			 distributors to disclose bottled water quality information, and for other
			 purposes.</official-title>

		<section id="HB7D18F88D71F44B1B64F034DF3BB6232" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bottled Water Quality Information Act</short-title></quote>.</text>
		</section><section id="H7230C5606FF44A22910FC45AB58839BC"><enum>2.</enum><header>Bottled water quality reports and labeling</header>
			<subsection id="HA768B65095734F9AB7EC7E04C2B5F11D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 410 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/349">21 U.S.C. 349</external-xref>) is amended by adding at the
			 end the following:</text>
				<quoted-block id="HB983FC267C7D47A9927CA388E42CC9FE" style="OLC">
					<subsection id="HC2C23495E2F1412F854866D65BB071BE"><enum>(c)</enum><header>Bottled Water Quality Reports</header>
						<paragraph commented="no" id="H9CB3C4E9596B4EE28BB8BAEFC9FA12D3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall, by regulation, require bottled water quality reports in accordance with
			 paragraph (3).</text>
						</paragraph><paragraph commented="no" id="H5717545DA1104C8F924DB4F29669C42B"><enum>(2)</enum><header>Regulations</header><text>In carrying out paragraph (1), the Secretary shall—</text>
							<subparagraph commented="no" id="H8C62520848B6435D8F2EA596EABB6452"><enum>(A)</enum><text display-inline="yes-display-inline">issue proposed regulations not later than 18 months after the date of enactment of this subsection;
			 and</text>
							</subparagraph><subparagraph commented="no" id="H6A8F61D5866B4E3BB7DA98C6A543FEB4"><enum>(B)</enum><text>issue final regulations not later than 18 months after the period for public comment on such
			 proposed regulations has ended.</text>
							</subparagraph></paragraph><paragraph id="H75A6E8E587084ABBA830B6395797B2D1"><enum>(3)</enum><header>Requirements</header><text>The regulations promulgated under paragraph (1) shall require that each bottled water manufacturer
			 or distributor annually prepare, and make available upon request, a
			 bottled water quality report for each bottled water product that includes—</text>
							<subparagraph id="H3567A9AD14AB4E008A4E4BDF7EDD4449"><enum>(A)</enum><text>the name and contact information of the bottled water manufacturer or distributor;</text>
							</subparagraph><subparagraph id="HE52CBE3740B745B6BDF221088392E176"><enum>(B)</enum><text display-inline="yes-display-inline">the type of water source (such as a spring, an artesian well, or a public water system);</text>
							</subparagraph><subparagraph commented="no" id="H4A1C39253CB84CDE9F4466BCF18845AF"><enum>(C)</enum><text display-inline="yes-display-inline">a brief and plainly worded definition of the terms <term>Standard of Identity (SOI)</term> as described in section 165.110(a) of the Code of Federal Regulations, title 21 (or any successor
			 regulations) and <quote>Standard of Quality (SOQ)</quote> as defined in section 165.110(b) of the Code of Federal Regulations, title 21 (or any successor
			 regulations) and as applied to bottled water under this Act and applicable
			 regulations;</text>
							</subparagraph><subparagraph id="HCB4B82D80FE2414595AAF305F3273541"><enum>(D)</enum><text>a brief description of the primary processing (treatment) methods used by the bottled water
			 manufacturer (such as reverse osmosis, ozonation, ultraviolet light, and
			 micron filtration); and</text>
							</subparagraph><subparagraph id="H48B552C7FFE24A029EB0A02AF10C03B7"><enum>(E)</enum><text display-inline="yes-display-inline">test results for the microbiological, physical, chemical, and radiological quality of bottled
			 water, as prescribed by section 165.110(b) of the Code of Federal
			 Regulations, title 21 (or any successor regulation).</text>
							</subparagraph></paragraph></subsection><subsection id="HB760D8011D9043A5AADE64C9B2F90C2B"><enum>(d)</enum><header>Bottled Water Labeling</header>
						<paragraph commented="no" id="H1CF004C156814BF29809CFFEC941C7DC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall, by regulation, require each bottled water label to include the information
			 prescribed under paragraph (3).</text>
						</paragraph><paragraph commented="no" id="H70DE341613344AFBBB5F9B6B41ED48C8"><enum>(2)</enum><header>Regulations</header><text>In carrying out paragraph (1), the Secretary shall—</text>
							<subparagraph commented="no" id="H4A8D36BF3EAB4035A918AEFFACAC906F"><enum>(A)</enum><text display-inline="yes-display-inline">issue proposed regulations not later than 18 months after the date of enactment of this subsection;
			 and</text>
							</subparagraph><subparagraph commented="no" id="HF90A4D89C4E04D1F9C69BD986DC691BB"><enum>(B)</enum><text>issue final regulations not later than 18 months after the period for public comment on such
			 proposed regulations has ended.</text>
							</subparagraph></paragraph><paragraph id="H875F7FB2DCA642F7A5C315BF706FB8A4"><enum>(3)</enum><header>Requirements</header><text>The regulations promulgated under paragraph (1) shall require that each bottled water label
			 include—</text>
							<subparagraph id="HC7E6EA4864514226941CA5BB642CFC36"><enum>(A)</enum><text>the name and contact information of the bottled water manufacturer or distributor;</text>
							</subparagraph><subparagraph id="H67A88C390DD046D696270571FCE40B19"><enum>(B)</enum><text>a statement on how consumers may obtain, upon request, a bottled water quality report as described
			 in subsection (c)(3); and</text>
							</subparagraph><subparagraph commented="no" id="HB5F675F8019B476BA146363561863767"><enum>(C)</enum><text display-inline="yes-display-inline">the type of water source (such as a spring, artesian well, or public water system).</text>
							</subparagraph></paragraph><paragraph id="HE1DFA2C73EC842A79D25C388A8439277"><enum>(4)</enum><header>Multiservice containers</header><text>For refillable and reusable multiservice containers, the requirements in paragraph (3) may be
			 satisfied by including the required information on one or more of the
			 following:</text>
							<subparagraph id="H5C0E6D11EAE749EB944EF3D4D76BD9F2"><enum>(A)</enum><text>The container label.</text>
							</subparagraph><subparagraph id="H170468B04AE348D5AB332EACE75B6707"><enum>(B)</enum><text>The cap label.</text>
							</subparagraph><subparagraph id="HD99FBA772D674C92A47FC8BB78F0C734"><enum>(C)</enum><text>An electronic or manual billing statement provided to the consumer.</text>
							</subparagraph></paragraph></subsection><subsection id="HB84EADB5D17D4BE98AE09ADBB9B1F845"><enum>(e)</enum><header>National uniform labeling</header><text>No State or political subdivision of a State may directly or indirectly establish or continue in
			 effect any requirement with respect to a bottled water quality report of
			 the type required under subsection (c), or with respect to bottled water
			 labeling of the type required under subsection (d), that is not identical
			 to the requirements of subsection (c) or (d), respectively.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HE2E4C156E41D4190B37EAE3489E6D727"><enum>(b)</enum><header>Prohibited act</header><text>Section 301 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331</external-xref>) is amended by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H668CCC1F03F84D4CBB04B42301FB2B40" style="OLC">
					<subsection id="H9AAA4F5736264E9A8CAFE4D9BDED6279"><enum>(ddd)</enum><text display-inline="yes-display-inline">The failure by a bottled water manufacturer or distributor to maintain an annual bottled water
			 quality report in accordance with section 410(c).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H85A670E123DB4F3AAC0C5190AFA64E0B"><enum>(c)</enum><header>Misbranding</header><text>Section 403 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/343">21 U.S.C. 343</external-xref>) is amended by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H0D0082CA8F4C4DBF936DE0244B4AF7F0" style="OLC">
					<subsection id="H2377A877CE2342048CEBCAD5D5EEC1B3"><enum>(z)</enum><text display-inline="yes-display-inline">If it is bottled water and its label fails to include the information required by section 410(d).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section></legis-body>
