		<official-title>To require the Secretary of Transportation to establish and implement a fatigue management plan,
			 and for other purposes.</official-title>

		<section id="HC8398F12478243E487C9652BE81DD636" section-type="section-one"><enum>1.</enum><header>Functioning alerter</header><text display-inline="no-display-inline">Not later than 30 days after the date of enactment of this Act, the Secretary of Transportation
			 shall issue such regulations as are necessary to ensure that all
			 controlling locomotives operated at speeds in excess of 25 mph, regardless
			 of the date on which the locomotive is placed in service for the first
			 time, are equipped with a functioning alerter as described in paragraphs
			 (b) through (d) of <external-xref legal-doc="usc" parsable-cite="usc/49/229">section 229.140</external-xref> of title 49, Code of Federal
			 Regulations.</text>
		</section><section id="H651609A09A6D45BC97FA5CB58BE5D36E"><enum>2.</enum><header>Fatigue management plan</header>
			<subsection id="HD2163ACB14854670A9E37C50EEFED360"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the Secretary of Transportation
			 shall require all railroad carriers to establish and implement a fatigue
			 management plan that identifies and evaluates any fatigue related railroad
			 safety hazards on its system and determine the degree of risk associated
			 with each hazard.</text>
			</subsection><subsection id="HB32DCC9181AD409895395789E3F6F234"><enum>(b)</enum><header>Contents</header><text>The plan required under subsection (a) shall—</text>
				<paragraph id="H49C80D69FC864875865BE34C164979AB"><enum>(1)</enum><text>be completed in accordance with the requirements in <external-xref legal-doc="usc" parsable-cite="usc/49/20156">section 20156(f)</external-xref> of title 49, United States
			 Code; and</text>
				</paragraph><paragraph id="HDAA72429EC494A5DB46C7F13FEFBFE00"><enum>(2)</enum><text>include consideration of sleep disorders, continuing treatment, and management of those risks in
			 order to reduce fatigue experienced by operating railroad employees.</text>
				</paragraph></subsection><subsection id="HC7BCF1EF9BA24F15A063EA975BF309A7"><enum>(c)</enum><header>Submission</header><text display-inline="yes-display-inline">The plan required under subsection (a) shall be submitted to the Secretary for approval.</text>
			</subsection><subsection id="H471735D624264566950E21E969FCF4AD"><enum>(d)</enum><header>Consensus</header><text>In preparing the plan required under subsection (a), each railroad shall use good faith and best
			 efforts in accordance with section 20156(g) of such title to reach an
			 agreement with affected employees.</text>
			</subsection></section><section id="H9ED20413ECCC4913B5DDB5AA8E023210"><enum>3.</enum><header>Positive train control report</header>
			<subsection id="HB9A060D5C84441A9998FE3D444DABC2B"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this Act, and biannually thereafter, the
			 Secretary of Transportation shall require any railroad carrier
			 implementing a positive train control system in accordance with section
			 20157 of title 49, United States Code, to submit to the Secretary a report
			 regarding the status of the progress of the implementation.</text>
			</subsection><subsection id="H0C4BB694D685429296F587ED2D0D9085"><enum>(b)</enum><header>Submission to Congress</header><text>Upon receipt of the report under subsection (a), the Secretary shall submit the report to Congress.</text>
			</subsection></section><section id="HF0D9146322AE472187E581E102A35563"><enum>4.</enum><header>Redundant signal protection</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Transportation
			 shall issue such regulations as are necessary to require that on-track
			 safety programs, as described in subpart C of part 214 of title 49, Code
			 of Federal Regulations, include requiring implementation of redundant
			 signal protection, such as shunting, for maintenance-of-way work crews who
			 depend on a train dispatcher to provide signal protection.</text>
		</section><section id="HC2249F49909B4A648F9B0D4613A2CFF4"><enum>5.</enum><header>Hours of service</header>
			<subsection id="HBD67F087D9844EE78CAC1F195C5125FE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Transportation
			 shall ensure that railroad carriers provide railroad employees with
			 predictable and defined work and rest schedules. Predictable work
			 schedules for railroad employees means either a defined start time or a
			 minimum of 10 hours prior notification before being required to report to
			 duty.</text>
			</subsection><subsection id="H2D766525B132498F87BCF347C57E5C10"><enum>(b)</enum><header>Supplemental regulation</header><text display-inline="yes-display-inline">Any requirement under subsection (a) shall supplement, and not supplant, the requirements of
			 <external-xref legal-doc="usc" parsable-cite="usc/49/21103">section 21103</external-xref> of title 49, United States Code.</text>
