<official-title>To amend title 38, United States Code, to provide priority for the establishment of new national cemeteries by the Secretary of Veterans Affairs, and for other purposes.</official-title>

<section id="H95C05FE9A7A245D2A42B9DA50F5E4D7F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans National Remembrance Act</short-title></quote>.</text></section> 
<section id="H4A6DEC227E144926B68C58B07B803817"><enum>2.</enum><header>Establishment of new national cemeteries by the Secretary of Veterans Affairs</header> 
<subsection id="H5F81FBB3F1C74BEEB3402444795E589A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/2404">Section 2404</external-xref> of title 38, United States Code, is amended by adding at the end the following new subsection:</text> 
<quoted-block display-inline="no-display-inline" id="H79517DDD11B34EFD98BD79429E4979F9" style="USC"> 
<subsection id="H47988C6EFF264BA18260C482935086B6"><enum>(i)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="HCE807EAB063A4999875D7A9022328544"><enum>(1)</enum><text>In selecting a location for the establishment of a new national cemetery under this chapter, the Secretary shall—</text> 
<subparagraph id="HDD4A6C20CFCA46949747AF6990801C4B" indent="up1"><enum>(A)</enum><text>give priority to a location in accordance with paragraph (2); and</text></subparagraph> 
<subparagraph id="H8A7024D7CDCC444395087EE9B5BF2F15" indent="up1" commented="no"><enum>(B)</enum><text>with respect to a location given such priority, ensure that the location is within 10 miles of the location that the Secretary determines likely to have a significant amount of the population to be served by such national cemetery during the 25-year period following such establishment.</text> </subparagraph></paragraph> 
<paragraph id="H5C80CA41CF7F4EF0B916D0B1F6BC9190" indent="up1"><enum>(2)</enum> 
<subparagraph id="H7F02C28D9747494187E26100D18F665F" display-inline="yes-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">Except as provided by subparagraph (C), in selecting a location for the establishment of a new national cemetery under this chapter, the Secretary shall give priority to a State that does not have a national cemetery.</text> </subparagraph> 
<subparagraph id="H3B15BE9099854E82A43C0F2F583C2E61" indent="up1"><enum>(B)</enum><text>In determining priority among more than one State described in subparagraph (A), the Secretary shall give priority to the State that has the largest population of veterans.</text> </subparagraph> 
<subparagraph id="H7D3B55CDCC344796B83EEAA94370A924" indent="up1" commented="no"><enum>(C)</enum><text>After any time that the Secretary establishes two national cemeteries in accordance with the priority described in subparagraph (A), the Secretary may waive the requirements of such priority in establishing the national cemetery that immediately follows such two national cemeteries if the Secretary determines that such waiver will allow the Secretary to establish a national cemetery that will serve a larger population of veterans as compared to establishing a national cemetery in accordance with such priority.</text></subparagraph></paragraph> 
<paragraph id="H239605424B644F05B72A7F060BE3DB19" indent="up1" commented="no"><enum>(3)</enum><text>In this subsection, the term <term>national cemetery</term>—</text> 
<subparagraph id="HCB009E826BD24AB2BF902910CC86172B" commented="no"><enum>(A)</enum><text>includes—</text> 
<clause id="HE81ACF4C658645C8AF8ECE6B881A8FC3" commented="no"><enum>(i)</enum><text>the cemeteries described in <external-xref legal-doc="usc" parsable-cite="usc/38/2400">section 2400(b)</external-xref> of this title; and</text></clause> 
<clause id="H318F72411D4C4EF38446571EE6B82652" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">any traditional or vaulted internments—</text> 
<subclause id="HBDCAC6A367AC4366AEFD4C48B86B6DC6" commented="no"><enum>(I)</enum><text>located on land that is larger than 20 acres; and</text></subclause> 
<subclause id="H6A8E0506416543D88123C856D8DD0F3F" commented="no"><enum>(II)</enum><text>administered and operated by employees of the Department; and</text></subclause></clause> </subparagraph> 
<subparagraph id="HB23C938F30094A919F861D2329C12510" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">does not include facilities of the National Cemetery Administration that are located in rural areas to serve small populations of veterans (commonly known as <quote>National Burial Grounds</quote>).</text> </subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HA9F35980FCEE45C488F09DF8340FB758"><enum>(b)</enum><header>Construction</header><text display-inline="yes-display-inline">Subsection (i) of <external-xref legal-doc="usc" parsable-cite="usc/38/2404">section 2404</external-xref> of title 38, United States Code, as added by subsection (a), may not be construed as affecting the plans of the Secretary of Veterans Affairs, as of the date of the enactment of this Act, to establish National Burial Grounds or National Columbariums.</text></subsection></section>
