		<section id="HD8A367E2F4F949D2AF9947091AACB07F" section-type="section-one"><enum>1.</enum><header>Prohibition on transfer of unprivileged enemy belligerents to the United States</header>
			<subsection id="H53C344B71B9C42A88E0BDD6ED6FF8DBC"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">No unprivileged enemy belligerent who is in the custody or under the effective control of the
			 Department of Defense or any other Federal entity may be transferred to or
			 released in the United States.</text>
			</subsection><subsection id="H91486B3BA96A4D1E9A9B022CE491044C"><enum>(b)</enum><header>Criminal penalties</header><text>A person who transfers or releases, or assists in the transfer or release, of an unprivileged enemy
			 belligerent to or within the United States shall be fined in accordance
			 with title 18, United States Code, imprisoned for not more than five
			 years, or both.</text>
			</subsection><subsection id="HC07A67A3372E440F9263907854BFE1F7"><enum>(c)</enum><header>Unprivileged enemy belligerent</header><text>For purposes of this Act, the term <quote>unprivileged enemy belligerent</quote> has the meaning given such term in <external-xref legal-doc="usc" parsable-cite="usc/10/948a">section 948a(7)</external-xref> of title 10, United States Code, and includes
			 any individual (other than a member of the Armed Forces) under detention
			 at United States Naval Station, Guantanamo Bay, Cuba, as of the date of
			 the enactment of this Act.</text>
			</subsection><subsection id="H14B846CBE2FD43F4A7AC4D84496FB244"><enum>(d)</enum><header>Citizens of the United States</header><text display-inline="yes-display-inline">This Act does not apply to any unprivileged enemy belligerent who—</text>
				<paragraph id="H5666B879CE6D497C9A1662200B7A791B"><enum>(1)</enum><text>is a citizen of the United States; and</text>
				</paragraph><paragraph id="H157F5BED2B2C4AD08E52B86BB729DCF7"><enum>(2)</enum><text>has engaged in hostilities within the United States and/or its territories.</text>
				</paragraph></subsection><subsection id="HA6746BB59DFC4121B796921514F98C91"><enum>(e)</enum><header>Termination</header><text>The provisions of this Act shall expire on December 31, 2017.</text>
