			 website regarding charges and actions brought by the Commission, and for

		<section id="H4BEFB6D750F74952B0B81E74D69E1DF6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>EEOC Transparency and Accountability Act</short-title></quote>.</text>
		</section><section id="H4CF264F99E17422FA571C184E781FD5B"><enum>2.</enum><header>Availability of information about cases on the EEOC website</header>
			<subsection id="H29C98D056FEB4EC38D52DDC5581F154F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning not later than 30 days after the date of enactment of this Act, the Equal Employment
			 Opportunity Commission shall maintain the following up-to-date information
			 on its public website:</text>
				<paragraph id="H6B64A8256834441A99B3D9C8EC2E3F2C"><enum>(1)</enum><text display-inline="yes-display-inline">A description of each case brought in court by the Commission, not later than 30 days after a
			 judgment is made with respect to any cause of action in the case, without
			 regard to whether the judgment is final. Such description shall identify—</text>
					<subparagraph id="H865671854B7D47A3B2967DD6892C5740"><enum>(A)</enum><text display-inline="yes-display-inline">the court in which the case was brought;</text>
					</subparagraph><subparagraph id="H051DCEF94E504346A27C13425D78D582"><enum>(B)</enum><text display-inline="yes-display-inline">the name and case number of the case, the nature of the allegation, the causes of action brought,
			 and the outcome of each cause of action in the case;</text>
					</subparagraph><subparagraph id="H7A9102CC1FBF4FF7A7E958C211BA8DC7"><enum>(C)</enum><text display-inline="yes-display-inline">each instance in which the Commission was ordered to pay fees and costs, including the amount of
			 such fees and costs ordered to be paid and, when applicable, the amount of
			 fees and costs actually paid by the Commission and the reason for the fee
			 or cost award;</text>
					</subparagraph><subparagraph id="H527996502D4F46D898DB43C612CF5E8E"><enum>(D)</enum><text display-inline="yes-display-inline">whether the case was authorized by a majority vote of the Commission or was brought pursuant to the
			 Commission’s delegation of authority to the General Counsel of the
			 Commission, including the basis on which the General Counsel determined
			 that submission to the Commission for authorization was not necessary and
			 a justification of that decision;</text>
					</subparagraph><subparagraph id="H34E58A0E6722432DAFB65BCE1C271EE1"><enum>(E)</enum><text display-inline="yes-display-inline">any case in which a sanction was imposed on the Commission, including the amount of such sanction
			 and the reason for the sanction; and</text>
					</subparagraph><subparagraph id="H72BD957E722C44029C72277A189518D6"><enum>(F)</enum><text>any appeal and the outcome of the appeal.</text>
					</subparagraph></paragraph><paragraph id="HB2B8F30E162348C8851EEDF81ED86E50"><enum>(2)</enum><text display-inline="yes-display-inline">The total number of charges of an alleged unlawful employment practice filed during the preceding
			 fiscal year by a member of the Commission, as authorized by the
			 Commissioner charge authority under section 706(b) of the Civil Rights Act
			 of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-5">42 U.S.C. 2000e–5(b)</external-xref>) and section 107(a) of the Americans with
			 Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12117">42 U.S.C. 12117(a)</external-xref>), and the total number of
			 resolutions of such charges disaggregated by type of resolution.</text>
				</paragraph><paragraph id="H6A9AD3BD74B04EF2815CAEBF615A3594"><enum>(3)</enum><text display-inline="yes-display-inline">The total number of charges of an alleged unlawful employment practice filed during the preceding
			 fiscal year as a result of the Commission’s use of its directed
			 investigation authority under section 7(a) of the Age Discrimination in
			 Employment Act of 1967 (<external-xref legal-doc="usc" parsable-cite="usc/29/626">29 U.S.C. 626(a)</external-xref>) and section 11(a) of the Fair
			 Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/211">29 U.S.C. 211(a)</external-xref>), and the total number of
			 resolutions of such charges disaggregated by type of resolution.</text>
				</paragraph><paragraph commented="no" id="H8C81E1B597E542F3806131421F5AAF5B"><enum>(4)</enum><text display-inline="yes-display-inline">Each case of systemic discrimination (including pattern or practice discrimination) brought in
			 court by the Commission under section 706 or 707 of the Civil Rights Act
			 of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-5">42 U.S.C. 2000e–5</external-xref>, 2000e–6) within the preceding 30 days, the
			 court in which the case was brought, the name and case number of the case,
			 the industry involved, the employment practice or practices at issue, the
			 nature of the alleged discrimination, and the circumstances of the
			 systemic discrimination alleged in the case.</text>
				</paragraph></subsection><subsection id="H07B56C7BFEFD4EF0AF18AE1EE5279014"><enum>(b)</enum><header>Disaggregation</header><text display-inline="yes-display-inline">With respect to the total number of charges of alleged unlawful employment practices provided under
			 paragraphs (2) and (3) of subsection (a), the Commission shall, on its
			 public website, disaggregate each such total number by the number of such
			 charges filed in each State, and within each State, by the number of such
			 charges alleging discrimination on the basis of, or filed under, each of
			 the following:</text>
				<paragraph id="HA86F3A69E503479D88B6240BC2B16293"><enum>(1)</enum><text>Race.</text>
				</paragraph><paragraph id="H5B8A9760A7364546B81163F519D98AB8"><enum>(2)</enum><text>Sex.</text>
				</paragraph><paragraph id="HBD8BBC0C91D941BD9926597265EF3417"><enum>(3)</enum><text>National Origin.</text>
				</paragraph><paragraph id="H2629AA299AD74963B7B267DCDBDABA89"><enum>(4)</enum><text>Religion.</text>
				</paragraph><paragraph id="H05096C65BDE049098A40BE02D1DC12B3"><enum>(5)</enum><text>Color.</text>
				</paragraph><paragraph id="HCB80B2891C7545DF9AFE48052E31DCB6"><enum>(6)</enum><text>Retaliation.</text>
				</paragraph><paragraph id="HB5B7792C56DB46E5B1131CF44DCEE3CA"><enum>(7)</enum><text>Age.</text>
				</paragraph><paragraph id="H09FB7BF9DA4A43BF85285B36BA2B1A7D"><enum>(8)</enum><text>Disability.</text>
				</paragraph><paragraph id="H2B531BDCBCE44AD5895709288E1B7B5B"><enum>(9)</enum><text>Section 6(d) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206(d)</external-xref>).</text>
				</paragraph></subsection><subsection id="H959DCDC9F08A4CD0BE7469058A36757C"><enum>(c)</enum><header>Annual performance report</header><text>Beginning fiscal year 2015, the Commission shall include in its annual performance report under
			 <external-xref legal-doc="usc" parsable-cite="usc/31/1116">section 1116</external-xref> of title 31, United States Code, the information described in
			 paragraphs (1) through (4) of subsection (a) for the preceding fiscal
			 year, except that such information shall not be disaggregated in
			 accordance with subsection (b).</text>
			</subsection><subsection id="HEF06A4D9D3454167861ED9280A384265"><enum>(d)</enum><header>Definition</header><text>For purposes of this section, the term <term>State</term> has the meaning given the term in section 701 of the Civil Rights Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e</external-xref>).</text>
			</subsection></section><section id="H664F0767426B459890442B7AC92A5E64"><enum>3.</enum><header>Good faith conference, conciliation, and persuasion</header><text display-inline="no-display-inline">Section 706(b) of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-5">42 U.S.C. 2000e–5(b)</external-xref>) is amended—</text>
			<paragraph id="H2FB5B65A13B249619C2365887020001F"><enum>(1)</enum><text>in the sixth sentence—</text>
				<subparagraph id="H6787C541360346D99A20E3ECA02C443B"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>shall endeavor</quote> and inserting <quote>shall use good faith efforts to endeavor</quote>; and</text>
				</subparagraph><subparagraph id="HFAD01DA08A9147388519A4C14962911C"><enum>(B)</enum><text>by inserting <quote>bona fide</quote> after <quote>conference,</quote>;</text>
				</subparagraph></paragraph><paragraph id="H4178331662CD4E878085F78B92F8DA4B"><enum>(2)</enum><text>in the seventh sentence—</text>
				<subparagraph id="H6698E8AE0F2442EBBFEBFCEA2F103789"><enum>(A)</enum><text>by inserting <quote>, good faith</quote> after <quote>such informal</quote>; and</text>
				</subparagraph><subparagraph id="H5C5CDB0D6F8448709D66220AE8D27749"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>persons concerned</quote> and inserting <quote>employer, employment agency, or labor organization, except for the sole purpose of allowing a party
			 to any pending litigation to present to the reviewing court evidence to
			 ensure the Commission’s compliance with its obligations under this section
			 prior to filing suit</quote>; and</text>
				</subparagraph></paragraph><paragraph id="H94A427AE4D0148678C0A834E5E393D53"><enum>(3)</enum><text>by adding at the end the following: <quote>No action or suit may be brought by the Commission under this title unless the Commission has in
			 good faith exhausted its conciliation obligations as set forth in this
			 subsection. No action or suit shall be brought by the Commission unless it
			 has certified that conciliation is at impasse. The determination as to
			 whether the Commission engaged in bone fide conciliation efforts shall be
			 subject to judicial review. The Commission’s good faith obligation to
			 engage in bona fide conciliation shall include providing the employer,
			 employment agency, or labor organization believed to have engaged in an
			 unlawful employment practice with all information regarding the legal and
			 factual bases for the Commission’s determination that reasonable causes
			 exist as well as all information that supports the Commission’s requested
			 monetary and other relief (including a detailed description of the
			 specific individuals or employees comprising the class of persons for whom
			 the Commission is seeking relief and any additional information requested
			 that is reasonably related to the underlying cause determination or
			 necessary to conciliate in good faith).</quote>.</text>
			</paragraph></section><section id="H4EF8AC155BF04D58993E0C001EAD544E"><enum>4.</enum><header>Reporting to Congress regarding cases in which the EEOC is ordered to pay fees and costs or
			 sanctions</header>
			<subsection id="H59A41D11792A43328EA852F7C23D4E28"><enum>(a)</enum><header>Investigation and report of Inspector General</header><text display-inline="yes-display-inline">In any case brought by the Equal Employment Opportunity Commission in which a court orders the
			 Commission to pay fees and costs or imposes a sanction on the Commission,
			 the Inspector General of the Commission shall—</text>
				<paragraph id="HEBD7EC1E9ADE4DAF8132DFCF6EC91DD5"><enum>(1)</enum><text display-inline="yes-display-inline">notify the Committee on Education and the Workforce of the House of Representatives and the
			 Committee on Health, Education, Labor, and Pensions of the Senate of the
			 order or sanction within 14 days of the court’s decision, including the
			 name of the case, the nature of the court’s determination, and the amount
			 of fees and costs ordered or the amount of the sanction imposed by the
			 court; and</text>
				</paragraph><paragraph id="H6D322819472442B8A84460862D6E437E"><enum>(2)</enum><text display-inline="yes-display-inline">conduct an investigation to determine why an order for sanction, fees, or costs was imposed by the
			 court, and, not later than 90 days after the court’s decision, submit a
			 report to the Committee on Education and the Workforce of the House of
			 Representatives and the Committee on Health, Education, Labor, and
			 Pensions
			 of the Senate that includes—</text>
					<subparagraph id="H7D9630744B7B4DA1B11051DA5ED43380"><enum>(A)</enum><text>information obtained from interviews and affidavits of each member and staff person of the
			 Commission involved in the case;</text>
					</subparagraph><subparagraph id="H238ECE79960046F5899B08D018141B3B"><enum>(B)</enum><text>the amount of resources allocated to the case, including in terms of full-time equivalents;</text>
					</subparagraph><subparagraph id="H866165EF1AF84F8DBB3357CF3CD8A96B"><enum>(C)</enum><text>a comparison of the case to other cases in which a court ordered fees and costs or imposed
			 sanctions against the Commission;</text>
					</subparagraph><subparagraph id="H4FC2621372294059A9747AE4FD900A20"><enum>(D)</enum><text>if the determination to bring the case was not by a vote of the full Commission, the reasons such a
			 vote was not held; and</text>
					</subparagraph><subparagraph id="H074C22635D154993B376C5D48E79CB45"><enum>(E)</enum><text>any other relevant information.</text>
					</subparagraph></paragraph></subsection><subsection id="HADE916DF455D4CA49B4530554523153F"><enum>(b)</enum><header>Report of the Commission</header><text display-inline="yes-display-inline">For any case described in subsection (a), the Commission, in consultation with the General Counsel
			 of the Commission, shall—</text>
				<paragraph id="HF6B0C59298AC439E992554C824A9499B"><enum>(1)</enum><text display-inline="yes-display-inline">not later than 60 days after the court’s decision, submit a report to the Committee on Education
			 and the Workforce of the House of Representatives and the Committee on
			 Health, Education, Labor, and Pensions of the Senate detailing the steps
			 the Commission is taking to reduce instances in which a court orders the
			 Commission to pay fees and costs or imposes a sanction on the Commission;
			 and</text>
				</paragraph><paragraph id="HF20DCC10B6934498962D215FB1C97702"><enum>(2)</enum><text display-inline="yes-display-inline">not later than 30 days after the report is submitted to the Committee on Education and the
			 Workforce of the House of Representatives and the Committee on Health,
			 Education, Labor, and Pensions of the Senate under paragraph (1), post
			 such
			 report on its public website.</text>
				</paragraph></subsection></section></legis-body>
