		<section id="HA9A233AA49074217A69E70E51FA8F588" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promise Zone Job Creation Act of 2014</short-title></quote>.</text>
		</section><section id="HEA8307DAF7A94BBD9D1841A68DBC3B94"><enum>2.</enum><header>Promise Zones</header>
			<subsection id="H3679D3C8D97547F78A30F5925CE2C334"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter Y of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the
			 following new part:</text>

					<part id="HFE76BEF824CF4A3289F6D1D9C5CAA965"><enum>IV</enum><header>Promise Zones</header>
						<toc container-level="part-container" idref="HFE76BEF824CF4A3289F6D1D9C5CAA965" lowest-bolded-level="division-lowest-bolded" lowest-level="section" quoted-block="no-quoted-block" regeneration="yes-regeneration">
							<toc-entry idref="H9062E6409BF44AFC8E2623C3AC0F55E9" level="section">Sec. 1400V–1. Designation of Promise Zones.</toc-entry>

						<section id="H9062E6409BF44AFC8E2623C3AC0F55E9"><enum>1400V–1.</enum><header>Designation of Promise Zones</header>
							<subsection id="H489889FB5EAD492CB4DF573CF30A11C3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of this part, the term <quote>Promise Zone</quote> means any area—</text>
								<paragraph id="HF69C7B94FE8F4D9E80B894C12FF78718"><enum>(1)</enum><text>which is nominated by 1 or more local governments or Indian Tribes (as defined in section 4(13) of
			 the Native American Housing Assistance and Self-Determination Act of 1996
			 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103(13)</external-xref>)) for designation as a Promise Zone (hereafter in this
			 section referred to as a <quote>nominated area</quote>),</text>
								</paragraph><paragraph id="HD63820648C9F4DF59EA13B5B132EB186"><enum>(2)</enum><text>which has a continuous boundary,</text>
								</paragraph><paragraph id="H0D98E49DDACA42BBAA6C40686C99EB70"><enum>(3)</enum><text>the population of which does not exceed 200,000, and</text>
								</paragraph><paragraph id="HB8517EE7DB844D1AAB1D049FE5D34C9A"><enum>(4)</enum><text display-inline="yes-display-inline">which the Secretary of Housing and Urban Development and the Secretary of Agriculture, acting
			 jointly, designate as a Promise Zone, after consultation with the
			 Secretary of Commerce, the Secretary of Education, the Attorney General,
			 the Secretary of Health and Human Services, the Secretary of Labor, the
			 Secretary of the Treasury, the Secretary of Transportation, and other
			 agencies as appropriate.</text>
								</paragraph></subsection><subsection id="H22BD1915D662439F94ED73FF49722955"><enum>(b)</enum><header>Number of designations</header>
								<paragraph id="HBCA8E9AC81984E37A024F368BE601DC2"><enum>(1)</enum><header>In general</header><text>Not more than 20 nominated areas may be designated as Promise Zones.</text>
								</paragraph><paragraph id="HD029EF6799A34D419E5C23758BB380D1"><enum>(2)</enum><header>Number of designations in rural areas</header><text>Of the areas designated under paragraph (1), 6 of such areas shall be areas—</text>
									<subparagraph id="HECC391104B914650A36DB4AB4C7EF774"><enum>(A)</enum><text>which are outside of a metropolitan statistical area (within the meaning of section 143(k)(2)(B)),
			 or</text>
									</subparagraph><subparagraph id="H910EC98E74D54D9882326760F0249466"><enum>(B)</enum><text display-inline="yes-display-inline">which are determined by the Secretary of Agriculture to be rural areas.</text>
									</subparagraph></paragraph></subsection><subsection id="H62872098B01B414D9520B02692E526D6"><enum>(c)</enum><header>Period of designations</header>
								<paragraph id="H5FB39B5110764ADCB406E50DBC6A3B31"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Housing and Urban Development and the Secretary of Agriculture shall, acting
			 jointly, designate 20 areas as Promise Zones before January 1, 2017.</text>
								</paragraph><paragraph id="H162156CE774746E885AAAA7836FCADBA"><enum>(2)</enum><header>Effective dates of designations</header><text>The designation of any Promise Zone shall take effect—</text>
									<subparagraph id="H900A40B38A094E63BB6EA6BD62575664"><enum>(A)</enum><text>for purposes of priority consideration in Federal grant programs and initiatives (other than this
			 part), upon execution of the Promise Zone agreement, and</text>
									</subparagraph><subparagraph id="H1A115C7228D04AFB853A11ED123F8FD1"><enum>(B)</enum><text>for purposes of this part, on January 1 of the first calendar year beginning after the date of the
			 execution of the Promise Zone agreement.</text>
									</subparagraph></paragraph><paragraph id="H54A8AA06ED854965A6F2CBD5E22853BE"><enum>(3)</enum><header>Termination of designations</header><text>The designation of any Promise Zone shall end on the earlier of—</text>
									<subparagraph id="H8263CF54C28440FEBA322C97E4ADFF3E"><enum>(A)</enum><text>the end of the 10-year period beginning on the date that such designation takes effect, or</text>
									</subparagraph><subparagraph id="HD296E99DD67B485B83072F0AAAE991B8"><enum>(B)</enum><text>the date of the revocation of such designation.</text>
									</subparagraph></paragraph><paragraph id="H3CE9B3A4D852444C9F07052E4BD1B689"><enum>(4)</enum><header>Application to certain Zones already designated</header><text>In the case of any area designated as a Promise Zone by the Secretary of Housing and Urban
			 Development and the Secretary of Agriculture before the date of the
			 enactment of this Act, such area shall be taken into account as a Promise
			 Zone designated under this section and shall reduce the number of Promise
			 Zones remaining to be designated under paragraph (1).</text>
								</paragraph></subsection><subsection id="H77D7F945CA314B8790C3F9CF71707C5C"><enum>(d)</enum><header>Limitations on designations</header><text>No area may be designated under this section unless—</text>
								<paragraph id="H07F5C5931F31456BA269E20D0124407F"><enum>(1)</enum><text>the entities nominating the area have the authority to nominate the area of designation under this
			 section,</text>
								</paragraph><paragraph id="H2A5A9F75BE414F8A86BA57DB512E002B"><enum>(2)</enum><text display-inline="yes-display-inline">such entities provide written assurances satisfactory to the Secretary of Housing and Urban
			 Development and the Secretary of Agriculture that the competitiveness plan
			 described in the application under subsection (e) for such area will be
			 implemented and that such entities will provide the Secretary of Housing
			 and Urban Development and the Secretary of Agriculture with such data
			 regarding the economic conditions of the area (before, during, and after
			 the area’s period of designation as a Promise Zone) as such Secretary may
			 require, and</text>
								</paragraph><paragraph id="H8227B1120EC14D2690CCB6412D931F87"><enum>(3)</enum><text display-inline="yes-display-inline">the Secretary of Housing and Urban Development and the Secretary of Agriculture determine that any
			 information furnished is reasonably accurate.</text>
								</paragraph></subsection><subsection id="H1FB1FD267175471FA6BEEBA6AD778182"><enum>(e)</enum><header>Application</header><text>No area may be designated under this section unless the application for such designation—</text>
								<paragraph id="HBC659C0BA7034223BEC822B29806AC70"><enum>(1)</enum><text>demonstrates that the nominated area satisfies the eligibility criteria described in subsection
			 (a), and</text>
								</paragraph><paragraph id="H2854C0FAABA248B4AFCD07F300297ABD"><enum>(2)</enum><text>includes a competitiveness plan which—</text>
									<subparagraph id="H9C1C2A68BA4B4054899EAE3841E4804F"><enum>(A)</enum><text>addresses the need of the nominated area to attract investment and jobs and improve educational
			 opportunities,</text>
									</subparagraph><subparagraph id="HB795E1E048EF4063A58F459E9A539AFA"><enum>(B)</enum><text display-inline="yes-display-inline">leverages the nominated area’s economic strengths and outlines targeted investments to develop
			 competitive advantages,</text>
									</subparagraph><subparagraph id="H8A9E5A96E97B479F96C3D628A238763D"><enum>(C)</enum><text>demonstrates collaboration across a wide range of stakeholders,</text>
									</subparagraph><subparagraph id="H5385D0ECA0144D3FABE59DB81DCD0554"><enum>(D)</enum><text>outlines a strategy which connects the nominated area to drivers of regional economic growth, and</text>
									</subparagraph><subparagraph id="HDBD0A95F078D4BC5A1AE6E2DF4EEEA79"><enum>(E)</enum><text>proposes a strategy for focusing on increased access to high quality affordable housing and
			 improved public safety.</text>
									</subparagraph></paragraph></subsection><subsection id="H5C5BE83ED54B43FF8C4BFBF7329B82DE"><enum>(f)</enum><header>Selection criteria</header><text display-inline="yes-display-inline">From among the nominated areas eligible for designation under this section, the Secretary of
			 Housing and Urban Development and the Secretary of Agriculture shall
			 designate Promise Zones on the basis of—</text>
								<paragraph id="HC62B6B0ABD914A9181D809EBB3098CF6"><enum>(1)</enum><text>the effectiveness of the competitiveness plan submitted under subsection (e) and the assurances
			 made under subsection (d),</text>
								</paragraph><paragraph id="HF465D97F51A5408083F261BD84D90C80"><enum>(2)</enum><text display-inline="yes-display-inline">unemployment rates, poverty rates, household income, home ownership, labor force participation,
			 educational attainment, and such other factors as the Secretary of Housing
			 and Urban Development and the Secretary of Agriculture may identify, and</text>
								</paragraph><paragraph id="H80DED7435466418BACB44CEA16E0FDCD"><enum>(3)</enum><text>other criteria as determined by the Secretary of Housing and Urban Development and the Secretary of
			 Agriculture.</text></paragraph><continuation-text continuation-text-level="subsection">The Secretary of Housing and Urban Development and the Secretary of Agriculture may set minimal
			 standards for the levels of unemployment and poverty that must be
			 satisfied for designation as a Promise Zone.</continuation-text></subsection></section><section id="HAE55E09D65DE487C8268402384C0039C"><enum>1400V–2.</enum><header>Promise Zone employment credit</header>
							<subsection id="H97409BD354C64180B7DB54E4F797DBAB"><enum>(a)</enum><header>Amount of credit</header><text display-inline="yes-display-inline">For purposes of section 38, the amount of the Promise Zone employment credit determined under this
			 section with respect to any employer for any taxable year is the
			 applicable percentage of the qualified wages paid or incurred during the
			 calendar year which ends with or within such taxable year.</text>
							</subsection><subsection id="H7DA03CC8E56B4A669F14171B2F4397CE"><enum>(b)</enum><header>Applicable percentage</header><text>For purposes of this section, the term <quote>applicable percentage</quote> means—</text>
								<paragraph id="HBC4DFEEF919243B9A06C93E48DAFF4C4"><enum>(1)</enum><text>in the case of qualified wages described in subsection (c)(1)(A), 20 percent, and</text>
								</paragraph><paragraph id="H72315BEC1FF84CA9B58F463AA9EB72A8"><enum>(2)</enum><text>in the case of qualified wages described in subsection (c)(1)(B), 10 percent.</text>
								</paragraph></subsection><subsection id="H1995125140714B94BFA4B2CC67486527"><enum>(c)</enum><header>Qualified wages</header><text display-inline="yes-display-inline">For purposes of this section—</text>
								<paragraph id="HF43184FB5DB44B6190D6DC13A0170BD2"><enum>(1)</enum><header>In general</header><text>The term <quote>qualified wages</quote> means any wages paid or incurred by an employer for services performed by an employee while such
			 employee is—</text>
									<subparagraph id="HC5D32144928A4B55A32EF022D50ED332"><enum>(A)</enum><text>a qualified zone employee, or</text>
									</subparagraph><subparagraph id="HDCCCEE7D5D4F40AA819D0CE76E23E4C3"><enum>(B)</enum><text>a qualified resident employee.</text>
									</subparagraph></paragraph><paragraph id="H6B332519D3AA4A239C07AEB96F8BCBB1"><enum>(2)</enum><header>Only first $15,000 of wages per year taken into account</header><text>With respect to each qualified employee, the amount of qualified wages taken into account for a
			 calendar year shall not exceed $15,000.</text>
								</paragraph><paragraph id="H1DAF9BC7CE62424FAD3F6548094BA5AF"><enum>(3)</enum><header>Coordination with work opportunity credit</header>
									<subparagraph id="H000DCF65015F42E39615BD0201789EB5"><enum>(A)</enum><header>In general</header><text>The term <quote>qualified wages</quote> shall not include wages taken into account in determining the credit under section 51.</text>
									</subparagraph><subparagraph id="H7EFC5332370346548E7DD8A030FDB1F1"><enum>(B)</enum><header>Coordination with dollar limitation</header><text>The $15,000 amount in paragraph (2) shall be reduced for any calendar year by the amount of wages
			 paid or incurred during such year which are taken into account in
			 determining the credit under section 51.</text>
									</subparagraph></paragraph><paragraph id="H13445948E38143BD817FFC22E18EB156"><enum>(4)</enum><header>Wages</header><text>The term <quote>wages</quote> has the meaning given such term by section 1397(a).</text>
								</paragraph></subsection><subsection id="H6F315913AF89420EAB558E4C1E7D709C"><enum>(d)</enum><header>Qualified employee</header><text>For purposes of this section—</text>
								<paragraph id="HD28170DB0464467E89D62CC0125905EF"><enum>(1)</enum><header>Qualified employee</header><text>The term <quote>qualified employee</quote> means any employee who is a qualified zone employee or a qualified resident employee.</text>
								</paragraph><paragraph id="H2BEE42C091494657B56091FCA25020AE"><enum>(2)</enum><header>Qualified zone employee</header><text>Except as otherwise provided in this subsection, the term <quote>qualified zone employee</quote> means, with respect to any period, any employee of an employer if—</text>
									<subparagraph id="HB25F04F89E0E437F91FE43BA9944E3FA"><enum>(A)</enum><text>substantially all of the services performed during such period by such employee for such employer
			 are performed within a Promise Zone in a trade or business of the
			 employer, and</text>
									</subparagraph><subparagraph id="HE9B7FF4474DC4E358892AB308C752CE0"><enum>(B)</enum><text>the principal place of abode of such employee while performing such services is within a Promise
			 Zone.</text>
									</subparagraph></paragraph><paragraph id="H31C35253D1CF43C2B5C81D3877DA276D"><enum>(3)</enum><header>Qualified resident employee</header><text display-inline="yes-display-inline">Except as otherwise provided in this subsection, the term <quote>qualified resident employee</quote> means, with respect to any period, an employee of an employer if the principal place of abode of
			 such employee during such period is within a Promise Zone, but
			 substantially all of the services performed during such period by such
			 employee for such employer are not performed within a Promise Zone in a
			 trade or business of the employer.</text>
								</paragraph><paragraph id="H49585CE4BA8D478EA85B96E90596E9E4"><enum>(4)</enum><header>Certain individuals not eligible</header><text>The terms <quote>qualified zone employee</quote> and <quote>qualified resident employee</quote> shall not include any individual described in paragraph (2) of section 1396(d)(2) (determined
			 after application of paragraph (3) thereof).</text>
								</paragraph></subsection><subsection id="HEB0D11417D894C25874691A8630833DA"><enum>(e)</enum><header>Special rules</header><text>Rules similar to the rules of section 1397 shall apply for purposes of this section.</text>
							</subsection><subsection id="HD7FE6CDE6751451C9092DD27793A75BD"><enum>(f)</enum><header>Taxpayer reporting</header><text>No credit shall be determined under this section with respect to any taxpayer for any taxable year
			 unless such taxpayer provides the Secretary with such information as the
			 Secretary may require to allow the Secretary to evaluate the effectiveness
			 of the program established under this part.</text>
							</subsection></section><section id="H82F56DDCB77C4340A62E35B1FDC36BD6"><enum>1400V–3.</enum><header>Expensing of Promise Zone property</header>
							<subsection id="HFCA78F2CA9FD4C84A070E0DC82BE33D9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A taxpayer may elect to treat the cost of any Promise Zone property as an expense which is not
			 chargeable to capital account. Any cost so treated shall be allowed as a
			 deduction for the taxable year in which the Promise Zone property is
			 placed in service.</text>
							</subsection><subsection id="H761A55FA0764417C851C007DD2CC64B1"><enum>(b)</enum><header>Promise Zone property</header><text>For purposes of this section—</text>
								<paragraph id="HE5F1DE40048A45E3B8FF5973334331A2"><enum>(1)</enum><header>In general</header><text>Except as otherwise provided in this subsection, the term <quote>Promise Zone property</quote> means property—</text>
									<subparagraph id="H7EF0616A42EB47D98C758F0FE7D18DEA"><enum>(A)</enum><text>which is—</text>
										<clause id="HB6963693D7E04208865DABA857CA0EDC"><enum>(i)</enum><text>tangible property (to which section 168 applies) with an applicable recovery period (within the
			 meaning of section 168) of 20 years or less,</text>
										</clause><clause id="HE6FC6EC70BE2463C80F06FE9511F4768"><enum>(ii)</enum><text>water utility property described in section 168(e)(5),</text>
										</clause><clause id="HFFC99E8770E84CF6B4C15BB4AEC33F54"><enum>(iii)</enum><text>computer software described in section 179(d)(1)(A)(ii), or</text>
										</clause><clause id="H69CF102BFC7A479898AEE168C51A1EFD"><enum>(iv)</enum><text>qualified leasehold improvement property (as defined in section 168(e)),</text>
										</clause></subparagraph><subparagraph id="H4368AFE57B9B46D79FBB68F92D096B57"><enum>(B)</enum><text>which is acquired by purchase (as defined in section 179(d)(2)) for use in the active conduct of a
			 trade or business, and</text>
									</subparagraph><subparagraph id="HF5764FB9163F4898AFFE16D018EF608E"><enum>(C)</enum><text>which is originally placed in service by the taxpayer in a Promise Zone.</text>
									</subparagraph></paragraph><paragraph id="H0CEBF393D714411DAFE87FCC93ED19D2"><enum>(2)</enum><header>Exception for certain property</header><text>Such term shall not include any property to which section 168(g) applies.</text>
								</paragraph></subsection><subsection id="H45767342F2F44F12B61E640C8D1ECC4E"><enum>(c)</enum><header>Election</header><text>An election under this section shall be made under rules similar to the rules of section 179(c).</text>
							</subsection><subsection id="H04E4A58BB01B485A9978B622EFECCCE1"><enum>(d)</enum><header>Coordination with section 179</header><text>For purposes of section 179, Promise Zone property shall not be treated as section 179 property.</text>
							</subsection><subsection id="HDA498D3156F84321B1F71F2E400518F7"><enum>(e)</enum><header>Application of other rules</header><text>Rules similar to the rules of paragraphs (3), (4), (5), (7), (9), and (10) of section 179(d) shall
			 apply for purposes of this section.</text>
							</subsection><subsection id="HE78F9F0F97C24964AFE84C152FE31903"><enum>(f)</enum><header>Taxpayer reporting</header><text display-inline="yes-display-inline">This section shall not apply with respect to any taxpayer for any taxable year unless such taxpayer
			 provides the Secretary with such information as the Secretary may require
			 to allow the Secretary to evaluate the effectiveness of the program
			 established under this part.</text>
							</subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H9073D626A1B74D09AA5CD3642942149E"><enum>(b)</enum><header>Conforming amendments</header>
				<paragraph id="H8C76F304AC694A71BDB5B8677B38727C"><enum>(1)</enum><text>Section 38(b) of such Code is amended by striking <quote>plus</quote> at the end of paragraph (35), by striking the period at the end of paragraph (36) and inserting <quote>, plus</quote>, and by adding at the end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HEEF3BE41AD3744C18426ADBB7DE7C470" style="OLC">
						<paragraph id="H5409A991C7A4425781CED1AC25D9B942"><enum>(37)</enum><text display-inline="yes-display-inline">the Promise Zone employment credit determined under section 1400V–2.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H5AEA7B6272684435B8A46A63B69264B2"><enum>(2)</enum><text display-inline="yes-display-inline">The table of parts for subchapter Y of chapter 1 of such Code is amended by adding at the end the
			 following new item:</text>
					<quoted-block display-inline="no-display-inline" id="H6A97065C6E6B4858BBE1C5E267DDF4C6" style="OLC">

							<toc-entry level="part">Part IV—Promise Zones</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HEBEBBCAB8A434AA089E85BE1524EF572"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years ending after December 31, 2014.</text>
