<enum>I</enum><header>Improving the Nutritional Quality of and Access to Foods in Underserved American Communities</header>
<subtitle id="HE332AD6CE92C4176AAD3C0516F77500C"><enum>A</enum><header>Access to Nutritious and Quality Foods in Underserved American Communities </header>
<section commented="no" display-inline="no-display-inline" id="H42E34F1DB96343B8AE948AEBFB7E4555" section-type="subsequent-section"><enum>101.</enum><header>Nutritious food access through mobility and innovation program</header>
<subsection commented="no" id="H34867ECCC3B2446D9FB8C9134091F3BD"><enum>(a)</enum><header>Administration</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall carry out a pilot program to make 3-year grants in accordance
with this section to nonprofit organizations, local government agencies,
and accredited colleges and universities.</text>
</subsection><subsection commented="no" id="HADBBEE27BC124D3EB32978AE39CA3C61"><enum>(b)</enum><header>Eligibility</header><text>To be eligible to receive a grant under this section, a nonprofit organization, local government
agency, for-profit business, or accredited college or university shall
submit to the Secretary an application in such form, and containing such
information, as the Secretary may require by rule. Such application shall
include an assurance that such applicant will create or expand an
innovative food distribution project that—</text>
<paragraph id="H3CDC9720F03C453BB5E49B12E4903113"><enum>(1)</enum><text>serves an area in which residents have low income, or an area that is a food desert or food swamp;</text>
</paragraph><paragraph id="HD3823ABE884D43A6960C29D1E2AA2A39"><enum>(2)</enum><text>is not a supermarket-based project;</text>
</paragraph><paragraph id="H2D1FFD4125EA48F69510557CCDE989A7"><enum>(3)</enum><text>provides for the free or low-cost delivery of fresh fruits and vegetables to food recipients who
participate in such project;</text>
</paragraph><paragraph id="H9ACD2C3D704C437A9F407DBCB084CCF0"><enum>(4)</enum><text>provides for the acquisition of produce trucks to distribute food to such recipients without a
delivery charge and without any other service charge; or</text>
</paragraph><paragraph id="H1233EA49F0EC46A4A0AD99034EB9BE25"><enum>(5)</enum><text>provides for the establishment of a community food market (including a food market in a school) at
which fresh fruits and vegetables are sold to such recipients at a low
cost.</text>
</paragraph></subsection><subsection commented="no" id="H8E659063EE64433E9D76DE00A8107BC7"><enum>(c)</enum><header>Priority</header><text>The Secretary shall give priority to—</text>
<paragraph id="H19D6D78DBC0A402DA6514BA26E050B08"><enum>(1)</enum><text>eligible applicants that propose to create or to expand a project that will operate in a
geographical area in which there is a high incidence of childhood obesity;</text>
</paragraph><paragraph id="HF94C0BCCA6784645BC039ABEF78D2D2A"><enum>(2)</enum><text>eligible applicants that have a proven record of serving low-income or minority communities; and</text>
</paragraph><paragraph id="HB1B72EC2C3154957BB44C960CC00C69D"><enum>(3)</enum><text>organizations with plans for sustainability plans in place for continuing successful services after
Federal funding lapses.</text>
</paragraph></subsection><subsection commented="no" id="HDB4D8F6409474F62B7BB4EE717433043"><enum>(d)</enum><header>Reporting</header><text display-inline="yes-display-inline">Each recipient of a 3-year grant made under this section shall submit annually to the Secretary a
report that includes an assessment of—</text>
<paragraph id="H4F53FFDF339947939A970271D22E2212"><enum>(1)</enum><text>the impact that the recipient’s project has had on the community involved during the year for
which such report is submitted; and</text>
</paragraph><paragraph id="HFD25F8ACFF0748E1B0761067B90A6557"><enum>(2)</enum><text>the prospects of continuing such project after the 3-year period for which such grant is made.</text>
</paragraph></subsection></section><section commented="no" id="H5CDC75C987FA48FBA57EA06E7675DCF6"><enum>102.</enum><header>Expansion of the Fresh Fruit and Vegetable Program</header><text display-inline="no-display-inline">Section 19 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1769a">42 U.S.C. 1769a</external-xref>) is amended—</text>
<paragraph commented="no" id="H8DE4A3680CF14B36A718A9D63C54BC67"><enum>(1)</enum><text>in subsection (a), by inserting <quote>, secondary schools, childcare centers, and family childcare homes</quote> after <quote>elementary schools</quote>;</text>
</paragraph><paragraph commented="no" id="H0D7F028745C241188C0219839D63A995"><enum>(2)</enum><text display-inline="yes-display-inline">by amending subsection (b) to read as follows:</text>
<quoted-block display-inline="no-display-inline" id="H80D014D42F464E438E5B777FBBB0F1A6" style="OLC">
<subsection commented="no" id="H0B1C2FC3AE834236811407FB157BCF30"><enum>(b)</enum><header>Program</header><text>A school, childcare center, or family childcare home participating in the program—</text>
<paragraph commented="no" id="H04D44E0DAAD649EFAD20EFE6942AAFFC"><enum>(1)</enum><text display-inline="yes-display-inline">shall make free fruits and vegetables available to students throughout the school, center, or home
day (or at such other times as are considered appropriate by the
Secretary) in 1 or more areas designated by the school, center, or home;
and</text>
</paragraph><paragraph commented="no" id="HC629FA66EE624FAEBDA0D929A5478E5C"><enum>(2)</enum><text display-inline="yes-display-inline">may make free fruits and vegetables in any other form (such as fresh, frozen, dried, pureed, or
canned) available to students throughout the school, center, or home day
(or at such other times as are considered appropriate by the Secretary) in
1 or more areas designated by the school only if such fruits and
vegetables meet any additional nutrition specifications, as established by
the Secretary.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
</paragraph><paragraph commented="no" id="HD4EFA00914394244A43FF6CD26DD0DF8"><enum>(3)</enum><text>in subsection (d)—</text>
<subparagraph commented="no" id="H3C0C339F71694E2AAE81FC9C53E1F213"><enum>(A)</enum><text display-inline="yes-display-inline">in the heading, by inserting <quote><header-in-text level="subsection" style="OLC">, centers, or homes</header-in-text></quote>;</text>
</subparagraph><subparagraph commented="no" id="H6F4BE1CF28154E4A9B891913166FF446"><enum>(B)</enum><text>in paragraph (1)—</text>

</clause><clause commented="no" id="H5B8E1FDC41784530A6EC061C86890982"><enum>(iv)</enum><text>by amending subparagraph (C) to read as follows:</text>
<quoted-block display-inline="no-display-inline" id="HEDE8AFECE67C4F37A4EC2D9AA3FF5EC9" style="OLC">
<subparagraph commented="no" id="H6FB0508590C84E66A0B32DF7395C69F0"><enum>(C)</enum><text display-inline="yes-display-inline">ensure that each school selected is an elementary school or secondary school (as such terms are
defined in section 9101 of the Elementary and Secondary Education Act of
1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)), each center selected is a childcare center (as
such term is defined in section 399OO of the Public Health Service Act),
and each home selected is a family childcare home (as such term is defined
in section 399OO of the Public Health Service Act).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
</clause><clause commented="no" id="H2CDF4CA2B4E84B109538DAA177983C29"><enum>(v)</enum><text>in subparagraph (D)—</text>
<subclause commented="no" id="H5732C766253B480CBD941A8F9275DDA9"><enum>(I)</enum><text display-inline="yes-display-inline">in the matter preceding clause (i), by inserting <quote>, centers, or homes</quote> after <quote>schools</quote>;</text>

</paragraph></section><section id="H9C1C0880E62B436AA359C7F0413510FB"><enum>103.</enum><header>Expanding access to the Summer Food Service Program for Children</header><text display-inline="no-display-inline">Section 13(a) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1761">42 U.S.C. 1761(a)</external-xref>) is amended—</text>
<paragraph commented="no" id="HD9D8B63847CC4C16ACDDE83636B4831C"><enum>(1)</enum><text>in paragraph (1)(A), by striking <quote>50 percent</quote> each place it appears and inserting <quote>40 percent</quote>;</text>
</paragraph><paragraph commented="no" id="H34B1F8E5D18F4DE5B3C9528CCEDD6780"><enum>(2)</enum><text>by repealing paragraph (9); and</text>
</paragraph><paragraph id="H594D27BBC7AB46D0AF94E510944B118E"><enum>(3)</enum><text>in paragraph (10)—</text>
<subparagraph id="HBADEEE08F1A54D85A408862B2022360E"><enum>(A)</enum><text>in subparagraph (A)—</text>
<clause id="H09206E9A81164D60BB7F210A67BAC9E1"><enum>(i)</enum><text>by striking <quote>The Secretary</quote> and inserting <quote>From the amounts appropriated to carry out this paragraph, the Secretary</quote>; and</text>

</subparagraph></paragraph></section><section commented="no" id="HBA21CEFCD9774228B72E26DF35A1B435"><enum>104.</enum><header>Study and report on physical activity and nutritional quality of meals and snacks served in
juvenile justice facilities</header>
<subsection commented="no" id="HF89C4B1FA0944000B2854DA665598ED5"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Administrator of the Office of Juvenile Justice and Delinquency Prevention, in consultation
with the Secretary of Agriculture, shall conduct a study on—</text>
<paragraph commented="no" id="H1A5717A5373C4E4EB91440399EC13CFC"><enum>(1)</enum><text display-inline="yes-display-inline">physical activity by juveniles in juvenile justice facilities, including—</text>
<subparagraph id="H6B332BDC028F4E3D975D10200C9B26F0"><enum>(A)</enum><text>the amount of such physical activity;</text>
</subparagraph><subparagraph id="H57F13488AFDC428089FB7898A12A0B6B"><enum>(B)</enum><text>the types of physical activities in which such juveniles participate;</text>
</subparagraph><subparagraph id="HDB7B7EF63C71499E966CC0B349071E43"><enum>(C)</enum><text>the number of hours per day such juveniles participate in such physical activity;</text>
</subparagraph><subparagraph id="HCDEAC90316544F05963F42624B6779BC"><enum>(D)</enum><text>the degree of inclusiveness for juveniles with disabilities in physical activities;</text>
</subparagraph><subparagraph id="H02088D79096B4606895C5B0E1A36E1E7"><enum>(E)</enum><text>the participation rates for juveniles with disabilities; and</text>
</subparagraph><subparagraph id="H9ECA279DC38D40FF8F4D5BA4D2A934E8"><enum>(F)</enum><text>the adequacy of the amounts and types of physical activity of such juveniles; and</text>
</subparagraph></paragraph><paragraph commented="no" id="HC08836A4D02A41F3B5A4E9DCF9FF98E3"><enum>(2)</enum><text>the nutritional quality of meals and snacks served in juvenile justice facilities.</text>
</paragraph></subsection><subsection commented="no" id="HFA8B07B970EC4A148FC2C85DB4DEF6E6"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than two years after the date of the enactment of this Act, the Administrator of the
Office of Juvenile Justice and Delinquency Prevention, in consultation
with the Secretary of Agriculture, shall submit to Congress a report on
the findings of the study conducted under <internal-xref idref="HF89C4B1FA0944000B2854DA665598ED5" legis-path="115.(a)">subsection (a)</internal-xref>, including an evaluation of whether the amounts and types of physical activity by juveniles, and
the nutritional quality of meals and snacks served, in juvenile justice
facilities are adequate to ensure the health and wellness of such
juveniles.</text>
</subsection></section><section id="H1EE8AA9DDB104806A88B5C8F15B511FC" section-type="subsequent-section"><enum>105.</enum><header>Local food insecurity assessments: evaluating the unique nutritional needs of local communities</header>
<subsection id="HC0C50C772C0F4D87B6A9BF351173CDDA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall establish a 3-year pilot program to award grants
to local and tribal governments, on a competitive basis, to allow such
local and tribal governments, in partnership with the local community
organizations under <internal-xref idref="H7E413194E6FF4BE48D67FA093B7843BC" legis-path="__.(e)">subsection (e)</internal-xref>, to—</text>
<paragraph id="H4F2713B8A9AA460DA2B36CE4AB00ED65"><enum>(1)</enum><text>conduct a food security assessment; and</text>
</paragraph><paragraph id="HFB204F3AA58F4E59BEF464B137670478"><enum>(2)</enum><text>make an inventory of the system in order to identify the strengths and gaps in such system.</text>
</paragraph></subsection><subsection id="H6930F45818BE441E99E570D349C06515"><enum>(b)</enum><header>Data points for Assessment</header><text>For purposes of conducting an assessment and making an inventory under a grant under <internal-xref idref="HC0C50C772C0F4D87B6A9BF351173CDDA" legis-path="__.(a)">subsection (a)</internal-xref>, with respect to the community served by a local or tribal government, such government shall
examine the following food security and food system issues in the
community:<italic></italic></text>
<paragraph id="H2956A1E6472D425596A07B3077AFD51C"><enum>(1)</enum><text>The prevalence of childhood obesity.</text>
</paragraph><paragraph id="H25380C2C4ED5407CAA85267022E63F46"><enum>(2)</enum><text>The availability of safe routes to school for children.</text>
</paragraph><paragraph id="HF44C108CAB1F41FABB42F6EBB612514D"><enum>(3)</enum><text>The quality of food served in school and childcare settings.</text>
</paragraph><paragraph id="HB534F3C7A72A471F88746D0FDA4F3307"><enum>(4)</enum><text>The availability of supermarkets.</text>
</paragraph><paragraph id="H455599C8EDC3442C96086E6DDC498B44"><enum>(5)</enum><text>The cost and availability of fresh fruits and vegetables.</text>
</paragraph><paragraph id="H081AEDF821454E919040F1092F42CD73"><enum>(6)</enum><text display-inline="yes-display-inline">The concentration of convenience stores and other food vendors that sell a disproportionate amount
of foods that are not fresh fruits and vegetables.</text>
</paragraph><paragraph id="HD541388ADA1E44F4BCFA39DE45D7B165"><enum>(7)</enum><text>The availability of products.</text>
</paragraph><paragraph id="H63BDD511FD8348D7A2F8D4C583B19501"><enum>(8)</enum><text>The concentration of fast food restaurants.</text>
</paragraph><paragraph id="HFD17001EF4B34A0A9F7C7B57AD5AA291"><enum>(9)</enum><text>The availability of green space or recreation areas, and the extent to which such space or areas
encourage physical activity by adults and children.</text>
</paragraph><paragraph id="HCC2CCE9D40604C91B90C5A79165FA61F"><enum>(10)</enum><text>Any other issues determined to be relevant by the local or tribal government.</text>
</paragraph><paragraph id="H98A72C74DBE24B67B320F9C09C9DFB80"><enum>(11)</enum><text>Any other issues determined to be relevant by the Secretary of Health and Human Services.</text>
</paragraph></subsection><subsection id="H7117378EE38C43329FF4A44C757A5EC0"><enum>(c)</enum><header>Number of sites</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services, in awarding grants under <internal-xref idref="HC0C50C772C0F4D87B6A9BF351173CDDA" legis-path="__.(a)">subsection (a)</internal-xref>, shall award grants to no more than—</text>
<paragraph id="H936286DFC0B0424B9CA749978607AD34"><enum>(1)</enum><text>20 local governments; and</text>
</paragraph><paragraph id="H3D5F45A3443E4E2EA93E20A57ADA1E75"><enum>(2)</enum><text>5 tribal governments.</text>
</paragraph></subsection><subsection id="H71D42EAFB56544E49BC877F2AE6734A2"><enum>(d)</enum><header>Priority</header><text display-inline="yes-display-inline">In awarding grants under <internal-xref idref="HC0C50C772C0F4D87B6A9BF351173CDDA" legis-path="__.(a)">subsection (a)</internal-xref>, the Secretary of Health and Human Services shall give priority to those local and tribal
governments that serve communities with the highest concentrations of
poverty.</text>
</subsection><subsection id="H7E413194E6FF4BE48D67FA093B7843BC"><enum>(e)</enum><header>Requirement of partnerships</header><text display-inline="yes-display-inline">In order to qualify for a grant under <internal-xref idref="HC0C50C772C0F4D87B6A9BF351173CDDA" legis-path="__.(a)">subsection (a)</internal-xref>, a local or tribal government shall demonstrate, to the satisfaction of the Secretary of Health
and Human Services, that the local or tribal government has entered into a
partnership (for the purpose of conducting an assessment and making an
inventory under <internal-xref idref="HC0C50C772C0F4D87B6A9BF351173CDDA" legis-path="__.(a)">subsection (a)</internal-xref>) with at least one of the following local community organizations:</text>
<paragraph id="HEC6CDCE2A43B4A85808C47E2F37AB964"><enum>(1)</enum><text>A nonprofit, community-based organization or entity.</text>
</paragraph><paragraph id="H238DF8C3BC1C41DD8B5AF4049C22BB08"><enum>(2)</enum><text>A developer or urban planning institution.</text>
</paragraph><paragraph id="HD8299222007A4B84BB0E1DEB42A0B589"><enum>(3)</enum><text display-inline="yes-display-inline">An accredited college or university.</text>
</paragraph><paragraph id="H59376F2517AF41EABF1545EF779827CD"><enum>(4)</enum><text display-inline="yes-display-inline">A freestanding children’s hospital or center with expertise in child health and policy.</text>
</paragraph></subsection></section><section id="H118D977B840942F2A550E9F5BAF2064E" section-type="subsequent-section"><enum>106.</enum><header>Weekends and holidays without hunger</header><text display-inline="no-display-inline">Section 18 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1769">42 U.S.C. 1769</external-xref>) is amended by
adding at the end the following:</text>

<subsection id="HA4472B80F99D4A21AB12E2A39E4C9F52"><enum>(l)</enum><header>Weekends and holidays without hunger</header>
<paragraph id="H29D7F9FC35614AE9B151D4BD7A5AAADC"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text>
<subparagraph id="H98E2970CE45847B784DBCCF283CA93BC"><enum>(A)</enum><header>At-risk school child</header><text>The term <term>at-risk school child</term> has the meaning given the term in section 17(r)(1).</text>
</subparagraph><subparagraph id="H714714E175AE4D4B9343AE3460336F65"><enum>(B)</enum><header>Eligible institution</header>
<clause id="HA4ADBD24326D45398B22FEF4CE7E725C"><enum>(i)</enum><header>In general</header><text>The term <term>eligible institution</term> means a public or private nonprofit institution that is determined by the Secretary to be able to
meet safe food storage, handling, and delivery standards established by
the Secretary.</text>
</clause><clause id="HF57613CC4D19498EBC61DB606348DC17"><enum>(ii)</enum><header>Inclusions</header><text>The term <term>eligible institution</term> includes—</text>
<subclause id="H38AAD9ED532B422E88164E6621B36D9D"><enum>(I)</enum><text>an elementary or secondary school or school food service authority;</text>
</subclause><subclause id="H83467EB8A2704C80A1BB5776E5B55BB3"><enum>(II)</enum><text>a food bank or food pantry;</text>
</subclause><subclause id="H4800B5265A064973A48A16288DF7B31F"><enum>(III)</enum><text>a homeless shelter; and</text>
</subclause><subclause id="H1DD3B503DC1A4D41A997BAD9234E6012"><enum>(IV)</enum><text>such other type of emergency feeding agency as is approved by the Secretary.</text>
</subclause></clause></subparagraph></paragraph><paragraph id="H7E2D8B10BC884DCB97A10A85430884AF"><enum>(2)</enum><header>Establishment</header><text display-inline="yes-display-inline">Subject to the availability of appropriations provided in advance in an appropriations Act
specifically for the purpose of carrying out this subsection, the
Secretary shall establish a program under which the Secretary shall
provide commodities, on a competitive basis, to eligible institutions to
provide nutritious food to at-risk children on weekends and during
extended school holidays during the school year.</text>
</paragraph><paragraph id="HC8DFA3E712134C2FB20F86C9560F7AF1"><enum>(3)</enum><header>Eligibility</header>
<subparagraph id="H07D5FD38637C4012B8F3AFA6910AAE50"><enum>(A)</enum><header>In general</header><text>To be eligible to receive commodities under this subsection, an eligible institution shall submit
an application to the Secretary at such time, in such manner, and
containing such information as the Secretary may determine.</text>
</subparagraph><subparagraph id="H10D1CD24E9884045B671C4DCC325662B"><enum>(B)</enum><header>Plan</header><text>An application under subparagraph (A) shall include the plan of the eligible institution for the
distribution of nutritious foods to at-risk school children, including—</text>
<clause id="HC270BCA66E5147B7AD8E4CD2542A086C"><enum>(i)</enum><text>methods of food service delivery to at-risk school children;</text>
</clause><clause id="HEC42F338F2E84930A89CCF0C7E6ECED9"><enum>(ii)</enum><text>assurances that children receiving foods under the project will not be publicly separated or
overtly identified;</text>
</clause><clause id="HDFB2F8B4BCD741938E90ABEDC86B534E"><enum>(iii)</enum><text>lists of the types of food to be provided under the project and provisions to ensure food quality
and safety;</text>
</clause><clause id="HC3213CD6817F4F7AAEE90C97194899D1"><enum>(iv)</enum><text>information on the number of at-risk school children to be served and the per-child cost of
providing the children with food; and</text>
</clause><clause id="H6AAC460C372A4406AE72363993AB9266"><enum>(v)</enum><text>such other information as the Secretary determines to be necessary to assist the Secretary in
evaluating projects that receive commodities under this subsection.</text>
</clause></subparagraph></paragraph><paragraph id="H5E652864364D4CEA9A262C4395C60D7C"><enum>(4)</enum><header>Priority</header><text>In selecting applications under this subsection, the Secretary shall give priority to eligible
institutions that—</text>
<subparagraph id="H2E8E465BFFB2487DBAC60F0CF4D3AAF9"><enum>(A)</enum><text>have on-going programs and experience serving populations with significant proportions of at-risk
school children;</text>
</subparagraph><subparagraph id="H9CC836081336434FBC291267BD9BB1D2"><enum>(B)</enum><text>have a good record of experience in food delivery and food safety systems;</text>
</subparagraph><subparagraph id="H5AA21F34EE31419CA598972CBC042278"><enum>(C)</enum><text>maintain high quality control, accountability, and recordkeeping standards;</text>
</subparagraph><subparagraph id="HF03DDBDCF37B438B871C880E03FCD52C"><enum>(D)</enum><text>provide children with readily consumable food of high nutrient content and quality;</text>
</subparagraph><subparagraph id="HECEC02BB55C1462F9AB14CCCAC95AC5A"><enum>(E)</enum><text>demonstrate cost efficiencies and the potential for obtaining supplemental funding from non-Federal
sources to carry out projects; and</text>
</subparagraph><subparagraph id="HE9580E3130AA40C2897A7B488AC80215"><enum>(F)</enum><text>demonstrate the ability to continue projects for the full approved term of the pilot project
period.</text>
</subparagraph></paragraph><paragraph id="H33C3D34D8E8F4B2CAA40490FB5ED3257"><enum>(5)</enum><header>Guidelines</header>
<subparagraph id="HEC4A440D3ACE43AF966AA968196CAAFA"><enum>(A)</enum><header>In general</header><text>The Secretary shall issue guidelines containing the criteria for projects to receive commodities
under this subsection.</text>
</subparagraph><subparagraph id="H5F9F494746224AAF83195AFF4DD6CC7C"><enum>(B)</enum><header>Inclusions</header><text>The guidelines shall, to the maximum extent practicable within the funds available and applications
submitted, take into account—</text>
<clause id="HE2B9E333A5354316808ABAE9AA640A88"><enum>(i)</enum><text>geographical variations in project locations to include qualifying projects in rural, urban, and
suburban areas with high proportions of families with at-risk school
children;</text>
</clause><clause id="H6A4A30EA9768493EA8B8A0DF6B63717B"><enum>(ii)</enum><text>different types of projects that offer nutritious foods on weekends and during school holidays to
at-risk school children; and</text>
</clause><clause id="H6DBE3CF08A5446D38CA2D0B0F2000B61"><enum>(iii)</enum><text>institutional capacity to collect, maintain, and provide statistically valid information necessary
for the Secretary—</text>
<subclause id="HB6A07B85E24244788029EA896E448E33"><enum>(I)</enum><text>to analyze and evaluate the results of the pilot project; and</text>
</subclause><subclause id="HFABAEE0AD18745B7A64594340E82D166"><enum>(II)</enum><text>to make recommendations to Congress.</text>
</subclause></clause></subparagraph></paragraph><paragraph id="H52D74E2950C34225BDB0C86533FF4CE5"><enum>(6)</enum><header>Evaluation</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H916C262912C64E99B972D65EBEB0D381"><enum>(A)</enum><header>Interim evaluation</header><text display-inline="yes-display-inline">Not later than November 30, 2016, the Secretary shall complete an interim evaluation of the pilot
program carried out under this subsection.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB2592D665E0F4E6EA71C1FB62C980DCE"><enum>(B)</enum><header>Final report</header><text display-inline="yes-display-inline">Not later than December 31, 2017, the Secretary shall submit to Congress a final report that
contains—</text>
<clause commented="no" display-inline="no-display-inline" id="H70F1DE9FF07F4EF89E70572ED2C9DA53"><enum>(i)</enum><text display-inline="yes-display-inline">an evaluation of the pilot program carried out under this subsection; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="H6701EE8AC8D9419D81C8BABC32557CD3"><enum>(ii)</enum><text>any recommendations of the Secretary for legislative action.</text>
</clause></subparagraph></paragraph><paragraph id="H27E46B64AFD74BA88487AC628F18368F"><enum>(7)</enum><header>Funding</header>
<subparagraph id="H5B4235B5A570402DADF37F2D111BEB1B"><enum>(A)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section such sums as are necessary, to
remain available until expended.</text>
</subparagraph><subparagraph id="H5CFF90AC20164C2AA7A63DE8B7B30B83"><enum>(B)</enum><header>Availability of funds</header><text>Not more than 3 percent of the funds made available under subparagraph (A) may be used by the
Secretary for expenses associated with review of the operations and
evaluation of the projects carried out under this subsection.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</section></subtitle><subtitle id="H9803EA52560145499B8B324958B7F12D"><enum>B</enum><header>Ensuring a Healthy Start for Children in Underserved American Communities </header>
<section id="H26050837A4B247AD9428AB0D380267AF"><enum>111.</enum><header>Improving healthy eating and physical activity among our youngest children</header><text display-inline="no-display-inline">Title III of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/241">42 U.S.C. 241 et seq.</external-xref>) is amended by adding at the end
the following:</text>
<quoted-block display-inline="no-display-inline" id="HD6B9A4CAB7E34E87B1748AF947B9D56D" style="OLC">
<part id="HA6C8E4048BFE46D5AA3E7B36F1EBA76A"><enum>W</enum><header>Healthy kids program</header>
<section id="H39580609727D45758A1DBA741826BD5C"><enum>399OO.</enum><header>Definitions</header><text display-inline="no-display-inline">In this part:</text>
<paragraph id="H7B272350410C4855ABC0316C344C1EE1"><enum>(1)</enum><header>Childcare center</header><text>The term <term>childcare center</term> means a center licensed or otherwise authorized to provide childcare services for fewer than 24
hours per day per child in a nonresidential setting, unless care in excess
of 24 hours is due to the nature of the parents' work.</text>
</paragraph><paragraph id="H509F4C18954D41ABB5BFB8A9F9916EC5"><enum>(2)</enum><header>Early learning council</header><text>The term <term>early learning council</term> means an early childhood assembly that is established to advise Governors, State legislators, or
State agency administrators on how best to meet the needs of young
children and their families specifically through improvement of programs
and services.</text>
</paragraph><paragraph id="HC4D58E72C91F4AFAB9F9B3155BD6D8D2"><enum>(3)</enum><header>Family childcare home</header><text>The term <term>family childcare home</term> means a private family home where home-based childcare is provided for a portion of the day,
unless care in excess of 24 hours is due to the nature of the parents’
work, and that is certified, registered, or licensed in the State in which
it is located.</text>
</paragraph><paragraph id="H75E70EB3083B4AEBB8EFE35BCF4095EB"><enum>(4)</enum><header>Screen time limits</header><text>The term <term>screen time limits</term> means policies or guidelines, such as those developed by the American Academy of Pediatrics,
designed to reduce the daily amount of time that children spend watching
or looking at digital monitors or displays, including television sets,
computer monitors, or hand-held gaming devices.</text>
</paragraph><paragraph id="HEF7B1C7B99A44C1EB923DD07890B9ED0"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services.</text>
</paragraph></section><section id="HC518BE70D8A74703935BBE560FA820AE"><enum>399OO–1.</enum><header>Grants</header>
<subsection id="H2678A88FD7AE445EA4BB91B4998734C8"><enum>(a)</enum><header>In general</header><text>The Secretary, in consultation with appropriate entities within the Department of Health and Human
Services, shall award 3-year competitive grants to 5 State health
departments (or other appropriate childcare licensing entities within such
States) to help reduce and prevent obesity among the birth to 5-year-old
population of the State in childcare settings outside a child's place of
residence.</text>
</subsection><subsection id="H9BFCFD35EBBE4C9291E609B9C0E42818"><enum>(b)</enum><header>Use of funds</header><text>State grantees shall use amounts received under a grant under this subsection to—</text>
<paragraph id="H5248BF052AC247E8A5CED4C6CCBCA0BD"><enum>(1)</enum><text>provide, or enter into contracts to provide, training (that meets the requirements of subsection
(c)) to the staff of national, State, or community-based organizations
with networks of childcare centers, or a consortium of childcare centers
and family childcare homes consisting of at least 10 centers, for the
purpose of implementing evidence-based healthy eating and physical
activity policies and practices, including curricula and other
interventions; and</text>
</paragraph><paragraph id="HA21ECAC5D4CB48BB82BD12F78CFD1E5E"><enum>(2)</enum><text>provide grants to childcare centers and family childcare homes, whose staff received the training
described in paragraph (1), to implement practice, curricula, and policy
changes (that meet the requirements of subsection (d)) that promote
healthy eating and physical activity among the birth to 5 years of age
population.</text></paragraph><continuation-text continuation-text-level="subsection">Preference in awarding grants shall be given to those States that demonstrate collaboration between
relevant State entities related to childcare and health and with key
stakeholders, such as State early learning councils and other
community-based organizations working with childcare centers or family
childcare homes.</continuation-text></subsection><subsection id="H5EE96EBA749C4CA1B06C89DD75834486"><enum>(c)</enum><header>Training requirements</header>
<paragraph id="H44AD01A5BA71476980BD41A66D8D7ED1"><enum>(1)</enum><header>In general</header><text>Training provided under subsection (b) shall—</text>
<subparagraph id="H198FE1DCB72347858644966F8F925CB4"><enum>(A)</enum><text>include the provision of information concerning age-appropriate healthy eating and physical
activity interventions and culturally competent curricula for the birth to
5 years of age population in the State involved, which at a minimum shall
include—</text>
<clause id="H2D000ECC7879406DB5B8AAE7FBDCD11D"><enum>(i)</enum><text>a handbook that includes recommendations, guidelines, and best practices for childcare centers and
family childcare homes relating to healthy eating, physical activity, and
screen time reduction;</text>
</clause><clause id="HE3A24A6166CD49B395A5B39B3E5E3AEB"><enum>(ii)</enum><text>information about the availability of and services provided by childcare health consultants; and</text>
</clause><clause id="HB1D942B1EFF04CC68B439FE25B8E2426"><enum>(iii)</enum><text>health and wellness resources available through the Child Care Bureau and the Maternal and Child
Health Bureau;</text>
</clause></subparagraph><subparagraph id="HBEB5B7FE3AF442B9A7FD0D1C7A27D87E"><enum>(B)</enum><text>identify, improve upon, and expand nutrition and physical activity best practices targeted to the
birth to 5 years of age population in the State involved and identify
strategies for incorporating parental education and other parental
involvement; and</text>
</subparagraph><subparagraph id="H7E1378323218498F876A3B6808DF8EBB"><enum>(C)</enum><text>provide instruction on how to appropriately model, direct, and encourage childcare staff behavior
to apply the best practices and strategies identified under subparagraph
(B).</text>
</subparagraph></paragraph><paragraph id="HD8AB8ECABFC54077A52C1EF1827D9993"><enum>(2)</enum><header>Training entities</header><text>A grantee may conduct the training required under this section directly, or may provide such
training through a contract with—</text>
<subparagraph id="HEC69FA5C40404B09A190F78C6F7CE0DB"><enum>(A)</enum><text>an appropriate national, State, or community organization with relevant expertise;</text>
</subparagraph><subparagraph id="H0BCD12F7D3BA42EAB86E9A5FFBAA2ED5"><enum>(B)</enum><text>a health care provider or professional organization with relevant expertise;</text>
</subparagraph><subparagraph id="H667928EFE9524148992A2C261013CE28"><enum>(C)</enum><text>a university or research center that employs faculty with relevant expertise; or</text>
</subparagraph><subparagraph id="H520F5DB0DC8D4A6D8E96C5D8914B81BE"><enum>(D)</enum><text>any other entity determined appropriate by the State and approved by the Secretary.</text>
</subparagraph></paragraph><paragraph id="H07586379F26D4DB99D2C214C832A162E"><enum>(3)</enum><header>Requirement of contract</header><text>If a grantee elects to provide the training under this section through a contract, the grantee
shall ensure that a consistent healthy eating and physical activity
curriculum is being developed for all childcare entities participating in
the pilot program in the State.</text>
</paragraph></subsection><subsection id="H639BD5B1A1F6421D8C0658CE274FB84E"><enum>(d)</enum><header>Practice, curricula, and policy changes</header><text>After training is provided as required under subsection (c), a State grantee shall ensure that the
organizations and consortia involved—</text>
<paragraph id="H2E437B615FBE4332B97DCD1A63DF28F8"><enum>(1)</enum><text>implement, in childcare settings, evidence-based policy changes that promote healthy eating,
physical activity, and appropriate screen time limits among the birth to 5
years of age population;</text>
</paragraph><paragraph id="H1060E9B9AFFA4595962FCA4BA6B340F3"><enum>(2)</enum><text>utilize an evidence-based, culturally competent healthy eating and physical activity curriculum in
childcare settings focusing on such birth to age 5 population;</text>
</paragraph><paragraph id="HE11849B4BF7A4D29A4DACEC28B73299E"><enum>(3)</enum><text>implement programs, activities, and procedures for incorporating parental education and involvement
of parents in programs, including disseminating a written parental
involvement policy, and coordinating and integrating parental involvement
strategies under this section, to the extent feasible and appropriate,
with parental involvement strategies under other programs, such as the
Head Start program and the Early Head Start Program; and</text>
</paragraph><paragraph id="HC72C94697C70468681896DCBEBE7F0CA"><enum>(4)</enum><text>find innovative ways to remove barriers that exist to providing opportunities for healthy eating
and physical activity.</text></paragraph><continuation-text continuation-text-level="subsection">All activities described in this paragraph shall be evidence-based and be consistent with the
curriculum presented through training activities described in subsection
(c).</continuation-text></subsection></section><section id="H9F0D5BB3AADE43DEB53E6BA5FB159D84"><enum>399OO–2.</enum><header>Grants for the evaluation of pilot programs</header><text display-inline="no-display-inline">The Secretary shall award competitive grants to prevention research centers or universities to
evaluate the programs carried out with grants under section 399OO–1,
including baseline, process, and outcome measurements.</text>
</section><section id="H0DCF5590E9844D65941AF7E792234B40"><enum>399OO–3.</enum><header>Coordination</header>
<subsection id="H878E0FB4216A4228BD14ABF3B106D146"><enum>(a)</enum><header>Interagency coordination</header><text>To the extent practicable, the Secretary shall coordinate activities conducted under this part with
activities undertaken by the National Prevention, Health Promotion and
Public Health Council established under section 4001 of the Patient
Protection and Affordable Care Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/148">Public Law 111–148</external-xref>). Where
practicable, such coordination shall—</text>
<paragraph id="H027D236C6BAC4A0AB5C9C1122D5F2B9A"><enum>(1)</enum><text>include the sharing of current and emerging best practices concerning healthy eating, physical
activity, and screen time limits that have a population-level impact in
promoting nutrition and physical activity in childcare settings;</text>
</paragraph><paragraph id="H684B0B7377AC403888EE0C60631D503D"><enum>(2)</enum><text>promote the effective implementation and sustainability of such programs; and</text>
</paragraph><paragraph id="HC5C4EF880AF94AEAB148039353734C4D"><enum>(3)</enum><text>avoid unnecessary duplication of effort.</text>
</paragraph></subsection><subsection id="H0365F5BAAC80426C8521CB133BCBACC8"><enum>(b)</enum><header>Pilot coordination</header><text>The Secretary shall designate an individual (directly or through contract) to provide technical
assistance to States and pilot centers in the development, implementation,
and evaluation of activities and dissemination of information described in
paragraphs (1), (2), and (3) of subsection (a).</text>
</subsection></section><section id="H7E34C53CCC4543A7A01CBCFDF5EEEBB8"><enum>399OO–4.</enum><header>Evaluation and reporting</header>
<subsection id="H5DB37CD2DCC7492E843441F1218C647E"><enum>(a)</enum><header>Technical assistance and information</header><text>The Secretary shall—</text>
<paragraph id="H58169F2FED70430EA035513E13C757FC"><enum>(1)</enum><text>provide technical assistance to grantees and other entities providing training under a grant under
this part; and</text>
</paragraph><paragraph id="HA3E0D8F8EEAD4FE3BE3761D54177629F"><enum>(2)</enum><text>disseminate to health departments and trainers under grants under this part information concerning
evidence-based approaches, including dissemination of existing toolkits,
curricula, and existing or emerging best practices that can be expanded or
improved upon through a program conducted under this part.</text>
</paragraph></subsection><subsection id="H5B89953AA31645FCAD33B4373532B101"><enum>(b)</enum><header>Evaluation requirements</header><text>With respect to evaluations conducted under section 399OO–2, the Secretary shall ensure that—</text>
<paragraph id="HD057133D8CDF478BA3411C98E965B488"><enum>(1)</enum><text>evaluation metrics are consistent across all programs funded under this part;</text>
</paragraph><paragraph id="HC24BACDFE3E34E55B54A99FC5C4B72B3"><enum>(2)</enum><text>interim outcomes are measured by the number of centers that have implemented policy and
environmental strategies that support use of curricula and practices
supporting healthy eating, physical activity, and screen time limits;</text>
</paragraph><paragraph id="HF7420033FE214B05A97656E520152091"><enum>(3)</enum><text>interim outcomes are measured, to the extent possible, by behavior changes in healthy eating,
physical activity, and screen time; and</text>
</paragraph><paragraph id="H9C76344AD0EB49DD9F39AEF1E385C6FF"><enum>(4)</enum><text>upon completion of the program, the evaluation shall include an identification of best practices
relating to behavior change and reductions in the increasing prevalence of
overweight and obesity that could be replicated in other settings.</text>
</paragraph></subsection><subsection id="H264D5459C47A45558CB32065D8B1D43B"><enum>(c)</enum><header>Dissemination of information</header><text>Upon the conclusion of the programs carried out under this part, the Secretary shall disseminate to
all appropriate agencies within the Department of Health and Human
Services evidence, best practices, and lessons learned from grantees. Such
agencies shall encourage the adoption of the best practices.</text>
</subsection><subsection id="HA0B857790FDA4357B46B0DC6CADF4E34"><enum>(d)</enum><header>Report to Congress</header><text>Not later than 6 months after the completion of the program under this part, the Secretary shall
submit to Congress a report containing an evaluation of the program,
including recommendations as to how lessons learned from the program can
be incorporated into future guidance documents developed and provided by
the Secretary and other Federal agencies, as appropriate.</text>
</subsection></section><section id="H0D9D358ADD4C4D54B83FB7669FF300B8"><enum>399OO–5.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to carry out this part, $2,500,000 for each of fiscal years
2015, 2016, and 2017.</text></section></part><after-quoted-block>.</after-quoted-block></quoted-block>
</section><section id="H7D7D94EB8A5E4F278828C403F4B6572D"><enum>112.</enum><header>Health and fitness school programs: training America’s youth to live healthy lifestyles</header>
<subsection id="H5187D5F17D634C2C952787420C630308"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretaries shall carry out a 2-year pilot program consisting of awarding grants to eligible
entities for the purpose of establishing or expanding evidence-based
health and fitness programs in secondary schools in low-income
communities.</text>
</subsection><subsection id="H2BB2E2D8C0254DC287346236BCCE5CB9"><enum>(b)</enum><header>Health and fitness program requirements</header><text display-inline="yes-display-inline">As a condition on receipt of a grant under this section, an eligible entity shall agree that any
health and fitness program at a secondary school funded through the grant
will—</text>
<paragraph id="HD727E0576FD241499E0498973CBD65BF"><enum>(1)</enum><text display-inline="yes-display-inline">be conducted in partnership with the secondary school, community entities, and tribal councils;</text>
</paragraph><paragraph id="H09E44B763FE444398771B2CCCC4E11C5"><enum>(2)</enum><text display-inline="yes-display-inline">ensure the services provided are inclusive of students with disabilities;</text>
</paragraph><paragraph id="HFA3A287B1FAC4C42846E9DAFB04939E5"><enum>(3)</enum><text>include services by recent graduates of institutions of higher education who are interested in
pursuing graduate degrees in medicine, nursing, nutrition science,
exercise physiology, public health, or a related discipline;</text>
</paragraph><paragraph id="HAA2C08FE869F46E799C744440D5E5A70"><enum>(4)</enum><text>use services by such graduates to supplement rather than supplant the health and fitness curriculum
of the secondary school;</text>
</paragraph><paragraph id="H20190EAE4DD0412FB12138845CEE41F9"><enum>(5)</enum><text>include a highly effective student-mentor intervention and education program conducted by such
graduates for a maximum of 2 years of service in 1 secondary school per
graduate;</text>
</paragraph><paragraph id="H6409A939EA2745BBB4A9C0806F5F9860"><enum>(6)</enum><text>build a healthier community through wellness activities and increased awareness about and access to
healthy foods;</text>
</paragraph><paragraph id="HD673E46D68814723955485C7526D697B"><enum>(7)</enum><text>provide daily health and fitness instruction to both students and faculty;</text>
</paragraph><paragraph id="H8C43F26085A245E7B5643F11DE1CBAF0"><enum>(8)</enum><text display-inline="yes-display-inline">conduct an annual in-school health and fitness fair using the services of secondary school students
with the objective of building a healthier community through wellness
activities and increased awareness about and access to healthy foods;</text>
</paragraph><paragraph id="HFEC1EC29D3F64078914B6527CB2868F5"><enum>(9)</enum><text display-inline="yes-display-inline">conduct an annual school-based and an annual community-based health and fitness fair using the
services of secondary school students with the objective of building a
healthier community through wellness activities and increased awareness
about and access to healthy foods; and</text>
</paragraph><paragraph id="H9F4725F99C9F4935B18F31EE0EDDD1F6"><enum>(10)</enum><text>expose secondary school students to a variety of career choices in wellness and health-related
disciplines, including careers in medicine, nursing, nutrition science,
and exercise physiology.</text>
</paragraph></subsection><subsection id="HCD35C8B78A7E48DEB072D93785FE42FD"><enum>(c)</enum><header>Non-Federal funds</header><text>The Secretaries shall encourage grantees under this section to contribute funds from non-Federal
sources to increase—</text>
<paragraph id="H0CCC6D77DF6740808E29E77A39B721A5"><enum>(1)</enum><text>the number of secondary schools at which health and fitness programs are offered; or</text>
</paragraph><paragraph id="H050BBAA1C8B14D63B3E8200C2A992467"><enum>(2)</enum><text>the longevity of such programs.</text>
</paragraph></subsection><subsection id="HD8EF6EB6446149DDABD95512257DD2B4"><enum>(d)</enum><header>Minimum number of schools</header><text>The Secretaries shall ensure that grants under this section are used to establish or expand health
and fitness programs at a total of not less than 20 schools.</text>
</subsection><subsection id="H13E670ED0FD74F07ADC3C78E07B806FB"><enum>(e)</enum><header>Assessment; reporting</header><text>As conditions on receipt of a grant under this section, an eligible entity shall agree to—</text>
<paragraph id="H4D8F1FC086CB4AB9B6C5A990EDF737DE"><enum>(1)</enum><text display-inline="yes-display-inline">conduct an annual assessment of health and fitness programs funded through the grant;</text>
</paragraph><paragraph id="H9D6AC0A6AC6A46228C8A9424B19B92F7"><enum>(2)</enum><text>on an annual basis, report the findings of each assessment under paragraph (1) to the participating
school, community partners, local contributors of funds, and tribal
councils; and</text>
</paragraph><paragraph id="H17D74B527B454B7084BA77AB8853BF5D"><enum>(3)</enum><text>not later than the end of fiscal year 2016, submit a report to the Secretaries and an appropriate
representative of the Centers for Disease Control and Prevention on the
success of the programs in educating children and families and thereby
preventing or reducing childhood obesity, including data from each
assessment under paragraph (1).</text>
</paragraph></subsection><subsection id="H535C51C9F11541D9B05CED29D078D65D"><enum>(f)</enum><header>Report to Congress</header><text>Not later than the end of fiscal year 2016, the Secretaries shall submit to the Congress a report
that—</text>
<paragraph id="H7C716317648843C3BA331903162C59F8"><enum>(1)</enum><text>summarizes the results achieved through programs funded under this section; and</text>
</paragraph><paragraph id="H77DE0E4E59044A6EACEDE3490BF65940"><enum>(2)</enum><text>includes a summary of the reports submitted by grant recipients under subsection (e)(3).</text>
</paragraph></subsection><subsection id="HB0D0260D587647D48F70210E78AE2975"><enum>(g)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="H2380AF0A5FFD4BAFB5234B2CB8A660C9"><enum>(1)</enum><text>The term <term>secondary school</term> has the meaning given to such term in section 9101 of the Elementary and Secondary Education Act
of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text>
</paragraph><paragraph id="HCB4AFCB3CD774E53BCD87E8BF9BB6C6A"><enum>(2)</enum><text>The term <term>eligible entity</term> means a nonprofit organization or entity with the ability to meet the requirements applicable to a
grantee under this section, as determined by the Secretaries.</text>
</paragraph><paragraph id="HC9CBA7C6D5E8460CBF3508A766DE4EC0"><enum>(3)</enum><text>The term <term>low-income communities</term> includes—</text>
<subparagraph id="HF9F9531FBE424684BD7D2F2BF4188C67"><enum>(A)</enum><text display-inline="yes-display-inline">communities with a high percentage of children eligible for free and reduced priced lunches under
the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>);
and</text>
</subparagraph><subparagraph id="HA4C1D97BB723404DBE544330510B68D7"><enum>(B)</enum><text>any other communities determined by the Secretaries to be low-income for purposes of this section.</text>
</subparagraph></paragraph><paragraph id="H32C67A45CF4145D5870EFEA60DF7B774"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>Secretaries</term> means the Secretary of Health and Human Services and the Secretary of Education, acting jointly
and in conjunction with the Director of the Centers for Disease Control
and Prevention.</text>
</paragraph></subsection><subsection id="H5C6808C4F5D74ED98BA120FC67EB5AEC"><enum>(h)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">To carry out this section, there is authorized to be appropriated $1,400,000 for the period of
fiscal years 2015 through 2016.</text>
</subsection></section></subtitle><enum>II</enum><header>Advancing Preventative Measures and Treatment of Obesity in Adults and Children in Underserved
Communities</header>
<section id="H62B3D7F359474D78B4DCFD364BDC555B" section-type="subsequent-section"><enum>201.</enum><header>Community health and wellness navigators pilot program: connecting America’s health professionals
with our schools</header>
<subsection id="HC3E99DA5878F4DBBBF7AE6CF8BDA9345"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall award grants to 5 or more States for the
establishment of a community navigator program, consisting of each such
State making subgrants to 1 or more eligible entities for a local
community navigator program described in subsection (b).</text>
</subsection><subsection id="H65D02917CDFC4A35A3800EE42021F2C8"><enum>(b)</enum><header>Program description</header><text>A local community navigator program described in this subsection shall consist of the following:</text>
<paragraph id="HA81FF708C9C74EE4916BFA4E8D8B5F4E"><enum>(1)</enum><text>An eligible entity, in partnership with a local educational agency, a bureau-funded school, or a
nonprofit health or education organization, will hire and train 2 or more
community navigators.</text>
</paragraph><paragraph id="HFD11727D4FAB4F1A813D3C26570BA2D0"><enum>(2)</enum><text display-inline="yes-display-inline">The community navigators will facilitate a relationship between the eligible entity and the local
educational agency, bureau-funded school, or nonprofit health or education
organization in low-income communities to ensure increased access to
medical care through educating parents and school administrators.</text>
</paragraph><paragraph id="H7EA87FC512F04BB3A7A984BC6D11BA76"><enum>(3)</enum><text>The community navigators will carry out educational activities for elementary school and secondary
school students and their parents in low-income communities with the goal
of—</text>
<subparagraph id="H18E1B29486F5477FB310213BE5322D86"><enum>(A)</enum><text>increasing familial intake of nutritious meals;</text>
</subparagraph><subparagraph id="H2AB40CE5B20C44CFBAED91C3BE8ADED4"><enum>(B)</enum><text>increasing physical activity both in and out of the school setting; and</text>
</subparagraph><subparagraph id="H344E99E09AA8449084DD8C14774B56B6"><enum>(C)</enum><text>increasing access to medical care.</text>
</subparagraph></paragraph><paragraph id="H20689044F88F4B6182FD4BD8E6C6B52B"><enum>(4)</enum><text display-inline="yes-display-inline">The community navigators will specifically recognize and address that there are subgroups that are
shown to have particular barriers to physical activities, such as persons
with disabilities.</text>
</paragraph></subsection><subsection id="H7D8106A08A6C478CABA0CBA3D1F93B16"><enum>(c)</enum><header>Report</header><text>Not later than 2 years after the date of the enactment of this Act, the Secretary shall submit a
report to the Congress on the effectiveness of the program under this
section.</text>
</subsection><subsection id="HBE4CA8F5CE224FFF9F7CB0290BB570FA"><enum>(d)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="HE395110F9C4E407BADBD28A46CF80B5D"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>bureau-funded school</term> has the meaning given such term in section 1146 of the Education Amendments of 1978 (25 U.S.C.
2026).</text>
</paragraph><paragraph id="H2A74FFABA95646349275EA22886BAC0A"><enum>(2)</enum><text>The terms <term>elementary school</term>, <term>local educational agency</term>, and <term>secondary school</term> have the meanings given to such terms in section 9101 of the Elementary and Secondary Education
Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text>
</paragraph><paragraph commented="no" id="HAAD4F009074D4D73B97275DE99C889F2"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>eligible entity</term> includes a Federally qualified health center (as defined in section 1861(aa) of the Social
Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(aa)</external-xref>)), a facility operated by the Indian
Health Service (including a facility operated by an Indian tribe or tribal
organization through a contract or compact with the Service under the
Indian Self-Determination and Education Assistance Act (25 U.S.C. 450 et
seq.)), a free-standing children’s hospital that is described in
subparagraph (L) or (M) of section 340B(a)(4) of the Public Health Service
Act (<external-xref legal-doc="usc" parsable-cite="usc/42/256b">42 U.S.C. 256b(a)(4)</external-xref>), a non-profit with demonstrated effectiveness
in the area of health care and with a focus on serving low-income
communities, a rural hospital, and a rural health clinic.</text>
</paragraph><paragraph display-inline="no-display-inline" id="HF77AFAAC3B7A4070A2B9A79B63328A95"><enum>(4)</enum><text>The term <term>low-income communities</term> includes—</text>
<subparagraph id="HEA291C450A2B46349C3EB732E2B978E4"><enum>(A)</enum><text display-inline="yes-display-inline">communities with a high percentage of children eligible for free and reduced priced lunches under
the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>);
and</text>
</subparagraph><subparagraph id="HCAAE3B1648774BB3876431A245B217B7"><enum>(B)</enum><text>any other communities determined by the Secretaries to be low-income for purposes of this section.</text>
</subparagraph></paragraph><paragraph id="H71D9286593D341BF8BFB9C0E50847FED"><enum>(5)</enum><text>The term <term>nonprofit health or education organization</term> shall be defined by the Secretary.</text>
</paragraph><paragraph id="HA9AD1887EA254ABFB16472D124240E08"><enum>(6)</enum><text>The term <term>Secretary</term> means the Secretary of Health and Human Services.</text>
</paragraph><paragraph commented="no" id="HC153C63A90854F9EAE494D7F770A40FC"><enum>(7)</enum><text display-inline="yes-display-inline">The term <term>State</term> includes the District of Columbia and any commonwealth, territory, or possession of the United
States, including the Commonwealth of Puerto Rico, the United States
Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern
Mariana Islands.</text>
</paragraph></subsection><subsection id="HBE4FC32A7A3E4077976DEFF3D802B823"><enum>(e)</enum><header>Authorization of appropriations</header><text>To carry out this section, there are authorized to be appropriated such sums as may be necessary
for fiscal years 2015 and 2016.</text>
</subsection></section><section display-inline="no-display-inline" id="H8565B319DE0648A492382895763478CA" section-type="subsequent-section"><enum>202.</enum><header>Coverage of evidence-based preventive services under Medicaid and SCHIP</header>
<subsection id="H21B727403250472C899DF885293257EB"><enum>(a)</enum><header>State Option To Provide Medical Assistance for Evidence-Based Preventive Services</header>
<paragraph id="H552839C836D843CC891DDF4F77674F92"><enum>(1)</enum><header>In general</header><text>Section 1905 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d</external-xref>) is amended—</text>
<subparagraph id="H025751E801AB43D0B02F20D145F5381B"><enum>(A)</enum><text>in subsection (a)—</text>

preventing obesity and comorbidities of obesity, including diet and
exercise counseling, and healthy weight and obesity counseling; and</text>
</paragraph><paragraph id="H1E93B1B063C7400199E7A71542910AA7"><enum>(2)</enum><text>any other evidence-based, effective, clinical intervention for obese individuals designed to
prevent comorbidities of obesity, including pharmacological or surgical

</subparagraph></paragraph><paragraph id="H94E2E1E1EABD48A4898C04A653DB854D"><enum>(2)</enum><header>Conforming amendment</header><text>Section 1902(a)(10)(C)(iv) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396(a)(10)(C)(iv)</external-xref>) is amended by inserting <quote>, or (29)</quote> after <quote>(24)</quote>.</text>

<paragraph id="HCCE769B1D31E4332B28AEA74DF71386E"><enum>(1)</enum><header>Required coverage</header><text>Section 2103 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397cc">42 U.S.C. 1397cc</external-xref>) is amended—</text>

defined in section 1861(vv)(1)), physical therapy or exercise training,
including steps needed to make such therapy and training inclusive for
persons with disabilities, behavioral health counseling, and such other
evidence-based services as recommended by the Secretary. For purposes of
the previous sentence the Secretary shall take into consideration the
American Academy of Pediatrics Expert Committee Guidelines Regarding the
Prevention, Assessment, and Treatment of Child and Adolescent Overweight
and Obesity and the National Center on Health, Physical Activity, and
Disability’s Physical Activity Guidelines for Individuals with
Disabilities.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</clause></subparagraph></paragraph><paragraph id="HF1938C73A1864C8BA6AD677D83430E10"><enum>(2)</enum><header>Conforming amendment</header><text>Section 2102(a)(7)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397bb">42 U.S.C. 1397bb(c)(2)</external-xref>) is amended by striking <quote>section 2103(c)(5)</quote> and inserting <quote>paragraphs (5) and (7) of section 2103(c)</quote>.</text>
</paragraph></subsection></section><section id="H83EDEE2E96CF4C858690BDB04E9B744C"><enum>205.</enum><header>National Commission on Child Obesity</header>
<subsection id="HE2B8EA720B5E4E94AFCE3C1DE7DBA568"><enum>(a)</enum><header>Establishment</header><text>There is established a commission to be known as the National Commission on Child Obesity (in this
section referred to as the <quote>Commission</quote>).</text>
</subsection><subsection id="HB7C39AFC37D5478ABFB0647B0E193A0F"><enum>(b)</enum><header>Duties of commission</header><text>The Commission shall—</text>
<paragraph id="HD5179CB2EC9640FEBF4904A7FC496522"><enum>(1)</enum><text>conduct a comprehensive study that examines and assesses the needs of children relating to the
prevalence, prevention, and treatment of childhood overweight and obesity,
including specific findings relating to—</text>
<subparagraph commented="no" id="H2FE4C72A29944C17BAD9D4EC2661F8F2"><enum>(A)</enum><text>best practices for the prevention and treatment of childhood overweight and obesity;</text>
</subparagraph><subparagraph id="HF7FB3A25AFF442F4BC88600FD4409F54"><enum>(B)</enum><text>child physical health and mental health;</text>
</subparagraph><subparagraph id="H41DCA4DB377546058B7FF0F7FAE0DFDB"><enum>(C)</enum><text>childcare in all settings;</text>
</subparagraph><subparagraph id="H9C3BC17A3FEA49D7956A71277A6AF5ED"><enum>(D)</enum><text>child welfare;</text>
</subparagraph><subparagraph id="HAF86CF99988B4B58A404DAC288D53935"><enum>(E)</enum><text>elementary and secondary education;</text>
</subparagraph><subparagraph id="HEE6C8A74EAFD44E8B58AB9F02082FD69"><enum>(F)</enum><text>food availability in neighborhoods;</text>
</subparagraph><subparagraph id="H10287AC7D4C3450EAA24B2F1976E1859"><enum>(G)</enum><text>access to health care;</text>
</subparagraph><subparagraph id="HC30353F0711A4E2AB199FC6CFD32E888"><enum>(H)</enum><text>health care utilization;</text>
</subparagraph><subparagraph id="H1659F7583F9D4FCF971DDFA608208D8A"><enum>(I)</enum><text>built environment;</text>
</subparagraph><subparagraph id="H487992BA95F84D90AF1219BF7C9DAC77"><enum>(J)</enum><text>parent physical health and education;</text>
</subparagraph><subparagraph id="H24FD4E00322A4AA3B1A37EE4A4645C81"><enum>(K)</enum><text>underserved communities, including tribal communities, health professional shortage areas
designated under section 332 of the Public Health Service Act (42 U.S.C.
254e), medically underserved areas (as defined in section 799B of such Act
(<external-xref legal-doc="usc" parsable-cite="usc/42/295p">42 U.S.C. 295p</external-xref>), and areas in the Appalachian region (as defined in
<external-xref legal-doc="usc" parsable-cite="usc/40/14102">section 14102(a)</external-xref> of title 40, United States Code);</text>
</subparagraph><subparagraph id="H5E3114B752984D14B6D1188DDFF0E115"><enum>(L)</enum><text>relevant activities in childhood overweight and obesity;</text>
</subparagraph><subparagraph id="H95FF414C015446B1AA9B99667C599AB0"><enum>(M)</enum><text display-inline="yes-display-inline">the availability of information on State and Federal supportive nutrition programs, such as the
Summer Food Service Program, the Women, Infants, and Children Program, the
State Children’s Health Insurance Program under title XXI of the Social
Security Act, and the Supplemental Nutrition Assistance Program; and</text>
</subparagraph><subparagraph id="H1DE33069F7704E6EAEE9034E39B8CE67"><enum>(N)</enum><text display-inline="yes-display-inline">children with disabilities;</text>
</subparagraph></paragraph><paragraph id="HC7CEBC77A08D4FF1805B19CA69DE6A25"><enum>(2)</enum><text>identify, review, and evaluate existing laws, regulations, policies, programs, and public health
initiatives relevant to best practices for the prevalence, prevention, and
treatment of childhood overweight and obesity;</text>
</paragraph><paragraph id="H8BA36B58B83C4AC98629B6339452EF65"><enum>(3)</enum><text>identify, review, and evaluate the lessons learned from past laws, regulations, policies, programs,
and public health initiatives relevant to the prevalence, prevention, and
treatment of childhood overweight and obesity;</text>
</paragraph><paragraph id="H3E180C1347F242A086A7F3AEAE35630A"><enum>(4)</enum><text>advise on the need to revise laws, regulations, policies, and programs relative to addressing best
practices for the prevalence, prevention, and treatment of childhood
overweight and obesity at regular intervals as new knowledge is gained;</text>
</paragraph><paragraph id="H2E91881CD85E4346A68CCDB223FA92C1"><enum>(5)</enum><text>include in the interim report required by subsection (i)(1) recommendations on—</text>
<subparagraph id="H984AC4D400CE476B89B0E4D091B46DC1"><enum>(A)</enum><text>the appropriate Federal agency to establish the infrastructure for the creation of a comprehensive
nationwide registry of patient data associated with children living with
obesity;</text>
</subparagraph><subparagraph id="H33DC009B442C49C0AC68FE4D816F39AB"><enum>(B)</enum><text>the specific criteria needed for such registry to allow the field of pediatric clinicians access to
patient-level, clinical data suitable for research and the development of
best practices;</text>
</subparagraph><subparagraph id="HA4185C7259CB4BC1B8F4AD7EB3CCF82E"><enum>(C)</enum><text>the appropriate funding level required for the establishment and implementation of such the
registry described in subparagraph (A); and</text>
</subparagraph><subparagraph id="HD5AA7A7E7EB64064A11E3018A883724B"><enum>(D)</enum><text>how to capture large-scale data that are currently unavailable on adolescent and child patients who
are currently obese; and</text>
</subparagraph></paragraph><paragraph id="H6C7DE68FF8604EC498A0D7BEAACF9ED8"><enum>(6)</enum><text>include in the final report required by subsection (i)(3) the Commission’s specific findings,
conclusions, and recommendations to address the needs of children relating
to the prevention and treatment of childhood overweight and obesity,
including specific recommendations on—</text>
<subparagraph id="H7E1320BDFAC5421DB1A40E20EED4258A"><enum>(A)</enum><text>the need for planning and establishing a national resource center for children and obesity; and</text>
</subparagraph><subparagraph id="H6A82E3B1B5654BFF8B31504A681B2A22"><enum>(B)</enum><text>such coordination of resources and services, administrative actions, policies, regulations, and
legislative changes as the Commission considers appropriate.</text>
</subparagraph></paragraph></subsection><subsection id="H6004949058BF470B827A6CF7E73F7869"><enum>(c)</enum><header>Composition</header>
<paragraph id="HE19EB58EDC6C4BCC8695840DEBFA18D8"><enum>(1)</enum><header>Members</header><text>The Commission shall be composed of 15 members, of whom—</text>
<subparagraph id="H7B4E281121C94072A2C0DFE45F3C4781"><enum>(A)</enum><text>3 members, including at least one from each major national political party, shall be appointed by
the President;</text>
</subparagraph><subparagraph id="H6E10AF7C16D24363A790E5DA8423E999"><enum>(B)</enum><text>3 members shall be appointed by the majority leader of the Senate;</text>
</subparagraph><subparagraph id="H4FC52697DBB0471DBC8546515C8BDE3D"><enum>(C)</enum><text>3 members shall be appointed by the minority leader of the Senate;</text>
</subparagraph><subparagraph id="H59C9D936630E47E0AADA1E9F0F26D38D"><enum>(D)</enum><text>3 members shall be appointed by the Speaker of the House of Representatives; and</text>
</subparagraph><subparagraph id="H784452BB392D40CCA7EA8555C85410E0"><enum>(E)</enum><text>3 members shall be appointed by the minority leader of the House of Representatives.</text>
</subparagraph></paragraph><paragraph id="HEF9093C265504051BC9ACB287F47E722"><enum>(2)</enum><header>Appointment</header><text>Members of the Commission shall be appointed not later than 6 months after the date of the
enactment of this Act.</text>
</paragraph><paragraph id="HEA51EECC8621434A8D6B84B05C39ABF3"><enum>(3)</enum><header>Chairperson, vice chairperson, and meetings</header>
<subparagraph id="H6E327271B3BC4A5381BCC4989FB4C040"><enum>(A)</enum><header>In general</header><text>Not later than 30 days after the date on which all members of the Commission are appointed under
paragraph (1), such members shall meet to elect a Chairperson and Vice
Chairperson from among such members and shall determine a schedule of
Commission meetings.</text>
</subparagraph><subparagraph id="HBACFDB67DDCD4C97A9C221F2660734BE"><enum>(B)</enum><header>Initial meeting</header><text>The Commission shall meet and begin the operations of the Commission not later than 120 days after
the appointment of members of the Commission.</text>
</subparagraph></paragraph><paragraph id="H31D029F31F9A4D158AD7209F00F4285E"><enum>(4)</enum><header>Governmental appointees</header><text>An individual appointed to the Commission may not be an official or employee of the Federal
Government.</text>
</paragraph><paragraph id="H11FFAA9FDE654C73BB82352D446F0D48"><enum>(5)</enum><header>Commission representation</header><text>The Commission shall include at least one—</text>
<subparagraph id="H1B4D3F32D80F41AD93C75DCCFD019567"><enum>(A)</enum><text>representative from each of a nonprofit and for-profit entity with demonstrated expertise in
addressing the needs of children relating to the prevalence, prevention,
and treatment of childhood overweight and obesity;</text>
</subparagraph><subparagraph commented="no" id="HCCC9E1D732C142B6A968CB5DA784CE47"><enum>(B)</enum><text>State or local director of health; and</text>
</subparagraph><subparagraph commented="no" id="HCAE1790DC5244B1DB10B32730956D95D"><enum>(C)</enum><text>tribal health representative.</text>
</subparagraph></paragraph><paragraph id="H07478B4B182948959C9B07653CDBB9F3"><enum>(6)</enum><header>Qualifications</header><text>Members appointed under paragraph (1) may include—</text>
<subparagraph id="H10A34184F8E8498890736999F586D34F"><enum>(A)</enum><text>individuals involved with providing services to children, including health and other social
services;</text>
</subparagraph><subparagraph id="H542ADBDE51B445C4AC6B621BC3CE072F"><enum>(B)</enum><text>individuals involved with administering health insurance coverage to children;</text>
</subparagraph><subparagraph id="HF7A04327C26C424A82932D512ACB610A"><enum>(C)</enum><text>individuals with experience in public health initiatives relating to the prevention and treatment
of childhood overweight and obesity, including coordination of resources
and services among State and local governments, the Federal Government,
and nongovernmental entities;</text>
</subparagraph><subparagraph id="H1071CDC284664CD69C179BE65331E487"><enum>(D)</enum><text>individuals with philanthropic experience focused on the needs of children relating to the
prevalence, prevention, and treatment of childhood overweight and obesity;</text>
</subparagraph><subparagraph id="H7295E59B6B0E4C29B9EB9D59719DA968"><enum>(E)</enum><text display-inline="yes-display-inline">individuals who have conducted academic research relating to the prevalence, prevention, and
treatment of childhood overweight and obesity; and</text>
</subparagraph><subparagraph id="H3724741228474600A744E62C62D1A823"><enum>(F)</enum><text>individuals with significant experience in child health and policy.</text>
</subparagraph></paragraph><paragraph id="H0327E796B009467DBF2D49763B88C252"><enum>(7)</enum><header>Quorum and Vacancy</header>
<subparagraph id="HA26C790B47BE4C629ACB79C4D7D04864"><enum>(A)</enum><header>Quorum</header><text>A majority of the members of the Commission shall constitute a quorum, but a lesser number of
members may hold hearings.</text>
</subparagraph><subparagraph id="HDDDBE7B7FCB24F2591C3DA00AAE4265C"><enum>(B)</enum><header>Vacancy</header><text>Any vacancy in the Commission shall not affect its powers and shall be filled in the same manner in
which the original appointment was made.</text>
</subparagraph></paragraph></subsection><subsection id="HCC60A0A8E54240D78AA79CA42F7156A7"><enum>(d)</enum><header>Powers of commission</header>
<paragraph id="H3D7E674E020744FDBC46E0A8A39DA8FE"><enum>(1)</enum><header>Hearings</header><text>The Commission may hold such hearings, meet and act at such times and places, and receive such
evidence as may be necessary to carry out the functions of the Commission.</text>
</paragraph><paragraph id="H40560A7BC51D45A9A3AD14203D6B2A73"><enum>(2)</enum><header>Information from Federal agencies</header>
<subparagraph id="H48E2A952FB6A4B2CB41E840F2391E434"><enum>(A)</enum><header>In general</header><text>The Commission may access, to the extent authorized by law, from any executive department, bureau,
agency, board, commission, office, independent establishment, or
instrumentality of the Federal Government such information, suggestions,
estimates, and statistics as the Commission considers necessary to carry
out this section.</text>
</subparagraph><subparagraph id="H435CF462032C4C4694F66E6E8D1596C9"><enum>(B)</enum><header>Provision of information</header><text>On written request of the Chairperson of the Commission, each department, bureau, agency, board,
commission, office, independent establishment, or instrumentality of the
Federal Government shall, to the extent authorized by law, provide the
requested information to the Commission.</text>
</subparagraph><subparagraph id="H0F2B2DF925A14666960512C85C5A2FCC"><enum>(C)</enum><header>Receipt, handling, storage, and dissemination</header><text>Information shall only be received, handled, stored, and disseminated by members of the Commission
and its staff consistent with all applicable statutes, regulations, and
Executive orders.</text>
</subparagraph></paragraph><paragraph id="HF34D13EED1584211B6B08E0B029413DA"><enum>(3)</enum><header>Assistance from Federal agencies</header>
<subparagraph id="H988A9070A1DF4BE79341D186CCCA0126"><enum>(A)</enum><header>General services administration</header><text>On request of the Chairperson of the Commission, the Administrator of General Services shall
provide to the Commission, on a reimbursable basis, administrative support
and other assistance necessary for the Commission to carry out its duties.</text>
</subparagraph><subparagraph id="H16AE7A9ADFAE48AC959ECDDC7E574BFB"><enum>(B)</enum><header>Other departments and agencies</header><text>In addition to assistance under subparagraph (A), departments and agencies of the United States may
provide to the Commission such assistance as they determine advisable and
as authorized by law.</text>
</subparagraph></paragraph><paragraph id="HE90D2EE682B24C84A5FBB3D75E99C93F"><enum>(4)</enum><header>Contracting</header><text>The Commission may enter into financially reasonable contracts to enable the Commission to
discharge its duties under this section.</text>
</paragraph><paragraph id="HB4B493CB21BF4DEA946CEC08B4555773"><enum>(5)</enum><header>Postal services</header><text>The Commission may use the United States mails in the same manner and under the same conditions as
a department or agency of the United States.</text>
</paragraph></subsection><subsection id="HE8B11FBC5C4A4EC28C0B31659B7161A0"><enum>(e)</enum><header>Staff of commission</header>
<paragraph id="HF34F39B62F9A4F5EA8393C4CEDF6D772"><enum>(1)</enum><header>In general</header><text>The Chairperson of the Commission, in consultation with the Vice Chairperson, in accordance with
rules agreed upon by the Commission, may appoint and fix the compensation
of a staff director, policy director, and administrative assistant (and
other staff if agreed upon by a majority of Commission members) to enable
the Commission to carry out its functions, in accordance with the
provisions of title 5, United States Code, except that no rate of pay
fixed under this paragraph may exceed the equivalent of that payable for a
position at level V of the Executive Schedule under section 5316 of title
5, United States Code.</text>
</paragraph><paragraph id="H93440F58F83A48CDA1C7FB141D0A42A4"><enum>(2)</enum><header>Staff of Federal agencies</header><text>Upon request of the Chairperson of the Commission, the head of any executive department, bureau,
agency, board, commission, office, independent establishment, or
instrumentality of the Federal Government may detail, without
reimbursement, any of its personnel to the Commission to assist it in
carrying out its duties under this section. Any detail of an employee
shall be without interruption or loss of civil service status or
privilege.</text>
</paragraph><paragraph id="HD2FB620678D444E98B2B2AAAA17393C6"><enum>(3)</enum><header>Consultant services</header><text>The Commission is authorized to procure (pursuant to a majority vote of the Commission members) the
services of experts and consultants in accordance with section 3109 of
title 5, United States Code, but at rates not to exceed the daily
equivalent of the annual rate of basic pay for level IV of the Executive
Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5315">section 5315</external-xref> of title 5, United States Code.</text>
</paragraph></subsection><subsection id="H0F11C977895E440C8454543653EBDA87"><enum>(f)</enum><header>Travel expenses</header><text>Each member of the Commission shall serve without compensation, but shall receive travel expenses,
including per diem in lieu of subsistence, in accordance with applicable
provisions in the same manner as persons employed intermittently in the
Government service are allowed expenses under <external-xref legal-doc="usc" parsable-cite="usc/5/5703">section 5703</external-xref> of title 5,
United States Code.</text>
</subsection><subsection id="H0C3E402FFC784A52B75036C8892280C1"><enum>(g)</enum><header>Applicability of FACA</header><text>The Federal Advisory Committee Act, including any provisions applicable to staff, is deemed to
apply to the Commission.</text>
</subsection><subsection id="HFBF24C5B2BB04C759DA9F3C1CF255A48"><enum>(h)</enum><header>Reports of commission; termination</header>
<paragraph id="HBFF0D5533B26468E939CCD36F4055CBE"><enum>(1)</enum><header>Interim report</header><text>The Commission shall, not later than 1 year after the date of its first meeting, submit to the
President and the Congress an interim report containing specific findings,
conclusions, and recommendations required under this section and agreed to
by a majority of Commission members.</text>
</paragraph><paragraph id="H9A69D8EB63BC4ADDAFBA2BA9BA0C80D0"><enum>(2)</enum><header>Other reports and information</header>
<subparagraph id="H1A90DF59A64C420786627ACC56B99B48"><enum>(A)</enum><header>Reports</header><text>The Commission may issue additional reports as the Commission determines necessary.</text>
</subparagraph><subparagraph id="H214722BB8D974EC99C952C18B0359121"><enum>(B)</enum><header>Information</header><text>The Commission may hold public hearings to collect information and shall make such information
available for use by the public.</text>
</subparagraph></paragraph><paragraph id="H467CF1A5224549E394FF0B0E7AA4265C"><enum>(3)</enum><header>Final report</header><text>The Commission shall, not later than 2 years after the date of its first meeting, submit to the
President and Congress a final report containing specific findings,
conclusions, and recommendations required under this section and agreed to
by a majority of Commission members.</text>
</paragraph><paragraph id="HA740F26CDF44416590F4FD2FD1B83F46"><enum>(4)</enum><header>Termination</header>
<subparagraph id="H565F8F715C384AD9B9C3685F407758F4"><enum>(A)</enum><header>In general</header><text>Unless reauthorized by statute, the Commission, and all the authorities of this section, shall
terminate 180 days after the date on which the final report is submitted
under paragraph (3).</text>
</subparagraph><subparagraph id="H69863AAA04F94A6E8EA8B369618655E6"><enum>(B)</enum><header>Records</header><text>Not later than the date of termination of the Commission under subparagraph (A), all records and
papers of the Commission shall be delivered to the Archivist of the United
States for deposit in the National Archives.</text>
</subparagraph></paragraph></subsection><subsection id="H8A34EA750FB4414FBC5825FB2DF0A6DC"><enum>(i)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="H946E22AC96C74B6899BDBD5EA398D74D"><enum>(1)</enum><header>Obesity</header><text>The term <term>obesity</term> with respect to children means having a body mass index (BMI) greater than or equal to the 95th
percentile for age and sex according to the Centers for Disease Control
and Prevention.</text>
</paragraph><paragraph id="H88EF56B137354BE1BB78FA200CD438D5"><enum>(2)</enum><header>Child; children</header><text>The terms <term>child</term> and <term>children</term> mean an individual or individuals, respectively, who have not attained 18 years of age.</text>
</paragraph></subsection><subsection id="HA6B529C7F40F49D4AA8036775446DF86"><enum>(j)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section, $1,500,000 for each of fiscal
years 2015 and 2016.</text>
</subsection></section><section display-inline="no-display-inline" id="H83F27099160B4145A1F9F1B381E58DAB" section-type="subsequent-section"><enum>206.</enum><header>GAO report</header><text display-inline="no-display-inline">Not later than 2 years after the first appropriation of Federal funds to carry out this Act, the
Comptroller General of the United States shall submit to Congress a report
on the effectiveness of the activities carried out under this Act in
reducing child obesity, which shall include an analysis of the costs and
the benefits of such activities.</text>
</section><enum>III</enum><header>Encouraging Physical Activity in Underserved American Communities </header>
<section display-inline="no-display-inline" id="H63F0F0B724D145E0B97CBED747E32557"><enum>301.</enum><header>Renovation of foreclosed and abandoned properties to create spaces that encourage physical activity
in American neighborhoods</header><text display-inline="no-display-inline">Section 106(a) of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5306">42 U.S.C. 5306(a)</external-xref>) is amended—</text>
<paragraph id="H0DE151B9AC364A03A59F3D9E7CDA1FA1"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3)—</text>
<subparagraph id="H24531CFD3D8746D9B674374039B39BAA"><enum>(A)</enum><text>by striking <quote>(1) and</quote> and inserting <quote>(1),</quote>; and</text>
</subparagraph><subparagraph id="H89E010AFEF104B328D047AEFE125CEE2"><enum>(B)</enum><text>by inserting <quote>and after reserving such amounts for units of general local government, special district
governments, and Indian tribes with high foreclosure rates and great
infrastructure need under paragraph (4),</quote> after <quote>paragraph (2),</quote>;</text>
</subparagraph></paragraph><paragraph id="H3232F5F60292428A98AEC7A06B7C35F6"><enum>(2)</enum><text>by redesignating paragraph (4) as paragraph (5);</text>
</paragraph><paragraph id="H4C40CE19F0914971B83364FA68C8C868"><enum>(3)</enum><text>in paragraph (5), as redesignated by paragraph (2) of this section, by striking <quote>paragraphs (1), (2), and (3)</quote> and inserting <quote>paragraphs (1), (2), (3), and (4)</quote>; and</text>

that the Secretary determines have both high foreclosure rates and the
greatest infrastructure needs, based on the scope of the needs, an amount
the Secretary determines necessary.</text>
</subparagraph><subparagraph id="H172DA02AB7564580B210F8D2407288FC" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Grants under this paragraph may be used by units of general local government, special district
governments, and Indian tribes to—</text>
<clause id="HE777F75F58664758B676F441D920E467"><enum>(i)</enum><text display-inline="yes-display-inline">renovate foreclosed commercial properties, abandoned commercial properties, or both, to be
transformed into community centers, public recreation facilities, swimming
pools, or any other type of facility that will encourage indoor physical
activity;</text>
</clause><clause id="HF4F7561CA5804E2EB4B03A141B8E5019"><enum>(ii)</enum><text>demolish foreclosed or abandoned commercial and residential properties, or both, to use the sites
for—</text>
<subclause id="H41CDDB3C5CDE4799861C9E7E8FDBAC34"><enum>(I)</enum><text>the construction of parks, playgrounds, outdoor swimming pools, tracks, soccer fields, baseball
diamonds, or any other type of facility that will encourage outdoor
physical activity;</text>
</subclause><subclause id="H618F361FC67A490E935B84C83489BF08"><enum>(II)</enum><text display-inline="yes-display-inline">community gardens or urban farms, particularly in areas that are food deserts (as such term is
defined in section 7527(a) of the Food, Conservation, and Energy Act of
2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/234">Public Law 110–234</external-xref>; 122 Stat. 2039); or</text>
</subclause><subclause id="H58D2DA9069FC4A7A8BE9C9E362D117C9"><enum>(III)</enum><text>mixed-use facilities that are used for both of the purposes under subclauses (I) and (II) of this
clause; and</text>
</subclause></clause><clause id="H67ECC20022364BDE992E259A8413D60A"><enum>(iii)</enum><text display-inline="yes-display-inline">reconstruct and repair dilapidated sidewalks, bike and pedestrian trails, and indoor and outdoor
facilities that encourage physical activity.</text>
</clause></subparagraph><subparagraph id="HBFEE340FCE86480983B41FA8B4F8E6E0" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">In making grants under this paragraph, the Secretary shall give priority among units of general
local government, special district governments, and Indian tribes eligible
pursuant to subparagraph (A)—</text>
<clause id="H528EE4A2B5F94F2AB75FBBE7F9BF55A3"><enum>(i)</enum><text display-inline="yes-display-inline">to units of general local government, special district governments, and Indian tribes that
demonstrate the ability and willingness to work with local educational
agencies, developers, and other community-based organizations to enter
into mixed-use agreements to maximize the use and efficiency of properties
renovated, constructed, or reconstructed and repaired through the use of
grant funds;</text>
</clause><clause id="HD7A1B8A2153544599397664279B7BA39"><enum>(ii)</enum><text display-inline="yes-display-inline">to units of general local government, special district governments, and Indian tribes that
demonstrate the willingness to recognize and promote the involvement of
individuals enrolled in a national service program authorized under the
National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12501">42 U.S.C. 12501 et seq.</external-xref>) or
the Domestic Volunteer Service Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4950">42 U.S.C. 4950 et seq.</external-xref>) in the
renovation, construction, or reconstruction and repair of properties
through the use of grant funds;</text>
</clause><clause id="H139EA53D794A4B3CBD3401770CC000A6"><enum>(iii)</enum><text display-inline="yes-display-inline">to projects proposed by units of general local government, special district governments, and Indian
tribes that are easily accessible, on foot or by public transportation,
for persons in low-income communities; and</text>
</clause><clause id="H8CF6B6FCEB0D4BA997678DC0AB339185"><enum>(iv)</enum><text display-inline="yes-display-inline">to projects proposed by units of general local government, special district governments, and Indian
tribes that have particular accessibility considerations for persons with
disabilities.</text>
</clause></subparagraph><subparagraph id="H9DE8EA150DBE48C5AB943609F0A60ACD" indent="up1"><enum>(D)</enum><text>For purposes of this paragraph, the term <term>special district government</term> means any organized local entity, known by a variety of titles, including districts, authorities,
boards, and commissions, other than a unit of general local government or
local educational agency, authorized by State law to provide only one or a
limited number of designated functions, and with sufficient administrative
and fiscal autonomy to qualify as a separate government unit, as
determined by the Secretary.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></section><section id="HE33A53D2FE7C4D59951D92B91526A7F3"><enum>302.</enum><header>National Youth Sports Program revitalization</header><text display-inline="no-display-inline">Section 682(g) of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9923">42 U.S.C. 9923(g)</external-xref>) is amended by striking <quote>$15,000,000</quote> and all that follows through <quote>2003</quote> and inserting <quote>$20,000,000 for each of the fiscal years 2015 through 2024</quote>.</text>
</section><section id="H4D9680720B534319AA5FEFF79D6C3796" section-type="subsequent-section"><enum>303.</enum><header>Expansion of the Zuni Youth Enrichment Project Summer Camp</header>
<subsection id="H06C72B87FE1C407B9818126AFA957121"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall establish a 2-year pilot program to provide funds
to community-based organizations on Indian reservations or tribal lands to
plan and implement an enrichment program for children (in the form of a
summer camp and a year-round program) for the purpose of—</text>
<paragraph id="HD87DCB8631974FDFA13ABDD07D182D0E"><enum>(1)</enum><text>reversing the epidemics of obesity, diabetes, and alcoholism in such areas; and</text>
</paragraph><paragraph id="H426DEC8ED6F74CD085FCF2EF5B5ABE96"><enum>(2)</enum><text>to mitigate other problems stemming from the formation of bad habits and the development of low
self-esteem during childhood.</text>
</paragraph></subsection><subsection id="H792AC29964BF4264904AF07FEDFBF293"><enum>(b)</enum><header>Partnerships</header><text display-inline="yes-display-inline">In order to qualify for funding under <internal-xref idref="H06C72B87FE1C407B9818126AFA957121" legis-path="(a)">subsection (a)</internal-xref>, a community-based organization shall demonstrate, to the satisfaction of the Secretary of Health
and Human Services, that the organization has entered into a partnership
with community entities, local funders, and tribal leaders (including, if
applicable, the tribal council) to plan and execute an enrichment program
under <internal-xref idref="H06C72B87FE1C407B9818126AFA957121" legis-path="1.(a)">subsection (a)</internal-xref>.</text>
</subsection><subsection display-inline="no-display-inline" id="H29A92A0B4D294D8BAB405CE25D86FA2B"><enum>(c)</enum><header>Number of sites</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services, in providing funding under <internal-xref idref="H06C72B87FE1C407B9818126AFA957121" legis-path="1.(a)">subsection (a)</internal-xref>, shall provide funding to no more than 20 community-based organizations.</text>
</subsection><subsection id="H99EEAA7185C44B32BDC58C3A6D88E5A1"><enum>(d)</enum><header>Model and camp requirement</header><text>The enrichment program under <internal-xref idref="H06C72B87FE1C407B9818126AFA957121" legis-path="1.(a)">subsection (a)</internal-xref> shall—</text>
<paragraph id="H779C5C9962B3443E83A694EB44462892"><enum>(1)</enum><text>be modeled on similar programs established by the Zuni Youth Enrichment Project; and</text>
</paragraph><paragraph id="HEB0F2CB4CC6A42A0A1046C50FE0ABC07"><enum>(2)</enum><text>shall include a camp of at least 6 weeks in duration during the summer<italic>.</italic></text>
</paragraph></subsection><subsection id="H82E768E039BB4F2180D54428CB0A0D5F"><enum>(e)</enum><header>Specific camp requirements</header>
<paragraph id="H7CE5AD48FE304ED3A81419BBFD1D5F9B"><enum>(1)</enum><header>Daily activities</header><text>With respect to children attending a camp under <internal-xref idref="HEB0F2CB4CC6A42A0A1046C50FE0ABC07" legis-path="1.(d)(2)">subsection (d)(2)</internal-xref>, the leader of the organization that receives funds under <internal-xref idref="H06C72B87FE1C407B9818126AFA957121" legis-path="1.(a)">subsection (a)</internal-xref> shall, for each day of the camp, ensure that such children are—</text>
<subparagraph id="H4AD306CC9E1948B19BABD216238C33CF"><enum>(A)</enum><text>involved in at least 60 minutes of physical activity (with appropriate accommodations made for
children with disabilities); and</text>
</subparagraph><subparagraph id="H042D60AA0BF94445AA439EAC10C1D01F"><enum>(B)</enum><text display-inline="yes-display-inline"><italic></italic>provided with at least two meals that meet national nutritional standards.</text>
</subparagraph></paragraph><paragraph id="H0FC2A3FE58754E85AB8BF4BDD288D3A2"><enum>(2)</enum><header>Other activities</header><text>Such leader shall also ensure that—</text>
<subparagraph id="H6BE8BFFA68B74B6A9CF4E1C688FCA606"><enum>(A)</enum><text>a community gardening activity is included in the activities conducted at the camp; and</text>
</subparagraph><subparagraph id="H98FDE27D5BCC4D2BB31568B9FB24DFA5"><enum>(B)</enum><text>health and wellness education is provided to the children attending the camp.</text>
</subparagraph></paragraph></subsection><subsection id="H89729C6EA0514DDE91A63833B573D0E0"><enum>(f)</enum><header>Evaluation</header>
<paragraph id="H78A8C4FA001D43AC83551229C97BDA8C"><enum>(1)</enum><header>In general</header><text>A community-based organization that receives funding under <internal-xref idref="H06C72B87FE1C407B9818126AFA957121" legis-path="1.(a)">subsection (a)</internal-xref>, shall, as a condition of receiving such funding, conduct an evaluation of the enrichment program
conducted by such organization.</text>
</paragraph><paragraph id="H0337F11280464023BB120B95D514A518"><enum>(2)</enum><header>Model</header><text>The form, manner, content, and frequency of the evaluation under <internal-xref idref="H78A8C4FA001D43AC83551229C97BDA8C" legis-path="1.(f)(1)">paragraph (1)</internal-xref> shall be modeled on the Zuni Youth Enrichment Project standard project evaluation.</text>
</paragraph></subsection><subsection id="H3369AF41BC574804B69E2C00968FCEF1"><enum>(g)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which a community organization first receives funding under <internal-xref idref="H06C72B87FE1C407B9818126AFA957121" legis-path="(a)">subsection (a)</internal-xref> and annually thereafter, the organization shall—</text>
<paragraph id="H2369D71DB71C4E1C9023AFFFC784DBD5"><enum>(1)</enum><text>submit a report to the Secretary of Health and Human Services on the outcomes of the enrichment
program conducted by the organization under this section, including—</text>
<subparagraph id="HA749AB11AD764C158498488A031DD6D9"><enum>(A)</enum><text>the findings of the evaluation conducted under <internal-xref idref="H89729C6EA0514DDE91A63833B573D0E0" legis-path="1.(f)">subsection (f)</internal-xref>; and</text>
</subparagraph><subparagraph id="H6E055189F44340799FD0710E935D920B"><enum>(B)</enum><text>the impact of such enrichment program on the rates of childhood obesity on the reservation or area
of tribal land served by the organization; and</text>
</subparagraph></paragraph><paragraph id="H42C97039DBCD4E79A5F0B02688D00EC2"><enum>(2)</enum><text display-inline="yes-display-inline">provide a copy of the findings under <internal-xref idref="HA749AB11AD764C158498488A031DD6D9" legis-path="1.(g)(1)(A)">paragraph (1)(A)</internal-xref> to community entities, local funders, tribal leaders (including, if applicable, the tribal
council), and the families of children participating in the enrichment
program.</text>
</paragraph></subsection></section><section id="HE215EDC576B1485EBA028F559E7E7E43" section-type="subsequent-section"><enum>304.</enum><header>Making routes to schools in underserved communities safe and accessible with public participation
through the Community Oriented Policing Services Program</header><text display-inline="no-display-inline">Section 1701 of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796dd">42 U.S.C. 3796dd</external-xref>) is
amended—</text>
<paragraph id="HF8E9AFD66F254DBAA7EFBC7D2E050D64"><enum>(1)</enum><text>in subsection (b)—</text>
<subparagraph id="HBD87721C43DA4383A93F6442A02B0FE3"><enum>(A)</enum><text>in paragraph (16), by striking <quote>and</quote> after the semicolon;</text>
</subparagraph><subparagraph id="HDAD400D402B94D47B433D64403DC33D9"><enum>(B)</enum><text>by redesignating paragraph (17) as paragraph (18), and in such paragraph (18) (as so redesignated),
by striking <quote>through (16)</quote> and inserting <quote>through (17)</quote>; and</text>
</subparagraph><subparagraph id="H6C90F2795A93477FA9E71723F28B4832"><enum>(C)</enum><text>by inserting after paragraph (16) the following new paragraph:</text>
<quoted-block display-inline="no-display-inline" id="H346A89EF3C634387B9CC5C7E49D8C0B7" style="OLC">
<paragraph id="H333D433F2DAB4A6394D24523C2F6E86B"><enum>(17)</enum><text display-inline="yes-display-inline">to award grants for Safe Routes to School-Community Oriented Policing Services programs, in
accordance with subsection (l); and</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
</subparagraph></paragraph><paragraph id="H165762A78F184814BFC0DD5F6AB539B0"><enum>(2)</enum><text>by adding at the end the following new subsection:</text>
<quoted-block display-inline="no-display-inline" id="H2F54C99CA6044DED974381F1DEE3DB12" style="OLC">
<subsection id="H018054A1EDB541C0BD27EC1A109EC230"><enum>(l)</enum><header>Safe Routes to School-Community Oriented Policing Services programs</header>
<paragraph id="H88E103C54F724CB7BAD19438AB9EA6DD"><enum>(1)</enum><header>Grant program</header><text display-inline="yes-display-inline">The Director of the Office of Community Oriented Policing Services, in collaboration with the
Secretary of Education, shall award grants to not fewer than 10 local and
tribal law enforcement agencies in low-income communities for the
planning, development, and assessment of Safe Routes to School-Community
Oriented Policing Services programs in accordance with this subsection.</text>
</paragraph><paragraph id="H67E1969064664606B4D927C1C64A92FE"><enum>(2)</enum><header>Grant period</header><text>Each grant awarded under this subsection shall be for a 3-year period beginning with the first
fiscal year that begins after the date of enactment of the <short-title>Fit for Life Act of 2014</short-title>, and may not be renewed.</text>
</paragraph><paragraph id="H16FE4EAEA7A646B884C24F84F381C34B"><enum>(3)</enum><header>Use of grants</header><text display-inline="yes-display-inline">A grant awarded under this subsection shall be used by each grantee to—</text>
<subparagraph id="HB04DD24638D84A6C93B602AF5EF74A1D"><enum>(A)</enum><text>assess the needs of the low-income community served by the grantee with respect to the ability of
elementary and secondary school students to get to and from school safely;
and</text>
</subparagraph><subparagraph id="HC40EE8CE259749BFA4BFC022D6997190"><enum>(B)</enum><text display-inline="yes-display-inline">establish and maintain a Safe Routes to School-Community Oriented Policing Services program that
ensures the availability of safe routes to and from school for elementary
and secondary school students in underserved communities by addressing the
unique personal safety dangers to students in such communities that may
cause routes to or from school to be unsafe, such as dangers associated
with crime, drug or gang activity, abandoned properties, and the presence
of sexual predators.</text>
</subparagraph></paragraph><paragraph id="HDF2DE4E6D87542F19A4EEE56A85D24E9"><enum>(4)</enum><header>Reports</header><text display-inline="yes-display-inline">Not later than one year after receiving a grant award under this subsection, and annually
thereafter, each grantee shall submit to the Director of the Office of
Community Oriented Policing Services a report on the Safe Routes to
School-Community Oriented Policing Services program carried out by the
grantee that includes—</text>
<subparagraph id="H2C55972A1C414B009D38BC33281E2C71"><enum>(A)</enum><text>a description of the activities carried out with such grant during the preceding year;</text>
</subparagraph><subparagraph id="HE575E6ECFCA14A0CA51CCFB3EC6ACE88"><enum>(B)</enum><text>the effectiveness of such activities in ensuring safe routes to and from school for elementary and
secondary school students;</text>
</subparagraph><subparagraph id="H63C095ADB0D84CFF8E814C84FA6FDF6D"><enum>(C)</enum><text>a description of the activities the grantee plans to carry out with such grant in succeeding years;
and</text>
</subparagraph><subparagraph id="H20EA6EB2F29249FA94C69B8B14BED68A"><enum>(D)</enum><text>best practices, plans, and findings for purposes of incorporation into urban planning and
development in underserved communities in succeeding years.</text>
</subparagraph></paragraph><paragraph id="H7A48A25A71A1479F9A63466A0D544840"><enum>(5)</enum><header>Definition</header><text>The term <term>low-income communities</term> includes—</text>
<subparagraph id="HED22971AC8874C3CB0D280EF1C6CEEC5"><enum>(A)</enum><text display-inline="yes-display-inline">communities with a high percentage of children eligible for free and reduced priced lunches under
the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>);
and</text>
</subparagraph><subparagraph id="H47D418EA7C15480CACEB190FDA41903C"><enum>(B)</enum><text display-inline="yes-display-inline">any other communities determined by the Director of the Office of Community Oriented Policing
Services to be low-income for purposes of this section.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></section><section commented="no" id="H2F79693A41C6406B870A97CEA9638C98"><enum>305.</enum><header>School infrastructure healthier upgrades competitive grant</header>
<subsection commented="no" id="H04094B4C8D88419BB204FCE049E9E112"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">From the amounts appropriated to carry out this Act, the Secretary of Education shall award grants,
on a competitive basis, to eligible entities to upgrade facilities
specifically pertaining to healthy eating and fitness.</text>
</subsection><subsection commented="no" id="H63F39E77071C47CA95F7FCF8F8E76859"><enum>(b)</enum><header>Authorized use of fund</header><text display-inline="yes-display-inline">An eligible entity receiving a grant under this section shall use such grant to upgrade facilities
specifically pertaining to healthy eating and fitness, which may include—</text>
<paragraph commented="no" id="H6C005F76BC6749C0B529A77CD173F6CE"><enum>(1)</enum><text display-inline="yes-display-inline">building or maintaining school gardens;</text>
</paragraph><paragraph commented="no" id="H3F4F738F7B9943949006B920404D24B2"><enum>(2)</enum><text>renovating outdoor facilities for physical educations or activity programs; or</text>
</paragraph><paragraph commented="no" id="H4DE5C1E3DEA74AECBD2A3F5FB916A3B1"><enum>(3)</enum><text>upgrading kitchen and cafeteria services to better prepare and store healthy foods.</text>
</paragraph></subsection><subsection commented="no" id="H4557001494CF4946BC9EC00232BBC2A3"><enum>(c)</enum><header>Priority</header><text>In awarding grants under this section to eligible entities that are local educational agencies, the
Secretary shall give priority to local educational agencies that—</text>
<paragraph commented="no" id="H59D324DCF8ED4F81845E7CB5C024D7E4"><enum>(1)</enum><text>serve a high-percentage of low-income students;</text>
</paragraph><paragraph id="H324137A4B69E4935BBA90A2877FF5B10"><enum>(2)</enum><text>serve a high-percentage of students who are minorities;</text>
</paragraph><paragraph id="H6D47FCDED65D43A692F2DD6250406BAA"><enum>(3)</enum><text>serve a high-percentage of students with childhood obesity; and</text>
</paragraph><paragraph commented="no" id="H0626FEE5ECD7443BA7C3C71EE561C9A0"><enum>(4)</enum><text>serve schools that have joint use agreements for afterschool programs or community-wellness
partnerships for afterschool or weekend use.</text>
</paragraph></subsection><subsection commented="no" id="HC4A30E56B19840D688DDA73E6F9FF387"><enum>(d)</enum><header>Definitions</header><text>In this section:</text>
<paragraph commented="no" id="HF0548B9F70364583A86449987D0A02F8"><enum>(1)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means a local educational agency or licensed childcare centers with evidence-based wellness
programs.</text>
</paragraph><paragraph commented="no" id="HD0C3D64ED6BB4BB2826D072B81AE4EF3"><enum>(2)</enum><header>Local educational agency</header><text>The term <term>local educational agency</term> has the meaning given the term in section 9101 of the Elementary and Secondary Education Act of
1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text>
</paragraph><paragraph commented="no" id="H69BF902F55D84BE3956C14FFD54BF392"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Education.</text>
</paragraph></subsection></section><section commented="no" id="H93B21626B8134FAE90D64831F995B0CB"><enum>306.</enum><header>Shared use agreement expansion pilot grant program</header>
<subsection commented="no" id="H84449ACD2528414395897CEBE145069B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">From the amounts appropriated to carry out this section, the Secretary of Education shall award
grants, on a competitive basis, to eligible entities to supplement
programmatic costs, operations, security, maintenance fees, and other
costs associated with out-of-school use of elementary school or secondary
school buildings or facilities for physical activity, fitness, and
wellness purposes.</text>
</subsection><subsection commented="no" id="HE556B9DD08E84B429C6E524BABBFDED4"><enum>(b)</enum><header>Grant terms</header><text display-inline="yes-display-inline">Each grant under this section shall be awarded for a period of not more than 3 years.</text>
</subsection><subsection commented="no" id="H6D5A2180665741BFB729DDCDA803FB8D"><enum>(c)</enum><header>Total grants</header><text>The Secretary shall award not less than 15 grants under this section for each fiscal year for which
funds are appropriated to carry out this section.</text>
</subsection><subsection commented="no" id="H04914DF1D872436EABF9930F1B7823B1"><enum>(d)</enum><header>Priority</header><text>In awarding grants under this section, the Secretary shall give priority to each eligible entity
that—</text>
<paragraph id="H4CC9CE309D3849F9A8A557B805FB3383"><enum>(1)</enum><text>serves low-income and minority populations;</text>
</paragraph><paragraph id="H853CF830C53B46DE89BCE72C969C750F"><enum>(2)</enum><text>serves communities with high levels of childhood obesity; and</text>
</paragraph><paragraph id="H1FE313962DA74AC48D0255ACB466BB21"><enum>(3)</enum><text>is supporting a joint or shared-use agreement (as described in subsection (e)(2)(A)) that—</text>
<subparagraph id="HF4E66C2DC3EF4DACA37F9D16C626AC6A"><enum>(A)</enum><text>was established not more than 5 years before the eligible entity received a grant under this
section; and</text>
</subparagraph><subparagraph id="HDD977DDF3A8442AD929F23851B720A3C"><enum>(B)</enum><text>allows the open community use of elementary school or secondary school buildings or facilities as
opposed to only fee-based sports league use.</text>
</subparagraph></paragraph></subsection><subsection commented="no" id="H92B4A99A1A4043CFAE5822ED5EDC1D9A"><enum>(e)</enum><header>Definitions</header><text>In this section:</text>
<paragraph commented="no" id="HC3776E6A94304F9DA66B6D2C42B1BAFB"><enum>(1)</enum><header>ESEA terms</header><text display-inline="yes-display-inline">The terms <term>elementary school</term> and <term>secondary school</term> have the meanings given such terms in section 9101 of the Elementary and Secondary Education Act

</paragraph><paragraph commented="no" id="H54DEBD3A19B34638839F69C5ACDDEE85"><enum>(2)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means an elementary school, secondary school, local government, or community partner that has—</text>
<subparagraph commented="no" id="HCEC1A147D9EE4C25A5AF18B6C50E182C"><enum>(A)</enum><text display-inline="yes-display-inline">adopted or entered into a joint or shared-use agreement authorizing elementary school or secondary
school buildings or facilities to be used by community and nonprofit
organizations for community programs; and</text>
</subparagraph><subparagraph commented="no" id="H22B2D6BB0E95441FB6B7D6B45433091C"><enum>(B)</enum><text>the ability to use funds to support such community programs.</text>
</subparagraph></paragraph><paragraph commented="no" id="H5DED5EE0660045A9BA50E8E7D0ECDD4A"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Education.</text>
</paragraph></subsection></section><section commented="no" id="H3D5EC7C4CCE64910A5AC76C43B92FD37"><enum>307.</enum><header>Land and Water Conservation Fund Program grants in low-income communities and expand tribal
participation</header><text display-inline="no-display-inline">Section 6(e) of the Land and Water Conservation Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/16/460l-8">16 U.S.C. 460l–8(e)</external-xref>) is amended by
adding at the end the following:</text>

communities and on or near Indian reservations.</text></paragraph><after-quoted-block>. </after-quoted-block></quoted-block>
</section><section display-inline="no-display-inline" id="HC3B9236539E64AA48873233090369364" section-type="subsequent-section"><enum>308.</enum><header>Changing Hearts, Attitudes, and Minds by Participating in Sports (CHAMPS) Program</header><text display-inline="no-display-inline">Part B of title III of the Public Health Service Act is amended by inserting after section 317T (42
U.S.C. 247b–22) the following:</text>
<quoted-block display-inline="no-display-inline" id="H7AB8131A3EA84AB19FBF0F9B0DAA5E29" style="OLC">
<section id="H4140FB27E6654833A5AFC2B498D0B5B3"><enum>317U.</enum><header>Changing Hearts, Attitudes, and Minds by Participating in Sports (CHAMPS) Program</header>
<subsection id="HEF537F7B7EBB4C73801BA4B7EF1B38E8"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">The Secretary, acting through the Director of the Centers for Disease Control and Prevention, may
make grants to eligible entities to carry out nationally based or
community-based qualified childhood obesity prevention initiatives.</text>
</subsection><subsection id="H07D7EF346E764581A458DCE959C6C3B8"><enum>(b)</enum><header>Eligible entities</header><text display-inline="yes-display-inline">To be eligible to seek a grant under this section, an entity shall be—</text>
<paragraph id="H467A4FA0D9EF445BACE11310699E83C1"><enum>(1)</enum><text>a nationally based nonprofit organization proposing to implement programs described in subsection
(c), each serving at least 1,000 individuals, at 5 or more locations
across the Nation; or</text>
</paragraph><paragraph id="H23EAC25E876F448192365392805C9BB9"><enum>(2)</enum><text>a community-based nonprofit organization proposing to implement a program described in subsection
(c) serving at least 1,000 individuals.</text>
</paragraph></subsection><subsection id="HF56AE357475A49EE947A90D9126866E4"><enum>(c)</enum><header>Qualified childhood obesity prevention initiative</header><text display-inline="yes-display-inline">To qualify as a childhood obesity prevention initiative eligible for funding under this section, an
initiative shall consist of programs that—</text>
<paragraph id="H0B951DF841E64044B58152421F8C46A0"><enum>(1)</enum><text>serve children or adolescents most at risk for being overweight and obese in predominantly
economically disadvantaged communities;</text>
</paragraph><paragraph id="HA9B68438EEF64FC49964D74D9CDE0AF0"><enum>(2)</enum><text>serve children or adolescents during after-school hours, weekends, or summer hours;</text>
</paragraph><paragraph id="HF27AA12EDE5140A29CBF1C413CD8E0BD"><enum>(3)</enum><text>provide structured physical fitness activities, including organized sports, which engage each
participant in a minimum of 60 minutes of moderate to vigorous physical
activity at least three days per week for a period of at least 24 weeks in
a given year;</text>
</paragraph><paragraph id="HA75FC9F3EF3C4EF586CC782DC81B58FC"><enum>(4)</enum><text>provide adult supervision and guidance or coaches who encourage and teach proper exercise
techniques and skills;</text>
</paragraph><paragraph id="HA7CBBE2990CD4CCCAF426DFD13B8D6C9"><enum>(5)</enum><text>combine physical fitness activities with nutritional counseling and education; and</text>
</paragraph><paragraph id="H8E83B7B99BF04FFCBBEF8D8925DBE8A7"><enum>(6)</enum><text>demonstrate measurable results for reducing childhood obesity on the part of participants,
including through—</text>
<subparagraph id="H4CFE857BE6B84C689B53BB7F6CAF6203"><enum>(A)</enum><text>measurement and study of participants’ moderate to vigorous physical activity (MVPA) each day, both
as part of the programs funded under this section and on the participants’
own initiative;</text>
</subparagraph><subparagraph id="H72947D8304BA49CFBD5AD96AB30612A4"><enum>(B)</enum><text>increased knowledge of and awareness about the importance of physical activity and exercise as well
as the nutritional value of food and beverage choices;</text>
</subparagraph><subparagraph id="H932264742A02405CABB586E6F0BD4CA4"><enum>(C)</enum><text>keeping track of and reporting meaningful reductions in the consumption of food and beverages with
low nutritional value, increased consumption of healthy items, and
increased levels of unstructured, self-initiated physical activity outside
of the programs funded under this section; and</text>
</subparagraph><subparagraph id="HC0828E3297EB409CB1F87614191D22ED"><enum>(D)</enum><text>measurement and study of participants’ body mass index (BMI) indicating that—</text>
<clause id="HB7322A295D94419DB26743F6610920B0"><enum>(i)</enum><text>children entering programs funded under this section with a healthy body mass index maintain it
while participating in such programs; and</text>
</clause><clause id="H1EEA12EDCEBE4872AE9CD1A5D62B145B"><enum>(ii)</enum><text>children participating in such programs with an unhealthy body mass index halt any negative trend
lines toward obesity or begin trend lines in a positive direction.</text>
</clause></subparagraph></paragraph></subsection><subsection id="H0711C7D109094E12A07A344569A59F4C"><enum>(d)</enum><header>Priority</header><text>In selecting among applicants for grants under this section, the Secretary shall give priority to
eligible entities proposing to carry out programs that will provide
additional societal benefits, such as—</text>
<paragraph id="H43601E598E6541A08FEFD1A1FBA7E2DA"><enum>(1)</enum><text display-inline="yes-display-inline">effectiveness in working with programs for ethnic and racial minorities that are evaluated by
independent, third-party evaluators;</text>
</paragraph><paragraph id="H99EE5C1E8FC84BA7B5D5E43CC3CFA792"><enum>(2)</enum><text>improvements to academic performance in school;</text>
</paragraph><paragraph id="H6AAC206475B7444E9AB8905109EB5DF7"><enum>(3)</enum><text>character building and leadership development;</text>
</paragraph><paragraph id="H616DCD685F1E448CAC39A08C8F03F59A"><enum>(4)</enum><text>gang and juvenile delinquency prevention and reduction;</text>
</paragraph><paragraph id="H3F7C40F42D3844A6B5A428E1CF9E4EFA"><enum>(5)</enum><text>gender equality and female empowerment;</text>
</paragraph><paragraph id="H84F0F95125A2475B8C7D1B94088BF6FD"><enum>(6)</enum><text>mentoring, volunteerism promotion, and service-learning opportunities;</text>
</paragraph><paragraph id="HC2ECC91117EB4D02BD02536797EAFCA6"><enum>(7)</enum><text>family and community engagement and participation;</text>
</paragraph><paragraph id="H0F5052BD97E044ABAD480902B52D3F3A"><enum>(8)</enum><text>workforce education and career development opportunities; or</text>
</paragraph><paragraph id="H20360AF39F844A0B93466F90CB70EB5E"><enum>(9)</enum><text display-inline="yes-display-inline">being inclusive of persons with disabilities.</text>
</paragraph></subsection><subsection id="H5A841D3CD5BB4D098F0815AB8A6429E6"><enum>(e)</enum><header>Distribution of funds</header><text>Of the amount made available to carry out this section for a fiscal year, the Secretary shall
award—</text>
<paragraph id="H64B5517441A24B0D9F6DFB5E14083599"><enum>(1)</enum><text>not less than 25 percent of such amount to nationally based nonprofit organizations described in
subsection (b)(1); and</text>
</paragraph><paragraph id="H648E4999B7F24F3285941E8C928917D9"><enum>(2)</enum><text>not more than 75 percent of such amount to community-based nonprofit organizations described in
subsection (b)(2).</text>
</paragraph></subsection><subsection id="HED2475EF657F45AAB3409F9211EA5812"><enum>(f)</enum><header>Cost-Share requirements</header>
<paragraph id="H589F1EE0284F499DA6E1C04DC8BE0B98"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to the costs of a qualified childhood obesity prevention initiative to be carried out
under this section—</text>
<subparagraph id="H57B8EA1FD0A3452E92C8FE43F6C5B22F"><enum>(A)</enum><text>in the case of an applicant that is a nationally based nonprofit organization, a grant under
subsection (a) may be made only if the organization agrees to make
available (directly or through donations from public or private entities)
non-Federal contributions toward such costs in an amount that is not less
than one-third of such costs ($1 for each $2 of Federal funds provided in
the grant); and</text>
</subparagraph><subparagraph id="HA975D61F419841598168E17A9EAC5975"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of an applicant that is a community-based nonprofit organization, a grant under
subsection (a) may be made only if the organization agrees to make
available (directly or through donations from public or private entities)
non-Federal contributions toward such costs in an amount that is not less
than one-fourth of such costs ($1 for each $3 of Federal funds provided in
the grant).</text>
</subparagraph></paragraph><paragraph id="HF9A6401E937A4D5F9A59821B131F4E94"><enum>(2)</enum><header>Non-Federal contributions by subgrantees</header><text display-inline="yes-display-inline">If a nationally based nonprofit organization chooses to provide grant funds received under this
section to a subgrantee to carry out one or more programs as part of the
organization’s qualified childhood obesity prevention initiative, the
organization shall require the subgrantee to make available (directly or
through donations from public or private entities) non-Federal
contributions toward the costs of such programs in an amount that is not
less than one-third of such costs ($1 for each $2 of Federal funds
provided in the grant). The amount of non-Federal contributions by
subgrantees required under this paragraph is in addition to the amount of
non-Federal contributions by the nationally based nonprofit organization
required under paragraph (1).</text>
</paragraph><paragraph id="HCE1B2982288743879FD62514C94D0C42"><enum>(3)</enum><header>Determination of amount contributed</header>
<subparagraph id="HB6ACFC7A5402476995A9010CDBA5CE9B"><enum>(A)</enum><header>In general</header><text>Non-Federal contributions required by paragraph (1) or (2)—</text>
<clause id="H3F575BEAED0E4F23B1D0AAA5AEA5B434"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of a nationally based nonprofit organization, shall be made in cash; and</text>
</clause><clause id="H1961F1DE41264B1E9BB367D821F20252"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of a subgrantee described in paragraph (2) or a community-based nonprofit organization,
may be in cash or in kind, fairly evaluated, including plant, equipment,
or services.</text>
</clause></subparagraph><subparagraph id="HE5E2155CDD8D4A00B0EF9E07B87417B6"><enum>(B)</enum><header>Exclusion of Federal contributions</header><text>Amounts provided by the Federal Government, or services assisted or subsidized to any significant
extent by the Federal Government, may not be included in determining the
amount of non-Federal contributions required by paragraph (1) or (2).</text>
</subparagraph></paragraph></subsection><subsection id="HA820A98D51074EC5AFE19FE375B87E67"><enum>(g)</enum><header>Report to Congress</header><text>Not later than one year after the first appropriation of Federal funds to carry out this section,
the Secretary shall report to the Congress on the progress made in
carrying out programs funded by grants under this section.</text>
</subsection><subsection id="HD5E5D3D2C694404BB3F57A299DA057A1"><enum>(h)</enum><header>Best practices guidelines</header><text>Based on the results of programs funded through grants under this section during the first two
fiscal years of such funding, the Secretary shall develop publicly
accessible best practices guidelines for obesity reduction programs. The
Secretary shall update these guidelines every two years.</text>
</subsection><subsection id="H8D1C38FAAE9F4C5D8B4A54D3989553E7"><enum>(i)</enum><header>Authorization of appropriations</header><text>To carry out this section, there is authorized to be appropriated $50,000,000 for each of fiscal
years 2015 through 2019.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
</section><section id="H0ED223C87D124942ABC671B6AB7D5EEE" section-type="subsequent-section"><enum>309.</enum><header>Coordinated school health initiatives</header>
<subsection id="H35AEF01EAEFF4F63BDAE17A9EDF112A1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">From the amounts appropriated to carry out this section, the Secretary of Education shall carry out
a pilot program to award grants to not more than 5 eligible entities to
carry out coordinated school health initiatives in schools.</text>
</subsection><subsection id="H015C6EAF33C445EEB83AE9A89BB4CD79"><enum>(b)</enum><header>Amount of grant</header><text>A grant awarded under subsection (a) may not exceed $15,000.</text>
</subsection><subsection id="H6179412C4A094DDE93A81BC29A87AEAE"><enum>(c)</enum><header>Use of funds</header><text display-inline="yes-display-inline">An eligible entity receiving a grant under this section shall carry out a coordinated school health
initiative in each school under the jurisdiction of the entity under which
the entity shall—</text>
<paragraph id="H3947052E2FD34B94947080937076CD58"><enum>(1)</enum><text>carry out a program, such as a fitness program, to assess the physical fitness (including aerobic
capacity, muscular strength and endurance, flexibility, and body
composition) of each student served by the entity; and</text>
</paragraph><paragraph id="H027FFBAE38A447549854CF0662264045"><enum>(2)</enum><text display-inline="yes-display-inline">evaluate such assessments to—</text>
<subparagraph id="HC471573179CA44E5A667FCC19AA1D29A"><enum>(A)</enum><text>establish baselines with respect to aerobic capacity, muscular strength and endurance, flexibility,
and body composition that each such student should meet by a certain
period; and</text>
</subparagraph><subparagraph id="H8B11F82CBF1846ED82F8003045D5ABE4"><enum>(B)</enum><text>identify interventions to assist each such student, including those with disabilities, in meeting
such baselines;</text>
</subparagraph></paragraph><paragraph id="H9A610C4A4FBE412DAC1BD881941E7ECE"><enum>(3)</enum><text>review the interventions identified under <internal-xref idref="H8B11F82CBF1846ED82F8003045D5ABE4" legis-path="307.(c)(2)(B)">paragraph (2)(B)</internal-xref> to determine the best practices with respect to such interventions;</text>
</paragraph><paragraph id="H02E53B6987804114B4AA57FA72AD7439"><enum>(4)</enum><text display-inline="yes-display-inline">use the determinations for best practices under <internal-xref idref="H9A610C4A4FBE412DAC1BD881941E7ECE" legis-path="307.(c)(3)">paragraph (3)</internal-xref> to implement interventions in each school under the jurisdiction of the entity; and</text>
</paragraph><paragraph commented="no" id="H7C4BD5B276464326AAFB9A73F93F85B1"><enum>(5)</enum><text display-inline="yes-display-inline">not later than 1 year after the implementation of the interventions, assess the physical fitness of
each student served by the entity.</text>
</paragraph></subsection><subsection id="HE499B55B1D964506B18D440CC4587832"><enum>(d)</enum><header>Reporting</header>
<paragraph id="HA1032D9C0646428FAC2315E24776290F"><enum>(1)</enum><header>Eligible entity</header><text>Each eligible entity receiving a grant under this section shall submit to the Secretary at such
time and in such manner as determined by the Secretary, a report on—</text>
<subparagraph id="HDE5EBCF7822F4141A05CB6AE8636554C"><enum>(A)</enum><text>the initial physical fitness assessments carried out under <internal-xref idref="H3947052E2FD34B94947080937076CD58" legis-path="307.(c)(1)">subsection (c)(1)</internal-xref>;</text>
</subparagraph><subparagraph id="HF21AA15EE9E04C7288FD6144447A94FC"><enum>(B)</enum><text>the interventions implemented under <internal-xref idref="H02E53B6987804114B4AA57FA72AD7439" legis-path="307.(c)(4)">subsection (c)(4)</internal-xref>; and</text>
</subparagraph><subparagraph id="HEF36DE0C458049F4A458EF7F5029083F"><enum>(C)</enum><text>the physical fitness assessments carried out under <internal-xref idref="H7C4BD5B276464326AAFB9A73F93F85B1" legis-path="307.(c)(5)">subsection (c)(5) </internal-xref>after the interventions have been implemented.</text>
</subparagraph></paragraph><paragraph id="H2403F3AF3F14435BB3C10B75D9ED7D2C"><enum>(2)</enum><header>Secretary</header><text display-inline="yes-display-inline">Not later than the first appropriation of Federal funds to carry out this section, the Secretary
shall use the reports received under <internal-xref idref="HA1032D9C0646428FAC2315E24776290F" legis-path="307.(d)(1)">paragraph (1)</internal-xref> to prepare and transmit to Congress a report on—</text>
<subparagraph id="H300CCF56746E44A3AB11518B01D499A0"><enum>(A)</enum><text>the average physical fitness levels of students participating in the coordinated school health
initiative under this section—</text>
<clause id="H0B9F7652B6D5463FA7DFCD053FB7BD15"><enum>(i)</enum><text>prior to the interventions implemented by each eligible entity under this section; and</text>
</clause><clause id="H3F9731E776C04A96A678DE6D4BE34F9B"><enum>(ii)</enum><text>1 year after the implementation of the interventions;</text>
</clause></subparagraph><subparagraph id="HA819078EDB5640A3B6CAD10B279BD56C"><enum>(B)</enum><text>the best practices with respect to the interventions; and</text>
</subparagraph><subparagraph id="H3D2E5F48C65946278A4313FFB5CD6FD0"><enum>(C)</enum><text>recommendations on how schools and local educational agencies may incorporate such best practices.</text>
</subparagraph></paragraph></subsection><subsection id="HB0A82D8592C64B08839F5349AE93B1E8"><enum>(e)</enum><header>Application</header><text>To receive a grant under this section, an eligible entity shall submit an application to the
Secretary of Education at such time, in such manner, and containing such
information as the Secretary may require.</text>
</subsection><subsection id="HDA904E310F694FE78BEF9C2F03CEF78A"><enum>(f)</enum><header>Supplement, Not Supplant</header><text display-inline="yes-display-inline">Funds received under this section shall be used to supplement, and not supplant, non-Federal funds
that would otherwise be used for activities authorized under this section.</text>
</subsection><subsection id="H8E293047ADF742CD9BB1E3B1D1C94C54"><enum>(g)</enum><header>Definitions</header><text>For purposes of this section:</text>
<paragraph id="H460A8EBFCF49479298E3D13A3123A749"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a local educational agency—</text>
<subparagraph id="HB475E7441EB54A2DBD33624D319159E8"><enum>(A)</enum><text>that serves—</text>
<clause id="H844CDA32A0A8409B8449D6BA87E109F1"><enum>(i)</enum><text>a high percentage of students eligible for free or reduced price lunches under the Richard B.
Russell National School Lunch Act; or</text>
</clause><clause id="HAB4BC8680F4B4384BF58BC9C43F94FBA"><enum>(ii)</enum><text>a community otherwise determined by the Secretary to be a low-income community; and</text>
</clause></subparagraph><subparagraph id="HAECF89FD08194CE4908DD632EAD696B4"><enum>(B)</enum><text>that forms a partnership with an institution of higher education or a nonprofit health or education
organization, as determined by the Secretary, for the purposes of carrying
out the coordinated school health initiative described in <internal-xref idref="H6179412C4A094DDE93A81BC29A87AEAE" legis-path="307.(d)">subsection (c)</internal-xref>.</text>
</subparagraph></paragraph><paragraph id="H7337797383814EBA9C14C6E3E50032A6"><enum>(2)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 101 of the Higher Education Act of 1965 (20 U.S.C.
1001).</text>
</paragraph><paragraph id="HA11D40146B114CE88ED95D3855D0A36A"><enum>(3)</enum><header>Local educational agency</header><text>The term <term>local educational agency</term> has the meaning given such term in section 9101 of the Elementary and Secondary Education Act of
1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text>
</paragraph><paragraph id="HDA8E3E4EB6EB4D74A441BAEE4E500758"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text>
</paragraph></subsection></section><section id="H816F5754FCB54A2DA69D8576A95765DB" section-type="subsequent-section"><enum>310.</enum><header>Rewarding elementary and secondary schools for outstanding student performance in physical fitness
programs</header>
<subsection id="HF67EE382BFAD4B5C8B95807A35DA1420"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services may make grants to elementary and secondary schools as
rewards for their students’ outstanding performance in the Presidential
Youth Fitness Program or other federally supported physical fitness
programs.</text>
</subsection><subsection id="H6FC8FFB8DAAB4528969548CE89C22729"><enum>(b)</enum><header>Preference</header><text>In making grants under subsection (a), the Secretary shall give preference to elementary and
secondary schools that—</text>
<paragraph id="HFA9B1AE5EF5C465E9FCF8A794A131895"><enum>(1)</enum><text display-inline="yes-display-inline">have the highest percentage of students earning a Presidential Physical Fitness Award through the
Presidential Youth Fitness Program;</text>
</paragraph><paragraph id="H0FBCC019FF9B4CBD98E5B396B7E16294"><enum>(2)</enum><text display-inline="yes-display-inline">demonstrate the greatest improvement in the number or percentage of students earning the National
Physical Fitness Award and the Participant Physical Fitness Award through
the Presidential Youth Fitness Program; and</text>
</paragraph><paragraph id="H28BA482479904D21BD7A76361B861659"><enum>(3)</enum><text display-inline="yes-display-inline">implement evidence-based physical education and physical activity policies and programs that align
with the Presidential Youth Fitness Program.</text>
</paragraph></subsection><subsection id="H280FC6818A3A4CACAFB614DBBB0C8C14"><enum>(c)</enum><header>Allocation of funds for underperforming schools</header><text>Of the amounts made available for grants under this section for each fiscal year, the Secretary
shall set aside a portion of such amounts for underperforming elementary
and secondary schools that—</text>
<paragraph id="HC2F9315E11D941BC81896F31B36824C7"><enum>(1)</enum><text>are in need of improvement;</text>
</paragraph><paragraph id="H0F0ED3EEE518405496AABE70B19729D0"><enum>(2)</enum><text>meet the requirements of this section; and</text>
</paragraph><paragraph id="H7DF2AC22837B47DFB1C0261052C41897"><enum>(3)</enum><text display-inline="yes-display-inline">have evidence-based physical education and physical activity policies and programs.</text>
</paragraph></subsection><subsection id="H5204FBA5F7C84777B36DB2C60A163EBC"><enum>(d)</enum><header>Use of funds</header><text>As a condition on receipt of a grant under this section, a school shall agree to use the grant
funds for programs and activities to further improve the physical fitness
of students.</text>
</subsection><subsection commented="no" id="H864BC3D3C4DA42E09AD2DBE7EBE9F1BB"><enum>(e)</enum><header>Data requirements</header><text display-inline="yes-display-inline">As a condition on receipt of a grant, a school shall agree to report the results achieved at the
school through the Presidential Youth Fitness Program or other Federal
physical fitness programs to the community and the relevant State agency—</text>
<paragraph id="HE492327DD42D43878E14B9F24CD9CE34"><enum>(1)</enum><text>to improve tracking of physical fitness data across the United States; and</text>
</paragraph><paragraph id="H03DBFFB36D3345378D3F1FF532AAA372"><enum>(2)</enum><text>to inform efforts to strengthen local wellness policies to improve student physical activity and
physical fitness.</text>
</paragraph></subsection><subsection commented="no" id="H7A7CA818B1354DC193A625C285CC0302"><enum>(f)</enum><header>Application</header><text display-inline="yes-display-inline">To seek a grant under this section, a school shall submit an application at such time, in such
manner, and containing such information as the Secretary may require. At a
minimum, an application under this subsection shall include—</text>
<paragraph commented="no" id="H684D2E51FA30431FA55CF8EBAEB01FFD"><enum>(1)</enum><text>a description of the school’s programs and activities for improving physical fitness;</text>
</paragraph><paragraph commented="no" id="H6E2831DAB0584EE2A921AD82BD971F41"><enum>(2)</enum><text>an assurance of compliance with applicable requirements of physical fitness programs of the
Department of Health and Human Services; and</text>
</paragraph><paragraph commented="no" id="H0AD5928258C3490F92A2109574024F83"><enum>(3)</enum><text>an assessment of physical fitness levels of students in the school before, during, and after
implementation such programs.</text>
</paragraph></subsection><subsection id="HB31B20B41996486181C9F465AB47000D"><enum>(g)</enum><header>Reports</header>
<paragraph id="HE17DEFF5F0A24316AAEE43D8965EA65D"><enum>(1)</enum><header>HHS</header><text>Not later than 18 months after the date of the enactment of this Act, and annually thereafter, the
Secretary shall submit a report to the Congress on the program of grants
under this section, including—</text>
<subparagraph id="H0C518CEA2E6A47C9A3676D64EE690BCD"><enum>(A)</enum><text>a description of best practices by elementary and secondary schools for improving physical fitness;
and</text>
</subparagraph><subparagraph id="HE981DE6DA26F47FC98D2BD4CB77B734E"><enum>(B)</enum><text>any recommendations for improving the program under this section.</text>
</subparagraph></paragraph><paragraph id="HBC30D26D7B994967AA3D9AC51E529369"><enum>(2)</enum><header>GAO</header><text>Not later than 24 months after the date of the enactment of this Act, the Comptroller General of
the United States shall complete a study and submit a report to the
Congress—</text>
<subparagraph id="H96C697A3B8174645A6A701D925065E8D"><enum>(A)</enum><text>analyzing physical fitness levels of students in elementary and secondary schools across the
Nation;</text>
</subparagraph><subparagraph id="H16D3E7DC657344799BCCBB68B5709E6C"><enum>(B)</enum><text display-inline="yes-display-inline">evaluating the President’s Challenge to determine whether the standards for Presidential Physical
Fitness Awards, National Physical Fitness Awards, and Participant Physical
Fitness Awards are accurate, up-to-date, and appropriate; and</text>
</subparagraph><subparagraph id="HF581F587C16941448D170146FE259E57"><enum>(C)</enum><text>evaluating the effectiveness of the awards described in subparagraph (B).</text>
</subparagraph></paragraph></subsection><subsection id="HE4434F3F40384D7AA09FA1EE928CAEC1"><enum>(h)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="H33BA6DFEF48147518DCF4B0531AE9128"><enum>(1)</enum><text>The term <term>elementary and secondary schools</term> means public or private elementary schools and secondary schools (as defined in section 9101 of
the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)).</text>
</paragraph><paragraph id="HF0CF0C42CC804BCD8818F9F9BB486A99"><enum>(2)</enum><text>The term <term>President’s Challenge</term> refers to the premier program of the President’s Council on Fitness, Sports & Nutrition, under the Secretary of Health and Human Services, for increasing physical activity and
improving physical fitness.</text>
</paragraph><paragraph id="HA47879F516A14B67B197E4569EF385AC"><enum>(3)</enum><text>The term <term>Secretary</term> means the Secretary of Health and Human Services.</text>
</paragraph></subsection></section>
