			<subsection id="H58C17BC1B7BF46C2BFDBBC737CF48C8A"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>International Megan’s Law to Prevent Demand for Child Sex Trafficking</short-title></quote>.</text>

			</subsection></section><section id="H96A6C93A394A42B6B293990E5294ACB7"><enum>2.</enum><header>Findings</header>
			<text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="HE8AE3AE451D14FE5A942832D3CD5D3C0"><enum>(1)</enum><text>Megan Nicole Kanka, who was 7 years old, was abducted, sexually assaulted, and murdered in 1994, in
			 the State of New Jersey by a violent predator living across the street
			 from her home. Unbeknownst to Megan Kanka and her family, he had been
			 convicted previously of a sex offense against a child.</text>
			</paragraph><paragraph id="H8E0B108380F244B794300E8C087B1243"><enum>(2)</enum><text>In 1996, Congress adopted Megan’s Law (<external-xref legal-doc="public-law" parsable-cite="pl/104/145">Public Law 104–145</external-xref>) as a means to encourage States to
			 protect children by identifying the whereabouts of sex offenders and
			 providing the means to monitor their activities.</text>
			</paragraph><paragraph id="H176AE284858B464A898B684C087ABA2D"><enum>(3)</enum><text>Law enforcement reports indicate that known child-sex offenders are traveling internationally, and
			 that the criminal background of such individuals may not be known to local
			 law enforcement prior to their arrival.</text>
			</paragraph><paragraph id="H7207CA960C6240EBA59F4DFD070190E9"><enum>(4)</enum><text>The commercial sexual exploitation of minors in child sex trafficking and pornography is a global
			 phenomenon. The International Labour Organization has estimated that 1.8
			 million children worldwide are victims of child sex trafficking and
			 pornography each year.</text>
			</paragraph><paragraph id="H22EC8300BC0B4B0EBA3B29B88F95B032"><enum>(5)</enum><text>Child sex tourism, where an individual travels to a foreign country and engages in sexual activity
			 with a child in that country, is a form of child exploitation and, where
			 commercial, child sex trafficking.</text>
			</paragraph><paragraph id="H380763D2C928429CB455BBF4E6DAB88B"><enum>(6)</enum><text display-inline="yes-display-inline">According to research conducted by The Protection Project of The Johns Hopkins University Paul H.
			 Nitze School of Advanced International Studies, sex tourists from the
			 United States who target children form a significant percentage of child
			 sex tourists in some of the most significant destination countries for
			 child sex tourism.</text>
			</paragraph><paragraph id="H94D4DC4755444D939B21D760F6BA1845"><enum>(7)</enum><text>In order to protect children, it is essential that United States law enforcement be able to
			 identify child-sex offenders in the United States who are traveling abroad
			 and child-sex offenders from other countries entering the United States.
			 Such identification requires cooperative efforts between the United States
			 and foreign governments. In exchange for providing notice of child-sex
			 offenders traveling to the United States, foreign authorities will expect
			 United States authorities to provide reciprocal notice of child-sex
			 offenders traveling to their countries.</text>
			</paragraph></section><section commented="no" id="HC615D5728C0C412DB5DA144E4BECE6D4"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H2A5C7C841946424B963FBE1CC4F9B1DC"><enum>(1)</enum><header>Appropriate congressional committees</header><text>Except as otherwise provided, the term <term>appropriate congressional committees</term> means—</text>
				<subparagraph id="H33145F41826E4B0C96B790EE4F9876B0"><enum>(A)</enum><text>the Committee on Foreign Affairs, the Committee on the Judiciary, and the Committee on Homeland
			 Security of the House of Representatives; and</text>
				</subparagraph><subparagraph id="HD20549A780FC4FFB935492DFCBB14450"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Foreign Relations, the Committee on the Judiciary, and the Committee on Homeland
			 Security and Governmental Affairs of the Senate.</text>
				</subparagraph></paragraph><paragraph id="H0061A287A7434CA2996DD887E533F03A"><enum>(2)</enum><header>Center</header><text display-inline="yes-display-inline">The term <term>Center</term> means the Angel Watch Center established pursuant to section 4(a).</text>
			</paragraph><paragraph commented="no" id="HD3F2E47B884F42C199CEDF2EF52BBE3F"><enum>(3)</enum><header>Child-sex offender</header>
				<subparagraph id="HFAD5A83694B04476BDD7DA061EDB1308"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>child-sex offender</term> means a sex offender described in paragraph (2), (3), or (4) of section 111 of the Adam Walsh
			 Child Protection and Safety Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/42/16911">42 U.S.C. 16911</external-xref>) who is convicted
			 of a child-sex offense.</text>
				</subparagraph><subparagraph id="H5E11B36072B0492E92F7238F9F8C0E3C"><enum>(B)</enum><header>Definition of convicted</header><text>In this paragraph, the term <term>convicted</term> has the meaning given the term in paragraph (8) of section 111 of such Act.</text>
				</subparagraph></paragraph><paragraph id="H77B6FF0E8AB44BB4B167B89AB3302D14"><enum>(4)</enum><header>Child-sex offense</header>
				<subparagraph id="H002176366FAB41FC815F8B4EE39C3BDA"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>child-sex offense</term> means a specified offense against a minor as defined in paragraph (7) of section 111 of the Adam
			 Walsh Child Protection and Safety Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/42/16911">42 U.S.C. 16911</external-xref>),
			 including—</text>
					<clause id="H298CAB85DBD34E4C8A92183898A906DA"><enum>(i)</enum><text>an offense (unless committed by a parent or guardian) involving kidnapping;</text>
					</clause><clause id="HD41C78B602BF4F06AC509D4AE5960B7A"><enum>(ii)</enum><text>an offense (unless committed by a parent or guardian) involving false imprisonment;</text>
					</clause><clause id="H6FFC41E16D6B4CEEB23E05B73E80E9BE"><enum>(iii)</enum><text>solicitation to engage in sexual conduct;</text>
					</clause><clause id="H1FBE030CF8F9406D95B0027C11E4F759"><enum>(iv)</enum><text>use in a sexual performance;</text>
					</clause><clause id="H00EDA8C6086D42B797C7A923AC1EB727"><enum>(v)</enum><text>solicitation to practice prostitution;</text>
					</clause><clause id="HA9B55C5629994EA185996E284D7F8AAC"><enum>(vi)</enum><text>video voyeurism as described in <external-xref legal-doc="usc" parsable-cite="usc/18/1801">section 1801</external-xref> of title 18, United States Code;</text>
					</clause><clause id="HBE27E3258D1E48D5B544A6764508F2B8"><enum>(vii)</enum><text>possession, production, or distribution of child pornography;</text>
					</clause><clause id="HE2C0618EC65D43C4AC02CD28741DB91E"><enum>(viii)</enum><text>criminal sexual conduct involving a minor, or the use of the Internet to facilitate or attempt such
			 conduct; and</text>
					</clause><clause id="HA801F8EF031840D3B680D3D5E2B6D558"><enum>(ix)</enum><text>any conduct that by its nature is a sex offense against a minor.</text>
					</clause></subparagraph><subparagraph id="H1B7C17E273134032A3C029466F5D93F2"><enum>(B)</enum><header>Foreign convictions</header><text display-inline="yes-display-inline">A foreign conviction is not a child-sex offense for purposes of this Act to the same extent and in
			 the same manner as a foreign conviction is not a sex offense for purposes
			 of the Adam Walsh Child Protection and Safety Act of 2006 (42 U.S.C.
			 16911) as described in section 111(5)(B) of such Act.</text>
				</subparagraph></paragraph><paragraph commented="no" id="H390BE26F428E4D3F9E9BB77233A773C8"><enum>(5)</enum><header>Jurisdiction</header><text display-inline="yes-display-inline">The term <term>jurisdiction</term> means any of the following:</text>
				<subparagraph commented="no" id="HF31A70CC7D18412D9765734F67893751"><enum>(A)</enum><text>A State.</text>
				</subparagraph><subparagraph commented="no" id="H272C23F0A7A04766A93D8572F9591DD7"><enum>(B)</enum><text>The District of Columbia.</text>
				</subparagraph><subparagraph commented="no" id="H3665B4F2FE1D4E458B21B2911B953EA2"><enum>(C)</enum><text>The Commonwealth of Puerto Rico.</text>
				</subparagraph><subparagraph commented="no" id="H2345072700A643BCB3F608ADC9E7C8D2"><enum>(D)</enum><text>Guam.</text>
				</subparagraph><subparagraph commented="no" id="H45308DCC54A64F5BA99507999E68BD02"><enum>(E)</enum><text>American Samoa.</text>
				</subparagraph><subparagraph commented="no" id="H1403E0762BC741A2AEBF3B26709D6D83"><enum>(F)</enum><text>The Northern Mariana Islands.</text>
				</subparagraph><subparagraph commented="no" id="H8102C2AF374B463ABA5EA950388BFAAA"><enum>(G)</enum><text>The United States Virgin Islands.</text>
				</subparagraph><subparagraph commented="no" id="H87E9C46A5D2F45C78864B3D1F4A79904"><enum>(H)</enum><text display-inline="yes-display-inline">To the extent provided in, and subject to the requirements of, section 127 of the Adam Walsh Child
			 Protection and Safety Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/42/16927">42 U.S.C. 16927</external-xref>), a federally
			 recognized Indian tribe.</text>
				</subparagraph></paragraph><paragraph id="H89DF3501761348E6A83D5BD67FF9850D"><enum>(6)</enum><header>Minor</header><text>The term <term>minor</term> means an individual who has not attained the age of 18 years.</text>
			</paragraph><paragraph commented="no" id="H6FDE82979CD34ABEA252A7F758C1E50E"><enum>(7)</enum><header>Passport card</header><text>The term <term>passport card</term> means a document issued by the Department of State pursuant to section 7209 of the Intelligence
			 Reform and Terrorism Prevention Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/458">Public Law 108–458</external-xref>; 8 U.S.C.
			 1185 note).</text>
			</paragraph></section><section id="HD0EB8A9614C44FC3BC658B5E0CBAB123"><enum>4.</enum><header>Angel Watch Center</header>
			<subsection commented="no" id="H435F2103A2D04905A8921775E4D79284"><enum>(a)</enum><header>Establishment</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of Homeland
			 Security shall establish within the Child Exploitation Investigations Unit
			 of United States Immigration and Customs Enforcement (ICE) of the
			 Department of Homeland Security a Center, to be known as the <quote>Angel Watch Center</quote>, to carry out the activities specified in subsection (d).</text>
			</subsection><subsection commented="no" id="HCB14B0FCF0CF41638DBB518ADDF7D62F"><enum>(b)</enum><header>Leadership</header><text display-inline="yes-display-inline">The Center shall be headed by the Director of ICE, in collaboration with the Commissioner of United
			 States Customs and Border Protection (CBP) and in consultation with the
			 Attorney General.</text>
			</subsection><subsection id="H1E2EC637A305488896FA55377DA51AB6"><enum>(c)</enum><header>Members</header><text display-inline="yes-display-inline">The Center shall consist of the following:</text>
				<paragraph id="H0FF4075B0D0344ED9EAB5718030C0D95"><enum>(1)</enum><text display-inline="yes-display-inline">The Director of ICE.</text>
				</paragraph><paragraph id="H6AB607C269704204BB5AD747EACB1F6A"><enum>(2)</enum><text display-inline="yes-display-inline">The Commissioner of CBP.</text>
				</paragraph><paragraph id="HDC8924D33D3141668F467E70D05F48C9"><enum>(3)</enum><text>Individuals who are designated as analysts in ICE or CBP.</text>
				</paragraph><paragraph id="HE61483F4AD664310974B0D9F53219450"><enum>(4)</enum><text display-inline="yes-display-inline">Individuals who are designated as program managers in ICE or CBP.</text>
				</paragraph></subsection><subsection id="H49803CFF8A7F4B6497131CD8F99B829F"><enum>(d)</enum><header>Activities</header>
				<paragraph id="HDB5CA4A7365B40658F316CE489839729"><enum>(1)</enum><header>In general</header><text>The Center shall carry out the following activities:</text>
					<subparagraph id="HACA4E2C246ED4698B8080B2047AE263C"><enum>(A)</enum><text>Receive information on travel by child-sex offenders.</text>
					</subparagraph><subparagraph id="H4FEF58519EA84016B8EF494086BD9DF7"><enum>(B)</enum><text>Transmit notice of impending or current international travel by child-sex offenders to the
			 Secretary of State, accompanied by an advisory regarding whether or not
			 the period of validity of the passport of the child-sex offender should be
			 limited to one year or such period of time as the Secretary of State shall
			 determine appropriate.</text>
					</subparagraph><subparagraph id="H2F6AD572F86746008C7BFD20D7216957"><enum>(C)</enum><text display-inline="yes-display-inline">Establish a system to maintain and archive all relevant information, including the response of
			 destination countries to notifications under subsection (e) where
			 available, and decisions not to transmit notification abroad.</text>
					</subparagraph><subparagraph id="HE6E30E7DC902496FB40D565141F255C3"><enum>(D)</enum><text>Establish an annual review process to ensure that the Center is consistent in procedures to provide
			 notification to destination countries or not to provide notification to
			 destination countries, as appropriate.</text>
					</subparagraph></paragraph><paragraph id="H71A9EF3DB4E746ADB6847185FDE6F29A"><enum>(2)</enum><header>Information required</header><text display-inline="yes-display-inline">The United States Marshals Service’s National Sex Offender Targeting Office shall make available to
			 the Center information on travel by child-sex offenders in a timely manner
			 for purposes of carrying out the activities described in paragraph (1) and
			 subsection (e).</text>
				</paragraph></subsection><subsection id="H80D7F683BBA2474385276D19310C7D09"><enum>(e)</enum><header>Additional activity related to transmission of notice</header>
				<paragraph id="HC432D8F7BBA44B8B8BA2D7B6497A33B8"><enum>(1)</enum><header>In general</header><text>The Center may transmit notice of impending or current international travel of child-sex offenders
			 to the country or countries of destination of such child-sex offenders,
			 including to the visa-issuing agent or agents in the United States of such
			 country or countries, as follows:</text>
					<subparagraph id="H41F4194BD07F4B12810BFC67AEFCDF38"><enum>(A)</enum><text>The notice may be transmitted through such means as determined appropriate by the Center, including
			 through an ICE attaché.</text>
					</subparagraph><subparagraph commented="no" id="H4A96A1ED6DB64C06BDDF7A1B8742D3FD"><enum>(B)</enum><text>If the Center has reason to believe that transmission of the notice poses a risk to the life or
			 well-being of the child-sex offender, the Center shall make every
			 reasonable effort to issue a warning to the child-sex offender of such
			 risk.</text>
					</subparagraph></paragraph><paragraph id="H3DC9AD2169514761833129627366D514"><enum>(2)</enum><header>Sunset</header><text display-inline="yes-display-inline">The authority of paragraph (1) shall terminate with respect to a child-sex offender beginning as of
			 the close of the last day of the registration period of such child-sex
			 offender under section 115 of the Adam Walsh Child Protection and Safety
			 Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/42/16915">42 U.S.C. 16915</external-xref>).</text>
				</paragraph></subsection><subsection id="H56E960771D5341B3BCB20C5FBE63E2BC"><enum>(f)</enum><header>Complaint review</header><text>The Center shall establish a mechanism to receive complaints from child-sex offenders affected by
			 notifications of destination countries of such child-sex offenders under
			 subsection (e).</text>
			</subsection><subsection id="H61E12C4DCD574466B07379868B03E37A"><enum>(g)</enum><header>Consultations</header><text>The Center shall seek to engage in ongoing consultations with—</text>
				<paragraph id="H07155F479A8D4A4B933F478C8B04E516"><enum>(1)</enum><text>nongovernmental organizations, including faith-based organizations, that have experience and
			 expertise in identifying and preventing child sex tourism and rescuing and
			 rehabilitating minor victims of international sexual exploitation and
			 trafficking;</text>
				</paragraph><paragraph id="H92802018EA7D4813A4626382DFC351BE"><enum>(2)</enum><text>the governments of countries interested in cooperating in the creation of an international sex
			 offender travel notification system or that are primary destination or
			 source countries for international sex tourism; and</text>
				</paragraph><paragraph id="HCD3856B5DDED4AD68633255668EFC1E4"><enum>(3)</enum><text>Internet service and software providers regarding available and potential technology to facilitate
			 the implementation of an international sex offender travel notification
			 system, both in the United States and in other countries.</text>
				</paragraph></subsection><subsection id="H2E23ADDB2C5F4CD9AEBC9FFE6A554354"><enum>(h)</enum><header>Technical assistance</header><text>The Secretary of Homeland Security and the Secretary of State may provide technical assistance to
			 foreign authorities in order to enable such authorities to participate
			 more effectively in the notification program system established under this
			 section.</text>
			</subsection></section><section commented="no" id="H9E7B3DC8767F4CFCB7E7389006823049"><enum>5.</enum><header>Authority to restrict passports</header>
			<subsection id="H8B98403D3DC3494387DEA2ECDE8FABC5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of State is authorized to—</text>
				<paragraph id="H991337293AEC49389A10EAC9707CBC2F"><enum>(1)</enum><text>limit to 1 year or such period of time as the Secretary of State shall determine appropriate the
			 period of validity of a passport issued to a child-sex offender; and</text>
				</paragraph><paragraph id="HCC7DFFCF8193404BB7F6558F47934104"><enum>(2)</enum><text>revoke the passport or passport card of an individual who has been convicted by a court of
			 competent jurisdiction in a foreign country of a child-sex offense.</text>
				</paragraph></subsection><subsection id="HDB4E2ED748D84F6EB425E03CDF6E4633"><enum>(b)</enum><header>Limitation for return to united states</header><text>Notwithstanding subsection (a), in no case shall a United States citizen convicted by a court of
			 competent jurisdiction in a foreign country of a child-sex offense be
			 precluded from entering the United States due to a passport revocation
			 under such subsection.</text>
			</subsection><subsection id="H1E774E332B144595A023D1771D2F67AF"><enum>(c)</enum><header>Reapplication</header><text>An individual whose passport or passport card was revoked pursuant to subsection (a)(2) may reapply
			 for a passport or a passport card at any time after such individual has
			 returned to the United States.</text>
			</subsection><subsection commented="no" id="H52793B6C22024D25B164687B38011480"><enum>(d)</enum><header>Time limitation</header><text>The time limitation on validity or revocation of a passport or passport card under subsection (a)
			 may not exceed the applicable registration period for the child-sex
			 offender to register pursuant to section 115 of the Adam Walsh Child
			 Protection and Safety Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/42/16915">42 U.S.C. 16915</external-xref>).</text>
			</subsection></section><section commented="no" id="HE54A2250FBB04A5F818A4577BD5DB643"><enum>6.</enum><header>Sense of Congress provisions</header>
			<subsection commented="no" id="HCE653D20DD2E4CEA8DEE4209BE01FFA9"><enum>(a)</enum><header>Bilateral agreements</header><text>It is the sense of Congress that the President should negotiate memoranda of understanding or other
			 bilateral agreements with foreign governments to further the purposes of
			 this Act and the amendments made by this Act, including by—</text>
				<paragraph commented="no" id="H561C9CAFB6EF4B2BA03009BFA7038CAB"><enum>(1)</enum><text display-inline="yes-display-inline">establishing systems to receive and transmit notices as required by title I of the Adam Walsh Child
			 Protection and Safety Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/42/16901">42 U.S.C. 16901 et seq.</external-xref>); and</text>
				</paragraph><paragraph commented="no" id="HAB93CDBCD620462FB750C2BCFE1B6819"><enum>(2)</enum><text>establishing mechanisms for private companies and nongovernmental organizations to report on a
			 voluntary basis suspected child pornography or exploitation to foreign
			 governments, the nearest United States embassy in cases in which a
			 possible United States citizen may be involved, or other appropriate
			 entities.</text>
				</paragraph></subsection><subsection commented="no" id="H2D0B5E4806284BC881806F5DF762E9B6"><enum>(b)</enum><header>Notification to the United States of child-Sex offenses committed abroad</header><text>It is the sense of Congress that the President should formally request foreign governments to
			 notify the United States when a United States citizen has been arrested,
			 convicted, sentenced, or completed a prison sentence for a child-sex
			 offense in the foreign country.</text>
			</subsection></section><section id="H44C64D0353EF45A9B5B319357EE9524A"><enum>7.</enum><header>Enhancing the minimum standards for the elimination of trafficking</header><text display-inline="no-display-inline">Section 108(b)(4) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7106">22 U.S.C. 7106(b)(4)</external-xref>) is
			 amended by adding at the end before the period the following: <quote>, including cases involving nationals of that country who are suspected of engaging in severe forms
			 of trafficking of persons in another country</quote>.</text>
		</section><section id="HE63AE9EDB1C040299F37E25FE9E57A36"><enum>8.</enum><header>Assistance to foreign countries to meet minimum standards for the elimination of trafficking</header>
			<text display-inline="no-display-inline">The President is strongly encouraged to exercise the authorities of section 134 of the Foreign
			 Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2152d">22 U.S.C. 2152d</external-xref>) to provide assistance to foreign
			 countries directly, or through nongovernmental and multilateral
			 organizations, for programs, projects, and activities, including training
			 of law enforcement entities and officials, designed to establish systems
			 to identify sex offenders and provide and receive notification of child
			 sex offender international travel.</text>
		</section><section commented="no" id="HA39EA3FD0DDC4CDDA97E3BE2DD5A9FDF"><enum>9.</enum><header>Rules of construction</header>
			<subsection commented="no" id="H7048D21127EE4B0285B5A5C21F81D310"><enum>(a)</enum><header>Department of Justice</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to preclude or alter the jurisdiction or authority of the
			 Department of Justice under the Adam Walsh Child Protection and Safety Act
			 of
			 2006 (<external-xref legal-doc="usc" parsable-cite="usc/42/16901">42 U.S.C. 16901 et seq.</external-xref>) or any other provision law, or to affect
			 the work of the United States Marshals Service with INTERPOL.</text>
			</subsection><subsection commented="no" id="HFF66DDA7BA794EEB8DFF09D6D7A967BA"><enum>(b)</enum><header>Angel Watch Center</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to preclude the Angel Watch Center from transmitting notice
			 on sex offenders as defined in section 111 of the Adam Walsh Child
			 Protection and Safety Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/42/16911">42 U.S.C. 16911</external-xref>).</text>
