		<section id="HB2F5F723E4E449B0A6DACC3159F91BF5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Innovation in Surface Transportation Act of 2014</short-title></quote>.</text>
		</section><section id="HB45BD10617F740EDA0F99B7C1CA87EF6"><enum>2.</enum><header>Innovation in surface transportation program</header>
			<subsection id="HA1A273774CF8415AADC06932F28684A6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">Chapter 1</external-xref> of title 23, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/23/104">section 104</external-xref> the following:</text>
				<quoted-block display-inline="no-display-inline" id="H22EA8ECB6CA44E8D8AEFE2A3FFEDD755" style="USC">
					<section id="HAEE5923C8DF3427B9B2B57102A82E4C1"><enum>105.</enum><header>Innovation in surface transportation program</header>
						<subsection id="H76A1D0E724904857AF013FD0495588BC"><enum>(a)</enum><header>In general</header><text>The Secretary, in coordination with State transportation departments, shall establish an innovation
			 in surface transportation program in accordance with the requirements of
			 this section.</text>
						</subsection><subsection id="H322ABD23A8254A3F86E64B0DBAD3365D"><enum>(b)</enum><header>Purposes</header><text>The purposes of the program shall be—</text>
							<paragraph id="H4A80E0E12D324E589E9B430145E70787"><enum>(1)</enum><text>to increase the return on investment in the Nation’s surface transportation system;</text>
							</paragraph><paragraph id="H573A6D51BC444E72B2975E555B21CD12"><enum>(2)</enum><text>to make the Nation’s surface transportation system more reliable, safe, and efficient by advancing
			 innovative projects selected through State competitions;</text>
							</paragraph><paragraph id="HA8E5C608C407422AA8227E5A88E01888"><enum>(3)</enum><text display-inline="yes-display-inline">to increase input from local government and stakeholders on projects receiving funding; and</text>
							</paragraph><paragraph id="H6D3FE27DCDE64B1086D29A91B82CD7D8"><enum>(4)</enum><text>to leverage Federal highway dollars further through in-State competitions.</text>
							</paragraph></subsection><subsection id="H8E41AD2FE6B84E83AB66958E20093C0B"><enum>(c)</enum><header>Grants</header>
							<paragraph id="H26210854CE6044F28B3E3161A4136E04"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A State shall make grants under this section to eligible entities for eligible projects to be
			 carried out in the State using funds reserved by the State for a fiscal
			 year under subsection (e)(1).</text>
							</paragraph><paragraph id="H5A5E8A54AD7B4F098D4F3C416C262097"><enum>(2)</enum><header>State competitions</header>
								<subparagraph id="HFFBA9AEDED6A4FF49EF05D43408160FB"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">For the purposes of making grants under this section, a State shall conduct a competition each
			 fiscal year under which the State will accept grant applications submitted
			 by eligible entities.</text>
								</subparagraph><subparagraph id="H0459699EE1A644CEB6DD03468C30F594"><enum>(B)</enum><header>Competition dates</header><text>A State shall conduct a competition under subparagraph (A)—</text>
									<clause id="H2B8B6A78E40248A1B1EA170EA9312DD3"><enum>(i)</enum><text>not later than 180 days after the date of enactment of this section; and</text>
									</clause><clause id="H61C42BB1C1544DF3AE16FB770F032C61"><enum>(ii)</enum><text>not later than 30 days after the first day of each fiscal year beginning after such date of
			 enactment.</text>
									</clause></subparagraph></paragraph><paragraph id="HFD46E9C8BEC44937A99F805240B2DFE1"><enum>(3)</enum><header>Selection criteria</header>
								<subparagraph id="HB1154A7AF378475AA849AFCF57E3F006"><enum>(A)</enum><header>Establishment of selection criteria</header><text display-inline="yes-display-inline">The State selection panel of each State shall establish and make available to the public the
			 project selection criteria that will be used by the State in conducting
			 competitions under paragraph (2).</text>
								</subparagraph><subparagraph id="H2B5BBBE6EAA947118FB7A80B01AECD22"><enum>(B)</enum><header>Factors</header><text>The project selection criteria of a State may provide for the approval of project applications
			 based on the extent to which the projects—</text>
									<clause id="H7671B4E8F15F46BDA893980155935D17"><enum>(i)</enum><text>improve safety for all users of the transportation network;</text>
									</clause><clause id="H91B51CAA6F924EB5AACD9735B806C37F"><enum>(ii)</enum><text>strengthen the contribution of a national freight network to the Nation’s economic competitiveness;</text>
									</clause><clause id="H49389732022F442CBFC195B07E571F9F"><enum>(iii)</enum><text>promote multimodal connectivity;</text>
									</clause><clause id="H9DBF238D79414A47A8B9696E63663CAD"><enum>(iv)</enum><text display-inline="yes-display-inline">strengthen return on investment, particularly the impact on local economic development;</text>
									</clause><clause id="HC745B3AF442C428B9ABCA88DF673403C"><enum>(v)</enum><text display-inline="yes-display-inline">improve access to jobs, sources of labor, schools, and opportunity;</text>
									</clause><clause id="H4177BB8B605F42F38A77AE14C83018BD"><enum>(vi)</enum><text display-inline="yes-display-inline">optimize, through better design and operation, the usage and efficiency of existing transportation
			 facilities;</text>
									</clause><clause id="HDC4B1A4D605A4BC586B2A5D76A982F55"><enum>(vii)</enum><text display-inline="yes-display-inline">improve the reliability of the transportation system of the United States;</text>
									</clause><clause id="H79D1912F75ED40DB85C66AB4649FE1D2"><enum>(viii)</enum><text display-inline="yes-display-inline">encourage innovation and the use of technology; or</text>
									</clause><clause id="HBB258D437A6E4EBEB76A98D5C7A7B630"><enum>(ix)</enum><text>further the purposes described in subsection (b).</text>
									</clause></subparagraph><subparagraph id="H78386116F1F34001AB845EEF9C2D09A4"><enum>(C)</enum><header>Special consideration of certain factors</header><text display-inline="yes-display-inline">In addition to the factors specified in subparagraph (B), the project selection criteria of a
			 State may—</text>
									<clause id="H9A2E104E9BCD4532A120CFFF222CC7F6"><enum>(i)</enum><text>provide that special consideration in the approval of project applications is given to eligible
			 projects that—</text>
										<subclause id="H32939CC368B147B2B55CD0856B0DF103"><enum>(I)</enum><text>maximize the amount of proposed project costs that can be borne by the applicant from non-Federal
			 sources; or</text>
										</subclause><subclause id="H91C2BDFB471D4EA6BEDBA89F9DA4E846"><enum>(II)</enum><text>have prior significant Federal or non-Federal investment; and</text>
										</subclause></clause><clause id="H95E27E7E2E2849F8B30D7E85196C81B9"><enum>(ii)</enum><text display-inline="yes-display-inline">give equal consideration to differences in the fiscal capacity of public eligible entities.</text>
									</clause></subparagraph><subparagraph id="H914D7F57AD364FA3AD0AC03DC1BA8524"><enum>(D)</enum><header>Funding distribution</header><text display-inline="yes-display-inline">The project selection criteria of a State shall take into consideration the equitable distribution
			 of funds by geography and population.</text>
								</subparagraph></paragraph><paragraph id="H8997FF2CBC004BA494512CD8F6FC6983"><enum>(4)</enum><header>Special rule for private transportation providers</header><text>An eligible entity that is a private transportation provider may submit a project application in a
			 State competition conducted under paragraph (2) only if the application is
			 sponsored by a public entity.</text>
							</paragraph></subsection><subsection id="H927BE2AA03E6420784D8DA9DE7C15D51"><enum>(d)</enum><header>Innovation in surface transportation selection panel</header>
							<paragraph id="H30A902A1815C4DC2A8B41EE0B0088621"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A State, in coordination with local transportation stakeholders, shall establish an innovation in
			 surface transportation selection panel in accordance with this subsection.</text>
							</paragraph><paragraph id="HBC749AAEF2D8457AB0F60C5C054A2148"><enum>(2)</enum><header>Duties</header><text>A State selection panel shall—</text>
								<subparagraph id="HEB9584A0A46E4C47A209A059814424EC"><enum>(A)</enum><text display-inline="yes-display-inline">review project applications submitted to the State during a competition conducted under subsection
			 (c)(2); and</text>
								</subparagraph><subparagraph id="H07408583B6B14066901C1290C23E6877"><enum>(B)</enum><text>approve and disapprove the project applications based on the criteria set forth in subsection
			 (c)(3).</text>
								</subparagraph></paragraph><paragraph id="HD3B0A421358848ED80A4BE74512659BD"><enum>(3)</enum><header>Membership</header><text display-inline="yes-display-inline">A State selection panel shall be composed of the following members to be appointed by the State—</text>
								<subparagraph id="HCA8FC8F592CC44AF87E69FC2E8ECC22E"><enum>(A)</enum><text>not fewer than 3 individuals representing the State’s transportation department;</text>
								</subparagraph><subparagraph id="HB7F61F0CDD3F468CBD240BE02BC1E7AA"><enum>(B)</enum><text>not fewer than 3 individuals representing local governments in the State, with at least 1
			 representative from each of—</text>
									<clause id="H030E61EDDE074FD794E27FFA53E1C46B"><enum>(i)</enum><text>a jurisdiction with a population of 50,000 individuals or fewer;</text>
									</clause><clause id="H71CABD04EECC4655A65F9A9049AFBA87"><enum>(ii)</enum><text>a jurisdiction with a population of more than 50,000 individuals and not more than 1,000,000
			 individuals; and</text>
									</clause><clause id="H39C3906FF3A84AB49F740D0CAF168500"><enum>(iii)</enum><text>a jurisdiction with a population of more than 1,000,000 individuals, if applicable; and</text>
									</clause></subparagraph><subparagraph id="HCC5B1D579F8D4FFEA1EEBFFB675CE12C"><enum>(C)</enum><text>not fewer than 3 individuals representing metropolitan planning organizations, councils of
			 governments, and rural planning organizations.</text>
								</subparagraph></paragraph><paragraph id="H86A5185780E24DA9AEBBB05E39AAF726"><enum>(4)</enum><header>Additional members</header><text>In addition to the members appointed under paragraph (3), a State selection panel shall be composed
			 of 9 members to be appointed by the State, in coordination with local
			 transportation stakeholders, from among individuals representing—</text>
								<subparagraph id="H6F3FB53FC40E48E2AD452B752F40637A"><enum>(A)</enum><text display-inline="yes-display-inline">local chambers of commerce;</text>
								</subparagraph><subparagraph id="HF4D986669B394A2EB5CAE667D58BF91B"><enum>(B)</enum><text>transportation management organizations, travel and tourism boards, economic development
			 organizations, and other coalitions of employers and commerce;</text>
								</subparagraph><subparagraph id="H5477ED936C114C67B4E71F95AF6DE89B"><enum>(C)</enum><text>local air quality boards or local organizations supporting improved air quality;</text>
								</subparagraph><subparagraph id="H2E85B11A636D46158E42B3286CE96D8B"><enum>(D)</enum><text>State safety boards or local organizations supporting safety;</text>
								</subparagraph><subparagraph id="HB21540B55C204EEEBE469D12782FB8B1"><enum>(E)</enum><text>transit agencies;</text>
								</subparagraph><subparagraph id="HDEF24B1FC45B4B1F971A009EF23E4EEC"><enum>(F)</enum><text>port authorities, if applicable;</text>
								</subparagraph><subparagraph id="H422CD91FC0E043FB8060F4ED2B50829A"><enum>(G)</enum><text>active transportation organizations;</text>
								</subparagraph><subparagraph id="HC8666D2A5A5D48FD9B87C5224B5B9963"><enum>(H)</enum><text display-inline="yes-display-inline">public interest organizations; and</text>
								</subparagraph><subparagraph id="H8FBB8AD4237C40B48DC02608B4F89F19"><enum>(I)</enum><text>labor unions.</text>
								</subparagraph></paragraph><paragraph id="HEB585A99651C4DD5B34B343F3FB29AA5"><enum>(5)</enum><header>Distribution of representatives</header><text display-inline="yes-display-inline">A State shall appoint members to the State’s selection panel in a manner such that—</text>
								<subparagraph id="HA0F836773A214117B25D102A3424F618"><enum>(A)</enum><text>the number of members appointed under each of paragraphs (3)(A), (3)(B), and (3)(C) is equal; and</text>
								</subparagraph><subparagraph id="HC3C0255AE6E7424796DEAAD41E56CA27"><enum>(B)</enum><text display-inline="yes-display-inline">at least 1 member is appointed under paragraph (4) from each of the entities described in
			 subparagraphs (A) through (H) of paragraph (4), if applicable.</text>
								</subparagraph></paragraph><paragraph id="HEE63CDC8E74F43AF92BF8EEF845EDB08"><enum>(6)</enum><header>Geographic diversity</header><text>The members of a State selection panel shall be geographically diverse, to the extent practicable.</text>
							</paragraph><paragraph id="HAA87B0049EA349FC9154E97D9BB9E281"><enum>(7)</enum><header>Representation limitation</header><text>Except for the representatives described in paragraphs (3)(A) and (3)(B)(iii), no entity may be
			 represented on a State selection panel for more than 2 consecutive years
			 if a comparable entity can also be represented on the panel.</text>
							</paragraph><paragraph id="H7A7E363610A3402C83D5C30EB146061B"><enum>(8)</enum><header>Continuity</header><text>A State shall appoint members to the State’s selection panel using a 2-tiered rotation process that
			 ensures continuity of the panel by rotating the membership of the panel on
			 a staggered basis.</text>
							</paragraph></subsection><subsection id="H100A2527913445EA8EC578A7C50E4D09"><enum>(e)</enum><header>Funding</header>
							<paragraph id="H1E695A5E7855466C840AE3E1A0191E27"><enum>(1)</enum><header>Reservation of funds</header><text display-inline="yes-display-inline">On October 1 of each fiscal year, a State shall make the following reservations of funds:</text>
								<subparagraph id="HA28AC7B16FB14666A110074BD87638EA"><enum>(A)</enum><header>National highway performance program</header><text display-inline="yes-display-inline">The State shall reserve 10 percent of the amount apportioned to the State for the fiscal year under
			 section 104(b)(1)—</text>
									<clause id="HC72867E161FD4DDBA8F648BF9BB74986"><enum>(i)</enum><text>for carrying out State competitions under this section; and</text>
									</clause><clause id="HF1C47A78D6004366B0F9119D2B480F06"><enum>(ii)</enum><text>for making grants under this section for eligible projects.</text>
									</clause></subparagraph><subparagraph id="HB1A8CE0878F14A79A2C1B17F129CC150"><enum>(B)</enum><header>Highway safety improvement program</header><text display-inline="yes-display-inline">The State shall reserve not less than 33 percent of the amount apportioned to the State for the
			 fiscal year under section 104(b)(3) for making grants under this section
			 for eligible projects that are projects described in section 148.</text>
								</subparagraph><subparagraph id="H01712D3EDE054DA39EC3DEC3F7862D64"><enum>(C)</enum><header>Congestion mitigation and air quality improvement program</header>
									<clause id="H4477C83BE69243AE94EDDFD2273E5728"><enum>(i)</enum><header>Reservation of funds</header><text display-inline="yes-display-inline">The State shall reserve not less than 33 percent of the amount apportioned to the State for the
			 fiscal year under section 104(b)(4) and unobligated balances for section
			 104(b)(4) from the prior fiscal year for making grants under this section
			 for eligible projects that are projects described in section 149(b).</text>
									</clause><clause id="HD09E2D61486549C295CE8BDF9AC58E07"><enum>(ii)</enum><header>Use of reserved funds</header><text display-inline="yes-display-inline">If the State has one or more nonattainment areas (as defined in section 171(2) of the Clean Air Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/7501">42 U.S.C. 7501(2)</external-xref>)), the State shall use amounts reserved under this
			 subparagraph for making grants under this section for eligible projects
			 described in section 149(b) in such areas.</text>
									</clause></subparagraph><subparagraph id="H220C7FEAB93C4C59961044D991132210"><enum>(D)</enum><header>Surface transportation program</header><text display-inline="yes-display-inline">The State shall reserve not less than 33 percent of the amount allocated to the State for the
			 fiscal year under section 133(d)(1)(B) for making grants under this
			 section for eligible projects.</text>
								</subparagraph><subparagraph id="HAC09BD3CCF5D410B9531FBA7AF3A1D12"><enum>(E)</enum><header>Transportation alternatives program</header><text display-inline="yes-display-inline">The State shall reserve 33 percent of the amount reserved by the State for the fiscal year under
			 section 213(c)(1)(B) for making grants under this section for eligible
			 projects that are projects described in section 213(b).</text>
								</subparagraph></paragraph><paragraph id="H91ED6703740D462EA21120EFCFE044BF"><enum>(2)</enum><header>Special rule</header><text display-inline="yes-display-inline">Any funds that a State directly suballocates to metropolitan areas or direct recipients of funds
			 under <external-xref legal-doc="usc" parsable-cite="usc/49/5307">section 5307</external-xref> of title 49 or awards through an open statewide
			 competition to eligible entities shall be excluded from the funds from
			 which reservations are to be made under paragraph (1).</text>
							</paragraph><paragraph id="H46BABA42832A4BCB816DB8431A00699E"><enum>(3)</enum><header>Non-awarded funds</header><text display-inline="yes-display-inline">For each fiscal year, a State shall—</text>
								<subparagraph id="HBEF4E8A0505C49C3B9E70C52F8B34650"><enum>(A)</enum><text>determine—</text>
									<clause id="HDD71BE3BB2ED4A3EADE57D936097B105"><enum>(i)</enum><text display-inline="yes-display-inline">the total amount of funds, if any, that have been reserved by the State for the fiscal year under
			 paragraph (1) but have not been awarded by the State in grants under this
			 section on or before the last day of the fiscal year; and</text>
									</clause><clause id="HEB592B7C5298458383BF30608935CD08"><enum>(ii)</enum><text display-inline="yes-display-inline">the total amount of funds, if any, that have been awarded in grants by the State under this section
			 but remain unobligated by the grant recipient after the last day of the
			 5-year period beginning on the date on which the grant was awarded; and</text>
									</clause></subparagraph><subparagraph id="HEDECF628830C4DE5810CABFE05BC064F"><enum>(B)</enum><text display-inline="yes-display-inline">distribute or redistribute such funds, as appropriate, using the process under subsection (c)(2).</text>
								</subparagraph></paragraph></subsection><subsection id="HD766F5DC16A5401BB15A5EE600CBB9E5"><enum>(f)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text>
							<paragraph id="H00D62CD3D6164C539D280E486B45C303"><enum>(1)</enum><header>Eligible entity</header><text>The term <quote>eligible entity</quote> means—</text>
								<subparagraph id="HEEAD268963C5486C91DFD8854D04E8C4"><enum>(A)</enum><text>a local government;</text>
								</subparagraph><subparagraph id="H68FE85B1B90E4E8399B6DB88690ADC73"><enum>(B)</enum><text>a regional transportation authority;</text>
								</subparagraph><subparagraph id="H601D51C8CCB84031B3DA9C4688B38E21"><enum>(C)</enum><text>a transit agency;</text>
								</subparagraph><subparagraph id="H1113BF2CE53847ED95B2B2E928A42456"><enum>(D)</enum><text>a tribal government;</text>
								</subparagraph><subparagraph id="H0E26267168F04E53956ABFC936895537"><enum>(E)</enum><text>a private provider of public transportation;</text>
								</subparagraph><subparagraph id="H4795F15C0EB24764A49B20A6713F403A"><enum>(F)</enum><text>a nonprofit transportation organization;</text>
								</subparagraph><subparagraph id="HAEB6B1214E4741B2830E07BD8FF22555"><enum>(G)</enum><text>a port authority;</text>
								</subparagraph><subparagraph id="HA4E120139B964B7B8C741BC2129F6993"><enum>(H)</enum><text>a joint power authority; or</text>
								</subparagraph><subparagraph id="HF3E456D1AB7848BDBA66D7E2633E56F5"><enum>(I)</enum><text>a local rail authority.</text>
								</subparagraph></paragraph><paragraph id="H846E7256FD644C7F943AA12CC8715427"><enum>(2)</enum><header>Eligible project</header><text>The term <quote>eligible project</quote> means—</text>
								<subparagraph id="HBAE409E6DDEC474094CD10D47EDCC03F"><enum>(A)</enum><text>a project eligible under—</text>
									<clause id="HAF8AD820772E4DC2890197FE3E23DF91"><enum>(i)</enum><text>section 133(b), relating to the surface transportation program;</text>
									</clause><clause commented="no" id="H35803F3F1E784DF7812DE5C58E6A838D"><enum>(ii)</enum><text display-inline="yes-display-inline">section 148, relating to the highway safety improvement program;</text>
									</clause><clause id="H51A22A20DFB04EAAB6A39E4FFB437996"><enum>(iii)</enum><text>section 149(b), relating to the congestion mitigation and air quality improvement program; or</text>
									</clause><clause id="H2B40F5A18F2042E79690CCC19EF150BB"><enum>(iv)</enum><text>section 213(b), relating to the transportation alternatives program; or</text>
									</clause></subparagraph><subparagraph id="HDA715E9983874BA7A15F163B10AB2A74"><enum>(B)</enum><text>a surface transportation project that will improve the movement of goods along a primary freight
			 network, including multimodal facilities near a primary freight route.</text>
								</subparagraph></paragraph><paragraph id="H0219B0233555496D956A6C07B76B15D4"><enum>(3)</enum><header>Program</header><text display-inline="yes-display-inline">The term <quote>program</quote>, except as otherwise specifically provided, means the innovation in surface transportation program
			 established under this section.</text>
							</paragraph><paragraph id="H0FD045E0AE854B2D82988EB4AF252AE4"><enum>(4)</enum><header>State selection panel</header><text display-inline="yes-display-inline">The term <quote>State selection panel</quote> means an innovation in surface transportation selection panel established by a State under
			 subsection (d).</text>
							</paragraph></subsection><subsection id="H4993CA6EAC9F422687BA7B2A71181C91"><enum>(g)</enum><header>Transparency</header><text>Not later than 30 days after a State has selected projects for a fiscal year to receive funding
			 under this section, the State shall make available, in a
			 publically accessible medium that is easy to navigate—</text>
							<paragraph id="H9192590337DF4F61B36D52F70A66E32A"><enum>(1)</enum><text>the criteria and methodology used to select the projects;</text>
							</paragraph><paragraph id="HB901EE07D70042E3B6E18E6A027A0D04"><enum>(2)</enum><text>a list of all the projects for which funding was requested, including, for each such project—</text>
								<subparagraph id="H6D436A2BA05A44FE861415BD7743766C"><enum>(A)</enum><text>the total estimated project cost; and</text>
								</subparagraph><subparagraph id="HF5AA610404C9411E845EA3291EAE901D"><enum>(B)</enum><text>the amount of funding requested;</text>
								</subparagraph></paragraph><paragraph id="HCB818FA080D8418EB53C08686B7D6EBB"><enum>(3)</enum><text>a list of projects that were selected to receive funding under this section, including, for each
			 such project—</text>
								<subparagraph id="HF7E605F11AF745829D5D90E175770B15"><enum>(A)</enum><text>the amount of funding requested;</text>
								</subparagraph><subparagraph id="H1B8B9F2B556B48F4AF036B50E8FC5DEF"><enum>(B)</enum><text>the amount of funding granted; and</text>
								</subparagraph><subparagraph id="HBA408B0963B94435BF24C1B673EAA1D1"><enum>(C)</enum><text>the source of the non-Federal share of cost of the project; and</text>
								</subparagraph></paragraph><paragraph id="H8D8F3D8B41354D3884935DC8BE5C811F"><enum>(4)</enum><text>the ranking and scoring of all projects for which funding was requested.</text>
							</paragraph></subsection><subsection id="H31D5BB4B154F49479BC8C70B9E28E8E1"><enum>(h)</enum><header>Reporting requirements</header>
							<paragraph id="HEF94322C217040008E3AD7CAAF285496"><enum>(1)</enum><header>State reports</header><text>Not later than 180 days after the last day of each fiscal year, a State shall submit to the
			 Secretary a report that describes—</text>
								<subparagraph id="H4F47B3F398A24B9298526E2FCB9DCDCF"><enum>(A)</enum><text>the information required under subsection (g);</text>
								</subparagraph><subparagraph id="H55CD882908FD4CDF980B0C1DC6A429BD"><enum>(B)</enum><text>the organizations that were represented on the State’s selection panel;</text>
								</subparagraph><subparagraph id="HA6367F078E6B4E1FA205E59806043439"><enum>(C)</enum><text>the portion of the funds available to the State for the program that have been obligated; and</text>
								</subparagraph><subparagraph id="H2373ACF4050348AD8B4C4DC1C2D53EDE"><enum>(D)</enum><text>the percentage of the funds available to the State for the program that were used for
			 administrative expenses.</text>
								</subparagraph></paragraph><paragraph id="HFF04C7208B6A407F87C7C999AC5AF04C"><enum>(2)</enum><header>Biennial report to Congress</header><text>Not later than September 30, 2016, and biennially thereafter, the Secretary shall submit a
			 consolidated report on the program, including a review of the State
			 reports submitted pursuant to paragraph (1), to—</text>
								<subparagraph id="HF5EB5C64DDD34EB6AB6B008CF549D971"><enum>(A)</enum><text>the Committee on Banking, Housing, and Urban Affairs of the Senate;</text>
								</subparagraph><subparagraph id="HCB8592DDCEA640BB92AD62476914BA20"><enum>(B)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate;</text>
								</subparagraph><subparagraph id="HF7FE6C3B70924259A53DA54DFA8A01B2"><enum>(C)</enum><text>the Committee on Environment and Public Works of the Senate; and</text>
								</subparagraph><subparagraph id="HCCC43E50DAF74B02B939156174A82F40"><enum>(D)</enum><text>the Committee on Transportation and Infrastructure of the House of Representatives.</text>
								</subparagraph></paragraph><paragraph id="H504FB52D63F048428C2F4BCEEB45C68A"><enum>(3)</enum><header>Availability</header><text>The Secretary shall make the report submitted under paragraph (2) available on the public Internet
			 Web site of the Department of Transportation.</text>
							</paragraph></subsection><subsection id="H2CE536F7282942ADAE46B079D015DD6A"><enum>(i)</enum><header>Special rule for States with competitive and suballocated programs</header>
							<paragraph id="H93D75DFE4FE64C33B5A282FAC812954B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may permit a State to distribute funding described in subparagraphs (A), (B), (C),
			 (D), or (E) of subsection (e)(1) through the mechanisms described in
			 paragraph (2) if the Secretary certifies that the State is distributing
			 such funding in a manner that fulfills the purposes of this section.</text>
							</paragraph><paragraph commented="no" id="H98752C11751F474BBEC4D7AA16EEDB78"><enum>(2)</enum><header>Distribution mechanisms</header><text display-inline="yes-display-inline">Distribution mechanisms that qualify under paragraph (1) include—</text>
								<subparagraph commented="no" id="H5483FA8E18F5428FB918190890045D8A"><enum>(A)</enum><text display-inline="yes-display-inline">an open and competitive State program that is substantially similar to the requirements of this
			 section;</text>
								</subparagraph><subparagraph commented="no" id="HF4EFDD8264D24B62B03F9CB8F0CB03DF"><enum>(B)</enum><text display-inline="yes-display-inline">direct suballocation to metropolitan areas of a majority of all funds—</text>
									<clause commented="no" id="H8CEF2A3DA80E49A59F30EE6C8BBA29A5"><enum>(i)</enum><text>apportioned to the State under sections 104(b)(1), 104(b)(2), 104(b)(3), and 104(b)(4); and</text>
									</clause><clause commented="no" id="H2C4F3975DE11446698BD138067353402"><enum>(ii)</enum><text>allocated to the State under section 213(a)(1); and</text>
									</clause></subparagraph><subparagraph commented="no" id="HD4EE9DD7D913403E89A7092C2F615751"><enum>(C)</enum><text display-inline="yes-display-inline">a competitive State program or direct suballocation to metropolitan areas or direct recipients of
			 funds under <external-xref legal-doc="usc" parsable-cite="usc/49/5307">section 5307</external-xref> of title 49 of more than 95 percent of the funds—</text>
									<clause commented="no" id="H39CB113E278845B7961E5A92C98EC8FA"><enum>(i)</enum><text display-inline="yes-display-inline">apportioned to the State under section 104(b)(1), 104(b)(2), 104(b)(3), or 104(b)(4); or</text>
									</clause><clause commented="no" id="HD534BD3902D04A64A462BC7FA302769B"><enum>(ii)</enum><text display-inline="yes-display-inline">allocated to the State under section 213(a)(1).</text>
									</clause></subparagraph></paragraph><paragraph id="HAB607A0831714D6196BE37B39CFF1608"><enum>(3)</enum><header>Publication in Federal Register</header><text>Before making a certification under paragraph (1)(B), the Secretary shall—</text>
								<subparagraph id="H5224ADB1AD0B4D8B852497FCE7B2E207"><enum>(A)</enum><text>publish in the Federal Register the Secretary’s intent to make the certification;</text>
								</subparagraph><subparagraph id="HD99C9CCAD1C24E5BA0F9283C16041B99"><enum>(B)</enum><text>provide the public not fewer than 90 days to comment on the proposed certification; and</text>
								</subparagraph><subparagraph id="HEF6349815A9C43C7BB5DA0F310009A93"><enum>(C)</enum><text>take into consideration any comments received during the comment period.</text>
								</subparagraph></paragraph><paragraph id="HD64B141ACCF24F4AA5F0CCF687F8CD60"><enum>(4)</enum><header>Notice to Congress</header><text>At least 15 days before making a certification under paragraph (1)(B), the Secretary shall submit a
			 notice to the congressional committees referred to in subsection (h)(2)
			 and the members of the State’s congressional delegation that includes—</text>
								<subparagraph id="HBC22613963A1403E884591F972E9F08E"><enum>(A)</enum><text>a notification of the Secretary’s intent to make the certification; and</text>
								</subparagraph><subparagraph id="H71706B9FA7E44435A6D51918A4F9BE5E"><enum>(B)</enum><text>a justification for the proposed certification.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H635E2D16F0C542148A5B8B19E4829663"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, is amended by inserting after the item
			 relating to section 104 the following:</text>
