		<official-title>To clarify that no express or implied warranty is provided by reason of a disclosure relating to
			 voluntary participation in the Energy Star program, and for other
			 purposes.</official-title>

		<section id="H2650247512864418B1F2599401361CF5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Energy Star Program Integrity Act</short-title></quote>.</text>
		</section><section id="HC469321F23E6463C9018BEDF31FD2D61"><enum>2.</enum><header>No warranty</header><text display-inline="no-display-inline">Section 324A of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6294a">42 U.S.C. 6294a</external-xref>) is amended by adding at
			 the end the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="HCD4A9D965DDE498D9C1E4DA76BBEBD53" style="OLC">
				<subsection id="H5B7F133C990A4A43A805F42B94752D71"><enum>(e)</enum><header>No warranty</header>
					<paragraph id="HD7F9A9E94EDE4D7FAA9EF1A22BA7D47B"><enum>(1)</enum><header>In General</header><text>Any disclosure relating to participation of a product in the Energy Star program shall not create
			 an express or implied warranty or give rise to any private claims or
			 rights of action under State or Federal law relating to the
			 disqualification of that product from Energy Star if—</text>
						<subparagraph id="H90BABD45846545568F1BB6C2B1495644"><enum>(A)</enum><text>the product has been certified by a certification body recognized by the Energy Star program;</text>
						</subparagraph><subparagraph id="H4BE9C120EC384B73A5997CD274D88B6B"><enum>(B)</enum><text display-inline="yes-display-inline">the Administrator has approved corrective measures, including a determination of whether or not
			 consumer compensation is appropriate; and</text>
						</subparagraph><subparagraph id="H0205A33AA7D648C9B023CA3A44E09A03"><enum>(C)</enum><text>the responsible party has fully complied with all approved corrective measures.</text>
						</subparagraph></paragraph><paragraph id="H81BB33A5494744128CA93C70792A4C22"><enum>(2)</enum><header>Construal</header><text>Nothing in this subsection shall be construed to require the Administrator to modify any procedure
			 or take any other action.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
