		<section id="HD76CEB39F0344A118F18E5EC01D1BD90" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nuclear Plant Decommissioning Act of 2014</short-title></quote>.</text>
		</section><section id="H39323ACA413D425D96ED4DD4ADC2DA59"><enum>2.</enum><header>Post-shutdown decommissioning activities reports</header><text display-inline="no-display-inline">Chapter 10 of title I of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2131">42 U.S.C. 2131 et seq.</external-xref>) is amended by
			 adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H2F34A1893F7F4233A3FF94169F2F279C" style="OLC">
				<section commented="no" display-inline="no-display-inline" id="H771DD3441733458BAC9E82CDB7BD8EA1" section-type="subsequent-section"><enum>113.</enum><header display-inline="yes-display-inline">Post-shutdown decommissioning activities reports</header>
					<subsection id="HB6F8DEF402A9464C967F018FD5B14E30"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
						<paragraph id="H4D915D2A82EC4F068333A52E77F3B1D8"><enum>(1)</enum><header>Affected State</header><text>The term <term>affected State</term> means—</text>
							<subparagraph id="H939E571A117D48EE9E39FE922931CEC4"><enum>(A)</enum><text>the host State of a covered facility; and</text>
							</subparagraph><subparagraph id="HA28DC3B3AA5140A994E6E3F112F9CD2C"><enum>(B)</enum><text>each State that is within 50 miles of a covered facility.</text>
							</subparagraph></paragraph><paragraph id="H3D70B983BBCE410F97A42188FF1F1519"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the Nuclear Regulatory Commission.</text>
						</paragraph><paragraph id="H967DD2ECB91342E3ABCBB7DC2779FD39"><enum>(3)</enum><header>Covered facility</header><text>The term <term>covered facility</term> means a facility of a licensee for which a PSDAR is required.</text>
						</paragraph><paragraph id="HB1DB3F56F38B4594833567B97ACD24E2"><enum>(4)</enum><header>Host State</header><text>The term <term>host State</term> means the State in which a covered facility is located.</text>
						</paragraph><paragraph id="H097E454397D045C69CD80661C73E55B4"><enum>(5)</enum><header>Licensee</header><text>The term <term>licensee</term> has the meaning given the term in <external-xref legal-doc="regulation" parsable-cite="cfr/10/50.2">section 50.2</external-xref> of title 10, Code of Federal Regulations (or any
			 successor regulation).</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H21200D7BB26E43F49A28E002AF324EA3"><enum>(6)</enum><header>PSDAR</header><text>The term <quote>PSDAR</quote> means a post-shutdown decommissioning activities report submitted to the Commission and affected
			 States under <external-xref legal-doc="usc" parsable-cite="usc/10/50">section 50.82(a)(4)(i)</external-xref> of title 10, Code of Federal
			 Regulations (or any successor regulation).</text>
						</paragraph></subsection><subsection id="H871E32D170FC4147ABEE05DE395151D7"><enum>(b)</enum><header>Development; initial consultation</header><text>A licensee shall develop a proposed PSDAR for a covered facility after consultation with—</text>
						<paragraph id="H906B2B3F97184D11BF9CB2905A5455AF"><enum>(1)</enum><text>each affected State; and</text>
						</paragraph><paragraph id="H0428473A0E064B56B9A4F477A5904995"><enum>(2)</enum><text>each unit of local government and tribal government in the affected State that is located within 50
			 miles of the covered facility.</text>
						</paragraph></subsection><subsection id="H8ED6A50EC3804134949BECBB1FB023E5"><enum>(c)</enum><header>Submission to Commission; additional consultation</header>
						<paragraph id="HECF9F23F503248009153D996213535BF"><enum>(1)</enum><header>In general</header><text>After additional consultation with the entities described in subsection (b) with respect to the
			 proposed PSDAR developed under that subsection, the licensee shall—</text>
							<subparagraph id="H729FC4BB586749428FA8CD49836305D7"><enum>(A)</enum><text>submit to the Commission the proposed PSDAR; and</text>
							</subparagraph><subparagraph id="H60FAA0124F09493A8AA9DDE0BD965443"><enum>(B)</enum><text>on submission of the proposed PSDAR under subparagraph (A), make the proposed PSDAR readily
			 available to the public.</text>
							</subparagraph></paragraph><paragraph id="HCBB52EF0F2C54B3CB0E051D613954C0C"><enum>(2)</enum><header>Public availability</header><text>On receipt of the proposed PSDAR under paragraph (1), the Commission shall make the proposed PSDAR
			 readily available to the public.</text>
						</paragraph></subsection><subsection id="H6984E4C6DE9F4DA3940B670639698F1C"><enum>(d)</enum><header>Public participation</header><text>During a period of at least 90 days beginning on the date on which the licensee submits the
			 proposed PSDAR to the Commission under subsection (c), the Commission
			 shall solicit public participation on the proposed PSDAR in the host
			 State, including through—</text>
						<paragraph id="H28A7B43C81FA4997B58911D8132A3C3C"><enum>(1)</enum><text>the solicitation of written comments from the public; and</text>
						</paragraph><paragraph id="H1EC84AD9504E48BB97E563E76A42BF10"><enum>(2)</enum><text>the conduct of at least 2 public hearings within the host State.</text>
						</paragraph></subsection><subsection id="HDF5676A7797F47B18DB100C42045E28B"><enum>(e)</enum><header>Support or nonsupport by host State</header>
						<paragraph id="H53003AD03DC643739A7A21247BFA57FF"><enum>(1)</enum><header>In general</header><text>Not later than 60 days after the receipt of a proposed PSDAR for a covered facility, the Commission
			 shall invite the host State to file with the Commission, by the date that
			 is 60 days after the date on which the host State receives the invitation
			 under this paragraph—</text>
							<subparagraph id="HBB0761CFBAFB452C9E0DFBB6527DAAB8"><enum>(A)</enum><text>a statement of support for the proposed PSDAR;</text>
							</subparagraph><subparagraph id="H90754EDE25F1439281990136E53EB2C4"><enum>(B)</enum><text>a statement of conditional support for the proposed PSDAR, with specific recommendations for
			 changes that could lead the host State to support the proposed PSDAR; or</text>
							</subparagraph><subparagraph id="HD60CAFDC000A48D7A2288983180F51E7"><enum>(C)</enum><text>a statement of nonsupport for the proposed PSDAR.</text>
							</subparagraph></paragraph><paragraph id="H695708B37E6143FAB0A832D2424F7BFA"><enum>(2)</enum><header>Statement of support or nonsupport; failure to submit</header>
							<subparagraph id="H9666A15711A445139C874AF3616F5286"><enum>(A)</enum><header>In general</header><text>If the host State files a statement of support under paragraph (1)(A), a statement of nonsupport
			 under paragraph (1)(C), or fails to file a statement with the Commission
			 by the deadline specified in paragraph (1), the Commission shall issue a
			 determination on whether the proposed PSDAR is adequate or inadequate—</text>
								<clause id="H5CC2BE2661CA430489F359A5165EB3C2"><enum>(i)</enum><text>based on the considerations described in subparagraph (B); and</text>
								</clause><clause id="H4A471C53F1E245F4B1A195E6B898479A"><enum>(ii)</enum><text>after taking into account—</text>
									<subclause id="H3092551EC02C4FF0B3C2746E7437E84B"><enum>(I)</enum><text>any written comments submitted by the host State, other States, and local communities with respect
			 to the proposed PSDAR; and</text>
									</subclause><subclause id="H3477FF9EE9E54783BF36B9DF83575432"><enum>(II)</enum><text>any input from the public under subsection (d).</text>
									</subclause></clause></subparagraph><subparagraph id="H5E046C41205847AEB81C5072A3403C1A"><enum>(B)</enum><header>Considerations</header><text>The Commission shall consider a proposed PSDAR to be adequate under subparagraph (A) if the
			 Commission determines that—</text>
								<clause id="HCDD4466140D54953A5F928A20CFE1372"><enum>(i)</enum><text>the proposed PSDAR provides for the overall protection of human health and the environment;</text>
								</clause><clause id="H04C9461BBF3D4D698612B939DB946209"><enum>(ii)</enum><text>the licensee has a substantial likelihood of implementing the proposed PSDAR within the timeframe
			 described in the proposed PSDAR;</text>
								</clause><clause commented="no" id="HD7F4A27A62734E35BA3688A5E3403CC6"><enum>(iii)</enum><text>the proposed PSDAR is in accordance with applicable law (including regulations); and</text>
								</clause><clause commented="no" id="HE730F1B47A3E47CC89C5C9E9271EBDD6"><enum>(iv)</enum><text>the licensee has proactively demonstrated that the licensee has, or will have, the funds required
			 to fully implement the proposed PSDAR within the timeframe described in
			 the proposed PSDAR.</text>
								</clause></subparagraph><subparagraph id="HD9F8AFA2D4DF4689B0FA7728D7E1C51B"><enum>(C)</enum><header>Determination of adequacy</header><text>If the Commission determines that the proposed PSDAR is adequate under subparagraph (A), the
			 Commission shall issue a decision document approving the PSDAR.</text>
							</subparagraph><subparagraph id="H5189912F08BA4A7EBCA50D3F496DABCF"><enum>(D)</enum><header>Determination of inadequacy</header><text>If the Commission determines that the proposed PSDAR is inadequate under subparagraph (A)—</text>
								<clause id="H7FE46DE93AEE4D5D91989B8DF0CF4926"><enum>(i)</enum><text>the Commission shall issue a decision rejecting the proposed PSDAR, including the reasons for the
			 decision; and</text>
								</clause><clause id="H5BA57FE0A28044259E7B10310C14D558"><enum>(ii)</enum><text>the licensee shall develop and submit to the Commission a new proposed PSDAR in accordance with
			 this section.</text>
								</clause></subparagraph></paragraph><paragraph id="H065E0134DF5847CB8F79F41570D0BA88"><enum>(3)</enum><header>Conditional support by host State</header>
							<subparagraph id="H36BACA737588480F879D76E815FEA4E7"><enum>(A)</enum><header>In general</header><text>The Commission shall determine whether the proposed PSDAR is permissible under applicable law
			 (including regulations) if the host State files a statement of conditional
			 support for the proposed PSDAR with the Commission in accordance with
			 paragraph (1)(B).</text>
							</subparagraph><subparagraph id="H1FD61530C9ED441A9CF0B58AD4EE6D28"><enum>(B)</enum><header>Changes</header><text>For each change recommended by the host State under paragraph (1)(B), the Commission shall—</text>
								<clause id="H0F4810AFA90545E0A95BC64616F9166A"><enum>(i)</enum><text>provide for the inclusion of the change into the final PSDAR, unless the Commission determines the
			 change to be inappropriate for inclusion, based on clear and convincing
			 evidence provided by the licensee that—</text>
									<subclause id="HBDEC78588B444DB084EECABBCF3E4504"><enum>(I)</enum><text>the change violates applicable law; or</text>
									</subclause><subclause id="H75AC805CCDB64B7CA5ED6678A2C4AC0E"><enum>(II)</enum><text>the costs of the change substantially outweigh the safety, economic, or environmental benefits of
			 the change to the host State; and</text>
									</subclause></clause><clause id="H688E8EF79E89447AA8CCE50F8A1D5F8E"><enum>(ii)</enum><text>provide the rationale for a determination of inappropriateness under clause (i).</text>
								</clause></subparagraph><subparagraph id="H86C50CE95A3D412E91A4C4DD1C15CDEC"><enum>(C)</enum><header>Decision document</header>
								<clause id="H70DAE08B8FF74C48AF5FC3969C401B1D"><enum>(i)</enum><header>In general</header><text>Based on the determinations made under subparagraphs (A) and (B), the Commission shall issue a
			 decision document that—</text>
									<subclause id="H703A4DEF374D432CB4C41E1C95D3C545"><enum>(I)</enum><text>accepts the proposed PSDAR with any changes recommended by the host State that are not determined
			 to be inappropriate under subparagraph (B); or</text>
									</subclause><subclause id="H38B639AA213842B6BBAB6150815A1D24"><enum>(II)</enum><text>rejects the proposed PSDAR.</text>
									</subclause></clause><clause id="H7F883C3F8FD14779B6E799C9377CFB7F"><enum>(ii)</enum><header>Applicable law</header><text>A decision document issued under clause (i) shall be considered to be a final order entered in a
			 proceeding under section 189(a).</text>
								</clause></subparagraph><subparagraph id="H31059C1A9D3C4227947C3F7FABC29F29"><enum>(D)</enum><header>Acceptance</header><text>If the Commission approves the proposed PSDAR under subparagraph (C)(i)(I)—</text>
								<clause id="H68AA576FA79F4B1989FC7A9FF3FEBAE0"><enum>(i)</enum><text>the PSDAR is final; and</text>
								</clause><clause id="HD5AD9ED4A18549B88BCA962C79B968B7"><enum>(ii)</enum><text>the licensee may begin implementation of the PSDAR.</text>
								</clause></subparagraph><subparagraph id="HC57CB0E9CA7B4C309ABA3C81AD78AAA0"><enum>(E)</enum><header>Rejection</header><text>If the Commission rejects the proposed PSDAR under subparagraph (C)(i)(II), the licensee shall
			 develop and submit to the Commission a new proposed PSDAR in accordance
			 with this section.</text>
							</subparagraph></paragraph></subsection><subsection id="H47008F2A7EE14F858849EE8EF35AC1FB"><enum>(f)</enum><header>Additional requirement</header><text>Notwithstanding any other provision of this section, a Commission shall not approve a PSDAR under
			 this section unless the proposed PSDAR includes a requirement that the
			 licensee comply with applicable State law relating to air, water, or soil
			 quality or radiological standards with respect to the implementation of
			 the proposed PSDAR if the applicable State law is more restrictive than
			 the applicable Federal law.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
