		<official-title>To amend title 10, United States Code, to provide certain members of the reserve components of the
			 Armed Forces who are victims of sex-related offenses with access to a
			 special victims’ counsel.</official-title>

		<section id="H393A42376ED94A708ACCB94C1C6BAA0A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Guard and Reserve Equal Access to Legal Services Act</short-title></quote>.</text>
		</section><section id="H6A52514536C4455C82A45AE0F4C2CE0C" section-type="subsequent-section"><enum>2.</enum><header>Access to special victims’ counsel</header>
			<subsection id="H34B2942628D24C60A7F4CFAD26DEC26C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (a) of <external-xref legal-doc="usc" parsable-cite="usc/10/1044e">section 1044e</external-xref> of title 10, United States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H0652FB2CC57A419C9277958B1D471712" style="USC">
					<subsection id="HF701B51F6FF0445386AFC3ECEA3F3064"><enum>(a)</enum><header>Designation; purposes</header>
						<paragraph commented="no" display-inline="yes-display-inline" id="HB01AB64B63464730AB9EBB9CD1C78BCD"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary concerned shall designate legal counsel (to be known as <quote>Special Victims’ Counsel</quote>) for the purpose of providing legal assistance to an individual described in paragraph (2) who is
			 the victim of an alleged sex-related offense, regardless of whether the
			 report of that offense is restricted or unrestricted.</text>
						</paragraph><paragraph id="HE1002CF9A15A483DA072C7B6FBAD22D3" indent="up1"><enum>(2)</enum><text>An individual described in this paragraph is any of the following:</text>
							<subparagraph id="H61A601839655459B9E9DFFB055CABBB2"><enum>(A)</enum><text display-inline="yes-display-inline">An individual eligible for military legal assistance under <external-xref legal-doc="usc" parsable-cite="usc/10/1044">section 1044</external-xref> of this title.</text>
							</subparagraph><subparagraph id="HAB483E29F9E5497DAE21BCC3C9A67C6C"><enum>(B)</enum><text display-inline="yes-display-inline">An individual who is—</text>
								<clause id="H8AC6BA94E169450494EFBF6561E4DA1D"><enum>(i)</enum><text>not covered under subparagraph (A);</text>
								</clause><clause id="HCA00A3ED505C4D2993F5CEC6E3D8C11B"><enum>(ii)</enum><text>a member of a reserve component of the armed forces; and</text>
								</clause><clause id="H70F7280AB67D455D8B7D6B52871C84E3"><enum>(iii)</enum><text>a victim of an alleged sex-related offense as described in paragraph (1) that was allegedly
			 committed by a member of the armed forces—</text>
									<subclause id="H77D5E9DAC3AE4BBEAE134EF87D4DDCC2"><enum>(I)</enum><text>during a period in which the individual served on active duty, full-time National Guard duty, or
			 inactive-duty training; or</text>
									</subclause><subclause id="H62C65FBDCD284A279F95F5823A245444"><enum>(II)</enum><text display-inline="yes-display-inline">during any period, regardless of the duty status of the individual, if the circumstances of the
			 alleged sex-related offense have a nexus to the military service of the
			 individual based on the membership in the armed forces of either the
			 victim or the member who allegedly committed such offense.</text></subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H41338A34B7A748BAA5748B5EF3261FF3"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Subsection (f) of such section is amended by striking <quote>eligible for military legal assistance under section 1044 of this title</quote> each place it appears and inserting <quote>described in subsection (a)(2)</quote>.</text>
			</subsection><subsection id="H38FB0DB175D242D0A309AA10535357F1"><enum>(c)</enum><header>Construction</header><text>The amendments made by this section may not be construed to authorize any additional benefit to a
			 member of a reserve component of the Armed Forces other than the access to
			 a Special Victims’ Counsel under <external-xref legal-doc="usc" parsable-cite="usc/10/1044e">section 1044e</external-xref> of title 10, United States
			 Code, as so amended.</text>
