="yes-display-inline">not later than—</text>
									<clause commented="no" id="H8196F07947C74BE0B38B94219086FECB"><enum>(i)</enum><text display-inline="yes-display-inline">1 year after the date of enactment of this subparagraph, demonstrate to the Secretary that the
			 State agency has developed, in consultation with State and local law
			 enforcement, juvenile justice systems, health care providers, education
			 agencies, and organizations with experience in dealing with at-risk
			 children and youth, policies and procedures (including relevant training
			 for caseworkers) for identifying, documenting in agency records, and
			 determining appropriate services with respect to—</text>
										<subclause id="HAF74FEAF4CDC43168C8C469B72E9DD12"><enum>(I)</enum><text display-inline="yes-display-inline">any child or youth over whom the State agency has responsibility for placement, care, or
			 supervision and who the State has reasonable cause to believe is, or is at
			 risk of being, a sex trafficking victim (including children for whom a
			 State child welfare agency has an open case file but who have not been
			 removed from the home, children who have run away from foster care and who
			 have not attained 18 years of age or such older age as the State has
			 elected under section 475(8) of this Act, and youth who are not in foster
			 care but are receiving services under section 477 of this Act); and</text>
										</subclause><subclause id="H03E2856D09844B46A3D31EA57A82C5CB"><enum>(II)</enum><text display-inline="yes-display-inline">at the option of the State, any individual who has not attained 26 years of age, without regard to
			 whether the individual is or was in foster care under the responsibility
			 of the State; and</text>
										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H7D81B798E6FA418BA883BBA5DBC83588"><enum>(ii)</enum><text display-inline="yes-display-inline">2 years after such date of enactment, demonstrate to the Secretary that the State agency is
			 implementing the policies and procedures referred to in clause (i).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="HB94570B0BC6C4E85A9A3914AF2ECBC4F"><enum>(b)</enum><header>Definition of sex trafficking victim</header><text>Section 475 (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675</external-xref>) is amended by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="HE96C161DF05F4D5A9ECBFD04DF143F04" style="OLC">
							<paragraph id="H87CFC6F4F52B4D18BC1D9CFBEE3586E9"><enum>(9)</enum><text display-inline="yes-display-inline">The term <term>sex trafficking victim</term> means a victim of—</text>
								<subparagraph id="H7EFCBC41116B4F38BFEA4D76A3BE10C0"><enum>(A)</enum><text>sex trafficking (as defined in section 103(10) of the Trafficking Victims Protection Act of 2000);
			 or</text>
								</subparagraph><subparagraph id="H609D0A298F1A4D18ADD72F96E60D4E39"><enum>(B)</enum><text>a severe form of trafficking in persons described in section 103(9)(A) of such Act.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection></section><section id="H58ED11A751544BDABE22978E11721CBF"><enum>102.</enum><header>Reporting instances of sex trafficking</header>
					<subsection id="H84A1EA70B8CC4AEA8F0EF6426F44EC05"><enum>(a)</enum><header>State plan requirements</header><text>Section 471(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)</external-xref>) is amended—</text>
						<paragraph id="H64EEB650D0C74191978A330AA4A95D22"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (32);</text>
						</paragraph><paragraph id="H7708B154FBBB422F8235FD3799691A63"><enum>(2)</enum><text>by striking the period at the end of paragraph (33) and inserting a semicolon; and</text>
						</paragraph><paragraph id="HF164D75B5A5F4F08BA01EC1ACC977CC6"><enum>(3)</enum><text>by adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="H984FF5D3EF064C0F801F8511EC85CAD9" style="OLC">
								<paragraph id="H110B307B8C884294BDC79F7EA65DD2D0"><enum>(34)</enum><text display-inline="yes-display-inline">provides that, for each child or youth described in paragraph (9)(C)(i)(I), the State agency shall—</text>
									<subparagraph id="H58624C4076494BCAB6DE17FF3D420236"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 2 years after the date of the enactment of this paragraph, report immediately, and
			 in no case later than 24 hours after receiving information on children or
			 youth who have been identified as being a sex trafficking victim, to the
			 law enforcement authorities; and</text>
									</subparagraph><subparagraph id="H640862DE4E43487E91CC39C3F4411259"><enum>(B)</enum><text display-inline="yes-display-inline">not later than 3 years after such date of enactment and annually thereafter, report to the
			 Secretary the total number of children and youth who are sex trafficking
			 victims.</text>
									</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="HAE4D4ABA364A49D5A9D08BB2E4FA90CD"><enum>(b)</enum><header>Duties of the Secretary</header><text>Section 471 (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671</external-xref>) is amended by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H97B3640F665B46189C48347032B166E3" style="OLC">
							<subsection id="HF6FA0822D5134B56824D2925FF53EA06"><enum>(d)</enum><header>Annual reports by the Secretary on number of children and youth reported by States To be sex
			 trafficking victims</header><text display-inline="yes-display-inline">Not later than 4 years after the date of the enactment of this subsection and annually thereafter,
			 the Secretary shall report to the Congress and make available to the
			 public on the Internet website of the Department of Health and Human
			 Services the number of children and youth reported in accordance with
			 subsection (a)(34)(B) of this section to be sex trafficking victims (as
			 defined in section 475(9)(A)).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection></section><section id="H1D7A0DE480A54C709580137F87FE5600"><enum>103.</enum><header>Including sex trafficking data in the Adoption and Foster Care Analysis and Reporting System</header>
					<text display-inline="no-display-inline">Section 479(c)(3) (<external-xref legal-doc="usc" parsable-cite="usc/42/679">42 U.S.C. 679(c)(3)</external-xref>) is amended—</text>
					<paragraph id="H72C0F360D2BD489197200785156B8C1E"><enum>(1)</enum><text>in subparagraph (C)(iii), by striking <quote>and</quote> after the comma; and</text>
					</paragraph><paragraph id="H51413AC183534A9F8CF64E42822D8EE2"><enum>(2)</enum><text>by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H5063743B3863426C88A9CFE3205D9CFF" style="OLC">
							<subparagraph id="H36E37DC36CEE4B5AB8546CD98C9AA862"><enum>(E)</enum><text display-inline="yes-display-inline">the annual number of children in foster care who are identified as sex trafficking victims—</text>
								<clause id="HA2CBA576823D484996E766FE823B81C3"><enum>(i)</enum><text>who were such victims before entering foster care; and</text>
								</clause><clause id="H4A8F818E85E1408E90144976609E4A94"><enum>(ii)</enum><text>who were such victims while in foster care; and</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section id="HC7647225B3BD4EB88D8D288CA076CE91"><enum>104.</enum><header>Locating and responding to children who run away from foster care</header><text display-inline="no-display-inline">Section 471(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)</external-xref>), as amended by section 102(a) of this Act, is amended—</text>
					<paragraph id="H15F161EE095F43E692F8A47D4FB8F430"><enum>(1)</enum><text>by striking the period at the end of paragraph (34) and inserting <quote>; and</quote>; and</text>
					</paragraph><paragraph id="HB8A6B3E25D534CD18CC8D45541FBD7B9"><enum>(2)</enum><text>by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H3EA21800608D4BA9ADFE5D79AF8B653E" style="OLC">
							<paragraph id="H2B3A5C02AEAA4590B8183F09020D7265"><enum>(35)</enum><text display-inline="yes-display-inline">provides that—</text>
								<subparagraph id="HE9F69CFDC6E446A2B7D0118A9458BD0A"><enum>(A)</enum><text>not later than 1 year after the date of the enactment of this paragraph, the State shall develop
			 and implement specific protocols for—</text>
									<clause id="H43832A4F478E41218F391C82816C66BE"><enum>(i)</enum><text>expeditiously locating any child missing from foster care;</text>
									</clause><clause id="HC9BF2BBD94F547518112B2943B894D1F"><enum>(ii)</enum><text>determining the primary factors that contributed to the child’s running away or otherwise being
			 absent from care, and to the extent possible and appropriate, responding
			 to those factors in current and subsequent placements;</text>
									</clause><clause id="H1D89BE468FAD4FCFA0F98F35D0505455"><enum>(iii)</enum><text>determining the child’s experiences while absent from care, including screening the child to
			 determine if the child is a possible sex trafficking victim (as defined in
			 section 475(9)(A)); and</text>
									</clause><clause id="H5400130D98F34DB18690E4AFB6ED0300"><enum>(iv)</enum><text>reporting such related information as required by the Secretary; and</text>
									</clause></subparagraph><subparagraph id="H59CB030E374E4C28A2E9861392C008FB"><enum>(B)</enum><text display-inline="yes-display-inline">not later than 2 years after such date of enactment, for each child and youth described in
			 paragraph (9)(C)(i)(I) of this subsection, the State agency shall report
			 immediately, and in no case later than 24 hours after receiving,
			 information on missing or abducted children or youth to the law
			 enforcement authorities for entry into the National Crime Information
			 Center (NCIC) database of the Federal Bureau of Investigation, established
			 pursuant to <external-xref legal-doc="usc" parsable-cite="usc/28/534">section 534</external-xref> of title 28, United States Code, and to the National Center for Missing and Exploited Children.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section id="H03D57E7E5D544F93B564ABF9877EE107"><enum>105.</enum><header>Increasing information on children in foster care to prevent sex trafficking</header><text display-inline="no-display-inline">Not later than 2 years after the date of the enactment of this Act, the Secretary of Health and
			 Human Services shall submit to the Congress a written report which
			 summarizes the following:</text>
					<paragraph id="H1AD3BCC4A3854B8B850208B4F257B485"><enum>(1)</enum><text display-inline="yes-display-inline">Information on children who run away from foster care and their risk of becoming sex trafficking
			 victims, using data reported by States under section 479 of the Social
			 Security Act and information collected by States related to section
			 471(a)(35) of such Act, including—</text>
						<subparagraph id="H8FD3C74C276A4F92B7C757925F869474"><enum>(A)</enum><text>characteristics of children who run away from foster care;</text>
						</subparagraph><subparagraph id="H0243C049684043DFBC109379F376B03A"><enum>(B)</enum><text display-inline="yes-display-inline">potential factors associated with children running away from foster care (such as reason for entry
			 into care, length of stay in care, type of placement, and other factors
			 that contributed to the child’s running away);</text>
						</subparagraph><subparagraph id="H98B9D2A33F104F2DB12D922A37AC0B3F"><enum>(C)</enum><text display-inline="yes-display-inline">information on children's experiences while absent from care; and</text>
						</subparagraph><subparagraph id="HCA705F8025C84E2FA816B7BF75608F33"><enum>(D)</enum><text>trends in the number of children reported as runaways in each fiscal year (including factors that
			 may have contributed to changes in such trends).</text>
						</subparagraph></paragraph><paragraph id="H6BC24981BCDA47E797E9BF55B224E1C0"><enum>(2)</enum><text>Information on State efforts to provide specialized services, foster family homes, child care
			 institutions, or other forms of placement for children who are sex
			 trafficking victims.</text>
					</paragraph><paragraph id="H14F950AFB3E64EC48E63E5AF9FF4B1C7"><enum>(3)</enum><text>Information on State efforts to ensure children in foster care form and maintain long-lasting
			 connections to caring adults, even when a child in foster care must move
			 to another foster family home or when the child is placed under the
			 supervision of a new caseworker.</text>
					</paragraph></section></subtitle><subtitle id="H09B798BBC0DC4647A2CA51E265BB0B84"><enum>B</enum><header>Improving Opportunities for Children in Foster Care and Supporting Permanency</header>
				<section display-inline="no-display-inline" id="H9AE7B282DF854368BF9C355122A11DAE"><enum>111.</enum><header>Supporting normalcy for children in foster care</header>
					<subsection id="HA823099CCC8E4ECBBEB5004126F123DE"><enum>(a)</enum><header>Reasonable and prudent parent standard</header>
						<paragraph id="H5A33423FF59143D6B21992D3083CA8B0"><enum>(1)</enum><header>Definitions relating to the standard</header><text>Section 475 (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675</external-xref>), as amended by section 101(b) of this Act, is amended by adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="HB9EDBE01C9FB4F4EAC98F2AB5F47A1F6" style="OLC">
								<paragraph id="HA198DA42E1604F97BBE172D1F20FE88D"><enum>(10)</enum>
									<subparagraph commented="no" display-inline="yes-display-inline" id="H7DF37303E9314AEF978D490F798B6048"><enum>(A)</enum><text>The term <term>reasonable and prudent parent standard</term> means the standard characterized by careful and sensible parental decisions that maintain the
			 health, safety, and best interests of a child while at the same time
			 encouraging the emotional and developmental growth of the child, that a
			 caregiver shall use when determining whether to allow a child in foster
			 care under the responsibility of the State to participate in
			 extracurricular, enrichment, cultural, and social activities.</text>
									</subparagraph><subparagraph id="H79954B6C764A4B258D6124BBA3B7EE91" indent="up1"><enum>(B)</enum><text>For purposes of subparagraph (A), the term <term>caregiver</term> means a foster parent with whom a child in foster care has been placed or a designated official
			 for a child care institution in which a child in foster care has been
			 placed.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA14B2A9C35E74B97A068E6E0FBE50FB4"><enum>(11)</enum>
									<subparagraph commented="no" display-inline="yes-display-inline" id="HF66CF153416442C4A9CBDC6F34D8FBD5"><enum>(A)</enum><text>The term <term>age or developmentally-appropriate</term> means—</text>
										<clause id="H1B3E08ABCAC044999B6540252FA3BD80" indent="up1"><enum>(i)</enum><text>activities or items that are generally accepted as suitable for children of the same chronological
			 age or level of maturity or that are determined to be
			 developmentally-appropriate for a child, based on the development of
			 cognitive, emotional, physical, and behavioral capacities that are typical
			 for an age or age group; and</text>
										</clause><clause id="HA1525E7AA3B14006825210098D75AC70" indent="up1"><enum>(ii)</enum><text>in the case of a specific child, activities or items that are suitable for the child based on the
			 developmental stages attained by the child with respect to the cognitive,
			 emotional, physical, and behavioral capacities of the child.</text>
										</clause></subparagraph><subparagraph id="HA6796AC5A55A460A900334ECB8407889" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">In the event that any age-related activities have implications relative to the academic curriculum
			 of a child, nothing in this part or part B shall be construed to authorize
			 an officer or employee of the Federal Government to mandate, direct, or
			 control a State or local educational agency, or the specific instructional
			 content, academic achievement standards and assessments, curriculum, or
			 program of instruction of a school.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph><paragraph id="H32200F7C66894EEBB8DA19B7E981CA92"><enum>(2)</enum><header>State plan requirement</header><text>Section 471(a)(24) (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)(24)</external-xref>) is amended—</text>
							<subparagraph id="HA3C93DB97956435D82FA08DAE424CB76"><enum>(A)</enum><text>by striking <quote>include</quote> and inserting <quote>includes</quote>;</text>
							</subparagraph><subparagraph id="HEE116953C83443FBA52AFEAE5F72DC6F"><enum>(B)</enum><text>by striking <quote>and that such preparation</quote> and inserting <quote>that the preparation</quote>; and</text>
							</subparagraph><subparagraph id="H6DDC9696A5674D3AB926594F8143E157"><enum>(C)</enum><text>by inserting <quote>, and that the preparation shall include knowledge and skills relating to the reasonable and
			 prudent parent standard for the participation of the child in age or
			 developmentally-appropriate activities, including knowledge and skills
			 relating to the developmental stages of the cognitive, emotional,
			 physical, and behavioral capacities of a child, and knowledge and skills
			 relating to applying the standard to decisions such as whether to allow
			 the child to engage in social, extracurricular, enrichment, cultural, and
			 social activities, including sports, field trips, and overnight activities
			 lasting 1 or more days, and to decisions involving the signing of
			 permission slips and arranging of transportation for the child to and from
			 extracurricular, enrichment, and social activities</quote> before the semicolon.</text>
							</subparagraph></paragraph><paragraph id="H3E1ADB6CABF844CE9EE7FD0A97DB4104"><enum>(3)</enum><header>Technical assistance</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall provide assistance to the States on best practices
			 for devising strategies to assist foster parents in applying a reasonable
			 and prudent parent standard in a manner that protects child safety, while
			 also allowing children to experience normal and beneficial activities,
			 including methods for appropriately considering the concerns of the
			 biological parents of a child in decisions related to participation of the
			 child in activities (with the understanding that those concerns should not
			 necessarily determine the participation of the child in any activity).</text>
						</paragraph></subsection><subsection id="HD98F32FA6F4B40B6845EE05C535A01D9"><enum>(b)</enum><header>Normalcy for children in child care institutions</header><text>Section 471(a)(10) (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)(10)</external-xref>) is amended to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="H3B2DA75EB31C4AD88AF2B57EB50685ED" style="OLC">
							<paragraph commented="no" display-inline="no-display-inline" id="H7ADE8878299745748A7D68EA41BF1BAC"><enum>(10)</enum><text display-inline="yes-display-inline">provides—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="H77E3D86E5AF84922979DBE6298E7F00D"><enum>(A)</enum><text display-inline="yes-display-inline">for the establishment or designation of a State authority or authorities that shall be responsible
			 for establishing and maintaining standards for foster family homes and
			 child care institutions which are reasonably in accord with recommended
			 standards of national organizations concerned with standards for the
			 institutions or homes, including standards related to admission policies,
			 safety, sanitation, and protection of civil rights, and which shall permit
			 use of the reasonable and prudent parenting standard;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H93E945F0F99F479FA2523FA5F8518DA0"><enum>(B)</enum><text display-inline="yes-display-inline">that the standards established pursuant to subparagraph (A) shall be applied by the State to any
			 foster family home or child care institution receiving funds under this
			 part or part B and shall require, as a condition of each contract entered
			 into by a child care institution to provide foster care, the presence
			 on-site of at least 1 official who, with respect to any child placed at
			 the child care institution, is designated to be the caregiver who is
			 authorized to apply the reasonable and prudent parent standard to
			 decisions involving the participation of the child in age or
			 developmentally-appropriate activities, and who is provided with training
			 in how to use and apply the reasonable and prudent parent standard in the
			 same manner as prospective foster parents are provided the training
			 pursuant to paragraph (24);</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H52A77FBB23784A0CBD137E465674ACD4"><enum>(C)</enum><text display-inline="yes-display-inline">that the standards established pursuant to subparagraph (A) shall include policies related to the
			 liability of foster parents and private entities under contract by the
			 State involving the application of the reasonable and prudent parent
			 standard, to ensure appropriate liability for caregivers when a child
			 participates in an approved activity and the caregiver approving the
			 activity acts in accordance with the reasonable and prudent parent
			 standard; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H42DE96393FB84DCFAA660B37E86D833A"><enum>(D)</enum><text display-inline="yes-display-inline">that a waiver of any standards established pursuant to subparagraph (A) may be made only on a
			 case-by-case basis for nonsafety standards (as determined by the State) in
			 relative foster family homes for specific children in care;</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="H736B6DC0B63A498C8D91DDD5C00CCF9F"><enum>(c)</enum><header>Supporting participation in age-Appropriate activities</header>
						<paragraph id="HC371232D08BA469FA80A06DF8BAED87A"><enum>(1)</enum><text>Section 477(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677(a)</external-xref>) is amended—</text>
							<subparagraph id="H9BC8C6E219794731A5FB436362DEFCEE"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of paragraph (6);</text>
							</subparagraph><subparagraph id="H773DFC99F226434989EB195E6D314DC2"><enum>(B)</enum><text>by striking the period at the end of paragraph (7) and inserting <quote>; and</quote>; and</text>
							</subparagraph><subparagraph id="HC6F70276224E4C4888E651EC38D1B242"><enum>(C)</enum><text>by adding at the end the following:</text>
								<quoted-block display-inline="no-display-inline" id="H43E5058F751C465B941919B122963A72" style="OLC">
									<paragraph id="HFBDBE5C4B6324AFD8CF95FB0CA0BD354"><enum>(8)</enum><text display-inline="yes-display-inline">to ensure children who are likely to remain in foster care until 18 years of age have regular,
			 ongoing opportunities to engage in age or developmentally-appropriate
			 activities as defined in section 475(11).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
							</subparagraph></paragraph><paragraph id="H6F5643F4811C4D5292157CF67ECDDF81"><enum>(2)</enum><text>Section 477(h)(1) (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677(h)(1)</external-xref>) is amended by inserting <quote>or, beginning in fiscal year 2020, $143,000,000</quote> after <quote>$140,000,000</quote>.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H5E0A4BFA9AE94A5E94DEE494CBEEDC5B"><enum>(d)</enum><header>Effective date</header>
						<paragraph id="H9B25D02F3B164EDAB145ADA4119D895A"><enum>(1)</enum><header>In general</header><text>The amendments made by this section shall take effect on the date that is 1 year after the date of
			 the enactment of this Act.</text>
						</paragraph><paragraph id="HA5455C9A115E444782FC35F49612BEA9"><enum>(2)</enum><header>Delay permitted if State legislation required</header><text display-inline="yes-display-inline">If the Secretary of Health and Human Services determines that State legislation (other than
			 legislation appropriating funds) is required in order for a State plan
			 developed pursuant to part E of title IV of the Social Security Act to
			 meet the additional requirements imposed by the amendments made by this
			 section, the plan shall not be regarded as failing to meet any of the
			 additional requirements before the 1st day of the 1st calendar quarter
			 beginning after the 1st regular session of the State legislature that
			 begins after the date of the enactment of this Act. If the State has a
			 2-year legislative session, each year of the session is deemed to be a
			 separate regular session of the State legislature.</text>
						</paragraph></subsection></section><section id="HB3B2CE523BEB4F32BDD63EE4CD39A368"><enum>112.</enum><header>Improving another planned permanent living arrangement as a permanency option</header>
					<subsection id="HBA333A7C184C48CC8C828EAB713AA562"><enum>(a)</enum><header>Elimination of another planned permanent living arrangement for children under age 16</header>
						<paragraph id="HB392A8AE1F0945B5A963E005CCB0CCD7"><enum>(1)</enum><header>In general</header><text>Section 475(5)(C)(i) (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675(5)(C)(i)</external-xref>) is amended by inserting <quote>only in the case of a child who has attained 16 years of age</quote> before <quote>(in cases where</quote>.</text>
						</paragraph><paragraph id="H21C2BD0AC6E7461EB15594303D35B80D"><enum>(2)</enum><header>Conforming amendment</header><text>Section 422(b)(8)(A)(iii)(II) (<external-xref legal-doc="usc" parsable-cite="usc/42/622">42 U.S.C. 622(b)(8)(A)(iii)(II)</external-xref>) is amended by inserting <quote>, subject to the requirements of sections 475(5)(C) and 475A(a)</quote> after <quote>arrangement</quote>.</text>
						</paragraph><paragraph id="H5108A07A96084F4396DEB90FF7F8693B"><enum>(3)</enum><header>Delayed applicability with respect to certain children</header><text display-inline="yes-display-inline">In the case of children in foster care under the responsibility of an Indian tribe, tribal
			 organization, or tribal consortium (either directly or under supervision
			 of a State), the amendments made by this subsection shall not apply until
			 the date that is 3 years after the date of the enactment of this Act.</text>
						</paragraph></subsection><subsection display-inline="no-display-inline" id="H3004D7EB8FDA4EC69840541408286FA0"><enum>(b)</enum><header>Additional requirements</header>
						<paragraph display-inline="no-display-inline" id="HA7126678E5C348519823BBE9A33B3E32"><enum>(1)</enum><header>In general</header><text>Part E of title IV (<external-xref legal-doc="usc" parsable-cite="usc/42/670">42 U.S.C. 670 et seq.</external-xref>) is amended by inserting after section 475 the following:</text>
							<quoted-block display-inline="no-display-inline" id="H4563BF971F45417B84FDD18EB5258845" style="OLC">
								<section id="HBD03675140A844FBB7531FAD17711DB7"><enum>475A.</enum><header>Additional case plan and case review system requirements</header>
									<subsection commented="no" display-inline="no-display-inline" id="H028A9374145E4077901EA7E4079D6791"><enum>(a)</enum><header>Requirements for another planned permanent living arrangement</header><text>In the case of any child for whom another planned permanent living arrangement is the permanency
			 plan determined for the child under section 475(5)(C), the following
			 requirements shall apply for purposes of approving the case plan for the
			 child and the case system review procedure for the child:</text>
										<paragraph id="H6086B92215B5491CA3B44F3267FC2B0B"><enum>(1)</enum><header>Documentation of intensive, ongoing, unsuccessful efforts for family placement</header><text>At each permanency hearing held with respect to the child, the State agency documents the
			 intensive, ongoing, and, as of the date of the hearing, unsuccessful
			 efforts made by the State agency to return the child home or secure a
			 placement for the child with a fit and willing relative (including adult
			 siblings), a legal guardian, or an adoptive parent, including through
			 efforts that utilize search technology (including social media) to find
			 biological family members for the children.</text>
										</paragraph><paragraph id="H5D71E92F346C4A3E98929B7635C54407"><enum>(2)</enum><header>Redetermination of appropriateness of placement at each permanency hearing</header><text>The State agency shall implement procedures to ensure that, at each permanency hearing held with
			 respect to the child, the court or administrative body appointed or
			 approved by the court conducting the hearing on the permanency plan for
			 the child does the following:</text>
											<subparagraph id="H61F65C21EB384500A758D1ADAB760999"><enum>(A)</enum><text>Ask the child about the desired permanency outcome for the child.</text>
											</subparagraph><subparagraph id="HF95A988AA60043FD91EC46AAC1F50DC3"><enum>(B)</enum><text display-inline="yes-display-inline">Make a judicial determination explaining why, as of the date of the hearing, another planned
			 permanent living arrangement is the best permanency plan for the child and
			 provide compelling reasons why it continues to not be in the best
			 interests of the child to—</text>
												<clause id="H7F508C5BCE3A4200BDF85D74B67D7CB1"><enum>(i)</enum><text>return home;</text>
												</clause><clause id="H5B409030D9AB4B7BA48F97752B4B14CE"><enum>(ii)</enum><text>be placed for adoption;</text>
												</clause><clause id="H9BE824DDFAF3432EBFDEC0FD76A3DA68"><enum>(iii)</enum><text>be placed with a legal guardian; or</text>
												</clause><clause id="H4D31B8F451294EF2A576B120149C53B6"><enum>(iv)</enum><text>be placed with a fit and willing relative.</text>
												</clause></subparagraph></paragraph><paragraph id="H7F3E97F75CB34589B2D68F7655C02E34"><enum>(3)</enum><header>Demonstration of support for engaging in age or developmentally-appropriate activities and social
			 events</header><text display-inline="yes-display-inline">At each permanency hearing held with respect to the child, the State agency shall document the
			 steps the State agency is taking to ensure that—</text>
											<subparagraph id="H0E623F9900344561AF17DBE75D172685"><enum>(A)</enum><text>the child's foster family home or child care institution is following the reasonable and prudent
			 parent standard; and</text>
											</subparagraph><subparagraph id="H2A4B2BF488AC4CC78ACF132EEF740776"><enum>(B)</enum><text>the child has regular, ongoing opportunities to engage in age or developmentally appropriate
			 activities (including by consulting with the child in an age-appropriate
			 manner about the opportunities of the child to participate in the
			 activities).</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph><paragraph id="HF0CB4C2B6378462A8059250742B06AD4"><enum>(2)</enum><header>Conforming amendments</header>
							<subparagraph id="HC6A96DC2A5E643FB9762B3C1246FF710"><enum>(A)</enum><header>State plan requirements</header>
								<clause id="H7A93CF9FA27343FB8A0635CD22F015D4"><enum>(i)</enum><header>Part B</header><text>Section 422(b)(8)(A)(ii) (<external-xref legal-doc="usc" parsable-cite="usc/42/622">42 U.S.C. 622(b)(8)(A)(ii)</external-xref>) is amended by inserting <quote>and in accordance with the requirements of section 475A</quote> after <quote>section 475(5)</quote>.</text>
								</clause><clause id="HC24A7170B2214B93BAB894879520B7B4"><enum>(ii)</enum><header>Part E</header><text>Section 471(a)(16) (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)(16)</external-xref>) is amended—</text>
									<subclause id="HA68FC2A3E0BF470DADDA48BBE765D569"><enum>(I)</enum><text>by inserting <quote>and in accordance with the requirements of section 475A</quote> after <quote>section 475(1)</quote>; and</text>
									</subclause><subclause id="HE70D2659C9C44CDFA5172C57550D7F00"><enum>(II)</enum><text>by striking <quote>section 475(5)(B)</quote> and inserting <quote>sections 475(5) and 475A</quote>.</text>
									</subclause></clause></subparagraph><subparagraph id="H61E3A67DEA0F4E6796E92B0ACD87EFA3"><enum>(B)</enum><header>Definitions</header><text>Section 475 (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675</external-xref>) is amended—</text>
								<clause id="H7AAFBA9FE1684FF2B9CCAFBA33C75AA4"><enum>(i)</enum><text>in paragraph (1), in the matter preceding subparagraph (A), by inserting <quote>meets the requirements of section 475A and</quote> after <quote>written document which</quote>; and</text>
								</clause><clause id="H3BA4720E12C049BFBEE7AEC73779CFF3"><enum>(ii)</enum><text>in paragraph (5)—</text>
									<subclause id="H85F3FA222EE6452C82A886A099535917"><enum>(I)</enum><text>in subparagraph (B), by adding at the end the following <quote>and, for a child for whom another planned permanent living arrangement has been determined as the
			 permanency plan, the steps the State agency is taking to ensure the
			 child’s foster family home or child care institution is following the
			 reasonable and prudent parent standard and to ascertain whether the child
			 has regular, ongoing opportunities to engage in age or developmentally
			 appropriate activities (including by consulting with the child in an
			 age-appropriate manner about the opportunities of the child to participate
			 in the activities);</quote>; and</text>
									</subclause><subclause id="H881BF9090BE74F79B9E4D7D188933FC4"><enum>(II)</enum><text>in subparagraph (C)—</text>
										<item id="H5C30A0A285ED4EDAA6EA55078263A3BA"><enum>(aa)</enum><text>by inserting <quote>, as of the date of the hearing,</quote> after <quote>compelling reason for determining</quote>; and</text>
										</item><item id="HA7499FE21E1847FE818C6A8CB41E69B3"><enum>(bb)</enum><text>by inserting <quote>subject to section 475A(a),</quote> after <quote>another planned permanent living arrangement,</quote>.</text>
										</item></subclause></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD0ED658C3DEA47BE954FAEB3CEEA8701"><enum>(c)</enum><header>Effective date</header>
						<paragraph id="HB6BEF07D1A884409B968A0CCF45FB41F"><enum>(1)</enum><header>In general</header><text>The amendments made by this section shall take effect on the date that is 1 year after the date of
			 the enactment of this Act.</text>
						</paragraph><paragraph id="H894B4FFCD46C4EA1B8F49B674E90C971"><enum>(2)</enum><header>Delay permitted if State legislation required</header><text display-inline="yes-display-inline">If the Secretary of Health and Human Services determines that State legislation (other than

						</paragraph></subsection></section><section id="HE1278693E8024F78B572E7DB6590A90A"><enum>113.</enum><header>Empowering foster children age 14 and older in the development of their own case plan and
			 transition planning for a successful adulthood</header>
					<subsection id="H51BF90128DEF4D51A8E1472330FA7E36"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 475(1)(B) (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675(1)(B)</external-xref>) is amended by adding at the end the following: <quote>With respect to a child who has attained 14 years of age, the plan developed for the child in
			 accordance with this paragraph, and any revision or addition to the plan,
			 shall be developed in consultation with the child and, at the option of
			 the child, with up to 2 members of the case planning team who are chosen
			 by the child and who are not a foster parent of, or caseworker for, the
			 child. A State may reject an individual selected by a child to be a member
			 of the case planning team at any time if the State has good cause to
			 believe that the individual would not act in the best interests of the
			 child. One individual selected by a child to be a member of the child's
			 case planning team may be designated to be the child's advisor and, as
			 necessary, advocate, with respect to the application of the reasonable and
			 prudent parent standard to the child.</quote>.</text>
					</subsection><subsection id="H75C7E67F35B045E7A59A3DB9BAF3E5C5"><enum>(b)</enum><header>Conforming amendments To include children 14 and older in transition planning</header><text display-inline="yes-display-inline">Section 475 (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675</external-xref>) is amended—</text>
						<paragraph id="HB716D7C8E6D945569C4BDCC5EDF4FE8D"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)(D), by striking <quote>Where appropriate, for a child age 16</quote> and inserting <quote>For a child who has attained 14 years of age</quote>; and</text>
						</paragraph><paragraph id="H49E1058A4A2D4B1C9BCBE7972AA9DB18"><enum>(2)</enum><text>in paragraph (5)—</text>
							<subparagraph id="HED3E9521E4BF453A9D620BA48AA39F9C"><enum>(A)</enum><text>in subparagraph (C)—</text>
								<clause id="HCCB6E60DCA3544CD8A9E33C661C595C9"><enum>(i)</enum><text>in clause (i), by striking <quote>16</quote> and inserting <quote>14</quote>;</text>
								</clause><clause id="H717B72B768EA46709FB3FD19BAACAED4"><enum>(ii)</enum><text>by striking <quote>and</quote> at the end of clause (ii); and</text>
								</clause><clause id="H928622669E404DF3BB1526A691D935C6"><enum>(iii)</enum><text>by adding at the end the following: <quote>and (iv) if a child has attained 14 years of age, the permanency plan developed for the child, and
			 any revision or addition to the plan, shall be developed in consultation
			 with the child and, at the option of the child, with not more than 2
			 members of the permanency planning team who are selected by the child and
			 who are not a foster parent of, or caseworker for, the child, except that
			 the State may reject an individual so selected by the child if the State
			 has good cause to believe that the individual would not act in the best
			 interests of the child, and 1 individual so selected by the child may be
			 designated to be the child’s advisor and, as necessary, advocate, with
			 respect to the application of the reasonable and prudent standard to the
			 child;</quote>; and</text>
								</clause></subparagraph><subparagraph id="H5DEBEAC8BD0A4E59A245E1618DA57829"><enum>(B)</enum><text>in subparagraph (I), by striking <quote>16</quote> and inserting <quote>14</quote>.</text>
							</subparagraph></paragraph></subsection><subsection id="H31239ACCCA494656889E0893E9AD28AC"><enum>(c)</enum><header>Transition planning for a successful adulthood</header><text>Paragraphs (1)(D), (5)(C)(i), and (5)(C)(iii) of section 475 (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675</external-xref>) are each amended by striking <quote>independent living</quote> and inserting <quote>a successful adulthood</quote>.</text>
					</subsection><subsection id="HA9DAB9A14C654BB597B697630B174BCB"><enum>(d)</enum><header>List of rights</header><text>Section 475A, as added by section 112(b)(1) of this Act, is amended by adding at the end the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="H2701D3A200A240AFB374A19B44CC59CE" style="OLC">
							<subsection id="H381378E17FA14397AB656A48E1C586DB"><enum>(b)</enum><header>List of rights</header><text display-inline="yes-display-inline">The case plan for any child in foster care under the responsibility of the State who has attained
			 14 years of age shall include—</text>
								<paragraph id="HD9A3548076F449A1868C71D4D08B5968"><enum>(1)</enum><text>a document that describes the rights of the child with respect to education, health, visitation,
			 and court participation, the right to be provided with the documents
			 specified in section 475(5)(I) in accordance with that section, and the
			 right to stay safe and avoid exploitation; and</text>
								</paragraph><paragraph id="HBD44636C232041BA8144E5BF91E72FDF"><enum>(2)</enum><text>a signed acknowledgment by the child that the child has been provided with a copy of the document
			 and that the rights contained in the document have been explained to the
			 child in an age-appropriate way.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="HDAD1B1AE4E314EF099E302C06ED5EBC2"><enum>(e)</enum><header>Report</header><text>Not later than 2 years after the date of the enactment of this Act, the Secretary of Health and
			 Human Services shall submit a report to Congress regarding the
			 implementation of the amendments made by this section. The report shall
			 include—</text>
						<paragraph id="H402F2F2F28D84B5898D773AA32E9645D"><enum>(1)</enum><text>an analysis of how States are administering the requirements of paragraphs (1)(B) and (5)(C) of
			 section 475 of the Social Security Act, as amended by subsections (a) and
			 (b) of this section, that a child in foster care who has attained 14 years
			 of age be permitted to select up to 2 members of the case planning team or
			 permanency planning team for the child from individuals who are not a
			 foster parent of, or caseworker for, the child; and</text>
						</paragraph><paragraph id="H89818DBA6E844D48BFB18F9197536D11"><enum>(2)</enum><text>a description of best practices of States with respect to the administration of the requirements.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H0558F668BECF4156889F72AF1C7ED7C2"><enum>(f)</enum><header>Effective date</header>
						<paragraph id="H1D804F2AB537453698223F45EC642C52"><enum>(1)</enum><header>In general</header><text>The amendments made by this section shall take effect on the date that is 1 year after the date of
			 the enactment of this Act.</text>
						</paragraph><paragraph id="H37B23250EF4B4A0CA8515B8A4AEEBA78"><enum>(2)</enum><header>Delay permitted if State legislation required</header><text display-inline="yes-display-inline">If the Secretary of Health and Human Services determines that State legislation (other than
			 legislation appropriating funds) is required in order for a State plan
			 developed pursuant to part E of title IV of the Social Security Act to
			 meet the additional requirements imposed by the amendments made by this
			 section, the plan shall not be regarded as failing to meet any of the
			 additional requirements before the 1st day of the 1st calendar quarter
			 beginning after the 1st regular session of the State legislature that
			 begins after the date of the enactment of this Act. If the State has a
			 2-year legislative session, each year of the session is deemed to be a
			 separate regular session of the State legislature.</text>
						</paragraph></subsection></section><section id="H399A04D87B7748FDB899EA76A462D20A"><enum>114.</enum><header>Ensuring foster children have a birth certificate, Social Security card, health insurance
			 information, medical records, and a driver’s license or equivalent
			 State-issued identification card</header>
					<subsection id="H3E53A58CB9DF4C2EBA82EE02EA1A72A9"><enum>(a)</enum><header>Case review system requirement</header><text display-inline="yes-display-inline">Section 475(5)(I) (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675(5)(I)</external-xref>) is amended—</text>
						<paragraph id="H63BC724F69AB4D3786FAA0A5D48DEF41"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>and receives assistance</quote> and inserting <quote>receives assistance</quote>; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3B9B1CB8A1CB450AAF9A46520CDE8D89"><enum>(2)</enum><text>by inserting <quote>, and, if the child is leaving foster care by reason of having attained 18 years of age or such
			 greater age as the State has elected under paragraph (8), unless the child
			 has been in foster care for less than 6 months, is not discharged from
			 care without being provided with (if the child is eligible to receive such
			 document) an official or certified copy of the United States birth
			 certificate of the child, a social security card issued by the
			 Commissioner of Social Security, health insurance information, a copy of
			 the child’s medical records, and a driver's license or identification card
			 issued by a State in accordance with the requirements of section 202 of
			 the REAL ID Act of 2005</quote> before the period.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H14553DF0394641E2887B8430BF348897"><enum>(b)</enum><header>Effective date</header>
						<paragraph id="H613D8263999D4DCF9F11F8376F561661"><enum>(1)</enum><header>In general</header><text>The amendments made by this section shall take effect 1 year after the date of enactment of this
			 Act.</text>
						</paragraph><paragraph id="H5D671DCDB9FE4E0A8F734D40D61220EB"><enum>(2)</enum><header>Delay permitted if State legislation required</header><text display-inline="yes-display-inline">If the Secretary of Health and Human Services determines that State legislation (other than
			 legislation appropriating funds) is required in order for a State plan
			 developed pursuant to part E of title IV of the Social Security Act to

						</paragraph></subsection></section><section display-inline="no-display-inline" id="H370C6E6FD041426593016DA10742895D" section-type="subsequent-section"><enum>115.</enum><header>Information on children in foster care in annual reports using AFCARS data; consultation</header><text display-inline="no-display-inline">Section 479A (<external-xref legal-doc="usc" parsable-cite="usc/42/679b">42 U.S.C. 679b</external-xref>) is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="H7800C7C1F662465A9CAED5DB4E95A833"><enum>(1)</enum><text>by striking <quote>The Secretary</quote> and inserting the following:</text>

			 fiscal year, State-by-State data on—</text>
								<subparagraph id="H223D314D34B1483CB984AE4E893520A9"><enum>(A)</enum><text display-inline="yes-display-inline">children in foster care who have been placed in a child care institution or other setting that is
			 not a foster family home, including—</text>
									<clause id="H85A918644EE2491AA9506D2E7A715167"><enum>(i)</enum><text>the number of children in the placements and their ages, including separately, the number and ages
			 of children who have a permanency plan of another planned permanent living
			 arrangement;</text>
									</clause><clause id="H5842CA9EBFC04DDB8A820D128A7DAE6A"><enum>(ii)</enum><text>the duration of the placement in the settings (including for children who have a permanency plan of
			 another planned permanent living arrangement);</text>
									</clause><clause id="H80AE345CA4E542C1868E9C29999322DD"><enum>(iii)</enum><text>the types of child care institutions used (including group homes, residential treatment, shelters,
			 or other congregate care settings);</text>
									</clause><clause id="H53C46C63B7364E8982C3D96BC65394A7"><enum>(iv)</enum><text>with respect to each child care institution or other setting that is not a foster family home, the
			 number of children in foster care residing in each such institution or
			 non-foster family home;</text>
									</clause><clause id="HEE01DA9820FE4DCFA99051811CD8BFF6"><enum>(v)</enum><text>any clinically diagnosed special need of such children; and</text>
									</clause><clause id="H5BEB45DE8F294576B13D7E0508248630"><enum>(vi)</enum><text display-inline="yes-display-inline">the extent of any specialized education, treatment, counseling, or other services provided in the
			 settings; and</text>
									</clause></subparagraph><subparagraph id="HC93C74182D1D44CB8F77E620722932CE"><enum>(B)</enum><text>children in foster care who are pregnant or parenting.</text>
								</subparagraph></paragraph><subsection commented="no" display-inline="no-display-inline" id="H4C04A131EA9B4201BA645E954F437BC6"><enum>(b)</enum><header>Consultation on other issues</header><text>The Secretary shall consult with States and organizations with an interest in child welfare,
			 including organizations that provide adoption and foster care services,
			 and shall take into account requests from Members of Congress, in
			 selecting other issues to be analyzed and reported on under this section
			 using data available to the Secretary, including data reported by States
			 through the Adoption and Foster Care Analysis and Reporting System and to
			 the National Youth in Transition Database.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section></subtitle><subtitle id="HFF4EDB63932E4AD098BF51D9B4D82F26"><enum>C</enum><header>National advisory committee</header>
				<section id="H38E45C0F2F434BC3B009FF505655AE24"><enum>121.</enum><header>Establishment of a national advisory committee on the sex trafficking of children and youth in the
			 United States</header><text display-inline="no-display-inline">Title XI (<external-xref legal-doc="usc" parsable-cite="usc/42/1301">42 U.S.C. 1301 et seq.</external-xref>) is amended by inserting after section 1114 the following:</text>
					<quoted-block display-inline="no-display-inline" id="HF4C595E8B47743F98B9325FB6D0E79D3" style="traditional">
						<section id="HE378D6D8A374455CA71AD62531E97413"><enum>1114A.</enum><header>NATIONAL ADVISORY COMMITTEE ON THE SEX TRAFFICKING OF CHIILDREN AND YOUTH IN THE UNITED STATES</header><subsection commented="no" display-inline="yes-display-inline" id="H45403F7C77E44954920F0502095E0FD7"><enum>(a)</enum><header>Official designation</header><text display-inline="yes-display-inline">This section relates to the National Advisory Committee on the Sex Trafficking of Children and
			 Youth in the United States (in this section referred to as the <quote>Committee</quote>).</text>
							</subsection><subsection id="H1E2D6A6074514693BBE0901FBF8D65A9"><enum>(b)</enum><header>Authority</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this section, the Secretary shall establish
			 and appoint all members of the Committee.</text>
							</subsection><subsection id="HA3EA0ABA0C7949CEAAACC69B3B52AC54"><enum>(c)</enum><header>Membership</header>
								<paragraph id="HA2A62D8844A64919BB50990FAC16D817"><enum>(1)</enum><header>Composition</header><text>The Committee shall be composed of not more than 21 members whose diverse experience and background
			 enable them to provide balanced points of view with regard to carrying out
			 the duties of the Committee.</text>
								</paragraph><paragraph id="H3FE8AAD8434B405FB559BFB7B7C9568F"><enum>(2)</enum><header>Selection</header><text>The Secretary, in consultation with the Attorney General and National Governors Association, shall
			 appoint the members to the Committee. At least 1 Committee member shall be
			 a former sex trafficking victim. 2 Committee members shall be a Governor
			 of a State, 1 of whom shall be a member of the Democratic Party and 1 of
			 whom shall be a member of the Republican Party.</text>
								</paragraph><paragraph id="H4C9B0C3E2BB34F6AA286D5E2F6FC8169"><enum>(3)</enum><header>Period of appointment; vacancies</header><text>Members shall be appointed for the life of the Committee. A vacancy in the Committee shall be
			 filled in the manner in which the original appointment was made and shall
			 not affect the powers or duties of the Committee.</text>
								</paragraph><paragraph id="HAAEAAAB59FC74661943AC3C102C69946"><enum>(4)</enum><header>Compensation</header><text>Committee members shall serve without compensation or per diem in lieu of subsistence.</text>
								</paragraph></subsection><subsection id="HA9DDB9CB55364A0DB816BD29983022C6"><enum>(d)</enum><header>Duties</header>
								<paragraph id="H2CED916ADBD643448A4B9B2543354337"><enum>(1)</enum><header>National response</header><text>The Committee shall advise the Secretary and the Attorney General on practical and general policies
			 concerning improvements to the Nation's response to the sex trafficking of
			 children and youth in the United States.</text>
								</paragraph><paragraph id="H752274F125D446949ABC58E12E1F3AC4"><enum>(2)</enum><header>Policies for cooperation</header><text>The Committee shall advise the Secretary and the Attorney General on practical and general policies
			 concerning the cooperation of Federal, State, local, and tribal
			 governments, child welfare agencies, social service providers, physical
			 health and mental health providers, victim service providers, State or
			 local courts with responsibility for conducting or supervising proceedings
			 relating to child welfare or social services for children and their
			 families, Federal, State, and local police, juvenile detention centers,
			 and runaway and homeless youth programs, schools, the gaming and
			 entertainment industry, and businesses and organizations that provide
			 services to youth, on responding to sex trafficking, including the
			 development and implementation of—</text>
									<subparagraph id="H9A71D46100234665B85900608825E0AE"><enum>(A)</enum><text>successful interventions with children and youth who are exposed to conditions that make them
			 vulnerable to, or victims of, sex trafficking; and</text>
									</subparagraph><subparagraph id="H3DC5C3C2E5D344C2AD8BE358213BD113"><enum>(B)</enum><text>recommendations for administrative or legislative changes necessary to use programs, properties, or
			 other resources owned, operated, or funded by the Federal Government to
			 provide safe housing for children and youth who are sex trafficking
			 victims and provide support to entities that provide housing or other
			 assistance to the victims.</text>
									</subparagraph></paragraph><paragraph id="HD13FB66BA74B4CF48A82DB4696C5180F"><enum>(3)</enum><header>Best practices and recommendations for states</header>
									<subparagraph id="H604D932297B0488D9F70CC550D653067"><enum>(A)</enum><header>In general</header><text>Within 2 years after the establishment of the Committee, the Committee shall develop 2 tiers
			 (referred to in this subparagraph as <quote>Tier I</quote> and <quote>Tier II</quote>) of recommended best practices for States to follow in combating the sex trafficking of children
			 and youth. Tier I shall provide States that have not yet substantively
			 addressed the sex trafficking of children and youth with an idea of where
			 to begin and what steps to take. Tier II shall provide States that are
			 already working to address the sex trafficking of children and youth with
			 examples of policies that are already being used effectively by other
			 States to address sex trafficking.</text>
									</subparagraph><subparagraph id="H463B5B26530643DCA87A96D910B40E4B"><enum>(B)</enum><header>Development</header><text display-inline="yes-display-inline">The best practices shall be based on multidisciplinary research and promising, evidence-based
			 models and programs as reflected in State efforts to meet the requirements
			 of sections 101 and 102 of the Preventing Sex Trafficking and
			 Strengthening Families Act.</text>
									</subparagraph><subparagraph id="HB469DDD523D3400F9C969FFA7DF7BA26"><enum>(C)</enum><header>Content</header><text>The best practices shall be user-friendly, incorporate the most up-to-date technology, and include
			 the following:</text>
										<clause id="H542107E816604F17BF31BEBF990CB895"><enum>(i)</enum><text>Sample training materials, protocols, and screening tools that, to the extent possible, accommodate
			 for regional differences among the States, to prepare individuals who
			 administer social services to identify and serve children and youth who
			 are sex trafficking victims or at-risk of sex trafficking.</text>
										</clause><clause id="HD34D03973AFB41D39B28B2BEF64EF992"><enum>(ii)</enum><text>Multidisciplinary strategies to identify victims, manage cases, and improve services for all
			 children and youth who are at risk of sex trafficking, or are sex
			 trafficking victims, in the United States.</text>
										</clause><clause id="HEEED28AE0CD341F88249D4573AE8991E"><enum>(iii)</enum><text>Sample protocols and recommendations based on current States’ efforts, accounting for regional
			 differences between States that provide for effective, cross-system
			 collaboration between Federal, State, local, and tribal governments, child
			 welfare agencies, social service providers, physical health and mental
			 health providers, victim service providers, State or local courts with
			 responsibility for conducting or supervising proceedings relating to child
			 welfare or social services for children and their families, the gaming and
			 entertainment industry, Federal, State, and local police, juvenile
			 detention centers and runaway and homeless youth programs, housing
			 resources that are appropriate for housing child and youth victims of
			 trafficking, schools, and businesses and organizations that provide
			 services to children and youth. These protocols and recommendations should
			 include strategies to identify victims and collect, document, and share
			 data across systems and agencies, and should be designed to help agencies
			 better understand the type of sex trafficking involved, the scope of the
			 problem, the needs of the population to be served, ways to address the
			 demand for trafficked children and youth and increase prosecutions of
			 traffickers and purchasers of children and youth, and the degree of victim
			 interaction with multiple systems.</text>
										</clause><clause id="HE3441961435D481DAF01398C3511A384"><enum>(iv)</enum><text>Developing the criteria and guidelines necessary for establishing safe residential placements for
			 foster children who have been sex trafficked as well as victims of
			 trafficking identified through interaction with law enforcement.</text>
										</clause><clause id="HF2B3375DCB324AC986F5C5C4ABD6AEE0"><enum>(v)</enum><text>Developing training guidelines for caregivers that serve children and youth being cared for outside
			 the home.</text>
										</clause></subparagraph><subparagraph id="HB938C3B6DA804FA89FCA45D8E78651BC"><enum>(D)</enum><header>Informing states of best practices</header><text>The Committee, in coordination with the National Governors Association, Secretary and Attorney
			 General, shall ensure that State Governors and child welfare agencies are
			 notified and informed on a quarterly basis of the best practices and
			 recommendations for States, and notified 6 months in advance that the
			 Committee will be evaluating the extent to which States adopt the
			 Committee’s recommendations.</text>
									</subparagraph><subparagraph id="HBDDAFBD1183C43FB834E4ED1A4F187D1"><enum>(E)</enum><header>Report on State implementation</header><text>Within 3 years after the establishment of the Committee, the Committee shall submit to the
			 Secretary and the Attorney General, as part of its final report as well as
			 for online and publicly available publication, a description of what each
			 State has done to implement the recommendations of the Committee.</text>
									</subparagraph></paragraph></subsection><subsection id="HEB407D0C343349EBA6DB35067A21E955"><enum>(e)</enum><header>Reports</header>
								<paragraph id="H77B8B3DF3D824702A32A660B36A7D5D9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Committee shall submit an interim and a final report on the work of the Committee to—</text>
									<subparagraph id="H02CA0797144F40F3A7879B9BBF562A34"><enum>(A)</enum><text>the Secretary;</text>
									</subparagraph><subparagraph id="HAF30801A5CF14834ACBDFFE465570C76"><enum>(B)</enum><text>the Attorney General;</text>
									</subparagraph><subparagraph id="H5078C740F4E248A8BCC6C0C006712CDC"><enum>(C)</enum><text>the Committee on Finance of the Senate; and</text>
									</subparagraph><subparagraph id="HFCC151F34DEE4BBF8CD566D3D919277B"><enum>(D)</enum><text>the Committee on Ways and Means of the House of Representatives.</text>
									</subparagraph></paragraph><paragraph id="H0580E5FA9C344F239BD89C5CDA57CAFA"><enum>(2)</enum><header>Reporting dates</header><text>The interim report shall be submitted not later than 3 years after the establishment of the
			 Committee. The final report shall be submitted not later than 4 years
			 after the establishment of the Committee.</text>
								</paragraph></subsection><subsection id="H4BD927A2233F4177A48C795B33E0A109"><enum>(f)</enum><header>Administration</header>
								<paragraph id="H4F5A24D79EFD4F679FAE56C7BC2E9CAD"><enum>(1)</enum><header>Agency support</header><text>The Secretary shall direct the head of the Administration for Children and Families of the
			 Department of Health and Human Services to provide all necessary support
			 for the Committee.</text>
								</paragraph><paragraph id="H96EDC381815641D69A4F3BEF0A78592E"><enum>(2)</enum><header>Meetings</header>
									<subparagraph id="H5AA70A61BB8C4823A75AA6D793AF3416"><enum>(A)</enum><header>In general</header><text>The Committee will meet at the call of the Secretary at least twice each year to carry out this
			 section, and more often as otherwise required.</text>
									</subparagraph><subparagraph id="H9F7F0985D694452895F90AB942EE121B"><enum>(B)</enum><header>Accommodation for committee members unable to attend in person</header><text>The Secretary shall create a process through which Committee members who are unable to travel to a
			 Committee meeting in person may participate remotely through the use of
			 video conference, teleconference, online, or other means.</text>
									</subparagraph></paragraph><paragraph id="H27BB594396584EDD8EB4B24FE0C4D827"><enum>(3)</enum><header>Subcommittees</header><text>The Committee may establish subcommittees or working groups, as necessary and consistent with the
			 mission of the Committee. The subcommittees or working groups shall have
			 no authority to make decisions on behalf of the Committee, nor shall they
			 report directly to any official or entity listed in subsection (d).</text>
								</paragraph><paragraph id="HCD9EFAEC9E35471281BA8BC8ECBC8F27"><enum>(4)</enum><header>Recordkeeping</header><text>The records of the Committee and any subcommittees and working groups shall be maintained in
			 accordance with appropriate Department of Health and Human Services
			 policies and procedures and shall be available for public inspection and
			 copying, subject to the Freedom of Information Act (<external-xref legal-doc="usc" parsable-cite="usc/5/552">5 U.S.C. 552</external-xref>).</text>
								</paragraph></subsection><subsection id="H78C1857636C847648A70BD791A93CB5B"><enum>(g)</enum><header>Termination</header><text>The Committee shall terminate 5 years after the date of its establishment, but the Secretary shall
			 continue to operate and update, as necessary, an Internet website
			 displaying the State best practices, recommendations, and evaluation of

			 incentive payments payable under paragraph (1) of this subsection are less
			 than the amount appropriated under subsection (h) for the fiscal year,
			 then, from the remainder of the amount appropriated for the fiscal year
			 that is not required for such payments (in this paragraph referred to as
			 the <term>timely adoption award pool</term>), the Secretary shall increase the adoption incentive payment determined under paragraph (1) for
			 each State that the Secretary determines is a timely adoption award State
			 for the fiscal year by the award amount determined for the fiscal year
			 under subparagraph (C).</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H98B62305E8724D10A0E566EF5523F882"><enum>(B)</enum><header>Timely adoption award State defined</header><text>A State is a timely adoption award State for a fiscal year if the Secretary determines that, for
			 children who were in foster care under the supervision of the State at the
			 time of adoptive placement, the average number of months from removal of
			 children from their home to the placement of children in finalized
			 adoptions is less than 24 months.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5783BC8156774F0299280E3BC22BA059"><enum>(C)</enum><header>Award amount</header><text>For purposes of subparagraph (A), the award amount determined under this subparagraph with respect
			 to a fiscal year is the amount equal to the timely adoption award pool for
			 the fiscal year divided by the number of timely adoption award States for
			 the fiscal year.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

								</subparagraph></paragraph><paragraph id="H93F0BE3D3D534C22AD72AD67DDE1839D"><enum>(2)</enum><header>Base rate of foster child adoptions</header><text display-inline="yes-display-inline">The term <term>base rate of foster child adoptions</term> means, with respect to a State and a fiscal year, the lesser of—</text>
								<subparagraph id="H95531D9214874A2FAB26CB1D4C651ADC"><enum>(A)</enum><text>the foster child adoption rate for the State for the then immediately preceding fiscal year; or</text>

			 fiscal years.</text>
								</subparagraph></paragraph><paragraph id="HBD4CE7ED52AB4BEC9895ACCD75B20236"><enum>(3)</enum><header>Foster child adoption</header><text display-inline="yes-display-inline">The term <term>foster child adoption</term> means the final adoption of a child who, at the time of adoptive placement, was in foster care
			 under the supervision of the State.</text>
							</paragraph><paragraph id="H856255AE97464AAFB5DFC3FCBEEF5E8C"><enum>(4)</enum><header>Pre-adolescent child adoption and pre-adolescent foster child guardianship rate</header><text display-inline="yes-display-inline">The term <term>pre-adolescent child adoption and pre-adolescent foster child guardianship rate</term> means, with respect to a State and a fiscal year, the percentage determined by dividing—</text>

			 finalized in the State during the fiscal year; by</text>

								</subparagraph></paragraph><paragraph id="HB3288F7656B0412798069C4EED052379"><enum>(5)</enum><header>Base rate of pre-adolescent child adoptions and pre-adolescent foster child guardianships</header><text>The term <term>base rate of pre-adolescent child adoptions and pre-adolescent foster child guardianships</term> means, with respect to a State and a fiscal year, the lesser of—</text>
								<subparagraph id="H44506FE037734A1DAF5568DEBA5856EE"><enum>(A)</enum><text>the pre-adolescent child adoption and pre-adolescent foster child guardianship rate for the State
			 for the then immediately preceding fiscal year; or</text>

								</subparagraph></paragraph><paragraph id="H13C766AA45544B81928F198CE463E0EB"><enum>(6)</enum><header>Pre-adolescent child adoption and pre-adolescent foster child guardianship</header><text>The term <term>pre-adolescent child adoption and pre-adolescent foster child guardianship</term> means the final adoption, or the placement into foster child guardianship (as defined in paragraph
			 (12)) of a child who has attained 9 years of age but not 14 years of age
			 if—</text>
								<subparagraph id="H2BA075398ECD406EA80150C1E70956BC"><enum>(A)</enum><text>at the time of the adoptive or foster child guardianship placement, the child was in foster care
			 under the supervision of the State; or</text>

								</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H1BC855C3CDDC4A7085836495CF353025"><enum>(7)</enum><header>Older child adoption and older foster child guardianship rate</header><text display-inline="yes-display-inline">The term <term>older child adoption and older foster child guardianship rate</term> means, with respect to a State and a fiscal year, the percentage determined by dividing—</text>

			 (12)) of a child who has attained 14 years of age if—</text>
								<subparagraph id="HFB7A95A0F3614B49A3005B49B37CCCD2"><enum>(A)</enum><text>at the time of the adoptive or foster child guardianship placement, the child was in foster care
			 under the supervision of the State; or</text>
								</subparagraph><subparagraph id="H158E82D6C89E482F9D54DD00CA602AFF"><enum>(B)</enum><text>an adoption assistance agreement was in effect under section 473(a) with respect to the child.</text>
								</subparagraph></paragraph><paragraph id="H4652F846AB074AA0B67AFE6D165601DF"><enum>(10)</enum><header>Foster child guardianship rate</header><text>The term <term>foster child guardianship rate</term> means, with respect to a State and a fiscal year, the percentage determined by dividing—</text>
								<subparagraph id="H6E1D35C07EC2428BACEF1991EF2BF6D1"><enum>(A)</enum><text>the number of foster child guardianships occurring in the State during the fiscal year; by</text>
								</subparagraph><subparagraph id="H2B39373D898E4CAC90CE956918633353"><enum>(B)</enum><text>the number of children in foster care under the supervision of the State on the last day of the
			 preceding fiscal year.</text>
								</subparagraph></paragraph><paragraph id="H535DD5E41E1B443C8991FF67B909BE3C"><enum>(11)</enum><header>Base rate of foster child guardianships</header><text>The term <term>base rate of foster child guardianships</term> means, with respect to a State and a fiscal year, the lesser of—</text>
								<subparagraph id="H81B910B0EB4E44DCAE95C4706F2C4D0B"><enum>(A)</enum><text>the foster child guardianship rate for the State for the then immediately preceding fiscal year; or</text>
								</subparagraph><subparagraph id="H01CFB1379FEA41489CB8CC13C6480D6C"><enum>(B)</enum><text>the foster child guardianship rate for the State for the average of the then immediately preceding
			 3 fiscal years.</text>
								</subparagraph></paragraph><paragraph id="HD947B81B5E134801BC9CF8A0B8B41B95"><enum>(12)</enum><header>Foster child guardianship</header><text display-inline="yes-display-inline">The term <term>foster child guardianship</term> means, with respect to a State, the exit of a child from foster care under the responsibility of
			 the State to live with a legal guardian, if the State has reported to the
			 Secretary—</text>
								<subparagraph id="H42D9987134A5495E812917AAC6A9F79F"><enum>(A)</enum><text display-inline="yes-display-inline">that the State agency has determined that—</text>
									<clause id="H385765670940462FB14A4AF8C9052237"><enum>(i)</enum><text>the child has been removed from his or her home pursuant to a voluntary placement agreement or as a
			 result of a judicial determination to the effect that continuation in the
			 home would be contrary to the welfare of the child;</text>
									</clause><clause id="H4989C4F609564D14A56EDFF82E94BD9F"><enum>(ii)</enum><text>being returned home or adopted are not appropriate permanency options for the child;</text>
									</clause><clause id="HAE67B01D8F6940DAA5BBAA74BABF52CB"><enum>(iii)</enum><text>the child demonstrates a strong attachment to the prospective legal guardian, and the prospective
			 legal guardian has a strong commitment to caring permanently for the
			 child; and</text>
									</clause><clause id="HA3A58A3B7AD24DF393A7CB7ED3508AC0"><enum>(iv)</enum><text>if the child has attained 14 years of age, the child has been consulted regarding the legal
			 guardianship arrangement; or</text>
									</clause></subparagraph><subparagraph id="H66904DAD485F4B3CA3187CD83A624117"><enum>(B)</enum><text>the alternative procedures used by the State to determine that legal guardianship is the
			 appropriate option for the child.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			 savings on certain services</header><text display-inline="no-display-inline">Section 473(a)(8) (<external-xref legal-doc="usc" parsable-cite="usc/42/673">42 U.S.C. 673(a)(8)</external-xref>) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HB122F6F0D2F44387B6FD7152916E7D13" style="OLC">
						<paragraph id="H0132ED9DC57C4B0EB93106BA7748867A" indent="up1"><enum>(8)</enum>
							<subparagraph commented="no" display-inline="yes-display-inline" id="H8A252BC81DC7425388E413C68A621266"><enum>(A)</enum><text display-inline="yes-display-inline">A State shall calculate the savings (if any) resulting from the application of paragraph (2)(A)(ii)
			 to all applicable children for a fiscal year, using a methodology
			 specified by the Secretary or an alternate methodology proposed by the
			 State and approved by the Secretary.</text>
							</subparagraph><subparagraph id="H709DAFF31A8E4FF29654E921ADAB4572" indent="up1"><enum>(B)</enum><text>A State shall annually report to the Secretary—</text>
								<clause id="H76B3CA2894FE45FD9B16B44C03272254"><enum>(i)</enum><text>the methodology used to make the calculation described in subparagraph (A), without regard to
			 whether any savings are found;</text>
								</clause><clause id="H1FC92EEFE5964269A61F63BB8E41F555"><enum>(ii)</enum><text>the amount of any savings referred to in subparagraph (A); and</text>
								</clause><clause id="HA7206E3956EB453ABDE633ED6AAC76BA"><enum>(iii)</enum><text display-inline="yes-display-inline">how any such savings are spent, accounting for and reporting the spending separately from any other
			 spending reported to the Secretary under part B or this part.</text>
								</clause></subparagraph><subparagraph id="H2BB44EBE51FD49238B43317D663D6DBE" indent="up1"><enum>(C)</enum><text>The Secretary shall make all information reported pursuant to subparagraph (B) available on the
			 website of the Department of Health and Human Services in a location
			 easily accessible to the public.</text>
							</subparagraph><subparagraph id="H20CC1895F77646E78D0D38BE9E5266D8" indent="up1"><enum>(D)</enum>
								<clause commented="no" display-inline="yes-display-inline" id="H44C5AC4E185A41429A626C93CFC94B03"><enum>(i)</enum><text display-inline="yes-display-inline">A State shall spend an amount equal to the amount of the savings (if any) in State expenditures
			 under this part resulting from the application of paragraph (2)(A)(ii) to
			 all applicable children for a fiscal year, to provide to children of
			 families any service that may be provided under part B or this part. A
			 State shall spend not less than 30 percent of any such savings on
			 post-adoption services, post-guardianship services, and services to
			 support and sustain positive permanent outcomes for children who otherwise
			 might enter into foster care under the responsibility of the State, with
			 at least <fraction>2/3</fraction> of the spending by the State to comply with such 30 percent requirement being spent on
			 post-adoption and post-guardianship services.</text>
								</clause><clause id="H0A28857F807F419883FCE4DE31DC9239" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">Any State spending required under clause (i) shall be used to supplement, and not supplant, any
			 Federal or non-Federal funds used to provide any service under part B or
			 this part.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="HD7D9844C42EA4394BD314056AB4E4A3B"><enum>207.</enum><header>Preservation of eligibility for kinship guardianship assistance payments with a successor guardian</header><text display-inline="no-display-inline">Section 473(d)(3) (<external-xref legal-doc="usc" parsable-cite="usc/42/673">42 U.S.C. 673(d)(3)</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HC12308ED7A354CA3AE95481D9A5BA810" style="OLC">
						<subparagraph id="HBB52F1D64F974C7DA1C0765076959ECC"><enum>(C)</enum><header>Eligibility not affected by replacement of guardian with a successor guardian</header><text display-inline="yes-display-inline">In the event of the death or incapacity of the relative guardian, the eligibility of a child for a
			 kinship guardianship assistance payment under this subsection shall not be
			 affected by reason of the replacement of the relative guardian with a
			 successor legal guardian named in the kinship guardianship assistance
			 agreement referred to in paragraph (1) (including in any amendment to the
			 agreement), notwithstanding subparagraph (A) of this paragraph and section
			 471(a)(28).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section commented="no" id="H9810725225214BE5B3AF955F8AE7045F"><enum>208.</enum><header>Data collection on adoption and legal guardianship disruption and dissolution</header><text display-inline="no-display-inline">Section 479 (<external-xref legal-doc="usc" parsable-cite="usc/42/679">42 U.S.C. 679</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H501B4929DA174D23BE670E3F81EF7C24" style="OLC">
						<subsection commented="no" id="HF97DDB7F61424356BB5F936213C591FE"><enum>(d)</enum><text>To promote improved knowledge on how best to ensure strong, permanent families for children, the
			 Secretary shall promulgate regulations providing for the collection and
			 analysis of information regarding children who enter into foster care
			 under the supervision of a State after prior finalization of an adoption
			 or legal guardianship. The regulations shall require each State with a
			 State plan approved under this part to collect and report as part of such
			 data collection system the number of children who enter foster care under
			 supervision of the State after finalization of an adoption or legal
			 guardianship and may include information concerning the length of the
			 prior adoption or guardianship, the age of the child at the time of the
			 prior adoption or guardianship, the age at which the child subsequently
			 entered foster care under supervision of the State, the type of agency
			 involved in making the prior adoptive or guardianship placement, and any
			 other factors determined necessary to better understand factors associated
			 with the child’s post-adoption or post-guardianship entry to foster care.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="H8A57FC5C7CF849B0812C980FFF61D7E6"><enum>209.</enum><header>Encouraging the placement of children in foster care with siblings</header>
					<subsection id="HA28C6177848649AEA5016BC44CA91686"><enum>(a)</enum><header>State plan amendment</header>
						<paragraph id="H19287B0BDD3A4814B2B551F0628FD9C0"><enum>(1)</enum><header>Notification of parents of siblings</header><text>Section 471(a)(29) (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)(29)</external-xref>) is amended by striking <quote>all adult grandparents</quote> and inserting <quote>the following relatives: all adult grandparents, all parents of a sibling of the child, where such
			 parent has legal custody of such sibling,</quote>.</text>
						</paragraph><paragraph id="H3340951090A044EAB8FC3C74CD93DE29"><enum>(2)</enum><header>Sibling defined</header><text>Section 475 (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675</external-xref>), as amended by sections 101(b) and 111(a)(1) of this Act, is amended by adding at the end the
			 following:</text>
							<quoted-block display-inline="no-display-inline" id="H7F495904500D4B468D9171692F98D3DE" style="OLC">
								<paragraph id="H4AEFEE0F17CC47E7AC46F4935DAA1E9C"><enum>(12)</enum><text>The term <term>sibling</term> means an individual who satisfies at least one of the following conditions with respect to a
			 child:</text>
									<subparagraph id="HBC03CF99A0A44C70AEB5B2D1794F8D60"><enum>(A)</enum><text>The individual is considered by State law to be a sibling of the child.</text>
									</subparagraph><subparagraph id="H25E7150B92E040F7A9E05EA820A04052"><enum>(B)</enum><text>The individual would have been considered a sibling of the child under State law but for a
			 termination or other disruption of parental rights, such as the death of a
			 parent.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H714191243936411392AB309941D06B3C"><enum>(b)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed as subordinating the rights of foster or adoptive
			 parents of a child to the rights of the parents of a sibling of that
			 child.</text>
					</subsection></section><section id="HCD4AD7455E7E4732A4284BCF29FA56A8"><enum>210.</enum><header>Effective dates</header>
					<subsection id="H3C58CAE7E7DC478D8420F24300FC55E5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as otherwise provided in this section, the amendments made by this subtitle shall take
			 effect as if enacted on October 1, 2013.</text>
					</subsection><subsection id="HCA0CC07179CC4DA0B29049DBF716BA82"><enum>(b)</enum><header>Restructuring and renaming of program</header>
						<paragraph id="H3F362FA0FA514DC29665D90A93C4FFA8"><enum>(1)</enum><header>In general</header><text>The amendments made by sections 202 and 203 shall take effect on October 1, 2014, subject to
			 paragraph (2).</text>
						</paragraph><paragraph id="H2945829FB9FA4C95937E9B89E06B4FDA"><enum>(2)</enum><header>Transition rule</header>
							<subparagraph id="H2516F9DC6738451887106FBA0BB3C22F"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of law, the total amount payable to a State under section 473A
			 of the Social Security Act for fiscal year 2014 shall be an amount equal
			 to <fraction>½</fraction> of the sum of—</text>
								<clause id="H100B6EB5928D46C0A965BB1F9D7C89E1"><enum>(i)</enum><text>the total amount that would be payable to the State under such section for fiscal year 2014 if the
			 amendments made by section 202 of this Act had not taken effect; and</text>
								</clause><clause id="HDCF8E9D7814E48F08F502B9C9D024E46"><enum>(ii)</enum><text display-inline="yes-display-inline">the total amount that would be payable to the State under such section for fiscal year 2014 in the
			 absence of this paragraph.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H008E2B023B3E4646A7FED524E08F643D"><enum>(B)</enum><header display-inline="yes-display-inline">Pro rata adjustment if insufficient funds available</header><text display-inline="yes-display-inline">If the total amount otherwise payable under subparagraph (A) for fiscal year 2014 exceeds the
			 amount appropriated pursuant to section 473A(h) of the Social Security Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/673b">42 U.S.C. 673b(h)</external-xref>) for that fiscal year, the amount payable to each State under subparagraph (A) for fiscal year
			 2014 shall be—</text>
								<clause commented="no" display-inline="no-display-inline" id="HA93C9E5DA46742418793339F616E685D"><enum>(i)</enum><text>the amount that would otherwise be payable to the State under subparagraph (A) for fiscal year
			 2014; multiplied by</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="HD700DEBC6F61463E90CC16D32EA7B919"><enum>(ii)</enum><text>the percentage represented by the amount so appropriated for fiscal year 2014, divided by the total
			 amount otherwise payable under subparagraph (A) to all States for that
			 fiscal year.</text>
								</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H84CC8B2964EA4A0684754DF3B1E6FFEA"><enum>(c)</enum><header>Use of incentive payments; eligibility for kinship guardianship assistance payments with a
			 successor guardian; data collection</header><text>The amendments made by sections 204, 207, and 208 shall take effect on the date of enactment of
			 this Act.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="H04FE5201FDC24EC9A8E9F3A0A9B63130"><enum>(d)</enum><header>Calculation and use of savings resulting from the phase-<enum-in-header>O</enum-in-header>ut of eligibility requirements for adoption assistance</header><text>The amendment made by section 206 shall take effect on October 1, 2014.</text>
					</subsection><subsection commented="no" id="HC3DE0E3216824300A2FDC7E9BD7BC9B5"><enum>(e)</enum><header>Notification of parents of siblings</header>
						<paragraph commented="no" id="HC59C1CF90F21438BB367F923403995E5"><enum>(1)</enum><header>In general</header><text>The amendments made by section 209 shall take effect on the date of enactment of this Act, subject
			 to paragraph (2).</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF9B51F61E4684734B652DBABF1285773"><enum>(2)</enum><header>Delay permitted if State legislation required</header><text>In the case of a State plan approved under part E of title IV of the Social Security Act which the
			 Secretary of Health and Human Services determines requires State
			 legislation (other than legislation appropriating funds) in order for the
			 plan to meet the additional requirements imposed by section 209, the State
			 plan shall not be regarded as failing to comply with the requirements of
			 such part solely on the basis of the failure of the plan to meet such
			 additional requirements before the 1st day of the 1st calendar quarter
			 beginning after the close of the 1st regular session of the State
			 legislature that ends after the 1-year period beginning with the date of
			 enactment of this Act. For purposes of the preceding sentence, in the case
			 of a State that has a 2-year legislative session, each year of the session
			 is deemed to be a separate regular session of the State legislature.</text>
						</paragraph></subsection></section></subtitle><subtitle id="H1C356A94DD104391ABA771476B596CDA"><enum>B</enum><header>Extending the Family Connection Grant Program</header>
				<section commented="no" display-inline="no-display-inline" id="HA0D515AA14CB4527885BF499C92EB387" section-type="subsequent-section"><enum>221.</enum><header>Extension of family connection grant program</header>
					<subsection id="HB656C91075F54541BD185B1E48E98B98"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 427(h) (<external-xref legal-doc="usc" parsable-cite="usc/42/627">42 U.S.C. 627(h)</external-xref>) is amended by striking <quote>2013</quote> and inserting <quote>2014</quote>.</text>

						</paragraph></subsection><subsection id="H7FF62E2F4F3F435BA7F12964B390D9ED"><enum>(c)</enum><header>Finding families for foster children who are parents</header><text>Section 427(a)(1)(E) (<external-xref legal-doc="usc" parsable-cite="usc/42/627">42 U.S.C. 627(a)(1)(E)</external-xref>) is amended by inserting <quote>and other individuals who are willing and able to be foster parents for children in foster care
			 under the responsibility of the State who are themselves parents</quote> after <quote>kinship care families</quote>.</text>
					</subsection><subsection id="H767F06C5FE104912AA3CB3B1D26FB80D"><enum>(d)</enum><header>Reservation of funds</header><text>Section 427(g) (<external-xref legal-doc="usc" parsable-cite="usc/42/627">42 U.S.C. 627(g)</external-xref>) is amended—</text>
						<paragraph id="H846C12504B0D42519F8C0A9441BBA737"><enum>(1)</enum><text>by striking paragraph (1); and</text>

			<section id="H5807752E423F4F18B497118A35E36DBF"><enum>301.</enum><header>Amendments to ensure access to child support services for international child support cases</header>
				<subsection id="H450DAC7BC3574D158338865B0BDC4509"><enum>(a)</enum><header>Authority of the secretary of HHS To ensure compliance with multilateral child support conventions</header>
					<paragraph id="HAB32E55A1F524AD99AD7F6F6CBAB8A14"><enum>(1)</enum><header>In general</header><text>Section 452 (<external-xref legal-doc="usc" parsable-cite="usc/42/652">42 U.S.C. 652</external-xref>) is amended—</text>
						<subparagraph id="HDF738ED4623C4B4486862795689C9D49"><enum>(A)</enum><text>by redesignating the second subsection (l) (as added by section 7306 of the Deficit Reduction Act

							</clause><clause id="H623D0FF65C824233AF7A4FC6825785B5" indent="up1"><enum>(ii)</enum><text>The amendments made by subparagraph (C) of paragraph (2) shall take effect on the date of the
			 enactment of this Act.</text>
							</clause></subparagraph></paragraph></subsection></section><section id="H6BA92C63B43F4F9E8EBE012852FDC087"><enum>302.</enum><header>Child support enforcement programs for Indian tribes</header>
				<subsection id="HB5E1CA09B0894324BA5D6072FEFC0822"><enum>(a)</enum><header>Tribal access to the Federal parent locator service</header><text>Section 453(c)(1) (<external-xref legal-doc="usc" parsable-cite="usc/42/653">42 U.S.C. 653(c)(1)</external-xref>) is amended by inserting <quote>or Indian tribe or tribal organization (as defined in subsections (e) and (l) of section 4 of the
			 Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>)),</quote> after <quote>any State</quote>.</text>
				</subsection><subsection id="H1FB3ABD3BF6B494986B4E01E3DAADC65"><enum>(b)</enum><header>Waiver authority for Indian tribes or tribal organizations operating child support enforcement
			 programs</header><text>Section 1115(b) (<external-xref legal-doc="usc" parsable-cite="usc/42/1315">42 U.S.C. 1315(b)</external-xref>) is amended—</text>
					<paragraph id="H858B36B6F68C49E7946D4596F3375BAA"><enum>(1)</enum><text>by redesignating paragraphs (1) through (3) as subparagraphs (A) through (C), respectively, and
			 realigning the left margin of subparagraph (C) so as to align with
			 subparagraphs (A) and (B) (as so redesignated);</text>
					</paragraph><paragraph id="H2822B41AD0E6415DB5AFE4CC01FE770A"><enum>(2)</enum><text>by inserting <quote>(1)</quote> after <quote>(b)</quote>; and</text>
					</paragraph><paragraph id="H379730E270A34BEBA828F1327A45D862"><enum>(3)</enum><text>by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H89BF69FEC2F744459874C73269EC6EE7" style="OLC">
							<paragraph id="H964DEEFE802D42A0ADFC6F460FC379A0" indent="up1"><enum>(2)</enum><text>An Indian tribe or tribal organization operating a program under section 455(f) shall be considered
			 a State for purposes of authority to conduct an experimental, pilot, or
			 demonstration project under subsection (a) to assist in promoting the
			 objectives of part D of title IV and receiving payments under the second
			 sentence of that subsection. The Secretary may waive compliance with any
			 requirements of section 455(f) or regulations promulgated under that
			 section to the extent and for the period the Secretary finds necessary for
			 an Indian tribe or tribal organization to carry out such project. Costs of
			 the project which would not otherwise be included as expenditures of a
			 program operating under section 455(f) and which are not included as part
			 of the costs of projects under section 1110, shall, to the extent and for
			 the period prescribed by the Secretary, be regarded as expenditures under
			 a tribal plan or plans approved under such section, or for the
			 administration of such tribal plan or plans, as may be appropriate. An
			 Indian tribe or tribal organization applying for or receiving start-up
			 program development funding pursuant to <external-xref legal-doc="regulation" parsable-cite="cfr/45/309.16">section 309.16</external-xref> of title 45, Code of Federal Regulations, shall not be considered to be an Indian tribe or tribal
			 organization operating a program under section 455(f) for purposes of this
			 paragraph.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H50C98EE5466A437DB8315653A8FFC07A"><enum>(c)</enum><header>Conforming amendments</header><text>Section 453(f) (<external-xref legal-doc="usc" parsable-cite="usc/42/653">42 U.S.C. 653(f)</external-xref>) is amended by inserting <quote>and tribal</quote> after <quote>State</quote> each place it appears.</text>
				</subsection></section><section id="HF640B92F16D145A49652AE17471457F0"><enum>303.</enum><header>Sense of the Congress regarding offering of voluntary parenting time arrangements</header>
				<subsection id="H91F670E2AE5243C5867A484B52F0A388"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">The Congress finds as follows:</text>
					<paragraph id="H967A2D82524345D18637BDF48032FFFF"><enum>(1)</enum><text display-inline="yes-display-inline">The separation of a child from a parent does not end the financial or other responsibilities of the
			 parent toward the child.</text>
					</paragraph><paragraph id="H981B04A1D2A64ED8AB6DB3CB3B879A48"><enum>(2)</enum><text display-inline="yes-display-inline">Increased parental access and visitation not only improve parent-child relationships and outcomes
			 for children, but also have been demonstrated to result in improved child
			 support collections, which creates a double win for children—a more
			 engaged parent and improved financial security.</text>
					</paragraph></subsection><subsection id="H59ABE5FFB98D4C30820DF327B242543A"><enum>(b)</enum><header>Sense of the Congress</header><text display-inline="yes-display-inline">It is the sense of the Congress that—</text>
					<paragraph id="H83E57D6B397D44DFAF60C0F8AC56120A"><enum>(1)</enum><text>establishing parenting time arrangements when obtaining child support orders is an important goal
			 which should be accompanied by strong family violence safeguards; and</text>
					</paragraph><paragraph id="HB839D3140F7F4C6C9F402DB677F92FB5"><enum>(2)</enum><text>States should use existing funding sources to support the establishment of parenting time
			 arrangements, including child support incentives, Access and Visitation
			 Grants, and Healthy Marriage Promotion and Responsible Fatherhood Grants.</text>
					</paragraph></subsection></section><section id="HF002F748F19446BC82EA637A8E9C0CDE"><enum>304.</enum><header>Data exchange standardization for improved interoperability</header>
				<subsection id="H39CB502DE2FB4478A9D5BA6C280B58CD"><enum>(a)</enum><header>In general</header><text>Section 452 (<external-xref legal-doc="usc" parsable-cite="usc/42/652">42 U.S.C. 652</external-xref>), as amended by section 301(a)(1) of this Act, is amended by adding at the end the following:</text>
					<quoted-block id="H2FFAE11F5A3A490382DB9843A6F467B7" style="OLC">
						<subsection id="HADA71B855DEA4589B0635BB3C93B035A"><enum>(o)</enum><header>Data exchange standards for improved interoperability</header>
							<paragraph id="HA4461581BFEE46EABB0413414B496B18"><enum>(1)</enum><header>Designation</header><text>The Secretary shall, in consultation with an interagency work group established by the Office of
			 Management and Budget and considering State government perspectives, by
			 rule, designate data exchange standards to govern, under this part—</text>
								<subparagraph id="H609A0944101B43C7849CB123328649BF"><enum>(A)</enum><text>necessary categories of information that State agencies operating programs under State plans
			 approved under this part are required under applicable Federal law to
			 electronically exchange with another State agency; and</text>
								</subparagraph><subparagraph id="HADA28563B7EC4D27BDA09959F6362A31"><enum>(B)</enum><text>Federal reporting and data exchange required under applicable Federal law.</text>
								</subparagraph></paragraph><paragraph id="H2638883C54B94A3FB9E11BC80A6E4471"><enum>(2)</enum><header>Requirements</header><text>The data exchange standards required by paragraph (1) shall, to the extent practicable—</text>
								<subparagraph id="HB053A12949F0409DB02FC7B95861A497"><enum>(A)</enum><text display-inline="yes-display-inline">incorporate a widely accepted, non-proprietary, searchable, computer-readable format, such as the
			 eXtensible Markup Language;</text>
								</subparagraph><subparagraph id="H40FBBA82432340AE938C4D7510211A71"><enum>(B)</enum><text>contain interoperable standards developed and maintained by intergovernmental partnerships, such as
			 the National Information Exchange Model;</text>
								</subparagraph><subparagraph id="HCE2B556F682344E1A5E9BEE4ABB75CB8"><enum>(C)</enum><text>incorporate interoperable standards developed and maintained by Federal entities with authority
			 over contracting and financial assistance;</text>
								</subparagraph><subparagraph id="H5E95EE18DB3D4093A4B0E97904476E09"><enum>(D)</enum><text>be consistent with and implement applicable accounting principles;</text>
								</subparagraph><subparagraph id="H142ADC7A1B2A423993EAA3918D1F8286"><enum>(E)</enum><text>be implemented in a manner that is cost-effective and improves program efficiency and
			 effectiveness; and</text>
								</subparagraph><subparagraph id="H2A438E8B88CA4BEEAE22B161739B90DA"><enum>(F)</enum><text>be capable of being continually upgraded as necessary.</text>
								</subparagraph></paragraph><paragraph id="H2D7F31267DB447C5BB63E315E4EAC906"><enum>(3)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to require a change to existing data exchange
			 standards found to be effective and efficient.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H94277031C0C04885AEE2717EBA1A4438"><enum>(b)</enum><header>Effective date</header><text>The Secretary of Health and Human Services shall issue a proposed rule within 24 months after the
			 date of the enactment of this section. The rule shall identify federally
			 required data exchanges, include specification and timing of exchanges to
			 be standardized, and address the factors used in determining whether and
			 when to standardize data exchanges. It should also specify State
			 implementation options and describe future milestones.</text>
				</subsection></section><section id="HC8624345D8B5482FB6E69A3E047FFBF9"><enum>305.</enum><header>Report to Congress</header><text display-inline="no-display-inline">The Secretary of Health and Human Services shall—</text>
				<paragraph id="H93D97F5C03E742A2AE966C8A3F820476"><enum>(1)</enum><text display-inline="yes-display-inline">in conjunction with the strategic plan, review and provide recommendations for cost-effective
			 improvements to the child support enforcement program under part D of
			 title IV of the Social Security Act, and ensure that the plan addresses
			 the effectiveness and performance of the program, analyzes program
			 practices, identifies possible new collection tools and approaches, and
			 identifies strategies for holding parents accountable for supporting their
			 children and for building the capacity of parents to pay child support,
			 with specific attention given to matters including front-end services,
			 on-going case management, collections, Tribal-State partnerships,
			 interstate and intergovernmental interactions, program performance, data
			 analytics, and information technology;</text>
				</paragraph><paragraph id="H2262A745B19C465AB85FB467B8503C5A"><enum>(2)</enum><text>in carrying out paragraph (1), consult with and include input from—</text>
					<subparagraph id="H086747BF62F2487382CE122CCB153E80"><enum>(A)</enum><text>State, tribal, and county child support directors;</text>
					</subparagraph><subparagraph id="HB0FC67601EA441909BAE9F1440E63985"><enum>(B)</enum><text>judges who preside over family courts or other State or local courts with responsibility for
			 conducting or supervising proceedings relating to child support
			 enforcement, child welfare, or social services for children and their
			 families, and organizations that represent the judges;</text>
					</subparagraph><subparagraph id="HDA5074614F304FA9AD897F4A6CCC265A"><enum>(C)</enum><text>custodial parents and organizations that represent them;</text>
					</subparagraph><subparagraph id="H0F05668341FA4E42970915339B5E8DF3"><enum>(D)</enum><text>noncustodial parents and organizations that represent them; and</text>
					</subparagraph><subparagraph id="HCA5A18DC370E47AD99E7BDA743CE201B"><enum>(E)</enum><text>organizations that represent fiduciary entities that are affected by child support enforcement
			 policies; and</text>
					</subparagraph></paragraph><paragraph id="HD03D4FC69CE2475CBB6F42C0EBF90FE4"><enum>(3)</enum><text>in developing the report required by paragraph (4), solicit public comment;</text>
				</paragraph><paragraph id="HD355E597AA0846538A915908C3595453"><enum>(4)</enum><text display-inline="yes-display-inline">not later than June 30, 2015, submit to the Congress a report that sets forth policy options for
			 improvements in child support enforcement, which report shall include the
			 following:</text>
					<subparagraph id="H0F27FD8A42B948D382F07E9FE7E131EE"><enum>(A)</enum><text>A review of the effectiveness of State child support enforcement programs, and the collection
			 practices employed by State agencies administering programs under such
			 part, and an analysis of the extent to which the practices result in
			 unintended consequences or performance issues associated with the programs
			 and practices.</text>
					</subparagraph><subparagraph id="HFC33F78E579D40AAB8F290384C5EE76A"><enum>(B)</enum><text>Recommendations for methods to enhance the effectiveness of child support enforcement programs and
			 collection practices.</text>
					</subparagraph><subparagraph id="H506477CDC75A4696A2829FF7664F3081"><enum>(C)</enum><text display-inline="yes-display-inline">A review of State best practices in regards to establishing and operating State and multistate lien
			 registries.</text>
					</subparagraph><subparagraph id="H961E82F7A25B4BF9AE8C0B3C07770723"><enum>(D)</enum><text>A compilation of State recovery and distribution policies.</text>
					</subparagraph><subparagraph id="H7F27412216AA46B7B9B55EB0D9DE8923"><enum>(E)</enum><text>Options, with analysis, for methods to engage noncustodial parents in the lives of their children
			 through consideration of parental time and visitation with children.</text>
					</subparagraph><subparagraph id="HE3A495C4417442C4A3412D97A60EC590"><enum>(F)</enum><text>An analysis of the role of alternative dispute resolution in making child support determinations.</text>
					</subparagraph><subparagraph id="HCC555BC5A2C645059F7B4D0B8F5096A3"><enum>(G)</enum><text>Identification of best practices for—</text>
						<clause id="H2570B86593C849F2BD50BF8F150177AF"><enum>(i)</enum><text>determining which services and support programs available to custodial and noncustodial parents are
			 non-duplicative, evidence-based, and produce quality outcomes, and
			 connecting custodial and noncustodial parents to those services and
			 support programs;</text>
						</clause><clause id="HC3CAD5074A1040AABD551A6F9F8339AA"><enum>(ii)</enum><text>providing employment support, job training, and job placement for custodial and noncustodial
			 parents; and</text>
						</clause><clause id="HB86CAAC15E1A47D585F3A380F0DA01E8"><enum>(iii)</enum><text>establishing services, supports, and child support payment tracking for noncustodial parents,
			 including options for the prevention of, and intervention on,
			 uncollectible arrearages, such as retroactive obligations.</text>
						</clause></subparagraph><subparagraph id="HAC6BA4CFAD5846BB8E9357478BC481E7"><enum>(H)</enum><text>Options, with analysis, for methods for States to use to collect child support payments from
			 individuals who owe excessive arrearages as determined under section
			 454(31) of such Act.</text>
					</subparagraph><subparagraph id="H2A9E6896DAEE42279A6EDF7B31E1384B"><enum>(I)</enum><text display-inline="yes-display-inline">A review of State practices under 454(31) of such Act used to determine which individuals are
			 excluded from the requirements of section 452(k) of such Act, including
			 the extent to which individuals are able to successfully contest or appeal
			 decisions.</text>
					</subparagraph><subparagraph id="H2691CA9043A141629DF62EF6409B2A54"><enum>(J)</enum><text>Options, with analysis, for actions as are determined to be appropriate for improvement in child
			 support enforcement.</text>
					</subparagraph></paragraph></section><section id="HC0449E12CC1C4559B5942E18CA81CE5F"><enum>306.</enum><header>Required electronic processing of income withholding</header>
				<subsection id="H2B61E4D614D44C04B0B0D85E7FA3A360"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 454A(g)(1) (<external-xref legal-doc="usc" parsable-cite="usc/42/654a">42 U.S.C. 654a(g)(1)(A)</external-xref>) is amended—</text>
					<paragraph id="HCB34D92677824A6083FF374BF54E8D30"><enum>(1)</enum><text>by striking <quote>, to the maximum extent feasible,</quote>; and</text>

						</subparagraph></paragraph></subsection><subsection id="H8E30BB717803497B8DD748EB975316AC"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect on October 1, 2015.</text>
				</subsection></section></title><title id="H5B5DCAE70A444C7EA44A789D1A93104C" style="OLC"><enum>IV</enum><header>Budgetary effects</header>
			<section commented="no" display-inline="no-display-inline" id="HCF27A2CC9BA6468FA4DADDFE5C8745F5" section-type="subsequent-section"><enum>401.</enum><header>Determination of budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go
			 Act of 2010, shall be determined by reference to the latest statement
