		<official-title>To amend title 5, United States Code, to provide that agencies may not deduct labor organization
			 dues from the pay of Federal employees, and for other purposes.</official-title>

	<legis-body id="HFFFC4C373B9E4277B73C2F73F4DDABED" style="OLC">
		<section id="H5B54F194959C49C7B2BA01099367E40C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Empower Employees Act</short-title></quote>.</text>
		</section><section id="HB38208144454479E852E182EAABA07D4" section-type="subsequent-section"><enum>2.</enum><header>Labor organization dues not deductible from pay</header>
			<subsection id="HE4EFC173321543EDACA096D5EEA245BF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/71">Chapter 71</external-xref> of title 5, United States Code, is amended by striking section 7115 and inserting the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H065CAFD0B6AF4D2F85C3D7DB4EF33C35" style="USC">
					<section id="H32B029E30A634A8C86B20BCD16079EC6"><enum>7115.</enum><header>Labor organization dues not deductible from pay</header>
						<subsection id="H89F3BC8426DC47AF8BBE7DE5868AD49D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">An agency may not deduct any amount from the pay of an employee for the dues of a labor
			 organization.</text>
						</subsection><subsection id="H4BDEB141C83A42C297F17955D552FD09"><enum>(b)</enum><header>Restriction</header><text display-inline="yes-display-inline">Appropriated funds may not be used to pay an employee who makes deductions described in subsection
			 (a).</text>
						</subsection><subsection id="HFFB8059AB124421AA8CFA98C5AD02ECF"><enum>(c)</enum><header>Definition</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>agency</term> means—</text>
							<paragraph id="H51A8B5FBDCFE470A9538317B278FF693"><enum>(1)</enum><text>an Executive agency (as defined in section 105), the United States Postal Service, and the Postal
			 Regulatory Commission;</text>
							</paragraph><paragraph id="HDF7E3A3C34644C21B01C7FD8E3AEB770"><enum>(2)</enum><text display-inline="yes-display-inline">an office, agency, or other establishment in the legislative branch;</text>
							</paragraph><paragraph id="H10BBAF278DF2445299F20054EEFC6B44"><enum>(3)</enum><text display-inline="yes-display-inline">an office, agency, or other establishment in the judicial branch; and</text>
							</paragraph><paragraph id="H77CDC53160C24835A498513F7AC5FC21"><enum>(4)</enum><text display-inline="yes-display-inline">the government of the District of Columbia.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HE60BA6B37221406493BF9B94600F3BD5"><enum>(b)</enum><header>Postal Service amendment</header><text><external-xref legal-doc="usc" parsable-cite="usc/39/1205">Section 1205</external-xref> of title 39, United States Code, is repealed.</text>
			</subsection><subsection display-inline="no-display-inline" id="H4B608184F00D4A5DBD6853FC7D59B792"><enum>(c)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/71">chapter 71</external-xref> of title 5, United States Code, is amended by
			 striking the item relating to section 7115 and inserting the following:</text>

			</subsection></section><section id="HABB1D35CEE1A4979BE0D21D6B2D52C93"><enum>3.</enum><header>Effective dates; transition provisions</header>
			<subsection id="H6C89C724D087490F9F979723A19470A1"><enum>(a)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this Act shall take effect on the date of enactment of this Act.</text>
			</subsection><subsection id="H4463FF43590D457192BD3C188BC065C2"><enum>(b)</enum><header>Transition provisions</header>
				<paragraph id="H5C18573B35E446D699B9613E186ECB14"><enum>(1)</enum><header>Current deductions for dues of an exclusive representative</header><text display-inline="yes-display-inline">Nothing in this Act shall, in the case of an assignment received before the date of enactment of
			 this Act under subsection (a) of <external-xref legal-doc="usc" parsable-cite="usc/5/7115">section 7115</external-xref> of title 5, United States
			 Code (as then in effect), cause the termination of such assignment before—</text>
					<subparagraph id="HEC27EB0EC40A4CAF88201D1E9400F55F"><enum>(A)</enum><text display-inline="yes-display-inline">the date on which such assignment is revoked, in accordance with the last sentence of such
			 subsection (a) (as last in effect before such date of enactment); or</text>
					</subparagraph><subparagraph id="H7A5B529F21264C539987D74739BD0F1E"><enum>(B)</enum><text display-inline="yes-display-inline">if earlier, the date determined under paragraph (1) or (2) of subsection (b) of such section 7115
			 (as last in effect before such date of enactment).</text>
					</subparagraph></paragraph><paragraph id="H9F614B6592A94029916114F1732DF8FA"><enum>(2)</enum><header>Current deductions for dues of other labor organizations</header><text display-inline="yes-display-inline">Nothing in this Act shall, in the case of a voluntary allotment made before the date of enactment
			 of this Act under subsection (c) of <external-xref legal-doc="usc" parsable-cite="usc/5/7115">section 7115</external-xref> of title 5, United States
			 Code (as then in effect), cause the termination of such allotment before
			 the date on which the underlying agreement (under authority of which such
			 allotment is being made) ceases to have effect, whether by reason of
			 section 7115(c)(2)(B) of such title 5 (as last in effect before such date
			 of enactment) or otherwise.</text>
				</paragraph><paragraph id="HE425FFB33A4242518828EA909A661E6D"><enum>(3)</enum><header>Current deductions for dues of a labor organization from Postal Service employees</header><text display-inline="yes-display-inline">Nothing in this Act shall, in the case of a written assignment received before the date of
			 enactment of this Act under <external-xref legal-doc="usc" parsable-cite="usc/39/1205">section 1205</external-xref> of title 39, United States Code
			 (as then in effect), cause the termination of such assignment before the
			 date on which such assignment—</text>
					<subparagraph id="H9EC2E9340B764826BEAB8C073FB4A9EA"><enum>(A)</enum><text>is revoked in accordance with such section (as last in effect before such date of enactment); or</text>
					</subparagraph><subparagraph id="H23BDB81F68244582B262695EBBCDB735"><enum>(B)</enum><text>otherwise expires.</text>
					</subparagraph></paragraph></subsection><subsection id="H0A660F493F354E5B839A6161F32413A3"><enum>(c)</enum><header>Nonrenewability</header>
				<paragraph id="H265008B0CC6B4DD0AD41200C26E98AB7"><enum>(1)</enum><header>In general</header><text>An agreement between an agency and a labor organization, entered into before the date of enactment
			 of this Act under subsection (a) or (c) of section 7115 of such title 5
			 (as then in effect), shall not, to the extent that it relates to
			 deductions for the payment of dues of such labor organization, be subject
			 to renewal or extension.</text>
				</paragraph><paragraph id="H743B00A00B894179AEF90D74A6A401CE"><enum>(2)</enum><header>Postal Service</header><text display-inline="yes-display-inline">A written assignment received by the United States Postal Service under <external-xref legal-doc="usc" parsable-cite="usc/39/1205">section 1205</external-xref> of title 39,
			 United States Code (as then in effect) or an agreement between the United
			 States Postal Service and any organization of employees in effect pursuant
			 to 1205(b) of such title (as then in effect), shall not, to the extent
			 that it relates to deductions for the payment of dues of such
			 organization, be subject to renewal or extension.</text>
				</paragraph></subsection><subsection id="HA67B459A981D419A920820287ABA9DF0"><enum>(d)</enum><header>Definitions</header><text>For purposes of this section, the terms <term>agency</term>, <term>exclusive representative</term>, and <term>labor organization</term> have the respective meanings given such terms in <external-xref legal-doc="usc" parsable-cite="usc/5/7103">section 7103</external-xref> of title 5, United States Code.</text>
