			 on certain individuals deemed dangerous for purposes of prohibiting
			 firearm possession by such individuals, and for other purposes.</official-title>

		<section id="H834041626A094632A2C3EE6BE425E7E3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>End Purchase of Firearms by Dangerous Individuals Act of 2014</short-title></quote>.</text>
		</section><section id="H2A9350A0D6B8494BBAD8C73C0A2A78C1"><enum>2.</enum><header>State reporting systems</header>
			<subsection id="H7559CCFB4036425894F0497589061B98"><enum>(a)</enum><header>State reporting systems as condition of receiving full Edward Byrne Memorial Justice Assistance
			 Grants amounts</header>
				<paragraph id="H61B31272B8E048D39486C9B1A7189F6E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For each fiscal year beginning with fiscal year 2018, a State shall—</text>
					<subparagraph id="HBFC770A0FE2047C5A7E82EBCFDD1F641"><enum>(A)</enum><text display-inline="yes-display-inline">establish a reporting system, in accordance with guidelines provided pursuant to section 4(a),
			 through which mental health professionals may report to appropriate State
			 entities—</text>
						<clause id="H9C52E6DC73534EA488CA9074649F7F0B"><enum>(i)</enum><text display-inline="yes-display-inline">in accordance with paragraph (2), information described in such paragraph with respect to
			 individuals described in such paragraph;</text>
						</clause><clause id="H7A1A817851B14EA69AC6246E33B5B4EA"><enum>(ii)</enum><text display-inline="yes-display-inline">in accordance with paragraph (3), information described in such paragraph with respect to
			 individuals described in such paragraph; and</text>
						</clause><clause id="H68607D859A5C4C4E80C50513A4872D6A"><enum>(iii)</enum><text display-inline="yes-display-inline">in accordance with paragraph (4), information described in such paragraph with respect to
			 individuals described in such paragraph;</text>
						</clause></subparagraph><subparagraph commented="no" id="HBDE93D95F9294801B1C6DD606BC47B4D"><enum>(B)</enum><text display-inline="yes-display-inline">establish under State law a process, in accordance with the guidelines provided pursuant to section
			 4(b), relating to temporarily committing individuals involuntarily to, or
			 holding individuals involuntarily at, mental health facilities;</text>
					</subparagraph><subparagraph id="H2525C5E24BA34246A2731CFC3758EF86"><enum>(C)</enum><text display-inline="yes-display-inline">from the information collected by the State pursuant to subparagraph (A), make electronically
			 available to the Attorney General records relevant to a determination of
			 whether a person is disqualified from possessing or receiving a firearm
			 under subsection (g)(4) of <external-xref legal-doc="usc" parsable-cite="usc/18/922">section 922</external-xref> of title 18, United States Code, or
			 applicable State law;</text>
					</subparagraph><subparagraph id="H69C5695482174639870772A8AC2BEC38"><enum>(D)</enum><text>upon notification under a subsequent paragraph of this section or subparagraph (G), or otherwise as
			 specified under such paragraph or subparagraph, that the basis under which
			 a record was made available under subparagraph (A) does not apply, or no
			 longer applies, shall, as soon as practicable—</text>
						<clause id="HD882DC1A14F24A5396072CB57514A404"><enum>(i)</enum><text>update, correct, modify, or remove, as applicable, the record from any database that the Federal or
			 State government maintains and makes available to the National Instant
			 Criminal Background Check System, consistent with the rules pertaining to
			 that database; and</text>
						</clause><clause id="H686B24773CE74EE0B10E30AEC3EEE36B"><enum>(ii)</enum><text>notify the Attorney General that such basis no longer applies so that the record system in which
			 the record is maintained is kept up to date;</text>
						</clause></subparagraph><subparagraph display-inline="no-display-inline" id="HA5AF62DEEF2246159B8F3CB7EAD6BE07"><enum>(E)</enum><text display-inline="yes-display-inline">ensure that the information submitted to the reporting system pursuant to this subsection—</text>
						<clause id="HE43853803AD543B28EEF961DE4668CFA"><enum>(i)</enum><text>with respect to an individual described in paragraph (3), is removed from such system on the date
			 described in the second sentence of such paragraph; and</text>
						</clause><clause id="H496DCB2E951C44D880EFFD805FF217A7"><enum>(ii)</enum><text>with respect to an individual described in paragraph (4), is removed from such system on the date
			 described in the second sentence of such paragraph;</text>
						</clause></subparagraph><subparagraph id="H28888396505A437C933F5F93B9A6EEA4"><enum>(F)</enum><text>ensure that the reporting system established under subparagraph (A) includes an appeals process
			 comparable to such a process applied with respect to the National Instant
			 Criminal Background Check System, including with respect to procedures for
			 notifications of individuals with respect to whom information is submitted
			 to the reporting system and an opportunity to review and appeal such
			 submission; and</text>
					</subparagraph><subparagraph id="H4A678E320E22414DB4DF13E87FAFB23D"><enum>(G)</enum>
						<clause commented="no" display-inline="yes-display-inline" id="HFF172C90601E4D5F95E9F9EC92C94968"><enum>(i)</enum><text>ensure that any individual who—</text>
							<subclause id="HFB32853D306C4CABAE1E88DCE447230F" indent="up1"><enum>(I)</enum><text>is disqualified from possessing or receiving a firearm under subsection (g)(4) of section 922, of
			 title United States Code, or applicable State law pursuant to information
			 reported through the reporting system established under subparagraph (A);
			 and</text>
							</subclause><subclause id="HDC3194C982F64C808B5E4368BBDD5CD5" indent="up1"><enum>(II)</enum><text>at the time of inclusion of such information in such reporting system is under 18 years of age;</text></subclause></clause><continuation-text continuation-text-level="subparagraph">is evaluated by a mental health professional by not later than the date the individual is 21 years
			 of age in order to determine if such individual should remain so
			 disqualified; and</continuation-text><clause id="H972093D6429849DCB0D00D76B1A6D9EF" indent="up1"><enum>(ii)</enum><text>upon determination that such individual should not remain so disqualified, notify the appropriate
			 State entity that the information so reported no longer applies for
			 inclusion in the reporting system or any database or record described in
			 subparagraph (D).</text>
						</clause></subparagraph></paragraph><paragraph id="H0F14E8BDFEFA407CB80B3511A6622D4D"><enum>(2)</enum><header>Individuals Temporarily Committed on a Voluntary Basis</header><text display-inline="yes-display-inline">For purposes of subsection (a)(1)(A)(i), in the case of an individual who is committed on a
			 voluntary basis to a mental institution (as defined for purposes of
			 <external-xref legal-doc="usc" parsable-cite="usc/18/922">section 922(g)(4)</external-xref> of title 18, United States Code) in a State, the mental
			 health professional who is primarily responsible for the individual’s
			 treatment at such institution—</text>
					<subparagraph id="H1326F999465041078234F32652B78F6A"><enum>(A)</enum><text display-inline="yes-display-inline">may report to the reporting system established by the State under paragraph (1)(A) information with
			 respect to such individual that is sufficient for inclusion in the
			 National Instant Criminal Background Check System and consistent with
			 Federal and State privacy laws if such mental health professional
			 determines, in accordance with the guidelines provided pursuant to section
			 4(a) and with section 5(c), such individual is a danger to the individual
			 or to others; and</text>
					</subparagraph><subparagraph id="H4E94D864BC494EF9888B23351735E72C"><enum>(B)</enum><text>upon discharge of such individual from such institution, shall notify the appropriate State entity
			 that the information submitted under subparagraph (A) no longer applies
			 for inclusion in the reporting system established under paragraph (1)(A)
			 or any database or record described in paragraph (1)(D).</text>
					</subparagraph></paragraph><paragraph id="H93D453CD64544EF99EEF5BF272145728"><enum>(3)</enum><header>Individuals temporarily committed or held on an involuntary basis</header><text display-inline="yes-display-inline">For purposes of subsection (a)(1)(A)(ii), in the case of an individual who is temporarily committed
			 or held on an involuntary basis, in accordance with a process described in
			 paragraph (1)(B), to a mental institution (as defined for purposes of
			 <external-xref legal-doc="usc" parsable-cite="usc/18/922">section 922(g)(4)</external-xref> of title 18, United States Code) in a State, the mental
			 health professional who is primarily responsible for the individual’s
			 treatment at such institution may report to the reporting system
			 established by the State under paragraph (1)(A), as soon as is practicable
			 after the date the individual is released from such institution,
			 information with respect to such individual that is sufficient for
			 inclusion in the National Instant Criminal Background Check System and
			 consistent with Federal and State privacy laws if such mental health
			 professional determines, in accordance with the guidelines provided
			 pursuant to section 4(a) and with section 5(c), such individual is a
			 danger to the individual or to others. On the date that is 5 years after
			 the date of such release, for purposes of subsections (a)(1)(D) and
			 (b)(1), the appropriate State entity and the Attorney General shall be
			 deemed to have been notified that the information submitted under the
			 previous sentence no longer applies for inclusion in the reporting system
			 established under paragraph (1)(A) or any database or record described in
			 paragraph (1)(D).</text>
				</paragraph><paragraph id="HECF0E1E10DB043C1A93A35078FBB9994"><enum>(4)</enum><header>Individuals making specific threat to mental health professional</header><text>For purposes of subsection (a)(1)(A)(iii), in the case of an individual who communicates to a
			 mental health professional a serious threat, as determined by the
			 professional in accordance with the guidance provided pursuant to section
			 4(a), of physical violence against another individual who is reasonably
			 identifiable, the mental health professional may report to the reporting
			 system established by the State under paragraph (1)(A), as soon as is
			 practicable after the date of such communication, information with respect
			 to such individual that is sufficient for inclusion in the National
			 Instant Criminal Background Check System and consistent with Federal and
			 State privacy laws. On the date that is 6 months after the date of such
			 report, for purposes of subsections (a)(1)(D) and (b)(1), the appropriate
			 State entity and the Attorney General shall be deemed to have been
			 notified that the information submitted under the previous sentence no
			 longer applies for inclusion in the reporting system established under
			 paragraph (1)(A) or any database or record described in paragraph (1)(D).</text>
				</paragraph></subsection><subsection id="HF0676F2859EC43D38C014F79C5C2D895"><enum>(b)</enum><header>National Instant Criminal Background Check System updates required</header>
				<paragraph id="H3DF57E6767F34B1C8BE82756EC6B1006"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Attorney General upon receiving notice pursuant to subsection (a)(1)(D) shall ensure that the
			 record in the National Instant Criminal Background Check System is
			 updated, corrected, modified, or removed within 30 days of receipt.</text>
				</paragraph><paragraph id="HEAD3E398E068481290ADB46462C74622"><enum>(2)</enum><header>Specific information removed from record</header><text display-inline="yes-display-inline">The Attorney General shall ensure that the information submitted to the National Instant Criminal
			 Background Check System pursuant to subsection (a)—</text>
					<subparagraph id="H2E2307C7CDCB437EA3003F2C57F8FC61"><enum>(A)</enum><text>with respect to an individual described in paragraph (3) of subsection (a), is removed from such
			 system on the date described in the second sentence of such paragraph; and</text>
					</subparagraph><subparagraph id="H98B4F3AE63244A33BF2E98261702A7AF"><enum>(B)</enum><text>with respect to an individual described in paragraph (4) of subsection (a), is removed from such
			 system on the date described in the second sentence of such paragraph.</text>
					</subparagraph></paragraph></subsection><subsection id="H2E7122B86F4B4549A819BBC5F161B4D8"><enum>(c)</enum><header>Enforcement</header>
				<paragraph id="H1504E54BC25243C0815D746003987245"><enum>(1)</enum><header>Attorney general report</header>
					<subparagraph id="H2F6C6E980A11497C9D2D074B3AE4E3AA"><enum>(A)</enum><header>In general</header><text>Not later than January 31 of each year, the Attorney General shall submit to the Committee on the
			 Judiciary of the Senate and the Committee on the Judiciary of the House of
			 Representatives a report on the progress of the States in implementing and
			 maintaining the reporting system described in subparagraph (A) of
			 subsection (a)(1) and process described in subparagraph (B) of such
			 subsection, and in providing that information pursuant to the requirements
			 of subparagraphs (C) and (D) of such subsection.</text>
					</subparagraph><subparagraph commented="no" id="H62B63C3D5FD140158480AB8155AA8FB4"><enum>(B)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Department of Justice, such funds as may be
			 necessary to carry out subparagraph (A).</text>
					</subparagraph></paragraph><paragraph id="H1AAD25B454A948A29FD5D4A0E282E68D"><enum>(2)</enum><header>Penalties</header>
					<subparagraph id="H8366AED344204A2D9ED06854BAE426CF"><enum>(A)</enum><header>Discretionary reduction</header>
						<clause id="HAF2DB4D4816B4868A7879F9BA3BD6BC8"><enum>(i)</enum><text>For each year during the 2-year period beginning 3 years after the date of enactment of this Act,
			 the Attorney General may withhold not more than 3 percent of the amount
			 that would otherwise be allocated to a State for such year under section
			 505 of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C.
			 3755) if the State is not in compliance with each requirement under
			 subsection (a)(1) with respect to such year.</text>
						</clause><clause id="HEE39410BD6A84A468D9596D2B5EF461B"><enum>(ii)</enum><text display-inline="yes-display-inline">For each year during the 5-year period after the expiration of the period referred to in clause
			 (i), the Attorney General may withhold not more than 4 percent of the
			 amount that would otherwise be allocated to a State for such year under
			 section 505 of the Omnibus Crime Control and Safe Streets Act of 1968 (42
			 U.S.C. 3755) if the State is not in compliance with each requirement under
			 subsection (a)(1) with respect to such year.</text>
						</clause></subparagraph><subparagraph id="H49EC763677B74278B2ACF78C0B38FD23"><enum>(B)</enum><header>Mandatory reduction</header><text display-inline="yes-display-inline">For each year after the expiration of the periods referred to in subparagraph (A), the Attorney
			 General shall withhold 5 percent of the amount that would otherwise be
			 allocated to a State for such year under section 505 of the Omnibus Crime
			 Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3755">42 U.S.C. 3755</external-xref>), if the State is not
			 in compliance with each requirement under subsection (a)(1) with respect
			 to such year.</text>
					</subparagraph><subparagraph id="H44FA88C723C24F3680ABCC81D443EF53"><enum>(C)</enum><header>Waiver by Attorney General</header><text>The Attorney General may waive the applicability of subparagraph (B) to a State with respect to the
			 requirements described in subparagraphs (A), (B), and (C) of subsection
			 (a)(1) if the State provides substantial evidence, as determined by the
			 Attorney General, that the State is making a reasonable effort to comply
			 with such requirements.</text>
					</subparagraph></paragraph><paragraph id="H0B11E1F79C98455890E7BB75391E35B5"><enum>(3)</enum><header>Reallocation</header><text display-inline="yes-display-inline">Any funds that are not allocated under section 505 of the Omnibus Crime Control and Safe Streets
			 Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3755">42 U.S.C. 3755</external-xref>) to a State pursuant to paragraph (2) because
			 of the failure of the State to comply with the requirements of subsection
			 (a)(1) shall be reallocated under such section to States that meet such
			 requirements.</text>
				</paragraph></subsection></section><section commented="no" id="H5BCB84851E9A44F7A48A040775414F96"><enum>3.</enum><header>Additional Firearms Prohibitions to Federal NICS System Based on State Reporting Systems</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/992">Section 992</external-xref> of title 18, United States Code, is amended—</text>
			<paragraph commented="no" id="HE9BA4CF8CE8F4931AD6909C73A77CF25"><enum>(1)</enum><text>in subsection (d)—</text>
				<subparagraph commented="no" id="H47180B413BF948E09F2FB4064B89AC5A"><enum>(A)</enum><text display-inline="yes-display-inline">by amending paragraph (4) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HC3B9490CE3934EAC928B3DC49ACA346B" style="USC">
						<paragraph commented="no" id="H986B6D34CD394D19858BBC209BB732C7"><enum>(4)</enum><text display-inline="yes-display-inline">has been—</text>
							<subparagraph commented="no" id="H3173A71A83A04A00AA57212C15313CDE"><enum>(A)</enum><text>adjudicated as a mental defective; or</text>
							</subparagraph><subparagraph commented="no" id="H964D887E737B41B9A1C04B811A72B794"><enum>(B)</enum><text>committed to any mental institution, and—</text>
								<clause commented="no" id="H85806D6487C4492B97B309FFD9FD4421"><enum>(i)</enum><text>in the case of a voluntary commitment—</text>
									<subclause id="H53A5FA48220749EFA7D9BA5C4636609A"><enum>(I)</enum><text display-inline="yes-display-inline">has been determined by a mental health professional, in accordance with section 5(c) of the End
			 Purchase of Firearms by Dangerous Individuals Act of 2014, to present a
			 danger to others; and</text>
									</subclause><subclause id="HF98A2818B4EB47CFAB86C3D221B6BB11"><enum>(II)</enum><text>is serving a period of commitment at such institution;</text>
									</subclause></clause><clause commented="no" id="HF5F6B82FFEB34428920D399CCA579D98"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of a temporary involuntary commitment or hold through a process established pursuant to
			 section 2(a)(1)(B) of the End Purchase of Firearms by Dangerous
			 Individuals Act of 2014—</text>
									<subclause id="H1B80C69702D94474B67EADDDFAF4FD00"><enum>(I)</enum><text display-inline="yes-display-inline">has been determined by a mental health professional, in accordance with section 5(c) of the End
			 Purchase of Firearms by Dangerous Individuals Act of 2014, to present a
			 danger to others; and</text>
									</subclause><subclause id="HF3AAAE741C0B45EDB3D7BD109E74B7EF"><enum>(II)</enum><text>is serving a period of commitment at such institution, or has been released from such institution
			 for a period of less than 5 years; or</text>
									</subclause></clause><clause id="H590ABD84E083407F9C9616F5748451AD"><enum>(iii)</enum><text display-inline="yes-display-inline">in the case of a formal commitment by a court, board, commission, or other lawful authority, is
			 serving a period of commitment at such institution, or has been released
			 from such institution;</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph><subparagraph commented="no" id="H74F7E5E6B4A74F0AA81B58055D9A9DCC"><enum>(B)</enum><text>in paragraph (8), by striking <quote>or</quote> at the end;</text>
				</subparagraph><subparagraph commented="no" id="HEB361BB214FE43AF8D3B0D97811740C7"><enum>(C)</enum><text>in paragraph (9), by striking the period at the end and inserting <quote>; or</quote>; and</text>
				</subparagraph><subparagraph commented="no" id="H177E537A2E9040CA9C14436C95733F5E"><enum>(D)</enum><text>by inserting after paragraph (9), the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HA28186EC40B14F84942AAD69EE4B47AE" style="USC">
						<paragraph commented="no" id="H73E7A5040D2844FF8E82429D2BBABB8C"><enum>(10)</enum><text display-inline="yes-display-inline">during the prior 6-month period, has communicated to a mental health professional a serious threat
			 to commit an act of physical violence against another identifiable person.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph commented="no" id="HB6DE649E77494706AB4C0C2356B01D27"><enum>(2)</enum><text>in subsection (g)—</text>
				<subparagraph commented="no" id="H681E7FBF1CC14686988032E9F50DFB3A"><enum>(A)</enum><text display-inline="yes-display-inline">by amending paragraph (4) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H6D37278F2F4D4F0E8BED5EA341D387E9" style="USC">
						<paragraph commented="no" id="HE972A1303CB4425A85BB84307B27B082"><enum>(4)</enum><text display-inline="yes-display-inline">who has been—</text>
							<subparagraph commented="no" id="HB9686EED10E94CAEA85EF49B00A1FAFC"><enum>(A)</enum><text>adjudicated as a mental defective; or</text>
							</subparagraph><subparagraph commented="no" id="HE50BA3DD0B0C499198D54D66DD268688"><enum>(B)</enum><text>committed to any mental institution, and—</text>
								<clause commented="no" id="H6A2FF311151C4C8A8FB74A38E4B6B181"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of a voluntary commitment—</text>
									<subclause id="H6EFFE01C94674BE79332D2FE42DAB70E"><enum>(I)</enum><text display-inline="yes-display-inline">has been determined by a mental health professional, in accordance with section 5(c) of the End
			 Purchase of Firearms by Dangerous Individuals Act of 2014, to present a
			 danger to others; and</text>
									</subclause><subclause id="HD2E7F4E2956B42F7B98938DEABD00CFC"><enum>(II)</enum><text>is serving a period of commitment at such institution;</text>
									</subclause></clause><clause commented="no" id="HF027B5121CBC4F4FBE8981B822FDD5B9"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of a temporary involuntary commitment or hold through a process established pursuant to
			 section 2(a)(1)(B) of the End Purchase of Firearms by Dangerous
			 Individuals Act of 2014—</text>
									<subclause id="H228585741FB94CEC846B99DCDB657621"><enum>(I)</enum><text display-inline="yes-display-inline">has been determined by a mental health professional, in accordance with section 5(c) of the End
			 Purchase of Firearms by Dangerous Individuals Act of 2014, to present a
			 danger to others; and</text>
									</subclause><subclause id="HAFAC99FF91484523BA407F9C5FC2DC1A"><enum>(II)</enum><text>is serving a period of commitment at such institution, or has been released from such institution
			 for a period of less than 5 years; or</text>
									</subclause></clause><clause id="H483D023DB0C347D8AF943868B72EF589"><enum>(iii)</enum><text display-inline="yes-display-inline">in the case of a formal commitment by a court, board, commission, or other lawful authority, is
			 serving a period of commitment at such institution, or has been released
			 from such institution;</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph><subparagraph commented="no" id="HE27F0758215845449BF2423384945B11"><enum>(B)</enum><text>in paragraph (8), by striking <quote>or</quote> at the end;</text>
				</subparagraph><subparagraph commented="no" id="H9A7E1B5E7EA24653B36F44D1FD2256E7"><enum>(C)</enum><text>in paragraph (9), by striking the comma at the end and inserting <quote>; or</quote>; and</text>
				</subparagraph><subparagraph commented="no" id="HBF85AF2F09AE45B391F331C7403606AF"><enum>(D)</enum><text>by inserting after paragraph (9), the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H34DB7302560D4373A96F3EF0BB7EE61B" style="USC">
						<paragraph commented="no" id="H98202BD584D74C2B928134AF69445DA7"><enum>(10)</enum><text display-inline="yes-display-inline">who has communicated to a mental health professional a serious threat to commit an act of physical
			 violence against another identifiable person, for a period of 6 months
			 after making such a threat,</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph></section><section id="H099A3C47200D4BD0A05DB5E2DE22D227"><enum>4.</enum><header>Guidelines</header>
			<subsection id="H30BEFF53AF0443EB9EAD38399E257180"><enum>(a)</enum><header>General guidelines for State reporting systems</header><text display-inline="yes-display-inline">Not later than 16 months after the date of the enactment of this Act, the Secretary of Health and
			 Human Services shall, pursuant to rulemaking and in accordance with
			 subsection (d), establish guidelines for States and mental health
			 professionals, with respect to establishing reporting systems under
			 section 2(a)(1)—</text>
				<paragraph id="H7A0D11B8A8004C9AB94ED0DC31B65280"><enum>(1)</enum><text display-inline="yes-display-inline">to ensure determinations described in paragraphs (2) and (3) of section 2(a) of dangerousness and
			 determinations described in section 2(a)(4) of serious threat for purposes
			 of reporting information under section 2(a)(1) are administered properly;</text>
				</paragraph><paragraph id="H4D5AB526362944139DF6EB46F27F1FF3"><enum>(2)</enum><text display-inline="yes-display-inline">to ensure that only individuals qualified to make such determinations are permitted to do so;</text>
				</paragraph><paragraph id="H2D581C1F72CB4CE1A9ADFEE3F08BBAFA"><enum>(3)</enum><text display-inline="yes-display-inline">to ensure an individual has recourse at any point during the detention of such individual at a
			 mental health institution on the basis of a voluntary or involuntary
			 commitment to contest the legality of such commitment or determination of
			 dangerousness by means of a “habeas corpus” or writ hearing;</text>
				</paragraph><paragraph id="HC45A576D4EF04C349B5638078F547A7D"><enum>(4)</enum><text display-inline="yes-display-inline">to ensure all reporting to law enforcement officials, State-based databases, and National Instant
			 Criminal Background Check System are compliant with applicable Federal and
			 State privacy and security protections and standards;</text>
				</paragraph><paragraph id="H50BF946641634884AE0DD53FB8A796FC"><enum>(5)</enum><text display-inline="yes-display-inline">to recommend the process by which qualified professionals should assess an individual to determine
			 dangerousness for purposes described in section 2; and</text>
				</paragraph><paragraph id="HBDEC08545A524C48B448BB6027B7B713"><enum>(6)</enum><text>for any other purpose deemed necessary by the Secretary.</text>
				</paragraph></subsection><subsection id="HC17AFC5D4E1F45A0B12CF2FE199F15DB"><enum>(b)</enum><header>Temporary involuntary commitment or hold process guidelines</header><text display-inline="yes-display-inline">Not later than 16 months after the date of the enactment of this Act, the Secretary of Health and
			 Human Services shall, pursuant to rulemaking and in accordance with
			 subsection (d), establish guidelines for States to establish a process for
			 temporarily committing or holding individuals on an involuntary basis to
			 mental health institutions. Such guidelines shall address at least the
			 following:</text>
				<paragraph id="HFCE33D5BC0A747969FD42838D666BA07"><enum>(1)</enum><header>Due Process</header><text>Guidelines to ensure any determination that an individual shall be temporarily involuntarily
			 committed or held is assessed by more than one qualified mental health
			 professional.</text>
				</paragraph><paragraph id="H34F28BE3F6B8405491E9C7602CE7C5A8"><enum>(2)</enum><header>Qualified professionals</header><text>Guidelines to determine which mental health professionals are qualified to handle the
			 responsibilities provided such professionals under section 2.</text>
				</paragraph><paragraph id="H0CA2D03A8358422C8E7B9999F889B7B7"><enum>(3)</enum><header>Recommendations in Assessing Patients</header><text>Guidelines recommending the process by which qualified professionals should assess an individual to
			 determine dangerousness for purposes described in section 2.</text>
				</paragraph><paragraph id="H990923876ED8422C886C51E4EDB1D784"><enum>(4)</enum><header>Treatments</header>
					<subparagraph id="H5CB60ACBC7804AAF83F90136CE0A7FE9"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Guidelines for how any individual designated to be temporarily involuntary committed or held and
			 who is receiving medication as a result of the mental illness of such
			 individual must be advised about the probable effects and possible side
			 effects of the medication.</text>
					</subparagraph><subparagraph id="H569D4858EA8F42EC814B31E3610AFFB2"><enum>(B)</enum><header>Information on medication</header><text>Guidelines for requiring the following information related to medications to be given to such an
			 individual:</text>
						<clause id="H90B4395EB03D433D91DC8EC7C74FD620"><enum>(i)</enum><text>The nature of the mental illness or behavior that is the reason the medication is being given or
			 recommended.</text>
						</clause><clause id="H7C25AAE662514C74AC9439C761A4A59E"><enum>(ii)</enum><text>The likelihood of such mental illness or behavior improving or not improving without the
			 medication.</text>
						</clause><clause id="H430C1EE1E80F4BC8B688B94D05BAA0E6"><enum>(iii)</enum><text>Reasonable alternative treatments available.</text>
						</clause><clause id="H24B3CCBD2F374DCA993575BC4ED68045"><enum>(iv)</enum><text>The name and type, frequency amount, and method of dispensing the medication, and the probable
			 length of time the medication will be taken.</text>
						</clause></subparagraph></paragraph><paragraph id="H381ACDAECF684FF798A1AF15E1995F83"><enum>(5)</enum><header>Assessment</header><text>Guidelines related to the process of assessing an individual for a temporary involuntary commitment
			 or hold, which shall incorporate the following requirements:</text>
					<subparagraph id="H64066F1E599043BB8875E06ADC959B52"><enum>(A)</enum><header>Face to Face</header><text>Prior to admitting an individual to a mental health facility pursuant to such commitment, the
			 qualified mental health professional in charge of the facility or designee
			 of such professional shall assess the individual with a face to face
			 assessment to determine the appropriateness of the temporary involuntary
			 detention or hold.</text>
					</subparagraph><subparagraph id="H51D1D46EB2F340148205A2C6014DDB01"><enum>(B)</enum><header>Verification from Second Professional</header><text>A second mental health professional shall independently verify the appropriateness of the temporary
			 involuntary detention or hold.</text>
					</subparagraph></paragraph><paragraph id="H6629F21A280A43B48DF24501EDE1DC4C"><enum>(6)</enum><header>Advisement</header><text>Guidelines related to advising such an individual orally and in written form during the following
			 steps in the process of the individual being temporarily involuntarily
			 committed or held:</text>
					<subparagraph id="H444A053DD5ED436793D4A10B9B3BCCA2"><enum>(A)</enum><header>Transport</header><text>After an initial detention by a qualified professional (as defined by the State) to transport a
			 patient to a facility, an oral advisement containing critical information
			 as determined by the Secretary must be given to the individual being
			 transported to a facility for an assessment.</text>
					</subparagraph><subparagraph id="HA299F87A5EAA4ACABCFEE5E55DD77161"><enum>(B)</enum><header>Upon Admission</header><text>Upon admission, after a determination of dangerousness by a qualified professional, an oral
			 advisement by a mental health professional containing critical information
			 as determined by the Secretary must be given to the individual.</text>
					</subparagraph></paragraph><paragraph id="H7384EF4285ED4975BB34939833B107E5"><enum>(7)</enum><header>Additional guidelines</header><text>Any other guidelines deemed necessary by the Secretary for purposes of this Act.</text>
				</paragraph></subsection><subsection id="H2683474D37DA4A7B875B26AA2ABD399B"><enum>(c)</enum><header>Certification process</header><text>The Secretary of Health and Human Services shall establish a process for certifying that States are
			 in compliance with the guidelines described in subsections (a) and (b) for
			 purposes of establishing the compliance of such States under section 2(c).</text>
			</subsection><subsection id="H96CB65D1ECFE4DB3A22EDD009F57297D"><enum>(d)</enum><header>Consultation with stakeholders</header><text>In establishing guidelines described in paragraphs (1), (2), and (5) of subsection (a) and
			 paragraphs (2), (3), (4), and (5) of subsection (b), the Secretary of
			 Health and Human Services shall consult with relevant mental health
			 professional organizations and stakeholders, such as the American
			 Psychological Association and the American Psychiatric Association.</text>
			</subsection></section><section id="HB7CDB98BB3094F8C8050B9DE36DC0454"><enum>5.</enum><header>Miscellaneous</header>
			<subsection id="H8BEE19697CA44A039E9C47EC75AFF330"><enum>(a)</enum><header>Individuals temporarily involuntarily committed or held To be treated as distinct from others who
			 are involuntarily committed</header><text display-inline="yes-display-inline">For purposes of the National Instant Criminal Background Check System, the provisions of this Act,
			 and <external-xref legal-doc="usc" parsable-cite="usc/18/922">section 922</external-xref> of title 18, United States Code, individuals who are
			 temporarily involuntarily committed or held under a State-level process
			 with respect to which the State has been certified under section 4(c)
			 shall be treated as a separate and distinct population from individuals
			 who are involuntarily committed through a judicial process.</text>
			</subsection><subsection id="H25FBDE57FCC0466BA8BEA95DD72443F0"><enum>(b)</enum><header>Limiting liability for mental health professionals</header><text display-inline="yes-display-inline">Any mental health professional who does not report under a reporting system established under
			 section 2(a)(1), in accordance with guidelines established under section
			 4(a), information described in paragraph (2), (3), or (4) of section 2(a),
			 with respect to an individual described in such respective paragraph,
			 shall not be held liable in any civil action in State or Federal court for
			 any damages resulting from such failure to report such information.</text>
			</subsection><subsection id="HF8501B70ADA24D9DA3F404B613763610"><enum>(c)</enum><header>Determination of dangerousness</header><text>For purposes of this Act, a determination of dangerousness, with respect to an individual, shall be
			 predicated on the presence of either—</text>
				<paragraph id="HACEABEC47BB245F885C8BC6DF3F7FD82"><enum>(1)</enum><text>a substantial risk of physical harm to the individual as manifested by evidence of, threats of, or
			 attempts at, suicide or serious bodily harm; or</text>
				</paragraph><paragraph id="H616CBDE9FFE14EA48D086B3CC6C9CB5D"><enum>(2)</enum><text>a substantial risk of physical harm to another individual as manifested by evidence of homicidal or
			 other violent behavior or evidence that such other individual is placed in
			 reasonable fear of violent behavior and physical harm to such other
			 individual.</text>
				</paragraph></subsection><subsection id="HF4A4AA2B342B47D7A5533BC3D2E7906B"><enum>(d)</enum><header>Study on existing State statutes</header>
				<paragraph id="HDE09D484217F4CC1A74D69507DB3E07D"><enum>(1)</enum><header>Study</header><text>The Secretary of Health and Human Services (in this subsection referred to as the <quote>Secretary</quote>) shall enter into an agreement with the Institute of Medicine (or if the Institute declines to
			 enter into such an agreement, another appropriate entity) to conduct a
			 comprehensive study on State statutes, enacted before the date of the
			 enactment of this Act, that require mental health professionals to
			 directly report certain individuals into State firearm prohibition
			 databases.</text>
				</paragraph><paragraph id="H147BEDA84B4C4164A891C01339765D4B"><enum>(2)</enum><header>Considerations</header><text>The study under paragraph (1) shall include consideration of the following:</text>
					<subparagraph id="H8F8777A325BF4CE7A346A8AFD7638709"><enum>(A)</enum><text>How the State statutes described in such paragraph impact the quality of care provided by mental
			 health professionals to patients.</text>
					</subparagraph><subparagraph id="HD3D84A6BAFEB48FC8D52BB56D349F030"><enum>(B)</enum><text display-inline="yes-display-inline">How such State statutes impact a patient’s decision to access mental health treatment.</text>
					</subparagraph><subparagraph id="H130A1CB2F9224CEC9139B4D55E9CFBF1"><enum>(C)</enum><text>The effectiveness of such State statutes as interventions for preventing firearm-related violence.</text>
					</subparagraph><subparagraph commented="no" id="H745EA50664E444309B6EF002DB14C294"><enum>(D)</enum><text>Any other relevant considerations, as determined by the Institute of Medicine (or, if applicable,
			 the other appropriate entity described in paragraph (1)).</text>
					</subparagraph></paragraph><paragraph id="HC77961E8EDFD4929A9A4DFA40027817E"><enum>(3)</enum><header>Report</header><text>The Secretary shall ensure that, not later than 12 months after the date of enactment of this Act—</text>
					<subparagraph id="H6D92363DC7194FA18580129406CCB446"><enum>(A)</enum><text>the study under subparagraph (1) is completed; and</text>
					</subparagraph><subparagraph id="H1D9F0B96FED94C91BF933E12CD7A7D58"><enum>(B)</enum><text>a report on the finding and conclusions of such study is submitted to the Congress.</text>
					</subparagraph></paragraph></subsection><subsection id="HEBAC46849A8E445DA551E7E7762A1E25"><enum>(e)</enum><header>Amending references from persons adjudicated as a mental defective to ineligible due to
			 disqualifying mental status</header>
				<paragraph id="H2341DCBD853148B59DDD036B8C061FC4"><enum>(1)</enum><header>In general</header>
					<subparagraph id="H942EDCCA309040799D84F7446BBE63BF"><enum>(A)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/18/175b">Section 175b(d)(2)(F)</external-xref> of title 18, United States Code, is amended by striking <quote>adjudicated as a mental defective,</quote> and inserting <quote>adjudicated as ineligible due to disqualifying mental status</quote>.</text>
					</subparagraph><subparagraph id="H4AF4131B7BE44BE5B143DF5BD8574D10"><enum>(B)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/18/842">Section 842</external-xref> of title 18, United States Code, is amended—</text>
						<clause id="HBAD41DB195B148B8B2D72D9CC82EF7AC"><enum>(i)</enum><text>in subsection (d)(6), by striking <quote>adjudicated a mental defective,</quote> and inserting <quote>adjudicated as ineligible due to disqualifying mental status</quote>; and</text>
						</clause><clause id="H57919E80B31D413AABC5248418E18E27"><enum>(ii)</enum><text>in subsection (i)(4), by striking <quote>adjudicated as a mental defective,</quote> and inserting <quote>adjudicated as ineligible due to disqualifying mental status</quote>.</text>
						</clause></subparagraph><subparagraph id="H2287D9E8FD21468DB0681DABD32EACC0"><enum>(C)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/18/922">Section 922</external-xref> of title 18, United States Code, is amended—</text>
						<clause id="H46C2AAA57ABA4D30801D449F0B181DBB"><enum>(i)</enum><text>in subsection (d)(4), by striking <quote>adjudicated as a mental defective,</quote> and inserting <quote>adjudicated as ineligible due to disqualifying mental status</quote>;</text>
						</clause><clause id="HD8AA9B218921498394571D03EB265272"><enum>(ii)</enum><text>in subsection (g)(4), by striking <quote>adjudicated as a mental defective,</quote> and inserting <quote>adjudicated as ineligible due to disqualifying mental status</quote>; and</text>
						</clause><clause id="HA9FA300FFE454524AA95141CD513507F"><enum>(iii)</enum><text>in subsection (s)(3)(B)(iv), by striking <quote>adjudicated as a mental defective,</quote> and inserting <quote>adjudicated as ineligible due to disqualifying mental status</quote>.</text>
						</clause></subparagraph><subparagraph id="H965304EFA07645C1B62D196645A23922"><enum>(D)</enum><text display-inline="yes-display-inline">The NICS Improvement Amendments Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/18/922">18 U.S.C. 922</external-xref> note) is amended—</text>
						<clause id="H9437B8BD76854E388054701767DF9891"><enum>(i)</enum><text>in section 3(2), by striking <quote>adjudicated as a mental defective,</quote> and inserting <quote>adjudicated as ineligible due to disqualifying mental status</quote>;</text>
						</clause><clause id="H20C8926B401F4A69A356F2C8765F61C2"><enum>(ii)</enum><text>in section 101—</text>
							<subclause id="HFF91F3577A5B4B65BCC34D2EFBD33BE4"><enum>(I)</enum><text>in subsection (b)(2)(C)(ii), by striking <quote>adjudicated as a mental defective,</quote> and inserting <quote>adjudicated as ineligible due to disqualifying mental status</quote>;</text>
							</subclause><subclause id="HE1A503FF835645F3A9370B48C24DEF20"><enum>(II)</enum><text>in subsection (c)(1)(C), by striking <quote>adjudicated as a mental defective,</quote> and inserting <quote>adjudicated as ineligible due to disqualifying mental status</quote>;</text>
							</subclause><subclause id="HE1F2701A4AF1457C859702F53D6F546F"><enum>(III)</enum><text>in subsection (c)(3), in the matter preceding subparagraph (A), by striking <quote>adjudicate a person as a mental defective,</quote> and inserting <quote>adjudicate a person as ineligible due to disqualifying mental status</quote>; and</text>
							</subclause><subclause id="H0848E0BEFAAE47FC838742A572DA3E30"><enum>(IV)</enum><text>in subsection (c)(3)(A), by striking <quote>adjudicate the person as a mental defective,</quote> and inserting <quote>adjudicate the person as ineligible due to disqualifying mental status</quote>; and</text>
							</subclause></clause><clause id="HBD6D79B72C314998B5AEE7FD9D8353B8"><enum>(iii)</enum><text>in section 102—</text>
							<subclause id="HF4AFBC2B72CE4CA8B1D60A41FFD9D00B"><enum>(I)</enum><text>in subsection (b)(1)(C)(iv), by striking <quote>adjudicated as a mental defective,</quote> and inserting <quote>adjudicated as ineligible due to disqualifying mental status</quote>; and</text>
							</subclause><subclause id="H995E8B04A99343B1829531C7014BB825"><enum>(II)</enum><text>in subsection (c)(3), by striking <quote>adjudicated as a mental defective,</quote> and inserting <quote>adjudicated as ineligible due to disqualifying mental status</quote>.</text>
							</subclause></clause></subparagraph></paragraph><paragraph id="HC4341EB493DA4C829C44174DD86670C7"><enum>(2)</enum><header>References</header><text>For purposes of each provision amended by paragraph (1), a reference to a person adjudicated as
			 ineligible due to disqualifying mental status shall be considered to refer
			 to a person adjudicated as a mental defective, as defined for that
			 provision on the day before the date of enactment of this Act.</text>
				</paragraph><paragraph id="H52D167C1E97F4952B0E91B9E4015F7CD"><enum>(3)</enum><header>Regulations</header><text>For purposes of regulations issued to carry out a provision amended by paragraph (1)—</text>
					<subparagraph id="H9B14EC81EA5E479EB82E17A68D077F35"><enum>(A)</enum><text>before the regulations are amended to carry out this subsection a reference in the regulations to a
			 person adjudicated as a mental defective shall be considered to be a
			 reference to a person adjudicated as ineligible due to disqualifying
			 mental status; and</text>
					</subparagraph><subparagraph id="H331B252654864354A0C464748BE2554A"><enum>(B)</enum><text>in amending the regulations to carry out this subsection, a Federal agency shall ensure that the
			 regulations clearly state that persons adjudicated as ineligible due to
			 disqualifying mental status were formerly termed persons adjudicated as a
			 mental defective.</text>
					</subparagraph></paragraph><paragraph id="HC1FCCF94B4554B6785F60C6E90CC502C"><enum>(4)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to alter or otherwise affect the definition of
			 persons previously termed <quote>adjudicated as a mental defective</quote> under provisions amended by paragraph (1).</text>
