		<section commented="no" id="HF75F7D90533A4C05B45722247E0FAFC1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medical Bankruptcy Fairness Act of 2014</short-title></quote>.</text>
		</section><section id="H3C980F9C6BF84ED3BB8C1D246C089650"><enum>2.</enum><header>Definitions</header>
			<subsection id="H1CAE979C44124ABC93C2CC9C8DB314A3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/11/101">Section 101</external-xref> of title 11, United States Code, is amended—</text>
				<paragraph id="H31F899D69CC24BA9B62329B3634C22AC"><enum>(1)</enum><text>by inserting after paragraph (39A) the following:</text>
					<quoted-block id="HE0511A68104A4BD79892E14CA6C774A3" style="OLC">
						<paragraph id="H9A8C4444AE6A4BFEB179572689AF0328"><enum>(39B)</enum><text>The term <term>medical debt</term> means any debt incurred voluntarily or involuntarily—</text>
							<subparagraph id="H683DA545195346AFBBB328CD0EBFD2D1"><enum>(A)</enum><text>as a result of the diagnosis, cure, mitigation, or treatment of injury, deformity, or disease of an
			 individual; or</text>
							</subparagraph><subparagraph id="HEEB3542822954E939D422D385082AF9B"><enum>(B)</enum><text>for services performed by a medical professional in the prevention of disease or illness of an
			 individual.</text>
							</subparagraph></paragraph><paragraph id="H2C4532243E054DB5BED82CD4F1A410D4"><enum>(39C)</enum><text display-inline="yes-display-inline">The term <term>medically distressed debtor</term> means—</text>
							<subparagraph id="H89D7C6C7CEC84EB9BFC89F16F5D20DB3"><enum>(A)</enum><text display-inline="yes-display-inline">a debtor who, during the 3 years before the date of the filing of the petition—</text>
								<clause id="H5C5CEF3BF0A3499DA5B489974AE2BE94"><enum>(i)</enum><text display-inline="yes-display-inline">incurred or paid aggregate medical debts for the debtor, a dependent of the debtor, or a
			 nondependent parent, grandparent, sibling, child, grandchild, or spouse of
			 the debtor that were not paid by any third-party payor and were greater
			 than the lesser of—</text>
									<subclause id="H078C115A4C8145948AA7A301D62B5298"><enum>(I)</enum><text>10 percent of the debtor’s adjusted gross income (as such term is defined in section 62 of the
			 Internal Revenue Code of 1986); or</text>
									</subclause><subclause id="H6246C6979D934B6FBDE0288704A64EB9"><enum>(II)</enum><text display-inline="yes-display-inline">$10,000;</text>
									</subclause></clause><clause id="H575AAAF78361479E946A143F4044D19C"><enum>(ii)</enum><text>did not receive domestic support obligations, or had a spouse or dependent who did not receive
			 domestic support obligations, of at least $10,000 due to a medical issue
			 of the person obligated to pay that would cause the obligor to meet the
			 requirements under clause (i) or (iii), if the obligor was a debtor in a
			 case under this title; or</text>
								</clause><clause id="H384DDB400D3F4364AA41451FE68C6E65"><enum>(iii)</enum><text>experienced a change in employment status that resulted in a reduction in wages, salaries,
			 commissions, or work hours or resulted in unemployment due to—</text>
									<subclause id="H69631FF4FB2B46F989FEC39831BCF1B1"><enum>(I)</enum><text>an injury, deformity, or disease of the debtor; or</text>
									</subclause><subclause id="HD3DDED24B3E0455D9EF3DD031A5BD061"><enum>(II)</enum><text>care for an injured, deformed, or ill dependent or nondependent parent, grandparent, sibling,
			 child, grandchild, or spouse of the debtor; or</text>
									</subclause></clause></subparagraph><subparagraph id="HF341033859CA41E59F956DA5161767EA"><enum>(B)</enum><text>a debtor who is the spouse of a debtor described in subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H591E1196416243F8B329686CF62045D4"><enum>(b)</enum><header>Conforming amendments</header><text><external-xref legal-doc="usc" parsable-cite="usc/11/104">Section 104</external-xref> of title 11, United States Code, is amended—</text>
				<paragraph id="H429B2608D6394D6A82175AB58556D326"><enum>(1)</enum><text>in subsection (a), by inserting <quote>101(39C)(A),</quote> after <quote>101(19)(A),</quote>; and</text>
				</paragraph><paragraph id="H5FEACF8E9A9B431DBDD5EE1E509DA7E0"><enum>(2)</enum><text>in subsection (b), by inserting <quote>101(39C)(A),</quote> after <quote>101(19)(A),</quote>.</text>
				</paragraph></subsection></section><section id="HE9DABFEBB5A8478C87C2837E8B09519D"><enum>3.</enum><header>Exemptions</header>
			<subsection id="H4B2A8894BE3445F4AAA4451B8B004CCA"><enum>(a)</enum><header>Exempt property</header><text><external-xref legal-doc="usc" parsable-cite="usc/11/522">Section 522</external-xref> of title 11, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H88752C5D40B640FDA3E2C38D709AB9A2" style="OLC">
					<subsection id="H21A9EBC692A24B21A51DE3F1D9CEA7FE"><enum>(r)</enum>
						<paragraph commented="no" display-inline="yes-display-inline" id="H8CF817046F18438FA51019D894E12223"><enum>(1)</enum><text>If a medically distressed debtor exempts property listed in subsection (b)(2), the debtor may, in
			 lieu of the exemption provided under subsection (d)(1), elect to exempt
			 the debtor's aggregate interest, not to exceed $250,000 in value, in
			 property described in paragraph (3) of this subsection.</text>
						</paragraph><paragraph id="HA7306A57AC314E3D8EC66D5FBBB975FF" indent="up1"><enum>(2)</enum><text>If a medically distressed debtor exempts property listed in subsection (b)(3) and the exemption
			 provided under applicable law specifically for the kind of property
			 described in paragraph (3) is for less than $250,000 in value, the debtor
			 may elect to exempt the debtor's aggregate interest, not to exceed
			 $250,000 in value, in any such property.</text>
						</paragraph><paragraph id="H343422155FA34EA7B637FC85146466EB" indent="up1"><enum>(3)</enum><text>The property described in this paragraph is—</text>
							<subparagraph id="H97509F88C85844E496BAE4837ACB5741"><enum>(A)</enum><text>real property or personal property that the debtor or a dependent of the debtor uses as a
			 residence;</text>
							</subparagraph><subparagraph id="HA2FD96CE273047988CEA877D89D00D1A"><enum>(B)</enum><text>a cooperative that owns property that the debtor or a dependent of the debtor uses as a residence;
			 or</text>
							</subparagraph><subparagraph id="H8EBD2FC2191F46B98BC5BDFCD68B8575"><enum>(C)</enum><text>a burial plot for the debtor or a dependent of the debtor.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA1E3FB55F47B42D2B1DFF7E7F6ACA6D6"><enum>(b)</enum><header>Conforming amendments</header><text><external-xref legal-doc="usc" parsable-cite="usc/11/104">Section 104</external-xref> of title 11, United States Code, is amended—</text>
				<paragraph id="HE23E6FF9F0EC4FE5B3EFFDB86AFFA2EA"><enum>(1)</enum><text>in subsection (a), by inserting <quote>522(r),</quote> after <quote>522(q),</quote>; and</text>
				</paragraph><paragraph id="HA895EB8AFEE24719A845011D71AA9BCB"><enum>(2)</enum><text>in subsection (b), by inserting <quote>522(r),</quote> after <quote>522(q),</quote>.</text>
				</paragraph></subsection></section><section id="H3E316B4D2A2A4ED0A758DB84E0136938"><enum>4.</enum><header>Waiver of administrative requirements</header>
			<subsection id="H5E522031E03D477EBFC75ECB62607C4C"><enum>(a)</enum><header>Case under chapter 7</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/11/707">Section 707(b)</external-xref> of title 11, United States Code, is amended by adding at the end the following:</text>
				<quoted-block id="HF9D630E5A4FA4830B21A3BF109171029" style="OLC">
					<paragraph id="H4037D78BF70A49269A0DBCCABA46BFE6"><enum>(8)</enum><text>Paragraph (2) does not apply in any case in which the debtor is a medically distressed debtor.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HFBC47DE3377044FF8AD9B8F7937798F8"><enum>(b)</enum><header>Case under chapter 13</header><text><external-xref legal-doc="usc" parsable-cite="usc/11/1325">Section 1325(b)(1)</external-xref> of title 11, United States Code, is amended—</text>
				<paragraph id="H9FF5E180E57349C3AF1FF41E646679F0"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>or</quote> at the end;</text>
				</paragraph><paragraph id="H5C5907928FB841C8A62F4882B18BEF16"><enum>(2)</enum><text>in subparagraph (B), by striking the period at the end and inserting <quote>; or</quote>; and</text>
				</paragraph><paragraph id="H52D18CCD3EF848979869883D301568EC"><enum>(3)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H3C004B2E86DA4F908DD830726B683FFA" style="OLC">
						<subparagraph id="H37C567241EB54754850BF917E914337F"><enum>(C)</enum><text>the debtor is a medically distressed debtor.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="H146E8BFCB75B4024947A0ED8E052D16F"><enum>5.</enum><header>Credit counseling</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/11/109">Section 109(h)(4)</external-xref> of title 11, United States Code, is amended by inserting <quote>a medically distressed debtor or</quote> after <quote>apply with respect to</quote>.</text>
		</section><section id="H6A5B882D73C647BD8A76A644CBA02384"><enum>6.</enum><header>Student loan undue hardship</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/11/523">Section 523(a)(8)</external-xref> of title 11, United States Code, is amended by inserting <quote>the debtor is a medically distressed debtor or</quote> before <quote>excepting</quote>.</text>
		</section><section id="H71B227A077E74CE0B18653B51616800E"><enum>7.</enum><header>Attestation by debtor</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/11/521">Section 521</external-xref> of title 11, United States Code, is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H353B78BC28B54048BCF71F174ABB3B2C" style="OLC">
				<subsection id="H6028C26DBD254A32804D482CE8E38BD0"><enum>(k)</enum><text>If the debtor seeks relief as a medically distressed debtor, the debtor shall file a statement of
			 medical expenses relevant to the determination of whether the debtor is a
			 medically distressed debtor, which statement shall declare under penalty
			 of perjury that such medical expenses were not incurred for the purpose of
			 bringing the debtor within the meaning of the term medically distressed
			 debtor.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H1D9CE6F024AB4D9ABB11250C539ECB72"><enum>8.</enum><header>Effective date; application of amendments</header>
			<subsection id="H33DA9A8A43C449208723EA170AB5FAAC"><enum>(a)</enum><header>Effective date</header><text>Except as provided in subsection (b), this Act and the amendments made by this Act shall take
			 effect on the date of enactment of this Act.</text>
			</subsection><subsection id="H456477EFAC58468C9899632C76C96AAB"><enum>(b)</enum><header>Application of amendments</header><text>The amendments made by this Act shall apply only with respect to cases commenced under title 11,
			 United States Code, on or after the date of enactment of this Act.</text>
