		<official-title>To amend the Employee Polygraph Protection Act of 1988 to provide an exemption from the protections
			 of that Act with regard to certain prospective employees whose job would
			 include caring for or interacting with unsupervised children.</official-title>

		<section id="H414E8AA764D7464D98BB5E57F2EE7346" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Our Children Act</short-title></quote>.</text>
		</section><section id="HF0C0375E09624F1A8939DAF1680477A7"><enum>2.</enum><header>Exemption for employers of employees who care for or interact with unsupervised children</header>
			<subsection id="H37B832C88FFC43FBB6CADC3733B8ACAF"><enum>(a)</enum><header>Exemption</header><text display-inline="yes-display-inline">Section 7 of the Employee Polygraph Protection Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/29/2006">29 U.S.C. 2006</external-xref>) is amended by adding at
			 the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H168ED250182546249478EF6A7A4EEDEC" style="OLC">
					<subsection id="H1ADA862D1AEF43FC93E73CAFFF77C2E1"><enum>(g)</enum><header>Exemption for certain employers of employees who care for or interact with unsupervised children</header>
						<paragraph id="HC87D74ECEF5D493A9CD8825ED6B0C6D3"><enum>(1)</enum><header>Exemption</header><text>Subject to paragraph (2) and subsection (c) of section 8, this Act shall not prohibit the use of a
			 polygraph test by any employer if the test is administered to a
			 prospective employee—</text>
							<subparagraph id="HAB5F9C5324654E28BF1DF42CD019F97A"><enum>(A)</enum><text>whose activities would involve the care or supervision of children or regular access to children
			 who are cared for or supervised by another employee;</text>
							</subparagraph><subparagraph id="HA34E62DEDE2E45738BE20F7627616A05"><enum>(B)</enum><text display-inline="yes-display-inline">whose job description indicates a high probability that the prospective employee will interact with
			 unsupervised children on a frequent basis; or</text>
							</subparagraph><subparagraph id="HC750FC98836B40F1999794E3137FA26C"><enum>(C)</enum><text display-inline="yes-display-inline">where the employer reasonably believes there is a high probability of unsupervised interaction
			 between the prospective employee and a child on a more than incidental
			 basis.</text>
							</subparagraph></paragraph><paragraph id="H7864F9A7042C46F18F9BDAD009D9CA3F"><enum>(2)</enum><header>Conditions</header><text>In addition to the requirements imposed by section 8(c), the exemption provided under paragraph (1)
			 shall not apply unless the following conditions are met:</text>
							<subparagraph id="H3B8808688CA14FCCA76EE557B83ADBB6"><enum>(A)</enum><text>The prospective employee is provided with reasonable written notice of the date, time, and location
			 of the polygraph test and of such examinee’s right to obtain and consult
			 with legal counsel or an employee representative before each phase of the
			 test.</text>
							</subparagraph><subparagraph id="HA001CDE53C29494BAA42EB41725C532A"><enum>(B)</enum><text>Following the polygraph test, before any adverse employment action is taken, the employer shall—</text>
								<clause id="H444D4AFCC9D147F890845726CD3D48EA"><enum>(i)</enum><text>further interview the examinee on the basis of the results of the test; and</text>
								</clause><clause id="H29D78A6F7C5042BDBC38191C0C31A483"><enum>(ii)</enum><text>provide the examinee with—</text>
									<subclause id="H500C7046C6F34668BF9720343C72F4FF"><enum>(I)</enum><text>a written copy of any opinion or conclusion rendered as a result of the test; and</text>
									</subclause><subclause id="H35C7409C7F2D4FE48C6AA1F65CFE232E"><enum>(II)</enum><text>a copy of the questions asked during the test along with the corresponding charted responses.</text></subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H8A82A0F46F4342E1AFBFB027856E8410"><enum>(b)</enum><header>Conforming amendment</header><text>Section 8(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2007">29 U.S.C. 2007(c)</external-xref>) is amended in the matter preceding paragraph (1), by
			 striking <quote>and (f)</quote> and inserting <quote>(f) and (g)</quote>.</text>
