Feasibility study on retraining veterans in cybersecurity.</toc-entry></toc></subsection></section><section id="H2101D5BF98A348AD8A6BBDB2D0A1F0E2"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="H1D61EE866054436B8AA80DAFAC15E047"><enum>(1)</enum><header display-inline="yes-display-inline">Congressional intelligence committees</header><text display-inline="yes-display-inline">The term <term>congressional intelligence committees</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="H912E66ACD212440CACEDD0507D0CFF3A"><enum>(A)</enum><text display-inline="yes-display-inline">the Select Committee on Intelligence of the Senate; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H678617A5D8FE4676878E28D87AFF177F"><enum>(B)</enum><text display-inline="yes-display-inline">the Permanent Select Committee on Intelligence of the House of Representatives.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3BF4B9B6C341484388FFB02D5B4E7B5B"><enum>(2)</enum><header display-inline="yes-display-inline">Intelligence community</header><text display-inline="yes-display-inline">The term <term>intelligence community</term> has the meaning given that term in section 3(4) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003(4)</external-xref>).</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id01175C241A654EB8837AC2E941103BC4"><enum>3.</enum><header>Budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory
			 Pay-As-You-Go-Act of 2010, shall be determined by reference to the latest
			 statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the Senate
			 Budget Committee, provided that such statement has been submitted prior to
			 the vote on passage.</text></section><title id="HEC258A54476A45E5BD08F3F8E4E2D4B6"><enum>I</enum><header>Intelligence activities</header><section id="id113D5EA12BD4431EA50312382E46892E"><enum>101.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Funds are hereby authorized to be appropriated for fiscal year 2015 for the conduct of the
			 intelligence and intelligence-related activities of the following elements
			 of the United States Government:</text><paragraph id="HA3BF9C4286AD40BE9B0FDA1A81361C4C"><enum>(1)</enum><text>The Office of the Director of National Intelligence.</text></paragraph><paragraph id="HF54C3D321B6E497688334B7CCE570E31"><enum>(2)</enum><text>The Central Intelligence Agency.</text></paragraph><paragraph id="HB665CD725A4E483A92D914995636EA38"><enum>(3)</enum><text>The Department of Defense.</text></paragraph><paragraph id="H3D7C8204699F42B49B061C40B72B2E0A"><enum>(4)</enum><text>The Defense Intelligence Agency.</text></paragraph><paragraph id="HC4EB2F9C1EA04EF781B0E0B78FDBF737"><enum>(5)</enum><text>The National Security Agency.</text></paragraph><paragraph id="H4D1E71631C8843CCA3E552E28DC4676A"><enum>(6)</enum><text>The Department of the Army, the Department of the Navy, and the Department of the Air Force.</text></paragraph><paragraph id="H0643598539A5494FBDDCFA785A893E77"><enum>(7)</enum><text>The Coast Guard.</text></paragraph><paragraph id="HB182DC5BD8784C6C96FB5E7EE7FB4489"><enum>(8)</enum><text>The Department of State.</text></paragraph><paragraph id="HFFB5EB18E4D3471FA21A07223B64F39E"><enum>(9)</enum><text>The Department of the Treasury.</text></paragraph><paragraph id="HDFD54A0BE6764E5FA67CC0555AB595AD"><enum>(10)</enum><text>The Department of Energy.</text></paragraph><paragraph id="HE593F73941A943B3998609822D12D268"><enum>(11)</enum><text>The Department of Justice.</text></paragraph><paragraph id="H4FBF4BA050D240599C0ACF4B7E76790A"><enum>(12)</enum><text>The Federal Bureau of Investigation.</text></paragraph><paragraph id="H6A920F5CA7A74AC592F9DA31743BC022"><enum>(13)</enum><text>The Drug Enforcement Administration.</text></paragraph><paragraph id="HB123CCC38E8047728ECE65C7198B6714"><enum>(14)</enum><text>The National Reconnaissance Office.</text></paragraph><paragraph id="HDB4D13847E0F44948A9A7C0B902A697F"><enum>(15)</enum><text>The National Geospatial-Intelligence Agency.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4973B58B02C54CF4A6F7448D2ECE703D"><enum>(16)</enum><text>The Department of Homeland Security.</text></paragraph></section><section id="id4CF700F3A6124A76843834A57E8B4414"><enum>102.</enum><header>Classified Schedule of Authorizations</header><subsection id="HBC60C8C57E754193A4ACEBCFEBBC9682"><enum>(a)</enum><header>Specifications of amounts and personnel levels</header><text display-inline="yes-display-inline">The amounts authorized to be appropriated under section 101 and, subject to section 103, the
			 authorized personnel ceilings as of September 30, 2015, for the conduct of
			 the intelligence activities of the elements listed in paragraphs (1)
			 through (16) of section 101, are those specified in the classified
			 Schedule of Authorizations prepared to accompany the bill H.R. 4681 of the
			 One Hundred Thirteenth Congress.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HF2D995CE46B447B689B104DF854E5300"><enum>(b)</enum><header>Availability of classified Schedule of Authorizations</header><paragraph id="H411391557F804C018708782AFD0F8675"><enum>(1)</enum><header>Availability</header><text>The classified Schedule of Authorizations referred to in subsection (a) shall be made available to
			 the Committee on Appropriations of the Senate, the Committee on
			 Appropriations of the House of Representatives, and to the President.</text></paragraph><paragraph id="H1DFD8C151CCB47EFA48816451BAFF89C"><enum>(2)</enum><header>Distribution by the President</header><text>Subject to paragraph (3), the President shall provide for suitable distribution of the classified
			 Schedule of Authorizations, or of appropriate portions of the Schedule,
			 within the executive branch.</text></paragraph><paragraph id="H3D0D53C9CEA6463D8A02CE178C73016D"><enum>(3)</enum><header>Limits on disclosure</header><text>The President shall not publicly disclose the classified Schedule of Authorizations or any portion
			 of such Schedule except—</text><subparagraph id="HCFCDBA99E7B2486F90398103DD55C3F1"><enum>(A)</enum><text>as provided in section 601(a) of the Implementing Recommendations of the 9/11 Commission Act of
			 2007 (<external-xref legal-doc="usc" parsable-cite="usc/50/3306">50 U.S.C. 3306(a)</external-xref>);</text></subparagraph><subparagraph id="H0375A16CAA0945AD8255BB7DCB9C3890"><enum>(B)</enum><text>to the extent necessary to implement the budget; or</text></subparagraph><subparagraph id="H9AEE0E0419F34753BFA65FF9F23775CE"><enum>(C)</enum><text>as otherwise required by law.</text></subparagraph></paragraph></subsection></section><section id="id9ECCC2BA87564E86A59629F8C2D903A5"><enum>103.</enum><header>Personnel ceiling adjustments</header><subsection id="H1EB381977D334EBEB4AFB86BF9661128"><enum>(a)</enum><header>Authority for increases</header><text display-inline="yes-display-inline">The Director of National Intelligence may authorize employment of civilian personnel in excess of
			 the number authorized for fiscal year 2015 by the classified Schedule of
			 Authorizations referred to in section 102(a) if the Director of National
			 Intelligence determines that such action is necessary to the performance
			 of important intelligence functions, except that the number of personnel
			 employed in excess of the number authorized under such section may not,
			 for any element of the intelligence community, exceed 3 percent of the
			 number of civilian personnel authorized under such Schedule for such
			 element.</text></subsection><subsection id="HCF244DDE75CE4262A211A86375B7A20B"><enum>(b)</enum><header>Treatment of certain personnel</header><text display-inline="yes-display-inline">The Director of National Intelligence shall establish guidelines that govern, for each element of
			 the intelligence community, the treatment under the personnel levels
			 authorized under section 102(a), including any exemption from such
			 personnel levels, of employment or assignment in—</text><paragraph id="HD133651777874B768722718121295089"><enum>(1)</enum><text display-inline="yes-display-inline">a student program, trainee program, or similar program;</text></paragraph><paragraph id="H0A83529C7384485B91AD844B3947333E"><enum>(2)</enum><text>a reserve corps or as a reemployed annuitant; or</text></paragraph><paragraph id="H3FCF71068760463F8AEBA50EDF9AED9C"><enum>(3)</enum><text>details, joint duty, or long term, full-time training.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H771E8459FDDB4FF196B210FB42B7BBBB"><enum>(c)</enum><header>Notice to congressional intelligence committees</header><text>The Director of National Intelligence shall notify the congressional intelligence committees in
			 writing at least 15 days prior to each exercise of an authority described
			 in subsection (a).</text></subsection></section><section id="id7E73B0EEE6974E16A935396253B9B7DC"><enum>104.</enum><header>Intelligence Community Management Account</header><subsection id="HF2C166314F624F018925821F7F52085A"><enum>(a)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated for the Intelligence Community Management Account of the
			 Director of National Intelligence for fiscal year 2015 the sum of
			 $507,400,000. Within such amount, funds identified in the classified
			 Schedule of Authorizations referred to in
			 section 102(a) for advanced research and development shall remain
			 available until September 30, 2016.</text></subsection><subsection id="H28BF48BE8B0A403DA9FCF9C808A0507D"><enum>(b)</enum><header>Authorized personnel levels</header><text display-inline="yes-display-inline">The elements within the Intelligence Community Management Account of the Director of National
			 Intelligence are authorized 794 positions as of September 30, 2015.
			 Personnel serving in such elements may be permanent employees
			 of the Office of the Director of National Intelligence or personnel
			 detailed from other elements of the United States Government.</text></subsection><subsection id="HD68E0EC7619C4FF1AF1F7B1058932948"><enum>(c)</enum><header>Classified authorizations</header><paragraph id="H873A5F63F79446968D9A269FA3A67F68"><enum>(1)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">In addition to amounts authorized to be appropriated for the Intelligence Community Management
			 Account by subsection (a), there are authorized to be appropriated for the
			 Community Management Account for fiscal year 2015 such additional amounts
			 as are specified in the classified Schedule of Authorizations referred to
			 in section 102(a). Such additional amounts for advanced research and
			 development shall remain available until September 30, 2016.</text></paragraph><paragraph id="H255742F9142C426AB05899A374DD9B9B"><enum>(2)</enum><header>Authorization of personnel</header><text display-inline="yes-display-inline">In addition to the personnel authorized by subsection (b) for elements of the Intelligence
			 Community Management Account as of September 30, 2015, there are
			 authorized such additional personnel for the Community Management Account
			 as of that date as are specified in the classified Schedule of
			 Authorizations referred to in section 102(a).</text></paragraph></subsection></section></title><title id="H27FAF07F2C8A4EB2B58EB08AF417D6BA"><enum>II</enum><header>Central Intelligence Agency Retirement and Disability System</header><section id="idD72EC4FA8657411A8753D0357C98B762"><enum>201.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated for the Central Intelligence Agency Retirement and
			 Disability Fund for fiscal year 2015 the sum of $514,000,000.</text></section></title><title id="HE4394D616F1E4AB2B13A5F8B89D463AC"><enum>III</enum><header>General provisions</header><subtitle id="id4DEB8B7993C64E5D9F2D53CDADF16851" style="OLC"><enum>A</enum><header>General Matters</header><section id="id4F25A7FAACC7405E8B50D6A2E5A6DACD"><enum>301.</enum><header>Increase in employee compensation and benefits authorized by law</header><text display-inline="no-display-inline">Appropriations authorized by this Act for salary, pay, retirement, and other benefits for Federal
			 employees may be increased by such additional or supplemental amounts as
			 may be necessary for increases in such compensation or benefits authorized
			 by law.</text></section><section id="idB31B49B46DFD4E7C975112E1D1FA905B"><enum>302.</enum><header>Restriction on conduct of intelligence activities</header><text display-inline="no-display-inline">The authorization of appropriations by this Act shall not be deemed to constitute authority for the
			 conduct of any intelligence activity which is not otherwise authorized by
			 the Constitution or the laws of the United States.</text></section><section id="id7dd8f0e683cb46b0b7dc84a04d3f061f"><enum>303.</enum><header>National intelligence strategy</header><subsection id="id6ac4165bb567410ea51db4e77093805b"><enum>(a)</enum><header>In general</header><text>Title I of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3021">50 U.S.C. 3021 et seq.</external-xref>) is amended by inserting after
			 section 108 the following:</text><quoted-block display-inline="no-display-inline" id="idcae564dbed7b4355b3b658a84a3dc800" style="OLC"><section id="id571b539dbbd046f39b2821f65872abd3"><enum>108A.</enum><header>National intelligence strategy</header><subsection id="id1803abddf84a49aa8ffe9aedf883a8ea"><enum>(a)</enum><header>In general</header><text>Beginning in 2017, and once every 4 years thereafter, the Director of National Intelligence shall
			 develop a comprehensive national intelligence strategy to meet national
			 security objectives for the following 4-year period, or a longer period,
			 if appropriate.</text></subsection><subsection id="id7b9bccd6399840b58888c868cb8f9599"><enum>(b)</enum><header>Requirements</header><text>Each national intelligence strategy required by subsection (a) shall—</text><paragraph id="idb9ef3493d3dd464cbd7afab2fb65a631"><enum>(1)</enum><text>delineate a national intelligence strategy consistent with—</text><subparagraph id="id6f0d69924184491487b995ebaee4a0ab"><enum>(A)</enum><text>the most recent national security strategy report submitted pursuant to section 108;</text></subparagraph><subparagraph id="idcfdd126ddb534c2dab17dde69a1cf172"><enum>(B)</enum><text>the strategic plans of other relevant departments and agencies of the United States; and</text></subparagraph><subparagraph id="id384f4ff9a5a7492e85780dd84257a626"><enum>(C)</enum><text>other relevant national-level plans;</text></subparagraph></paragraph><paragraph id="id29eb265eb4da426a8fdf2030664ba612"><enum>(2)</enum><text>address matters related to national and military intelligence, including counterintelligence;</text></paragraph><paragraph id="ide731934eb5d74e3091604b63b80b5335"><enum>(3)</enum><text>identify the major national security missions that the intelligence community is currently pursuing
			 and will pursue in the future to meet the anticipated security
			 environment;</text></paragraph><paragraph id="id87c4a25faf4440f29db5b03cd1526423"><enum>(4)</enum><text>describe how the intelligence community will utilize personnel, technology, partnerships, and other
			 capabilities to pursue the major national security missions identified in
			 paragraph (3);</text></paragraph><paragraph id="idf156230342b34845be828800cf2b80ab"><enum>(5)</enum><text>assess current, emerging, and future threats to the intelligence community, including threats from
			 foreign intelligence and security services and insider threats;</text></paragraph><paragraph id="id4096ae8e6cb84175b52a47e4323edd73"><enum>(6)</enum><text>outline the organizational roles and missions of the elements of the intelligence community as part
			 of an integrated enterprise to meet customer demands for intelligence
			 products, services, and support;</text></paragraph><paragraph id="id19ed6732a741401489f3c8c969210cc2"><enum>(7)</enum><text>identify sources of strategic, institutional, programmatic, fiscal, and technological risk; and</text></paragraph><paragraph id="id5457b9379f78436da702ca18403280cc"><enum>(8)</enum><text>analyze factors that may affect the intelligence community’s performance in pursuing the major
			 national security missions identified in paragraph (3) during the
			 following 10-year period.</text></paragraph></subsection><subsection id="idba0d1171efe04d9f8e829cccb9bd29a8"><enum>(c)</enum><header>Submission to Congress</header><text>The Director of National Intelligence shall submit to the congressional intelligence committees a
			 report on each national intelligence strategy
			 required by subsection (a)  not
			 later than 45 days after the date of the completion of such strategy.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id3b7a011471ae40f2a8ec8da41f3e92d1"><enum>(b)</enum><header>Table of contents amendments</header><text>The table of contents in the first section of the National Security Act of 1947 is amended by
			 inserting after the item relating to section 108 the following new item:</text><quoted-block display-inline="no-display-inline" id="idB205E04DB6A3448B98D6EB8F2CD008DB" style="OLC"><toc><toc-entry idref="id571b539dbbd046f39b2821f65872abd3" level="section">Sec. 108A. National intelligence strategy.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" id="H03F642A9515C4C61AFA67B045D6AEDCA"><enum>304.</enum><header>Software licensing</header><text display-inline="no-display-inline">Section 109 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3044">50 U.S.C. 3044</external-xref>) is amended—</text><paragraph id="HD8A94C4D5B7C42B9A7701B92D306513A"><enum>(1)</enum><text>in subsection (a)(2), by striking <quote>usage; and</quote> and inserting</text><quoted-block display-inline="yes-display-inline" id="H3F19C37E50C84D8DA67F6573E8858C07" style="OLC"><text>usage, including—</text><subparagraph display-inline="no-display-inline" id="HEFE630AEB6324FC296C28887E67EC723"><enum>(A)</enum><text display-inline="yes-display-inline">increasing the centralization of the management of software licenses;</text></subparagraph><subparagraph id="HA785FD07192F4D259242F61A1C19F4D4"><enum>(B)</enum><text>increasing the regular tracking and maintaining of comprehensive inventories of software licenses
			 using automated discovery and inventory tools and metrics;</text></subparagraph><subparagraph id="H42648C4D42F5442C90B4E5D9A64AF9CC"><enum>(C)</enum><text>analyzing software license data to inform investment decisions; and</text></subparagraph><subparagraph id="H1B6FD865D26C48719EEA3B04945DDF41"><enum>(D)</enum><text>providing appropriate personnel with sufficient software licenses management training; and</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HFB0F4607C5DD414BA5E50B82B69C66B5"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="H3FA412F423984DA292B0770F2DACE781"><enum>(A)</enum><text>in paragraph (1), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="H9017F0FD64B344C3BBB91EB4A3F26D9E"><enum>(B)</enum><text>in paragraph (2), by striking <quote>usage.</quote> and inserting</text><quoted-block display-inline="yes-display-inline" id="H7DD5F1B3B08546DD9E62B04822D9D7EB" style="OLC"><text>usage, including—</text><subparagraph display-inline="no-display-inline" id="H7CCC21674EE542DFA891994FC3E3F962"><enum>(A)</enum><text display-inline="yes-display-inline">increasing the centralization of the management of software licenses;</text></subparagraph><subparagraph id="H5B0CFF36080641D1B1B4AE4E3D01EB91"><enum>(B)</enum><text>increasing the regular tracking and maintaining of comprehensive inventories of software licenses
			 using automated discovery and inventory tools and metrics;</text></subparagraph><subparagraph id="HA35648B896A2449CB1246F0660709625"><enum>(C)</enum><text>analyzing software license data to inform investment decisions; and</text></subparagraph><subparagraph id="H940C12B8278F4EA39E2328888CB793CD"><enum>(D)</enum><text>providing appropriate personnel with sufficient software licenses management training; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H827F4D0C4836490F91A514BC574F1490"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="HCE328DD9802544CAA1DFA1799B0ED52A" style="OLC"><paragraph id="HFA1FDF109ED347E9AD813D5443BE877C"><enum>(3)</enum><text display-inline="yes-display-inline">based on the assessment required under paragraph (2), make such recommendations with respect to
			 software procurement and usage to the Director of National Intelligence as
			 the Chief Information Officer considers appropriate.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HA78FEA4D1AD34913A38C24D78EEA412D"><enum>(3)</enum><text>by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="HAE859EFBF1A24251BA4F4BCE5DCDA1A0" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="H878681210ACF4F989C4A279488D70B15"><enum>(d)</enum><header>Implementation of recommendations</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which the Director of National Intelligence receives
			 recommendations from the Chief Information Officer of the Intelligence
			 Community in accordance with subsection (b)(3), the Director of National
			 Intelligence shall, to the extent practicable, issue guidelines for the
			 intelligence community on software procurement and usage based on such
			 recommendations.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H9C2823E9F9F947C2B42C00C8325A63A7"><enum>305.</enum><header>Reporting of certain employment activities by former intelligence officers and employees</header><subsection id="H3501B087AFCB45DFB94E6F331B34068D"><enum>(a)</enum><header>Restriction</header><text display-inline="yes-display-inline">Title III of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3071">50 U.S.C. 3071 et seq.</external-xref>) is amended by inserting
			 after section 303 the following new section:</text><quoted-block display-inline="no-display-inline" id="HE121570CE3E444FBAF84001179329F2F" style="OLC"><section id="H58ED1C63BF4C48508BFE0E58BFBC7778"><enum>304.</enum><header>Reporting of certain employment activities by former intelligence officers and employees</header><subsection commented="no" id="H867D0132DB864F859772D05CBCF37F02"><enum>(a)</enum><header>In General</header><text>The head of each element of the intelligence community shall issue regulations requiring each
			 employee of such element occupying a covered position to sign a written
			 agreement requiring the regular reporting of covered employment to the
			 head of such element.</text></subsection><subsection commented="no" id="H954CCD2BCAE4490C98BEDC4EACFCF632"><enum>(b)</enum><header>Agreement Elements</header><text display-inline="yes-display-inline">The regulations required under subsection (a) shall provide that an agreement contain provisions
			 requiring each employee occupying a covered position to, during the
			 two-year period beginning on the date on which such employee ceases to
			 occupy such covered position—</text><paragraph id="H22B50E82E1EF48E1A76234591A06324E"><enum>(1)</enum><text>report covered employment to the head of the element of the intelligence community that employed
			 such employee in such covered position upon accepting such covered
			 employment; and</text></paragraph><paragraph id="H5E996368EF114BC6B10D2572331E70B3"><enum>(2)</enum><text>annually (or more frequently if the head of such element considers it appropriate) report covered
			 employment to the head of such element.</text></paragraph></subsection><subsection id="H2E7311147ACE4B3C8847CCAFEB27DF6B"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H160B7FEF2BBE4D199E4A3222000C6A97"><enum>(1)</enum><header>Covered employment</header><text display-inline="yes-display-inline">The term <quote>covered employment</quote> means direct employment by, representation of, or the provision of advice relating to national
			 security to the government of a foreign country or any person whose
			 activities are directly or indirectly supervised, directed, controlled,
			 financed, or subsidized, in whole or in major part, by any government of a
			 foreign country.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H38FC4E12DF26441DBBD658108B682D8D"><enum>(2)</enum><header>Covered position</header><text display-inline="yes-display-inline">The term <quote>covered position</quote> means a position within an element of the intelligence community that, based on the level of
			 access of a person occupying such position to information regarding
			 sensitive intelligence sources or methods or other exceptionally sensitive
			 matters, the head of such element determines should be subject to the
			 requirements of this section.</text></paragraph><paragraph id="H1A89EC0FFF33486C97B4F820001EE13F"><enum>(3)</enum><header>Government of a foreign country</header><text>The term <quote>government of a foreign country</quote> has the meaning given the term in section 1(e) of the Foreign Agents Registration Act of 1938 (22
			 U.S.C. 611(e)).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3D07F73507AB42F9A0032AFC5AD2BAA9"><enum>(b)</enum><header>Regulations and certification</header><paragraph id="HF9E8C055FAA2422195137AC665BA56C4"><enum>(1)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the head of each element of the
			 intelligence community shall issue the regulations required under section
			 304 of the National Security Act of 1947, as added by subsection (a) of
			 this section.</text></paragraph><paragraph id="H5B67B760F8664342AE84E01DFDEAAF3D"><enum>(2)</enum><header>Certification</header><text>Not later than 180 days after the date of the enactment of this Act, the Director of National
			 Intelligence shall submit to the congressional intelligence committees—</text><subparagraph id="H038F4B8F437E4309BDF3094BAD673508"><enum>(A)</enum><text>a certification that each head of an element of the intelligence community has prescribed the
			 regulations required under section 304 of the National Security Act of
			 1947, as added by subsection (a) of this section; or</text></subparagraph><subparagraph id="H726444E7B58E4E658696C3E791E6642E"><enum>(B)</enum><text>if the Director is unable to submit the certification described under subparagraph (A), an
			 explanation as to why the Director is unable to submit such certification,
			 including a designation of which heads of an element of the intelligence
			 community have prescribed the regulations required under such section 304
			 and which have not.</text></subparagraph></paragraph></subsection><subsection id="H9EB1CBF5525948DFA9CD2696336E9A5F"><enum>(c)</enum><header>Table of contents amendments</header><text>The table of contents in the first section of the National Security Act of 1947 is amended—</text><paragraph id="H01271E80A75D46C3B7E4B26127921F35"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the second item relating to section 302 (Under Secretaries and Assistant Secretaries)
			 and the items relating to sections 304, 305, and 306; and</text></paragraph><paragraph id="H23BF591283794CB381039B06A6390E36"><enum>(2)</enum><text>by inserting after the item relating to section 303 the following new item:</text><quoted-block display-inline="no-display-inline" id="H845EC357F8AF4A9F92FC7642154E1439" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 304. Reporting of certain employment activities by former intelligence officers and employees.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section commented="no" id="HA95FABEBE0534AC79C9506D07FCCD662"><enum>306.</enum><header>Inclusion of Predominantly Black Institutions in intelligence officer training program</header><text display-inline="no-display-inline">Section 1024 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3224">50 U.S.C. 3224</external-xref>) is amended—</text><paragraph commented="no" id="HE074F0F5B5AA488FA6723C787DC700AB"><enum>(1)</enum><text>in subsection (c)(1), by inserting <quote>and Predominantly Black Institutions</quote> after <quote>universities</quote>; and</text></paragraph><paragraph commented="no" id="HC5D717B23E9A498087CBD62113816E91"><enum>(2)</enum><text>in subsection (g)—</text><subparagraph commented="no" id="HDA5C0E2890374418AE990CCE54B1CF4C"><enum>(A)</enum><text>by redesignating paragraph (4) as paragraph (5); and</text></subparagraph><subparagraph commented="no" id="HFC07694684BC44A98C5043C6F6633DD8"><enum>(B)</enum><text>by inserting after paragraph (3) the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H0756D89C3ED0487B926E62A921E2DEAB" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="HEA0862F3318A4F9AB82F382E8B0BF697"><enum>(4)</enum><header>Predominantly Black Institution</header><text display-inline="yes-display-inline">The term <quote>Predominantly Black Institution</quote> has the meaning given the term in section 318 of the Higher education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059e">20 U.S.C. 1059e</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="id9A5DEA1F509D4609BC72F288BDB4D34A"><enum>307.</enum><header>Management and oversight of financial intelligence</header><subsection id="id600dc5db870e4780a20fb6e44b4af451"><enum>(a)</enum><header>Requirement for plan</header><text>Not later than 90 days after the date of the enactment of this Act, the Director of National
			 Intelligence shall prepare a
			 plan for management of the elements of the intelligence community that
			 carry out financial intelligence activities.</text></subsection><subsection id="idFBF2F0C88D2C41F4887503B798412FA5"><enum>(b)</enum><header>Contents of plan</header><text>The plan required by subsection (a) shall establish a governance framework, procedures for sharing
			 and harmonizing the acquisition and use of financial analytic tools,
			 standards for quality of analytic products,  procedures for oversight and
			 evaluation of resource allocations associated with the joint development
			 of information sharing efforts and tools,
			 and an education and training
			 model for elements of the intelligence community that carry out financial
			 intelligence activities.</text></subsection><subsection id="idb6b9fd4b7a974802a72ba07783ed9e56"><enum>(c)</enum><header>Briefing to Congress</header><text>Not later than 180 days after the date of the enactment of this Act, the Director of National
			 Intelligence shall brief the congressional intelligence committees on the
			 actions the Director proposes to implement the plan required by subsection
			 (a).</text></subsection></section><section id="idB97A52F29F7A426F9DD12CB6610E78C9"><enum>308.</enum><header>Analysis of private sector policies and procedures for countering insider threats</header><subsection id="ida9016601a3f54733af57b528254d2a00"><enum>(a)</enum><header>Analysis</header><text>Not later than 180 days after the date of the enactment of this Act, the Director of National
			 Intelligence, in consultation with the National Counterintelligence
			 Executive, shall submit to the congressional intelligence committees an
			 analysis of private sector policies and procedures for countering insider
			 threats.</text></subsection><subsection id="id2775747eaa0c4389967a5ee651c65705"><enum>(b)</enum><header>Content</header><text>The analysis required by subsection (a) shall include—</text><paragraph id="id3d94268ee78742af88aa471272ab7393"><enum>(1)</enum><text>a review of whether and how the intelligence community could utilize private sector hiring and
			 human
			 resources best practices to screen, vet, and validate the credentials,
			 capabilities, and character of applicants for positions involving trusted
			 access to sensitive information;</text></paragraph><paragraph id="id4f6883d57b174512a25a2ac11da41c02"><enum>(2)</enum><text>an analysis of private sector policies for holding supervisors and subordinates accountable for
			 violations of established security protocols and whether the intelligence
			 community should adopt similar policies for positions of trusted access to
			 sensitive information;</text></paragraph><paragraph commented="no" id="idb0c2baf1b06b47b0b8c53c524822ab62"><enum>(3)</enum><text>an assessment of the feasibility and advisability of applying mandatory leave policies, similar to
			 those endorsed by
			 the Federal Deposit Insurance Corporation and the Securities and Exchange
			 Commission to identify fraud in the financial services industry, to
			 certain positions within the intelligence community; and</text></paragraph><paragraph commented="no" id="id2c37f402c84744c1bf82569183b70d0c"><enum>(4)</enum><text>recommendations for how the intelligence community could utilize private sector risk indices, such
			 as credit risk scores, to make determinations about employee access to
			 sensitive information.</text></paragraph></subsection></section><section commented="no" id="idA01B0EB4E614457B970E0003644C2199"><enum>309.</enum><header>Procedures for
			 the retention of incidentally acquired communications</header><subsection commented="no" id="id5cd3d044cce3494cbbbf70c80924f20f"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text><paragraph commented="no" id="id3c78b3a5fca24e7f9e98c755a8f8d25d"><enum>(1)</enum><header>Covered
			 communication</header><text>The term <term>covered communication</term> means
			 any nonpublic telephone or electronic communication acquired without the
			 consent of a person who is a party to the communication, including
			 communications in electronic storage.</text></paragraph><paragraph commented="no" id="idbc5b58d1bf0a4d029e6b7fd77b86a809"><enum>(2)</enum><header>Head of an
			 element of the intelligence community</header><text>The term <term>head of an
			 element of the intelligence community</term> means, as appropriate—</text><subparagraph commented="no" id="iddf978d5b5f5f438eaa08c5673681c772"><enum>(A)</enum><text>the head of an
			 element of the intelligence community; or</text></subparagraph><subparagraph commented="no" id="id24fbc0f491b14b188314f44fd9dd539a"><enum>(B)</enum><text>the head of the
			 department or agency containing such element.</text></subparagraph></paragraph><paragraph commented="no" id="id1e30be8660824e339a6efaf61aafaa43"><enum>(3)</enum><header>United States
			 person</header><text>The term <term>United States person</term> has the meaning
			 given that term in section 101 of the Foreign Intelligence Surveillance
			 Act of
			 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801</external-xref>).</text></paragraph></subsection><subsection commented="no" id="id4190f20e7cef48a3a50ae551c60a0bc9"><enum>(b)</enum><header>Procedures for
			 covered communications</header><paragraph commented="no" id="idfefca03ac70047ffbdd38dc594a41f06"><enum>(1)</enum><header>Requirement to
			 adopt</header><text>Not later than 2 years after the date of the enactment of
			 this Act each head of an element of the intelligence community shall adopt
			 procedures approved by the Attorney General for such element that ensure
			 compliance with the requirements of paragraph (3).</text></paragraph><paragraph commented="no" id="id8f9afb6a2f4b43459cd248b4d4d27cb1"><enum>(2)</enum><header>Coordination
			 and approval</header><text>The procedures required by paragraph (1) shall
			 be—</text><subparagraph commented="no" id="id703bd200085040d98dbfa246ec4ad866"><enum>(A)</enum><text>prepared in
			 coordination with the Director of National Intelligence; and</text></subparagraph><subparagraph commented="no" id="id2cccb8d62ca648269632e31f42cc3b12"><enum>(B)</enum><text>approved by the
			 Attorney General prior to issuance.</text></subparagraph></paragraph><paragraph commented="no" id="id2d20b8d2406d454380867f44cb2bfb30"><enum>(3)</enum><header>Procedures</header><subparagraph commented="no" id="id8475469632D3493281B962D4B7FE3705"><enum>(A)</enum><header>Application</header><text>The
			 procedures required by paragraph (1) shall apply to any intelligence
			 collection
			 activity not otherwise
			 authorized by court order (including an order or certification issued by a
			 court
			 established under subsection (a) or (b) of section 103 of the Foreign
			 Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803</external-xref>)),  subpoena, or
			 similar legal process that is reasonably anticipated to result in the
			 acquisition of a covered communication to or from a United States person
			 and shall permit the acquisition, retention, and dissemination of covered
			 communications subject to the limitation in subparagraph (B).</text></subparagraph><subparagraph commented="no" id="id2b645e0153d4462982ebedbf70b88ace"><enum>(B)</enum><header>Limitation on retention</header><text>A
			 covered communication shall not be retained in excess of
			 5 years, unless—</text><clause commented="no" id="id80f67d4055a648a7a34c7cadd82234f8"><enum>(i)</enum><text>the
			 communication has been affirmatively determined, in whole or in part, to
			 constitute foreign intelligence or counterintelligence or is necessary to
			 understand or assess foreign intelligence or counterintelligence;</text></clause><clause commented="no" id="id9b09a8e65d8848f9a473b984c90ac643"><enum>(ii)</enum><text>the communication is reasonably believed to constitute evidence of a crime and is retained by a law
			 enforcement agency;</text></clause><clause commented="no" id="idd706fdc345b24c8290d875a91150f648"><enum>(iii)</enum><text>the communication is enciphered or reasonably believed to have a secret meaning;</text></clause><clause commented="no" id="idf9a73060e80e41d78f6e58b5f5f8316b"><enum>(iv)</enum><text>all parties to
			 the communication are reasonably believed to be non-United States persons;</text></clause><clause commented="no" id="idd5b0d34f470a431dbd1fe3629f82e994"><enum>(v)</enum><text>retention is
			 necessary to protect against an imminent threat to human life, in which
			 case
			 both the nature of the threat and the information to be retained shall be
			 reported to the congressional intelligence committees not later than 30
			 days
			 after the date such retention is extended under this clause;</text></clause><clause commented="no" id="id393a26c5d9394918bfcd66fa19c7fa79"><enum>(vi)</enum><text>retention is
			 necessary for technical assurance or compliance purposes, including a
			 court order or discovery obligation, in which case
			 access
			 to information retained for technical assurance or compliance purposes
			 shall be
			 reported to the congressional intelligence committees on an annual basis;
			 or</text></clause><clause commented="no" id="id47f15bf98ccc42cbbcf64c10c54fbe50"><enum>(vii)</enum><text>retention for a
			 period in excess of 5 years is approved by the head of the element of the
			 intelligence community responsible for such retention, based on a
			 determination that retention is necessary to
			 protect the national security of the United States, in which case the head
			 of such  element shall
			 provide to the congressional intelligence committees a written
			 certification describing—</text><subclause commented="no" id="idc510a3dcd7dd45f09b730e4283346255"><enum>(I)</enum><text>the reasons
			 extended retention is necessary to protect the national security of the
			 United
			 States;</text></subclause><subclause commented="no" id="idfa7dafe38d26476b80fb534a92f47369"><enum>(II)</enum><text>the duration for which the head of the element is authorizing retention;</text></subclause><subclause commented="no" id="id7aff931d74ae499690b99088fe395a9b"><enum>(III)</enum><text>the particular
			 information to be retained; and</text></subclause><subclause commented="no" id="idf6ef28c215024a07a06ac20dd5d12fdc"><enum>(IV)</enum><text>the measures
			 the element of the intelligence community is taking to protect the privacy
			 interests of United States persons or persons located inside the United
			 States.</text></subclause></clause></subparagraph></paragraph></subsection></section><section id="id24769424b9984a679b411f7214e4ea2f"><enum>310.</enum><header>Clarification of limitation of review to retaliatory security clearance or access determinations</header><text display-inline="no-display-inline">Section 3001(b)(7) of the Intelligence Reform and Terrorism Prevention Act of 2004 (50 U.S.C.
			 3341(b)(7)) is amended—</text><paragraph id="id1893ba85564544c5a8845f2e76159fb7"><enum>(1)</enum><text>in the matter preceding subparagraph (A), by striking <quote>2014—</quote> and inserting <quote>2014, and consistent with subsection (j)—</quote>;</text></paragraph><paragraph id="idA58F906869304179B8778CEAE868F758"><enum>(2)</enum><text>in subparagraph (A), by striking <quote>to appeal a determination to suspend or revoke a security clearance or access to classified
			 information</quote>  and inserting <quote>alleging reprisal for having made a protected disclosure (provided the individual does not disclose
			 classified information or other information contrary to law) to appeal any
			 action affecting an employee’s access to classified information</quote>; and</text></paragraph><paragraph id="id07F4BC648CE648BB881B907D9CEBBE4B"><enum>(3)</enum><text>in subparagraph (B), by striking <quote>information,</quote> inserting <quote>information following a protected disclosure,</quote>.</text></paragraph></section><section commented="no" id="idDC772BF8108142D6AF54B247F723FBEB"><enum>311.</enum><header>Feasibility study on consolidating classified databases of cyber threat indicators and malware
			 samples</header><subsection commented="no" id="idE925A9E90F5344C2A63BF9C67FFEC8F5"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Director of National
			 Intelligence, in consultation with the Secretary of Homeland Security, the
			 Director of the National Security Agency, the Director of the Central
			 Intelligence Agency, and the Director of the Federal Bureau of
			 Investigation, shall conduct a feasibility study on consolidating
			 classified databases of cyber threat indicators and malware samples in the
			 intelligence
			 community.</text></subsection><subsection commented="no" id="idE6E9850D650746169144C7DF577E5A2F"><enum>(b)</enum><header>Elements</header><text>The feasibility study required by subsection (a) shall include the following:</text><paragraph commented="no" id="idF1C70EF5B9FD4A0BB4560B51E0796BFE"><enum>(1)</enum><text>An inventory of classified databases of cyber threat indicators and malware samples in the
			 intelligence
			 community.</text></paragraph><paragraph commented="no" id="id8464D08B7640424485A30EB500277E41"><enum>(2)</enum><text>An assessment of actions that could be carried out to consolidate such databases to achieve the
			 greatest possible information sharing within the intelligence community
			 and cost savings for the Federal Government.</text></paragraph><paragraph commented="no" id="idD60AA003DB834B51843C176E12AC8C51"><enum>(3)</enum><text>An assessment of any impediments to such consolidation.</text></paragraph><paragraph commented="no" id="idC5E4A1186FE340BF8A5EE8BAB2D37652"><enum>(4)</enum><text>An assessment of whether the Intelligence Community Information Technology Enterprise can support
			 such consolidation.</text></paragraph></subsection><subsection commented="no" id="id4AE04DA69C964D77982388BA6072C539"><enum>(c)</enum><header>Report to Congress</header><text>Not later than 30 days after the date on which the Director of National Intelligence completes the
			 feasibility study required by subsection (a), the Director shall submit to
			 the
			 congressional intelligence committees a written report that summarizes the
			 feasibility study, including the information required under subsection
			 (b).</text></subsection></section><section commented="no" id="HC8808302347C" section-type="subsequent-section"><enum>312.</enum><header>Sense of Congress on cybersecurity threat and cybercrime cooperation with Ukraine</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph commented="no" id="id3c06dc3f86eb4c3697f84d5ac52e29e4"><enum>(1)</enum><text>cooperation between the intelligence and law enforcement agencies of the United States and Ukraine
			 should be increased to improve cybersecurity policies between these two
			 countries;</text></paragraph><paragraph commented="no" id="id3e38c61fe6ab4f8889f6549b3f8a38ee"><enum>(2)</enum><text>the United States should pursue improved extradition procedures among the Governments of the United
			 States, Ukraine, and other countries  from which cybercriminals target
			 United States citizens and entities;</text></paragraph><paragraph commented="no" id="idf196518b5c7c41bfaf026629975cd36b"><enum>(3)</enum><text>the President should—</text><subparagraph commented="no" id="id107DD56F351D4650AC7704067F41F1E9"><enum>(A)</enum><text>initiate a round of formal United States-Ukraine bilateral talks on cybersecurity threat and
			 cybercrime
			 cooperation, with additional multilateral talks that include other law
			 enforcement partners such as Europol and Interpol; and</text></subparagraph><subparagraph commented="no" id="idBA559BBB47C74D15A84BFF8A97004297"><enum>(B)</enum><text>work to obtain a commitment from the Government of Ukraine to end cybercrime directed at persons
			 outside Ukraine  and to work with the
			 United States and other allies to deter and convict known cybercriminals;</text></subparagraph></paragraph><paragraph commented="no" id="id0708de0b11634f9da4ccfa205b972ef1"><enum>(4)</enum><text>the President should establish a capacity building program with the Government of Ukraine, which
			 could include—</text><subparagraph commented="no" id="id2ff6a3066a784581a467331bcd1dfbc9"><enum>(A)</enum><text>a joint effort to improve cyber capacity building, including intelligence and law enforcement
			 services in Ukraine;</text></subparagraph><subparagraph commented="no" id="id7c4fc777b3984cc5ba7848b347231f3d"><enum>(B)</enum><text>sending United States law enforcement agents to aid law enforcement agencies in Ukraine in
			 investigating cybercrimes; and</text></subparagraph><subparagraph commented="no" id="id5358518e0aac4825a41a97d62256b529"><enum>(C)</enum><text>agreements to improve communications networks to enhance law enforcement cooperation, such as a
			 hotline directly connecting law enforcement agencies in the United States
			 and Ukraine; and</text></subparagraph></paragraph><paragraph commented="no" id="id56a7b02549a942c481979742225531be"><enum>(5)</enum><text>the President should establish and maintain an intelligence and law enforcement cooperation
			 scorecard with metrics designed to measure the number of instances that
			 intelligence and law enforcement agencies in the United States request
			 assistance from intelligence and law enforcement agencies in Ukraine and
			 the number and type of responses received to such requests.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id5D1FB9DB06554BED8AD1EADB1348AADB" section-type="subsequent-section"><enum>313.</enum><header display-inline="yes-display-inline">Replacement of	locally employed staff serving at United States diplomatic facilities in
			 the Russian Federation</header><subsection commented="no" display-inline="no-display-inline" id="id4A66BB83952945B2B24B24182C099308"><enum>(a)</enum><header display-inline="yes-display-inline">Employment requirement</header><paragraph commented="no" display-inline="no-display-inline" id="id8D52085531F7419C983DB643DEE72DBB"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of State shall ensure that, not later than one year after the date of the enactment
			 of
			 this Act, every supervisory position at a United States diplomatic
			 facility in the Russian Federation shall be occupied by a citizen of the 
			 United States who has passed, and shall be
			 subject to, a thorough background check.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id528E35EABEAB4FB5BD7E56F37FFA4DEA"><enum>(2)</enum><header>Extension</header><text>The Secretary of State may extend the deadline under paragraph (1) for up to one year by providing
			 advance written notification and justification of such extension to the
			 appropriate
			 congressional
			 committees.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4AE529BB675A489688DE60D0A14DC12D"><enum>(3)</enum><header>Progress report</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of State shall
			 submit to the appropriate congressional committees a report on progress
			 made toward meeting  the employment  requirement under paragraph (1).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3C6665B316B741A6BB3660249F350A8D"><enum>(b)</enum><header>Plan for reduced use of locally employed staff</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of State, in
			 coordination with other appropriate government agencies, shall submit to
			 the appropriate congressional committees a plan to
			 further reduce the reliance on locally employed staff in United States
			 diplomatic facilities in the Russian Federation.  The plan shall, at a
			 minimum, include cost estimates, timelines, and numbers of employees to be
			 replaced.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idEEF33A4580584B49A613FF0AF4D3AAC5"><enum>(c)</enum><header>Appropriate congressional committees defined</header><text>In this section, the term <term>appropriate congressional committees</term> means—</text><paragraph commented="no" display-inline="no-display-inline" id="id27224EF9BCC049F7B94576EA26FBB410"><enum>(1)</enum><text>the congressional intelligence committees;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF6625A53E3094F6B9747BA32303BC8E6"><enum>(2)</enum><text>the Committee on Armed Services, the Committee on Foreign Relations, and the Committee on
			 Appropriations of the Senate; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1B2371142ADF4F87986B868DF5ED10BA"><enum>(3)</enum><text>the Committee on Armed Services, the Committee on Foreign Affairs, and the Committee on
			 Appropriations of the House of
			 Representatives.</text></paragraph></subsection><subsection id="id3ccb742613ab410a9c64f8de34543c89"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to infringe on the power of the President, by and with
			 the advice and consent of the Senate, to appoint ambassadors, other public
			 ministers, and consuls.”</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id9FED0E8E953C4D839EEAA7BAE7CAD519" section-type="subsequent-section"><enum>314.</enum><header display-inline="yes-display-inline">Inclusion of  Sensitive Compartmented Information Facilities in United States diplomatic facilities
			 in the Russian
			 Federation and adjacent
			 countries</header><subsection commented="no" display-inline="no-display-inline" id="idE4F532476B94421C8D0188114256DB8E"><enum>(a)</enum><header display-inline="yes-display-inline">Sensitive Compartmented Information Facility requirement</header><text display-inline="yes-display-inline">Each United States diplomatic facility that, after the date of the enactment of this Act, is
			 constructed in, or undergoes a construction upgrade in, the Russian
			 Federation, any country that shares a land border with the Russian
			 Federation, or any country that is a former member of the Soviet Union 
			 shall be constructed to include a Sensitive Compartmented Information
			 Facility.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idA2187C32B1504FBEB81CADFBBF015348"><enum>(b)</enum><header>National security waiver</header><text>The Secretary of State may waive the requirement under subsection (a) if the Secretary	 determines
			 that such waiver is in the national security interest of the United States
			 and 
			 submits a written justification to the appropriate congressional
			 committees not later than 180 days before exercising such waiver.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id9D59D04E959E4AFC9DB30BB29A49F9CB"><enum>(c)</enum><header>Appropriate congressional committees defined</header><text>In this section, the term <term>appropriate congressional committees</term> means—</text><paragraph commented="no" display-inline="no-display-inline" id="id6B3E32DA8DBF4A3789FEDC60467E7A3E"><enum>(1)</enum><text>the congressional intelligence committees;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id55AFA4627F664855838FA58FE94EAC04"><enum>(2)</enum><text>the Committee on Armed Services, the Committee on Foreign Relations, and the Committee on
			 Appropriations of the Senate; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id11D406E99E4C43649273BF35BC28896D"><enum>(3)</enum><text>the Committee on Armed Services, the Committee on Foreign Affairs, and the Committee on
			 Appropriations of the House of
			 Representatives.</text></paragraph></subsection></section></subtitle><subtitle id="id25DA343344414ECE9983A1B62C3A719F" style="OLC"><enum>B</enum><header>Reporting</header><section id="idA41928EB806547F8A975114D98F0315C"><enum>321.</enum><header>Report on declassification process</header><text display-inline="no-display-inline">Not later than December 31, 2016, the Director of National
			 Intelligence shall submit to Congress a report describing—</text><paragraph id="id6B6F31B58ECD42C7AFFBF6877810A2CA"><enum>(1)</enum><text>proposals to improve the declassification process throughout the intelligence community; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2D2B401EE88E4887B01E963A318C886F"><enum>(2)</enum><text>steps the intelligence community could take, or legislation that may be necessary, to enable the
			 National Declassification Center to better accomplish the missions
			 assigned to the Center by Executive Order No. 13526 (75 Fed. Reg. 707).</text></paragraph></section><section id="id7E5061694CEC435195CE9914DD328C4C"><enum>322.</enum><header>Report on intelligence community efficient spending targets</header><subsection id="idA52115EBEC5D4C4CA1C3EB9376138AF4"><enum>(a)</enum><header>In general</header><text>Not later than April 1, 2016, and April 1, 2017, the Director of National Intelligence shall
			 submit to the congressional intelligence committees a report on the status
			 and effectiveness of efforts to reduce administrative costs for the
			 intelligence community during the preceding year.</text></subsection><subsection id="id079ee5274ed74687b4c50d863f2dd875"><enum>(b)</enum><header>Elements</header><text>Each report under subsection (a) shall include for each element of the intelligence community the
			 following:</text><paragraph id="id90335f753e1349a9af9c94b85ebcdf07"><enum>(1)</enum><text>A description of the status and effectiveness of efforts to devise alternatives to government
			 travel and promote efficient travel spending, such as teleconferencing and
			 video conferencing.</text></paragraph><paragraph id="id2e9845d237194dd6a7c26d0133c337cf"><enum>(2)</enum><text>A description of the status and effectiveness of efforts to limit costs related to hosting and
			 attending conferences.</text></paragraph><paragraph id="id47b17de57eed4d4796865433eae4adfa"><enum>(3)</enum><text>A description of the status and effectiveness of efforts to assess information technology
			 inventories and usage, and establish controls, to reduce costs related to
			 underutilized information technology equipment, software, or services.</text></paragraph><paragraph id="idfdbfb614cbc9425e8ecd60953f01e3c3"><enum>(4)</enum><text>A description of the status and effectiveness of efforts to limit the publication and printing of
			 hard copy documents.</text></paragraph><paragraph id="idf9002857f464411591d4262c7f84ba7c"><enum>(5)</enum><text>A description of the status and effectiveness of efforts to improve the performance of Federal
			 fleet motor vehicles and limit executive transportation.</text></paragraph><paragraph id="id75b63bbb13994b37b2a6ff8afabadca2"><enum>(6)</enum><text>A description of the status and effectiveness of efforts to limit the purchase of extraneous
			 promotional items, such as plaques, clothing, and commemorative items.</text></paragraph><paragraph id="id2066d5b8b0ae4e0ab683c0356f0fb9b2"><enum>(7)</enum><text>A description of the status and effectiveness of efforts to consolidate and streamline workforce
			 training programs to focus on the highest priority workforce and mission
			 needs.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2f3f1d30bd8b420fb5b4f8a793f4e7e8"><enum>(8)</enum><text>Such other matters relating to efforts to reduce intelligence community administrative costs as the
			 Director may specify for purposes of this section.</text></paragraph></subsection></section><section id="H8426199954184C03B32B5BE312687617" section-type="subsequent-section"><enum>323.</enum><header>Annual report on violations of law or executive order</header><subsection id="HB101699C9A3247D49A2B217F875DDEE5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3091">50 U.S.C. 3091 et seq.</external-xref>)
			 is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HDAAE37A6E0D74F18840ABE56E767B6A1" style="OLC"><section id="HB89FEE695B524F67BD1E57A68EB1FA1F"><enum>511.</enum><header>Annual report on violations of law or executive order</header><subsection id="H8AD782EE91564B8C809FB0AEC505EEF7"><enum>(a)</enum><header>Annual reports required</header><text>The Director of National Intelligence shall annually submit to the congressional intelligence
			 committees a report on violations of law or executive order relating to
			 intelligence activities by personnel
			 of an element of the intelligence community that were identified during
			 the previous calendar year.</text></subsection><subsection id="HAD0B01E1AB354399988E719C39505384"><enum>(b)</enum><header>Elements</header><text>Each report submitted under subsection (a) shall, consistent with the need to preserve ongoing
			 criminal investigations, include a description of, and any action taken in
			 response to, any violation of law or executive order (including Executive
			 Order No. 12333 (<external-xref legal-doc="usc" parsable-cite="usc/50/3001">50 U.S.C. 3001</external-xref> note)) relating to intelligence activities
			 committed by personnel of an element of the intelligence community in the
			 course of the employment of such personnel that, during the previous
			 calendar year, was—</text><paragraph id="H66C119F7DDA2426FA5BE0891E86FC36F"><enum>(1)</enum><text>determined by the director, head, or general counsel of any element of the intelligence community
			 to have occurred;</text></paragraph><paragraph id="HACDD914BD1B84A219D44FD70474C155D"><enum>(2)</enum><text>referred to the Department of Justice for possible criminal prosecution; or</text></paragraph><paragraph id="HEF635487FEE94A16A82AE97BB05387EF"><enum>(3)</enum><text>substantiated by the inspector general of any element of the intelligence community.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H50246095909A4D33AB37066E6A5D3CBF"><enum>(b)</enum><header>Initial report</header><text>The first report required under section 511 of the National Security Act of 1947, as added by
			 subsection (a), shall be submitted not later than one year after the date
			 of the enactment of this Act.</text></subsection><subsection id="H982E45A1E2BC4136A697B86E9467038F"><enum>(c)</enum><header>Guidelines</header><text>Not later than 180 days after the date of the enactment of this Act, the Director of National
			 Intelligence, in consultation with the head of each element of the
			 intelligence community, shall—</text><paragraph id="HB161CE5FE22749519D3BA1FF0DA849B9"><enum>(1)</enum><text>issue guidelines to carry out section 511 of the National Security Act of 1947, as added by
			 subsection (a); and</text></paragraph><paragraph id="H2E4CC8D052CB4CA48E3669F646CED42B"><enum>(2)</enum><text>submit such guidelines to the congressional intelligence committees.</text></paragraph></subsection><subsection commented="no" id="H3ADB25C1E96A4F0CA3990301F263BCFF"><enum>(d)</enum><header>Table of contents amendment</header><text>The table of sections in the first section of the National Security Act of 1947 is amended by
			 adding after the item
			 relating to section 510 the following new
			 item:</text><quoted-block display-inline="no-display-inline" id="HFC113EE91EF4432EB9C158DCE7D442DE" style="OLC"><toc><toc-entry bold="off" level="section">Sec. 511. Annual report on violations of law or executive order.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H8F6CDE9C884C4D0BB169942582757B5E"><enum>(e)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section or the amendments made by this section shall be construed to alter any
			 requirement existing on the date of the enactment of this Act to submit a
			 report under any provision of law.</text></subsection></section><section id="id92366018a78044668e14804557484eeb"><enum>324.</enum><header>Annual report on intelligence activities of the Department of Homeland Security</header><subsection id="id3eee2855cc5c4f3491b54bceb7b985d6"><enum>(a)</enum><header>In general</header><text>For each fiscal year and  along with the budget materials submitted in support
			 of the budget of the Department of Homeland Security pursuant to section
			 1105(a) of title 31,
			 United States Code, the Under Secretary for Intelligence and Analysis of
			 the Department shall submit to the
			 congressional intelligence committees a report for such fiscal year on 
			 each intelligence activity of each intelligence component of the
			 Department, as designated by the Under
			 Secretary, that includes the
			 following:</text><paragraph id="id5d141b4ade5b4b19a4f28ecd2defff85"><enum>(1)</enum><text>The amount of funding requested for each such intelligence activity.</text></paragraph><paragraph id="id79f501e9c86d4de1aebe419767791a9f"><enum>(2)</enum><text>The number of full-time employees funded to perform each such intelligence activity.</text></paragraph><paragraph id="idb630e99212444d609ff1bc54a5de7687"><enum>(3)</enum><text>The number of full-time contractor employees (or the equivalent of full-time in the case of
			 part-time contractor employees) funded to perform or in support of
			 each such intelligence activity.</text></paragraph><paragraph id="idfed220b67f624f9d93d36c4476eafd57"><enum>(4)</enum><text>A determination as to whether each such intelligence activity is predominantly in support of
			 national intelligence or departmental missions.</text></paragraph><paragraph id="ida47b19efdc514aa1a35e8be156635916"><enum>(5)</enum><text>The total number of analysts of the Intelligence Enterprise of the Department
			 that perform—</text><subparagraph id="idf4aa2df32cea444b8dde98e432b4d297"><enum>(A)</enum><text>strategic analysis; or</text></subparagraph><subparagraph id="id0eb8b400738a43949b3a6c8217adb455"><enum>(B)</enum><text>operational analysis.</text></subparagraph></paragraph></subsection><subsection id="id57d68adeb13c474cad8b6861e3a364fe"><enum>(b)</enum><header>Feasibility and advisability report</header><text>Not later than 120 days after the date of the enactment of this Act, the Secretary of Homeland
			 Security, acting through the Under Secretary for Intelligence and
			 Analysis, shall submit to the congressional intelligence committees a
			 report that—</text><paragraph id="idc0af3c900ce449fead08c27751d48ad8"><enum>(1)</enum><text>examines the feasibility and advisability of including the budget request for all intelligence
			 activities of each intelligence component of the Department that
			 predominantly support
			 departmental missions, as designated
			 by the Under Secretary for Intelligence and
			 Analysis,  in the Homeland Security Intelligence Program; and</text></paragraph><paragraph id="id268afe73afdb4b6592c9c78b9845ad45"><enum>(2)</enum><text>includes a plan to enhance the coordination of department-wide
			 intelligence activities to achieve greater efficiencies in the performance
			 of the Department of Homeland Security intelligence functions.</text></paragraph></subsection><subsection id="id4ef263818a004dd7a1ff8ef657c6d099"><enum>(c)</enum><header>Intelligence component of the Department</header><text>In this section, the term <quote>intelligence component of the Department</quote> has the meaning given that term in section 2 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101</external-xref>).</text></subsection></section><section id="id8D9BDB3641144E06B8E2FA67B09F95A5"><enum>325.</enum><header>Report on political prison camps in North Korea</header><subsection id="id4e27fa032f714190916841935e970faa"><enum>(a)</enum><header>In general</header><text>The Director of National Intelligence, in consultation with the Secretary of State, shall submit to
			 the congressional intelligence committees, the Committee on Foreign
			 Relations of the Senate, and the Committee on Foreign Affairs of the House
			 of Representatives a report on political prison
			 camps in North Korea.</text></subsection><subsection id="id5925BE54E4F847A4A74EF54ECA65D7C4"><enum>(b)</enum><header>Elements</header><text>The report required by subsection (a) shall—</text><paragraph id="id2DAF78D9D65B4007AD619EA2C9937BB7"><enum>(1)</enum><text>describe the actions the United States is taking to support implementation of the recommendations
			 of the United Nations Commission of Inquiry on Human Rights in the
			 Democratic People's Republic of Korea, including the eventual
			 establishment of a tribunal to hold individuals accountable for abuses;
			 and</text></paragraph><paragraph id="idD553E124532E48609028687AABBC7DC0"><enum>(2)</enum><text>include, with respect to each political prison camp in North Korea to the extent information is
			 available—</text><subparagraph id="ideb52559b421043339c015c337184afd5"><enum>(A)</enum><text>the estimated prisoner population of each such camp;</text></subparagraph><subparagraph id="id6a9f9da898a94a38994639929bb180a3"><enum>(B)</enum><text>the geographical coordinates of each such camp;</text></subparagraph><subparagraph id="iddca42aaf551d45fb9a4491d1b7540f8b"><enum>(C)</enum><text>the reasons for confinement of the prisoners at each such camp;</text></subparagraph><subparagraph id="id9191a28d42824da4a69afed5f0b49e92"><enum>(D)</enum><text>a description of the primary industries and products made at each such camp, and the end users of
			 any goods produced in such camp;</text></subparagraph><subparagraph id="idf6be3b1e0575414d83dac1ff9448f3a2"><enum>(E)</enum><text>information regarding involvement of any non-North Korean entity or individual involved in the
			 operations of each such camp, including as an end user or source of any
			 good or products used in, or produced by, in such camp;</text></subparagraph><subparagraph id="idef9016354f6046158565e89412421853"><enum>(F)</enum><text>information identifying individuals and agencies responsible for conditions in each such camp at
			 all levels of the Government of North Korea;</text></subparagraph><subparagraph id="idb7427848c4c648af94c465bc2c1750ba"><enum>(G)</enum><text>a description of the  conditions under which prisoners are confined, with respect to the adequacy
			 of food, shelter, medical care, working conditions, and reports of
			 ill-treatment of prisoners, at each such camp; and</text></subparagraph><subparagraph id="id2308f07ff6454c21987191a685908e4b"><enum>(H)</enum><text>unclassified imagery, including satellite imagery, of each such camp.</text></subparagraph></paragraph></subsection><subsection id="ideced339c8e40427d92d93ba8d7770abb"><enum>(c)</enum><header>Form</header><text>The report required by subsection (a) shall be submitted in an unclassified form and may include a
			 classified annex if necessary.</text></subsection></section><section display-inline="no-display-inline" id="H8B5FCD299CC24823A26753F1F178BA0C" section-type="subsequent-section"><enum>326.</enum><header>Assessment of security of domestic oil refineries and related rail transportation infrastructure</header><subsection id="H83D27FA5BC804C54B1ADA679E96FE3D8"><enum>(a)</enum><header>Assessment</header><text display-inline="yes-display-inline">The Under Secretary of Homeland Security for Intelligence and Analysis shall conduct an
			 intelligence assessment of the security of domestic oil refineries and
			 related rail transportation infrastructure.</text></subsection><subsection id="HF07ADED870754BE19E8B73FB9885E516"><enum>(b)</enum><header>Submission</header><text>Not later than 180 days after the date of the enactment of this Act, the Under Secretary of
			 Homeland Security for Intelligence and Analysis shall submit to the
			 congressional intelligence committees—</text><paragraph id="H6700751C80E74540960278F3351B2211"><enum>(1)</enum><text>the results of the assessment required under subsection (a); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H22F56F3BFF4F4B66A7B8255F07F6DF85"><enum>(2)</enum><text>any recommendations with respect to intelligence sharing or intelligence collection to improve the
			 security of domestic oil refineries and related rail transportation
			 infrastructure to protect the communities surrounding such refineries or
			 such infrastructure from potential harm that the Under Secretary considers
			 appropriate.</text></paragraph></subsection></section><section commented="no" id="HB07330CBF8264B6C89F8A995A363929A"><enum>327.</enum><header>Enhanced contractor level assessments for the intelligence community</header><text display-inline="no-display-inline">Section 506B(c) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3098">50 U.S.C. 3098(c)</external-xref>) is amended—</text><paragraph commented="no" id="idD9404AEE629040BB9CAF6471ABC3D9D1"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (11), by striking <quote>or contracted</quote>;</text></paragraph><paragraph commented="no" id="idA7B88190BD0A483280E7329773EDA3FE"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraph (12) as paragraph (13); and</text></paragraph><paragraph commented="no" id="id432EBF4B337240A99E27ED47C4BCBDB3"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (11) the following:</text><quoted-block display-inline="no-display-inline" id="id739C0547E0AB4FF48AC7FDA2440DEBE5" style="OLC"><paragraph commented="no" id="id832B85FA871D43CD811811BC635447A9"><enum>(12)</enum><text>The best estimate of the number of intelligence collectors and analysts contracted by each element
			 of the intelligence community and a description of the functions performed
			 by such contractors.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H149BFB0F7D074EC085E9FDCB38647C2A"><enum>328.</enum><header>Assessment of the efficacy of memoranda of understanding to facilitate intelligence-sharing</header><text display-inline="no-display-inline">Not later than 90 days after the date of the enactment of this Act, the Under Secretary of Homeland
			 Security for Intelligence and Analysis, in consultation with the Director
			 of the Federal Bureau of Investigation and the Program Manager of the
			 Information Sharing Environment, shall submit to the congressional
			 intelligence committees, the Committee on Homeland Security and
			 Governmental Affairs of the Senate, the Committee on Homeland Security
			 of the House
			 of Representatives, the Committee on the Judiciary of the Senate, and the
			 Committee on the Judiciary of the House of Representatives an assessment
			 of the efficacy of the
			 memoranda of understanding signed between Federal, State, local, tribal,
			 and territorial agencies to facilitate intelligence-sharing within and
			 separate from the Joint Terrorism Task Force. Such assessment shall
			 include—</text><paragraph id="H7BCFBA22546A4C4BAE8DB144875F60AB"><enum>(1)</enum><text>any language within such memoranda of understanding that prohibited or may be construed to prohibit
			 intelligence-sharing between Federal, State, local, tribal, and
			 territorial agencies; and</text></paragraph><paragraph id="H35CC1A3534F140B4854ECE8B36E4E24D"><enum>(2)</enum><text>any recommendations for memoranda of understanding to better facilitate intelligence-sharing
			 between Federal, State, local, tribal, and territorial agencies.</text></paragraph></section><section commented="no" id="HEEA4A4372D9D4FBCA66ED13ACD15A39D"><enum>329.</enum><header>Report on foreign man-made electromagnetic pulse weapons</header><subsection commented="no" id="H3AE6451D13A442A6A605C3EE10C001FF"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Director of National
			 Intelligence shall submit to the congressional intelligence committees,
			 the Committee on Armed Services of the Senate, and the Committee on Armed
			 Services of the House of Representatives a report on the threat posed by
			 man-made electromagnetic pulse
			 weapons to United States interests through 2025, including threats from
			 foreign countries and foreign non-State actors.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HDE31DBB7086849AE914C70DB5EC37E61"><enum>(b)</enum><header>Form</header><text>The report required under subsection (a) shall be submitted in unclassified form, but may include a
			 classified annex.</text></subsection></section><section commented="no" id="HFCD6718CC9EF4C0F92837E536C50AB08"><enum>330.</enum><header>Report on United States counterterrorism strategy to disrupt, dismantle, and defeat al-Qaeda and
			 its
			 affiliated or associated groups</header><subsection commented="no" id="HC1AA3D088FE943F5A8649D996456685F"><enum>(a)</enum><header>Report</header><paragraph commented="no" id="H885646D3185D4ADD82EE02145526897D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Director of National
			 Intelligence shall submit to the appropriate committees of Congress a
			 comprehensive report on the United States counterterrorism strategy to
			 disrupt, dismantle, and defeat al-Qaeda and its affiliated or associated
			 groups.</text></paragraph><paragraph commented="no" id="H0DCA80937CBD4C88992B53793010D712"><enum>(2)</enum><header>Coordination</header><text display-inline="yes-display-inline">The report required by paragraph (1) shall be prepared in coordination with the Secretary of State,
			 the Secretary of the Treasury, the Attorney General, and the Secretary of
			 Defense, and the head of any other department or agency of the United
			 States Government that has responsibility for activities directed at
			 combating al-Qaeda and its affiliated or associated groups.</text></paragraph><paragraph commented="no" id="HCE29680B1F224288936E6D559EF8AFDF"><enum>(3)</enum><header>Elements</header><text>The report required by paragraph (1) shall include the following:</text><subparagraph commented="no" id="HC3246BF1B17B49E1B2C0B832E66D3605"><enum>(A)</enum><text display-inline="yes-display-inline">A definition of—</text><clause commented="no" id="H23C2B62C5FA344068FB5C9E6D40808DD"><enum>(i)</enum><text>al-Qaeda core, including a list of which known individuals constitute al-Qaeda core;</text></clause><clause commented="no" id="H793888D4CC604433ACB4FD4577B7C088"><enum>(ii)</enum><text>an affiliated group of al-Qaeda, including a list of which known groups constitute an affiliate
			 group of al-Qaeda;</text></clause><clause commented="no" id="H7D3F1231CF884FC3A91127E4803F47E6"><enum>(iii)</enum><text>an associated group of al-Qaeda, including a list of which known groups constitute an associated
			 group of al-Qaeda; and</text></clause><clause commented="no" id="HDC77ADA9B4524B14ABD862D496CF2C7E"><enum>(iv)</enum><text>a group aligned with al-Qaeda, including a description of what actions a group takes or statements
			 it makes that qualify it as a group aligned with al-Qaeda.</text></clause></subparagraph><subparagraph commented="no" id="id1c0be87059614a21bdc1167c2c0dd32b"><enum>(B)</enum><text>A list of any other group, including the organization that calls itself the Islamic State (also
			 known as <quote>ISIS</quote> or <quote>ISIL</quote>), that adheres to the core mission of al-Qaeda, or who espouses the same violent jihad ideology as
			 al-Qaeda.</text></subparagraph><subparagraph commented="no" id="H5833792C927B4D72A4E4BCFAAD5FC6AE"><enum>(C)</enum><text>An assessment of the relationship between al-Qaeda core and the groups referred to in subparagraph
			 (B).</text></subparagraph><subparagraph commented="no" id="HBD67AD64B81D4201BC545CB6D08A6796"><enum>(D)</enum><text display-inline="yes-display-inline">An assessment of the strengthening or weakening of al-Qaeda and the groups referred to in
			 subparagraph (B) from January 1, 2010, to the present, including a
			 description of the metrics that are used to assess strengthening or
			 weakening and an assessment of the relative increase or decrease in
			 violent attacks attributed to such entities.</text></subparagraph><subparagraph commented="no" id="H8DA3724A1EBF49E792ABBCFBD173FF4E"><enum>(E)</enum><text>An assessment of whether or not an individual can be a member of al-Qaeda core if such individual
			 is not located in Afghanistan or Pakistan.</text></subparagraph><subparagraph commented="no" id="H16F126B8B74C4CCEA4D294F92EB490D8"><enum>(F)</enum><text>An assessment of whether or not an individual can be a member of al-Qaeda core as well as a member
			 of a group referred to in subparagraph (B).</text></subparagraph><subparagraph commented="no" id="HFE5A9D87164B49DD92FD00136D1BF30C"><enum>(G)</enum><text>A definition of defeat of core al-Qaeda.</text></subparagraph><subparagraph commented="no" id="HFF832350C6A64C2CB5BD1884C1ACF6CA"><enum>(H)</enum><text>An assessment of the extent or coordination, command, and control between core al-Qaeda and the
			 groups referred to in subparagraph (B), specifically
			 addressing each such group.</text></subparagraph><subparagraph commented="no" id="HF8D49C4A0362441CAEFEA7E967AD1D91"><enum>(I)</enum><text>An assessment of the effectiveness of counterterrorism operations against core al-Qaeda and the
			 groups referred to in subparagraph (B), and whether such
			 operations have had a sustained impact on the capabilities and
			 effectiveness of core al-Qaeda and such groups.</text></subparagraph></paragraph><paragraph commented="no" id="HFDD612CF692446F2808F5863B4E0BA1E"><enum>(4)</enum><header>Form</header><text display-inline="yes-display-inline">The report required by paragraph (1) shall be submitted in unclassified form, but may include a
			 classified annex.</text></paragraph></subsection><subsection commented="no" id="H645C2621513846B3B5C45FFFF091D59C"><enum>(b)</enum><header>Appropriate committees of Congress defined</header><text>In this section, the term <quote>appropriate committees of Congress</quote> means—</text><paragraph commented="no" display-inline="no-display-inline" id="id6D0F44C2057C45D0AD22EF41382BCB65"><enum>(1)</enum><text display-inline="yes-display-inline">the congressional intelligence committees;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3D80AD16276B40ADBFF43CA5BFF8FD2A"><enum>(2)</enum><text display-inline="yes-display-inline">the Committee on Foreign Relations and the Committee on
			 Armed Services of the Senate; and</text></paragraph><paragraph commented="no" id="HB8576EC8C44249119C4ECCACE4BC1D71"><enum>(3)</enum><text display-inline="yes-display-inline">the Committee on Foreign Affairs and the Committee
			 on Armed Services of the House of Representatives.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H35AB70BBA3894060B110B50D546DC53E" section-type="subsequent-section"><enum>331.</enum><header>Feasibility study on retraining veterans in cybersecurity</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Director of National
			 Intelligence, in consultation with the Secretary of Defense, the Secretary
			 of Veterans Affairs, and the Secretary of Homeland Security, shall submit
			 to Congress a feasibility study on retraining veterans and retired members
			 of
			 elements of the intelligence community in cybersecurity.</text></section></subtitle></title></amendment-block></amendment></engrossed-amendment-body><attestation><attestation-group><attestor></attestor><role>Secretary</role></attestation-group></attestation><endorsement></endorsement></amendment-doc>
