		<official-title>To amend the Native American Business Development, Trade Promotion, and Tourism Act of 2000 to
			 require the Secretary of Commerce to prepare and submit to Congress a
			 report and recommendations to promote the sustained economic development
			 of Indian tribes and Indian lands.</official-title>

		<section id="H77BD6C5D2E2744F3A6D0ED126366B86C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Indian Country Economic Revitalization Act of 2014</short-title></quote>.</text>
		</section><section id="H529BE48F110E45489CDEFEE20A22E3A8"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph display-inline="no-display-inline" id="H0CBD35E28A764B46A34886ED8471AF6F"><enum>(1)</enum><text display-inline="yes-display-inline">In 2000, the Native American Business Development, Trade Promotion, and Tourism Act (Public Law
			 106–464; <external-xref legal-doc="usc" parsable-cite="usc/25/4301">25 U.S.C. 4301 et seq.</external-xref>) identified the need for the Federal
			 Government to promote long-range economic development of Indian lands.</text>
			</paragraph><paragraph id="H21B0F5BAEFC74002A2435812074F0EA7"><enum>(2)</enum><text display-inline="yes-display-inline">This law established within the Department of Commerce an office to coordinate Federal programs
			 related to Indian economic development, promote the international trade
			 and export of Indian goods and services, and conduct intertribal tourism
			 demonstration projects.</text>
			</paragraph><paragraph id="H18D5C95E0E1941E0AC28FC4C3FE27195"><enum>(3)</enum><text display-inline="yes-display-inline">To have additional impact, this law should be amended to expand Federal support for the economic
			 development of Indian tribes and Indian lands.</text>
			</paragraph><paragraph id="H483AADA452D94321AA2F0C5C86CF07FF"><enum>(4)</enum><text display-inline="yes-display-inline">Recent fiscal priorities of the Federal Government have negatively impacted Indian tribes as well
			 as others due to their dependence upon Federal funds.</text>
			</paragraph><paragraph id="H775F9D0834B14BE1B2A08878B7087CAD"><enum>(5)</enum><text display-inline="yes-display-inline">The Federal Government has a trust responsibility to Indian tribes and should support tribal-owned
			 enterprises and Indian-owned businesses by preparing recommendations for
			 Congress on improved statutory measures that support the development of
			 sustainable tribal economies.</text>
			</paragraph></section><section id="HDE8137771FC741A7977658AB38248893"><enum>3.</enum><header>Report and recommendations to Congress on tribal economic development</header><text display-inline="no-display-inline">The Native American Business Development, Trade Promotion, and Tourism Act of 2000 (Public Law
			 106–464; <external-xref legal-doc="usc" parsable-cite="usc/25/4301">25 U.S.C. 4301 et seq.</external-xref>) is amended—</text>
			<paragraph id="H4989959B39FC40558730BA572D7935CD"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating section 8 as section 9; and</text>
			</paragraph><paragraph id="HCE5922C9EFA944338C37741C0BB3333C"><enum>(2)</enum><text>by inserting after section 7 the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="HCBA5ECBF84BD4D35917D87C9054BA034" style="OLC">
					<section id="HF66B262DCD35459EAC69AEDDECA398D4"><enum>8.</enum><header>Report and recommendations to Congress on tribal economic development</header>
						<subsection id="HE3173F9206B74F84B5DD02F9E3F889C6"><enum>(a)</enum><header>Reporting Requirement</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of the Indian Country Economic Revitalization
			 Act of 2014, and every 3 years thereafter, the Secretary of Commerce shall
			 prepare and submit to the Committee on Natural Resources of the House of
			 Representatives and the Committee on Indian Affairs of the Senate a report
			 and recommendations for promoting the sustained growth of the economies of
			 Indian tribes and Indian lands. In conducting the reports under this
			 section, the Secretary of Commerce shall consult with—</text>
							<paragraph id="HF3A2ACF547434E278CF76F6001A5FE31"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary of the Treasury;</text>
							</paragraph><paragraph id="H0025D1A6D9BB46D19ECE97900B2AA291"><enum>(2)</enum><text>the Secretary of the Interior;</text>
							</paragraph><paragraph id="H8B8053FA1E284C58B0C6390E4F508A9A"><enum>(3)</enum><text>the Secretary of Agriculture;</text>
							</paragraph><paragraph id="H30C8F49E229440F4B5713235F7FFAD4D"><enum>(4)</enum><text display-inline="yes-display-inline">the Administrator of the Small Business Administration;</text>
							</paragraph><paragraph id="H9015183353B04BDEA1113D2D68EC0422"><enum>(5)</enum><text display-inline="yes-display-inline">the Board of Governors of the Federal Reserve System;</text>
							</paragraph><paragraph id="HE5B940164245435AACC6759A4D043C3B"><enum>(6)</enum><text>the heads of other Federal agencies as determined by the Secretary of Commerce;</text>
							</paragraph><paragraph id="HE54CFD259A9C46939DEF5D70DE124A24"><enum>(7)</enum><text>the White House Council on Native American Affairs; and</text>
							</paragraph><paragraph id="H73392F6F5F3347B7BF93308C1E037828"><enum>(8)</enum><text>Indian tribes.</text>
							</paragraph></subsection><subsection id="H9622A723ED094010916E2B75EEA6484A"><enum>(b)</enum><header>Contents of Report</header><text display-inline="yes-display-inline">Each report prepared under subsection (a) shall include the following:</text>
							<paragraph id="HBAB1F966A31442A487502790F8957E64"><enum>(1)</enum><text display-inline="yes-display-inline">Data on Indian business development and employment during the 3-year period immediately preceding
			 the date of the submission of the report, except that the first such
			 report shall include data for the 10-year period immediately preceding the
			 date of the submission of such report. Such data shall include, at a
			 minimum—</text>
								<subparagraph id="HB54353E73A1E4FD7A91399514F3C152B"><enum>(A)</enum><text>data from each decennial census conducted by the Bureau of the Census for the period covered by the
			 report; and</text>
								</subparagraph><subparagraph id="H688B191352A74037AF3FE3423DA8F6C1"><enum>(B)</enum><text>relevant data voluntarily provided by Indian tribes, Indian-owned businesses, and other tribal
			 business entities.</text>
								</subparagraph></paragraph><paragraph id="HDCBF19E232EB4D62A9511FAD03348F85"><enum>(2)</enum><text display-inline="yes-display-inline">An assessment of existing structural advantages and barriers to the economic development of Indian
			 tribes and Indian lands, including an analysis of the economic effect on
			 Indian tribes and Indian lands of the following:</text>
								<subparagraph id="HE8894E5496204B1486A6992AFBF2EC46"><enum>(A)</enum><text display-inline="yes-display-inline">Federal judicial decisions and administrative actions authorizing the application of laws of
			 general applicability to economic development activities occurring on
			 Indian lands, in places with respect to which Congress has not expressly
			 authorized such application.</text>
								</subparagraph><subparagraph id="H087466221A4F4CC69351EBD38D231774"><enum>(B)</enum><text display-inline="yes-display-inline">Federal judicial decisions and actions by the Internal Revenue Service authorizing the taxation of
			 Indian income and economic development activities within Indian lands in
			 places with respect to which Federal law does not expressly authorize such
			 taxation.</text>
								</subparagraph><subparagraph id="H9B657D4155144BCA8620F0ADFBDB5495"><enum>(C)</enum><text display-inline="yes-display-inline">Tax incentives in the Internal Revenue Code of 1986, including wage credits, accelerated
			 depreciation deductions, tax-exempt bonds, and new market tax credits,
			 including an assessment of how additional new tax incentives such as
			 tribal empowerment zones may impact tribal economic development.</text>
								</subparagraph><subparagraph id="HE5097549E210488E936DDFA305019759"><enum>(D)</enum><text>Such other related factors that provide an advantage or barrier to economic development on Indian
			 lands.</text>
								</subparagraph></paragraph><paragraph id="HE38EF1B7E5334E27A1584DFBF41E228D"><enum>(3)</enum><text display-inline="yes-display-inline">Analysis of Indian access to adequate infrastructure, affordable energy, educational opportunities,
			 and investment capital.</text>
							</paragraph><paragraph id="HA2BC9FB83C2644CB8A5F251DEA7CF0B2"><enum>(4)</enum><text display-inline="yes-display-inline">Recommendations to Congress on legislation to strengthen the economies of Indian tribes and Indian
			 lands in areas that include—</text>
								<subparagraph id="H3D36FBA030FB49BDAD30FCEE0E5D7A3E"><enum>(A)</enum><text>regulatory, tax, and trust reform; and</text>
								</subparagraph><subparagraph id="HD3B8766961E0452CBDD277F31B5A7ED5"><enum>(B)</enum><text>other related areas that promote the findings and purposes provided in section 2.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" id="HCC1FC4AEEC074FF5BAE9614B0CC13ED9"><enum>(c)</enum><header>Use of previous studies</header><text display-inline="yes-display-inline">In conducting the studies under this section, the Secretary of Commerce shall consider any
			 appropriate information contained in previous studies and reports, such as
			 the following:</text>
							<paragraph id="H2CD0F309A6884360A6A9FE229727F85E"><enum>(1)</enum><text>The American Indian Policy Review Commission Final Report, dated May 17, 1977.</text>
							</paragraph><paragraph commented="no" id="H84215A1CA358439D9774E9E8BA7335BD"><enum>(2)</enum><text display-inline="yes-display-inline">The Report and Recommendations of the Presidential Commission on Indian Reservation Economies,
			 dated November 1984.</text>
							</paragraph><paragraph id="HC5FF9BECA76B4B3383BC47F9537E49AA"><enum>(3)</enum><text display-inline="yes-display-inline">The Native American Economic Policy Report: Developing Tribal Economies to Create Healthy,
			 Sustainable, and Culturally Vibrant Communities, dated 2007.</text>
