<official-title>To allow certain student loan borrowers to refinance Federal student loans.</official-title>

<section id="H5258814C300D4424B1996570DFD2AF7A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Student Loan Refinancing Act</short-title></quote>.</text></section>
<section id="HDA6BF66761B74415850A7242DA0467F9"><enum>2.</enum><header>Student loan consolidation</header><text display-inline="no-display-inline">Section 459B of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087i-2">20 U.S.C. 1087i–2</external-xref>) is amended—</text>
<paragraph id="H3D82146E1D69411AB3A51CD60ADF5615"><enum>(1)</enum><text>in subsection (a)(3), by striking <quote>section</quote> and inserting <quote>subsection</quote>;</text></paragraph>
<paragraph id="H1E7758B777EC402FAD29F08225492813"><enum>(2)</enum><text>in subsection (b), by striking <quote>this section</quote> and inserting <quote>subsection (a)</quote> each place the term appears; and</text></paragraph>
<paragraph id="HD9BA2B876D1A454C8FFB5C41CFDF366A"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting at the end the following:</text>

<subsection id="HD9538685B8174B68948311454BBD0608"><enum>(c)</enum><header>Temporary Loan Consolidation Authority for certain loans made after July 1, 2006</header>
<paragraph id="HB7520135DEF84FE19D1B67A7B53185A4"><enum>(1)</enum><header>Loan consolidation authority</header>
<subparagraph id="HFA397C7A0B6B40F9AE708D7695FDD042"><enum>(A)</enum><header>In General</header><text display-inline="yes-display-inline">A borrower who has 1 or more loans in a category described in subparagraph (B) may consolidate all of the loans of the borrower that are described in subparagraph (B) into a Federal Direct Consolidation Loan during the period described in subparagraph (C).</text></subparagraph>
<subparagraph id="HD8F82EC89C294B8E9A25BCE561FD758C"><enum>(B)</enum><header>Categories of loans that may be consolidated</header><text display-inline="yes-display-inline">The categories of loans that may be consolidated under subparagraph (A) are loans made on or after July 1, 2006, that are—</text>
<clause id="H756BA45805ED48EE875B7F10C3D62CEA"><enum>(i)</enum><text display-inline="yes-display-inline">loans made under this part;</text></clause>
<clause id="H4BC46165068E4FD7866538B5276008B0"><enum>(ii)</enum><text display-inline="yes-display-inline">loans purchased by the Secretary pursuant to section 459A; and</text></clause>
<clause id="H65B9AE4549FA4E44879F14E798346D09"><enum>(iii)</enum><text display-inline="yes-display-inline">loans made under part B that are held by an eligible lender, as such term is defined in section 435(d).</text></clause></subparagraph>
<subparagraph id="HB4912CA6204048A98A67D090E31AA9FE"><enum>(C)</enum><header>Time period in which loans may be consolidated</header>
<clause id="H5211A1400ECB4C58ACF302EA3A30BA13"><enum>(i)</enum><header>Federal Direct Loans</header><text>In the case of a borrower who has 1 or more loans described under subparagraph (B)(i), the Secretary shall—</text>
<subclause id="HB270D0DDF0FA4AD68C882C20B0629FC4"><enum>(I)</enum><text>consolidate the loans described under subparagraph (B)(i) not later than 90 days after the date of enactment of the <short-title>Federal Student Loan Refinancing Act</short-title>; and</text></subclause>
<subclause id="H9EA7BEF646D948B18B17433A8DD2FE1F"><enum>(II)</enum><text>notify the borrower, in writing, prior to such consolidation that—</text>
<item id="H73355F53029B4EE7A62437989DFF6D77"><enum>(aa)</enum><text>the borrower's loans under this part have been consolidated at a lower interest rate; and</text></item>
<item id="H36DE81DB60B341BF8C51D202DD9274DB"><enum>(bb)</enum><text>the borrower's repayment plan and the other terms and conditions of the borrower's loan remain unchanged.</text></item></subclause></clause>
<clause id="HD9CE42C5C4BF48A6BDB7028039A3C893"><enum>(ii)</enum><header>Other Loans</header><text>In the case of a borrower who has 1 or more loans described under clause (ii) or (iii) of subparagraph (B), the Secretary shall—</text>
<subclause id="H540DDF4E9B1C4D67ADE57292AF42BF9A"><enum>(I)</enum><text>initiate the loan consolidation process for the loans described under clause (ii) or (iii) of subparagraph (B), not later than 90 days after the date of enactment of the <short-title>Federal Student Loan Refinancing Act</short-title>, by sending a completed loan consolidation application to the borrower;</text></subclause>
<subclause id="H1D9543E944DF421699B2187F0BFA4C93"><enum>(II)</enum><text>notify the borrower, as part of such application, that a fee will be assessed and that the interest rate of the Federal Direct Consolidation Loan will be set in accordance with paragraph (2); and</text></subclause>
<subclause id="HFF54EEA97E5B4D14A7509431DE2F73D7"><enum>(III)</enum><text>notify the borrower, as part of such application, that if the borrower wishes to consolidate in accordance with the completed application, the borrower must endorse the application and submit the application to the Secretary not more than 6 months after receipt of the application.</text></subclause></clause></subparagraph></paragraph>
<paragraph id="HAFA457F2628C43D2972AF0DD281A764C"><enum>(2)</enum><header>Terms of loans</header><text>The following terms and conditions shall apply to a Federal Direct Consolidation Loan made under this subsection:</text>
<subparagraph id="H0FE1CA5161BF4C2789212C43759E27B9"><enum>(A)</enum><text>The applicable rate of interest on a Federal Direct Consolidation Loan made under this subsection shall be—</text>
<clause id="H56BA95AC4E3D4747BECA2D14FF2DB046"><enum>(i)</enum><text>4 percent; or</text></clause>
<clause commented="no" id="H31F33A8501B24AB5AA49D0D1A31A2F2D"><enum>(ii)</enum><text>in a case in which the weighted average of the interest rates on the outstanding loans of a borrower that will be consolidated is less than 4 percent, the lesser of—</text>
<subclause commented="no" id="H827BDC8081D14CCEBC522329BAD9913D"><enum>(I)</enum><text>the weighted average of the interest rates on the outstanding loans of a borrower that will be consolidated; or</text></subclause>
<subclause commented="no" id="HDB012F608C9B4E7FAB6A4F485B4226AF"><enum>(II)</enum><text>a rate of interest equal to—</text>
<item commented="no" id="H6D7FED4A57314F41BE9B48832F3051C8"><enum>(aa)</enum><text>4 percent; minus</text></item>
<item commented="no" id="HEE456435F9BB48E09CC30EFD66961DB3"><enum>(bb)</enum><text>0.4 percent of the principal balance of the consolidation loan, at the time of consolidation.</text></item></subclause></clause></subparagraph>
<subparagraph id="H9200D8CE24D14DECB8EE41F15B15EBAE"><enum>(B)</enum><text>In the case of a loan consolidated under paragraph (1)(C)(ii), an origination fee equal to 0.4 percent of the principal balance of the consolidation loan, at the time of consolidation, will be added to the principal balance of the loan, and the Secretary shall use the fee to cover the cost of making and servicing the loan.</text></subparagraph>
<subparagraph id="HA7E447F019B14670ACDBE6302CA35385"><enum>(C)</enum><text>If 1 or more of the loans being consolidated is a loan described under subparagraph (B)(iii), the interest rate on the Federal Direct Consolidation Loan under this subsection shall be reduced by 0.25 percent.</text></subparagraph>
<subparagraph id="H3C2A45A3FE8749F185F42D68B379185D"><enum>(D)</enum><text>Any benefit a borrower is receiving or earning at the time a Federal Direct Consolidation loan is issued under this subsection shall not be affected by consolidation under this section, including benefits such as a deferment or forbearance, accumulation of monthly payments as part of the public service loan forgiveness program under section 455(m), accumulation of monthly payments toward a loan discharge under the income-based repayment plan under section 493C, participation in a particular repayment plan, and other benefits to the borrower.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="H5D6F089472FB4DD4A44C4BF6B897D6D5"><enum>3.</enum><header>Exemptions from other laws</header>
<subsection id="H6565117A43F648E787337F0790419AEB"><enum>(a)</enum><header>Exemption from the Paperwork Reduction Act</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">Chapter 35</external-xref> of title 44, United States Code, shall not apply to this Act.</text></subsection>
<subsection id="H1F939F2A3721432FA74EAA6F3C503496"><enum>(b)</enum><header>Inapplicability of rulemaking requirements</header><text>Sections 482(c) and 492 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1089">20 U.S.C. 1089(c)</external-xref>, 1098a) and <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code, shall not apply to the amendments made by this Act, or to any regulations promulgated under such amendments.</text></subsection></section>
