		<section id="HC38821CCCF5D416EADD523474671F120" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Christen O’Donnell Equestrian Helmet Safety Act of 2013</short-title></quote>.</text>
		</section><section id="HF67DF6F3B9554BE090A1617BAB99DECD"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text>
			<paragraph id="HB9D3AB53D7D84E5EB783EFF642BBDBDB"><enum>(1)</enum><text>Head injuries are the number one reason for hospital admissions of horseback riders and the leading
			 cause of death following a horseback riding injury.</text>
			</paragraph><paragraph id="H93EEC133F49E44EF812611555A240522"><enum>(2)</enum><text>Over 100 deaths per year are estimated to result from equestrian related activities, with head
			 injuries accounting for 3 of every 5 of these deaths.</text>
			</paragraph><paragraph id="H05E6FCE2F47E4C399A9F3F3D82B78271"><enum>(3)</enum><text>Nearly 68,000 people visited the emergency room in 2012 as a result of horseback riding related
			 injuries, with head injuries accounting for 22 percent and concussions
			 accounting for 7 percent of these visits.</text>
			</paragraph><paragraph id="H7019776AB47B4220BDF82442F3A265D8"><enum>(4)</enum><text>Horseback riding causes 11.7 percent of sports-related traumatic brain injuries, which is the
			 largest percentage of any recreational sport.</text>
			</paragraph><paragraph id="H8F8D588D83CC46C3B22DF68ABE3057BD"><enum>(5)</enum><text>Between 2001 and 2009, children under 19 made 3,638 emergency room visits per year for traumatic
			 brain injuries resulting from horseback riding accidents.</text>
			</paragraph><paragraph id="HFA8AF91EE77B468CAEE9377558EACD01"><enum>(6)</enum><text>Between 75 and 80 percent of head injuries occur while physically mounted on a horse—when a rider
			 would normally be wearing his or her helmet.</text>
			</paragraph><paragraph id="H417965EC453B45DDA0046744918E0D12"><enum>(7)</enum><text>Racing organizations require helmets, and as a result jockeys now sustain fewer head injuries than
			 pleasure riders.</text>
			</paragraph><paragraph id="H722399460DAC4918A4E1E0A5C77AFA50"><enum>(8)</enum><text>The U.S. Pony Clubs lowered head injury rates by 29 percent through mandatory helmet use.</text>
			</paragraph><paragraph id="HDE1572AF2B3149DC96A017020CF7631C"><enum>(9)</enum><text>Properly fitted ASTM/SEI certified helmets can reduce head injury-related deaths by 70 to 80
			 percent.</text>
			</paragraph></section><section id="H4346D9ACB2104A99A4A33D402E03917B"><enum>3.</enum><header>Standards</header>
			<subsection id="H254A558D4E40426E8B7754BDA0D507AD"><enum>(a)</enum><header>In general</header><text>Every equestrian helmet manufactured on or after the date that is 9 months after the date of
			 enactment of this Act shall meet—</text>
				<paragraph id="HF936090EB4564540A6B16D2F75B29963"><enum>(1)</enum><text>the interim standard specified in subsection (b), pending the establishment of a final standard
			 pursuant to subsection (c); and</text>
				</paragraph><paragraph id="H7DF8F01D98EC4CF8B32AE244B14BB86F"><enum>(2)</enum><text>the final standard, once that standard has been established under subsection (c).</text>
				</paragraph></subsection><subsection id="HFC2EC7215B724967A85FA5E3C208DEF6"><enum>(b)</enum><header>Interim standard</header><text>The interim standard for equestrian helmets is the American Society for Testing and Materials
			 (ASTM) standard designated as F1163.</text>
			</subsection><subsection id="H43066E3F15104A01B4E0F455B6D208D0"><enum>(c)</enum><header>Final standard</header>
				<paragraph id="H1E9F046FA3B74A53B337667980397D79"><enum>(1)</enum><header>Requirement</header><text>Not later than 60 days after the date of enactment of this Act, the Consumer Product Safety
			 Commission shall begin a proceeding under <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United
			 States Code, to—</text>
					<subparagraph id="H56F970FF63304356930F2474732CD3E9"><enum>(A)</enum><text>establish a final standard for equestrian helmets that incorporates all the requirements of the
			 interim standard specified in subsection (b);</text>
					</subparagraph><subparagraph id="H5010BD82150646EE9DE92B8FE12F600B"><enum>(B)</enum><text>provide in the final standard a mandate that all approved equestrian helmets be certified to the
			 requirements promulgated under the final standard by an organization that
			 is accredited to certify personal protection equipment in accordance with
			 ISO Guide 65; and</text>
					</subparagraph><subparagraph id="HD9222C211ED140949A1689067D4B73A5"><enum>(C)</enum><text>include in the final standard any additional provisions that the Commission considers appropriate.</text>
					</subparagraph></paragraph><paragraph id="H879FEB0F9B0740849EBA92683D25FD20"><enum>(2)</enum><header>Inapplicability of certain laws</header><text>Sections 7 and 9 of the Consumer Product Safety Act (15 U.S.C. 2056 and 2058) shall not apply to
			 the proceeding under this subsection, and section 11 of such Act (15
			 U.S.C. 2060) shall not apply with respect to any standard issued under
			 such proceeding.</text>
				</paragraph><paragraph id="H9EC3D71086054C409AF5618096BB3CFD"><enum>(3)</enum><header>Effective date</header><text>The final standard shall take effect not later than 1 year after the date it is issued.</text>
				</paragraph></subsection><subsection id="HFB5E3DDF82EF4D48940DDF2612369455"><enum>(d)</enum><header>Failure To meet standards</header>
				<paragraph id="HB893B8896D8A4DBD95CD21C2659518E0"><enum>(1)</enum><header>Failure to meet interim standard</header><text>Until the final standard takes effect, an equestrian helmet that does not meet the interim
			 standard, required under subsection (a)(1), shall be considered in
			 violation of a consumer product safety standard promulgated under the
			 Consumer Product Safety Act.</text>
				</paragraph><paragraph id="HD36AEE906A2547BCBD2F18B1CD9B19D5"><enum>(2)</enum><header>Status of final standard</header><text>The final standard developed under subsection (c) shall be considered a consumer product safety
			 standard promulgated under the Consumer Product Safety Act.</text>
				</paragraph></subsection></section><section id="H985F11110A074CB4BC37E5F4B54E24C7"><enum>4.</enum><header>Authorizations of appropriations</header>
			<text display-inline="no-display-inline">There is authorized to be appropriated to the Consumer Product Safety Commission to carry out this
			 Act, $500,000 for fiscal year 2014, which amount shall remain available
			 until expended.</text>
		</section><section id="H29D19A1C3F8340808CC34AA70C310351"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H51A14468BA474C259DD0CC978DBAE830"><enum>(1)</enum><header>Approved equestrian helmet</header><text>The term <quote>approved equestrian helmet</quote> means an equestrian helmet that meets—</text>
				<subparagraph id="H82F1A6AD7DC8429CBD37B877F8624EF5"><enum>(A)</enum><text>the interim standard specified in section 3(b), pending establishment of a final standard under
			 section 3(c); and</text>
				</subparagraph><subparagraph id="H24532FA74CFE4A0DB3996720D404F3CD"><enum>(B)</enum><text>the final standard, once it is effective under section 3(c).</text>
				</subparagraph></paragraph><paragraph id="HD66099358CE0410B9FA53A588432CA52"><enum>(2)</enum><header>Equestrian helmet</header><text>The term <quote>equestrian helmet</quote> means a hard shell head covering intended to be worn while participating in an equestrian event or
			 activity.</text>
