		<official-title>To clarify that a closure of a branch or campus of an institution of higher education may qualify a
			 borrower for loan discharge under the Higher Education Act of 1965, and
			 for other purposes.</official-title>

		<section id="H028F1933BF774746B944FB0C3D59BD71" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Students from Failing Institutions Act</short-title></quote>.</text>
		</section><section id="H62BB085EB0124FE8801485850DAA1E85"><enum>2.</enum><header>Closure of a campus or branch of an institution of higher education</header><text display-inline="no-display-inline">Section 437(c) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087">20 U.S.C. 1087(c)</external-xref>) is amended—</text>
			<paragraph id="H142637E769F44EFFA8F6C4638EAEDE6C"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>or the closure of a campus or branch of the institution,</quote> after <quote>closure of the institution</quote>;</text>
			</paragraph><paragraph id="H85DC692E425E4CE0A126266FE4DE4207"><enum>(2)</enum><text>in paragraph (3)—</text>
				<subparagraph id="H5EC8EA7F0CCA4097894A1378D68EA20E"><enum>(A)</enum><text>by inserting <quote>or the closing of a campus or branch of the institution</quote> after <quote>closing of the institution</quote>; and</text>
				</subparagraph><subparagraph id="H6FFA484C1E2C47208844B25A04A93B4F"><enum>(B)</enum><text>by inserting before the period the following: <quote>and shall not count towards the student’s duration limit for Federal Pell Grants under section
			 401(c)(5)</quote>; and</text>
				</subparagraph></paragraph><paragraph id="H901B1FE58BBA47268F2F0D8105869C0A"><enum>(3)</enum><text>by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H07983432FAC54C0399D534E089C6C15E" style="OLC">
					<paragraph id="HF8E1FA6FF78B4781809809FCC94C02BE"><enum>(6)</enum><header>Campus or branch closure</header><text>A borrower who withdraws from an institution not more than 120 days before the date of closure of
			 the campus or branch of the institution in which the borrower was enrolled
			 and such closure would have prevented the borrower from completing the
			 program in which the borrower was enrolled shall, for purposes of
			 discharging such borrower’s loans under paragraph (1) and determining the
			 borrower’s eligibility for additional assistance under this title in
			 accordance with paragraphs (3) and (4), be considered to be a student who
			 is unable to complete the program in which such student is enrolled due to
			 the closure of the campus or branch of the institution.</text>
					</paragraph><paragraph id="HD74C8939E9E74FB48F9CD44E4B48ABA0"><enum>(7)</enum><header>Federal Pell Grants</header><text display-inline="yes-display-inline">In a case of a borrower that receives a Federal Pell Grant under subpart 1 of part A of this title
			 for an academic year for enrollment in a program at a campus or branch of
			 an institution and such campus or branch closes, even if for purposes of
			 paragraph (1) the borrower is considered to be able to complete the
			 program in which such borrower is enrolled, the borrower may use the
			 remaining amount of the Federal Pell Grant for such academic year at
			 another institution.</text>
					</paragraph><paragraph id="H36666A9294124312B35E2B93E4841A78"><enum>(8)</enum><header>Definition</header><text display-inline="yes-display-inline">For purposes of this subsection, the terms <quote>campus</quote> and <quote>branch</quote> include the term <quote>branch campus</quote> as defined in <external-xref legal-doc="regulation" parsable-cite="cfr/34/600.2">section 600.2</external-xref> of title 34, Code of Federal Regulations (or a successor regulation).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
