<official-title>To direct the Secretary of Veterans Affairs to carry out a pilot program to provide veterans the option of using an alternative appeals process to more quickly determine claims for disability compensation.</official-title>

<section id="H6224CD1667CE4965B790D21E29DA92AC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Express Appeals Act</short-title></quote>.</text></section> 
<section id="HDDA0C0DF13744346AE52D70382BB7E1C" section-type="subsequent-section"><enum>2.</enum><header>Pilot program on express appeals</header> 
<subsection id="H0779CA43673A43E0B335A0BF5FB32F56"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall carry out a pilot program to provide the option of an alternative appeals process that shall more quickly determine such appeals in accordance with this section.</text></subsection> 
<subsection id="H37CB1E46F888408C8966E16AD6666B90"><enum>(b)</enum><header>Election</header> 
<paragraph id="H8C868083418141E6904EEAAA9272A063"><enum>(1)</enum><header>Filing</header><text display-inline="yes-display-inline">In accordance with paragraph (2), a claimant may elect to file an express appeal under the pilot program under subsection (a) by filing with the Secretary the following:</text> 
<subparagraph id="H14D120BD91C948D991605B1B173F08CD"><enum>(A)</enum><text>The notice of disagreement under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/71">chapter 71</external-xref> of title 38, United States Code.</text></subparagraph> 
<subparagraph id="HCCDF981A637C422EA37CB8B612E4BDA0"><enum>(B)</enum><text>All evidence that the claimant believes is needed for the appeal as of the date of the filing.</text></subparagraph> 
<subparagraph id="H6910F0B7DCC94845B3E8B7E7D08B4086"><enum>(C)</enum><text>A statement of the argument in support of the claim, if any. </text></subparagraph> 
<subparagraph id="H65A14663FE2240B7A16C0DC55DE4D812"><enum>(D)</enum><text>The written election of the claimant to have the appeal determined under the pilot program.</text></subparagraph></paragraph> 
<paragraph id="H7299E9422A284295B1018A072E4140DF"><enum>(2)</enum><header>Timing</header><text>A claimant shall make an election under paragraph (1)—</text> 
<subparagraph id="H70E1FBABF03B489A8B65585CF94A98A4"><enum>(A)</enum><text display-inline="yes-display-inline">if the claimant has filed a traditional appeal with respect to the claim for disability compensation before the date on which the pilot program under subsection (a) commences, at any time during the traditional appeal process; or</text></subparagraph> 
<subparagraph id="H945477314707491FB603AFD0A95BCA25"><enum>(B)</enum><text display-inline="yes-display-inline">if the claimant has not so filed a traditional appeal with respect to the claim for disability compensation before such date, by not later than 90 days after the date on which the Secretary provides to the claimant the notice of the determination of the claim.</text></subparagraph></paragraph> 
<paragraph id="HA81D231FD1D94689888C38CC6D4537C0" commented="no"><enum>(3)</enum><header>Change of processing</header><text>If a claimant described in paragraph (2)(A) seeks to elect to make an election under paragraph (1) to change a traditional appeal to an express appeal, the Secretary shall—</text> 
<subparagraph id="H189094088369466FA34573017B0C84E4" commented="no"><enum>(A)</enum><text>inform the claimant of whether, in light of such traditional appeal being processed, the claimant will achieve any time savings through such an express appeal; and</text></subparagraph> 
<subparagraph id="H546994CFA95E459687BE1F2004E95728" commented="no"><enum>(B)</enum><text>if the claimant elects to file such express appeal, process the express appeal in accordance with this section to the extent practicable.</text></subparagraph></paragraph> 
<paragraph id="H1CC52245DAD64326A92130ED96C3829B" commented="no"><enum>(4)</enum><header>Reversion</header><text>At any time, a claimant who makes an election under paragraph (1) may elect to revert to the traditional appeals process without any penalty to the claimant other than the loss of the docket number associated with the express appeal.</text></paragraph> 
<paragraph id="HEE0464BC2C644F40B5920207B8FBD1E0"><enum>(5)</enum><header>Use of express appeal</header><text display-inline="yes-display-inline">A claimant may only make an election under paragraph (1) with respect to a claim for disability compensation filed by the claimant that is not, with respect to a claim previously decided by express appeal, a petition to reopen the claim or a separate claim for an increased rating for the claim.</text></paragraph> 
<paragraph id="H04245BCB8FFF40F9A5041FE74F56FCBE" commented="no"><enum>(6)</enum><header>Outreach</header><text>In providing claimants with notices of the determination of a claim during the period in which the pilot program under subsection (a) is carried out, the Secretary shall provide to the claimant information regarding—</text> 
<subparagraph id="H24200521A37941B08BB4B35DB0FA44E3" commented="no"><enum>(A)</enum><text>the pilot program;</text></subparagraph> 
<subparagraph id="H9660DD6087F64F2AA238AD2BD4816E9F" commented="no"><enum>(B)</enum><text>how to make an election under paragraph (1);</text></subparagraph> 
<subparagraph id="H9378B590476D4121A4D37B9A31D1F563" commented="no"><enum>(C)</enum><text>what documents the claimant must provide during the course of the appeals process; and</text></subparagraph> 
<subparagraph id="H7BBD28A8F4C44F24AD03778A4324D4A0" commented="no"><enum>(D)</enum><text>the ability of the claimant to seek advice and education regarding such process from veterans service organizations and attorneys recognized under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/59">chapter 59</external-xref> of title 38, United States Code.</text></subparagraph></paragraph></subsection> 
<subsection id="H5CA4E711FBEE4958854DFD82DC4DB4EC"><enum>(c)</enum><header>Treatment by Department and Board</header> 
<paragraph id="H59AE83A76F3C4A1EA0E7C34F290DA6FF"><enum>(1)</enum><header>Process</header><text display-inline="yes-display-inline">Upon the election of a claimant to file an express appeal pursuant to subsection (b)(1), the Secretary shall—</text> 
<subparagraph id="H4F65BACB072748219613D0C31FC67E29"><enum>(A)</enum><text>not provide the claimant with a statement of the case nor require the claimant to file a substantive appeal; and</text></subparagraph> 
<subparagraph id="HF2608C487177445BB02B26EAFD199D3F"><enum>(B)</enum><text>transfer jurisdiction over the express appeal directly to the Board of Veterans’ Appeals.</text></subparagraph></paragraph> 
<paragraph id="H26712E62A46546DB87170E4298556F07" commented="no"><enum>(2)</enum><header>Docket</header><text display-inline="yes-display-inline">The Board of Veterans’ Appeals shall—</text> 
<subparagraph id="H63757FAB21B044F7B5A91EC79DA140CF"><enum>(A)</enum><text>maintain express appeals on a separate docket than traditional appeals;</text></subparagraph> 
<subparagraph id="HE7FF45A6C2CD4D34A885CAC3A8645222"><enum>(B)</enum><text>hear express appeals in the order that the express appeals are received on the express appeal docket; and</text></subparagraph> 
<subparagraph id="HFD802D669A5A494EAB32F26175ABB11E"><enum>(C)</enum><text>decide not more than one express appeal for each four traditional appeals decided.</text></subparagraph></paragraph> 
<paragraph id="H50D47F1D220E4850964E24531FE3ADEC" commented="no"><enum>(3)</enum><header>New evidence</header> 
<subparagraph id="HF36BD740624248A4B9DC151992E6F986" commented="no"><enum>(A)</enum><text>If a claimant submits to the Board of Veterans’ Appeals any new evidence relating to an express appeal after filing such appeal, the claimant may—</text> 
<clause id="HDD507D8F9E6541DA8714F7A28B784937" commented="no"><enum>(i)</enum><text>revert to the traditional appeals process pursuant to subsection (b)(4) and use such new evidence during the course of such process; or</text></clause> 
<clause id="H37F5FA05BFA947438E668466ED600636" commented="no"><enum>(ii)</enum><text>withdraw such new evidence and continue the express appeal.</text> </clause></subparagraph> 
<subparagraph id="H37C2A2C13C2F418E8F256EA4CB64D144" commented="no"><enum>(B)</enum><text>If a claimant withdraws new evidence pursuant to subparagraph (A)(ii), the Secretary shall inform the claimant, after the Board decides the express appeal, of the ability of the claimant to use such new evidence as the basis for a petition to reopen the claim or as a separate claim for an increased rating.</text></subparagraph></paragraph> 
<paragraph id="H67D739B7DB6148E3B1405EC525D0B557"><enum>(4)</enum><header>Prohibition on remand to regional office</header><text display-inline="yes-display-inline">If the Board of Veterans’ Appeals determines that an express appeal requires additional information, including any medical examination, the Board shall—</text> 
<subparagraph id="H2441A8E6ABDB4169848B4318AFFC695E"><enum>(A)</enum><text>direct the Veterans Benefits Administration to take such actions as may be necessary to develop such information;</text></subparagraph> 
<subparagraph id="H74F2B68180604DE689EDFCF470380EB5"><enum>(B)</enum><text display-inline="yes-display-inline">retain jurisdiction of the express appeal without requiring a determination by the Veterans Benefits Administration based on such information;</text></subparagraph> 
<subparagraph id="HD97B9B3C4BB548FB915475CBA17DD47B"><enum>(C)</enum><text>direct the Veterans Benefits Administration to ensure the claimant receives a copy of such information; and</text></subparagraph> 
<subparagraph id="HF02B2F8679554DC58B8517F3E70564E5"><enum>(D)</enum><text>provide the claimant a period of 45 days after the receipt of such information to provide the Board any additional evidence.</text></subparagraph></paragraph> 
<paragraph id="H8328EA7107B2432AA045C4ACA75D70B6" commented="no"><enum>(5)</enum><header>Hearings</header><text display-inline="yes-display-inline">Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/38/7107">section 7107</external-xref> of title 38, United States Code, the Board of Veterans’ Appeals may not provide hearings with respect to express appeals. A claimant may request to hold a hearing pursuant to such section 7107 if the claimant reverts to the traditional appeals process pursuant to subsection (b)(4).</text></paragraph> </subsection> 
<subsection id="HD64B8AC7DE51466DBB27AA33DA835702"><enum>(d)</enum><header>Duration; application</header><text display-inline="yes-display-inline">The Secretary shall carry out the pilot program under subsection (a) for a five-year period beginning one year after the date of the enactment of this Act. This section shall apply only to express appeals that are filed during such period.</text></subsection> 
<subsection id="H71C9FAE3E215470CB9C49F6F61327996"><enum>(e)</enum><header>Reports</header><text display-inline="yes-display-inline">During each year in which the pilot program under subsection (a) is carried out, the Secretary shall submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate a report on the pilot program. The first such report shall be submitted by not later than 180 days after the date on which the pilot program commences.</text></subsection> 
<subsection id="H1B2134243BFF4C6C863A0017BF9191BE"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> 
<paragraph id="HD7594517D6984E28832E6B6B6025175D"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>claimant</term> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/38/5100">section 5100</external-xref> of title 38, United States Code.</text></paragraph> 
<paragraph id="HD1E12563D73B456697859D4CA6D8D633"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>compensation</term> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/38/101">section 101</external-xref> of title 38, United States Code.</text></paragraph> 
<paragraph id="HFF95FB1169B3475BBCF47F67D71A5A55" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>express appeal</term> means an appeal of a claim for disability compensation that is—</text> 
<subparagraph id="H22B5798DB92B406A918309C891D3F214"><enum>(A)</enum><text>filed by a claimant in accordance with subsection (b)(1); and</text></subparagraph> 
<subparagraph id="HEC468552BB804C6C9D6BC1FB1CE65B7D"><enum>(B)</enum><text>considered in accordance with this section.</text> </subparagraph></paragraph> 
<paragraph id="HAE7EB9F6A4104D07B4A96DE70E098B84" commented="no"><enum>(4)</enum><text>The term <term>traditional appeal</term> means an appeal of a claim for disability compensation that is not an express appeal.</text> </paragraph></subsection> </section>
