		<section id="H161FC9CBC4A749C4A933E5BC0B64630E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Managed Carbon Price Act of 2014</short-title></quote>.</text>
		</section><section id="H6B49D7CCDA5647A79E35E732C3293889" section-type="subsequent-section"><enum>2.</enum><header>Greenhouse Gas Emission Substances</header>
			<subsection id="H45B625D0B03B431181921373F8322744"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Internal Revenue Code of 1986 is amended by adding at the end the following:</text>

						<section id="H301E8EA42B734A0EBD4C3A6F075EF542"><enum>9901.</enum><header>Condition precedent to sale or use of greenhouse gas emission substance</header>
							<subsection id="H4709C1EE19BB474D895A3AEAC034913E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">No covered person may sell any greenhouse gas emission substance except pursuant to a Federal
			 emission permit for each carbon dioxide equivalent that the Administrator
			 of the Environmental Protection Agency determines would be emitted from
			 the combustion or other greenhouse gas emitting use of such substance.</text>
							</subsection><subsection id="H29D8A2CCCEDA493DBC7D44A36A474EB8"><enum>(b)</enum><header>Covered person</header><text>For purposes of this subtitle, the term <term>covered person</term> means—</text>
								<paragraph id="H10FD3CE9E8C74923A7128C91383E10F2"><enum>(1)</enum><text display-inline="yes-display-inline">in the case of coal (including lignite and peat) produced from a mine in the United States, the
			 producer of such coal,</text>
								</paragraph><paragraph id="H1B8AD53F898E4950B19B09BDE86514B8"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of crude oil or petroleum products received at a United States refinery, the operator
			 of the United States refinery,</text>
								</paragraph><paragraph id="HE93A6CF490AD43C3A087BE77CE83BF54"><enum>(3)</enum><text display-inline="yes-display-inline">in the case of natural gas, the first seller of such natural gas,</text>
								</paragraph><paragraph id="H2A1A5A9B25D24A1DA6C261FE4D49F180"><enum>(4)</enum><text>in the case of any greenhouse gas emission substance not described in paragraph (1), (2), or (3)
			 produced in the United States, the producer of such substance, and</text>
								</paragraph><paragraph id="H1A42D25F54F947B7B1E9B330EE85D6EB"><enum>(5)</enum><text display-inline="yes-display-inline">in the case of any greenhouse gas emission substance entered into the United States for
			 consumption, use, or warehousing, the person entering such substance for
			 consumption, use, or warehousing.</text>
								</paragraph></subsection><subsection id="H9512ADC92B5940A7A2BE8A1FCD252218"><enum>(c)</enum><header>Use treated as sale</header>
								<paragraph id="H8CF315AA18B1428F9FA84D8704B92458"><enum>(1)</enum><header>In general</header><text>If any person uses a greenhouse gas emission substance before the first retail sale of such
			 substance, then such person shall be liable for the purchase of a Federal
			 emission permit under section 9902 in the same manner as if such substance
			 were sold at retail on the date of such use by such person pursuant to a
			 Federal emission permit.</text>
								</paragraph><paragraph id="H82765D5FD174413F931E7D2F0F33ADDF"><enum>(2)</enum><header>Exemption for use in further manufacture</header><text>Paragraph (1) shall not apply to use of a greenhouse gas emission substance as material in the
			 manufacture or production of, or as a component part of, another article
			 to be manufactured or produced by such person.</text>
								</paragraph></subsection><subsection id="H18C14F6D43EF475DA46B5E9F59EF7203"><enum>(d)</enum><header>Exceptions</header><text>Subsection (a) shall not apply to—</text>
								<paragraph id="H3F11F944343B4813A0AD21A30EDEE8FC"><enum>(1)</enum><text>a greenhouse gas emission substance to be used for noncombustion agricultural purposes, or</text>
								</paragraph><paragraph id="H01D637ABAEA94C64AF176152633514D3"><enum>(2)</enum><text>a greenhouse gas emission substance with respect to which a Federal emission permit has previously
			 been purchased.</text>
								</paragraph></subsection><subsection id="HFC3A594E1A244546830FF595B069A975"><enum>(e)</enum><header>Importation of Carbon Intensive Goods</header>
								<paragraph id="H250B22A68DF344FF92E2D062B6D1F8BF"><enum>(1)</enum><header>Greenhouse gas emission permit equivalency fees</header><text>The Secretary shall impose a greenhouse gas emission permit equivalency fee on imports of carbon
			 intensive goods that shall be equivalent to the cost that domestic
			 producers of comparable carbon intensive goods incur as a result of—</text>
									<subparagraph id="H69C704264B1F4AEBB544BEEAB16992F8"><enum>(A)</enum><text>permit fees paid by covered persons for greenhouse gas emission substances under this section, and</text>
									</subparagraph><subparagraph id="HBE632F6E8C814EFBA47595F8F6E4D424"><enum>(B)</enum><text>greenhouse gas emission permit equivalency fees paid by importers of carbon intensive goods used in
			 the production of the comparable carbon intensive goods in question.</text>
									</subparagraph></paragraph><paragraph id="HBBA661702B2C4943944D3D4779CC4A56"><enum>(2)</enum><header>Expiration</header><text>Paragraph (1) and section 6433(b) shall cease to have effect at such time as and to the extent
			 that—</text>
									<subparagraph id="H390A0B0D5D8B4EE19E6F635B3E700F81"><enum>(A)</enum><text>an international agreement requiring countries that emit greenhouse gases and produce carbon
			 intensive goods for international markets to adopt equivalent measures
			 comes into effect, and</text>
									</subparagraph><subparagraph id="H35BC107F73B34D299575C9068CD13747"><enum>(B)</enum><text>the country of export has implemented equivalent measures, and the actions provided for by
			 paragraph (1) and section 6433(b) are no longer appropriate.</text>
									</subparagraph></paragraph></subsection></section><section id="H694C18147DEF48D5910938DF2AF03AF5"><enum>9902.</enum><header>Federal emission permit</header>
							<subsection id="H71206DF4A1DF4ED0AB0883DFBD132B79"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall, subject to subsection (d), issue Federal emission permits, as provided for in
			 this subtitle. A Federal emission permit may only be obtained upon making
			 payment to the Secretary.</text>
							</subsection><subsection id="HAB1AECBFFA794FDB88832B7667A2BE3A"><enum>(b)</enum><header>Rules relating to permits</header><text>For purposes of this subtitle—</text>
								<paragraph id="HC0EFA9849CB4495784FA56A3DD5D18E5"><enum>(1)</enum><text>Each Federal emission permit shall be denominated in one-quarter carbon dioxide equivalents.</text>
								</paragraph><paragraph id="HA3B732B790364DFF8BA0E14E0F2916EF"><enum>(2)</enum><text display-inline="yes-display-inline">A Federal emission permit may only be purchased within fourteen calendar days before or after a
			 greenhouse gas emission substance is produced or entered into the United
			 States, as the case may be.</text>
								</paragraph><paragraph id="H5AE5191B846D4CE0B44CC4C90D8F04C1"><enum>(3)</enum><text>Except as provided in subsection (a), a Federal emission permit may not be sold, exchanged, or
			 otherwise transferred.</text>
								</paragraph></subsection><subsection id="H4EEBDDEC9B8640928EF997159EBF9BE7"><enum>(c)</enum><header>Permit Price</header>
								<paragraph id="H9AB6BD2F8C434696ADFD850495840F5D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, after consultation with the Administrator of the Environmental Protection Agency and
			 the Secretary of Energy, shall establish the price of obtaining a Federal
			 emission permit for a calendar year based on a determination of the dollar
			 amount necessary to meet the emissions reductions targets specified in
			 subsection (d).</text>
								</paragraph><paragraph id="HBDFA383C01AA44EDA66E48EF5FC6E9EE"><enum>(2)</enum><header>5-year price schedule</header>
									<subparagraph commented="no" id="HD25B07EA68924ABE8464181FC2CAB9A4"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than January 1, 2016, the Secretary shall publish a schedule of the prices determined
			 under paragraph (1) for obtaining a Federal emission permit during each of
			 the five years from 2017 to 2021. The Secretary shall publish the price
			 for obtaining a Federal emission permit in each year after 2020 no later
			 than five years before January 1 of the applicable year.</text>
									</subparagraph><subparagraph id="HC99C4F5B38A6462EA25FC79EED0FD8AE"><enum>(B)</enum><header>Reduction in price if target reductions being exceeded</header><text>If the Secretary determines—</text>
										<clause id="H87F552920B0C44AE97B054645FBC63E7"><enum>(i)</enum><text>that greenhouse gas emissions are being reduced at a rate that exceeds the reduction expected in
			 national greenhouse gas emissions for the year, and</text>
										</clause><clause id="HC6D0B373EEDC42DDAC78407968531828"><enum>(ii)</enum><text>that the Federal permit price can be reduced while still attaining the national greenhouse gas
			 emission target reductions specified in subsection (d) for the year,</text></clause><continuation-text continuation-text-level="subparagraph">the Secretary may, at any time before the beginning of the year, reduce the Federal permit price
			 for that year.</continuation-text></subparagraph></paragraph><paragraph id="H8C5F542B8C19407797E0A41138900F96"><enum>(3)</enum><header>Increase in price if target reductions not being met</header><text display-inline="yes-display-inline">If the Secretary determines that the reduction of greenhouse gas emissions is failing to meet the
			 target reductions specified in subsection (d) for a year in such period,
			 the Secretary may increase the Federal permit price for permits no earlier
			 than 2 years after the year for which the determination is made.</text>
								</paragraph><paragraph id="H42F9AE6CEF484529BE37CD9622EF7640"><enum>(4)</enum><header>Maximum and Minimum Price</header>
									<subparagraph id="HECD81B1C02454913ADE395CC564AD7C8"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than January 1, 2023, and every 10 years thereafter, the Secretary, after consultation
			 with the Administrator of the Environmental Protection Agency and the
			 Secretary of Energy, shall publish a 10-year schedule of the minimum and
			 maximum prices for Federal emissions permits.</text>
									</subparagraph><subparagraph id="HC3F8ED7B9C2047DC80F03E541F436F1C"><enum>(B)</enum><header>Prices specified</header><text>The maximum and minimum price for a Federal emission permit issued by the Secretary in a year may
			 not be below the minimum price or the maximum price for the corresponding
			 year specified in the following table:</text>

									</subparagraph><subparagraph id="H739A75B625814198B227BEEF16257E57"><enum>(C)</enum><header>Adjustment for inflation</header><text display-inline="yes-display-inline">In the case of any calendar year beginning after 2015, each dollar amount contained in the table in
			 subparagraph (B) shall be increased by an amount equal to—</text>
										<clause display-inline="no-display-inline" id="H518E7FDB35B64EF3AAF89322017ECC28"><enum>(i)</enum><text>such dollar amount, multiplied by</text>
										</clause><clause id="H47C8F22C989D4E2ABFBA3D77ECF287C2"><enum>(ii)</enum><text>the cost of living adjustment determined under section 1(f)(3) for the calendar year, determined by
			 substituting <quote>calendar year 2014</quote> for <quote>calendar year 1992</quote> in subparagraph (B) thereof.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="HCE6E9CD6D96F42E68769D60CFE887171"><enum>(d)</enum><header>National Limitation</header>
								<paragraph id="H719C7B43FD6240C297649315A27DC6F8"><enum>(1)</enum><header>Targets</header><text display-inline="yes-display-inline">For purposes of this section—</text>
									<subparagraph id="HF4FD3C892EA84C38A5CA7FFD7EC6FCEA"><enum>(A)</enum><header>2015 through 2019</header><text display-inline="yes-display-inline">The average emissions for the period 2015 through 2019 shall be no more than the carbon dioxide
			 equivalents emitted in the United States in 2005.</text>
									</subparagraph><subparagraph id="H0AE199A135B143CFBD7EC91AA4CC9C24"><enum>(B)</enum><header>2025 through 2029</header><text display-inline="yes-display-inline">The average emissions for the period 2025 through 2029 shall be no more than 70 percent of the
			 carbon dioxide equivalents emitted in the United States in 2005.</text>
									</subparagraph><subparagraph id="H6848CD7ED6C34C6193E1BE2867798BA4"><enum>(C)</enum><header>2035 through 2039</header><text>The average emissions for the period 2035 through 2039 shall be no more than 50 percent of the
			 carbon dioxide equivalents emitted in the United States in 2005.</text>
									</subparagraph><subparagraph id="H1F10A07FBE424FA3B3D47715AF0AD4FF"><enum>(D)</enum><header>2045 through 2049</header><text>The average emissions for the period 2045 through 2049 shall be no more than 30 percent of the
			 carbon dioxide equivalents emitted in the United States in 2005.</text>
									</subparagraph><subparagraph id="H48A32ADFA27246CFA31939C3A7028EF7"><enum>(E)</enum><header>2055 through 2059</header><text>The average emissions for the period 2055 through 2059 shall be no more than 20 percent of the
			 carbon dioxide equivalents emitted in the United States in 2005.</text>
									</subparagraph></paragraph><paragraph id="H0BFB1F6640B74544AB9E5EAEEF9D4E47"><enum>(2)</enum><header>Determination of 2005 levels</header><text display-inline="yes-display-inline">For purposes of subparagraph (A), the number of metric tons of carbon dioxide equivalents emitted
			 in the United States in 2005 shall be the number determined under section
			 1605(a) of the Energy Policy Act of 1992 and published by the Energy
			 Information Administration.</text>
								</paragraph></subsection><subsection commented="no" id="H874A4CF90B7E4BA995D95657A906D00A"><enum>(e)</enum><header>Report</header>
								<paragraph id="H721B908F57F1429497B3A321DE4182B5"><enum>(1)</enum><header>In general</header><text>Not later than the second March 1 after the date of the enactment of the <short-title>Managed Carbon Price Act of 2014</short-title>, and annually thereafter, the Secretary shall publish a report describing—</text>
									<subparagraph id="H055BAFB09A5A41639D97A099975BE136"><enum>(A)</enum><text>the extent to which the United States greenhouse gas emission limitations specified under
			 subsection (d) are being achieved,</text>
									</subparagraph><subparagraph id="H7B84BF81131049858743F9CF87A9B407"><enum>(B)</enum><text display-inline="yes-display-inline">the United States greenhouse gas emission permits sold during the previous calendar year and the
			 impact of the number of such permits on greenhouse gas emissions in the
			 United States, and</text>
									</subparagraph><subparagraph id="H241E151A63F241008647B7A13D67839B"><enum>(C)</enum><text>the total greenhouse gas emissions worldwide for the previous calendar year in relation to such
			 emissions for 2005.</text>
									</subparagraph></paragraph><paragraph id="H409FD93E944E4228B2C474F11CF12F84"><enum>(2)</enum><header>Report details</header><text>Such report shall include—</text>
									<subparagraph id="HCCCDF7CE27DD4CB4B1227B861F20EFE6"><enum>(A)</enum><text>an explanation of the methodology and assumptions the Secretary has used in establishing prices
			 under this section, and</text>
									</subparagraph><subparagraph id="H5B274C94BBDC4E0A841142ED09489FAE"><enum>(B)</enum><text display-inline="yes-display-inline">an estimation, or range of estimations, of the price of permits for the 10-year period following
			 the current prices published under subsection (c).</text>
									</subparagraph></paragraph></subsection></section><section id="H66CC40438F42472C9B8759D9239D308E" section-type="subsequent-section"><enum>9903.</enum><header>Definitions</header>
							<subsection id="H7B110B6A12D64724A641B974A7FD0103"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of this subtitle—</text>
								<paragraph id="HCAEB04CAF4CA4A89BE701AFB5E71ED16"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text>
								</paragraph><paragraph display-inline="no-display-inline" id="HAF2B49C80D3943018036D62B0A22FF26"><enum>(2)</enum><header>Carbon dioxide equivalent</header><text>The term <term>carbon dioxide equivalent</term> means, for each greenhouse gas emission substance, the quantity of the greenhouse gas emission
			 substance that the Administrator determines makes the same contribution to
			 global warming as 1 metric ton of carbon dioxide.</text>
								</paragraph><paragraph display-inline="no-display-inline" id="HD1023835157F44B49FB3D130DEE7B9CD"><enum>(3)</enum><header>Greenhouse gas emission substance</header><text>The term <term>greenhouse gas emission substance</term> means—</text>
									<subparagraph id="H5474F4B7DC634961906CD80814E42A03"><enum>(A)</enum><text display-inline="yes-display-inline">coal (including lignite, peat, and derivatives of coal), to be used as a combustion fuel,</text>
									</subparagraph><subparagraph id="H0CBE3E8A47A14D25976D910CB850D4E4"><enum>(B)</enum><text>petroleum and any petroleum product, to be used as a combustion fuel,</text>
									</subparagraph><subparagraph id="H3ADB8CC596F64D38B6A8768F2CECCE85"><enum>(C)</enum><text display-inline="yes-display-inline">natural gas (including the gasses released as a result of flaring or venting such natural gas),</text>
									</subparagraph><subparagraph id="H1656E78638444D2EA264C46AA42CA6C5"><enum>(D)</enum><text>methane,</text>
									</subparagraph><subparagraph id="H4AEA0619B31B4F1DA73E2B8850796012"><enum>(E)</enum><text>nitrous oxide,</text>
									</subparagraph><subparagraph id="HB8232C5E72304065A0D063687EBAFEEA"><enum>(F)</enum><text>sulfur hexafluoride,</text>
									</subparagraph><subparagraph id="HE095A497ECC942E8BFA11710B0E63498"><enum>(G)</enum><text>a perfluorocarbon,</text>
									</subparagraph><subparagraph id="HC2D8A1FE41E5471285222B8BE48A5D67"><enum>(H)</enum><text display-inline="yes-display-inline">a hydrofluorocarbon, and</text>
									</subparagraph><subparagraph id="H7C529C113BDF41F1B23ECEA7845930A1"><enum>(I)</enum><text display-inline="yes-display-inline">any other substance that is determined by the Administrator to contribute to global warming to a
			 nonnegligible degree.</text>
									</subparagraph></paragraph><paragraph id="H4074EF11250C45029D47B8930B7EA3A0"><enum>(4)</enum><header>Federal emission permit</header><text>The term <term>Federal emission permit</term> means a permit required under section 9901.</text>
								</paragraph><paragraph id="H00282A7404AB407BB775518C142DF72B"><enum>(5)</enum><header>Carbon intensive good</header><text>The term <term>carbon intensive good</term> means—</text>
									<subparagraph id="H3E5994C061754166924C4EB119C3959B"><enum>(A)</enum>
										<clause commented="no" display-inline="yes-display-inline" id="H26783EEF8286451FB22BC8635C701182"><enum>(i)</enum><text>iron, steel, any steel mill product (including pipe and tube), aluminum, cement, glass (including
			 flat, container, and specialty glass and fiberglass), pulp, paper,
			 chemicals, and industrial ceramics, and</text>
										</clause><clause id="H4ADF4F488EF54985AD5EF2AA6DD5044A" indent="up1"><enum>(ii)</enum><text>any other manufactured product that the Secretary determines—</text>
											<subclause id="H6B63FAB765304AC7AA1841D3A9A8B805"><enum>(I)</enum><text>is sold for purposes of further manufacture, and</text>
											</subclause><subclause id="HAAB90E53E84042EF943B6E474768761E"><enum>(II)</enum><text>generates, in the course of the manufacture of the product, direct and indirect greenhouse gas
			 emissions that are comparable (on an emissions per dollar of output basis)
			 to emissions generated in the manufacture or production of a good
			 identified in clause (i), and</text>
											</subclause></clause></subparagraph><subparagraph id="H9DEFF59B3E394F45A0ECE86419A3A51D"><enum>(B)</enum><text>a manufactured item in which one or more goods identified under subparagraph (A) are inputs and the
			 cost of production of which in the United States the Secretary determines
			 is significantly increased by this subtitle.</text>
									</subparagraph></paragraph><paragraph id="H9BA3E6F24BF04C639AABBBF9D633780F"><enum>(6)</enum><header>Petroleum product</header><text>The term <term>petroleum product</term> has the meaning given such term in section 4612(a)(3).</text>
								</paragraph></subsection><subsection id="H6DD4BA2FFB3146A08A14FC6F0E35011E"><enum>(b)</enum><header>Identification of carbon intensive goods</header><text>The determinations by the Secretary required by subsection (a)(5) shall be by rule.</text>
							</subsection><subsection id="H4AA079454B30448894DD5B19FC8CE829"><enum>(c)</enum><header>Publication of schedule</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of the <short-title>Managed Carbon Price Act of 2014</short-title>, the Administrator, in consultation with the Secretary and the Secretary of Energy, shall publish
			 a schedule listing each greenhouse gas emission substance and the quantity
			 of each substance required to make 1 metric ton of carbon dioxide. The
			 Administrator, in consultation with the Secretary and the Secretary of
			 Energy, may update such schedule from time to time.</text>
							</subsection></section><section commented="no" id="H7F11DCD805514E9788DD3A3E083B9356"><enum>9904.</enum><header>Information reporting requirements</header><text display-inline="no-display-inline">Secretary may solicit information from covered persons regarding estimated future use of greenhouse
			 gas emissions substances.</text>
						</section><section id="H6D8507F5384541468F8BFBBE9B15FAA9"><enum>9905.</enum><header>Regulations</header><text display-inline="no-display-inline">The Secretary shall issue such regulations as may be necessary or appropriate to carry out this
			 subtitle, including regulations relating to the timely and efficient
			 issuance of permits and collection of payments for such permits.</text></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H4C4EEC1C09D944A8ABE9D3157AD21DD2"><enum>(b)</enum><header>Refund of Federal emission permit fee</header><text display-inline="yes-display-inline">Subchapter B of chapter 65 of such Code is amended by adding at the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="HE67C66120AAF47C3B9EFDFD8556BF3CA" style="OLC">
					<section id="HEFF1B361EC594310A3FCD964D4C65781"><enum>6433.</enum><header>Refunds of Federal emission permit fee for certain uses</header>
						<subsection id="H953E6F6CD63648868267B899DA73AF47"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">If a Federal emission permit has been acquired with respect to a greenhouse gas emission substance
			 pursuant to section 9902 and the acquirer of such permit uses such
			 substance in a manner that will make a negligible or no contribution to
			 global warming, as determined by the Secretary in consultation with the
			 Administrator of the Environmental Protection Agency, the Secretary shall
			 pay (without interest) to the acquirer of such substance pursuant to such
			 permit an amount equal to the amount paid for the applicable Federal
			 emission permit.</text>
						</subsection><subsection display-inline="no-display-inline" id="HF66A2EA67F0549D9A0B0FFC02609A34E"><enum>(b)</enum><header>Payments to exporters</header><text>The Secretary shall pay (without interest) to the exporter of a carbon intensive good (as defined
			 in section 9903(5)) produced in the United States an amount equal to the
			 cost that domestic producers of such carbon intensive goods incur as a
			 result of—</text>
							<paragraph id="H1AFEE398640148AC9656348FD7B9CB47"><enum>(1)</enum><text>the dollar amount paid by covered persons for Federal emission permits for greenhouse gas emission
			 substances under this section 9902, and</text>
							</paragraph><paragraph id="HC857145E58724734B978337ED445CA22"><enum>(2)</enum><text>greenhouse gas emission permit equivalency fees paid under section 9901(e) by importers of carbon
			 intensive goods used in the production of the comparable carbon intensive
			 goods in question.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA85ECD056DA34740AFF67E7F808509F4"><enum>(c)</enum><header>Failure To obtain permit</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/38">Chapter 38</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new
			 subchapter:</text>

						<section id="H90DE5EC0602E4EA09FA93697C0FC27F8"><enum>4691.</enum><header>Greenhouse gas emission substances</header>
							<subsection id="H2EE0BAC30B2F4B4B9BF814C80A19692C"><enum>(a)</enum><header>Imposition of tax</header><text display-inline="yes-display-inline">There is hereby imposed on any covered person who fails to obtain a Federal emission permit
			 pursuant to subtitle L a tax equal to 100 percent of the dollar amount of
			 the fee that would have been charged for such permit but for such failure.</text>
							</subsection><subsection id="H4123690BFA4C40099D52416D708F1186"><enum>(b)</enum><header>Covered person</header><text display-inline="yes-display-inline">The term <term>covered person</term> has the meaning given such term by section 9901(b).</text>
							</subsection><subsection id="H6A0273CABD624327980C4CAE7207B7CC"><enum>(c)</enum><header>Federal emission permit</header><text display-inline="yes-display-inline">The term <term>Federal emission permit</term> means a permit required under section 9901.</text>
							</subsection><subsection id="H6E4DCE8E461A4F08A6C4F930D0D9092D"><enum>(d)</enum><header>Coordination</header><text>The tax imposed under this section is in addition to the fee imposed under subtitle L.</text></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection display-inline="no-display-inline" id="HE687A00D34054607B017175DD4AE69FC"><enum>(d)</enum><header>Establishment of Energy and Economic Security Trust Fund</header>
				<paragraph id="H39C52285C68246E8A7484160577E04D4"><enum>(1)</enum><header>Finding</header><text display-inline="yes-display-inline">The Congress finds that revenue generated from the sale of Federal emission permits must be
			 recycled into the American economy—</text>
					<subparagraph id="HFB9BAA171E614A5096EECAB8E2CF0B21"><enum>(A)</enum><text>to facilitate economic growth and clean energy production, and</text>
					</subparagraph><subparagraph id="HEEC1F51CEC6E4F71A8340BEAFDE0356A"><enum>(B)</enum><text>to protect the economic security of American families and communities.</text>
					</subparagraph></paragraph><paragraph id="H1A811FB10EA6478E897018D612BF6B79"><enum>(2)</enum><header>Establishment of trust fund</header><text>Subchapter A of chapter 98 of such Code (relating to trust fund code) is amended by adding at the
			 end the following:</text>
					<quoted-block id="H65A20774674F4CD481003F5522E2E462" style="OLC">
						<section id="HACB0DB3428704121A3FBABCB7D3F0496"><enum>9512.</enum><header>Energy and Economic Security Trust Fund</header>
							<subsection id="H66048676856746AC9CAE55ADE7DAB065"><enum>(a)</enum><header>Creation of Trust Fund</header><text>There is established in the Treasury of the United States a trust fund to be known as the <quote>Energy and Economic Security Trust Fund</quote> (referred to in this section as the <quote>Trust Fund</quote>), consisting of such amounts as may be appropriated or credited to the Trust Fund as provided in
			 this section or section 9602(b).</text>
							</subsection><subsection id="H5E4C342F40EC4296BC59D3B8C83F7536"><enum>(b)</enum><header>Transfers to Trust Fund</header><text>There is hereby appropriated to the Trust Fund an amount equivalent to the amounts received in the
			 Treasury pursuant to subtitle L.</text>
							</subsection><subsection commented="no" id="H65EA36B2532D409FA6A4FC6835251062"><enum>(c)</enum><header>Expenditures from Trust Fund</header>
								<paragraph commented="no" id="HA2AFA9ED30B94F40963D0EAECCB60177"><enum>(1)</enum><header>In general</header><text>The Secretary shall pay monthly from the Trust Fund the dividend amount to each taxpayer.</text>
								</paragraph><paragraph commented="no" id="H1ACBEA6A6FB94AE7A60D8ABD7A584963"><enum>(2)</enum><header>Dividend amount</header><text display-inline="yes-display-inline">For purposes of paragraph (1), the term <term>dividend amount</term> means the sum of—</text>
									<subparagraph commented="no" id="H7AFE19AD922C40E6B52AF7AE5DB152E9"><enum>(A)</enum>
										<clause commented="no" display-inline="yes-display-inline" id="HBD6526CAE8BA49B5831F1998E5F4E99C"><enum>(i)</enum><text>in the case of the taxpayer filing a joint return, the individual share for the husband and the
			 individual share for the wife, and</text>
										</clause><clause id="H1B1D0588681E49EDAF85BB39CDCAF410" indent="up1"><enum>(ii)</enum><text>in the case of a taxpayer other than a taxpayer described in subparagraph (A), the individual
			 share, and</text>
										</clause></subparagraph><subparagraph commented="no" id="HD40385A788B441368E245D916F99B13F"><enum>(B)</enum><text>in the case of an individual who is a dependent (as defined in section 152) of the taxpayer, <fraction>½</fraction> of the individual share.</text></subparagraph><continuation-text commented="no" continuation-text-level="paragraph">For purposes of subparagraph (B), not more than 2 dependents may be taken into account for each
			 taxpayer.</continuation-text></paragraph><paragraph commented="no" id="H5A0777C4A8254E789FD7FB819E489BA9"><enum>(3)</enum><header>Individual share</header><text display-inline="yes-display-inline">For purposes of this subsection, the term <term>individual share</term> means the amount determined by the Secretary by dividing the total amount deposited in the Trust
			 Fund for the month by the total number of individual shares payable at the
			 end of such month.</text>
								</paragraph><paragraph commented="no" id="HF5C5CA5A145B4965AC9D178382BD3F2B"><enum>(4)</enum><header>Limitation</header><text display-inline="yes-display-inline">For purposes of this subsection—</text>
									<subparagraph commented="no" id="H2029334FD36346669E05373796442DC8"><enum>(A)</enum><header>In general</header><text>No amount is payable under this subsection with respect to an individual unless the individual is a
			 qualified individual.</text>
									</subparagraph><subparagraph commented="no" id="HABFC414630924404A035A182248EADAC"><enum>(B)</enum><header>Qualified individual</header><text>The term <term>qualified individual</term> means an individual who is a lawful resident of the United States on the date of such payment. For
			 purposes of ensuring that payments are made under this subsection to all
			 qualified individuals, the Secretary shall consult with such other Federal
			 and State officials as the Secretary determines necessary or appropriate.</text>
									</subparagraph><subparagraph id="HBD4DDB2CC67F4AC8A8D3ADC50C3B77B0"><enum>(C)</enum><header>United States</header><text display-inline="yes-display-inline">For purposes of subparagraph (B), the United States includes the District of Columbia, the
			 Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa, and
			 the Commonwealth of the Northern Mariana Islands.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H2718E048186A4E7884516DEABF3AE8CE"><enum>(e)</enum><header>Conforming and clerical amendments</header>
				<paragraph id="H238411E9887246E58B3C36740A65F852"><enum>(1)</enum><text display-inline="yes-display-inline">The table of subchapters for chapter 38 of such Code is amended by adding at the end the following
