			<section id="H3812E8AB57F34F13984F70DFB1B64CB0"><enum>101.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Enabling Innovation for Science, Technology, and Energy in America Act of 2014</short-title></quote> or the <quote><short-title>EINSTEIN Act</short-title></quote>.</text>
			</section><subtitle id="H64E8B1F6327640CD999C26174992FF2E"><enum>A</enum><header>Office of Science</header>
				<section id="H89533AF7469746F5A38C222222B68948"><enum>111.</enum><header>Mission</header><text display-inline="no-display-inline">Section 209 of the Department of Energy Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7139">42 U.S.C. 7139</external-xref>) is amended by adding at
			 the end the following:</text>
					<quoted-block id="H9F858B329D06494F85E6912743AD5BBC" style="OLC">
						<subsection id="H5E587536E6504F169102A24E1C1FCB80"><enum>(c)</enum><header>Mission</header><text display-inline="yes-display-inline">The mission of the Office of Science shall be the delivery of scientific discoveries, capabilities,
			 and major scientific tools to transform the understanding of nature and to
			 advance the energy, economic, and national security of the United States.
			 In support of this mission, the Director shall carry out programs on basic
			 energy sciences, advanced scientific computing research, high energy
			 physics, biological and environmental research, fusion energy sciences,
			 and nuclear physics, including as provided under subtitle A of the <short-title>Enabling Innovation for Science, Technology, and Energy in America Act of 2014</short-title>, through activities focused on—</text>
							<paragraph id="H385AD537808A4363BE0A54D3940D9A5D"><enum>(1)</enum><text display-inline="yes-display-inline">fundamental scientific discoveries through the study of matter and energy;</text>
							</paragraph><paragraph id="HA6AAF6D2CABC4D72B68F7E08BFF21802"><enum>(2)</enum><text>science for national need, including—</text>
								<subparagraph id="H2E35B83122544390B0D62C4D208A27A9"><enum>(A)</enum><text display-inline="yes-display-inline">advancing an agenda for American energy independence through research on energy production,
			 storage, transmission, efficiency, and use; and</text>
								</subparagraph><subparagraph id="HB230954286794D6F943BC7683DFDA062"><enum>(B)</enum><text>advancing our understanding of the Earth’s climate through research in atmospheric and
			 environmental sciences; and</text>
								</subparagraph></paragraph><paragraph id="H01B0B10ECA39455F9A4D852C1D61CD01"><enum>(3)</enum><text>National Scientific User Facilities to deliver the 21st century tools of science, engineering, and
			 technology and provide the Nation’s researchers with the most advanced
			 tools of modern science including accelerators, colliders, supercomputers,
			 light sources and neutron sources, and facilities for studying materials
			 science.</text>
							</paragraph></subsection><subsection id="H42BCD775C228494C9795C3B870DC84F9"><enum>(d)</enum><header>Coordination with other Department of Energy programs</header><text>The Under Secretary for Science and Energy shall ensure the coordination of Office of Science
			 activities and programs with other activities of the Department.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="HDE620DF8437D44C282A58E965232F166"><enum>112.</enum><header>Basic energy sciences</header>
					<subsection id="H30ABC47C70D446E3A0D08D171FB72A71"><enum>(a)</enum><header>Program</header><text>The Director shall carry out a program in basic energy sciences, including materials sciences and
			 engineering, chemical sciences, physical biosciences, and geosciences, for
			 the purpose of providing the scientific foundations for new energy
			 technologies.</text>
					</subsection><subsection id="HE29ECA4C4607418A8A1B851107871330"><enum>(b)</enum><header>Mission</header><text>The mission of the program described in subsection (a) shall be to support fundamental research to
			 understand, predict, and ultimately control matter and energy at the
			 electronic, atomic, and molecular levels in order to provide the
			 foundations for new energy technologies and to support Department missions
			 in energy, environment, and national security.</text>
					</subsection><subsection id="H691E860DD4444B8794B2938F6B5AE08A"><enum>(c)</enum><header>Basic energy sciences user facilities</header><text>The Director shall carry out a subprogram for the development, construction, operation, and
			 maintenance of national user facilities to support the program under this
			 section. As practicable, these facilities shall serve the needs of the
			 Department, industry, the academic community, and other relevant entities
			 to create and examine new materials and chemical processes for the
			 purposes of advancing new energy technologies and improving the
			 competitiveness of the United States. These facilities shall include—</text>
						<paragraph id="H9BC8786503C944A38BE396DA573F06BB"><enum>(1)</enum><text>x-ray light sources;</text>
						</paragraph><paragraph id="H831DAFC0DD9549B0B4724A99EA8BF5E1"><enum>(2)</enum><text>neutron sources;</text>
						</paragraph><paragraph id="H8C3F4D1827BA408C99EC242D1176BF52"><enum>(3)</enum><text>nanoscale science research centers; and</text>
						</paragraph><paragraph id="H0D175516FF0B4A2ABE3BF088BB74392F"><enum>(4)</enum><text display-inline="yes-display-inline">other facilities the Director considers appropriate, consistent with section 209 of the Department
			 of Energy Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7139">42 U.S.C. 7139</external-xref>).</text>
						</paragraph></subsection><subsection id="H2C1FB11B3AE64485B851C2B66FB9326B"><enum>(d)</enum><header>Light source leadership initiative</header>
						<paragraph id="HC4A55B5085FC4C388176221450000A80"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">In support of the subprogram authorized in subsection (c), the Director shall establish an
			 initiative to sustain and advance global leadership of light source user
			 facilities.</text>
						</paragraph><paragraph id="H59146E7408D74E29BD550313B07736A7"><enum>(2)</enum><header>Leadership strategy</header><text>Not later than 9 months after the date of enactment of this Act, and biennially thereafter, the
			 Director shall prepare, in consultation with relevant stakeholders, and
			 submit to the Committee on Science, Space, and Technology of the House of
			 Representatives and the Committee on Energy and Natural Resources of the
			 Senate a light source leadership strategy that—</text>
							<subparagraph id="H7E4220E416EA4A07B2179226E0597142"><enum>(A)</enum><text>identifies, prioritizes, and describes plans for the development, construction, and operation of
			 light sources over the next decade;</text>
							</subparagraph><subparagraph id="H7088FD6250614989A4F6F26CEFEA4EDA"><enum>(B)</enum><text>describes plans for optimizing management and use of existing light source facilities; and</text>
							</subparagraph><subparagraph id="H869D4C7064F04ACA96F28BE3ABC15871"><enum>(C)</enum><text>assesses the international outlook for light source user facilities and describes plans for United
			 States cooperation in such projects.</text>
							</subparagraph></paragraph><paragraph id="HE675F3CDFCFB4FB892CE95921AFC335D"><enum>(3)</enum><header>Advisory committee feedback and recommendations</header><text display-inline="yes-display-inline">Not later than 45 days after submission of the strategy described in paragraph (2), the Basic
			 Energy Sciences Advisory Committee shall provide the Director, the
			 Committee on Science, Space, and Technology of the House of
			 Representatives, and the Committee on Energy and Natural Resources of the
			 Senate a report of the Advisory Committee’s analyses, findings, and
			 recommendations for improving the strategy, including a review of the most
			 recent budget request for the initiative.</text>
						</paragraph><paragraph id="H92A586BCED4F4CDAA02EFFE3D81FEBDC"><enum>(4)</enum><header>Proposed budget</header><text>The Director shall transmit annually to Congress a proposed budget corresponding to the activities
			 identified in the strategy.</text>
						</paragraph></subsection><subsection id="HEE6A6E05B47E4A4D8FFC8C4E9C739CC3"><enum>(e)</enum><header>Accelerator research and development</header><text>The Director shall carry out research and development on advanced accelerator and storage ring
			 technologies relevant to the development of Basic Energy Sciences user
			 facilities, in consultation with the Office of Science’s High Energy
			 Physics and Nuclear Physics programs.</text>
					</subsection><subsection id="H61F54FE655064AD991162EC484B9D02F"><enum>(f)</enum><header>EPSCoR</header>
						<paragraph id="HD58E4567E2EC49A29E274D5B9F2081E9"><enum>(1)</enum><header>Continuation of program</header><text>The Secretary shall continue to carry out the Experimental Program to Stimulate Competitive
			 Research, established at the Department of Energy under section 2203(b)(3)
			 of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/42/13503">42 U.S.C. 13503(b)(3)</external-xref>) (in this
			 subsection referred to as <quote>EPSCoR</quote>), with the objective of expanding the research capabilities of the eligible States to enable them
			 to better address the many energy and energy-related issues that confront
			 their States and the Nation on a daily basis.</text>
						</paragraph><paragraph id="HE9539FDF6BED46D9949E77E5A052DE61"><enum>(2)</enum><header>Representation</header><text>Advisory committees, workshops, and review panels are critical tools to help the Department to make
			 sound decisions about how to best spend research and development funds, as
			 well as to identify other opportunities to advance the Department’s
			 research priorities. The Secretary shall ensure that the process for
			 nominating members to such advisory committees and review panels considers
			 candidates from a broad range of geographic locations, with an objective
			 of reflecting an expansive geographic distribution of research
			 universities.</text>
						</paragraph><paragraph id="HAFDE4FAB5FBA4805A4D8B7EC3A2BE073"><enum>(3)</enum><header>Congressional reports</header><text>The Director shall report to the Committee on Science, Space, and Technology of the House of
			 Representatives and the Committee on Energy and Natural Resources of the
			 Senate on an annual basis, using the most recent available data, on—</text>
							<subparagraph id="H04BF915207FF4C8880C91E7611D507C5"><enum>(A)</enum><text>the total research funding made available by the Department to each State in the Nation;</text>
							</subparagraph><subparagraph id="HA6258457FA6C4FB58F8E5398160D7D40"><enum>(B)</enum><text>the total amount of research funding made available, by State, under EPSCoR;</text>
							</subparagraph><subparagraph id="H1D6D28966D00485AAEADA68765F88C0D"><enum>(C)</enum><text>the total amount of Department research funding made available to all institutions and entities
			 within EPSCoR States;</text>
							</subparagraph><subparagraph id="H355D2A6DB1984FA58A1C7311FF652D01"><enum>(D)</enum><text>a breakdown of the EPSCoR funds spent in each subject matter area;</text>
							</subparagraph><subparagraph id="H0F837994FA304B69B4A176D6FD0D63A3"><enum>(E)</enum><text>the geographic breakdown of members of the Department’s research advisory boards; and</text>
							</subparagraph><subparagraph id="H1C7E0E2F9D014F8A961295266FBCAEA0"><enum>(F)</enum><text>efforts and accomplishments to more fully integrate the EPSCoR States in major activities and
			 initiatives of the Department.</text>

			 fiscal year 2015, $22,000,000.</text>
						</paragraph></subsection></section><section id="HB8E296C83A2D4F888D7C405E61A8F217"><enum>113.</enum><header>Advanced scientific computing research</header>
					<subsection id="H1394194FB930459D9FB77A2D0E8B4B7D"><enum>(a)</enum><header>Program</header><text>The Director shall carry out a research, development, demonstration, and commercial application
			 program to advance computational and networking capabilities to analyze,
			 model, simulate, and predict complex phenomena relevant to the development
			 of new energy technologies and the competitiveness of the United States.</text>
					</subsection><subsection id="HB095BFB80A0C4DDE9AA19AD6E229B06E"><enum>(b)</enum><header>Facilities</header><text>The Director, as part of the program described in subsection (a), shall develop and maintain
			 world-class computing and network facilities for science and deliver
			 critical research in applied mathematics, computer science, and advanced
			 networking to support the Department’s missions.</text>
					</subsection><subsection id="H5BF0005E22B241449E1EFFCBF77B3523"><enum>(c)</enum><header>Definitions</header><text>Section 2 of the Department of Energy High-End Computing Revitalization Act of 2004 (15 U.S.C.
			 5541) is amended by striking paragraphs (1) through (5) and inserting the
			 following:</text>
						<quoted-block id="H8D46DA615C8F49899A5610557FFF9CB4" style="OLC">
							<paragraph id="H9C4AD5586512449EAB89892EDA688C19"><enum>(1)</enum><header>Co-design</header><text>The term <quote>co-design</quote> means the joint development of application algorithms, models, and codes with computer technology
			 architectures and operating systems to maximize effective use of high-end
			 computing systems.</text>
							</paragraph><paragraph id="H3B77ED2F4AB54CB8AB27192CA72EEE70"><enum>(2)</enum><header>Department</header><text>The term <quote>Department</quote> means the Department of Energy.</text>
							</paragraph><paragraph id="H8164FFE44DAE47048A6C7456817E027F"><enum>(3)</enum><header>Exascale</header><text>The term <quote>exascale</quote> means computing system performance at or near 10 to the 18th power floating point operations per
			 second.</text>
							</paragraph><paragraph id="H85A7A5EA715C46F4916B7E1C77994B5E"><enum>(4)</enum><header>High-end computing system</header><text>The term <quote>high-end computing system</quote> means a computing system with performance that substantially exceeds that of systems that are
			 commonly available for advanced scientific and engineering applications.</text>

							</paragraph><paragraph id="HD2AE9C51E3904F9FA3BD82128F62DA82"><enum>(6)</enum><header>Leadership System</header><text display-inline="yes-display-inline">The term <quote>Leadership System</quote> means a high-end computing system that is among the most advanced in the world in terms of
			 performance in solving scientific and engineering problems.</text>
							</paragraph><paragraph id="HAD6BB5F2223842E793ECFCD4FE387B64"><enum>(7)</enum><header>National laboratory</header><text>The term <quote>National Laboratory</quote> means any one of the seventeen laboratories owned by the Department.</text>
							</paragraph><paragraph id="HB1736491F0C54E50903D06999EA9432D"><enum>(8)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Energy.</text>

			 computing systems to advance the missions of the Department.</text>
									</paragraph><paragraph id="H0D6FD50094814E90BB62897A9D3718A4"><enum>(2)</enum><header>Execution</header><text>The Secretary shall, on a competitive, merit-reviewed basis, establish 2 or more National
			 Laboratory-industry-university partnerships to conduct integrated
			 research, development, and engineering of multiple exascale architectures,
			 and—</text>
										<subparagraph id="H38448F548BBB4FD99257C0EA3DCF5B7D"><enum>(A)</enum><text>conduct mission-related co-design activities in developing exascale platforms;</text>
										</subparagraph><subparagraph id="H2ECE12B28CC246D6B1C357DB164BE85A"><enum>(B)</enum><text>develop those advancements in hardware and software technology required to fully realize the
			 potential of an exascale production system in addressing Department target
			 applications and solving scientific problems involving predictive modeling
			 and simulation and large-scale data analytics and management; and</text>
										</subparagraph><subparagraph id="H934219822D504A0682ED7E6F91137D45"><enum>(C)</enum><text>explore the use of exascale computing technologies to advance a broad range of science and
			 engineering.</text>
										</subparagraph></paragraph><paragraph id="H4B66D120B0914D78B959340014788ABF"><enum>(3)</enum><header>Administration</header><text>In carrying out this program, the Secretary shall—</text>
										<subparagraph id="HC9A8900412844BA38735523B32753CFB"><enum>(A)</enum><text>provide, on a competitive, merit-reviewed basis, access for researchers in United States industry,
			 institutions of higher education, National Laboratories, and other Federal
			 agencies to exascale systems, as appropriate; and</text>
										</subparagraph><subparagraph id="HBE0A250279E24965BE0AA3115A16F69A"><enum>(B)</enum><text>conduct outreach programs to increase the readiness for the use of exascale platforms by domestic
			 industries, including manufacturers.</text>
										</subparagraph></paragraph><paragraph id="HE2FE0BD9F71A463C9579F2F7A69C8D56"><enum>(4)</enum><header>Reports</header>
										<subparagraph id="H647F109CEB2C4975A408E5C9E9BBD0EE"><enum>(A)</enum><header>Integrated strategy and program management plan</header><text>The Secretary shall submit to Congress, not later than 90 days after the date of enactment of the <short-title>Enabling Innovation for Science, Technology, and Energy in America Act of 2014</short-title>, a report outlining an integrated strategy and program management plan, including target dates for
			 prototypical and production exascale platforms, interim milestones to
			 reaching these targets, functional requirements, roles and
			 responsibilities of National Laboratories and industry, acquisition
			 strategy, and estimated resources required, to achieve this exascale
			 system capability. The report shall include the Secretary’s plan for
			 Departmental organization to manage and execute the Exascale Computing
			 Program, including definition of the roles and responsibilities within the
			 Department to ensure an integrated program across the Department. The
			 report shall also include a plan for ensuring balance and prioritizing
			 across ASCR subprograms in a flat or slow-growth budget environment.</text>
										</subparagraph><subparagraph id="H182583EFBDD84DD8870E4EE734ED482C"><enum>(B)</enum><header>Status reports</header><text>At the time of the budget submission of the Department for each fiscal year, the Secretary shall
			 submit a report to Congress that describes the status of milestones and
			 costs in achieving the objectives of the exascale computing program.</text>
										</subparagraph><subparagraph id="H9AA0C79CEF8E46FC88D26F5AEE7B11E4"><enum>(C)</enum><header>Exascale merit report</header><text>At least 18 months prior to the initiation of construction or installation of any exascale-class
			 computing facility, the Secretary shall transmit a plan to the Congress
			 detailing—</text>
											<clause id="H959B6B2C43254FBD9955F93354D494A0"><enum>(i)</enum><text>the proposed facility’s cost projections and capabilities to significantly accelerate the
			 development of new energy technologies;</text>
											</clause><clause id="H3CAC9986D71844F3AF6E5319DE9D8543"><enum>(ii)</enum><text>technical risks and challenges that must be overcome to achieve successful completion and operation
			 of the facility; and</text>
											</clause><clause id="H0312F94C6812436286FEF60CEFB44B75"><enum>(iii)</enum><text>an independent assessment of the scientific and technological advances expected from such a
			 facility relative to those expected from a comparable investment in
			 expanded research and applications at terascale-class and petascale-class
			 computing facilities, including an evaluation of where investments should
			 be made in the system software and algorithms to enable these advances.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection></section><section id="H7776206098C4419289767390FDB841AE"><enum>114.</enum><header>High energy physics</header>
					<subsection id="HE9A5BD459F3D4F53A29C05A67F9523FB"><enum>(a)</enum><header>Program</header><text>The Director shall carry out a research program on the elementary constituents of matter and energy
			 and the nature of space and time.</text>
					</subsection><subsection id="HDC0089E44C4F429482896D1577AAE562"><enum>(b)</enum><header>Underground science</header>
						<paragraph id="H440FB68A71564ACD9E620243F5AA7B86"><enum>(1)</enum><header>Purpose</header><text>The Director shall create, preserve, and maintain United States facilities essential to underground
			 scientific research supported by the Department.</text>
						</paragraph><paragraph id="H117BF80716E142EABDEE243AE24038B4"><enum>(2)</enum><header>Report</header><text>Not later than 120 days after the date of enactment of this Act, and biennially thereafter, the
			 Director shall submit to the Committee on Science, Space, and Technology
			 of the House of Representatives and the Committee on Energy and Natural
			 Resources of the Senate a report on the activities to steward national
			 leadership in underground science, including—</text>
							<subparagraph id="H6D08F279651042069CECD2839660FA0F"><enum>(A)</enum><text>methods for coordination between activities carried out under this section and activities carried
			 out under section 117;</text>
							</subparagraph><subparagraph id="HB1641E2F04084216916B59903A5FA20D"><enum>(B)</enum><text>demonstration of engagement with other relevant Federal agencies, including the National Science
			 Foundation;</text>
							</subparagraph><subparagraph id="H190FEF574A1B4D58B03F1497591A9309"><enum>(C)</enum><text>plans for sustaining and advancing United States leadership in underground science, particularly as
			 they relate to development of scientific user facilities to explore the
			 frontiers of particle physics and science in general; and</text>
							</subparagraph><subparagraph id="HDB3AC6867CF040B884484987B11EF7D0"><enum>(D)</enum><text>identification of priorities in the area of underground science, taking into consideration previous
			 Department and National Research Council reports.</text>
							</subparagraph></paragraph><paragraph id="H4E9254BA4A1842929B1F7938A4113162"><enum>(3)</enum><header>Grants in support of underground science</header><text>The Director shall carry out a competitive program to award grants to scientists and engineers at
			 institutions of higher education, nonprofit institutions, and National
			 Laboratories to conduct research in underground science.</text>
						</paragraph><paragraph id="H29682B10490244EEB1E40320B2A02B8A"><enum>(4)</enum><header>Transfer of stewardship</header><text display-inline="yes-display-inline">If the Department determines that one or more underground research facilities are no longer
			 required to carry out the program described in this section, the Secretary
			 may designate another appropriate steward of underground research
			 facilities. If such stewardship is transferred, the Secretary shall
			 provide notification to Congress within 30 days.</text>
						</paragraph></subsection><subsection id="H03A0B0FB072541EEB771F9FA6FABCCD1"><enum>(c)</enum><header>Accelerator Research and Development</header><text display-inline="yes-display-inline">The Director shall carry out research and development in advanced accelerator concepts and
			 technologies, including laser technologies, to reduce the necessary scope
			 and cost for the next generation of particle accelerators.</text>
					</subsection></section><section id="H3D4F8E43DD0342C18B89BD94963856EA"><enum>115.</enum><header>Biological and environmental research</header>
					<subsection id="H4AD3425EBBEE442BAC8C36CF906C5852"><enum>(a)</enum><header>Program</header><text>The Director shall carry out a program of research, development, and demonstration in the areas of
			 biological systems science and climate and environmental science to
			 support the energy and environmental missions of the Department.</text>
					</subsection><subsection id="HED1D6BBED09F40C9B6415DF72F8A0042"><enum>(b)</enum><header>Priority research</header><text display-inline="yes-display-inline">In carrying out this section, the Director shall prioritize fundamental research on biological
			 systems and genomics science with the greatest potential to enable
			 technological solutions for American energy independence.</text>
					</subsection><subsection id="H45D8B3FF8BA84C5F92BBBC0FA9EE278E"><enum>(c)</enum><header>Assessment</header><text>Not later than 12 months after the date of enactment of this Act, the Comptroller General shall
			 submit a report to Congress identifying climate science-related
			 initiatives under this section that overlap or duplicate initiatives of
			 other Federal agencies and the extent of such overlap or duplication.</text>
					</subsection><subsection id="H2CB3C0A5B1604CF78A80C1238A490941"><enum>(d)</enum><header>Limitation</header><text>The Director shall not approve new climate science-related initiatives to be carried out through
			 the Office of Science without making a determination that such work is
			 unique and not duplicative of work by other Federal agencies. Not later
			 than 3 months after receiving the assessment required under subsection
			 (c), the Director shall cease those climate science-related initiatives
			 identified in the assessment as overlapping or duplicative, unless the
			 Director justifies that such work is critical to achieving American energy
			 independence.</text>
					</subsection><subsection commented="no" id="HA638E0AEC1A04A47AAA9611C08D07DE9"><enum>(e)</enum><header>Low dose radiation research program</header>
						<paragraph commented="no" id="HF2B486154D3940458947A128AC9DA7C9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Director shall carry out a research program on low dose radiation. The purpose of the program
			 is to enhance the scientific understanding of and reduce uncertainties
			 associated with the effects of exposure to low dose radiation in order to
			 inform improved risk management methods.</text>
						</paragraph><paragraph commented="no" id="HBF53DED1AA9040DEBECFC367AC5CB37E"><enum>(2)</enum><header>Study</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the Director shall enter into an
			 agreement with the National Academies to conduct a study assessing the
			 current status and development of a long-term strategy for low dose
			 radiation research. The study shall be conducted in coordination with
			 Federal agencies that perform ionizing radiation effects research and
			 shall leverage the most current studies in this field. Such study shall—</text>
							<subparagraph commented="no" id="H860257D74A354CF2A2F83C12C6A59F45"><enum>(A)</enum><text>identify current scientific challenges for understanding the long-term effects of ionizing
			 radiation;</text>
							</subparagraph><subparagraph commented="no" id="H0CFD81D199FF4B7C89AE56A3C5411FD6"><enum>(B)</enum><text>assess the status of current low dose radiation research in the United States and internationally;</text>
							</subparagraph><subparagraph commented="no" id="HAF63483432064F62ADA63449FF1DCC7F"><enum>(C)</enum><text>formulate overall scientific goals for the future of low-dose radiation research in the United
			 States;</text>
							</subparagraph><subparagraph commented="no" id="H44AE5C3BDD9F4DEC9007126E25E62F99"><enum>(D)</enum><text>recommend a long-term strategic and prioritized research agenda to address scientific research
			 goals for overcoming the identified scientific challenges in coordination
			 with other research efforts;</text>
							</subparagraph><subparagraph commented="no" id="H5D123F2EAD8C4196A3901F5AAB09DE24"><enum>(E)</enum><text>define the essential components of a research program that would address this research agenda
			 within the universities and the National Laboratories; and</text>
							</subparagraph><subparagraph commented="no" id="HB87AD5C5C4F748439BC39DB3E7A6AC72"><enum>(F)</enum><text>assess the cost-benefit effectiveness of such a program.</text>
							</subparagraph></paragraph><paragraph commented="no" id="HC4CFD466FE274DC9AC7EF5AEBDED282D"><enum>(3)</enum><header>Research plan</header><text>Not later than 90 days after the completion of the study performed under paragraph (2) the
			 Secretary shall deliver to the Committee on Science, Space, and Technology
			 of the House of Representatives and the Committee on Energy and Natural
			 Resources of the Senate a 5-year research plan that responds to the
			 study’s findings and recommendations and identifies and prioritizes
			 research needs.</text>
						</paragraph><paragraph id="HDFE3A7A16ABD47DFBBA93DD87E8056E9"><enum>(4)</enum><header>Definition</header><text display-inline="yes-display-inline">In this subsection, the term <quote>low dose radiation</quote> means a radiation dose of less than 100 millisieverts.</text>
						</paragraph><paragraph id="HB8E5057EB38B4AF081E3A7E0D375B8BB"><enum>(5)</enum><header>Prohibition on biomedical research</header><text display-inline="yes-display-inline">Section 977(e) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16317">42 U.S.C. 16317(e)</external-xref>) is amended to read as follows:</text>
							<quoted-block display-inline="no-display-inline" id="H982956AD0621493EAA5546823D6DDBC2" style="OLC">
								<subsection id="HB459BF0C38A5464BAE843108A5EA53F7"><enum>(e)</enum><header>Prohibition on biomedical research</header><text display-inline="yes-display-inline">In carrying out the program under this section, the Secretary shall not conduct biomedical
			 research.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection></section><section id="HCE37C6B8382E43E1898D22A57E0E4EA9"><enum>116.</enum><header>Fusion energy</header>
					<subsection id="HE9F4E4929E704EE99FD4364B70CEBCE2"><enum>(a)</enum><header>Program</header><text>The Director shall carry out a fusion energy sciences research program to expand the fundamental
			 understanding of plasmas and matter at very high temperatures and
			 densities and to build the scientific foundation necessary to enable
			 fusion power.</text>
					</subsection><subsection id="H6CD819EC12AB42678B14BE9B2375B0C2"><enum>(b)</enum><header>Plan</header><text>Not later than 12 months after the date of enactment of this Act, the Director shall prepare, in
			 consultation with relevant stakeholders including experts in fusion
			 science and technology and engineering and operations, and submit to the
			 Committee on Science, Space, and Technology of the House of
			 Representatives and the Committee on Energy and Natural Resources of the
			 Senate a plan to carry out the program set forth in subsection (a). The
			 plan shall—</text>
						<paragraph id="H89F00DEA8819426288A1802D5D304D57"><enum>(1)</enum><text>outline the tasks required to resolve the remaining scientific, engineering, and materials
			 challenges, including a schedule for accomplishing these tasks under
			 various budget scenarios;</text>
						</paragraph><paragraph id="H21A9999417E647248A80717105C98FEC"><enum>(2)</enum><text>identify priorities for initiation of facility construction and facility decommissioning under
			 various budget scenarios;</text>
						</paragraph><paragraph id="H12B61ECBD88D457782AC79344EA935DB"><enum>(3)</enum><text display-inline="yes-display-inline">specify how existing domestic experimental capabilities and United States participation in the ITER
			 project contribute to this effort, and what additional capabilities,
			 including facilities for materials, plasma confinement, and fusion
			 technologies and advances in large scale computer simulations may be
			 needed within the United States;</text>
						</paragraph><paragraph id="HF6C7AD42F746449E9989DAFD4E7C5F7F"><enum>(4)</enum><text>provide a strategy to develop conceptual designs for building a demonstration power plant including
			 the associated cost and schedule under various budget scenarios, and
			 address considerations with respect to operability, reliability, and
			 maintainability; and</text>
						</paragraph><paragraph id="H5AB358287FD04E62B0B9AACA26D2369E"><enum>(5)</enum><text>describe options of involving international partners or collaborators and explain how such
			 partnerships or collaborations might be leveraged to decrease costs or
			 accelerate the schedule while enhancing United States leadership in fusion
			 science and technology.</text>
						</paragraph></subsection><subsection id="HF8EFB632AB534276A42BD393B1D1A0C7"><enum>(c)</enum><header>Advisory Committee Report and Recommendations</header><text display-inline="yes-display-inline">Not later than 120 days after submission of the plan required under subsection (b), the
			 Department’s Fusion Energy Science Advisory Committee shall provide the
			 Director, the Committee on Science, Space, and Technology of the House of
			 Representatives, and the Committee on Energy and Natural Resources of the
			 Senate a report of its findings, analyses, and recommendations to improve
			 the plan, including a review of the most recent budget request.</text>
					</subsection><subsection id="H3AB9AF1B18C541FD91109A932FC0045E"><enum>(d)</enum><header>ITER study</header><text display-inline="yes-display-inline">The Comptroller General shall conduct a study to identify uncertainties and the outlook regarding
			 on-schedule completion of the International Thermonuclear Experimental
			 Reactor. The study shall review, examine, and investigate any management
			 and technical challenges, as well as financial risks, associated with the
			 International Thermonuclear Experimental Reactor. Not later than 6 months
			 after the date of enactment of this Act, the Comptroller General shall
			 submit a report to Congress on the results of the study.</text>
					</subsection></section><section id="HDA4547265B9D4D5FADFF93F4397EF40D"><enum>117.</enum><header>Nuclear physics</header>
					<subsection id="H23DACE69B64C497B9C113C97CF8F65E6"><enum>(a)</enum><header>Program</header><text>The Director shall carry out a program of experimental and theoretical research, and support
			 associated facilities, to discover, explore, and understand all forms of
			 nuclear matter.</text>
					</subsection><subsection id="HA3DC4F5555DC40D78E4A1F18C7A2E9DC"><enum>(b)</enum><header>Isotope development and production for research applications</header><text>The Director shall carry out a program for the production of isotopes, including the development of
			 techniques to produce isotopes, that the Secretary determines are needed
			 for research, medical, industrial, or other purposes. In making this
			 determination, the Secretary shall—</text>
						<paragraph id="HC6D0DDE7BCBF4DAA836954FAB3A7EF4F"><enum>(1)</enum><text>ensure that, as has been the policy of the United States since the publication in 1965 of Federal
			 Register notice 30 Fed. Reg. 3247, isotope production activities do not
			 compete with private industry unless critical national interests
			 necessitate the Federal Government’s involvement;</text>
						</paragraph><paragraph id="H141B943508A74D978C96ED0127FDAB33"><enum>(2)</enum><text display-inline="yes-display-inline">ensure that activities undertaken pursuant to this section, to the extent practicable, promote the
			 growth of a robust domestic isotope production industry; and</text>
						</paragraph><paragraph id="H5AE16B800ACF4BE0AA0A81DA92075DAF"><enum>(3)</enum><text>consider any relevant recommendations made by Federal advisory committees, the National Academies,
			 and interagency working groups in which the Department participates.</text>
						</paragraph></subsection></section><section id="HA50C13A85BF24D7A9BB0A673A700A387"><enum>118.</enum><header>Science laboratories infrastructure program</header>
					<subsection id="HDF869BC81C6249B4AF15D24693E1EA4C"><enum>(a)</enum><header>Program</header><text>The Director shall carry out a program to improve the safety, efficiency, and mission readiness of
			 infrastructure at Office of Science laboratories. The program shall
			 include projects to—</text>
						<paragraph id="H599777E0C1754D22942F5B1FCB3C14C9"><enum>(1)</enum><text>renovate or replace space that does not meet research needs;</text>
						</paragraph><paragraph id="HE459B6B43A4E43DD9384E0A78CD63CB1"><enum>(2)</enum><text>replace facilities that are no longer cost effective to renovate or operate;</text>
						</paragraph><paragraph id="HA5C15FAD60F8413D81A2E1B3C85BDA45"><enum>(3)</enum><text>modernize utility systems to prevent failures and ensure efficiency;</text>
						</paragraph><paragraph id="H1562F65EFC424B7DA1FB66CFF576C91A"><enum>(4)</enum><text>remove excess facilities to allow safe and efficient operations; and</text>
						</paragraph><paragraph id="H08D49502DA07488BBEC32F81F454460B"><enum>(5)</enum><text>construct modern facilities to conduct advanced research in controlled environmental conditions.</text>
						</paragraph></subsection><subsection id="H68CD5114CD9E492E98577F088A0299E8"><enum>(b)</enum><header>Approach</header><text>In carrying out this section, the Director shall utilize all available approaches and mechanisms,
			 including capital line items, minor construction projects, energy savings
			 performance contracts, utility energy service contracts, alternative
			 financing, and expense funding, as appropriate.</text>
					</subsection></section><section id="HDAF6D3C7697A4C26A305A159D51F6FE2"><enum>119.</enum><header>Authorization of appropriations</header>
					<subsection id="H2FEC33D45A2B4858AD7B092DC58B112C"><enum>(a)</enum><header>Fiscal year 2014</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Secretary for the Office of Science for fiscal year
			 2014 $5,071,000,000, of which—</text>

				<section id="H0123763DFBEA431888373F73DD2CC338"><enum>121.</enum><header>Transparency</header>
					<subsection id="H2DDC2E84543548D3AD1FDE6EDA47B6DB"><enum>(a)</enum><header>Cost Share</header><text>The Secretary shall make public all cost-share waivers granted under section 988(b)(3) or (c)(2) of
			 the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16352">42 U.S.C. 16352(b)(3)</external-xref> or (c)(2)) not later
			 than 30 days after the waiver is issued. The information shall include—</text>
						<paragraph id="HE31869DBB9034CF9955DC1ADD49C6DFD"><enum>(1)</enum><text>the name of the entity receiving the waiver;</text>
						</paragraph><paragraph id="H01445A68F5164B409375FA6AE18F7F54"><enum>(2)</enum><text>a justification for the reduction or elimination;</text>
						</paragraph><paragraph id="H86C47F83431B4F059D61C16838FAAE38"><enum>(3)</enum><text>the final cost share percentage;</text>
						</paragraph><paragraph id="HBFBA69EE27744AD9A3004305E42CB2AA"><enum>(4)</enum><text>the amount of total cost share;</text>
						</paragraph><paragraph id="HD0C2481F9B6F45C9B7A5BCDEB5B61DC5"><enum>(5)</enum><text>the date when the waiver is granted; and</text>

						</paragraph></subsection><subsection id="HAAAF3E57EC184CCBB62135839E5B56BB"><enum>(b)</enum><header>Technology transfer agreements</header><text>The Secretary shall make public, not later than 30 days after a National Laboratory enters into a
			 technology transfer agreement with a nongovernment entity, basic,
			 nonproprietary information related to such technology transfer agreement,
			 including—</text>
						<paragraph id="H3FB8F7372C63439E8DBD9DC7EA81D373"><enum>(1)</enum><text>Cooperative Research and Development Agreements;</text>
						</paragraph><paragraph id="HB19B6EA2B96340CBABB675AE1BEBCCF1"><enum>(2)</enum><text>non-Federal Work for Others Agreements; and</text>
						</paragraph><paragraph id="H500DF7C7381A4C82BF64CD2C76623BCE"><enum>(3)</enum><text>Agreements for Commercializing Technology under the pilot program described in section 127.</text>
						</paragraph></subsection><subsection id="H1323F135596A404A9D458B1DF8647A06"><enum>(c)</enum><header>Financial awards</header><text>The Secretary shall make public all grants, agreements, and other financial support for all
			 research, development, demonstration, and commercial application
			 activities within 30 days of an agreement. The information shall include—</text>
						<paragraph id="H70824B1361F74DE2A814296894F22318"><enum>(1)</enum><text>the name of the project recipient, including all project partners;</text>
						</paragraph><paragraph id="H245A56BF276D4B8B849F60594CBAAAEB"><enum>(2)</enum><text>the amount of the award;</text>
						</paragraph><paragraph id="H505D07044751492B9F28AD9442E458BE"><enum>(3)</enum><text>a project description; and</text>
						</paragraph><paragraph id="H5103B0E111274250888499C4C4DF91A2"><enum>(4)</enum><text>the expected timeframe of completion.</text>
						</paragraph></subsection><subsection id="HD87E9764873E4025960FE508FA1B2D27"><enum>(d)</enum><header>Exemption</header><text>This section shall not require the disclosure of information protected from disclosure under
			 <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552(b)</external-xref> of title 5, United States Code.</text>
					</subsection></section><section id="H2FC35C8525DB4FAF8E161B843DEBFE7F"><enum>122.</enum><header>National Energy Technology Laboratory</header>
					<subsection id="H6940F27C9CBC4AA2A8D0670977F7B4D8"><enum>(a)</enum><header>Finding</header><text display-inline="yes-display-inline">Congress finds that the Department of Energy owns 17 National Laboratories, 16 of which are
			 contractor-operated. The National Energy Technology Laboratory is the
			 exclusive Government-operated laboratory.</text>
					</subsection><subsection id="H231409579871462D98F7963C6EB52B6A"><enum>(b)</enum><header>Assessment</header><text>Not later than 60 days after the date of enactment of this Act, the Under Secretary shall enter
			 into an arrangement with the National Academy of Public Administration to
			 conduct an assessment of the management and operations of the National
			 Energy Technology Laboratory.</text>
					</subsection><subsection id="HBAEF4C817D97483DB130F2795C54E622"><enum>(c)</enum><header>Elements of assessment</header><text>The assessment performed under subsection (b) shall—</text>
						<paragraph id="HB511F156AB134B1CB94C1851BF7126C8"><enum>(1)</enum><text display-inline="yes-display-inline">compare laboratory management as a government-owned, government-operated model compared to a
			 government-owned, contractor-operated model;</text>
						</paragraph><paragraph id="H6F1E32520F644557AA94D6B8447A193A"><enum>(2)</enum><text>provide a cost-benefit analysis to support the comparison under paragraph (1); and</text>
						</paragraph><paragraph id="H921EF987B464401CB5B20E94AA6435B6"><enum>(3)</enum><text>identify a strategy for transitioning the laboratory to a government-owned, contractor-operated
			 model.</text>
						</paragraph></subsection><subsection id="HADB67B695EB7404A9063EDEB809BDA37"><enum>(d)</enum><header>Secretary’s Response</header><text display-inline="yes-display-inline">Not later than 90 days after the completion of the assessment performed under subsection (b), the
			 Secretary shall deliver to the Committee on Science, Space, and Technology
			 of the House of Representatives and the Committee on Energy and Natural
			 Resources of the Senate a response to the findings and recommendations of
			 the National Academy of Public Administration.</text>
					</subsection></section><section id="HBC0AFF6ABDA44871843EDB2C9E279057"><enum>123.</enum><header>Savings clause</header><text display-inline="no-display-inline">Nothing in this subtitle or an amendment made by this subtitle abrogates or otherwise affects the
			 primary responsibilities of any National Laboratory to the Department.</text>
				</section><section id="HC2F0CD3D279241AEB53CFC6884C5CB75"><enum>124.</enum><header>Under Secretary for Science and Energy</header>
					<subsection id="H7B55D365EDF64FFFA9104CA56D3E3770"><enum>(a)</enum><header>In general</header><text>Section 202(b) of the Department of Energy Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7132">42 U.S.C. 7132(b)</external-xref>) is amended—</text>
						<paragraph id="H61606BB441E3472398FE01D5AB9FE253"><enum>(1)</enum><text>by striking <quote>Under Secretary for Science</quote> each place it appears and inserting <quote>Under Secretary for Science and Energy</quote>; and</text>
						</paragraph><paragraph id="H40411C9FF1004436A2CC4EAD98EBEB33"><enum>(2)</enum><text>in paragraph (4)—</text>
							<subparagraph id="HD754C1875926486794C1DCFD5FC4E8ED"><enum>(A)</enum><text>in subparagraph (F), by striking <quote>and</quote> at the end;</text>
							</subparagraph><subparagraph id="H423CC548B9A34F6795AB455FD27FF96D"><enum>(B)</enum><text>in subparagraph (G), by striking the period at the end and inserting a semicolon; and</text>
							</subparagraph><subparagraph id="HB5F41153CF9F46FFBE1FD1C215910C71"><enum>(C)</enum><text>by inserting after subparagraph (G) the following:</text>

									</subparagraph><subparagraph id="HB2E753E3C95046B8B3FCC49436706353"><enum>(I)</enum><text>perform such functions and duties as the Secretary shall prescribe, consistent with this section.</text></subparagraph><after-quoted-block>. </after-quoted-block></quoted-block>
							</subparagraph></paragraph></subsection><subsection id="H6F72E4F943654B2AB354E359A611DB13"><enum>(b)</enum><header>Conforming amendments</header>
						<paragraph id="HD1E11F59E3A34399BE8FE251F66D615F"><enum>(1)</enum><text>Section 3164(b)(1) of the Department of Energy Science Education Enhancement Act (42 U.S.C.
			 7381a(b)(1)) is amended by striking <quote>Under Secretary for Science</quote> and inserting <quote>Under Secretary for Science and Energy</quote>.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4288697EDFC4483DB65BC48BB56BD38E"><enum>(2)</enum><text>Section 641(h)(2) of the United States Energy Storage Competitiveness Act of 2007 (42 U.S.C.
			 17231(h)(2)) is amended by striking <quote>Under Secretary for Science</quote> and inserting <quote>Under Secretary for Science and Energy</quote>.</text>
						</paragraph></subsection></section><section id="H3DB24ACD510749F380215E426D8E547B"><enum>125.</enum><header>National Laboratories operations and performance management</header>
					<subsection id="H8E24991D722043C9BC07AD2BE5FC9BF0"><enum>(a)</enum><header>In general</header><text>The Secretary shall ensure that the following duties and responsibilities are carried out through
			 one or more appropriate statutory or administrative entities:</text>
						<paragraph id="HEA5785C55E9543BF99E53486E4E8CF98"><enum>(1)</enum><text>Evaluation, coordination, and promotion of transfer of National Laboratory research and development
			 results to the market in collaboration with the Technology Transfer
			 Coordinator.</text>
						</paragraph><paragraph id="HF7042713CEDA418AAE75FF7871CECDF5"><enum>(2)</enum><text>Submission to the Secretary of reports describing recommendations for best practices for the
			 National Laboratories including, with respect to management and operations
			 procedures, conflict of interest regulations, engagement with the private
			 sector, and technology transfer methodologies.</text>
						</paragraph><paragraph id="HFB8A99B600CB45DFB7F543A95A1C71D9"><enum>(3)</enum><text>Implementation of other duties, as the Secretary determines appropriate, to improve the operations
			 and performance of the National Laboratories.</text>
						</paragraph></subsection><subsection id="H197D96C38527475C8D4DDCCA9C4C9F06"><enum>(b)</enum><header>Reporting</header><text>The Secretary, in consultation with the appropriate committees of Congress, shall provide an annual
			 update on progress made in carrying out subsection (a), including the
			 improvement of National Laboratory operations and performance and
			 strategic departmental and National Laboratory coordination.</text>
					</subsection></section><section id="H8A8480514DEF4E7C965ABDAE709895DE"><enum>126.</enum><header>Sense of Congress on an integrated strategy for National Laboratories in the 21st century</header><text display-inline="no-display-inline">It is the sense of Congress that—</text>
					<paragraph id="HF3FC664891D9420F823BCDB4F231B854"><enum>(1)</enum><text display-inline="yes-display-inline">the establishment of the independent Commission to Review the Effectiveness of the National Energy
			 Laboratories under section 319 of title III of division D of the
			 Consolidated Appropriations Act, 2014, is an important step towards
			 developing a coordinated strategy for the National Laboratories in the
			 21st century; and</text>
					</paragraph><paragraph id="H3136304A6D8143C2950E411A11B586C0"><enum>(2)</enum><text display-inline="yes-display-inline">Congress looks forward to—</text>
						<subparagraph id="HBF9AC82A30754405BE8989D0973ABD65"><enum>(A)</enum><text display-inline="yes-display-inline">receiving the findings and conclusions of the Commission; and</text>
						</subparagraph><subparagraph id="HF09B940D2B0B418696E988DD85964266"><enum>(B)</enum><text display-inline="yes-display-inline">engaging with the Administration—</text>
							<clause id="H92C05E25729F4C65AD2EF0008D50B094"><enum>(i)</enum><text display-inline="yes-display-inline">in strengthening the mission of the National Laboratories; and</text>
							</clause><clause id="HBD53AADF798044ACB3B5431E2A25F07B"><enum>(ii)</enum><text display-inline="yes-display-inline">to reform and modernize the operations and management of the National Laboratories.</text>
							</clause></subparagraph></paragraph></section><section id="HE7A4E1A53E1D4E1EA576B33E490305A8"><enum>127.</enum><header>Agreements for Commercializing Technology pilot program</header>
					<subsection id="HE11259E8813E4405AA16812B28FB639B"><enum>(a)</enum><header>In general</header><text>The Secretary shall carry out the Agreements for Commercializing Technology pilot program of the
			 Department, as announced by the Secretary on December 8, 2011, in
			 accordance with this section.</text>
					</subsection><subsection commented="no" id="HF4463FF03B1C4736AFAF3CC28F06C875"><enum>(b)</enum><header>Terms</header><text>Each agreement entered into pursuant to the pilot program referred to in subsection (a) shall
			 provide to the contractor of the applicable National Laboratory, to the
			 maximum extent determined to be appropriate by the Secretary, increased
			 authority to negotiate contract terms, such as intellectual property
			 rights, indemnification, payment structures, performance guarantees, and
			 multiparty collaborations.</text>
					</subsection><subsection id="H229AD9A3C8F54BF28FB5E385349D4EC9"><enum>(c)</enum><header>Eligibility</header>
						<paragraph id="H5A7C865E242E4536B3A22610EBE47064"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law (including regulations), any National Laboratory may
			 enter into an agreement pursuant to the pilot program referred to in
			 subsection (a).</text>
						</paragraph><paragraph id="H24005CF7BFAA4135AE98EB3247263EBB"><enum>(2)</enum><header>Agreements with non-Federal entities</header><text>To carry out paragraph (1) and subject to paragraph (3), the Secretary shall permit the directors
			 of the National Laboratories to execute agreements with non-Federal
			 entities, including non-Federal entities already receiving Federal funding
			 that will be used to support activities under agreements executed pursuant
			 to paragraph (1).</text>
						</paragraph><paragraph id="H64063B7F77E74598B8C523B1A43D9351"><enum>(3)</enum><header>Restriction</header><text>The requirements of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/35/18">chapter 18</external-xref> of title 35, United States Code (commonly known as the <quote>Bayh-Dole Act</quote>) shall apply if—</text>
							<subparagraph id="HC9F1D7746D4C4B288251A6C1EBE6B6F5"><enum>(A)</enum><text>the agreement is a funding agreement (as that term is defined in section 201 of that title); and</text>
							</subparagraph><subparagraph id="HDB2AB30A60CB4AF6B509A691B08CC055"><enum>(B)</enum><text>at least 1 of the parties to the funding agreement is eligible to receive rights under that
			 chapter.</text>
							</subparagraph></paragraph></subsection><subsection id="H4143AF79448543339A330E451B087E68"><enum>(d)</enum><header>Submission to Secretary</header><text>Each affected director of a National Laboratory shall submit to the Secretary, with respect to each
			 agreement entered into under this section—</text>
						<paragraph id="H41E815C2364540F4A92B15C8EE564ED6"><enum>(1)</enum><text>a summary of information relating to the relevant project;</text>
						</paragraph><paragraph id="H01C901DB806441A9A3B8B05270A2828F"><enum>(2)</enum><text>the total estimated costs of the project;</text>
						</paragraph><paragraph id="H99705076FE0A43DCADAFC2FB1A86EDAC"><enum>(3)</enum><text>estimated commencement and completion dates of the project; and</text>
						</paragraph><paragraph id="H5A867D80837D446D8F8A6DA1BFB7E9F6"><enum>(4)</enum><text>other documentation determined to be appropriate by the Secretary.</text>
						</paragraph></subsection><subsection id="H7F02268C27BE49528DE53F89A9EE1822"><enum>(e)</enum><header>Certification</header><text>The Secretary shall require the contractor of the affected National Laboratory to certify that each
			 activity carried out under a project for which an agreement is entered
			 into under this section—</text>
						<paragraph id="HD001480EEAD34CA5B921AEC42DD4A89E"><enum>(1)</enum><text>is not in direct competition with the private sector; and</text>
						</paragraph><paragraph id="HF7DA4F0061D642858EA230223254A9D3"><enum>(2)</enum><text>does not present, or minimizes, any apparent conflict of interest, and avoids or neutralizes any
			 actual conflict of interest, as a result of the agreement under this
			 section.</text>
						</paragraph></subsection><subsection id="HB66564F575E8480894750B0F4A7B3A7A"><enum>(f)</enum><header>Extension</header><text>The pilot program referred to in subsection (a) shall be extended for a term of 2 years after the
			 date of enactment of this Act.</text>
					</subsection><subsection id="H4762A34CC1BF4E428C1769BAB1B61088"><enum>(g)</enum><header>Report</header><text>Not later than 60 days after the date described in subsection (f), the Secretary, in coordination
			 with directors of the National Laboratories, shall submit to the Committee
			 on Science, Space, and Technology of the House of Representatives and the
			 Committee on Energy and Natural Resources of the Senate a report that—</text>
						<paragraph id="HE9F3769B74514BEF895AC61C2E723620"><enum>(1)</enum><text>assesses the overall effectiveness of the pilot program referred to in subsection (a);</text>
						</paragraph><paragraph id="H8EFB79C7E8E04E0BA37DBA7819F4F1AA"><enum>(2)</enum><text>identifies opportunities to improve the effectiveness of the pilot program;</text>
						</paragraph><paragraph id="H88E6047B93A4434D8FA2F561F230FD9F"><enum>(3)</enum><text>assesses the potential for program activities to interfere with the responsibilities of the
			 National Laboratories to the Department; and</text>
						</paragraph><paragraph id="HCD59FC999B1D44C8805FD407D4086748"><enum>(4)</enum><text>provides a recommendation regarding the future of the pilot program.</text>
						</paragraph></subsection></section><section id="H1E3EAEDF24714B2DA68C0DF642A001C3"><enum>128.</enum><header>Technology transfer</header>
					<subsection id="H6FC5D695F1D74CF587220FA48C8896F4"><enum>(a)</enum><header>In general</header><text>Subject to subsections (b) and (c), the Secretary shall delegate to directors of the National
			 Laboratories signature authority with respect to any agreement described
			 in subsection (b) the total cost of which (including the National
			 Laboratory contributions and project recipient cost share) is less than
			 $500,000.</text>
					</subsection><subsection id="H0BAEE7EA473D48C8881A5EDB1CD718E6"><enum>(b)</enum><header>Agreements</header><text>Subsection (a) applies to—</text>
						<paragraph id="HC8B1CB3BDB7D43D58E0762014A564A89"><enum>(1)</enum><text>a cooperative research and development agreement;</text>
						</paragraph><paragraph id="H496CB99A75184C7DB59D875F6D5A46DB"><enum>(2)</enum><text>a non-Federal work-for-others agreement; and</text>
						</paragraph><paragraph id="H42C967BE01504A2A889A6C781CBDB833"><enum>(3)</enum><text display-inline="yes-display-inline">Agreements for Commercializing Technology entered into under the pilot program described in section
			 127.</text>
						</paragraph></subsection><subsection id="H92FD6BF48766452CBAA529BB5D3C7494"><enum>(c)</enum><header>Administration</header>
						<paragraph commented="no" id="H87A3C32C2C9E408C9F7AA99B5331B934"><enum>(1)</enum><header>Accountability</header><text>The director of the affected National Laboratory and the affected contractor shall carry out an
			 agreement under this section in accordance with applicable policies of the
			 Department, including by ensuring that the agreement does not compromise
			 any national security, economic, or environmental interest of the United
			 States.</text>
						</paragraph><paragraph commented="no" id="H748A2744EA114A98B32F7ED6CC8EC836"><enum>(2)</enum><header>Certification</header><text>The director of the affected National Laboratory and the affected contractor shall certify that
			 each activity carried out under a project for which an agreement is
			 entered into under this section does not present, or minimizes, any
			 apparent conflict of interest, and avoids or neutralizes any actual
			 conflict of interest, as a result of the agreement under this section.</text>
						</paragraph><paragraph id="HAACE5D70EBF641838A42B542EF63DB9A"><enum>(3)</enum><header>Availability of records</header><text>On entering an agreement under this section, the director of a National Laboratory shall submit to
			 the Secretary for monitoring and review all records of the National
			 Laboratory relating to the agreement.</text>
						</paragraph><paragraph id="H3868B0F34BEF4A68AB83A79A484ABCD2"><enum>(4)</enum><header>Rates</header><text>The director of a National Laboratory may charge higher rates for services performed under a
			 partnership agreement entered into pursuant to this section, regardless of
			 the full cost of recovery.</text>
						</paragraph></subsection><subsection id="HECDC2445FC424DFA9B41AB1C395C1D91"><enum>(d)</enum><header>Conforming amendment</header><text>Section 12 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3710a">15 U.S.C. 3710a</external-xref>) is amended—</text>
						<paragraph id="H0BE6B44FC1ED43AFB20A250CAB703F63"><enum>(1)</enum><text>in subsection (a)—</text>
							<subparagraph id="HEC3639BA93FF43BCB1E31FE487CA941D"><enum>(A)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and indenting
			 the subparagraphs appropriately;</text>
							</subparagraph><subparagraph id="H3EDB7B49E7D341E5A9DA0B6213FD35D7"><enum>(B)</enum><text>by striking <quote>Each Federal agency</quote> and inserting the following:</text>

									<paragraph id="H3C14E0E9572C4FF9AF5B5DB87E20EB88"><enum>(2)</enum><header>Exception</header><text>Notwithstanding paragraph (1), in accordance with section 128(a) of the <short-title>Enabling Innovation for Science, Technology, and Energy in America Act of 2014</short-title>, approval by the Secretary of Energy shall not be required for any technology transfer agreement
			 proposed to be entered into by a National Laboratory of the Department of
			 Energy, the total cost of which (including the National Laboratory
			 contributions and project recipient cost share) is less than $500,000.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
							</subparagraph></paragraph><paragraph id="HB4AB5DD3D3804CBCBD4DD897C0818A4D"><enum>(2)</enum><text>in subsection (b), by striking <quote>subsection (a)(1)</quote> each place it appears and inserting <quote>subsection (a)(1)(A)</quote>.</text>
						</paragraph></subsection></section><section id="HBC57660DB99246268C5DE7DC2E2641F4"><enum>129.</enum><header>Inclusion of early-stage technology demonstration in authorized technology transfer activities</header><text display-inline="no-display-inline">Section 1001 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16391">42 U.S.C. 16391</external-xref>) is amended by—</text>
					<paragraph id="HA2ED740662FB4207B551124CC94475AA"><enum>(1)</enum><text>redesignating subsection (g) as subsection (h); and</text>
					</paragraph><paragraph id="H0FAA7BFCD79D4D13BCB9701A0548ED29"><enum>(2)</enum><text>inserting after subsection (f) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H39E8852A51704C2AA61FEFF5AF84BA6C" style="OLC">
							<subsection id="H6E85067F1A0244E097EE2C07E488FC8A"><enum>(g)</enum><header>Early-Stage technology demonstration</header><text display-inline="yes-display-inline">The Secretary shall permit the directors of the National Laboratories to use funds allocated for
			 technology transfer within the Department to carry out early-stage and
			 pre-commercial technology demonstration activities to remove technology
			 barriers that limit private sector interest and demonstrate potential
			 commercial applications of any research and technologies arising from
			 National Laboratory activities intended to meet the Federal Government’s
			 research needs.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section id="HE2636A41166F4184BABBBD19189F8D82"><enum>130.</enum><header>Funding competitiveness for institutions of higher education and other nonprofit institutions</header><text display-inline="no-display-inline">Section 988(b) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16352">42 U.S.C. 16352(b)</external-xref>) is amended—</text>
					<paragraph id="HCDD26EC2C11C4CA09F6CE64CE630EF13"><enum>(1)</enum><text>in paragraph (1), by striking <quote>Except as provided in paragraphs (2) and (3)</quote> and inserting <quote>Except as provided in paragraphs (2), (3), and (4)</quote>; and</text>
					</paragraph><paragraph id="HBE61C58F090645BBA1685BCB8693A3C6"><enum>(2)</enum><text>by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H57B1612584CF45A18F93ECD7780B2FD8" style="OLC">

			 enactment of this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section id="HC447494450BE491294B07E144B47E8B6"><enum>131.</enum><header>Report by Government Accountability Office</header><text display-inline="no-display-inline">Not later than 3 years after the date of enactment of this Act, the Comptroller General of the
			 United States shall submit to Congress a report describing the results of
			 the projects developed under sections 127, 128, and 129, and the
			 amendments made thereby, including information regarding—</text>
					<paragraph id="H31947C60939E423F9AF4BC7CB7D05704"><enum>(1)</enum><text>partnerships initiated as a result of those projects and the potential linkages presented by those
			 partnerships with respect to national priorities and other taxpayer-funded
			 research; and</text>
					</paragraph><paragraph id="HE1A4049BE25E40A6AF1D89CE6802481B"><enum>(2)</enum><text>whether the activities carried out under those projects result in—</text>
						<subparagraph id="H1AA039A88B5F4C22B5A33F0B27183A27"><enum>(A)</enum><text>fiscal savings;</text>
						</subparagraph><subparagraph id="H186BB6343ED442578F691912FC1ACB44"><enum>(B)</enum><text>expansion of National Laboratory capabilities;</text>
						</subparagraph><subparagraph id="H0E309522B991444EA48CF11002E08E5A"><enum>(C)</enum><text>increased efficiency of technology transfers; or</text>
						</subparagraph><subparagraph id="HAACF7F9E0F6F4BA989C315F76A2FF6D6"><enum>(D)</enum><text>an increase in general efficiency of the National Laboratory system.</text>

					<subsection id="HF84E893808FC4DE58884DAF1B31605B4"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text>
						<paragraph id="H6B56C7AE25CC440D902E567C486D7DFD"><enum>(1)</enum><text>The President believes that the United States energy policy must have <quote>an all-of-the-above strategy for the 21st century that develops every source of American-made
			 energy</quote>.</text>
						</paragraph><paragraph id="H8616113039214F9F8CFD41716454CFEC"><enum>(2)</enum><text>The Department plays a strategic role in critical energy research and development to ensure a
			 balanced, prosperous, and secure energy future.</text>
						</paragraph></subsection><subsection id="HE3B706352A684D33A75B0D3B94B641A9"><enum>(b)</enum><header>Addressing our Nation’s energy future issues</header><text>The Secretary shall, through the Under Secretary for Science and Energy, utilize the capabilities
			 of the Department to address issues facing our Nation’s energy future,
			 including identifying strategic opportunities for collaborative research,
			 development, demonstration, and commercial application of innovative
			 science and technologies for—</text>
						<paragraph id="H1ADD38AB698E4140AA1816CEBC0B6A71"><enum>(1)</enum><text>advancing the state of the energy-water-land use nexus;</text>
						</paragraph><paragraph id="H0F0ACB00A0A044FCAF641C5546D9F146"><enum>(2)</enum><text>improving energy transmission and distribution systems security and resiliency;</text>
						</paragraph><paragraph id="HB9069F6A1EC64ED8BB9BFFD6E0AAA924"><enum>(3)</enum><text>utilizing supercritical carbon dioxide in electric power generation;</text>
						</paragraph><paragraph id="H07CDCF9C609B418E9657582BF37F808C"><enum>(4)</enum><text>subsurface engineering;</text>
						</paragraph><paragraph id="H76906E55FCDE48D59DC1AFB6A6C88F0E"><enum>(5)</enum><text>exascale computing; and</text>
						</paragraph><paragraph id="H8D2229DF3FDE45858255F677CBA1FA20"><enum>(6)</enum><text>critical challenges identified through comprehensive energy studies, evaluations, and reviews.</text>
						</paragraph></subsection><subsection id="H5A05174C377143C094DC188A777D537E"><enum>(c)</enum><header>Crosscutting approaches</header><text>To the maximum extent practicable, the Secretary shall seek to leverage existing programs, and
			 consolidate and coordinate activities, throughout the Department to
			 promote collaboration and crosscutting approaches within programs.</text>
					</subsection><subsection id="HC8089BEFFDA849F0BF38AF3F0EB064FB"><enum>(d)</enum><header>Additional actions</header><text>The Secretary shall—</text>
						<paragraph id="HFDFE1E39943F4C108DFD2FAD29AE8D33"><enum>(1)</enum><text display-inline="yes-display-inline">prioritize activities that promote the utilization of all affordable domestic resources;</text>
						</paragraph><paragraph id="HEA26D1863FDE4975ADE8929E7A7EE8F4"><enum>(2)</enum><text>identify opportunities for public-private partnerships, innovative financing mechanisms, and grant
			 challenges;</text>
						</paragraph><paragraph id="H9616C8FAED0D4083BE977460699FC3E9"><enum>(3)</enum><text>develop a rigorous and realistic planning, evaluation, and technical assessment framework for
			 setting objective, long-term strategic goals and evaluating progress that
			 ensures the integrity and independence to insulate planning from political
			 influence and the agility and flexibility to adapt to market dynamics;</text>
						</paragraph><paragraph id="HDD325B4F51FF4B4FA8A66FA5E6B5D537"><enum>(4)</enum><text>ensure that activities shall be undertaken in a manner that does not duplicate other activities
			 within the Department or other Federal Government activities; and</text>
						</paragraph><paragraph id="HF99D11A835684A798DE736E1B17B1901"><enum>(5)</enum><text display-inline="yes-display-inline">identify programs that may be more effectively left to the States, industry, nongovernmental
			 organizations, institutions of higher education, or other stakeholders.</text>
						</paragraph></subsection></section><section id="H80F14DC46AFB443B925E2534543170CB" section-type="subsequent-section"><enum>212.</enum><header>Strategic research portfolio analysis and coordination plan</header><text display-inline="no-display-inline">Section 994 of Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16358">42 U.S.C. 16358</external-xref>) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HDFD18201520147029CAFC56D409C6212" style="OLC">
						<section id="H747F83F4FED54EE9A19CE6F914BD6E95"><enum>994.</enum><header>Strategic research portfolio analysis and coordination plan</header>
							<subsection id="H6D12503CFFEA4368B09F159C306CB63F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall periodically review all of the science and technology activities of the
			 Department in a strategic framework that takes into account the frontiers
			 of science to which the Department can contribute, the national needs
			 relevant to the Department's statutory missions, and global energy
			 dynamics.</text>
							</subsection><subsection id="HEB27C2D8B21A462F9F9E92557692362D"><enum>(b)</enum><header>Coordination analysis and plan</header><text display-inline="yes-display-inline">As part of the review under subsection (a), the Secretary shall develop a coordination plan to
			 improve coordination and collaboration in research, development,
			 demonstration, and commercial application activities across Department
			 organizational boundaries.</text>
							</subsection><subsection id="H02432C8FFAAF401FB0E4A97DE72F71A0"><enum>(c)</enum><header>Plan contents</header><text display-inline="yes-display-inline">The plan shall describe—</text>
								<paragraph id="HB8207C1E06E340BEBA8A986ACAB4FB51"><enum>(1)</enum><text>cross-cutting scientific and technical issues and research questions that span more than one
			 program or major office of the Department;</text>
								</paragraph><paragraph id="H9E3B927801DD49A3A8E85E85FDCF14C2"><enum>(2)</enum><text>how the applied technology programs of the Department are coordinating their activities, and
			 addressing those questions;</text>
								</paragraph><paragraph id="H7B120F763EAA42DEB26DD23D7D1C484C"><enum>(3)</enum><text>ways in which the technical interchange within the Department, particularly between the Office of
			 Science and the applied technology programs, can be enhanced, including
			 ways in which the research agendas of the Office of Science and the
			 applied programs can interact and assist each other;</text>
								</paragraph><paragraph id="H2FE90FD159E3495AB19E6E8846C9F676"><enum>(4)</enum><text>a description of how the Secretary will ensure that the Department’s overall research agenda
			 include, in addition to fundamental, curiosity-driven research,
			 fundamental research related to topics of concern to the applied programs,
			 and applications in Departmental technology programs of research results
			 generated by fundamental, curiosity-driven research;</text>
								</paragraph><paragraph id="H5717FEA7C28E413280944DA4E300C376"><enum>(5)</enum><text display-inline="yes-display-inline">critical assessments of any ongoing programs that have experienced sub-par performance or cost
			 over-runs of 10 percent or more over one or more years; and</text>
								</paragraph><paragraph id="H7A66C9E7DDD34C15B5EF419B06D87340"><enum>(6)</enum><text display-inline="yes-display-inline">activities that may be more effectively left to the States, industry, nongovernmental
			 organizations, institutions of higher education, or other stakeholders.</text>
								</paragraph></subsection><subsection id="HD5A3CDEBD1624DC6A0DF06E50A782FBB"><enum>(d)</enum><header>Plan transmittal</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>ONE Future Act</short-title>, and every 4 years thereafter, the Secretary shall transmit to the Committee on Science, Space,
			 and Technology of the House of Representatives and the Committee on Energy
			 and Natural Resources of the Senate the results of the review under
			 subsection (a) and the coordination plan under subsection (b).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			 The programs shall address advanced energy technologies and systems and
			 advanced grid security, resiliency, and reliability technologies.</text>

			 demonstration, and commercial application, including activities described
			 in this subtitle. Such programs shall take into consideration the
			 following objectives:</text>
								<paragraph id="HDFAE5731D6CF4D9C99FCB842652CA9C7"><enum>(1)</enum><text>Enhancing nuclear power's viability as part of the United States energy portfolio.</text>
								</paragraph><paragraph commented="no" id="HFC03C562E44D46E2B7AA8F26A6123F56"><enum>(2)</enum><text display-inline="yes-display-inline">Reducing used nuclear fuel and nuclear waste products generated by civilian nuclear energy.</text>
								</paragraph><paragraph id="HD590505D04DB40FA9A4C78BB34D1C85C"><enum>(3)</enum><text>Supporting technological advances in areas that industry by itself is not likely to undertake
			 because of technical and financial uncertainty.</text>
								</paragraph><paragraph id="H9B455F8E98A94CEFA620F78043E47913"><enum>(4)</enum><text>Providing the technical means to reduce the likelihood of nuclear proliferation.</text>
								</paragraph><paragraph id="H012EA52E244B419AB9BAC7CB84BB0C4B"><enum>(5)</enum><text>Maintaining a cadre of nuclear scientists and engineers.</text>
								</paragraph><paragraph id="HF6AD8B41F5254A4791D730ABEC92C2F6"><enum>(6)</enum><text>Maintaining National Laboratory and university nuclear programs, including their infrastructure.</text>
								</paragraph><paragraph id="H0A05F6BECBED4CD7B43E5AAA57109D63"><enum>(7)</enum><text>Supporting both individual researchers and multidisciplinary teams of researchers to pioneer new
			 approaches in nuclear energy, science, and technology.</text>
								</paragraph><paragraph id="H1BAB9CD9B01C4D5D9E6DBC45C52EC2B8"><enum>(8)</enum><text>Developing, planning, constructing, acquiring, and operating special equipment and facilities for
			 the use of researchers.</text>
								</paragraph><paragraph id="H0DB3E8E7AEF54176A06230B81ACC832C"><enum>(9)</enum><text>Supporting technology transfer and other appropriate activities to assist the nuclear energy
			 industry, and other users of nuclear science and engineering, including
			 activities addressing reliability, availability, productivity, component
			 aging, safety, and security of nuclear power plants.</text>
								</paragraph><paragraph id="H8B3DE2BFDCC84620A24357DAFBE42877"><enum>(10)</enum><text>Reducing the environmental impact of nuclear energy-related activities.</text>
								</paragraph><paragraph id="HAA850581B1DD492B812517E30ABE5689"><enum>(11)</enum><text display-inline="yes-display-inline">Researching and developing technologies and processes to meet Federal and State requirements and
			 standards for nuclear power systems.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph id="HFA53FDD65D8342DF84A133C4B681F474"><enum>(2)</enum><text>by striking subsections (b) through (d); and</text>
					</paragraph><paragraph id="H8575102D33E34D0382F88813E0CC75DE"><enum>(3)</enum><text>by redesignating subsection (e) as subsection (b).</text>
					</paragraph></section><section display-inline="no-display-inline" id="H43C730D41BB14C89A6A246D39128D641"><enum>222.</enum><header>Program objectives study</header><text display-inline="no-display-inline">Section 951 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16271">42 U.S.C. 16271</external-xref>) is further amended by adding at the
			 end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="HBBAB3F5D095F45A18CF94D1B02135331" style="OLC">
						<subsection id="H9E71522951D64D26A598E51CD9AC2ABD"><enum>(c)</enum><header>Program objectives study</header><text display-inline="yes-display-inline">In furtherance of the program objectives listed in subsection (a) of this section, the Government
			 Accountability Office shall, within one year after the date of enactment
			 of this subsection, transmit to the Congress a report on the results of a
			 study on the scientific and technical merit of major Federal and State
			 requirements and standards, including moratoria, that delay or impede the
			 further development and commercialization of nuclear power, and how the
			 Department can assist in overcoming such delays or impediments.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="H66007F1A11A74FC789B480F63515247B"><enum>223.</enum><header>Nuclear energy research and development programs</header><text display-inline="no-display-inline">Section 952 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16272">42 U.S.C. 16272</external-xref>) is amended by striking subsections
			 (c) through (e) and inserting the following:</text>

						<subsection id="H429D36A11E4D4F24AA6CD22FEC19726A"><enum>(c)</enum><header>Reactor concepts</header>
							<paragraph id="H2451872E092343B28EDDA0B141FBDDEB"><enum>(1)</enum><header>In general</header><text>The Secretary shall carry out a program of research, development, demonstration, and commercial
			 application to advance nuclear power systems as well as technologies to
			 sustain currently deployed systems.</text>
							</paragraph><paragraph id="H4BD118482C7E429B8CCF6C7B63FCA11D"><enum>(2)</enum><header>Designs and technologies</header><text>In conducting the program under this subsection, the Secretary shall examine advanced reactor
			 designs and nuclear technologies, including those that—</text>
								<subparagraph id="H6E242EF6AF3541F4854AAD7265423256"><enum>(A)</enum><text>are economically competitive with other electric power generation plants;</text>
								</subparagraph><subparagraph id="HBCF2750F4CAB45EDB846DDEE1B23E1F4"><enum>(B)</enum><text>have higher efficiency, lower cost, and improved safety compared to reactors in operation as of the
			 date of enactment of the <short-title>ONE Future Act</short-title>;</text>
								</subparagraph><subparagraph id="H2ACB35F3208F4D0589AAA44677D53351"><enum>(C)</enum><text display-inline="yes-display-inline">utilize passive safety features;</text>
								</subparagraph><subparagraph id="H9BEC70554B124C05BC596D001566F1B4"><enum>(D)</enum><text>minimize proliferation risks;</text>
								</subparagraph><subparagraph id="H2DF17B478CAD43958AF127A468D467D9"><enum>(E)</enum><text>substantially reduce production of high-level waste per unit of output;</text>
								</subparagraph><subparagraph id="HD52BAAB646A849AFBCAF45F4A1FF1DBC"><enum>(F)</enum><text>increase the life and sustainability of reactor systems currently deployed;</text>
								</subparagraph><subparagraph id="H75EE606DCEDC4C3EB1600DD21059C42C"><enum>(G)</enum><text>use improved instrumentation;</text>
								</subparagraph><subparagraph id="H297898C1E6474B25A6DFBB2AB139861B"><enum>(H)</enum><text>are capable of producing large-scale quantities of hydrogen or process heat;</text>
								</subparagraph><subparagraph id="H7C36C67633814126915A3E99306123EA"><enum>(I)</enum><text display-inline="yes-display-inline">minimize water usage or use alternatives to water as a cooling mechanism; or</text>
								</subparagraph><subparagraph id="HAE6AB05BD5C6487CB0039C2248C2797E"><enum>(J)</enum><text>use nuclear energy as part of an integrated energy system.</text>
								</subparagraph></paragraph><paragraph id="H77450B57EC644D3F94C758AAA226D518"><enum>(3)</enum><header>International cooperation</header><text>In carrying out the program under this subsection, the Secretary shall seek opportunities to
			 enhance the progress of the program through international cooperation
			 through such organizations as the Generation IV International Forum or any
			 other international collaboration the Secretary considers appropriate.</text>
							</paragraph><paragraph id="H32A4E4BDD56D47F9B0AC4A1C5D45057C"><enum>(4)</enum><header>Exceptions</header><text>No funds authorized to be appropriated to carry out the activities described in this subsection
			 shall be used to fund the activities authorized under sections 641 through
			 645.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="H25C54A84AB5C4786970C7A9CD71A298E"><enum>224.</enum><header>Small modular reactor program</header><text display-inline="no-display-inline">Section 952 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16272">42 U.S.C. 16272</external-xref>) is further amended by adding at the
			 end the following new subsection:</text>
					<quoted-block id="H66328FE6D67B49C7BBD1C5BAED069118" style="OLC">
						<subsection id="H321F7641A6D840BBA5F18CD92A71C1B8"><enum>(d)</enum><header>Small modular reactor program</header>
							<paragraph id="HDA15D9484DED419E929A752816E2DB77"><enum>(1)</enum><header>In general</header><text>The Secretary shall carry out a small modular reactor program to promote research, development,
			 demonstration, and commercial application of small modular reactors,
			 including through cost-shared projects for commercial application of
			 reactor systems designs.</text>
							</paragraph><paragraph id="H87CD893DA4854C44A8678F3352EF2A68"><enum>(2)</enum><header>Consultation</header><text>The Secretary shall consult with and utilize the expertise of the Secretary of the Navy in
			 establishing and carrying out such program.</text>
							</paragraph><paragraph id="H67FCB0310B13490D9F0FB4664D76A6B1"><enum>(3)</enum><header>Additional activities</header><text>Activities may also include development of advanced computer modeling and simulation tools, by
			 Federal and non-Federal entities, which demonstrate and validate new
			 design capabilities of innovative small modular reactor designs.</text>
							</paragraph><paragraph id="H21645066786145478C0094D3C9E29B8F"><enum>(4)</enum><header>Definition</header><text display-inline="yes-display-inline">For the purposes of this subsection, the term <term>small modular reactor</term> means a nuclear reactor meeting generally accepted industry standards—</text>
								<subparagraph id="H92E973DCBDC14A4CAF9679C6E46919B2"><enum>(A)</enum><text>with a rated capacity of less than 300 electrical megawatts;</text>
								</subparagraph><subparagraph id="H8D38A68496FF401F8E14905FFD6C86C0"><enum>(B)</enum><text>with respect to which most parts can be factory assembled and shipped as modules to a reactor plant
			 site for assembly; and</text>
								</subparagraph><subparagraph id="H940981377EB74FBDB99E556035B4060F"><enum>(C)</enum><text>that can be constructed and operated in combination with similar reactors at a single site.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section display-inline="no-display-inline" id="HA419B5CB4C6C40BBB7B432B4C9E20997"><enum>225.</enum><header>Conventional improvements to nuclear power plants</header><text display-inline="no-display-inline">Section 952 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16272">42 U.S.C. 16272</external-xref>) is further amended by adding at the
			 end the following new subsection:</text>

			 related to power conversion improvements to nuclear power plants to
			 promote the research, development, demonstration, and commercial
			 application of—</text>
								<subparagraph display-inline="no-display-inline" id="HA473A6170F914D6EB6087C53B490F5D0"><enum>(A)</enum><text display-inline="yes-display-inline">cooling systems;</text>
								</subparagraph><subparagraph id="HA38C455BF9374AF4B3DECE28E1E683BA"><enum>(B)</enum><text>turbine technologies;</text>
								</subparagraph><subparagraph id="H80D25C2DC2684C74A6572496BC6DE975"><enum>(C)</enum><text>heat exchangers and pump design;</text>
								</subparagraph><subparagraph id="H8F9EDE7EB6894EC2B5BD55716041CC50"><enum>(D)</enum><text>special coatings to improve lifetime of components and performance of heat exchangers; and</text>
								</subparagraph><subparagraph id="HF211EE4C543E4C7982A055E56B423309"><enum>(E)</enum><text>advanced power conversion systems for advanced reactor technologies.</text>
								</subparagraph></paragraph><paragraph id="HA59FA15C65684FEA9630D6C3A96CEBFF"><enum>(2)</enum><header>Administration</header><text>The Secretary may undertake initiatives under this subsection only when the goals are relevant and
			 proper to enhance the performance of technologies developed under
			 subsection (c). Not more than $10,000,000 of funds authorized for this
			 section may be used for carrying out this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

								<subsection id="HE5A54982D9B84F4290168E393D49F37A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall conduct a fuel cycle research, development, demonstration, and commercial
			 application program (referred to in this section as the <quote>program</quote>) on fuel cycle options that improve uranium resource utilization, maximize energy generation,
			 minimize nuclear waste creation, improve safety, mitigate risk of
			 proliferation, and improve waste management in support of a national
			 strategy for spent nuclear fuel and the reactor concepts research,
			 development, demonstration, and commercial application program under
			 section 952(c).</text>
								</subsection><subsection id="HF7E945C5B6D84E39AAC6DDDD573BB8F5"><enum>(b)</enum><header>Fuel cycle options</header><text>Under this section the Secretary may consider implementing the following initiatives:</text>
									<paragraph id="HE87AA3A5C71246C48D142F9D9F542514"><enum>(1)</enum><header>Open cycle</header><text display-inline="yes-display-inline">Developing fuels, including the use of nonuranium materials and alternate claddings, for use in
			 reactors that increase energy generation, improve safety performance and
			 margins, and minimize the amount of nuclear waste produced in an open fuel
			 cycle.</text>
									</paragraph><paragraph display-inline="no-display-inline" id="H42E71A3F901746EEA7D3285195A8A5F8"><enum>(2)</enum><header>Recycle</header><text display-inline="yes-display-inline">Developing advanced recycling technologies, including advanced reactor concepts to improve resource
			 utilization, reduce proliferation risks, and minimize radiotoxicity, decay
			 heat, and mass and volume of nuclear waste to the greatest extent
			 possible.</text>
									</paragraph><paragraph id="HAF858369B4954692972ABDABE57B4CEA"><enum>(3)</enum><header>Advanced storage methods</header><text>Developing advanced storage technologies for both onsite and long-term storage that substantially
			 prolong the effective life of current storage devices or that
			 substantially improve upon existing nuclear waste storage technologies and
			 methods, including repositories.</text>
									</paragraph><paragraph id="H6F3A12D6B1414E469CF8B0663CADADF1"><enum>(4)</enum><header>Alternative and deep borehole storage methods</header><text display-inline="yes-display-inline">Developing alternative storage methods for long-term storage, including deep boreholes into stable
			 crystalline rock formations and mined repositories in a range of geologic
			 media.</text>
									</paragraph><paragraph id="H3E69B0B891E7439384EE5EAF30FFAA90"><enum>(5)</enum><header>Fast test reactor</header><text display-inline="yes-display-inline">Investigating the potential research benefits of a fast test reactor to conduct experiments on
			 fuels and materials related to fuel forms and fuel cycles that will
			 increase fuel utilization, reduce proliferation risks, and reduce nuclear
			 waste products.</text>
									</paragraph><paragraph id="HB4E180CB86A24F4DBCBE9BEEDAF81556"><enum>(6)</enum><header>Other technologies</header><text>Developing any other technology or initiative that the Secretary determines is likely to advance
			 the objectives of the program.</text>
									</paragraph></subsection><subsection id="HF3FE559C901546029D1C82AA8395BAFE"><enum>(c)</enum><header>Additional advanced recycling and crosscutting activities</header><text display-inline="yes-display-inline">In addition to and in support of the specific initiatives described in paragraphs (1) through (6)
			 of subsection (b), the Secretary may support the following activities:</text>
									<paragraph id="H9732943DD75549119656E039DBFDDAB2"><enum>(1)</enum><text>Development and testing of integrated process flow sheets for advanced nuclear fuel recycling
			 processes.</text>
									</paragraph><paragraph id="H5026721771704AA28B9CF7E356B58588"><enum>(2)</enum><text>Research to characterize the byproducts and waste streams resulting from fuel recycling processes.</text>
									</paragraph><paragraph id="H943E321370444004BF3E17501ADE256F"><enum>(3)</enum><text>Research and development on reactor concepts or transmutation technologies that improve resource
			 utilization or reduce the radiotoxicity of waste streams.</text>
									</paragraph><paragraph id="H57CDFBA9B4A749C4ACFF5925C28C3089"><enum>(4)</enum><text>Research and development on waste treatment processes and separations technologies, advanced waste
			 forms, and quantification of proliferation risks.</text>
									</paragraph><paragraph id="H14C9EAA530624593A511B9D3ABD42CEA"><enum>(5)</enum><text>Identification and evaluation of test and experimental facilities necessary to successfully
			 implement the advanced fuel cycle initiative.</text>
									</paragraph><paragraph id="H0A750D4DB6374373984AD0754B45092A"><enum>(6)</enum><text>Advancement of fuel cycle-related modeling and simulation capabilities.</text>

			 the reactor concepts research, development, demonstration, and commercial
			 application program under section 952(c) and the fuel cycle research and
			 development program under section 953, and support crosscutting nuclear
			 energy concepts. Activities commenced under this section shall be
			 concentrated on broadly applicable research and development focus areas.</text>
								</subsection><subsection id="H59FFF3F49A3846869CD28F5FCD532339"><enum>(b)</enum><header>Activities</header><text>Activities conducted under this section may include research involving—</text>
									<paragraph id="H89CD9CE727A241869870BFD8BC8EF483"><enum>(1)</enum><text>advanced reactor materials;</text>
									</paragraph><paragraph id="H130CDF04B713421EB9B897FF32E85B2E"><enum>(2)</enum><text>advanced radiation mitigation methods;</text>
									</paragraph><paragraph id="HC57DA1B54B4043779F4C0BBC78A06248"><enum>(3)</enum><text>advanced proliferation and security risk assessment methods;</text>
									</paragraph><paragraph id="HBF6FDFDD8E8D430982190ABC23A07F99"><enum>(4)</enum><text>advanced sensors and instrumentation;</text>

			 simulation for nuclear energy systems; and</text>
									</paragraph><paragraph id="H178970A614F14EE0804B317C61BD9560"><enum>(7)</enum><text>any crosscutting technology or transformative concept aimed at establishing substantial and
			 revolutionary enhancements in the performance of future nuclear energy
			 systems that the Secretary considers relevant and appropriate to the
			 purpose of this section.</text>
									</paragraph></subsection><subsection id="H1FE70B4782B64BDE9C6B33A5D9759C53"><enum>(c)</enum><header>Report</header><text>The Secretary shall submit, as part of the annual budget submission of the Department, a report on
			 the activities of the program conducted under this section, which shall
			 include a brief evaluation of each activity’s progress.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="HB213922FDB164A8780440A91B179E9D3"><enum>(b)</enum><header>Conforming amendment</header><text>The table of contents of the Energy Policy Act of 2005 is amended by adding at the end of the items
			 for subtitle E of title IX the following new item:</text>

					</subsection></section><section id="H709B142F0262467693B4C0D4600BA814"><enum>228.</enum><header>Technical standards collaboration</header>
					<subsection id="HC564D11961AD4965B1D127399A304FAA"><enum>(a)</enum><header>In general</header><text>The Director of the National Institute of Standards and Technology shall establish a nuclear energy
			 standards committee (in this section referred to as the <quote>technical standards committee</quote>) to facilitate and support, consistent with the National Technology Transfer and Advancement Act
			 of 1995, the development or revision of technical standards for new and
			 existing nuclear power plants and advanced nuclear technologies.</text>
					</subsection><subsection id="HA96F4B99DADB40359C9407B4E241AEEC"><enum>(b)</enum><header>Membership</header>
						<paragraph id="H3F61728F0A5447C085BDEDEE0DC42570"><enum>(1)</enum><header>In general</header><text>The technical standards committee shall include representatives from appropriate Federal agencies
			 and the private sector, and be open to materially affected organizations
			 involved in the development or application of nuclear energy-related
			 standards.</text>
						</paragraph><paragraph id="H60989C85F18D4F68B3B8813FFF6FDF3C"><enum>(2)</enum><header>Co-chairs</header><text>The technical standards committee shall be co-chaired by a representative from the National
			 Institute of Standards and Technology and a representative from a private
			 sector standards organization.</text>
						</paragraph></subsection><subsection id="H486750D35C734A559BEDD030A563E507"><enum>(c)</enum><header>Duties</header><text>The technical standards committee shall, in cooperation with appropriate Federal agencies—</text>
						<paragraph id="H1A09DE470D124C3EA412C99B7AA2B96F"><enum>(1)</enum><text>perform a needs assessment to identify and evaluate the technical standards that are needed to
			 support nuclear energy, including those needed to support new and existing
			 nuclear power plants and advanced nuclear technologies;</text>
						</paragraph><paragraph id="H965B130FADBD447A96E1C27D74808373"><enum>(2)</enum><text>formulate, coordinate, and recommend priorities for the development of new technical standards and
			 the revision of existing technical standards to address the needs
			 identified under paragraph (1);</text>
						</paragraph><paragraph id="HD5C8ECBFD16E46E2BE8BBFC50C0903C3"><enum>(3)</enum><text>facilitate and support collaboration and cooperation among standards developers to address the
			 needs and priorities identified under paragraphs (1) and (2);</text>
						</paragraph><paragraph id="H90A271E176134D208C5835D9357DB6FD"><enum>(4)</enum><text>as appropriate, coordinate with other national, regional, or international efforts on nuclear
			 energy-related technical standards in order to avoid conflict and
			 duplication and to ensure global compatibility; and</text>
						</paragraph><paragraph id="H3C1879BDDDA04C9685124ACAFD55E56C"><enum>(5)</enum><text>promote the establishment and maintenance of a database of nuclear energy-related technical
			 standards.</text>
						</paragraph></subsection><subsection id="HE03CC4B2918B4B768AEEB338FD830A76"><enum>(d)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated $1,000,000 for fiscal year 2015 to the Director of the
			 National Institute of Standards and Technology for activities under this
			 section.</text>
					</subsection></section><section id="H8B99B6A68AFA406B87421990EEC5F2FD"><enum>229.</enum><header>Evaluation of long-term operating needs</header>
					<subsection id="H452AA2C1964F4B6CAE4D8D1ED17AC0E1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall enter into an arrangement with the National Academies to conduct an evaluation
			 of the scientific and technological challenges to the long-term
			 maintenance and safe operation of currently deployed nuclear power
			 reactors up to and beyond the specified design-life of reactor systems.</text>
					</subsection><subsection id="H89DB7BE9301242248E849C20D28E46DF"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall transmit to the
			 Congress, and make publically available, the results of the evaluation
			 undertaken by the Academies pursuant to subsection (a).</text>
					</subsection></section><section id="H526DD81C39E448489E792631E5E9B9E4"><enum>230.</enum><header>Available facilities database</header><text display-inline="no-display-inline">The Secretary shall prepare a database of non-Federal user facilities receiving Federal funds that
			 may be used for unclassified nuclear energy research.  The Secretary shall
			 make this database accessible on the Department’s website.</text>
				</section><section id="H7FDFC0830C804A88A46A9F73A8E7E028"><enum>231.</enum><header>Nuclear waste disposal</header><text display-inline="no-display-inline">To the extent consistent with the requirements of current law, the Department shall be responsible
			 for disposal of high-level radioactive waste or spent nuclear fuel
			 generated by reactors under the programs authorized in this subtitle, or
			 the amendments made by this subtitle.</text>
				</section></subtitle><subtitle id="H25A1C8A7E1FE4EAC9B203BC0B5497FAC"><enum>C</enum><header>Energy Efficiency and Renewable Energy Research and Development</header>
				<section id="H36EB9817C37A437DA4403F5AA0D8C274"><enum>241.</enum><header>Energy efficiency</header><text display-inline="no-display-inline">Section 911 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16191">42 U.S.C. 16191</external-xref>) is amended to read as follows:</text>

								</paragraph><paragraph id="H5DC213259D084BFCA72BCE0B40453AD5"><enum>(3)</enum><text>Improving the energy security of the United States.</text>
								</paragraph><paragraph id="HAC1DE11349BE4F6BB63FF43E71273047"><enum>(4)</enum><text>Reducing the environmental impact of energy-related activities.</text>
								</paragraph></subsection><subsection id="HF8BD4BB37C664E868D030F0CF2D1CC0F"><enum>(b)</enum><header>Programs</header><text>Programs under this subtitle shall include research, development, demonstration, and commercial
			 application of—</text>
								<paragraph id="HA31ECEA724DF4DDBAD871A43A149B695"><enum>(1)</enum><text>innovative, affordable technologies to improve the energy efficiency and environmental performance
			 of vehicles, including weight and drag reduction technologies, and
			 whole-vehicle design optimization;</text>
								</paragraph><paragraph id="H2089A6D9E272443A91B9A54168731660"><enum>(2)</enum><text>cost-effective technologies, for new construction and retrofit, to improve the energy efficiency
			 and environmental performance of buildings, using a whole-buildings
			 approach;</text>
								</paragraph><paragraph id="H455473CEA7DB491AAE9CB1821FB26791"><enum>(3)</enum><text>advanced technologies to improve the energy efficiency, environmental performance, and process
			 efficiency of energy-intensive and waste-intensive industries; and</text>
								</paragraph><paragraph id="HA31D7D796AFA4586A99627B9669BA49B"><enum>(4)</enum><text display-inline="yes-display-inline">technologies to improve the energy efficiency of appliances and mechanical systems for buildings in
			 extreme climates, including cogeneration, trigeneration, and
			 polygeneration units and increased use of renewable resources, or
			 alternative fuels.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="H77A9B136A8224FC69137A8BBABE96C80"><enum>242.</enum><header>Next Generation Lighting Initiative</header><text display-inline="no-display-inline">Section 912 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16192">42 U.S.C. 16192</external-xref>) is repealed.</text>
				</section><section id="HCF4413BD04574217A7D3F54FB584B48D"><enum>243.</enum><header>Building standards</header><text display-inline="no-display-inline">Section 914 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16194">42 U.S.C. 16194</external-xref>) is amended by striking subsection
			 (c).</text>
				</section><section id="HBAE3DA44EF384CA7A06F9CDE9DE737DC"><enum>244.</enum><header>Secondary electric vehicle battery use program</header><text display-inline="no-display-inline">Section 915 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16195">42 U.S.C. 16195</external-xref>) is repealed.</text>
				</section><section id="H9F37436627084FE28FBCDF8D88A0D577"><enum>245.</enum><header>Energy Efficiency Science Initiative</header><text display-inline="no-display-inline">Section 916(a) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16196">42 U.S.C. 16196(a)</external-xref>) is amended to read as follows:</text>

									<subparagraph id="H9EB8C49C2CBD4E00B54A967677B536D6"><enum>(A)</enum><header>Solar energy</header><text>The Secretary shall conduct a program of research, development, demonstration, and commercial
			 application for solar energy, including innovations in—</text>
										<clause id="H8D4B3FC43ED34F71B4FE353F635F6B4C"><enum>(i)</enum><text>photovoltaics;</text>
										</clause><clause id="H086BEBE4F3D24CB7B8B52E7AF6E74207"><enum>(ii)</enum><text>solar heating;</text>
										</clause><clause id="H395B3EAA5EF4440095EAF487D64AC521"><enum>(iii)</enum><text>concentrating solar power;</text>
										</clause><clause id="H3A911891B3B5403E9FA98EE535355F52"><enum>(iv)</enum><text>lighting systems that integrate sunlight and electrical lighting in complement to each other;</text>
										</clause><clause id="H5060BA14698E407DBA02BAFA6E650345"><enum>(v)</enum><text>manufacturability of low cost, high quality solar systems; and</text>
										</clause><clause id="H412BDEEC660E42BB99B0D30B8E66CB4E"><enum>(vi)</enum><text>development of technologies that can be easily integrated into new and existing buildings.</text>
										</clause></subparagraph><subparagraph id="H097E65E1453D4ECEA7761AD5B955EDEF"><enum>(B)</enum><header>Wind energy</header><text>The Secretary shall conduct a program of research, development, demonstration, and commercial
			 application for wind energy, including innovations in—</text>
										<clause id="HE6321DB3E10D4237985AAF0D2B9F678F"><enum>(i)</enum><text>low speed wind energy;</text>
										</clause><clause id="HA27A8D0560A04A858DD1BC73D6CFD475"><enum>(ii)</enum><text>testing and verification technologies;</text>
										</clause><clause id="HE44CEC65E7D4437196124BAAF9E512A5"><enum>(iii)</enum><text>distributed wind energy generation; and</text>
										</clause><clause id="HC28C205AFBF747A6B0B26DE4EE658C36"><enum>(iv)</enum><text display-inline="yes-display-inline">transformational technologies for harnessing wind energy.</text>
										</clause></subparagraph><subparagraph id="H13775C7734F74B8983C5D3402A40E787"><enum>(C)</enum><header>Geothermal</header><text>The Secretary shall conduct a program of research, development, demonstration, and commercial
			 application for geothermal energy. The program shall focus on developing
			 innovative and transformational technologies for reducing the costs of
			 geothermal energy, including technologies for—</text>
										<clause id="H7FFB59C9BB514532851364F91B5F6345"><enum>(i)</enum><text>improving detection of geothermal resources;</text>
										</clause><clause id="HCA7618D7681A4E7DB689A20EA8B82538"><enum>(ii)</enum><text>decreasing drilling costs;</text>
										</clause><clause id="HFD8436F0A0084B1886DBCB6AF6F901B3"><enum>(iii)</enum><text>decreasing maintenance costs through improved materials;</text>
										</clause><clause id="H82EB55357DB548668FF31BE4D41F6EA1"><enum>(iv)</enum><text>increasing the potential for other revenue sources, such as mineral production; and</text>
										</clause><clause id="H43D3E32B5B4D40DDB5432B99BF83FB8C"><enum>(v)</enum><text>increasing the understanding of reservoir life cycle and management.</text>
										</clause></subparagraph><subparagraph id="H0BC8B4A00D55412F95CF95E4C4B17B4C"><enum>(D)</enum><header>Hydropower</header><text>The Secretary shall conduct a program of research, development, demonstration, and commercial
			 application for cost competitive technologies that enable the development
			 of new and incremental hydropower capacity, adding to the diversity of the
			 energy supply of the United States, including:</text>
										<clause id="H3E176E4CFB0B43138D2037519D2DE075"><enum>(i)</enum><text>Advanced technologies to enhance environmental performance and yield greater energy efficiencies.</text>
										</clause><clause id="HB3E189F4430F4E7694337F3FD76143E6"><enum>(ii)</enum><text display-inline="yes-display-inline">Ocean energy, including wave energy.</text>
										</clause></subparagraph><subparagraph id="HC1C7D3DBB4514402A7067A9D8761333F"><enum>(E)</enum><header>Miscellaneous projects</header><text>The Secretary shall conduct research, development, demonstration, and commercial application
			 programs for—</text>
										<clause id="H416637B4C1314937BE7CD99F18342A29"><enum>(i)</enum><text>the combined use of renewable energy technologies with one another and with other energy
			 technologies, including the combined use of renewable power and fossil
			 technologies;</text>
										</clause><clause id="H4FA13919EAB74C258C92E6A0B703AFF8"><enum>(ii)</enum><text>renewable energy technologies for cogeneration of hydrogen and electricity;</text>
										</clause><clause id="H6F2CCA30336A4212971474C603BCBF07"><enum>(iii)</enum><text>kinetic hydro turbines; and</text>
										</clause><clause id="HCF9569206BC34AF8BF667D516C7ED060"><enum>(iv)</enum><text>the Pioneering Energy Research Program under section 262 of the <short-title>ONE Future Act</short-title>.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="H2537391826F0404F93318E0BF031FE73"><enum>(b)</enum><header>Rural Demonstration Projects</header><text>In carrying out this section, the Secretary, in consultation with the Secretary of Agriculture,
			 shall give priority to demonstrations that assist in delivering
			 electricity to rural and remote locations including—</text>
								<paragraph id="HAAFA4ACFA3CE422DBD8C7FB10C3C3DE7"><enum>(1)</enum><text>advanced renewable power technology, including combined use with fossil technologies;</text>
								</paragraph><paragraph id="H566D1C2166AD4D68A3F1B1B0D9F57904"><enum>(2)</enum><text>biomass; and</text>
								</paragraph><paragraph id="HA6A4362C435841DD9BB398995215BBBD"><enum>(3)</enum><text>geothermal energy systems.</text>
								</paragraph></subsection><subsection id="H3D2AAB885869420691E73101467326B8"><enum>(c)</enum><header>Analysis and Evaluation</header>
								<paragraph id="H5EBC6D3E40054BC9AA4A9B2AB60FD246"><enum>(1)</enum><header>In general</header><text>The Secretary shall conduct analysis and evaluation in support of the renewable energy programs
			 under this subtitle. These activities shall be used to guide budget and
			 program decisions, and shall include—</text>
									<subparagraph id="H8A58D60D19244853A3F31798D8CA57B7"><enum>(A)</enum><text>economic and technical analysis of renewable energy potential, including resource assessment;</text>
									</subparagraph><subparagraph id="H0C16A62D2C5A457FB1EEF90A1B83875C"><enum>(B)</enum><text>analysis of past program performance, both in terms of technical advances and in market
			 introduction of renewable energy;</text>
									</subparagraph><subparagraph id="H88C374EF5535474788BE7BDBABAA8FF6"><enum>(C)</enum><text>assessment of domestic and international market drivers, including the impacts of any Federal,
			 State, or local grants, loans, loan guarantees, tax incentives, statutory
			 or regulatory requirements, or other government initiatives; and</text>
									</subparagraph><subparagraph id="H47F44C27E2D34BB6A7A73147499CEFA7"><enum>(D)</enum><text>any other analysis or evaluation that the Secretary considers appropriate.</text>
									</subparagraph></paragraph><paragraph id="H872AD2AF99CD4468977F446D1E67C3FB"><enum>(2)</enum><header>Funding</header><text display-inline="yes-display-inline">The Secretary may designate up to 1 percent of the funds appropriated for carrying out this
			 subtitle for analysis and evaluation activities under this subsection.</text>
								</paragraph><paragraph id="HFBF9617634B34525A9A309E6473FB431"><enum>(3)</enum><header>Submittal to congress</header><text>This analysis and evaluation shall be submitted to the Committee on Science, Space, and Technology
			 of the House of Representatives and the Committee on Energy and Natural
			 Resources of the Senate at least 30 days before each annual budget request
			 is submitted to Congress.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="HEABE5E063FC84EA5BA755186E5B5987B"><enum>248.</enum><header>Bioenergy program</header><text display-inline="no-display-inline">Section 932 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16232">42 U.S.C. 16232</external-xref>) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HACBB62634BA646B9A06CD2727870723D" style="OLC">
						<section id="H8137729B68EB4AAA9E830EFC073F4E9F"><enum>932.</enum><header>Bioenergy program</header>
							<subsection id="H58D50A33BEBD4BF2AEA8A80123E1E3A8"><enum>(a)</enum><header>Program</header><text>The Secretary shall conduct a program of research, development, demonstration, and commercial
			 application for bioenergy, including innovations in—</text>
								<paragraph id="HD60E17A51AA448EC85F56B0FC8B0F452"><enum>(1)</enum><text>biopower energy systems;</text>
								</paragraph><paragraph id="HBBD3DE2C44E54F43A163B9069F41274E"><enum>(2)</enum><text>biofuels;</text>
								</paragraph><paragraph id="HE50E7B98D42342DBB1BD558F2E720ED6"><enum>(3)</enum><text>bioproducts;</text>
								</paragraph><paragraph id="HC3AD9BAE7F8148EBB733A17EE69A62C9"><enum>(4)</enum><text>integrated biorefineries that may produce biopower, biofuels, and bioproducts; and</text>
								</paragraph><paragraph id="HF66398AC832E4F788A95396AC6026E35"><enum>(5)</enum><text>cross-cutting research and development in feedstocks.</text>
								</paragraph></subsection><subsection id="HA2469D49410E4C1FA0F70B29AB0246DC"><enum>(b)</enum><header>Biofuels and Bioproducts</header><text>The goals of the biofuels and bioproducts programs shall be to develop, in partnership with
			 industry and institutions of higher education—</text>
								<paragraph id="HB776595A9C674AEBB49C3F1BD7F7FA47"><enum>(1)</enum><text>advanced biochemical and thermochemical conversion technologies capable of making fuels from
			 lignocellulosic feedstocks that are price-competitive with fossil-based
			 fuels and fully compatible with either internal combustion engines or fuel
			 cell-powered vehicles;</text>
								</paragraph><paragraph id="HBEAAADEFF8194EB0B9333B298D384088"><enum>(2)</enum><text>advanced biotechnology processes capable of making biofuels and bioproducts with emphasis on
			 development of biorefinery technologies using enzyme-based processing
			 systems; and</text>
								</paragraph><paragraph id="HD788EC7F1BD24C71A242891D70E734FA"><enum>(3)</enum><text>other advanced processes that will enable the development of cost-effective bioproducts, including
			 biofuels.</text>
								</paragraph></subsection><subsection id="H03C4AC42BED041B7A5C9905337AFFFFB"><enum>(d)</enum><header>Retrofit Technologies for the Development of Ethanol From Cellulosic Materials</header><text>The Secretary shall establish a program of research, development, demonstration, and commercial
			 application for technologies and processes to enable biorefineries that
			 exclusively use corn grain or corn starch as a feedstock to produce
			 ethanol to be retrofitted to accept a range of biomass, including
			 lignocellulosic feedstocks.</text>
							</subsection><subsection id="H9EEC1AD461B1444D988F6CEB18D4D1A9"><enum>(c)</enum><header>Definitions</header><text>In this section:</text>
								<paragraph id="H226E1E955807481DBD4E6CC089BEC6D7"><enum>(1)</enum><header>Biomass</header><text>The term <term>biomass</term> means—</text>
									<subparagraph id="HC9503CB33F724387A8B10F4B369B62F3"><enum>(A)</enum><text>any organic material grown for the purpose of being converted to energy;</text>
									</subparagraph><subparagraph id="HA86BD5068E56441A89DA46C8AE2C7B4D"><enum>(B)</enum><text>any organic byproduct of agriculture (including wastes from food production and processing) that
			 can be converted into energy; or</text>
									</subparagraph><subparagraph id="H8B0431AD8D0943B1B1FCB37E081B6D3F"><enum>(C)</enum><text>any waste material that can be converted to energy, is segregated from other waste materials, and
			 is derived from—</text>
										<clause id="HBB5BEB266B07474F8C8EB3F852D51000"><enum>(i)</enum><text>any of the following forest-related resources: mill residues, precommercial thinnings, slash,
			 brush, or otherwise nonmerchantable material;</text>
										</clause><clause id="HF170182578B1471689BEF467A0A574E2"><enum>(ii)</enum><text>wood waste materials, including waste pallets, crates, dunnage, manufacturing and construction wood
			 wastes (other than pressure-treated, chemically treated, or painted wood
			 wastes), and landscape or right-of-way tree trimmings, but not including
			 municipal solid waste, gas derived from the biodegradation of municipal
			 solid waste, or paper that is commonly recycled; or</text>
										</clause><clause id="H904B7394484042108503C04F592E8A00"><enum>(iii)</enum><text display-inline="yes-display-inline">solids derived from waste water treatment processes.</text>
										</clause></subparagraph></paragraph><paragraph id="HE8007FE87FB74FAFA210CDD09070F8E1"><enum>(2)</enum><header>Lignocellulosic feedstock</header><text>The term <term>lignocellulosic feedstock</term> means any portion of a plant or coproduct from conversion, including crops, trees, forest
			 residues, and agricultural residues not specifically grown for food,
			 including from barley grain, grapeseed, rice bran, rice hulls, rice straw,
			 soybean matter, and sugarcane bagasse.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="H5E9E4A3FFD7146D3B91E13D77555B177"><enum>249.</enum><header>Concentrating solar power research program</header><text display-inline="no-display-inline">Section 934 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16234">42 U.S.C. 16234</external-xref>) is repealed.</text>
				</section><section id="HC25F8349CDD5409BA2D46253E5BF54BA"><enum>250.</enum><header>Renewable energy in public buildings</header><text display-inline="no-display-inline">Section 935 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16235">42 U.S.C. 16235</external-xref>) and the item relating thereto in the
			 table of contents of that Act are repealed.</text>
				</section></subtitle><subtitle id="H1D5B7F43ED074872B299D027F484CBA7"><enum>D</enum><header>Fossil Energy Research and Development</header>
				<section id="H030C1BE4E8CE49B29DA40C7899A3ECD6" section-type="subsequent-section"><enum>261.</enum><header>Fossil energy</header><text display-inline="no-display-inline">Section 961 of Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16291">42 U.S.C. 16291</external-xref>) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H438F18E1C15546B095FD644C8AAF8FD0" style="OLC">
						<section id="HCCDD3FC1DACE40D3B93A9EC6E7F1D894"><enum>961.</enum><header>Fossil energy</header>
							<subsection id="H67D4351FBD7A4EF89E040E957BC2660D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall carry out research, development, demonstration, and commercial application
			 programs in fossil energy, including activities under this subtitle, with
			 the goal of improving the efficiency, effectiveness, and environmental
			 performance of fossil energy production, upgrading, conversion, and
			 consumption. Such programs shall take into consideration the following
			 objectives:</text>
								<paragraph id="H8E53E541C8B346419E48BA84D78BCECC"><enum>(1)</enum><text>Increasing the energy conversion efficiency of all forms of fossil energy through improved
			 technologies.</text>
								</paragraph><paragraph id="H9FFA9292355C4BD482809066E3A539B5"><enum>(2)</enum><text>Decreasing the cost of all fossil energy production, generation, and delivery.</text>
								</paragraph><paragraph id="HD02D21C56C7F48D0A4C435CF28EB7235"><enum>(3)</enum><text>Promoting diversity of energy supply.</text>
								</paragraph><paragraph id="HD372618CCF004EA09B53D1BC0C7291A2"><enum>(4)</enum><text>Decreasing the dependence of the United States on foreign energy supplies.</text>
								</paragraph><paragraph id="H78E74FD50A774661BE3AFD83E4B79EC1"><enum>(5)</enum><text>Improving United States energy security.</text>
								</paragraph><paragraph id="HFA095A4472644D3F86D13FE2CF2AF6A7"><enum>(6)</enum><text>Decreasing the environmental impact of energy-related activities.</text>
								</paragraph><paragraph id="HA1F474274013484499AB8AF0E32CD5F9"><enum>(7)</enum><text>Increasing the export of fossil energy-related equipment, technology, and services from the United
			 States.</text>
								</paragraph></subsection><subsection id="H14547AA82DF549219F6EAC01F6AA9F8F"><enum>(b)</enum><header>Limitations</header>
								<paragraph id="HD100F126CBD44D65BD7FF9A1E2A68A12"><enum>(1)</enum><header>Uses</header><text display-inline="yes-display-inline">None of the funds authorized for carrying out this section may be used for Fossil Energy
			 Environmental Restoration.</text>
								</paragraph><paragraph id="H953086270534447195A0E7F9594520E0"><enum>(2)</enum><header>Institutions of higher education</header><text display-inline="yes-display-inline">Not less than 20 percent of the funds appropriated for carrying out section 964 of this Act for
			 each fiscal year shall be dedicated to research and development carried
			 out at institutions of higher education.</text>
								</paragraph><paragraph id="H5F2B0D735BAE4139AB37E8ED6CF519C7"><enum>(3)</enum><header>Use for regulatory assessments or determinations</header><text display-inline="yes-display-inline">The results of any research, development, demonstration, or commercial application projects or
			 activities of the Department may not be used for regulatory assessments or
			 determinations by Federal regulatory authorities.</text>
								</paragraph></subsection><subsection id="H050534AC38754B1FB48FFB9E72A80683"><enum>(c)</enum><header>Assessments</header>
								<paragraph id="H2BA378A3A3364877B1FF97A865F60783"><enum>(1)</enum><header>Constraints against bringing resources to market</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>ONE Future Act</short-title>, the Secretary shall transmit to Congress an assessment of the technical, institutional, policy,
			 and regulatory constraints to bringing new domestic fossil resources to
			 market.</text>
								</paragraph><paragraph id="HCD50F4D65AA149C995995189F4F401B6"><enum>(2)</enum><header>Technology capabilities</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of the <short-title>ONE Future Act</short-title>, the Secretary shall transmit to Congress a long-term assessment of existing and projected
			 technological capabilities for expanded production from domestic
			 unconventional oil, gas, and methane reserves.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="HEB02ADE01E9C483D8F85DA11729915A5"><enum>262.</enum><header>Pioneering Energy Research</header>
					<subsection id="H8218366BE1754EFC949BB9315CE7FB5F"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary, in conjunction with the program consortium selected under subsection (d), shall
			 establish and carry out a public-private partnership Pioneering Energy
			 Research Program for research, development, demonstration, and commercial
			 application of technologies to maximize domestic energy production,
			 improve environmental stewardship, ensure domestic energy security, and
			 maintain global energy leadership.</text>
					</subsection><subsection id="HB9AF476C485C4395B0F6C6A378B9C3C9"><enum>(b)</enum><header>Covered activities</header><text display-inline="yes-display-inline">The program under this section shall include research, development, demonstration, and commercial
			 application on—</text>
						<paragraph id="H5CC2B3EFF9AA44AEB5D144CF3A01D945"><enum>(1)</enum><text display-inline="yes-display-inline">natural gas and other petroleum resource exploration, production and consumption, including
			 technologies and processes to improve well and pipeline integrity, improve
			 understanding of fluid flow and storage, reduce surface footprints, and
			 improve water management technologies in conventional and unconventional
			 resources;</text>
						</paragraph><paragraph id="HFBF040E76CDD4C8190CD739B44E7D5EE"><enum>(2)</enum><text>alternative liquid transportation fuel activities, including integration of biomass and natural gas
			 for transportation fuels production, cleaner fuels, renewable liquid fuels
			 other than ethanol, natural gas vehicles, and other innovative
			 fossil-based fuels;</text>
						</paragraph><paragraph id="H92351900D2BB43BC98CF91F2E7FB7F2D"><enum>(3)</enum><text>energy system risk management, optimization, resiliency, and integration;</text>
						</paragraph><paragraph id="H37EB8A1C1BC64C3F9594C2B5FD6D7ECD"><enum>(4)</enum><text>hydraulic fracturing and shale petroleum, including the establishment and continued operation of
			 one or more Hydraulic Fracturing Test Sites to address efficiency, safety,
			 and environmental sustainability of hydraulic fracturing and shale
			 petroleum technologies;</text>
						</paragraph><paragraph id="H15F0B498AFDD46C98C69A2E3A78249A0"><enum>(5)</enum><text>small producer technology challenges, including improving well integrity and efficiency;</text>
						</paragraph><paragraph id="HADA38E6FFC2945159588A9F3B8C83E9C"><enum>(6)</enum><text>subsurface energy exploration and production, including geothermal energy;</text>
						</paragraph><paragraph id="H730A6A22BF67417497432AAD1A4C5478"><enum>(7)</enum><text>interstate and intrastate natural gas pipeline and distribution system integrity management; and</text>
						</paragraph><paragraph id="H588C3C93A1A9477D9B2E5B6B161DB850"><enum>(8)</enum><text>other domestic energy challenges as identified by the Secretary or the program consortium and
			 included in the annual plan prepared under subsection (i).</text>
						</paragraph></subsection><subsection id="H283AC456EC294BFEA41C322E99216A89"><enum>(c)</enum><header>Role of the secretary</header><text>The Secretary shall have ultimate responsibility for, and oversight of, all aspects of the program
			 under this section. The Secretary may not assign any activities to the
			 program consortium except as specifically authorized under this section.</text>
					</subsection><subsection id="HDEB26F83E6EA4AA0BE30E71046842BA2"><enum>(d)</enum><header>Selection of the program consortium</header>
						<paragraph id="HC3CB038E95AD40BA9C7C3A4AE8F53586"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall select the
			 program consortium through an open, competitive process.</text>
						</paragraph><paragraph id="HB106B942742541F3A47658C9A9264E75"><enum>(2)</enum><header>Requirement of section <enum-in-header>501(c)(3)</enum-in-header> status</header><text>The Secretary shall not select a program consortium under this section unless such consortium is an
			 organization described in section 501(c)(3) of the Internal Revenue Code
			 of 1986 and exempt from tax under such section 501(a) of such Code.</text>
						</paragraph></subsection><subsection id="HF282A3653212456FA5681D559494B39E"><enum>(e)</enum><header>Role of the program consortium</header><text>Upon approval of the Secretary, the program consortium shall—</text>
						<paragraph id="H1EE7E7F1E0CA4EA7ACF393F7D40D01F6"><enum>(1)</enum><text>administer the program, to the extent provided under subsection (c);</text>
						</paragraph><paragraph id="H7CD368B026FC435298AE8C3808870871"><enum>(2)</enum><text>issue research project solicitations;</text>
						</paragraph><paragraph id="H17CA8228CA1043C29BE40F37B5BD0AF1"><enum>(3)</enum><text>make project awards to research performers;</text>
						</paragraph><paragraph id="H4EFC2CA1B46C41058275392DE77F7C0D"><enum>(4)</enum><text>disburse research funds awarded under this section to research performers in accordance with the
			 annual plan prepared under subsection (i); and</text>
						</paragraph><paragraph id="H402FA6DB205240ADA8518F24208E7285"><enum>(5)</enum><text>carry out other activities assigned to the program consortium or as provided in the annual plan.</text>
						</paragraph></subsection><subsection id="HBC139023B0FE4A10AA578EFA11EE4BD1"><enum>(f)</enum><header>Administrative costs</header><text display-inline="yes-display-inline">To compensate the program consortium for carrying out its activities under this section, the
			 Secretary shall provide to the program consortium up to 10 percent of the
			 total appropriation for carrying out this section each fiscal year.</text>
					</subsection><subsection id="HF3C2D2AEAD6C4266BA3EBE85417A9B5C"><enum>(g)</enum><header>Coordination</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary and the program consortium shall promote coordination
			 and cooperation among program offices at the Department.</text>
					</subsection><subsection id="H2F5DCABD529F49BAAEE8FB9B319641F7"><enum>(h)</enum><header>Complementary research</header><text display-inline="yes-display-inline">The Secretary, through the National Renewable Energy Laboratory and the National Energy Technology
			 Laboratory, shall carry out research and other activities complementary to
			 and supportive of the program authorized under this section. Up to 12.5
			 percent of appropriated program funds each fiscal year shall be for
			 complementary research conducted by the National Energy Technology
			 Laboratory and the National Renewable Energy Laboratory.</text>
					</subsection><subsection id="HAA6D9D1C27374DAEBCCFBC34660CA72A"><enum>(i)</enum><header>Annual plan</header>
						<paragraph id="HA48BF91BB7CA4A7FAB22BB9A3AD23E49"><enum>(1)</enum><header>Development</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, and annually thereafter, the program
			 consortium shall develop, and transmit to the Secretary, the Committee on
			 Science, Space, and Technology of the House of Representatives, and the
			 Committee on Energy and Natural Resources of the Senate, a plan for
			 activities under this section, including the distribution of Program
			 funds, which shall be reviewed and approved within 60 days by the
			 Secretary.</text>
						</paragraph><paragraph id="HF764EB4961934546A81CC8207091CA32"><enum>(2)</enum><header>Contents</header><text>The annual plan shall describe the ongoing and prospective activities of the program under this
			 section and shall include a list of any solicitations for awards to carry
			 out research, development, demonstration, and commercial application
			 activities, including specifics on the topics for such work, who would be
			 eligible to apply, selection criteria, and the duration of awards.</text>
						</paragraph></subsection><subsection id="H8F20E58E99AB4D11AF66EC32D83B612A"><enum>(j)</enum><header>Awards</header>
						<paragraph id="H5F421E5E60ED4833B58587F1C90159CE"><enum>(1)</enum><header>In general</header><text>Upon approval of the Secretary, the program consortium shall make awards to research performers to
			 carry out research, development, demonstration, and commercial application
			 activities under this section.</text>
						</paragraph><paragraph id="H99D18BDC2A2942CF91DD390BF9D78811"><enum>(2)</enum><header>Oversight</header>
							<subparagraph id="H4BA46F872C5846928138FEBB84261BC7"><enum>(A)</enum><header>In general</header><text>The program consortium shall oversee the implementation of awards under this subsection, consistent
			 with the annual plan developed under subsection (i), including disbursing
			 funds and monitoring activities carried out under such awards for
			 compliance with the terms and conditions of the awards.</text>
							</subparagraph><subparagraph id="H663E72ADA41A41BFB700F0994F5D73AA"><enum>(B)</enum><header>Effect</header><text>Nothing in subparagraph (A) shall limit the authority or responsibility of the Secretary to oversee
			 awards, or limit the authority of the Secretary to review or revoke
			 awards.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" id="H89F7284380A6464C82BD00CBE9B396C7"><enum>(k)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary, to remain available until expended, for
			 carrying out this section—</text>
						<paragraph commented="no" id="H678B56F2AEE043B88083D9E45C703CA6"><enum>(1)</enum><text>$50,000,000, to be derived from amounts appropriated under section 291(c); and</text>
						</paragraph><paragraph commented="no" id="H9FA490A96629475B84D62CD339DF532C"><enum>(2)</enum><text>$50,000,000, to be derived from amounts appropriated under section 291(d).</text>
						</paragraph></subsection></section><section id="H5F09A4FC02F4457A976D90BFB2099BB0"><enum>263.</enum><header>Research, development, demonstration, and commercial application programs</header>
					<subsection id="HBC3B56555F71446C996ED79E54CAE73D"><enum>(a)</enum><header>In general</header><text>Section 962 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16292">42 U.S.C. 16292</external-xref>) is amended—</text>
						<paragraph id="H342A1CF873534E49A6A9B03BCC9A8BD8"><enum>(1)</enum><text>in subsection (a)—</text>
							<subparagraph id="HAD74264DBD4B4C56917F5AE6580EAD2C"><enum>(A)</enum><text>in paragraph (10), by striking <quote>and</quote> at the end;</text>
							</subparagraph><subparagraph id="H5ECBA27E740142F9A577FAAC8B76633D"><enum>(B)</enum><text>in paragraph (11), by striking the period at the end and inserting a semicolon; and</text>

			 conversion, flexibility of operation, and other modifications to address

							</subparagraph></paragraph><paragraph id="HBB322EB03FD34BA2A400AB86DB61E09C"><enum>(2)</enum><text>by redesignating subsections (b) through (d) as subsections (c) through (e), respectively;</text>
						</paragraph><paragraph id="H1B9ABBC714524C27AC8ED09EC3AB338E"><enum>(3)</enum><text>by inserting after subsection (a) the following:</text>

			 application of technologies, including the accelerated development of—</text>
										<subparagraph id="H2BA0A58DA53E4BDBB0E8BBCECAF3492A"><enum>(A)</enum><text>chemical looping technology;</text>
										</subparagraph><subparagraph id="H23C2789D5DCB45DD9E8C76FE99F705F9"><enum>(B)</enum><text>supercritical carbon dioxide power generation cycles;</text>
										</subparagraph><subparagraph id="H13DBA740530F4BB99EA38FD79E1B639B"><enum>(C)</enum><text>pressurized oxycombustion, including new and retrofit technologies; and</text>
										</subparagraph><subparagraph id="HEBA6A8D07F404B3D9F849B59D06CCD2C"><enum>(D)</enum><text>other technologies that are characterized by the use of—</text>
											<clause id="H2C84EA29BF734E76821BCCA982E40AFE"><enum>(i)</enum><text>alternative energy cycles;</text>
											</clause><clause id="H6CC1F169C9B943E39E69B3FFD3F81B1D"><enum>(ii)</enum><text>thermionic devices using waste heat;</text>
											</clause><clause id="HCF9C5ACC48E5400988CF466C2CE0CD5A"><enum>(iii)</enum><text>fuel cells;</text>
											</clause><clause id="H35D48D5182884611BBCD1F67688BC97B"><enum>(iv)</enum><text>replacement of chemical processes with biotechnology;</text>
											</clause><clause id="H56D50E28C870426EBCBCBD0507E282F7"><enum>(v)</enum><text>nanotechnology;</text>
											</clause><clause id="H655393F6DF724408A0488F6BF1478D0C"><enum>(vi)</enum><text>new materials in applications (other than extending cycles to higher temperature and pressure),
			 such as membranes or ceramics;</text>
											</clause><clause id="HB6CCB33679644AD18D81261183C7FAA5"><enum>(vii)</enum><text>carbon utilization, such as in construction materials, using low quality energy to reconvert back
			 to a fuel, or manufactured food;</text>
											</clause><clause id="H596A1C877C824BF78E015FDD24BE433B"><enum>(viii)</enum><text>advanced gas separation concepts; and</text>
											</clause><clause id="HF75E4734F1274FD9A3450BD35D30BF06"><enum>(ix)</enum><text>other technologies, including—</text>
												<subclause id="H4332AA5CA2954744BF820D9FFCC165A3"><enum>(I)</enum><text>modular, manufactured components; and</text>
												</subclause><subclause id="H75826D4546C74B3BB5AF5B51F211B975"><enum>(II)</enum><text>innovative production or research techniques, such as using 3–D printer systems, for the production
			 of early research and development prototypes.</text>
												</subclause></clause></subparagraph></paragraph><paragraph id="HC8014318B5B64BD3BC061B365193BB95"><enum>(2)</enum><header>Cost share</header><text>In carrying out the program described in paragraph (1), the Secretary shall enter into partnerships
			 with private entities to share the costs of carrying out the program. The
			 Secretary may reduce or eliminate the non-Federal cost share requirement
			 if the Secretary determines that the reduction or elimination is necessary
			 and appropriate considering the technological risks involved in the
			 project.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
						</paragraph><paragraph id="HBA78D4886A6140AB84692953B008B3B8"><enum>(4)</enum><text>in subsection (c) (as so redesignated)—</text>
							<subparagraph id="H2F84FFC702794803AF8DEEE746C5046B"><enum>(A)</enum><text>by striking paragraph (1) and inserting the following:</text>
								<quoted-block id="HD7DD3D4FB1304542A588181AABD0CB4D" style="OLC">
									<paragraph id="H6DB1C991B436461F92AB74AD2C2553F4"><enum>(1)</enum><header>In general</header><text>In carrying out programs authorized by this section, the Secretary shall identify cost and
			 performance goals for coal-based technologies that would permit the
			 continued cost-competitive use of coal for the production of electricity,
			 chemical feedstocks, transportation fuels, and other marketable products.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
							</subparagraph><subparagraph id="H3090C61D00654D52B2DB1C07F879D980"><enum>(B)</enum><text>in paragraph (2), by striking <quote>date of enactment of this Act</quote> each place it appears and inserting <quote>date of enactment of the <short-title>ONE Future Act</short-title></quote>.</text>
							</subparagraph></paragraph></subsection><subsection id="H2DEC2C89FBC747CAA3C869D345D2D20B"><enum>(b)</enum><header>Advisory committee; authorization of appropriations</header><text>Section 963 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16293">42 U.S.C. 16293</external-xref>) is amended—</text>
						<paragraph id="HF6052A0C75B04FB890502567C65EB73E"><enum>(1)</enum><text>by amending paragraph (6) of subsection (c) to read as follows:</text>
							<quoted-block id="HA66D12B7079040898DF8B3D4826A3457" style="OLC">
								<paragraph id="HDBEE78DD286649A5AB3AB58301F2811C"><enum>(6)</enum><header>Advisory committee</header>
									<subparagraph id="H3622015E7A314E7FBABA033CBE265AC0"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the Secretary shall establish an advisory committee to undertake, not
			 less frequently than once every 3 years, a review and prepare a report on
			 the progress being made by the Department of Energy to achieve the goals
			 described in subsections (a) and (b) of section 962 and subsection (b) of
			 this section.</text>
									</subparagraph><subparagraph id="H35A659B9CF3149D68008CADD41319848"><enum>(B)</enum><header>Membership requirements</header><text>Members of the advisory committee established under subparagraph (A) shall be appointed by the
			 Secretary.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
						</paragraph><paragraph id="H75A7A85CF0B0408EAD21E77896CD008C"><enum>(2)</enum><text>by amending subsection (d) to read as follows:</text>
							<quoted-block display-inline="no-display-inline" id="H4E4C29F646CA49E88FEC3D2C348F9C3D" style="OLC">
								<subsection id="H793B3E76B1B747179D715F95E9B6CB15"><enum>(d)</enum><header>Study of carbon dioxide pipelines</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>ONE Future Act</short-title>, the Secretary shall transmit to Congress the results of a study to assess the cost and
			 feasibility of engineering, permitting, building, maintaining, regulating,
			 and insuring a national system of carbon dioxide pipelines.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection></section><section id="H54E180E177BC4326B6086385240BAF5D" section-type="subsequent-section"><enum>264.</enum><header>High efficiency gas turbines research and development</header>
					<subsection id="HAAADA6DF6BC34FA88A82AE5386113B1D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, through the Office of Fossil Energy, shall carry out a multiyear, multiphase program
			 of research, development, demonstration, and commercial application to
			 innovate technologies to maximize the efficiency of gas turbines used in
			 power generation systems.</text>
					</subsection><subsection id="H74A95AB9949E4EE494D3B59B354B9AFF"><enum>(b)</enum><header>Program elements</header><text>The program under this section shall—</text>
						<paragraph id="H2ACBE71042704B0A87BB437A84394EB3"><enum>(1)</enum><text>support innovative engineering and detailed gas turbine design for megawatt-scale and utility-scale
			 electric power generation, including—</text>
							<subparagraph id="H12F660197D464811A429FA9A3CAF096E"><enum>(A)</enum><text>high temperature materials, including superalloys, coatings, and ceramics;</text>
							</subparagraph><subparagraph id="H27432CDA745A4365A43053795875CE90"><enum>(B)</enum><text>improved heat transfer capability;</text>
							</subparagraph><subparagraph id="HB2E101454B7E4845BF9DE859654F55AA"><enum>(C)</enum><text>manufacturing technology required to construct complex three-dimensional geometry parts with
			 improved aerodynamic capability;</text>
							</subparagraph><subparagraph id="H77E663C68714411FAF16E8A5FE141841"><enum>(D)</enum><text>combustion technology to produce higher firing temperature while lowering nitrogen oxide and carbon
			 monoxide emissions per unit of output;</text>
							</subparagraph><subparagraph id="H8861EB7D84124D428484189C53FDC71A"><enum>(E)</enum><text>advanced controls and systems integration;</text>
							</subparagraph><subparagraph id="H3C98A619321B4096959B7603ADEFC8F4"><enum>(F)</enum><text>advanced high performance compressor technology; and</text>
							</subparagraph><subparagraph id="H854A1592BB034620B7FB244E6C12D2DE"><enum>(G)</enum><text>validation facilities for the testing of components and subsystems;</text>
							</subparagraph></paragraph><paragraph id="H2A95E516817E463A9DB6961D257BD2FE"><enum>(2)</enum><text>include technology demonstration through component testing, subscale testing, and full scale
			 testing in existing fleets;</text>
						</paragraph><paragraph id="H12285248103A47EAA0C57E9B8109D1F9"><enum>(3)</enum><text>include field demonstrations of the developed technology elements so as to demonstrate technical
			 and economic feasibility; and</text>
						</paragraph><paragraph id="H710F84CC286B4F049DBF01F5AF6DD58C"><enum>(4)</enum><text>assess overall combined cycle and simple cycle system performance.</text>
						</paragraph></subsection><subsection id="HCF9AE85FD6A647459F61F9A09F41D64F"><enum>(c)</enum><header>Program goals</header><text>The goals of the multiphase program established under subsection (a) shall be—</text>
						<paragraph id="HA17CE03E19114200A4C8D80C1B1ACF78"><enum>(1)</enum><text>in phase I—</text>
							<subparagraph id="HB394B490BDE44C8D80BCA7321DC594A4"><enum>(A)</enum><text display-inline="yes-display-inline">to develop the conceptual design of advanced high efficiency gas turbines that can achieve at least
			 62 percent combined cycle efficiency or 47 percent simple cycle efficiency
			 on a lower heating value basis; and</text>
							</subparagraph><subparagraph id="H6849BA3BA9374189A7D4AE7E9B3070FE"><enum>(B)</enum><text display-inline="yes-display-inline">to develop and demonstrate the technology required for advanced high efficiency gas turbines that
			 can achieve at least 62 percent combined cycle efficiency or 47 percent
			 simple cycle efficiency on a lower heating value basis; and</text>
							</subparagraph></paragraph><paragraph id="H1664F8C681FF470EB6D12C389974EAA2"><enum>(2)</enum><text display-inline="yes-display-inline">in phase II, to develop the conceptual design for advanced high efficiency gas turbines that can
			 achieve at least 65 percent combined cycle efficiency or 50 percent simple
			 cycle efficiency on a lower heating value basis.</text>
						</paragraph></subsection><subsection id="H177BC94E16E2486DB60E6233D589E052"><enum>(d)</enum><header>Proposals</header><text display-inline="yes-display-inline">Within 180 days after the date of enactment of this Act, the Secretary shall solicit grant and
			 contract proposals from industry, small businesses, universities, and
			 other appropriate parties for conducting activities under this section. In
			 selecting proposals, the Secretary shall emphasize—</text>
						<paragraph id="HF767EF04D26E402C883E867EED3BC7A7"><enum>(1)</enum><text>the extent to which the proposal will stimulate the creation or increased retention of jobs in the
			 United States; and</text>
						</paragraph><paragraph id="H800700E67F274E0AAFC1D242472C175E"><enum>(2)</enum><text>the extent to which the proposal will promote and enhance United States technology leadership.</text>
						</paragraph></subsection><subsection display-inline="no-display-inline" id="H5F45CC7A8ED44091B04537C0239C3A59"><enum>(e)</enum><header>Competitive Awards</header><text display-inline="yes-display-inline">The provision of funding under this section shall be on a competitive basis with an emphasis on
			 technical merit.</text>
					</subsection><subsection id="H5F5F536FB6024C508BC6399D0C4A43E0"><enum>(f)</enum><header>Cost sharing</header><text>Section 988 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16352">42 U.S.C. 16352</external-xref>) shall apply to an award of financial
			 assistance made under this section.</text>
					</subsection></section></subtitle><subtitle id="HCFAC16D8C5EE4CDB9418CBE41232F82D"><enum>E</enum><header>Advanced Research Projects Agency–Energy</header>
				<section id="H2C229BBBF8944796BF867D09B03D143A"><enum>281.</enum><header>ARPA–E amendments</header><text display-inline="no-display-inline">Section 5012 of the America COMPETES Act (<external-xref legal-doc="usc" parsable-cite="usc/42/16538">42 U.S.C. 16538</external-xref>) is amended—</text>
					<paragraph id="H52B701F39D134918A31E1B095B8001AF"><enum>(1)</enum><text>by amending paragraph (1) of subsection (c) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="HB96A7DF81BFD4C1EA2D871EE0775B86B" style="OLC">
							<paragraph id="H3ADBCCA64AB047D8985FA8C4373B43D8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The goals of ARPA–E shall be to enhance the economic and energy security of the United States and
			 to ensure that the United States maintains a technological lead through
			 the development of advanced energy technologies.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph id="HC2DF3610746B444D9ABE3D44E063C254"><enum>(2)</enum><text>in subsection (i)(1), by inserting <quote>ARPA–E shall not provide funding for a project unless the prospective grantee demonstrates
			 sufficient attempts to secure private financing as to indicate that the
			 project is not independently commercially viable.</quote> after <quote>relevant research agencies.</quote>;</text>
					</paragraph><paragraph id="H8320058CA4304202994B92ECF6C21359"><enum>(3)</enum><text>in subsection (l)(1), by inserting <quote>and once every 6 years thereafter,</quote> after <quote>operation for 6 years,</quote>; and</text>
					</paragraph><paragraph id="HD0A9E82D6B044BA19AF38226DB61F97A"><enum>(4)</enum><text>by redesignating subsection (n) as subsection (o) and inserting after subsection (m) the following
			 new subsection:</text>

								<paragraph id="HF910207F77034AFFAF0593B668B11F8E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The following categories of information collected by the Advanced Research Projects Agency–Energy
			 from recipients of financial assistance awards shall be considered
			 privileged and confidential and not subject to disclosure pursuant to
			 <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code:</text>
									<subparagraph id="H2318946549184D09B0776369F69A4B10"><enum>(A)</enum><text>Plans for commercialization of technologies developed under the award, including business plans,
			 technology to market plans, market studies, and cost and performance
			 models.</text>
									</subparagraph><subparagraph id="H41484BBD824A4FF38A0C86B6B0971675"><enum>(B)</enum><text>Investments provided to an awardee from third parties, such as venture capital, hedge fund, or
			 private equity firms, including amounts and percentage of ownership of the
			 awardee provided in return for such investments.</text>
									</subparagraph><subparagraph id="HE4579980B2B8409598FEDDD44A0C3081"><enum>(C)</enum><text>Additional financial support that the awardee plans to invest or has invested into the technology
			 developed under the award, or that the awardee is seeking from third
			 parties.</text>
									</subparagraph><subparagraph id="H4701BA4340534252A9C401950992B8B9"><enum>(D)</enum><text>Revenue from the licensing or sale of new products or services resulting from the research
			 conducted under the award.</text>
									</subparagraph></paragraph><paragraph id="H06235F73CFD34B5590622F4561DB5118"><enum>(2)</enum><header>Effect of subsection</header><text>Nothing in this subsection affects—</text>
									<subparagraph id="H7F9AD954F569477D8324A8983A25290A"><enum>(A)</enum><text>the authority of the Secretary to use information without publicly disclosing such information; or</text>
									</subparagraph><subparagraph id="H54D22C5050B64143B3FFA0C9EE3027F0"><enum>(B)</enum><text>the responsibility of the Secretary to transmit information to Congress as required by law.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				<section id="H938754A8241C4C3DAD042E700CFBD97F" section-type="subsequent-section"><enum>291.</enum><header>Authorization of appropriations</header>

						<paragraph id="HA826A5BB0B3A41E3A53551CDD6EB1B3E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Secretary for research, development, demonstration,
			 and commercial application for nuclear energy technology activities within
			 the Office of Nuclear Energy $488,630,000 for each of fiscal years 2014
			 and 2015.</text>
						</paragraph><paragraph commented="no" id="H09C3ECA7428C49A9B58360026E864B40"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">Any amounts made available pursuant to the authorization of appropriations under paragraph (1)
			 shall not be derived from the Nuclear Waste Fund established under section

			 technology activities within the Office of Energy Efficiency and Renewable
			 Energy—</text>
						<paragraph id="H4CA3978DA189422886F20AC2D1E7CF24"><enum>(1)</enum><text>$1,683,486,000 for fiscal year 2014; and</text>
						</paragraph><paragraph id="HE5B4DE17E4784AB4B7B14F169FD6C2F1"><enum>(2)</enum><text display-inline="yes-display-inline">$1,197,631,000 for fiscal year 2015.</text>

			 and commercial application for fossil energy technology activities within
			 the Office of Fossil Energy $561,931,000 for each of fiscal years 2014 and
			 2015.</text>
