		<official-title>To amend the Clean Air Act with respect to exceptional event demonstrations, and for other
			 purposes.</official-title>

		<section id="H7D890F532CDB4AFA98F2649AD6965744" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Commonsense Legislative Exceptional Events Reforms Act of 2014</short-title></quote>.</text>
		</section><section id="HF8C79132EDAD488DAC7ACD593FBA8335"><enum>2.</enum><header>Clean Air Act exceptional events</header><text display-inline="no-display-inline">Section 319(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7619">42 U.S.C. 7619(b)</external-xref>) is amended—</text>
			<paragraph id="HDD9C7DAA9ABA4A0FA8F16A81F5F3FAC4"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)(B)—</text>
				<subparagraph id="HC0836C92117C468EB26DBDF97E99A8AB"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (i)—</text>
					<clause id="H7059D43F7A4F4E5B8883390D005886C1"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>(i) stagnation of air masses or</quote> and inserting <quote>(i)(I) ordinarily occurring stagnation of air masses or (II)</quote>; and</text>
					</clause><clause id="H9D50EE37A4F64775BB5450F08B118E1E"><enum>(ii)</enum><text>by inserting <quote>or</quote> after the semicolon;</text>
					</clause></subparagraph><subparagraph id="H0196B32AFBED45CDB40FE8E05564E405"><enum>(B)</enum><text display-inline="yes-display-inline">by striking clause (ii); and</text>
				</subparagraph><subparagraph id="HEA29E04D2860419AB8395F53A3458489"><enum>(C)</enum><text>by redesignating clause (iii) as clause (ii); and</text>
				</subparagraph></paragraph><paragraph id="HC5B4A7F1DAC4493CAD9A5D2A7413D258"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (3)—</text>
				<subparagraph id="H801D0C141B5D466B8DCE503DA86110C3"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (B)(iv), by striking <quote>to petition the Administrator to</quote> and inserting <quote>to submit a petition (in this section referred to as an <term>exceptional event demonstration</term>) to the Administrator to</quote>; and</text>
				</subparagraph><subparagraph id="H7E9FE2403B94425195A68EADF2B097DC"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HD089C2C1748B4975AA0B0E36463A1FC2" style="OLC">
						<subparagraph id="HF1DA7007881D472397B41ED5D28E8427"><enum>(C)</enum><header>Criteria for determination of exceptional event demonstration</header>
							<clause id="HD7A012EC473E42BC99BDAEE6E23ED4FF"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The criteria for evidence, analyses, and documentation applicable to approval or disapproval of an
			 exceptional event demonstration under the regulations under this section
			 shall be stated with specificity in order to minimize the discretion of
			 the Administrator in approving or disapproving that demonstration.</text>
							</clause><clause id="HE8D6504B8A8642299D5DE9D6FDE58FEA"><enum>(ii)</enum><header>State participation</header><text display-inline="yes-display-inline">The Administrator shall develop the criteria in conjunction with input from the States.</text>
							</clause><clause id="H03C4990AF1A14EEBA32E867AAD0E2D9E"><enum>(iii)</enum><header>Contents</header><text display-inline="yes-display-inline">The criteria shall reflect the varying levels of technical expertise and resources available in
			 State and local agencies and the varying availability of meteorological
			 and other monitoring data in rural areas, and may vary with respect to
			 different regions.</text>
							</clause><clause id="H1279D9750CFB4D9D9200B7425F315EBA"><enum>(iv)</enum><header>Considerations</header><text display-inline="yes-display-inline">In developing the criteria, the Administrator shall consider the use of an expedited or streamlined
			 approval process and conditions under which exceptional event
			 demonstrations may be suitable for such a process.</text>
							</clause></subparagraph><subparagraph id="H72FE43EDEDFD4347B89A5FB5144ABBBC"><enum>(D)</enum><header>Timing of determination of exceptional event demonstration</header>
							<clause id="H54F9607F038F4DE49CC1E3703435EECD"><enum>(i)</enum><header>Deadline for determination</header>
								<subclause id="H47B47AB6E7C14CEB8C13C2CE4335F7D5"><enum>(I)</enum><header>In general</header><text>Not later than 90 days after submission of an exceptional event demonstration, the Administrator
			 shall approve, disapprove, or request additional information from a State
			 regarding the exceptional event demonstration.</text>
								</subclause><subclause id="HC37A92351AE54E50805A2CA0E87A530B"><enum>(II)</enum><header>Administration</header><text>If the Administrator does not approve, disapprove, or request additional information relating to an
			 exceptional event demonstration within the 90-day period described in
			 subclause (I), the demonstration shall be considered to be approved on the
			 day after the date on which that 90-day period ends.</text>
								</subclause></clause><clause id="HAB8842D9387C48EE8EABCE05144C995A"><enum>(ii)</enum><header>Deadline if additional information requested</header>
								<subclause id="HF493FEEEA5B94FA1A15569AE637043BF"><enum>(I)</enum><header>In general</header><text>If the Administrator requests additional information from a State regarding an exceptional event
			 demonstration under clause (i), not later than 90 days after the
			 submission of that additional information, the Administrator shall approve
			 or disapprove the demonstration.</text>
								</subclause><subclause id="H204BCF2DD1154F928F6CDC9BEA5E91C0"><enum>(II)</enum><header>Administration</header><text>If the Administrator does not approve or disapprove a demonstration for which additional
			 information is submitted within the 90-day period described in subclause
			 (I), the demonstration shall be considered to be approved.</text>
								</subclause></clause></subparagraph><subparagraph commented="no" id="H715BC70719E8497FA143A2985A78BF81"><enum>(E)</enum><header>Burden of proof</header><text display-inline="yes-display-inline">The regulations promulgated under this section shall provide that—</text>
							<clause commented="no" id="HEA8DB593F1A5453584AFF371151FEE62"><enum>(i)</enum><text display-inline="yes-display-inline">a determination by the Administrator with respect to approval or disapproval of an exceptional
			 event demonstration be based on a preponderance of the evidence; and</text>
							</clause><clause commented="no" id="H8ADFD255FB2D4D788344049592A0969E"><enum>(ii)</enum><text display-inline="yes-display-inline">in making a determination, the Administrator—</text>
								<subclause commented="no" id="HBA54AB23DE2D4FBAB2118E381196A9E5"><enum>(I)</enum><text display-inline="yes-display-inline">shall accord substantial deference to the findings of the State exceptional event demonstration;
			 and</text>
								</subclause><subclause commented="no" id="H8E29A7847FEE4DF0A383E2B450923A97"><enum>(II)</enum><text display-inline="yes-display-inline">may develop and use analyses and consider evidence not provided in the exceptional event
			 demonstration, subject to the condition that the analyses are developed by
			 the Environmental Protection Agency.</text>
								</subclause></clause></subparagraph><subparagraph id="H6EC39E98E9484FA0B9B66DD95C097DB3"><enum>(F)</enum><header>Appeals</header>
							<clause id="HA0CD56054BA14941A271D7B56F1F1C98"><enum>(i)</enum><header>Disapproval</header>
								<subclause id="HD85F2409B733494EBBCB4CA4F40D544C"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subclause (II), disapproval by the Administrator of an exceptional event demonstration
			 shall be considered final action subject to judicial review under section
			 307(b).</text>
								</subclause><subclause id="H8326A64C260542208F667BAD4BAB0A0C"><enum>(II)</enum><header>Limitation</header><text>Notwithstanding subclause (I), disapproval by the Administrator of an exceptional event
			 demonstration shall only be subject to appeal by the State that submitted
			 the exceptional event demonstration.</text>
								</subclause></clause><clause id="H4EA8197EA2BE404DB9DA71E54B70825B"><enum>(ii)</enum><header>Approval</header><text display-inline="yes-display-inline">Approval by the Administrator of an exceptional event demonstration shall not be subject to appeal
			 or other judicial action.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph></section><section id="H1352F113BF2F457D86F545239AE458EA"><enum>3.</enum><header>Revision of regulations</header><text display-inline="no-display-inline">After providing for a notice and comment period, but not later than 180 days after the date of
			 enactment of this Act, the Administrator of the Environmental Protection
			 Agency shall revise the regulations under section 319(b) of the Clean Air
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7619">42 U.S.C. 7619(b)</external-xref>) to carry out the amendments made by this Act.</text>
