		<section id="HD086FF2E682B4B8098AA8AB96E6361BA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Boating Occupancy and Teaching Safety Act</short-title></quote> or the <quote><short-title>BOATS Act</short-title></quote> .</text>
		</section><section id="H9ACEAE41060F4DE1A370DF7A41982430"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H6EF1F208094146309708BA3854299C13"><enum>(1)</enum><header>Flying bridge</header><text display-inline="yes-display-inline">The term <term>flying bridge</term> means an open deck above the main navigating bridge of a recreational vessel.</text>
			</paragraph><paragraph id="H6F5C3C81F6E14861885A19491879124D"><enum>(2)</enum><header>Passenger</header><text>The term <term>passenger</term> includes any individual aboard a vessel.</text>
			</paragraph><paragraph id="H802290EEF6FA4CD0BFC5D7A3F6E6B54B"><enum>(3)</enum><header>Recreational vessel</header>
				<subparagraph commented="no" id="H56C70209946E464E9CEDDD838997A06C"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>recreational vessel</term> means any vessel of greater than 20 feet and less than 45 feet overall in length, that is—</text>
					<clause commented="no" id="HEB7DFD615D0040E8A6C2B871ED699CC0"><enum>(i)</enum><text>manufactured or used primarily for pleasure; or</text>
					</clause><clause commented="no" id="H45D3FD62540F4A269ADBF290C58A2C65"><enum>(ii)</enum><text>leased, rented, or chartered to a person for the pleasure of that person.</text>
					</clause></subparagraph><subparagraph id="H2EDA6C6BD6284B46A26908AB24B3C235"><enum>(B)</enum><header>Exclusion</header><text>The term <term>recreational vessel</term> does not include a vessel that—</text>
					<clause id="H0AA99E34FC504D54A5D42D38EB06168D"><enum>(i)</enum><text>is subject to Coast Guard inspection;</text>
					</clause><clause id="H1B8031D921C54599A4550F588231A3E0"><enum>(ii)</enum><text display-inline="yes-display-inline">is constructed before January 1, 2016; and</text>
					</clause><clause id="H1C58930D2FB44918A249AD85C055F12B"><enum>(iii)</enum>
						<subclause commented="no" display-inline="yes-display-inline" id="HFC10CBC2D29B4551B455D7FBC86327A9"><enum>(I)</enum><text>is engaged in commercial use; or</text>
						</subclause><subclause id="HA889BA24766C497DBD72DC0587C4FBC9" indent="up1"><enum>(II)</enum><text>carries paying passengers.</text>
						</subclause></clause></subparagraph></paragraph></section><section id="HC72D00C9F28D4D1AB59D50AC917C6FF2"><enum>3.</enum><header>Capacity limits for recreational vessels</header>
			<subsection id="H61AFA20467424004857E13FF30BA3FAD"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Commandant of the Coast
			 Guard shall—</text>
				<paragraph id="HD9CA67EECA2F49E8A99D03670D15C34C"><enum>(1)</enum><text>establish standards for determining the maximum passenger capacity in whole number of passengers
			 and in pounds for recreational vessels;</text>
				</paragraph><paragraph id="H1ED8E0178EEE4A79966560AE882228DD"><enum>(2)</enum><text>require each manufacturer of a passenger vessel to post such maximum passenger capacity on the
			 passenger vessel as described in subsection (b); and</text>
				</paragraph><paragraph id="H8354789B606B4D14930EBD0D91E3E60B"><enum>(3)</enum><text>require each operator of a passenger vessel to ensure that—</text>
					<subparagraph id="H5757D6D8EDD74364A57C6D2ABEC612B0"><enum>(A)</enum><text>such maximum passenger capacity is posted as described in subsection (b) and legible to passengers;
			 and</text>
					</subparagraph><subparagraph id="H9160701CE59C4EC9A268F7FB23B7FC6C"><enum>(B)</enum><text>notice of the need to balance the weight carried by the vessel to avoid capsizing is posted as
			 described in subsection (b) and legible to passengers.</text>
					</subparagraph></paragraph></subsection><subsection id="HC13E1E1FF95F46EEA36741C37A3C28BB"><enum>(b)</enum><header>Elements and locations of displays</header><text>The maximum passenger capacity, maximum carrying capacity in pounds, and notice of the need to
			 balance the carried weight for a passenger vessel shall each be
			 permanently displayed in a legible matter—</text>
				<paragraph id="H56E13891CAFC4FF8960488B6689FC48C"><enum>(1)</enum><text>in a location that is clearly visible to a passenger boarding the passenger vessel; and</text>
				</paragraph><paragraph id="HACFE3D3F625F4D86A3B9820C216C7B0F"><enum>(2)</enum><text>on each flying bridge of the vessel, in a location that is clearly visible to a passenger on the
			 flying bridge.</text>
				</paragraph></subsection><subsection id="HBA8C175C82B84652B16D9E257D1A3565"><enum>(c)</enum><header>Penalties</header><text>Not later than 180 days after the date of the enactment of this Act, the Commandant of the Coast
			 Guard shall publish regulations that establish appropriate penalties for a
			 manufacturer of a recreational vessel that does not comply with the
			 requirements of this section.</text>
			</subsection><subsection id="HFF8698A00E36409093E7DB7110A9009C"><enum>(d)</enum><header>Application</header><text>The requirements of this section shall apply to any recreational vessel manufactured after the date
			 that is 180 days after the date of the enactment of this Act.</text>
			</subsection></section><section id="H75B1F98F945D448AA8ABE1142AF2A3CA"><enum>4.</enum><header>State recreational boating safety programs</header>
			<subsection id="H9008F831E0344CBF858F6518F7ECDCF7"><enum>(a)</enum><header>Program acceptance</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/13103">Section 13103</external-xref> of title 46, United States Code, is amended—</text>
				<paragraph id="H6DD303FC2CFB4E4CB0B6B1D43D93C464"><enum>(1)</enum><text>in subsection (c)—</text>
					<subparagraph id="HABDC27A1CED7490790B9BF3B1BE5439C"><enum>(A)</enum><text>in paragraph (4) by striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="H81830615AD2943F6A5BE1722C4FC13A6"><enum>(B)</enum><text>in paragraph (5) by striking the period at the end and inserting <quote>; and</quote>; and</text>
					</subparagraph><subparagraph id="H6A3D87F36AA945D49D6E950711C48244"><enum>(C)</enum><text>by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H4FEFB0173C66471D90456B29DA77C033" style="USC">
							<paragraph id="HF093AFF5BC594A93A2E41D95584604ED"><enum>(6)</enum><text display-inline="yes-display-inline">contracting practices in accordance with subsection (e).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HA651C95EA18E4A7DB3FAB762D25BFD0F"><enum>(2)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H8D3E3BAB656D4D06BC6764235287C4F4" style="USC">
						<subsection id="H4D6926E5438A45848903FF96BBF40C8E"><enum>(e)</enum><header>Contracting</header>
							<paragraph id="HE35A40C46DCA4F9EA2D2C97A738E4F2F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A State carrying out a State recreational boating safety program may enter into a contract with a
			 local government or private entity to have the government or entity
			 provide boating safety education services under the program.</text>
							</paragraph><paragraph id="H12BF43C64A484011A8B3EBBC17808D58"><enum>(2)</enum><header>Expenditure requirement</header><text display-inline="yes-display-inline">Each fiscal year, a State carrying out a State recreational boating safety program shall expend on
			 contracts described in paragraph (1) not less than 5 percent of the
			 Federal amounts received by that State in that fiscal year under this
			 chapter.</text>
							</paragraph><paragraph commented="no" id="H3E132D2AC4374626B0686A2A3E2A1324"><enum>(3)</enum><header>Considerations</header><text>In entering into contracts under paragraph (1), a State shall consider—</text>
								<subparagraph commented="no" id="H1925D015C3EE4936A6A6BCEF85D11F4A"><enum>(A)</enum><text>the need for geographic diversity among the local governments and private entities providing
			 education services under the contracts;</text>
								</subparagraph><subparagraph commented="no" id="HF69FD80F4383427DBD29A94B2DF03484"><enum>(B)</enum><text>the need to have education services that address the various vessels utilized in the State;</text>
								</subparagraph><subparagraph commented="no" id="H11A115267BFE4715953F21AA5D2F7AF7"><enum>(C)</enum><text>the need to have education services that address the various waterways in the State; and</text>
								</subparagraph><subparagraph commented="no" id="H204D75B40D1D4BF799AE4056D0A09AE6"><enum>(D)</enum><text>all the costs related to providing education services under the contracts that may affect the local
			 governments and private entities providing the services.</text>
								</subparagraph></paragraph><paragraph id="HA0CC62A49F14474F8BB3DE02510CF2C8"><enum>(4)</enum><header>Eligibility</header>
								<subparagraph id="H08B6B1EE652E4F9CA4D327DE1EC5272B"><enum>(A)</enum><header>In general</header><text>To be eligible to enter into a contract under paragraph (1), a local government or private entity
			 shall—</text>
									<clause id="H3C21A9EB68724DCCA67446A8F437B0A1"><enum>(i)</enum><text>submit to the appropriate State lead authority or agency designated under subsection (a)(4) a
			 detailed proposal for the provision of boating safety education services;
			 and</text>
									</clause><clause id="HBD5742CE386D41FDA06B9F5046F580EB"><enum>(ii)</enum><text>certify that the government or entity will not profit financially from providing the services.</text>
									</clause></subparagraph><subparagraph commented="no" id="HA83B2FD1C5BB4FC58BACC226365FA5DC"><enum>(B)</enum><header>Exceptions</header>
									<clause commented="no" id="H5E226F5871074A59BF901977F5512507"><enum>(i)</enum><header>Existing providers</header><text display-inline="yes-display-inline">Subparagraph (A)(i) does not apply to a local government or private entity that provided boating
			 safety education services before the date of enactment of this subsection
			 under standards established by the relevant State.</text>
									</clause><clause commented="no" id="H6F676645667241AAA72EE946334259DB"><enum>(ii)</enum><header><enum-in-header>501(c)(3)</enum-in-header> organizations</header><text>Subparagraph (A)(ii) does not apply to an organization described in section 501(c)(3) of the
			 Internal Revenue Code of 1986 and exempt from taxation under section
			 501(a) of such Code if the organization certifies to the relevant State
			 that all relevant profits will be used to advance boating safety.</text>
									</clause></subparagraph></paragraph><paragraph id="HAE08E1EAFEE946FE8DA514D3DA1C1853"><enum>(5)</enum><header>Education services criteria</header><text>The Secretary, in consultation with States and relevant stakeholders, shall establish criteria for
			 the boating safety education services provided by local governments and
			 private entities under this subsection. Using the criteria, a State shall
			 establish outlines specifying the requirements for education services in
			 that State and education services in that State shall be provided in
			 accordance with the outlines.</text>
							</paragraph><paragraph commented="no" id="HE5D39E5D27874FCD9D6C129BA9616902"><enum>(6)</enum><header>Additional contracting</header><text>A local government that enters into a contract under paragraph (1) to provide boating safety
			 education services may contract with a private entity to receive
			 assistance with the provision of those services.</text>
							</paragraph><paragraph id="H68B33E792435446CBA435AB0646DB7E8"><enum>(7)</enum><header>Advertising</header><text>A local government or private entity that enters into a contract under paragraph (1) to provide
			 boating safety education services may utilize funds provided under that
			 contract to advertise such services.</text>
							</paragraph><paragraph id="H486DB7B5BF1C47E18C6C794DEA8A98D6"><enum>(8)</enum><header>Report</header><text>Each fiscal year, a State that entered into contracts under this subsection shall submit to the
			 Secretary a report specifying the governments and entities contracted with
			 in that fiscal year.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HBC200A74CF7C487DB1A70AC97FB5C743"><enum>(b)</enum><header>Sport Fish Restoration and Boating Trust Fund</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/9504">Section 9504(b)(2)(A)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>the MAP–21</quote> and inserting <quote><short-title>Boating Occupancy and Teaching Safety Act</short-title></quote> .</text>
			</subsection></section></legis-body>
