<section id="HB0E2DB15F9D24C8A827D8F38BEDF6286" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tick-Borne Disease Research Accountability and Transparency Act of 2014</short-title></quote>.</text></section>
<section id="H91C71383D5E74DDEA6691F0C1E6EB444" commented="no"><enum>2.</enum><header>Lyme disease and other tick-borne diseases</header><text display-inline="no-display-inline">Title III of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/241">42 U.S.C. 241 et seq.</external-xref>) is amended by adding at the end the following new part:</text>

<part id="H2421D23F060B41B99FAFF1448E69ECD9" commented="no"><enum>W</enum><header>Lyme disease and other tick-borne diseases</header>
<section id="HEE27B4EBBF244F1EA5C3113C9F54EFC6" commented="no"><enum>399OO.</enum><header>Research</header>
<subsection id="H54DBE31F2FA449DB821BA65E3FE50618" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall conduct or support epidemiological, basic, translational, and clinical research regarding Lyme disease and other tick-borne diseases.</text></subsection>
<subsection id="HC016E832332D45F78357A3AE078DCB49" commented="no"><enum>(b)</enum><header>Biennial reports</header><text>The Secretary shall ensure that each biennial report under section 403 includes information on actions undertaken by the National Institutes of Health to carry out subsection (a) with respect to Lyme disease and other tick-borne diseases, including an assessment of the progress made in improving the outcomes of Lyme disease and such other tick-borne diseases.</text></subsection></section>
<section id="H62DA6DFA0C3D4F41BA5BDF42E8F6E6AF" commented="no"><enum>399OO–1.</enum><header>Working Group</header>
<subsection id="HA2F8871F8E8B41C1ACD0484C6E483413" commented="no"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish a permanent working group, to be known as the Interagency Lyme and Tick-Borne Disease Working Group (in this section and section 399OO–2 referred to as the <quote>Working Group</quote>), to review all efforts within the Department of Health and Human Services concerning Lyme disease and other tick-borne diseases to ensure interagency coordination, minimize overlap, and examine research priorities.</text></subsection>
<subsection id="HEF8B7F08F7A847E7BC9E0FBA9E0191BE" commented="no"><enum>(b)</enum><header>Responsibilities</header><text>The Working Group shall—</text>
<paragraph id="H7ACDA68324C24AEA81AA8B01E48C8521" commented="no"><enum>(1)</enum><text>not later than 24 months after the date of enactment of this part, and every 24 months thereafter, develop or update a summary of—</text>
<subparagraph id="H9337A9493FFD4DE38FE8FA4C9C29661F" commented="no"><enum>(A)</enum><text>ongoing Lyme disease and other tick-borne disease research related to causes, prevention, treatment, surveillance, diagnosis, duration of illness, intervention, and access to services and supports for individuals with Lyme disease or other tick-borne diseases;</text></subparagraph>
<subparagraph id="H7952574A451A4A829BE72E9C26B9A4D4" commented="no"><enum>(B)</enum><text>advances made pursuant to such research;</text></subparagraph>
<subparagraph id="H4A1F6DD8B7F2464E8F0BF32B0FAEB6F2" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">the engagement of the Department of Health and Human Services with persons that participate at the public meetings required by paragraph (5); and</text></subparagraph>
<subparagraph id="H75A4680C209C4B3AA4CB79204A9E229F" commented="no"><enum>(D)</enum><text>the comments received by the Working Group at such public meetings and the Secretary’s response to such comments;</text></subparagraph></paragraph>
<paragraph id="HA5C5CF8680ED4919B6A1F2509809612F" commented="no"><enum>(2)</enum><text>ensure that a broad spectrum of scientific viewpoints is represented in each such summary;</text></paragraph>
<paragraph id="H646B7792F4F14F48A1944F1E0EC61B93" commented="no"><enum>(3)</enum><text>monitor Federal activities with respect to Lyme disease and other tick-borne diseases;</text></paragraph>
<paragraph id="H8251CE8E9A714E42BEA18485C69544C9" commented="no"><enum>(4)</enum><text>make recommendations to the Secretary regarding any appropriate changes to such activities; and</text></paragraph>
<paragraph id="H8D2EF14995C141A7BC5085C283A83402" commented="no"><enum>(5)</enum><text>ensure public input by holding annual public meetings that address scientific advances, research questions, surveillance activities, and emerging strains in species of pathogenic organisms.</text></paragraph></subsection>
<subsection id="H7C849D9A3BAA4AECAA9FB533252AA0B3" commented="no"><enum>(c)</enum><header>Membership</header>
<paragraph id="H436FFD04C3F2423A8954C4DC873F1A9B" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Working Group shall be composed of a total of 14 members as follows: </text>
<subparagraph id="H402DC933E4D04408BF24B1027862106E" commented="no"><enum>(A)</enum><header>Federal members</header><text>Seven Federal members, consisting of one or more representatives of each of—</text>
<clause id="H0AB9C78B26F54DDF8D4F498EBECC0EDE" commented="no"><enum>(i)</enum><text>the Office of the Assistant Secretary for Health;</text></clause>
<clause id="H3B9BC8C07A4340ACB08E21114E5E2FEC" commented="no"><enum>(ii)</enum><text>the Food and Drug Administration;</text></clause>
<clause id="HAB3D55EF06F7405F90EE2110F54ED9FD" commented="no"><enum>(iii)</enum><text>the Centers for Disease Control and Prevention;</text></clause>
<clause id="H9FFC7406A32F4E65B0A623603DC3FD7E" commented="no"><enum>(iv)</enum><text>the National Institutes of Health; and</text></clause>
<clause id="HC410ABC6C168474E9C991485A49A560D" commented="no"><enum>(v)</enum><text>such other agencies and offices of the Department of Health and Human Services as the Secretary determines appropriate.</text></clause></subparagraph>
<subparagraph id="H91A31DA634AE4771853A3C30A1F32512" commented="no"><enum>(B)</enum><header>Non-Federal public members</header><text>Seven non-Federal public members, consisting of representatives of the following categories: </text>
<clause id="HF6437621D118423B92092E446CAA6B8B" commented="no"><enum>(i)</enum><text>Physicians and other medical providers with experience in diagnosing and treating Lyme disease and other tick-borne diseases.</text></clause>
<clause id="H286D1940948943E0AC483F947FF0F692" commented="no"><enum>(ii)</enum><text>Scientists or researchers with expertise.</text></clause>
<clause id="HD6BF3A80EFEF4925A32E123EE79BE922" commented="no"><enum>(iii)</enum><text>Patients and their family members.</text></clause>
<clause id="H19D8C8C5B64244DFBC6054155693B28F" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">Nonprofit organizations that advocate for patients with respect to Lyme disease and other tick-borne diseases. </text></clause>
<clause id="H44C813ADE8DB49D5A14D62A20101105D" commented="no"><enum>(v)</enum><text>Other individuals whose expertise is determined by the Secretary to be beneficial to the functioning of the Working Group.</text></clause></subparagraph></paragraph>
<paragraph id="H95E50B0DCBEB4BD2AE0EA4709D780FC3" commented="no"><enum>(2)</enum><header>Appointment</header><text>The members of the Working Group shall be appointed by the Secretary, except that of the non-Federal public members under paragraph (1)(B)—</text>
<subparagraph id="H0452B1DA2B924AD482D10C2174E5084A" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">one shall be appointed by the Speaker of the House of Representatives; and</text></subparagraph>
<subparagraph id="H48540214FE6F47AE845FDE9542AB210D" commented="no"><enum>(B)</enum><text>one shall be appointed by the Majority Leader of the Senate.</text></subparagraph></paragraph>
<paragraph id="H5AF642737BB74C68AF5A19831A4978DE" commented="no"><enum>(3)</enum><header>Diversity of scientific perspectives</header><text display-inline="yes-display-inline">In making appointments under paragraph (2), the Secretary, the Speaker of the House of Representatives, and the Majority Leader of the Senate shall ensure that the non-Federal public members of the Working Group represent a diversity of scientific perspectives.</text></paragraph>
<paragraph id="H8A4BE14608DB4807838C208B03750A16" commented="no"><enum>(4)</enum><header>Terms</header><text>The non-Federal public members of the Working Group shall each be appointed to serve a 4-year term and may be reappointed at the end of such term.</text></paragraph></subsection>
<subsection id="HCB7504733ABA4F82A4D707FDDD446317" commented="no"><enum>(d)</enum><header>Meetings</header><text>The Working Group shall meet as often as necessary, as determined by the Secretary, but not less than twice each year.</text></subsection>
<subsection id="H474FFE789FBE418E8AC0CDD94B54D905" commented="no"><enum>(e)</enum><header>Reporting</header><text display-inline="yes-display-inline">Not later than 24 months after the date of enactment of this part, and every 24 months thereafter, the Working Group—</text>
<paragraph id="H849E96A3BAB24F12B94F6BB3E83CB81A" commented="no"><enum>(1)</enum><text>shall submit a report on its activities, including an up-to-date summary under subsection (b)(1) and any recommendations under subsection (b)(4), to the Secretary, the Committee on Energy and Commerce of the House of Representatives, and the Committee on Health, Education, Labor and Pensions of the Senate;</text></paragraph>
<paragraph id="HC15EF5C9DA8D4B0780DC7E3D7342471D" commented="no"><enum>(2)</enum><text>shall make each such report publicly available on the website of the Department of Health and Human Services; and</text></paragraph>
<paragraph id="H73C56489B9494BB18DE50F3BC550F06C" commented="no"><enum>(3)</enum><text>shall allow any member of the Working Group to include in any such report minority views.</text></paragraph></subsection></section>
<section id="HB9442732A12C495799EC30687E25BA97" commented="no"><enum>399OO–2.</enum><header>Strategic plan</header><text display-inline="no-display-inline">Not later than 3 years after the date of enactment of this section, and every 5 years thereafter, the Secretary shall submit to the Congress a strategic plan, informed by the most recent summary under section 399OO–1(b)(1), for the conduct and support of Lyme disease and tick-borne disease research, including—</text>
<paragraph id="H2D90F5B863644514825E8CA93D7240E3" commented="no"><enum>(1)</enum><text>proposed budgetary requirements;</text></paragraph>
<paragraph id="H92623696FCB343C192B4E7AA90946F02" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">a plan for improving outcomes of Lyme disease and other tick-borne diseases, including progress related to chronic or persistent symptoms and chronic or persistent infection and co-infections;</text></paragraph>
<paragraph id="HD4A3A292FD2A4C4DBB7D3A6128C97FE2" commented="no"><enum>(3)</enum><text>a plan for improving diagnosis, treatment, and prevention;</text></paragraph>
<paragraph id="H0FC87D5AFCE64F0A9B0250F52D8BD8E6" commented="no"><enum>(4)</enum><text>appropriate benchmarks to measure progress on achieving the improvements described in paragraphs (2) and (3); and</text></paragraph>
<paragraph id="HD3123B352782426FA2BFFB05BE7CF7C9" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">a plan to disseminate each summary under section 399OO–1(b)(1) and other relevant information developed by the Working Group to the public, including health care providers, public health departments, and other relevant medical groups.</text></paragraph></section></part><after-quoted-block>.</after-quoted-block></quoted-block></section>
