			 self-sufficiency, to provide information on total spending on means-tested
			 welfare programs, to provide an overall spending limit on means-tested

			<section commented="no" display-inline="no-display-inline" id="H2F5C529117724ABEB102F95E3C7FD3D4" section-type="subsequent-section"><enum>101.</enum><header>Work requirements</header>
				<subsection id="HB336015898C049F28E0DB9FBE410DC9B"><enum>(a)</enum><header>Declaration of policy</header><text>Section 2 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011</external-xref>) is amended by adding at the end the
			 following: <quote>Congress further finds that it should also be the purpose of the supplemental nutrition assistance
			 program to increase employment, to encourage healthy marriage, and to
			 promote prosperous self-sufficiency, which means the ability of households
			 to maintain an income above the poverty level without services and
			 benefits from the Federal Government.</quote>.</text>
				</subsection><subsection id="HE0835FBA9EDD44C88149BD6CF7177D41"><enum>(b)</enum><header>Definition of food</header><text display-inline="yes-display-inline">Section 3(k) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012(k)</external-xref>) is amended by inserting
			 before the period at the end the following: <quote>, except that a food, food product, meal, or other item described in this subsection shall be
			 considered a food under this Act only if it is a bare essential (as
			 determined by the Secretary)</quote>.</text>
				</subsection><subsection id="H7502CA524C364D7AACAA3F5B4F31CD28"><enum>(c)</enum><header>Other definitions</header><text>Section 3 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012</external-xref>) is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="H124907DC8FEC4D3BA623733C6321AD4F" style="OLC">
						<subsection id="H2AB48C12D3D14B16AAADAF2F156E60E5"><enum>(w)</enum><header>Able-Bodied, work-Capable adult</header>
							<paragraph id="H6459E63A98174C6484814C783DAC9C89"><enum>(1)</enum><header>In general</header><text>The term <term>able-bodied, work-capable adult</term> means an individual who—</text>
								<subparagraph id="H9ACB02B9A19948F29558E7779E5A738C"><enum>(A)</enum><text>is more than 18, and less than 63, years of age;</text>
								</subparagraph><subparagraph id="HFBE462FE1E054411A5AE0542C1BF7704"><enum>(B)</enum><text>is not physically or mentally incapable of work; and</text>
								</subparagraph><subparagraph id="H349FAF0E79B54826885572E6BBFE95BC"><enum>(C)</enum><text>is not the full-time caretaker of a disabled adult dependent.</text>
								</subparagraph></paragraph><paragraph id="HB3C96B1D24DF4984B0638CCB58513BF1"><enum>(2)</enum><header>Physically or mentally incapable of work</header><text>For purposes of paragraph (1)(B), the term <term>physically or mentally incapable of work</term> means an individual who—</text>
								<subparagraph id="HD6FF441650CC4FC49EBD44F048DE1EE2"><enum>(A)</enum><text>currently receives benefits under the supplemental security income program established under title
			 XVI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1381">42 U.S.C. 1381 et seq.</external-xref>) or another program
			 that provides recurring benefits to individuals because the individual is
			 disabled and unable to work; or</text>
								</subparagraph><subparagraph id="H99C0C193A29B467DA68FA986D9360E06"><enum>(B)</enum><text>has been medically certified as physically or mentally incapable of work and who has a credible
			 pending application for enrollment in the supplemental security income
			 program established under title XVI of the Social Security Act (42 U.S.C.
			 1381 et seq.) or another program that provides recurring benefits to
			 individuals because the individual is disabled and unable to work.</text>
								</subparagraph></paragraph></subsection><subsection id="HB6BEB8C1D4E7447E87F31C76D87C8EB0"><enum>(x)</enum><header>Approved offsite work activation</header><text>The term <term>approved offsite work activation</term> means—</text>
							<paragraph id="HB21E59B9602F4FF7BB2D6491F9CD9D61"><enum>(1)</enum><text>online job preparation and training programs that are approved and monitored by the State agency;
			 or</text>
							</paragraph><paragraph id="HDC15FACDD6E24FC8808DFDFCD3534C7A"><enum>(2)</enum><text>job search activities that are approved by the State agency and monitored by the State to ensure
			 that an appropriate number of job applications and employer contacts are
			 performed.</text>
							</paragraph></subsection><subsection id="H1CA4201ED65C4937A652735513BFF2B1"><enum>(y)</enum><header>Family head</header><text>The term <term>family head</term> means—</text>
							<paragraph id="H7A8C8BDE4A5145FEAFCCE4F337964F81"><enum>(1)</enum><text>a biological parent who is lawfully present in the United States and resides within a household
			 with 1 or more dependent children who are the biological offspring of the
			 parent; or</text>
							</paragraph><paragraph id="H94CC7F6F9AA049659A8B3622239448AF"><enum>(2)</enum><text>in the absence of a biological parent, a step parent, adoptive parent, guardian, or adult relative
			 who resides with and provides care to the 1 or more children and is
			 lawfully present in the United States.</text>
							</paragraph></subsection><subsection id="HF2A9A4EDE9584DCBB4A221A06F9555E1"><enum>(z)</enum><header>Family unit</header><text>The term <term>family unit</term> means—</text>
							<paragraph id="H2A30C0BA4E154F1AAABE0F87236F5A66"><enum>(1)</enum><text>an adult residing without dependent children;</text>
							</paragraph><paragraph id="H03BB80AD955243958543E51B44BD17C4"><enum>(2)</enum><text>a single-headed family with dependent children; or</text>
							</paragraph><paragraph id="H0CF995B069E3443EA5802F91B5CB2971"><enum>(3)</enum><text>a married couple family with dependent children.</text>
							</paragraph></subsection><subsection id="H4C234E7D83C14959A71893542DA92F57"><enum>(aa)</enum><header>Family with dependent children</header>
							<paragraph id="H2785748016134DBDA0FA7D9F2FD55009"><enum>(1)</enum><header>In general</header><text>The term <term>family with dependent children</term> means a unit consisting of a family head, 1 or more dependent children, and, if applicable, the
			 married spouse of the family head, all of whom share meals and reside
			 within a single household.</text>
							</paragraph><paragraph id="HB787B84BD97948FB894CF3E0762D3897"><enum>(2)</enum><header>Multiple families in a household</header><text>There may be more than 1 family with dependent children in a single household.</text>
							</paragraph></subsection><subsection id="HA3DB6288389749BCA510C4167080BEAC"><enum>(bb)</enum><header>Married couple family with dependent children</header><text>The term <term>married couple family with dependent children</term> means a family with dependent children that has both a family head and the married spouse of the
			 family head residing with the family.</text>
						</subsection><subsection id="H7023F993566644F784FE752E34042E62"><enum>(cc)</enum><header>Married spouse of the family head</header><text>The term <term>married spouse of the family head</term> means the lawfully married spouse of the family head who—</text>
							<paragraph id="HF9F9DEE665F542819FE4578BBF5AE766"><enum>(1)</enum><text>resides with the family head and dependent children; and</text>
							</paragraph><paragraph id="HC9AC56B99C634D48880AD742AC40ED95"><enum>(2)</enum><text>is lawfully present in the United States.</text>
							</paragraph></subsection><subsection id="H9FC4A90189EA4B8A87D0719C53E4EDA8"><enum>(dd)</enum><header>Member of a family</header><text>The term <term>member of a family</term> means the family head, married spouse of the family head if present, and all dependent children
			 within a family with dependent children.</text>
						</subsection><subsection id="H2187CCDA2CFE45179797A25A52EB5AF3"><enum>(ee)</enum><header>Onsite work activation</header>
							<paragraph id="H572EED92F4E547CFAF796AB3B5A7A27D"><enum>(1)</enum><header>In general</header><text>The term <term>onsite work activation</term> means—</text>
								<subparagraph id="HB1AC805A920B4C3AA10796F08666AE65"><enum>(A)</enum><text>supervised job search;</text>
								</subparagraph><subparagraph id="H7EDD46BF2E754BE99F976A9298331702"><enum>(B)</enum><text>community service activities;</text>
								</subparagraph><subparagraph id="H81A1493C6D02460383C11712E00246B2"><enum>(C)</enum><text>education and job training for individuals who are family heads or married spouses of family heads;</text>
								</subparagraph><subparagraph id="HCE3B761E17A640F1843E0650BB16FA5B"><enum>(D)</enum><text>workfare under section 20; or</text>
								</subparagraph><subparagraph id="H42FF8098E3F04686AE8D3ECFD9717DF6"><enum>(E)</enum><text>drug or alcohol treatment.</text>
								</subparagraph></paragraph><paragraph id="HA8E33A713D804F6281FE6062CFF89D83"><enum>(2)</enum><header>Supervised job search</header><text>For purposes of paragraph (1)(A), the term <term>supervised job search</term> means a job search program that has the following characteristics:</text>
								<subparagraph id="HC3B19EFC201C4066A24303A33EFF014E"><enum>(A)</enum><text>The job search occurs at an official location where the presence and activity of the recipient can
			 be directly observed, supervised, and monitored.</text>
								</subparagraph><subparagraph id="H9AEFAA1EE7C447DA9886005EDDF25C43"><enum>(B)</enum><text>The recipient's entry, time onsite, and exit from the official job search location are recorded in
			 a manner that prevents fraud.</text>
								</subparagraph><subparagraph id="HC4FF8E74F8D9439D8C0DE159A64AF641"><enum>(C)</enum><text>The recipient is expected to remain and undertake job search activities at the job search center.</text>
								</subparagraph><subparagraph id="H44AB731F0CB448BB9918EA2AFB08DE1C"><enum>(D)</enum><text>The quantity of time the recipient is observed and monitored engaging in job search at the official
			 location is recorded for purposes of compliance with section 29.</text>
								</subparagraph></paragraph></subsection><subsection id="H5BED0C3509FB4BD2A47F5131487C9BD5"><enum>(ff)</enum><header>Penalty period</header>
							<paragraph id="HA8B5BC86BDD048A89617FA924E46CB15"><enum>(1)</enum><header>In general</header><text>The term <term>penalty period</term> means either of 2 periods of 6 consecutive months during each fiscal year.</text>
							</paragraph><paragraph id="H1A3EEC13519749319375C325E33F7764"><enum>(2)</enum><header>First penalty period</header><text>The first penalty period of each fiscal year shall be the 6-month period beginning on October 1.</text>
							</paragraph><paragraph id="HA6EDBE2C7AB34A47834C09C4745DBBC5"><enum>(3)</enum><header>Second penalty period</header><text>The second penalty period of each fiscal year shall be the 6-month period beginning on April 1.</text>
							</paragraph><paragraph id="HA47433DC14864B4099039F8E9D5D7FB8"><enum>(4)</enum><header>Adjustment</header><text>The entire supplemental nutrition assistance program 6-month funding allotment of a State during a
			 penalty period shall be adjusted in response to the performance of the
			 work activation program of the State during previous performance
			 measurement periods.</text>
							</paragraph></subsection><subsection id="HC12D9BC89B084DF1A9132F25C8FFB489"><enum>(gg)</enum><header>Performance measurement period</header>
							<paragraph id="HBAC62B44975A45AE9D687A12984D08B3"><enum>(1)</enum><header>In general</header><text>The term <term>performance measurement period</term> means either of 2 periods of 6 consecutive months during each fiscal year.</text>
							</paragraph><paragraph id="H3ED91F7B65904177AFBD37F8F5885755"><enum>(2)</enum><header>First performance measurement period</header><text>The first performance measurement period of each fiscal year shall be the 6-month period beginning
			 on October 1.</text>
							</paragraph><paragraph id="H49D482A14E6D4229A77485542FA334CD"><enum>(3)</enum><header>Second performance measurement period</header><text>The second performance measurement period of each fiscal year shall be the 6-month period beginning
			 on April 1.</text>
							</paragraph></subsection><subsection id="HB49A96063F46490188CC653DAD599B4B"><enum>(hh)</enum><header>Program-Eligible adult without dependent children</header><text>The term <term>program-eligible adult without dependent children</term> means a work-capable adult without dependent children who—</text>
							<paragraph id="H9B6B6114171342F19B78D5FCB5AC1CB1"><enum>(1)</enum><text>receives program benefits for 1 month; and</text>
							</paragraph><paragraph id="HF842DCD4C212416E9C44EA918202CC42"><enum>(2)</enum><text>has maintained less than 120 hours of paid employment during that month.</text>
							</paragraph></subsection><subsection id="HF101C6D360424806A253EBD9D9F31A9F"><enum>(ii)</enum><header>Program-Eligible family unit</header><text>The term <term>program-eligible family unit</term> means—</text>
							<paragraph id="H95B06F0D64A04CE7AE01EE2D4859A6F5"><enum>(1)</enum><text>a program-eligible adult without dependent children;</text>
							</paragraph><paragraph id="H4B7A5E1C3DDD497D852C0E4A81C83B0B"><enum>(2)</enum><text>a program-eligible single-headed family with dependent children; or</text>
							</paragraph><paragraph id="HE8FD9BF80E124B9DA0CF51D823CC4FA9"><enum>(3)</enum><text>a program-eligible married couple with dependent children.</text>
							</paragraph></subsection><subsection id="HC9388D8C5FD94DC98E8D4E625D4853F3"><enum>(jj)</enum><header>Program-Eligible married couple with dependent children</header><text>The term <term>program-eligible married couple with dependent children</term> means a work-capable married couple family with dependent children that—</text>
							<paragraph id="H5023F20B65504F0096575F7F0CCA6117"><enum>(1)</enum><text>receives program benefits for 1 month; and</text>
							</paragraph><paragraph id="H020CEB716F8D4BE3A8AFBC4B8B0AD09A"><enum>(2)</enum><text>has maintained less than 120 hours of paid employment between the family head and the married
			 spouse of the family head, summed together and counted jointly, during the
			 month.</text>
							</paragraph></subsection><subsection id="HB7D81639E479425896FAF5385491C70B"><enum>(kk)</enum><header>Program-Eligible single-Headed family with dependent children</header><text>The term <term>program-eligible single-headed family with dependent children</term> means a work-capable single-headed family with dependent children that—</text>
							<paragraph id="HE080C7AEC7B64329BF8029FD195551C8"><enum>(1)</enum><text>receives program benefits for 1 month; and</text>
							</paragraph><paragraph id="H934A9A92BECD439CB2EB0D6554AB6293"><enum>(2)</enum><text>has a family head who has maintained less than 120 hours of paid employment during that month.</text>
							</paragraph></subsection><subsection id="HC5F55524F8894FB68316FE56459865C8"><enum>(ll)</enum><header>Single-Headed family with dependent children</header><text>The term <term>single-headed family with dependent children</term> means a family with dependent children that—</text>
							<paragraph id="H4CA45A8F785649C4AD06B22F9AC066AA"><enum>(1)</enum><text>contains a family head residing with the family; but</text>
							</paragraph><paragraph id="H3F58DD732F7B4C899B173CD7EFF9874E"><enum>(2)</enum><text>does not have a married spouse of the family head residing with the family.</text>
							</paragraph></subsection><subsection id="H1671AE611AD449E784AD1907BC24F57B"><enum>(mm)</enum><header>State share of work-Capable family units in calendar year 2010</header><text>The term <term>State share of work-capable family units in calendar year 2010</term> for each State means the quotient obtained by dividing—</text>
							<paragraph id="HFB0D0E89B5FA453C8F8FE548090CF0D1"><enum>(1)</enum><text>the average monthly number of work-capable family units in the State during calendar year 2010; by</text>
							</paragraph><paragraph id="H7E1A90DE32A74FC8B5DE728848F96A0E"><enum>(2)</enum><text>the average monthly number of work-capable family units in all 50 States and the District of
			 Columbia during calendar year 2010.</text>
							</paragraph></subsection><subsection id="H18962904010D432B9ADA969528C5E46A"><enum>(nn)</enum><header>Total family units eligible for participation in work activation</header><text>The term <term>total family units eligible for participation in work activation</term> in a month means, in the State in that month, the sum of—</text>
							<paragraph id="HD936BC4FC87A47D1A6B9CB79DD4B222C"><enum>(1)</enum><text>program-eligible adults without dependent children;</text>
							</paragraph><paragraph id="HB81FAED49D98467A9BDCFB5F6E532E6E"><enum>(2)</enum><text>program-eligible single-headed families with dependent children; and</text>
							</paragraph><paragraph id="H58CFE944B681401FBEB8D4EABA2B4B70"><enum>(3)</enum><text>program-eligible married couples with dependent children.</text>
							</paragraph></subsection><subsection id="H727BB87111C640879FF1BC0DCE40A471"><enum>(oo)</enum><header>Work activation</header><text>The term <term>work activation</term> means—</text>
							<paragraph id="H5396BEE675944306BAB0B9D6B2121742"><enum>(1)</enum><text>onsite work activation; and</text>
							</paragraph><paragraph id="HC6B024A1A7D545CBA65006E80A301C1E"><enum>(2)</enum><text>approved offsite work activation.</text>
							</paragraph></subsection><subsection id="H0195934F26794AFFB0DA901141C9BF72"><enum>(pp)</enum><header>Work-Capable adult without dependent children</header><text>The term <term>work-capable adult without dependent children</term> means an individual who—</text>
							<paragraph id="HFF9654A29C804622AF7BBB0D5785998E"><enum>(1)</enum><text>is an able-bodied, work-capable adult; and</text>
							</paragraph><paragraph id="HAE4B945FA9E146488D3ABCE817B11805"><enum>(2)</enum><text>is not a family head or the married spouse of a family head.</text>
							</paragraph></subsection><subsection id="H2FBD9B9E822142B8A462B0FEC0EF1178"><enum>(qq)</enum><header>Work-Capable married couple family with dependent children</header><text>The term <term>work-capable married couple family with dependent children</term> means a married couple with dependent children that contains at least 1 work-capable, able-bodied
			 adult who is—</text>
							<paragraph id="HAB5AB1EC40BC47A88827FE95CBE37182"><enum>(1)</enum><text>the family head; or</text>
							</paragraph><paragraph id="H63C256E6066D4D5C88626D63588EBE25"><enum>(2)</enum><text>the married spouse of the family head.</text>
							</paragraph></subsection><subsection id="H54D482611320471BAC14D578A54C3516"><enum>(rr)</enum><header>Work-Capable single-Headed family with dependent children</header><text>The term <term>work-capable single-headed family with dependent children</term> means a single-headed family with dependent children that has a family head who is an able-bodied,
			 work-capable adult.</text>
						</subsection><subsection id="H0E9584B75A27497DABBCFA904E39A667"><enum>(ss)</enum><header>Program-Eligible family unit with dependent children</header><text>The term <quote>program eligible family unit with dependent children</quote> means the group that includes all—</text>
							<paragraph id="H7A6219A9FDC540FC92E3E7E2815BEC65"><enum>(1)</enum><text>program eligible married couples with dependent children; and</text>
							</paragraph><paragraph id="H2AF8F18A571E44399356E980011DA81B"><enum>(2)</enum><text>program-eligible single-headed families with dependent children.</text>
							</paragraph></subsection><subsection id="H44C9BF82824F49A9B65B9BE6C649735A"><enum>(tt)</enum><header>Ratio of caseload decline among work-Eligible adults without dependent children</header>
							<paragraph id="H30AD4EC2A19B498C88443ADF5F9D53C5"><enum>(1)</enum><header>Definition</header><text display-inline="yes-display-inline">The term <quote>ratio of caseload decline among work eligible adults without dependent children</quote> means, in a given fiscal year, the figure that equals the ratio of the number individuals
			 specified in subparagraph (A) divided by the number of individuals
			 specified in subparagraph (B).</text>
								<subparagraph id="H12C32D8D6FCA49609AF2D137152A0DD9"><enum>(A)</enum><text>The remainder of—</text>
									<clause id="HB565BD4E364046B2842DAD859F4993BE"><enum>(i)</enum><text>the average monthly number of work eligible adults without dependent children who received benefits
			 in the State in fiscal year 2014; minus</text>
									</clause><clause id="H7303E50002A14A7AA1D5490DAD99BDCE"><enum>(ii)</enum><text>the average monthly number of work eligible adults without dependent children who received benefits
			 in the State in the given fiscal year.</text>
									</clause></subparagraph><subparagraph id="HC6D50F85DC58419BB0B65414EFD2D4E1"><enum>(B)</enum><text>The average monthly number of work eligible adults without dependent children who received benefits
			 in the State in fiscal year 2014.</text>
								</subparagraph></paragraph><paragraph commented="no" id="H07B9FF8DA1B6443E9A94D8FA45C67F71"><enum>(2)</enum><header>Limitation</header><text>If the average monthly number of work eligible adults without dependent children who received
			 benefits in the State in the given fiscal year is greater than the average
			 monthly number of work eligible adults without dependent children who
			 received benefits in the State in fiscal year 2014, then the ratio of
			 caseload decline among work eligible adults without dependent children for
			 the given fiscal year shall be zero.</text>
							</paragraph></subsection><subsection id="H367AE87769404F4BB0EBDF6F042CBF38"><enum>(uu)</enum><header>Contingency factor</header><text>The term <quote>contingency factor</quote> for a State in a given fiscal year means the percentage of the program eligible family units with
			 dependent children in the State in that year that equals—</text>
							<paragraph id="HF7C1F7ECD0DA46F491E306EAE209FFE8"><enum>(1)</enum><text>the ratio of caseload decline among work eligible adults without dependent children in the State in
			 the previous fiscal year; multiplied by</text>
							</paragraph><paragraph id="H5C2062C72FFD470D96AAC98BDADA5EE8"><enum>(2)</enum><text>fifty.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H1AAE2B88482E4EAC85C3DD83DA77B9C3"><enum>(d)</enum><header>Conditions of participation</header><text>Section 6 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2015">7 U.S.C. 2015</external-xref>) is amended by striking subsection
			 (d) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="HF549A80ADEDD45429A5B786A6DBDDA2D" style="OLC">
						<subsection id="HD98C98C9E9E74A40BC5C4A84485949F3"><enum>(d)</enum><header>Conditions of participation</header>
							<paragraph id="HF3E70567510E42B983CEE5C29E1887E7"><enum>(1)</enum><header>Work requirements</header>
								<subparagraph id="H8F131D69AD9946C5855F3B4DA89AD144"><enum>(A)</enum><header>In general</header><text>No able-bodied, work-capable adult shall be eligible to participate in the supplemental nutrition
			 assistance program if the individual—</text>
									<clause id="H0E301096823C45C3A81BDFB09F11F636"><enum>(i)</enum><text>refuses, at the time of application and every 12 months thereafter, to register for employment in a
			 manner prescribed by the Secretary;</text>
									</clause><clause id="H94E1C286403B40E9BC00A04C7C2126F4"><enum>(ii)</enum><text>refuses without good cause to accept an offer of employment, at a site or plant not subject to a
			 strike or lockout at the time of the refusal, at a wage not less than the
			 higher of—</text>
										<subclause id="HB76B92A2D05E442DB09FD6150CAF155A"><enum>(I)</enum><text>the applicable Federal or State minimum wage; or</text>
										</subclause><subclause id="H5036B1D5B5974AE388D12315A30CBC54"><enum>(II)</enum><text>80 percent of the wage that would have applied had the minimum hourly rate under section 6(a)(1) of
			 the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206(a)(1)</external-xref>) been applicable
			 to the offer of employment;</text>
										</subclause></clause><clause id="H529F5FE20C2F400FA57D7D01FCD0203F"><enum>(iii)</enum><text>refuses without good cause to provide a State agency with sufficient information to allow the State
			 agency to determine the employment status or the job availability of the
			 individual; or</text>
									</clause><clause id="H00193E9ED04F43108270477FA4B44142"><enum>(iv)</enum><text>voluntarily—</text>
										<subclause id="H3273A6E476F5414B8B7FCDD2621FC7E4"><enum>(I)</enum><text>quits a job; or</text>
										</subclause><subclause id="HDEF98D0E066D4F52A710A99A877753C4"><enum>(II)</enum><text>reduces work effort and, after the reduction, is working less than 30 hours per week, unless
			 another adult in the same family unit increases employment at the same
			 time by an amount that is at least equal to the reduction in work effort
			 by the first adult.</text>
										</subclause></clause></subparagraph><subparagraph id="H58F3557AB9B0428C9469552766EF066D"><enum>(B)</enum><header>Family unit ineligibility</header><text>If an able-bodied, work-capable adult is ineligible to participate in the supplemental nutrition
			 assistance program because of subparagraph (A), no other member of the
			 family unit to which that adult belongs shall be eligible to participate.</text>
								</subparagraph><subparagraph id="H2B717C8AFA6A449E9532B18DCE74C735"><enum>(C)</enum><header>Duration of ineligibility</header><text>An able-bodied, work-capable adult who becomes ineligible under subparagraph (A), and members of
			 the family unit who become ineligible under subparagraph (B), shall remain
			 ineligible for 3 months after the date on which ineligibility began.</text>
								</subparagraph><subparagraph id="H3F440E7AFFD441339CCB3F42788B8492"><enum>(D)</enum><header>Restoration of eligibility</header><text>At the end of the 3-month period of ineligibility under subparagraph (c), members of a work-capable
			 family unit may have their eligibility to participate in the supplemental
			 nutrition assistance program restored, if—</text>
									<clause id="H05345DBEE793401A83829404FABAC7ED"><enum>(i)</enum><text>the family unit is no longer a work-capable family unit; or</text>
									</clause><clause id="H1EC15EE437574871A7F5828B80011EC1"><enum>(ii)</enum><text>the adult members of the family unit begin and maintain any combination of paid employment and work
			 activation sufficient to meet the appropriate standards for resumption of
			 benefits in section 29(c)(2).</text>
									</clause></subparagraph></paragraph><paragraph id="H0D40AF19DCD84AAE99901E4973ED10EA"><enum>(2)</enum><header>Strike against a government</header><text>For the purpose of subparagraph (A)(iv), an employee of the Federal Government, a State, or a
			 political subdivision of a State, who is dismissed for participating in a
			 strike against the Federal Government, the State, or the political
			 subdivision of the State shall be considered to have voluntarily quit
			 without good cause.</text>
							</paragraph><paragraph id="HDF8D3E7AF1A840719378BB57767FE0C6"><enum>(3)</enum><header>Striking workers ineligible</header>
								<subparagraph id="H1A9FEE04A8FF413BA7AC3CA5A66F5E8F"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraphs (B) and (C) and notwithstanding any other provision of law, no
			 member of a family shall be eligible to participate in the supplemental
			 nutrition assistance program at any time that any able-bodied,
			 work-capable adult member of the household is on strike as defined in
			 section 501 of the Labor Management Relations Act, 1947 (<external-xref legal-doc="usc" parsable-cite="usc/29/142">29 U.S.C. 142</external-xref>),
			 because of a labor dispute (other than a lockout) as defined in section 2
			 of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/152">29 U.S.C. 152</external-xref>).</text>
								</subparagraph><subparagraph id="H67DCE8A2804649B290DB917E3CB36E1C"><enum>(B)</enum><header>Prior eligibility</header>
									<clause id="H1908D69EECA148D69FE26C6E2A605AC1"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), a family unit shall not lose eligibility to participate in the supplemental
			 nutrition assistance program as a result of 1 of the members of the family
			 unit going on strike if the household was eligible immediately prior to
			 the strike.</text>
									</clause><clause id="H290AB39315174B07AC8890B90301D760"><enum>(ii)</enum><header>No increased allotment</header><text>A family unit described in clause (i) shall not receive an increased allotment as the result of a
			 decrease in the income of the 1 or more striking members of the household.</text>
									</clause></subparagraph><subparagraph id="HB9C273BCD1F44ECD8457583FC08BDC5D"><enum>(C)</enum><header>Refusal to accept employment</header><text>Ineligibility described in subparagraph (A) shall not apply to any family unit that does not
			 contain a member on strike, if any of the members of the family unit
			 refuses to accept employment at a plant or site because of a strike or
			 lockout.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HCA38A8A094004B93B18FFC33E1EA190A"><enum>(e)</enum><header>Eligibility of students with dependent children</header><text>Section 6(e) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2015">7 U.S.C. 2015(e)</external-xref>) is amended by striking
			 paragraph (8) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H1E87F30CAB834DDF89B7A07294825034" style="OLC">
						<paragraph id="H8A6A427AAE634112BD8B7C7C615478A7"><enum>(8)</enum><text>is enrolled full-time in an institution of higher education, as determined by the institution, and—</text>
							<subparagraph id="H2D82B0EE1167467AA69E9BC3E4512BF5"><enum>(A)</enum><text>is a single parent with responsibility for the care of a dependent child under 12 years of age; or</text>
							</subparagraph><subparagraph id="HF2B0C072078241C281244518B505B749"><enum>(B)</enum><text>is a family head or married spouse of a family head in a married couple family with dependent
			 children and has a dependent child under age 12 residing in the home.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H99246241B4D14B57A17F240EC7884575"><enum>(f)</enum><header>Work requirement</header><text>Section 6 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2015">7 U.S.C. 2015</external-xref>) is amended by striking subsection
			 (o) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="HB1EF973A8BC64812B88859309587086F" style="OLC">
						<subsection id="H1AB103ECCA96429484B7E6035BA41752"><enum>(o)</enum><header>Fulfillment of employment and work activation requirements</header>
							<paragraph id="H154EF3F1EB2C4B7D9C200FE987091BC3"><enum>(1)</enum><header>In general</header><text>If 1 or more adults within a program-eligible family unit are required by the State agency to
			 participate in work activation under section 29, no member of the family
			 unit shall be eligible for supplemental nutrition assistance benefits
			 unless the relevant 1 or more adults fully comply with the work activation
			 standards.</text>
							</paragraph><paragraph id="HFC2141C0C50A4BA3BD3E7D4C09EC51F4"><enum>(2)</enum><header>Sanctions and resumption of benefits</header><text>If 1 or more adults within a program-eligible family unit who are required by the State agency to
			 participate in work activation under section 29 during a given month fail
			 to comply with the work activation standards, benefits for all members of
			 the family unit—</text>
								<subparagraph id="H1B5C6BE324AA4F0685AD1C7432ABAD24"><enum>(A)</enum><text>shall be terminated in accordance with section 29(c)(1); and</text>
								</subparagraph><subparagraph id="H2FE16E27C51844DDA21F8081E24D28A3"><enum>(B)</enum><text>may be resumed upon compliance with section 29(c)(2).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HC122EAF9873345A48D2DBA79AD62E004"><enum>(g)</enum><header>Exclusion</header><text>Section 6 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2015">7 U.S.C. 2015</external-xref>) is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="HC18609B8571D46408B1B40ED032AD707" style="OLC">
						<subsection id="HBB6D41BCF4DC432EAC210365FB483C6D"><enum>(r)</enum><header>Minor children</header><text>No child less than age 18 years of age may participate in the supplemental nutrition assistance
			 program unless the child is a member of a family with dependent children
			 and resides with an adult who is—</text>
							<paragraph id="H05F16F97103A40FB89D59E87AE1DED62"><enum>(1)</enum><text>the family head of the same family of which the child is also a member;</text>
							</paragraph><paragraph id="H82EB56FD019344D5A9C514D2D8BCD054"><enum>(2)</enum><text>eligible to participate, and participating, in the supplemental nutrition assistance program as a
			 member of the same household as the child; and</text>
							</paragraph><paragraph id="HC19C26A08D1741FCBA13440F1D619F4E"><enum>(3)</enum><text>lawfully residing, and eligible to work, in the United States.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H57203D4AFFFE4777A59E6D3DA9ECEF0F"><enum>(h)</enum><header>Hearing and determination</header><text>Section 11(e)(10) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2020">7 U.S.C. 2020(e)(10)</external-xref>) is amended by
			 striking <quote>: <italic>Provided</italic></quote> and all that follows through <quote>hearing;</quote> at the end and inserting a semicolon.</text>
				</subsection><subsection id="HBC48224D83324346A2D04EBFB39F5292"><enum>(i)</enum><header>Work requirements and activation program</header><text>The Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>) is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="H62E9DC1F988A42248C5E643D2AD6DF04" style="OLC">
						<section id="H575C018B16634AC4AAAF5A0D2E7F49BE"><enum>29.</enum><header>Work requirements and activation program</header>
							<subsection id="HB64CA2C9EEB34DA4ADC0A2165E44583C"><enum>(a)</enum><header>Work activation standards</header>
								<paragraph id="H012BE4AF05714DBFAAC830B6E9B57B39"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (3), a family unit with adult members that is required to participate in work
			 activation under subsection (e) during a full month of participation in
			 the supplemental nutrition assistance program shall fulfill the following
			 levels of work activation during that month:</text>
									<subparagraph id="H916D24059472431DB90B1A1F36974902"><enum>(A)</enum><header>Work activation performance level for program-eligible adult without dependent children</header><text>Each program-eligible adult without dependent children who is required to participate in work
			 activation by a State agency under subsection (e) for a particular month
			 shall be required to perform a minimum of 36 hours of work activation for
			 that month, including at least—</text>
										<clause id="HB221E6A0DDC24F9EB6E4B91A15E0D02C"><enum>(i)</enum><text>a minimum of 16 hours of supervised onsite work activation; and</text>
										</clause><clause id="H97B572D4AD654157B11533B4BDCCE3E8"><enum>(ii)</enum><text>a minimum of 20 additional hours of—</text>
											<subclause id="HCC741B60FA0F45ABAB9AC25F46F8B548"><enum>(I)</enum><text>onsite work activation;</text>
											</subclause><subclause id="HAE32C50D301D464BBD425EFC9AB7691B"><enum>(II)</enum><text>approved offsite work activation; or</text>
											</subclause><subclause id="H2871B83F421F4A82AFF543DA3AB2D5C0"><enum>(III)</enum><text>a combination of both.</text>
											</subclause></clause></subparagraph><subparagraph id="HA75F4EA789FE4446BB66BB2AD2775191"><enum>(B)</enum><header>Work activation performance levels for program-eligible single parent families with dependent
			 children</header><text>Work-capable adult family heads in program-eligible single parent families with dependent children
			 who are required by a State agency to participate in work activation under
			 subsection (e) shall be required to perform a minimum of 72 hours of work
			 activation per month, including at least—</text>
										<clause id="HAA4F84A6C67744198442E86467973C94"><enum>(i)</enum><text>a minimum of 32 hours of supervised onsite work activation; and</text>
										</clause><clause id="HC1280507DDF44452915434CA0B54AEAB"><enum>(ii)</enum><text>a minimum of 40 additional hours of—</text>
											<subclause id="H96ABA77EE5E941119C3946AF53D54DD4"><enum>(I)</enum><text>onsite work activation;</text>
											</subclause><subclause id="HBB923A0E980B4F1E87B7C48D11BAACCC"><enum>(II)</enum><text>approved offsite work activation; or</text>
											</subclause><subclause id="HCE1943E41BA942539D0529927CB1576E"><enum>(III)</enum><text>a combination of both.</text>
											</subclause></clause></subparagraph><subparagraph id="HA9843238A09E4B06BCC061FC6CB27E81"><enum>(C)</enum><header>Work activation performance levels for program-eligible married couples with dependent children</header>
										<clause id="HE6B60C3D8D6F4EE0AAB07816BEC0B8E6"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), each program-eligible married couple with dependent children that is
			 required by a State agency to participate in work activation under
			 subsection (e) shall be required to perform a minimum of 72 hours of work
			 activation per month, including at least—</text>
											<subclause id="H36587135226E494EA0E36EDAE744A416"><enum>(I)</enum><text>a minimum of 32 hours of supervised onsite work activation; and</text>
											</subclause><subclause id="HE40DE1617C794846843259A13DBB10F1"><enum>(II)</enum><text>a minimum of 40 additional hours of—</text>
												<item id="H64E868BEC8D44641971C6B6585390CEC"><enum>(aa)</enum><text>onsite work activation;</text>
												</item><item id="H5AA4629EFCB9445B8D3A9E68B33C5D74"><enum>(bb)</enum><text>approved offsite work activation; or</text>
												</item><item id="HEE797FB21E7647C3816A7AABAB125575"><enum>(cc)</enum><text>a combination of both.</text>
												</item></subclause></clause><clause id="H34BABB284BDD48C98D133F0DBA3C9E3D"><enum>(ii)</enum><header>Requirements</header>
											<subclause id="H9021532405CE4E558112182ACB0D0C87"><enum>(I)</enum><header>Single joint obligation</header><text>The 72-hour requirement under clause (i) shall be a single joint obligation for the married couple
			 as a whole in which the activities of both married partners shall be
			 combined together and counted jointly.</text>
											</subclause><subclause id="H654341001017460FBE287529DCC94730"><enum>(II)</enum><header>Options</header><text>The work activation requirement for a work-capable married couple family with dependent children
			 may be fulfilled by—</text>
												<item id="H22BBC27DEB784F39B427FDAA5E78A3F0"><enum>(aa)</enum><text>72 or more hours of appropriate activity by the family head;</text>
												</item><item id="H1FCA1261502D4FAAAD8A1B96910E0A64"><enum>(bb)</enum><text>72 or more hours of appropriate activity by the married spouse of the family head; or</text>
												</item><item id="HA30992D817014C659CEBB6D56E24153B"><enum>(cc)</enum><text>the combined activity of the family head and married spouse of the family head which when added
			 together equal or exceed 72 hours.</text>
												</item></subclause></clause></subparagraph><subparagraph id="H58EBE9D65BBB4B249B7C9E7FF0286F5E"><enum>(D)</enum><header>No separate work activation requirement</header><text>Neither the family head nor the married spouse of the family in a married couple family with
			 dependent children shall be subject to a separate work activation
			 requirement as individuals.</text>
									</subparagraph></paragraph><paragraph id="H4E4EA8D2CD7C4161A87862954C51432C"><enum>(2)</enum><header>State option to require greater amounts of work activation</header><text>At its discretion, a State may require work-capable family units to engage in hours of work
			 activation per month that are greater than the levels specified in
			 paragraph (1), except that the number of hours of work activation required
			 of work-capable married couples with dependent children shall not be
			 greater than the number maximum hours of work activation required of
			 work-capable single parent families with dependent children.</text>
								</paragraph><paragraph id="HC70592126E7E4E1DA0FA6F7FB19C0E02"><enum>(3)</enum><header>Limitation on combined hours of work activation and paid employment</header>
									<subparagraph id="HF48EEA09C22F46AA897784A86A62D945"><enum>(A)</enum><header>In general</header><text>Notwithstanding subparagraphs (A), (B), and (C) of paragraph (1), a State may count any
			 program-eligible family unit as fulfilling the full engagement requirement
			 of the family unit for a month, for purposes of paragraphs (3) and (4) of
			 subsection (e), if the combined sum of paid employment and work activation
			 by work-capable adults within the family unit in that month equals at
			 least 160 hours.</text>
									</subparagraph><subparagraph id="H4C0E98A4DE5640AA89EF58288AB82C7B"><enum>(B)</enum><header>Result of fulfillment</header><text>If the combined sum of hours of paid employment and work activation by work-capable individuals
			 within a program-eligible family unit is at least 160 hours in a given
			 month—</text>
										<clause id="H2FDA6929DE6846C898E0364147B49DB2"><enum>(i)</enum><text>the family unit has fulfilled the Federal work activation standards of the family unit for that
			 month; and</text>
										</clause><clause id="H7AB3854178794A10AE882315434196FF"><enum>(ii)</enum><text>the State agency need not require members of the family unit to perform additional work activation
			 during that month.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="H87B2D7969A16426981FCB4BD507BBE8A"><enum>(b)</enum><header>Pro rata reduction in employment and work activation standard during a partial month</header>
								<paragraph id="H581C8D4FB6554AF2A2F0708B15E1F0E3"><enum>(1)</enum><header>In general</header><text>A program-eligible family unit shall be subject to a pro-rated work activation standard, if the
			 family unit—</text>
									<subparagraph id="HE4C149C04EB7441AACC2A52D38D5D07B"><enum>(A)</enum><text>receives a pro-rated monthly allotment during the initial month of enrollment under section 8(c);
			 and</text>
									</subparagraph><subparagraph id="HC8FD157A552A43EBB88AA208F140326E"><enum>(B)</enum><text>is required by the State to participate in the work activation program during that month.</text>
									</subparagraph></paragraph><paragraph id="H52E7A275617340DFB8258DE5EC8F560C"><enum>(2)</enum><header>Pro-rated work activation standard</header><text>For purposes of paragraph (1), the term <term>pro-rated work activation standard</term> means a standard that equals a number of hours of work activity of a family unit that bears the
			 same proportion to the work activation requirement for the family unit for
			 a full month under subsection (a) as the proportion that—</text>
									<subparagraph id="H32BE84D4C26A4297AD614E8DB123D623"><enum>(A)</enum><text>the pro-rated monthly allotment received by the household for the partial month under section 8(c);
			 bears to</text>
									</subparagraph><subparagraph id="H952C5A744FE8488EB71A0CA5BD094BC0"><enum>(B)</enum><text>the full allotment the same household would receive for a complete month.</text>
									</subparagraph></paragraph><paragraph id="HF05A5C32A83E4D3EA08192803206C050"><enum>(3)</enum><header>Requirement</header><text>For purposes of fulfilling the pro-rated work activation requirement during an initial month of
			 enrollment in the supplemental nutrition assistance program, only those
			 hours of adult work activation that occurred during the portion of the
			 month in which the family unit was participating in the supplemental
			 nutrition assistance program shall be counted.</text>
								</paragraph></subsection><subsection id="H0912BEB2A00144FF9C4DAEBAEAEA8C3C"><enum>(c)</enum><header>Sanction for noncompliance by family units</header>
								<paragraph id="H76DBDC9BCF24483A931F7FE1A1E152C4"><enum>(1)</enum><header>Standard</header>
									<subparagraph id="H8E6FC810B74748E4ABFFFE03211C7E68"><enum>(A)</enum><header>In general</header><text>If 1 or more members of a program-eligible family unit are required to participate in the work
			 activation program under subsection (e) in a calendar month and 1 or more
			 individuals fail to fulfill the work activation standards under subsection
			 (a) or (b) for that month—</text>
										<clause id="HA45481175D2E4E3CAFA867B07416C8B8"><enum>(i)</enum><text>no member of the family unit shall be eligible to receive supplemental nutrition assistance
			 benefits during the subsequent calendar month; and</text>
										</clause><clause id="HAA5ED221F1914AB4BDDE88A31457B106"><enum>(ii)</enum><text>except as provided in subparagraph (B), the State agency shall not provide the supplemental
			 nutrition assistance benefit payment for all members of the family unit
			 that otherwise would have been issued at the beginning of the next month.</text>
										</clause></subparagraph><subparagraph id="H91EBE582C5B14F02AC8CBAF6FC4732D4"><enum>(B)</enum><header>Administrative delay of sanction</header>
										<clause id="H263349871325419A8415972351985A23"><enum>(i)</enum><header>In general</header><text>Except as provided in clauses (ii) and (iii), if it is administratively infeasible for the State to
			 not provide the supplemental nutrition assistance benefit that would be
			 issued at the beginning of the first month after the month of
			 noncompliance, the State shall not provide the payment to all members of
			 the family unit that otherwise would have been made at the beginning of
			 the second month after the month of noncompliance.</text>
										</clause><clause id="H6F1122DEEC0A46DAA0CB928CB8A5B473"><enum>(ii)</enum><header>Deadline</header><text>The sanction of benefits shall occur not later than 32 days after the end of the month of
			 noncompliance.</text>
										</clause><clause id="H020B45E42F7143B69B48EF6AF0981392"><enum>(iii)</enum><header>Relationship of payments to members of the family unit</header><text>At least 1 monthly payment to all members of the family unit shall be not provided for each month
			 of noncompliance under subparagraph (A).</text>
										</clause></subparagraph></paragraph><paragraph id="H92CE95B4CA0143789A6FF16DA0499BF2"><enum>(2)</enum><header>Resumption of benefits after sanction</header>
									<subparagraph id="HB6D04C35BF8F444FB70755DBCC39C622"><enum>(A)</enum><header>In general</header><text>If a family unit has had the monthly benefit of the family unit not provided due to noncompliance
			 with a work activation requirement under paragraph (1), the family unit
			 shall not be eligible to receive future benefits under the supplemental
			 nutrition assistance program until—</text>
										<clause id="H64736A5B7CEC40358675DE0B0F183366"><enum>(i)</enum><text>the 1 or more work-capable members of the family unit have—</text>
											<subclause id="HE0A63850187B41BD9574DF740409261F"><enum>(I)</enum><text>successfully participated in a work activation program under subsection (e) for at least 4
			 consecutive, subsequent weeks; and</text>
											</subclause><subclause id="H2F470F27024B477DA092A2D5C2B51616"><enum>(II)</enum><text>fulfilled the work activation standard for the family unit for that same 4-week period by
			 maintaining an hourly total of participation in work activation that is at
			 least equal to the appropriate monthly totals for hours of participation
			 provided in subsection (a);</text>
											</subclause></clause><clause id="H43A038D9602241E088388501153CAA20"><enum>(ii)</enum><text>the family unit no longer contains any able-bodied, work-capable adults; or</text>
										</clause><clause id="H2EC67FF41D7741748C7FC1BB044E827C"><enum>(iii)</enum><text>the family unit maintains at least 120 hours of paid employment during the 4-week period.</text>
										</clause></subparagraph><subparagraph id="H5652F8F985EB4B1082CBF9983ACF0AEB"><enum>(B)</enum><header>Limitation</header><text>The resumed benefits provided under subparagraph (A) shall not restore or compensate for the
			 benefits that were not provided due to the sanction imposed under
			 paragraph (1).</text>
									</subparagraph></paragraph></subsection><subsection id="HE2F5AF6A89DB4774BB1C98D76625CAF5"><enum>(d)</enum><header>Work activation is not employment</header><text>Participation in work activation activities under this section shall not be—</text>
								<paragraph id="H12336BD01C1148A38A77EFD13278C234"><enum>(1)</enum><text>considered to be employment; or</text>
								</paragraph><paragraph id="H21F580B82EC741E88BFECFD6668EBF42"><enum>(2)</enum><text>subject to any law pertaining to wages, compensation, hours, or conditions of employment under any
			 law administered by the Secretary of Labor.</text>
								</paragraph></subsection><subsection id="H3A096CE82C394E83AB9402F18B5857D7"><enum>(e)</enum><header>Work activation program</header>
								<paragraph id="H0E9FB6FA666144F89FF1F412A13B451B"><enum>(1)</enum><header>Program</header><text>Each State participating in the supplemental nutrition assistance program shall carry out a work
			 activation program.</text>
								</paragraph><paragraph id="H49A2AC676B6047D4B865CB6362DC9A0F"><enum>(2)</enum><header>Purpose</header>
									<subparagraph id="HEC842EEE7E5A4C689EE38FCA80E1DB6C"><enum>(A)</enum><header>In general</header><text>The goals of each work activation program shall be—</text>
										<clause id="H15C319EDA9F94A149C83675337EEBF51"><enum>(i)</enum><text>to encourage and assist able-bodied, work-capable adult recipients of supplemental nutrition
			 assistance to obtain paid employment;</text>
										</clause><clause id="H7E268753EAC944698296A29444115886"><enum>(ii)</enum><text>to reduce dependence on government assistance; and</text>
										</clause><clause id="H0A9A5A9D61674BBC8BD6DDAA5091BD87"><enum>(iii)</enum><text>to ensure that able-bodied, work-capable adult recipients of supplemental nutrition assistance make
			 a contribution to society and the taxpayers in exchange for assistance
			 received.</text>
										</clause></subparagraph><subparagraph id="HF622CEC733DF4B5EA6D1B0161ACEAD29"><enum>(B)</enum><header>Requirement</header><text>To accomplish the goals described in subparagraph (A), each State shall require able-bodied,
			 work-capable adult recipients of supplemental nutrition assistance who are
			 unemployed or under-employed to engage in work activation.</text>
									</subparagraph></paragraph><paragraph id="H61F4A250053742D38345BB26374E3235"><enum>(3)</enum><header>Required State work activation participation rates</header>
									<subparagraph id="H71289C8196DC425F8C700DBD148B1B12"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (D), each State that receives supplemental nutrition assistance program
			 funding shall be required to meet, for the work activation programs of the
			 State—</text>
										<clause id="H92D01F40B57C47D485BD1D7D845CEB35"><enum>(i)</enum><text>a work activation participation rate for work-capable adults without dependent children, as
			 described in subparagraph (B); and</text>
										</clause><clause id="H69F0DAFB3EC7494EB6236E29BDFCA543"><enum>(ii)</enum><text display-inline="yes-display-inline">a work activation participation rate for program eligible family units as described in subparagraph
			 (C).</text>
										</clause></subparagraph><subparagraph id="H4B3550C664B64892BB9F5DE18FD24F25"><enum>(B)</enum><header>Participation rate for work-capable adults without dependent children</header><text>The average monthly percent of program-eligible work-capable without dependent children who shall
			 be required to maintain full engagement in work activation under
			 subparagraph (A)(i) shall be—</text>
										<clause id="H88B1B707497F4F298775A7778B19E4BE"><enum>(i)</enum><text>for each performance measurement period in fiscal year 2015, 30 percent of all program-eligible
			 adults without dependent children;</text>
										</clause><clause id="HCFCC1AEC9C54462A9087FD36005A85A6"><enum>(ii)</enum><text>for each performance measurement period in fiscal year 2016, 50 percent of all program-eligible
			 adults without dependent children who are eligible for work activation;
			 and</text>
										</clause><clause id="HC9B8FE81A1AC4AFA8701614D4A4149E1"><enum>(iii)</enum><text display-inline="yes-display-inline">for each performance measurement period in fiscal year 2017 and each subsequent fiscal year, 85
			 percent of all program-eligible adults without dependent children who are
			 eligible for work activation.</text>
										</clause></subparagraph><subparagraph id="HB65CB2734D294C8B8A6442825F9BE87B"><enum>(C)</enum><header>Participation rate for program-eligible family units with dependent children</header>
										<clause id="H9CF60135567E4EE99A456AA819FE1834"><enum>(i)</enum><header>Requirements</header><text display-inline="yes-display-inline">Subject to the limitation in clause (ii), the average monthly percent of program-eligible family
			 units with dependent children that shall be required to maintain full
			 engagement in work activation in a given month shall be—</text>
											<subclause id="H95208B5B04A54F6AA616EFEC2CDE05B8"><enum>(I)</enum><text>for each performance measurement period in fiscal year 2017, 15 percent of program-eligible family
			 units with dependent children; and</text>
											</subclause><subclause id="H854B7188C0CD4BFEA77481A978920A85"><enum>(II)</enum><text>for each performance measurement period in fiscal year 2018 and subsequent years, the sum of—</text>
												<item id="H5A9C910392C14D388885EAE1241057DB"><enum>(aa)</enum><text>15 percent of percent of program-eligible family units with dependent children, plus</text>
												</item><item id="H11088C73812A4013ABFA005C527EC8CF"><enum>(bb)</enum><text>the percent of program-eligible family units with dependent children that equals the contingency
			 factor for the State for that year.</text>
												</item></subclause></clause><clause commented="no" id="H7D13786AAD4A401BB4DFA8F9DED61A0D"><enum>(ii)</enum><header>Limitation</header><text>Notwithstanding clause (i), no State shall be required to maintain an average monthly rate of full
			 engagement in work activation by program-eligible family units with
			 dependent children, in either performance measurement period in a fiscal
			 year, that exceeds the following:</text>
											<subclause commented="no" id="H4D2F88C567EA4D24AEAA8F9F1DA33575"><enum>(I)</enum><text>In fiscal year 2017, 15 percent of program-eligible family units with dependent children.</text>
											</subclause><subclause commented="no" id="H4F297CE4A3E64E1D89CC3FAD64257AF1"><enum>(II)</enum><text>In fiscal year 2018, 25 percent of program-eligible family units with dependent children.</text>
											</subclause><subclause commented="no" id="H204DEB0562834B5DB80F879F410DE39C"><enum>(III)</enum><text>In fiscal year 2019, 35 percent of program-eligible family units with dependent children.</text>
											</subclause><subclause commented="no" id="HA1C8E1A11DA34C9AAD7A15D978C4759A"><enum>(IV)</enum><text>In fiscal year 2020, 50 percent of program-eligible family units with dependent children.</text>
											</subclause></clause></subparagraph><subparagraph id="H8716C90F468647BC8783061AE53DBFB7"><enum>(D)</enum><header>Higher levels of work activation at State discretion</header><text>Nothing in this law shall be construed to prohibit a State from maintaining levels of work
			 activation that are higher than those specified subparagraph (B) or (C).</text>
									</subparagraph></paragraph><paragraph id="H763DEB371B9A4DE4805C063C69D01567"><enum>(4)</enum><header>Counting full engagement in work activation for purposes of measuring State compliance with
			 participation rates</header>
									<subparagraph id="HB9E39F86CD734A5EA82C24D6A7067DDA"><enum>(A)</enum><header>In general</header><text>For purposes of determining the compliance of a State with the participation rate standards in
			 paragraph (3), a State shall count in each month the number of
			 program-eligible family units that maintained full engagement in work
			 activation in that month.</text>
									</subparagraph><subparagraph id="H674505F826C34FD3930638D3C55FA532"><enum>(B)</enum><header>Full Engagement</header>
										<clause id="H2E3D7579837A43D79F2A3FF66CE79C7A"><enum>(i)</enum><header>In general</header><text>For purposes of subparagraph (A), a family unit shall be counted as having maintained full
			 engagement in work activation in a given month if the family unit was—</text>
											<subclause id="H591BE8F4B5374DD890DB6C8AEB40F5C8"><enum>(I)</enum><text>a program-eligible family unit that performed sufficient work activation in the month to meet the
			 work activation standards provided in subsection (a) or (b);</text>
											</subclause><subclause id="H77D0095A5DA440CAB0B19F90620ABD1F"><enum>(II)</enum><text>a family unit that did not qualify for supplemental nutrition assistance benefits in a current
			 month because of a prior sanction but that qualified for a resumption of
			 benefits due to work activation performed in the month that meets the
			 standards provided in subsection (c)(2); or</text>
											</subclause><subclause id="HCDAA34FF07D140ED881F6C7391963440"><enum>(III)</enum><text>a program-eligible family unit that—</text>
												<item id="H626EE6DFB4004D2BAFA240D63137F43E"><enum>(aa)</enum><text>received supplemental nutrition assistance benefits in a given month;</text>
												</item><item id="HA556DC13F8A140208C21CD3C25DCD976"><enum>(bb)</enum><text>was required by a State agency to participate in work activation in that month;</text>
												</item><item id="HCBDC97EFE5504A558BBF492A7E4528DF"><enum>(cc)</enum><text>failed to perform sufficient work activation in that month to meet the standards in subsection (a)
			 or (b); and</text>
												</item><item id="HF9E5CFB98C364830BF6F131D12AC2EB8"><enum>(dd)</enum><text>was sanctioned by an elimination of supplemental nutrition assistance benefits in the 1 or more
			 immediately succeeding months, in accordance with subsection (c)(1).</text>
												</item></subclause></clause><clause id="HEE36BABC899943C79FB6AED120965DD8"><enum>(ii)</enum><header>Limitation</header>
											<subclause id="H8BDEC3C1437046D8B1E3320F6977941E"><enum>(I)</enum><header>In general</header><text>For purposes of clause (i)(III), a family unit that was required to participate in work activation
			 but failed to perform sufficient activity to meet the standard shall be
			 counted as having maintained full engagement in work activation only in
			 the first month of noncompliance.</text>
											</subclause><subclause id="H08DB03E1036046B0B812045B8DF3EE9D"><enum>(II)</enum><header>Subsequent months</header><text>Except as provided in clause (i)(II), the family unit shall not be counted as maintaining full
			 engagement in work activation in any subsequent month in which the family
			 unit was subject to the sanction for noncompliance.</text>
											</subclause></clause></subparagraph><subparagraph id="H37B115B1CF4746CB8DFB6D4F56F9613F"><enum>(C)</enum><header>Benefits previously terminated</header><text>Except as provided in subparagraph (B)(i)(II) concerning family units that qualify for resumption
			 of benefits, a family unit that does not receive supplemental nutrition
			 assistance benefits in a given month because the benefits of the family
			 unit have been previously terminated in accordance with subsection (c)(1)
			 shall not be counted in that month—</text>
										<clause id="HCD8C388CD3134F65AB8C4113ADFB5794"><enum>(i)</enum><text>as a family unit that has maintained full engagement in work activation; or</text>
										</clause><clause id="H2F86F679FCB74BF2B87D8801AB5B3847"><enum>(ii)</enum><text>as a program-eligible family unit.</text>
										</clause></subparagraph></paragraph><paragraph id="H0E1BA0EBC89F4B40A8DC13DA51E22790"><enum>(5)</enum><header>Penalties for inadequate State performance</header>
									<subparagraph id="H639F9B1F3B554B2A82F1070A743E4248"><enum>(A)</enum><header>Requirement</header>
										<clause id="H42D60F221D2E4B818663679FDF793AE6"><enum>(i)</enum><header>In general</header><text>Beginning in fiscal year 2015 and for each subsequent fiscal year, each State shall count the
			 monthly average number of program-eligible family units that maintain full
			 engagement in work activation during each performance measurement period.</text>
										</clause><clause id="H6E8541837CA74940ACA1CB0F53C0E802"><enum>(ii)</enum><header>Reduction in funding</header><text>If the monthly average number of program-eligible family units that maintain full engagement in a
			 State is not sufficient to fulfill 1 or both of the relevant performance
			 standards in subparagraphs (B) and (C) of paragraph (3) during a
			 performance measurement period (subject to the limitation in paragraph
			 (3)(D)), the Federal supplemental nutrition assistance program funding for
			 the State shall be reduced for the entire penalty period that commences 12
			 months after the commencement of the relevant performance measurement
			 period.</text>
										</clause></subparagraph><subparagraph id="H1E173CC9A5F34DE7952E9B9BC0ACC4C1"><enum>(B)</enum><header>Schedule of funding reductions</header>
										<clause id="HB61A618FAEA645A888528FD35BC08499"><enum>(i)</enum><header>In general</header><text>The funding reduction for a State under subparagraph (A) shall be determined by the number of
			 consecutive performance measurement periods during which the State has
			 failed to meet 1 or both of the relevant work activation participation
			 rates under subparagraphs (B) and (C) of paragraph (3) (subject to
			 paragraph (3)(D)).</text>
										</clause><clause id="H4A681065CB58450C828E768C4CCBA5F7"><enum>(ii)</enum><header>Failure</header><text>If any State fails to maintain a monthly average number of program-eligible family units that
			 maintain full engagement in work activation during a performance
			 measurement period that fulfills 1 or both of the relevant performance
			 standards under subparagraphs (B) and (C) of paragraph (3) (subject to
			 paragraph (3)(D))—</text>
											<subclause id="H273452AB3A0F4437A1960436BA471E19"><enum>(I)</enum><text>for a single, nonconsecutive performance measurement period, the Federal supplemental nutrition
			 assistance program funding for the State shall be reduced by 20 percent of
			 the normal funding allotment of the State for the penalty period that
			 commences 12 months after the relevant performance measurement period;</text>
											</subclause><subclause id="H40BB7D2853E54921983F9B218CDE8298"><enum>(II)</enum><text>for 2 consecutive performance measurement periods, the Federal supplemental nutrition assistance
			 program funding for the State shall be reduced by 30 percent of the normal
			 funding allotment of the State for the penalty period that commences 12
			 months after the relevant performance measurement period;</text>
											</subclause><subclause id="H6519C39F5272424EA6C169537030CAD1"><enum>(III)</enum><text>for 3 consecutive performance measurement periods, the Federal supplemental nutrition assistance
			 program funding for the State shall be reduced by 40 percent of the normal
			 funding allotment of the State for the penalty period that commences 12
			 months after the relevant performance measurement period;</text>
											</subclause><subclause id="H333EA85EF6004A5CAD11EC658BD291FD"><enum>(IV)</enum><text>for 4 consecutive performance measurement periods, the Federal supplemental nutrition assistance
			 program funding for the State shall be reduced by 50 percent of the normal
			 funding allotment of the State for the penalty period that commences 12
			 months after the relevant performance measurement period;</text>
											</subclause><subclause id="HAB3E3E7CCEDA465D80033F03A55585E8"><enum>(V)</enum><text>for 5 consecutive performance measurement periods, the Federal supplemental nutrition assistance
			 program funding for the State shall be reduced by 70 percent of the normal
			 funding allotment of the State for the penalty period that commences 12
			 months after the relevant performance measurement period; and</text>
											</subclause><subclause id="H6F02B69098EE4B85AE93C626DCD91441"><enum>(VI)</enum><text display-inline="yes-display-inline">for 6 or more consecutive performance measurement periods, the Federal supplemental nutrition
			 assistance program funding for the State shall be reduced by 100 percent
			 of the normal funding allotment of the State for the penalty period that
			 commences 12 months after the relevant performance measurement period.</text>
											</subclause></clause></subparagraph><subparagraph id="H8680113A05DC46C98281A1CB4B15C8C4"><enum>(C)</enum><header>Restoration in funding resulting from improved State performance</header>
										<clause id="HFC72F8EBF53F4C678D3923AAA7B736D5"><enum>(i)</enum><header>In general</header><text>Subject to clause (iii), if a State maintains a monthly average number of program-eligible family
			 units that maintain full engagement in work activation that is sufficient
			 to fulfill the relevant performance standards described in subparagraphs
			 (B) and (C) of paragraph (3), subject to the limitation in paragraph
			 (3)(D) for 1 nonconsecutive performance measurement period, the Federal
			 supplemental nutrition assistance funding for the State for the next
			 penalty period shall equal <fraction>1/2</fraction> of the sum of—</text>
											<subclause id="H919B729220AF4430982DEA126F83E21F"><enum>(I)</enum><text>the normal funding allotment of the State for the performance measurement period; and</text>
											</subclause><subclause id="HAB6617B350E64A96A89CCB8E38216711"><enum>(II)</enum><text>the funding allotment of the State for the previous penalty period.</text>
											</subclause></clause><clause id="H3F0C18821BD342FC9EEFB0752AE9DB75"><enum>(ii)</enum><header>Subsequent periods</header><text>Subject to clause (iii), if a State maintains a monthly average number of program-eligible family
			 units who maintain full engagement in work activation that is sufficient
			 to fulfill the relevant performance standards described in subparagraphs
			 (B) and (C) of paragraph (3), subject to the limitation in paragraph
			 (3)(D) for 2 consecutive performance measurement periods, the Federal
			 supplemental nutrition assistance funding for the State shall equal 100
			 percent of the normal funding allotment of the State for the next penalty
			 period.</text>
										</clause><clause id="HA846B6C9CD5F417A8F1853E7E3D770F1"><enum>(iii)</enum><header>Limitation</header><text>Notwithstanding clauses (i) and (ii), no State shall receive more than 100 percent of the normal
			 funding allotment of the State due to the provisions of this paragraph.</text>
										</clause></subparagraph></paragraph><paragraph id="H94EEA10A8194426AB9AEA182EACC2BC6"><enum>(6)</enum><header>Rewards to States for reducing government dependence</header>
									<subparagraph id="HAB01FBAFC22E48C0AC2E67954319E675"><enum>(A)</enum><header>In general</header><text>If, in any future year, a State reduces the supplemental nutrition assistance caseload of the State
			 below the levels that existed in calendar year 2006, the State shall
			 receive a financial reward for reducing dependence.</text>
									</subparagraph><subparagraph id="HC0FBDF9115374F2F99318D9CD1C07A3E"><enum>(B)</enum><header>Amount</header><text>The reward shall equal <fraction>1⁄4</fraction> of the savings to the Federal Government for that year that resulted from the caseload reduction.</text>
									</subparagraph><subparagraph id="HCB3AD03D2F4349A496C146DDA6C78FCE"><enum>(C)</enum><header>Use of reward</header><text>A State may use reward funding under this paragraph for any purpose chosen by the State that—</text>
										<clause id="HC9BAE7BE66874E0FB8AC101D17B3E209"><enum>(i)</enum><text>provides benefits or services to individuals with incomes below 200 percent of the Federal poverty
			 level;</text>

										</clause><clause id="H175F225131DD4F4880BF6CBDF8D52872"><enum>(iii)</enum><text>encourages healthy marriage; or</text>
										</clause><clause id="H865E533FAA3C48FFA581D30947269340"><enum>(iv)</enum><text>increases self-sufficiency and reduces dependence.</text>
										</clause></subparagraph></paragraph><paragraph id="H3E4D576888C94344A88F9F9E817B2696"><enum>(7)</enum><header>Authorization of funding</header>
									<subparagraph id="H7F829F36FDEE4CC482AA422DF6E989CB"><enum>(A)</enum><header>In general</header><text>There is authorized to be appropriated to the Secretary to provide funds to State governments for
			 the purpose of carrying out work activation programs in accordance with
			 this section $500,000,000 for fiscal year 2014 and each subsequent fiscal
			 year.</text>
									</subparagraph><subparagraph id="H3757428F5C1F4C66BF8400C64C092CF0"><enum>(B)</enum><header>Allocation among States</header><text>The total amount appropriated under subparagraph (A) for a fiscal year shall be allocated among the
			 States in accordance with the proportion of each State’s share of total

			 in fiscal year 2007.</text>

			 State that receives supplemental nutrition assistance funds may spend, in
			 that fiscal year to administer the work activation program of the State
			 under this section, up to—</text>
												<item id="HF354A50BE50348D0B250BB56957B8BB4"><enum>(aa)</enum><text>30 percent of the Federal funds available to the State through the program of block grants to
			 States for temporary assistance for needy families established under part

			 (aa).</text>
												</item></subclause><subclause commented="no" display-inline="no-display-inline" id="H1CC4D0BF7A404E25ADC7E40989C701A6"><enum>(II)</enum><header>Effect</header><text display-inline="yes-display-inline">Any State that uses State funds allocated to the program of block grants to States for temporary
			 assistance for needy families established under part A of title IV of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>) to administer the work activation program under this section may count
			 those funds for purposes of meeting the maintenance of effort requirement
			 of the State under that program of block grants in that fiscal year.</text>

							</clause></subparagraph><subparagraph id="H4D99C0DCF37447FEAB003CC7A8D6FA45" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">The term <term>means-tested welfare spending</term> includes the full cost of benefits and services provided under a program and the administrative
			 costs for operating the program, subject to the limitations under
			 subparagraph (E).</text>
						</subparagraph><subparagraph id="H94662ADEBD894286A3632EBAD33A67E3" indent="up1"><enum>(E)</enum>
							<clause commented="no" display-inline="yes-display-inline" id="HBC518785CA2E492597C16173A9D8F95B"><enum>(i)</enum>
								<subclause commented="no" display-inline="yes-display-inline" id="H905202C46E494712BE89C2B25057FBB0"><enum>(I)</enum><text display-inline="yes-display-inline">For purposes of this paragraph, only the refundable portion of the following tax credits shall be
			 means-tested welfare spending:</text>
									<item id="H463E7669A7A14CFEA1782C4E48EC5C21" indent="up2"><enum>(aa)</enum><text>The earned income tax credit.</text>
									</item><item id="H42D82DD555E24D0690A2D3514A6E91F3" indent="up2"><enum>(bb)</enum><text>The child tax credit.</text>
									</item><item id="H4088CB1CB3624D20821F51A46556BD9A" indent="up2"><enum>(cc)</enum><text>The making work pay tax credit.</text>
									</item></subclause><subclause id="HF546E7336BE446DDB92C4AFCAD49D670" indent="up2"><enum>(II)</enum><text>For purposes of this paragraph, only the refundable portion of the premium and out of pocket health
			 care subsidies to be paid under the Patient Protection and Affordable
			 Health Care Act shall be means-tested welfare spending.</text>
								</subclause><subclause id="HBC9EFDE6565E4B088F030D960055D96B" indent="up2"><enum>(III)</enum><text>For purposes of this clause, the term <term>refundable portion</term> means the portion of the credit which is paid to an individual in excess of the amount of Federal
			 income tax owed by the individual.</text>
								</subclause></clause><clause id="H1C8206F00E8F45B9B215D7DC2A55A4A8" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">For purposes of this paragraph, only the costs of the free and reduced price segments of the school
			 lunch and school breakfast programs shall be means-tested welfare
			 spending.</text>
							</clause></subparagraph><subparagraph id="HC1284D31B9ED49CA83F7E55C8E60EC31" indent="up1"><enum>(F)</enum><text display-inline="yes-display-inline">For purposes of this paragraph expenditures by State and local governments of funds that are—</text>
							<clause id="H75F742FD8D5B4A6298471ABE6C6FA1FF"><enum>(i)</enum><text display-inline="yes-display-inline">obtained by the State and local government from taxes, fees, or other sources of revenue
			 established by the State or local government; and</text>
							</clause><clause id="H6A0E97A07EE24EA69B7630E540BC77FA"><enum>(ii)</enum><text>are not received as any form of grant from the Federal Government,</text></clause><continuation-text continuation-text-level="subparagraph" indent="paragraph">shall not be Federal means-tested welfare spending, without regard to whether such State and local
			 expenditures take the form of contributions to a Federal program described
			 in subparagraph (A) or listed in subparagraph (B).</continuation-text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HE30BC9FA0617475585363F113971C6F0"><enum>302.</enum><header>Reports to budget committees</header><text display-inline="no-display-inline">Section 202(e)(1) of the Congressional Budget Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/602">2 U.S.C. 602(e)(1)</external-xref>) is amended—</text>
				<paragraph id="H69681E7115514C46B1AB9F08795490D7"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>(A)</quote> after <quote>(1)</quote>; and</text>
				</paragraph><paragraph id="H66D85F0C722548219802092E15D62630"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H3030A9BAE8E94CDA82817909AE39DB24" style="OLC">
						<subparagraph id="HCE91077017DA49F5B3DA5BB635824FD3" indent="up1"><enum>(B)</enum>
							<clause commented="no" display-inline="yes-display-inline" id="H8FA6992480A946398D28DA97CA2FE861"><enum>(i)</enum><text display-inline="yes-display-inline">The Director shall include in each report submitted to the Committees on the Budget of the House of
			 Representatives and the Senate under subparagraph (A) the information
			 described in clause (ii) beginning on the earlier of—</text>
								<subclause id="H4088049330CF405488829E11ED7392CE" indent="up1"><enum>(I)</enum><text display-inline="yes-display-inline">the first fiscal year that begins after the date of enactment of this subparagraph and after any
			 monthly rate of unemployment during the immediately preceding fiscal year
			 is below 6 percent; or</text>
								</subclause><subclause id="H2BE63BA2AAB2425B8011C1E3D227360E" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">fiscal year 2016.</text>
								</subclause></clause><clause id="HCC6B7E9D594246799FA0BB95C94160EB" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">The Director shall include the following information for the fiscal year commencing on October 1 of
			 the year in which the report is submitted and for each of the ensuing 4
			 fiscal years:</text>
								<subclause id="H8952772ACAD14055AEC545D3DC81CA1E"><enum>(I)</enum><text>The Congressional Budget Office baseline level of means-tested welfare spending.</text>
								</subclause><subclause id="H0A05B769EE5E458CAD1EAF62950CA794"><enum>(II)</enum><text display-inline="yes-display-inline">The aggregate level of means-tested welfare spending computed by taking the aggregate level of
			 means-tested welfare spending for fiscal year 2007 and adjusting that for
			 inflation according to the procedures specified in clause (iii).</text>
								</subclause></clause><clause commented="no" id="HE82E8140B673456EB1D90C87CD78527B" indent="up1"><enum>(iii)</enum><text>In preparing the information required to be included under this subparagraph—</text>
								<subclause commented="no" id="HDC5C6A6053CE477E9E2CD9B474FE8E22"><enum>(I)</enum><text>means-tested welfare spending relating to medical assistance programs shall be adjusted for
			 inflation according to the price index for personal consumption
			 expenditures for health products and services as calculated by the Bureau
			 of Economic Analysis; and</text>
								</subclause><subclause commented="no" id="HADF11E471625429AA1E265E6CD29A381"><enum>(II)</enum><text>all other means-tested welfare spending shall be adjusted for inflation according to the weighted
			 price index for personal consumption expenditures excluding health
			 products and services as calculated by the Bureau of Economic Analysis.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="H603AE9078B6240E7AFD972B0EC476D59"><enum>303.</enum><header>Content of concurrent resolutions on the budget</header><text display-inline="no-display-inline">Section 301 of the Congressional Budget Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/632">2 U.S.C. 632</external-xref>) is amended by adding at the end
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="H597C412F6BE14EF386F23CA63D3253C4" style="OLC">
					<subsection id="H926325C86CD7446EBBC7ABE7C0F27E9A"><enum>(j)</enum><header>Means-Tested welfare spending</header>
						<paragraph id="HEA3AEC09D2D9454EAA67A287489C82A7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The concurrent resolution on the budget for a fiscal year shall set forth the appropriate level for
			 aggregate means-tested welfare spending for the first fiscal year of that
			 concurrent resolution and for at least each of the 4 ensuing fiscal years
			 beginning on the earlier of—</text>
							<subparagraph id="H9A56505D96EA47B4940D9F38EFACF361"><enum>(A)</enum><text display-inline="yes-display-inline">the first fiscal year that begins after the date of enactment of this subsection and after any
			 monthly rate of unemployment during the immediately preceding fiscal year
			 is below 6 percent; or</text>
							</subparagraph><subparagraph id="H4D12A08198224F9983A2FD9E5A092BE8"><enum>(B)</enum><text display-inline="yes-display-inline">fiscal year 2016.</text>
							</subparagraph></paragraph><paragraph id="H89AFC8D6C43F416997306A0E063254D2"><enum>(2)</enum><header>Setting level</header><text display-inline="yes-display-inline">The level described in paragraph (1) shall not exceed the aggregate level of Federal means-tested
			 welfare spending for fiscal year 2007, adjusted for inflation as follows:</text>
							<subparagraph id="H1B4ECAB8F8CE4A559894546AF5CA09C6"><enum>(A)</enum><text>In fiscal year 2016, the sum of $825,000,000,000.</text>
							</subparagraph><subparagraph id="H48728645960E4E249B0238E2CEA4881E"><enum>(B)</enum><text display-inline="yes-display-inline">In fiscal year 2017, the sum of $750,000,000,000.</text>
							</subparagraph><subparagraph id="HEACDBAA95F804F239254DB734E330394"><enum>(C)</enum><text display-inline="yes-display-inline">In fiscal year 2018 and in subsequent fiscal years, the aggregate level of Federal means-tested
			 welfare spending for fiscal year 2007, adjusted for inflation as follows:</text>
								<clause id="HDF2A51CE040C470DB4599700F1CD4D77"><enum>(i)</enum><text>Means-tested welfare spending relating to medical assistance programs shall be adjusted for
			 inflation according to the price index for personal consumption
			 expenditures for health products and services as calculated by the Bureau
			 of Economic Analysis.</text>
								</clause><clause id="H4F84D3D5D9B8457595BDFA570D8D693D"><enum>(ii)</enum><text>All other means-tested welfare spending shall be adjusted for inflation according to the weighted
			 price index for personal consumption expenditures excluding health
			 products and services as calculated by the Bureau of Economic Analysis.</text>
								</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H55DB589D744F46218D16F6A38CEB479F"><enum>304.</enum><header>Allocations of means-tested welfare spending</header>
				<subsection id="H9FE4D25E062A4BD28B4BC16B90568264"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 302 of the Congressional Budget Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/633">2 U.S.C. 633</external-xref>) is amended by adding at the end
			 the following:</text>
					<quoted-block display-inline="no-display-inline" id="H878DD25462F5471DBEBA1A1ABFABA312" style="OLC">
						<subsection id="H75EFA43A172842949FEA3865383A7647"><enum>(h)</enum><header>Means-Tested welfare spending limit</header>
							<paragraph id="H6926EDDCDCAC4FAFA424962C9F8D0299"><enum>(1)</enum><header>Further division of amounts</header><text>For any concurrent resolution on the budget in which levels for aggregate means-tested welfare
			 spending are set forth under section 301(j), in the House of
			 Representatives and the Senate, the amounts allocated under subsection (a)
			 shall be further divided to establish an allocation of—</text>
								<subparagraph id="H2566B6D0CE114AEFB1BBD1C873C48CB3"><enum>(A)</enum><text display-inline="yes-display-inline">total new budget authority and total outlays for discretionary means-tested welfare spending in
			 appropriation measures for the first fiscal year of that concurrent
			 resolution; and</text>
								</subparagraph><subparagraph id="HD31711EF668F42ED8938A260C3C1DC4E"><enum>(B)</enum><text display-inline="yes-display-inline">total new budget authority and total outlays for mandatory means-tested welfare spending for the
			 first fiscal year of that concurrent resolution and at least each of the
			 ensuing 4 fiscal years to all other committees of the House of
			 Representatives and the Senate that have jurisdiction over legislation
			 providing mandatory means-tested welfare spending.</text>
								</subparagraph></paragraph><paragraph id="H170E7D2DF6714FD5BE446F356D7C7E6B"><enum>(2)</enum><header>Point of order</header>
								<subparagraph id="HFC779FBCD2D6444C9F5F56718E7F7D35"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), it shall not be in order in the House of Representatives or
			 the Senate to consider any bill, joint resolution, amendment, or amendment
			 between the Houses if—</text>
									<clause id="HFF33B45EE1A347C99DF193B3E8D5BF38"><enum>(i)</enum><text>the enactment of such bill or resolution as reported;</text>
									</clause><clause id="HC3980AE99FE34A06921845324D31EA97"><enum>(ii)</enum><text>the adoption and enactment of such amendment;</text>
									</clause><clause id="H8634009277EC4F3284C9E7DA11ACD5B9"><enum>(iii)</enum><text>the enactment of such bill or resolution in the form recommended in such conference report; or</text>
									</clause><clause id="H0805281D360C4BA4A5FDC44B55BBF371"><enum>(iv)</enum><text>the enactment of such amendment between the Houses,</text></clause><continuation-text continuation-text-level="subparagraph">would cause the applicable allocation of new budget authority or outlays made under subparagraph
			 (A) or (B) of paragraph (1) for a fiscal year to be exceeded.</continuation-text></subparagraph><subparagraph id="HC3750E43670D41279618B9886B435E3C"><enum>(B)</enum><header>Exception</header><text>The limits on the allocation of new budget authority or outlays made under subparagraph (A) or (B)
			 of paragraph (1) shall not be in effect for a fiscal year if the average
			 monthly unemployment rate in the preceding fiscal year exceeded 7.5
			 percent.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H42CFA1F68CD54699B1913ED244C8F98A"><enum>(b)</enum><header>Conforming amendment</header><text>Section 302(b) of the Congressional Budget Act of 1974 is amended by striking <quote>under subsection (a)</quote> and inserting <quote>under subsections (a) and (h)</quote>.</text>
				</subsection></section><section id="H8F9B055D3CD54B8CBF94580E59EEC5EE"><enum>305.</enum><header>Reconciliation</header><text display-inline="no-display-inline">Section 310(a) of the Congressional Budget Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/641">2 U.S.C. 641(a)</external-xref>) is amended—</text>

				</paragraph><paragraph id="HEE12CFA010C444DBA4A286BB5BFD3B11"><enum>(4)</enum><text>in paragraph (5), as so redesignated, by striking <quote>and (3)</quote> and inserting <quote>(3), and (4)</quote>.</text>

				<subsection id="H9FED22FFBFFA4C81888783D4F91D65A8"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this title is to encourage States to develop policies to promote self-sufficiency
			 and prosperity and to reduce poverty and Government dependence.</text>
				</subsection><subsection id="H2BB0ACF1FD614E9C9E7A5D27F858BE50"><enum>(b)</enum><header>Grants</header><text display-inline="yes-display-inline">The Social Security Act is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H03D26C3D5F6E4E399FD6F3A3C64899AA" style="OLC">
						<title id="HF68E7BF5B7D44D049E2F029A47A07D18"><enum>XXII</enum><header>Grants to States to Promote Self-Sufficiency and Prosperity and to Reduce Dependence</header>
							<section id="HC1A9E3D3962D4F5BA81E4D3488AB29F2"><enum>2201.</enum><header>Grants to States</header>
								<subsection id="H7D321781B485469C8007E2BA88EAD7CA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may provide grants to States to reward reductions in poverty and Government
			 dependence and increases in self-sufficiency.</text>
								</subsection><subsection id="H8E31B2634FA944B69FFFE38B25947818"><enum>(b)</enum><header>Allocation of grants to states</header><text>For each fiscal year for which funds are made available under subsection (e), the Secretary shall
			 make a grant in an amount equal to $100,000,000 to each of the 3 States
			 with the greatest percentage increases in the self-sufficiency ratio of
			 the State for the preceding fiscal year over the self-sufficiency ratio of
			 the State for fiscal year 2007, as compared with the changes in that ratio
			 for each other State, subject to subsection (c).</text>
								</subsection><subsection id="HE37FA1FCDDFA40FD92790CFD2183AFDE"><enum>(c)</enum><header>Limitation on eligibility for grants</header><text>A State shall not be eligible for a grant under this title for a fiscal year unless the
			 self-sufficiency ratio of the State for the fiscal year is greater than
			 the self-sufficiency ratio of the State for fiscal year 2007.</text>
								</subsection><subsection id="H24EA632B74A348868F35E04AE8366DB7"><enum>(d)</enum><header>Definitions</header><text>In this title:</text>
									<paragraph id="H54F76F1E9B0E44B2BB03CC82188E8557"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>self-sufficient family</term> means a family (including a 1-person family) whose combined income, excluding receipt of
			 means-tested welfare spending (as defined in section 3(11)(A) of the
			 Congressional Budget and Impoundment Control Act of 1974), exceeds the
			 poverty line (within the meaning of section 673(2) of the Omnibus Budget
			 Reconciliation Act of 1981, including any revision required by such
			 section applicable to a family of the size involved).</text>
									</paragraph><paragraph id="H5125D0434DCF4A89B4C620C14FB48CF6"><enum>(2)</enum><text>The term <term>self-sufficiency ratio</term> means, with respect to a State and a fiscal year—</text>
										<subparagraph id="H0F0750ABFEC84499B6EB9F19EA59D042"><enum>(A)</enum><text>the number of self-sufficient families residing in the State during the fiscal year that are headed
			 by able-bodied individuals who have not attained 63 years of age; divided
			 by</text>
										</subparagraph><subparagraph id="HFDB112B216684AC4B4D199F8AA29F726"><enum>(B)</enum><text display-inline="yes-display-inline">the total number of families residing in the State during the fiscal year that are headed by
			 able-bodied individuals who have not attained 63 years of age.</text>
										</subparagraph></paragraph><paragraph id="H9C55797010144CEEA00B86EDACB167BD"><enum>(3)</enum><text>The term <term>State</term> means the 50 States and the District of Columbia.</text>
									</paragraph></subsection><subsection display-inline="no-display-inline" id="HFE303B1C98904C7CBECB9B132FBE808E"><enum>(e)</enum><header>Limitations on authorization of appropriations</header><text>For grants under this title, there are authorized to be appropriated to the Secretary $300,000,000
			 for fiscal year 2016 and each succeeding fiscal year.</text></subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section></title><title id="H2A7871F98B64423597750A3B47738CAE"><enum>V</enum><header>Prohibition on funding of abortion</header>
			<section id="H018A2376B7E049DBA1B9690D991FF463"><enum>501.</enum><header>Prohibition on funding for abortions</header><text display-inline="no-display-inline">No funds authorized or appropriated by Federal law, and none of the funds in any trust fund to
			 which funds are authorized or appropriated by Federal law, shall be
			 expended for any abortion.</text>
			</section><section id="HF82B7CF19B7D4483882F0720E60F19B7"><enum>502.</enum><header>Prohibition on funding for health benefits plans that cover abortion</header><text display-inline="no-display-inline">None of the funds authorized or appropriated by Federal law, and none of the funds in any trust
			 fund to which funds are authorized or appropriated by Federal law, shall
			 be expended for health benefits coverage that includes coverage of
			 abortion.</text>
			</section><section id="H275E7A1348AF4D5390DB192EE3BA03B7"><enum>503.</enum><header>Prohibition on tax benefits relating to abortion</header><text display-inline="no-display-inline">For taxable years beginning after the date of the enactment of this section, no credit shall be
			 allowed under the internal revenue laws with respect to amounts paid or
			 incurred for an abortion or with respect to amounts paid or incurred for a
			 health benefits plan (including premium assistance) that includes coverage
			 of abortion.</text>
			</section><section id="HA71DFC08E3B8485087684C8367A265D6"><enum>504.</enum><header>Construction relating to separate coverage</header><text display-inline="no-display-inline">Nothing in this title shall be construed as prohibiting any individual, entity, or State or
			 locality from purchasing separate abortion coverage or health benefits
			 coverage that includes abortion so long as such coverage is paid for
			 entirely using only funds not authorized or appropriated by Federal law
			 and such coverage shall not be purchased using matching funds required for
			 a federally subsidized program, including a State's or locality's
			 contribution of Medicaid matching funds.</text>
			</section><section id="H102150D5911F463FA85FC32876B1D9C2"><enum>505.</enum><header>Construction relating to the use of non-Federal funds for health coverage</header><text display-inline="no-display-inline">Nothing in this title shall be construed as restricting the ability of any non-Federal health
			 benefits coverage provider from offering abortion coverage, or the ability
			 of a State or locality to contract separately with such a provider for
			 such coverage, so long as only funds not authorized or appropriated by
			 Federal law are used and such coverage shall not be purchased using
			 matching funds required for a federally subsidized program, including a
			 State's or locality's contribution of Medicaid matching funds.</text>
			</section><section id="HBE0A6060115747528C7BEC1E814EB922"><enum>506.</enum><header>Treatment of abortions related to rape, incest, or preserving the life of the mother</header><text display-inline="no-display-inline">The limitations established in this title shall not apply to an abortion—</text>
				<paragraph id="H54A6153A328146E2814D13C961DC0DD5"><enum>(1)</enum><text>if the pregnancy is the result of an act of rape or incest; or</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9F16A8D9AB0D442882D203446401049B"><enum>(2)</enum><text>in the case where a woman suffers from a physical disorder, physical injury, or physical illness
			 that would, as certified by a physician, place the woman in danger of
			 death unless an abortion is performed, including a life-endangering
			 physical condition caused by or arising from the pregnancy itself.</text>
				</paragraph></section></title></legis-body>
