		<section id="HF49716708CB14B3F84F47F076176AFF6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Native American Children’s Safety Act</short-title></quote>.</text>
		</section><section id="H8723172BCB6C4DEB949B2CA6DFDD7542"><enum>2.</enum><header>Character investigations</header><text display-inline="no-display-inline">Section 408 of the Indian Child Protection and Family Violence Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3207">25 U.S.C. 3207</external-xref>) is
			 amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H0F9CB20B722A46609729D7FEE8CCEDA7" style="OLC">
				<subsection id="H7A2D24211C7546DA87ADF885D8CDAF1F"><enum>(d)</enum><header>By tribal social services agency for foster care placements in tribal court proceedings</header>
					<paragraph id="H7DE01B119D5D42BDAA826AA78967078D"><enum>(1)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text>
						<subparagraph id="H753EFE954BCB4B1990BC31E375A63382"><enum>(A)</enum><header>Covered individual</header><text>The term <term>covered individual</term> includes—</text>
							<clause id="H99A5F2B90489442BBE49919FC258CBD8"><enum>(i)</enum><text>any individual 18 years of age or older; and</text>
							</clause><clause id="H38E0EA6FF8894203A7098146619FB5E4"><enum>(ii)</enum><text>any individual who an Indian tribe described in paragraph (2)(A) determines is subject to a
			 character investigation under that paragraph.</text>
							</clause></subparagraph><subparagraph id="H1835EFABF4184633917A3986B388AC7F"><enum>(B)</enum><header>Foster care placement</header><text>The term <term>foster care placement</term> means any action removing an Indian child from a parent or Indian custodian for temporary
			 placement in a foster home or institution or the home of a guardian or
			 conservator if—</text>
							<clause id="HA8C38BA5B5A64134A23DB5CB51771ABC"><enum>(i)</enum><text>the parent or Indian custodian cannot have the child returned on demand; and</text>
							</clause><clause id="H7D1D09BEA25442A19BB2C279FCF16AAC"><enum>(ii)</enum><text>parental rights have not been terminated.</text>
							</clause></subparagraph><subparagraph id="H807E1222052240B3A616403111213ACE"><enum>(C)</enum><header>Indian custodian</header><text>The term <term>Indian custodian</term> means any Indian—</text>
							<clause id="H53F8A4CB94AE4FA0B21483CC5D06DC19"><enum>(i)</enum><text>who has legal custody of an Indian child under tribal law or custom or under State law; or</text>
							</clause><clause id="H9D5BC32A1BD044329EB4EFC008E3A10E"><enum>(ii)</enum><text>to whom temporary physical care, custody, and control has been transferred by the parent of the
			 child.</text>
							</clause></subparagraph><subparagraph id="H8C25C2FE07444692A175E0DC2CC926C5"><enum>(D)</enum><header>Parent</header><text>The term <term>parent</term> means—</text>
							<clause id="H0D2FDA517C6E48949D300D7C201C5D62"><enum>(i)</enum><text>any biological parent of an Indian child; or</text>
							</clause><clause id="H3AD0B7406960450691E7D4BB9DD4F7D5"><enum>(ii)</enum><text>any Indian who has lawfully adopted an Indian child, including adoptions under tribal law or
			 custom.</text>
							</clause></subparagraph><subparagraph id="HEE5D2AFCBD0B40239B27969D055D44DF"><enum>(E)</enum><header>Tribal court</header><text>The term <term>tribal court</term> means a court—</text>
							<clause id="H5072D9B831AA4BFDADCBECA658581B82"><enum>(i)</enum><text>with jurisdiction over foster care placements; and</text>
							</clause><clause id="HC9A369B47D3B4822B515FC9A6F633676"><enum>(ii)</enum><text>that is—</text>
								<subclause id="H031FB82A59A44DB2A3F8EFE6BBA4747D"><enum>(I)</enum><text>a Court of Indian Offenses;</text>
								</subclause><subclause id="HE231A8D3E7FB4619B19F6A6DFAB68DBF"><enum>(II)</enum><text>a court established and operated under the code or custom of an Indian tribe; or</text>
								</subclause><subclause id="H72E0F937210D4B90A7024C43976F422C"><enum>(III)</enum><text>any other administrative body of a tribe that is vested with authority over foster care placements.</text>
								</subclause></clause></subparagraph><subparagraph id="H8C62CA2261224361AD8F431DBCB00D46"><enum>(F)</enum><header>Tribal social services agency</header><text>The term <term>tribal social services agency</term> means the agency of the Federal Government or of an Indian tribe described in paragraph (2)(A)
			 that has the primary responsibility for carrying out foster care services
			 (as of the date on which the proceeding described in paragraph (2)(A)
			 commences) on the Indian reservation of the Indian tribe.</text>
						</subparagraph></paragraph><paragraph id="HD41CA22A4A3A41C88F63BF081B5CD7C3"><enum>(2)</enum><header>Character investigations before placement</header>
						<subparagraph id="HA94C8718A0D34A34A5B78B0630427C54"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (3), no foster care placement shall be ordered in any proceeding
			 over which an Indian tribe has exclusive jurisdiction until the tribal
			 social services agency—</text>
							<clause id="HF36C3CC6861845CDBDB307F501A1A273"><enum>(i)</enum><text display-inline="yes-display-inline">completes an investigation of the character of each covered individual who resides in the household
			 or is employed at the institution in which the foster care placement will
			 be made; and</text>
							</clause><clause id="H3499DBE8874544ED834872D766E7200B"><enum>(ii)</enum><text>concludes that each covered individual described in clause (i) meets such standards of character as
			 the Indian tribe shall establish in accordance with subparagraph (B).</text>
							</clause></subparagraph><subparagraph id="H94236FBA737148CABB57B652E41EC216"><enum>(B)</enum><header>Standards of character</header><text>The standards of character described in subparagraph (A)(ii) shall include—</text>
							<clause id="HD3ADC9E569C8439ABB494D230BEBD20D"><enum>(i)</enum><text>requirements that each tribal social services agency described in subparagraph (A)—</text>
								<subclause id="HA1BAC8498CE547F09B540168D21450EB"><enum>(I)</enum><text>perform criminal records checks, including fingerprint-based checks of national crime information
			 databases (as defined in <external-xref legal-doc="usc" parsable-cite="usc/28/534">section 534(f)(3)</external-xref> of title 28, United States
			 Code); and</text>
								</subclause><subclause id="HE3D69E228DA949968595283D09D4CFB3"><enum>(II)</enum><text>check any child abuse and neglect registry maintained by the State in which the covered individual
			 resides for information on the covered individual, and request any other
			 State in which the covered individual resided in the preceding 5 years, to
			 enable the tribal social services agency to check any child abuse and
			 neglect registry maintained by that State for such information; and</text>
								</subclause></clause><clause id="HA8C109000C744CEF898B22277216036F"><enum>(ii)</enum><text>any other additional requirement that the Indian tribe determines is necessary.</text>
							</clause></subparagraph><subparagraph id="H41970C363093411DB0BB243733F35882"><enum>(C)</enum><header>Results</header><text>Except as provided in paragraph (3), no foster care placement shall be ordered in any proceeding
			 described in subparagraph (A) if an investigation described in clause (i)
			 of that subparagraph reveals that a covered individual described in that
			 clause—</text>
							<clause id="H5F225D0F6850450E997E6DC3D9BCAD83"><enum>(i)</enum><text>has been found by a Federal, State, or tribal court to have committed any crime listed in clause
			 (i) or (ii) of section 471(a)(20)(A) of the Social Security Act (42 U.S.C.
			 671(a)(20)(A)); or</text>
							</clause><clause id="H7D14083F47094B5796E0F6CA4F5EA33F"><enum>(ii)</enum><text>is listed on a registry described in subparagraph (B)(i)(II).</text>
							</clause></subparagraph><subparagraph id="HB5E367B2206B4199844F5DCB53E0281A"><enum>(D)</enum><header>Deadline</header><text>Except as provided in paragraph (3), the tribal social services agency shall satisfy the
			 requirements of clauses (i) and (ii) of subparagraph (A) not later than 14
			 days after the date on which the proceeding described in subparagraph (A)
			 commences.</text>
						</subparagraph></paragraph><paragraph id="HA810F56F10204093B5586079217E643D"><enum>(3)</enum><header>Emergency placement</header><text>Paragraph (2) shall not apply to an emergency foster care placement, as determined by an Indian
			 tribe described in paragraph (2)(A).</text>
					</paragraph><paragraph id="H8E4F6170653748C8B3D7275DF8CBBA2A"><enum>(4)</enum><header>Recertification of foster homes or institutions</header>
						<subparagraph id="H16E64F80C2674B999553260ACB08725D"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this subsection, each Indian tribe shall
			 establish procedures to recertify homes or institutions in which foster
			 care placements are made.</text>
						</subparagraph><subparagraph id="H7F85BD5CE06D48D187CB93014E9E626D"><enum>(B)</enum><header>Contents</header><text>The procedures described in subparagraph (A) shall include, at a minimum, periodic intervals at
			 which the home or institution shall be subject to recertification to
			 ensure—</text>
							<clause id="HDD22EBC066CD4A889C8351F80FDEF301"><enum>(i)</enum><text>the safety of the home or institution for the Indian child; and</text>
							</clause><clause id="HD50CD00D017043FC8277F67797B0D1D4"><enum>(ii)</enum><text>that each covered individual who resides in the home or is employed at the institution is subject
			 to a character investigation in accordance with this subsection, including
			 any covered individual who—</text>
								<subclause id="H9831FBCC354E4838AE67BBBB55D7E482"><enum>(I)</enum><text>resides in the home or is employed at the institution on the date on which the procedures
			 established under subparagraph (A) commences; and</text>
								</subclause><subclause id="H543DC044002C4BDEA240396F91C6F245"><enum>(II)</enum><text>did not reside in the home or was not employed at the institution on the date on which the
			 investigation described in paragraph (2)(A)(i) was completed.</text>
								</subclause></clause></subparagraph><subparagraph id="H44CA3970939744DA92961390C9FF2CCA"><enum>(C)</enum><header>Regulations promulgated or guidance issued by the Secretary</header><text>The procedures established under subparagraph (A) shall be subject to any regulation promulgated or
			 guidance issued by the Secretary that is in accordance with the purpose of
			 this subsection.</text>
						</subparagraph></paragraph><paragraph id="HDB00DECECE2D424BBAFA8F511FF9B327"><enum>(5)</enum><header>Regulations</header><text>Not later than 180 days after the date of enactment of this subsection and after consultation with
			 Indian tribes, the Secretary shall promulgate a regulation regarding—</text>
						<subparagraph id="H33C2ED00E0D040EE9CC40C14A18C60D5"><enum>(A)</enum><text>procedures for a character investigation of any covered individual who—</text>
							<clause id="HAAEB760AE8FE4F128FB8A341F845939F"><enum>(i)</enum><text>resides in the home or is employed at the institution in which the foster care placement is made
			 after the date on which the investigation described in paragraph (2)(A)(i)
			 is completed; and</text>
							</clause><clause id="H7C26CA1AD67246DCB479E62314A940BF"><enum>(ii)</enum><text>was not the subject of an investigation described in paragraph (2)(A)(i) before the foster care
			 placement was made;</text>
							</clause></subparagraph><subparagraph id="H0DD3CDC4443B4A00BB86F66DEB739188"><enum>(B)</enum><text>self-reporting requirements for foster care homes or institutions in which any covered individual
			 described in subparagraph (A) resides if the head of the household or the
			 operator of the institution has knowledge that the covered individual—</text>
							<clause id="HADFC7DD68DC64A53BFA01105B15F36F9"><enum>(i)</enum><text>has been found by a Federal, State, or tribal court to have committed any crime listed in clause
			 (i) or (ii) of section 471(a)(20)(A) of the Social Security Act (42 U.S.C.
			 671(a)(20)(A)); or</text>
							</clause><clause id="H1933EDF2020143F180C7A51794758FC1"><enum>(ii)</enum><text>is listed on a registry described in paragraph (2)(B)(i)(II);</text>
							</clause></subparagraph><subparagraph id="HDF46E253378C4B12B4A031A24A43831B"><enum>(C)</enum><text>procedures and guidelines for emergency foster care placements under paragraph (3); and</text>
						</subparagraph><subparagraph id="H686805595F72442B868CEEEFB74385B1"><enum>(D)</enum><text>procedures for certifying compliance with this Act.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
