<legis-type>A BILL</legis-type> 
<official-title>To amend the Consumer Financial Protection Act of 2010 to create a consumer opt-out list for data collected by the Bureau, to put time limits on data held by the Bureau, and for other purposes.</official-title>

<section id="HDC0662FBA7B44FD7A0E2562D547BC169" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>CFPB Data Collection Security Act</short-title></quote>.</text></section> 
<section id="HD1741E6C80D4496384098B61B23BAD65"><enum>2.</enum><header>Collection and disposal of consumer information</header><text display-inline="no-display-inline">Section 1022(c) of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5512">12 U.S.C. 5512(c)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="HF78952E404DA40569AE5B29233B827A8"><enum>(10)</enum><header>Opt-out list for data collection</header> 
<subparagraph id="HBAFACFE169D640B8B301D3F656AE2940"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Bureau shall establish an opt-out list, which shall contain a list of consumers who have notified the Bureau that they do not wish to allow the Bureau to collect personally identifiable information about them.</text></subparagraph> 
<subparagraph id="H6C645385D95A4864975C6B36AD225C34"><enum>(B)</enum><header>Availability of list</header><text>The Bureau shall provide consumers with a method of adding and removing their names from the opt-out list both over the phone and on the website of the Bureau.</text></subparagraph> 
<subparagraph id="H93914D2F38C54B878D4FA0E0E656554E"><enum>(C)</enum><header>Prohibition on data collection</header> 
<clause id="H2D10DEA362FF48B0913C878ADA878BA5"><enum>(i)</enum><header>In general</header><text>The Bureau may not collect personally identifiable information about a consumer if the consumer is listed on the opt-out list.</text> </clause> 
<clause id="H2E211EBB51004FC6B4ABC374E0C3F6AD"><enum>(ii)</enum><header>Exception for consumer complaints</header> 
<subclause id="HCD18C5CF944B4F2DBBA5E465115C320D"><enum>(I)</enum><header>In general</header><text>This subparagraph shall not apply with respect to consumer complaints.</text></subclause> 
<subclause id="HB0DB3560878F4CA9899E36D3306E00F5"><enum>(II)</enum><header>Use of data</header><text>Personally identifiable information contained in a consumer complaint with respect to a consumer that is listed on the opt-out list may not be used for any purpose other than the consumer complaint, including supervisory functions or market monitoring.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="HE2C0B7BCC07F47C68008AFF079F73EA8"><enum>(11)</enum><header>Timing limitation on data held by the Bureau</header><text display-inline="yes-display-inline">The Bureau shall delete or otherwise destroy—</text> 
<subparagraph id="HF882597E530744BE88D5C2990FD14CC8"><enum>(A)</enum><text display-inline="yes-display-inline">any information related to a consumer complaint regarding consumer financial products or services, not later than the end of the 60-day period following the completion of any review into such complaint where no further action will be taken;</text></subparagraph> 
<subparagraph id="H488C025970C145538C116B0E441348D8"><enum>(B)</enum><text display-inline="yes-display-inline">any reports issued by, or data collected while conducting an examination of, any covered person, depository institution, or credit union over which the Bureau has supervisory authority, after three examinations, except for enforcement actions that specifically address payments to consumers; and</text></subparagraph> 
<subparagraph id="H5B46FE84AB424A21AB8C04CD0D5A7879"><enum>(C)</enum><text>any information collected by the Bureau about a particular consumer or other person not described under subparagraph (A) or (B), not later than the 60-day period following the date on which the Bureau collected such information.</text></subparagraph></paragraph> 
<paragraph id="H29B9A90AEB75410C86096E82E6F7F1EB"><enum>(12)</enum><header>Requirement in event of privacy breach</header><text display-inline="yes-display-inline">If the Bureau experiences a data breach that exposes personally identifiable information about a consumer, the Bureau shall provide such consumer with one year of free credit monitoring and publicly notify consumers of the breach on the front page of the Bureau’s website.</text></paragraph> 
<paragraph id="HCC705C2C74974C2CBF01B91EC29AF8DC"><enum>(13)</enum><header>Requirement for Senate-confirmed Director</header><text>Notwithstanding any other provision of law, the Bureau may not collect any data or perform any market monitoring unless the Bureau has a Senate-confirmed Director. </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H8300132BAD134CC485F61B62345BCC9E"><enum>3.</enum><header>Personnel requirement</header><text display-inline="no-display-inline">Section 1013(a) of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5493">12 U.S.C. 5493(a)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="HE4F0FBDFBC8F4874B73111EE0D42AC7E"><enum>(6)</enum><header>Confidential security clearance required for certain employees</header><text display-inline="yes-display-inline">No employee of the Bureau may access personally identifiable information collected by the Bureau unless such employee holds a <quote>confidential</quote> security clearance. </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </section>
