		<official-title>To provide for the establishment of an office within the Internal Revenue Service to focus on
			 violations of the internal revenue laws by persons who are under
			 investigation for conduct relating to the promotion of commercial sex acts
			 and trafficking in persons crimes, and to increase the criminal monetary
			 penalty limitations for the underpayment or overpayment of tax due to
			 fraud.</official-title>

		<section id="H275C19A5404E4F06B8AC0910AF9219B8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Human Trafficking Fraud Enforcement Act of 2014</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="HCB4D9CC69233478991063A807C90846E"><enum>2.</enum><header>Office for tax law enforcement relating to human trafficking and promotion of commercial sex acts</header>
			<subsection id="H76FE70004E7444D1A553C353863811D7"><enum>(a)</enum><header>Establishment</header><text>The Secretary of the Treasury shall establish an office within the Internal Revenue Service to
			 investigate and prosecute violations of the internal revenue laws by
			 persons that appear to be engaged in conduct in violation of any of the
			 provisions specified in subsection (b).</text>
			</subsection><subsection id="HDCB0CB9698954F92A76D77CD07E59AAF"><enum>(b)</enum><header>Certain criminal provisions relating to human trafficking and promotion of commercial sex acts</header><text>The provisions of law referenced in this subsection are as follows:</text>
				<paragraph id="H45856F6EEA6347BDA65C5D212EAB2124"><enum>(1)</enum><text>The following provisions of title 18, United States Code:</text>
					<subparagraph id="H4E3DE0E18C2F4A53856D3B12AC71AF23"><enum>(A)</enum><text>Section 1351.</text>
					</subparagraph><subparagraph id="H9F9A569AF0B944089EB2D5666CF5E8F4"><enum>(B)</enum><text>Section 1589.</text>
					</subparagraph><subparagraph id="HCEE1B9D6D1294A61B544EAC1AD7A36E7"><enum>(C)</enum><text>Section 1590.</text>

					</subparagraph></paragraph><paragraph id="H83875E5C015C4707AC0D9DFF0ED4E635"><enum>(2)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/8/1328">Section 1328</external-xref> of title 8, United States Code.</text>
				</paragraph><paragraph id="HDB9BCB201A7346FE804220795A560C1B"><enum>(3)</enum><text>The laws of any State or territory that prohibit the promotion of prostitution or of any commercial
			 sex act (as such term is defined in <external-xref legal-doc="usc" parsable-cite="usc/18/1591">section 1591(e)(3)</external-xref> of title 18, United
			 States Code).</text>
				</paragraph></subsection><subsection id="HF3BCC658B1284EC29FE06A44BAAA28A5"><enum>(c)</enum><header>Cooperation with Department of Justice</header><text display-inline="yes-display-inline">To the extent possible, the office established under subsection (a) shall cooperate with the Child
			 Exploitation and Obscenity Section of the Department of Justice and the
			 Innocence Lost National Initiative of the Federal Bureau of Investigation.</text>
			</subsection><subsection id="H6BCBFB5196E64502A6AD41C4AE0251FA"><enum>(d)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this Act, the Secretary of the Treasury
			 shall report to the Committee on Ways and Means of the House of
			 Representatives and the Committee on Finance of the Senate on the
			 enforcement activities of the office established under subsection (a) and
			 shall include any recommendations for statutory changes to assist in
			 future prosecutions pursuant to this section.</text>
			</subsection><subsection id="HB3BD6EFFC166499CAA360266FD8CB4BF"><enum>(e)</enum><header>Applicability of whistleblower awards to victims of human trafficking</header><text display-inline="yes-display-inline">For purposes of making an award under paragraph (1) or (2) of section 7623(b) of the Internal
			 Revenue Code of 1986 with respect to information provided by victims of
			 any person convicted of violating any of the provisions specified in
			 subsection (b), the determination of whether such person is described in
			 such paragraph shall be made without regard to paragraph (3) of section
			 7623(b) of such Code.</text>
			</subsection><subsection id="H2B52502D88364A98B8FE09C13893DEBE"><enum>(f)</enum><header>Authorization of appropriations</header>
				<paragraph id="HAB43F3E8219547E3B817A1360A11DE27"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated not more than $4,000,000 for fiscal year 2015 to carry out
			 subsection (a).</text>
				</paragraph><paragraph id="H0BCB5EB6826544DAB2423ED9D259B0DB"><enum>(2)</enum><header>Additional funding for administration of office</header><text>Unless specifically appropriated otherwise, there is authorized to be appropriated and is
			 appropriated to the office established under subsection (a) for fiscal
			 years 2015 and 2016 for the administration of such office an amount equal
			 to the sum of—</text>
					<subparagraph id="HD2B0924ACE2040AEB51D060876080DFD"><enum>(A)</enum><text>the amount of any tax under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 (including any interest)
			 collected during such fiscal years as the result of the actions of such
			 office, plus</text>
					</subparagraph><subparagraph id="H55193EF677C2481294E6894D40247CFB"><enum>(B)</enum><text>the amount of any civil or criminal monetary penalties imposed under such Code relating to such tax
			 and so collected.</text>
					</subparagraph><continuation-text continuation-text-level="paragraph">Amounts not expended under the preceding sentence shall be transferred to and deposited in the
			 Crime Victims Fund in the Treasury (<external-xref legal-doc="usc" parsable-cite="usc/42/10601">42 U.S.C. 10601</external-xref>).</continuation-text></paragraph></subsection></section><section display-inline="no-display-inline" id="H45E81226EE324A74BAE66CF4C744E74F" section-type="subsequent-section"><enum>3.</enum><header>Increase in criminal monetary penalties</header>
			<subsection id="HD9F66B931CCF431AAC21406AB45F1732"><enum>(a)</enum><header>Attempt To evade or defeat tax</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/7201">Section 7201</external-xref> of the Internal Revenue Code of 1986 (relating to attempt to evade or defeat tax) is
			 amended—</text>
				<paragraph id="HD980D8831F09488CA4539491192661F0"><enum>(1)</enum><text>by striking <quote>Any person</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H97B7A38BB4094EB19FCA9F5AC2C252CF" style="OLC">
						<subsection id="H5E5A7DCB2F4647EBBE1DEB6AFE267D7E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Any person</text></subsection><after-quoted-block>, and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H4C2AA252D97C41AAB449705A782C6E89"><enum>(2)</enum><text>by adding at the end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H3A479DF3017A4D78BA93148F346EA3CA" style="OLC">
						<subsection id="H1064472C46814FDC97F960355BA7E315"><enum>(b)</enum><header>Attempt To evade or defeat tax attributable to human trafficking and commercial sex acts</header>
							<paragraph id="HDAE3701DD69847B380836848D9325F4A"><enum>(1)</enum><header>In general</header><text>In the case of any attempt to evade or defeat any tax attributable to income derived from an act
			 described in paragraph (2), subsection (a) shall be applied—</text>
								<subparagraph id="H413D383EB71C42729B426587E62100F8"><enum>(A)</enum><text>by substituting <quote>$500,000 ($1,000,000</quote> for <quote>$100,000 ($500,000</quote>, and</text>
								</subparagraph><subparagraph id="HC41D160F4F6549948E8EF9B5F5C4D896"><enum>(B)</enum><text>by substituting <quote>10 years</quote> for <quote>5 years</quote>.</text>
								</subparagraph></paragraph><paragraph id="HE6D5DBA192C84794B864349395FF1975"><enum>(2)</enum><header>Human trafficking and commercial sex acts</header><text display-inline="yes-display-inline">For purposes of paragraph (1), an act described in this paragraph is any act which is a violation
			 of any of the provisions specified in section 2(b) of the <short-title>Human Trafficking Fraud Enforcement Act of 2014</short-title>.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H5F147B0873804599B9493F67D675C4E2"><enum>(b)</enum><header>Willful failure To file return, supply information, or pay tax</header>
				<paragraph id="H1BDD69536013489D8FFFA067302E730C"><enum>(1)</enum><header>General increase in monetary penalty</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/7203">Section 7203</external-xref> of the Internal Revenue Code of 1986 (relating to willful failure to file return,
			 supply information, or pay tax) is amended by striking <quote>$25,000</quote> and inserting <quote>$50,000</quote>.</text>
				</paragraph><paragraph id="H3FC61F04937844F5AD24F6CBFD50A540"><enum>(2)</enum><header>Increase in penalties for failure to file with respect to tax attributable to human trafficking and
			 commercial sex acts</header>
					<subparagraph id="H67D21E9D9EF34FA0AC136A6A0E9FDEE3"><enum>(A)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/7203">Section 7203</external-xref> of the Internal Revenue Code of 1986 (relating to willful failure to file return,
			 supply information, or pay tax), as amended by paragraph (1), is amended
			 by striking <quote>Any person</quote> in the first sentence and inserting the following:</text>
						<quoted-block id="H60D1C3A408154E2F9F3E0CD0FAC8F85E" style="OLC">
							<subsection id="HA12593EFEE324198846C139B7E37EC34"><enum>(a)</enum><header>In general</header><text>Any person</text></subsection><after-quoted-block>, and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H524E6AFB481C468FB6ED0D395B887DC2"><enum>(B)</enum><text>by adding at the end the following new subsection:</text>
						<quoted-block id="H5420718E60E746B6B93E7D239FEC5ED9" style="OLC">
							<subsection id="H7D7F0A30C74047D7B398DE0738F4D204"><enum>(b)</enum><header>Failure To file with respect to tax attributable to human trafficking and commercial sex acts</header><text display-inline="yes-display-inline">In the case of any failure with respect to any tax attributable to income derived from an act
			 described in paragraph (2) of section 7201(b), the first sentence of
			 subsection (a) shall be applied by substituting—</text>
								<paragraph id="H18DACCFFB2F54EFB8C11FE0314C60254"><enum>(1)</enum><text><quote>felony</quote> for <quote>misdemeanor</quote>,</text>
								</paragraph><paragraph id="HCA0ED470425A4CAC841791790E33799D"><enum>(2)</enum><text><quote>$500,000 ($1,000,000</quote> for <quote>$50,000 ($100,000</quote>, and</text>
								</paragraph><paragraph id="HEB8DBF4CDD894CEDAA33C0B03455D91A"><enum>(3)</enum><text><quote>10 years</quote> for <quote>1 year</quote>.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H38D7FD70C9874E439A32C1E0C6E830B2"><enum>(3)</enum><header>Conforming amendment</header><text>The third sentence of <external-xref legal-doc="usc" parsable-cite="usc/26/7203">section 7203(a)</external-xref> of the Internal Revenue Code of 1986 (as amended by paragraph
			 (1)) is amended by striking <quote>this section</quote> and inserting <quote>this subsection</quote>.</text>
				</paragraph></subsection><subsection id="H8977D9E4923B4609A92AD82CA9D4ECB0"><enum>(c)</enum><header>Fraud and false statements</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/7206">Section 7206</external-xref> of the Internal Revenue Code of 1986 (relating to fraud and false statements) is
			 amended—</text>
				<paragraph id="H8B5826D940FC414CB28541A09966B3E0"><enum>(1)</enum><text>by striking <quote>Any person</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H47DB4298E8454BFFAC3F3C85A41EA619" style="OLC">
						<subsection id="H1AE41E8032D04D5E914B0DCF2DC747FB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Any person</text></subsection><after-quoted-block>, and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H630D87B8450E4C6782B36DF2D6ED9CE5"><enum>(2)</enum><text>by adding at the end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H1A53FC729C5F46208760E620740EDD53" style="OLC">
						<subsection id="H0D4AADF437AC461CA641AE34BA97EB3E"><enum>(b)</enum><header>Fraud and false statements with respect to tax attributable to human trafficking and commercial sex
			 acts</header><text display-inline="yes-display-inline">In the case of any violation of subsection (a) relating to any tax attributable to income derived
			 from an act described in paragraph (2) of section 7201(b), subsection (a)
			 shall be applied—</text>
							<paragraph id="HDD5C41BB096B4D9D96CD6296AD56095A"><enum>(1)</enum><text>by substituting <quote>$500,000 ($1,000,000</quote> for <quote>$100,000 ($500,000</quote>, and</text>
							</paragraph><paragraph id="H6DC8EEDA31AE4A0C9A840CB46FAEA3CC"><enum>(2)</enum><text>by substituting <quote>5 years</quote> for <quote>3 years</quote>.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H7C5A8F848738473196CEE2CD6DB0FD35"><enum>(d)</enum><header>Penalties may be applied in addition to other penalties</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/7204">Section 7204</external-xref> of the Internal Revenue Code of 1986 (relating to fraudulent statement or failure to
			 make statement to employees) is amended by striking <quote>the penalty provided in section 6674</quote> and inserting <quote>the penalties provided in sections 6674, 7201, and 7203</quote>.</text>
			</subsection><subsection id="H85332FF3E6B84F83B82FB5C03DA237FC"><enum>(e)</enum><header>Increase in monetary limitation for underpayment or overpayment of tax due to fraud</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/7206">Section 7206</external-xref> of the Internal Revenue Code of 1986 (relating to fraud and false statements), as
			 amended by subsection (c), is amended by adding at the end the following
			 new subsection:</text>
				<quoted-block id="HE4CFF65C46FC4CCDAAAD6BF7E0BF72FA" style="OLC">
					<subsection id="H519DB9A37A2C442C804A7697C7F31E7F"><enum>(c)</enum><header>Increase in monetary limitation for underpayment or overpayment of tax due to fraud</header><text>If any portion of any underpayment (as defined in section 6664(a)) or overpayment (as defined in
			 section 6401(a)) of tax required to be shown on a return is attributable
			 to fraudulent action described in subsection (a), the applicable dollar
			 amount under subsection (a) shall in no event be less than an amount equal
			 to such portion. A rule similar to the rule under section 6663(b) shall
			 apply for purposes of determining the portion so attributable.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="H72C01E0374884F7CB847A536A0A9095D"><enum>(f)</enum><header>Moneys available To assist victims of crime</header><text>There are hereby appropriated to the Crime Victims Fund (<external-xref legal-doc="usc" parsable-cite="usc/42/10601">42 U.S.C. 10601</external-xref>) amounts equivalent to the
			 increase in receipts to the Treasury by reason of the amendments made by
			 this section. Such amounts shall be available for victim assistance grants
			 under the Victims of Crime Act of 1984, including crisis intervention,
			 emergency shelter and transportation, counseling, and criminal justice
			 advocacy to victims of crime.</text>
			</subsection><subsection id="H6E80DBDFCBB24523B40A411A3E0E9953"><enum>(g)</enum><header>Effective date</header><text>The amendments made by this section shall apply to actions, and failures to act, occurring after
			 the date of the enactment of this Act.</text>
