		<official-title>To amend the Forest Legacy Program of the Cooperative Forestry Assistance Act of 1978 to authorize
			 States to allow certain entities to acquire, hold, and manage conservation
			 easements under the program.</official-title>

		<section id="H8982684513DC4024A85491F8270888BD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Forest Legacy Management Flexibility Act</short-title></quote>.</text>
		</section><section id="H8E5E076E9A7E48518E9A905D4B73595C"><enum>2.</enum><header>Authority of States to allow qualified organizations to acquire, hold, and manage conservation
			 easements under the Forest Legacy Program</header><text display-inline="no-display-inline">Section 7(l) of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2103c">16 U.S.C. 2103c</external-xref>) is amended by
			 adding at the end the following new paragraph:</text>
			<quoted-block display-inline="no-display-inline" id="HD4178A5CD41B4D248D124DF9B1960E16" style="OLC">
				<paragraph id="H56615C29F1F744DA86233DBA08148292"><enum>(4)</enum><header>State authorization</header>
					<subparagraph id="H844C3AB57F494BBB99F6E24EEFF87659"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">At the request of a State acting through the State Lead Agency, the Secretary shall authorize the
			 State to allow qualified organizations, as defined in section 170(h)(3) of
			 the Internal Revenue Code of 1986, and organized for one or more of the
			 purposes described in section 170(h)(4)(A) of that Code, to acquire, hold,
			 and manage conservation easements, using funds granted to the State under
			 this subsection, for purposes of the Forest Legacy Program in the State.</text>
					</subparagraph><subparagraph id="H4261C801CD324F0C8758BF2E06A078F0"><enum>(B)</enum><header>Eligibility</header><text>To be eligible to acquire and manage conservation easements under this paragraph, a qualified
			 organization described in subparagraph (A) must demonstrate to the
			 Secretary the abilities necessary to acquire, monitor, and enforce
			 interests in forestland consistent with the Forest Legacy Program and the
			 assessment of need for the State.</text>
					</subparagraph><subparagraph id="HE871519DCD0E4ED68DF8D193D9D51057"><enum>(C)</enum><header>Reversion</header><text>If the Secretary, or a State acting through the State Lead Agency, makes any of the determinations
			 described in subparagraph (D) with respect to a conservation easement
			 acquired by a qualified organization under the authority of subparagraph
			 (A)—</text>
						<clause id="H5F899272DD3C4DECB935EB220964D793"><enum>(i)</enum><text>all right, title, and interest of the qualified organization in and to the conservation easement
			 shall terminate; and</text>
						</clause><clause id="HCE154B3E17524427A5D94244C06FB617"><enum>(ii)</enum><text>all right, title, and interest in and to the conservation easement shall revert to the State or
			 other qualified designee as approved by the State.</text>
						</clause></subparagraph><subparagraph id="H7DF2EBA650764077B2ED8BE2EB389031"><enum>(D)</enum><header>Determinations</header><text>The determinations required for operation of the reversionary interest retained in subparagraph (C)
			 are that—</text>
						<clause id="H8912D67BBD8248C8A73DCC22F4FC3B0A"><enum>(i)</enum><text>the qualified organization is unable to carry out its responsibilities under the Forest Legacy
			 Program in the State with respect to the conservation easement;</text>
						</clause><clause id="HBA36B605EB2F422DBF085650E3D56482"><enum>(ii)</enum><text>the conservation easement has been modified in a way that is inconsistent with the purposes of the
			 Forest Legacy Program or the assessment of need for the State; or</text>
						</clause><clause id="H3DA4BAC7CCDA4B0496A381FA04DF33F7"><enum>(iii)</enum><text>the conservation easement has been conveyed to another person (other than a qualified organization
			 approved by the State and the Secretary).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
