		<official-title>To require Federal agencies to provide notice and consideration of evidence before submitting debts
			 to the Secretary of the Treasury for collection through reduction of tax
			 refunds, and to restore the 10-year statute of limitations applicable to
			 collection of debt by administrative offset.</official-title>

		<section id="HF8A0E81C39FF4152A1CDE340B7B5E89A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Verify It Act</short-title></quote>.</text>
		</section><section id="H1A7258716FF141BAAEFD2CFF035B381B"><enum>2.</enum><header>Requirement that Federal agencies provide notice and consideration of evidence before submitting
			 debts to the Secretary of the Treasury for collection through reduction of
			 tax refunds</header>
			<subsection id="H701184647E2F4C688CADDAFCA0832C20"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/6402">Section 6402(d)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following
			 new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HB7252A92D16F4A4BBB89193E8A48628D" style="OLC">
					<paragraph id="HC41DC9C06E0B4FC79464DE61C4E1789A"><enum>(4)</enum><header>Notice; consideration of evidence</header><text display-inline="yes-display-inline">A Federal agency may not notify the Secretary under this subsection of any past-due legally
			 enforceable debt until such Federal agency—</text>
						<subparagraph id="H97A4E99D89CE4E5AAC195D813A4C1BBA"><enum>(A)</enum><text display-inline="yes-display-inline">notifies by certified mail with return receipt the person owing the past-due legally enforceable
			 debt that the Federal agency proposes to take action pursuant to this
			 subsection;</text>
						</subparagraph><subparagraph id="HDA58B3A90BE64943901ABB70FE2B3C78"><enum>(B)</enum><text>gives such person at least 60 days to present evidence that all or part of such liability is not
			 past-due or not legally enforceable;</text>
						</subparagraph><subparagraph id="H5DFDDAB97C1F44F58FE37A3150B6DB43"><enum>(C)</enum><text>considers any evidence presented by such person and determines that an amount of such debt is
			 past-due and legally enforceable; and</text>
						</subparagraph><subparagraph id="H6373685AAA8D49DFAF4418F429974AC3"><enum>(D)</enum><text>satisfies such other conditions as the Secretary may prescribe to ensure that the determination
			 made under subparagraph (C) is valid and that the Federal agency has made
			 reasonable efforts to obtain payment of such debt.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H88CF7E5FB4D74B6199747E571B58023F"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall take effect on the date of the enactment of this Act.</text>
			</subsection></section><section id="H541E08DF28644DB69C0122B5606FE71D" section-type="subsequent-section"><enum>3.</enum><header>Restoration of statute of limitations</header>
			<subsection id="H387F1DAA29AE40D1872D7596095DCB9D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/31/3716">Section 3716(e)</external-xref> of title 31, United States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HBBC7FC7B39884925972341D67B07191D" style="USC">
					<subsection id="H8E91021C3D014B05B382973D36F8C257"><enum>(e)</enum><text display-inline="yes-display-inline">This section does not apply—</text>
						<paragraph id="HB7081916B7244A9BB779109EC3E40B34"><enum>(1)</enum><text display-inline="yes-display-inline">to a claim under this subchapter that has been outstanding for more than 10 years; or</text>
						</paragraph><paragraph id="H50CF02B797B94A81A66CE2FF67204263"><enum>(2)</enum><text>when a statute explicitly prohibits using administrative offset or setoff to collect the claim or
			 type of claim involved.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H074C44BDA72049699849CBE8D7B8EDA3"><enum>(b)</enum><header>Retroactivity</header><text>In the administration of <external-xref legal-doc="usc" parsable-cite="usc/31/3716">section 3716(e)</external-xref> of title 31, United States Code, the following provisions
			 of law shall be treated as if they had never been enacted:</text>
				<paragraph id="H916C54F2F56348D49237F0BC8D636B53"><enum>(1)</enum><text>Section 14219 of the Food, Conservation, and Energy Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/234">Public Law 110–234</external-xref>; 122 Stat.
			 1483), repealed as duplicative enactment by section 4 of Public Law
			 110–246 (<external-xref legal-doc="usc" parsable-cite="usc/7/8701">7 U.S.C. 8701</external-xref> note).</text>
				</paragraph><paragraph id="HA75FDEF61D244C24BF408E4986CF7790"><enum>(2)</enum><text>Section 14219 of the Food, Conservation, and Energy Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/246">Public Law 110–246</external-xref>; 122 Stat.
			 2245).</text>
